Republica Moldova şi Republica Turcia

Republica Moldova şi Republica Turcia, denumite în continuare ”State Contractante”, dorind să reglementeze şi să dezvolte relaţiile dintre cele două State Contractante în domeniul securităţii sociale, au convenit după cum urmează:
PARTEA I
DISPOZIŢII GENERALE
Articolul 1
Definiţii
(1) În scopul prezentului Acord, următorii termeni şi expresii desemnează:
a) teritoriu:
În ceea ce priveşte Republica Moldova, teritoriul în limitele hotarelor existente în cadrul căruia se aplică legislaţia sa,
În ceea ce priveşte Turcia, Republica Turcia;
b) legislaţie: legile, regulamentele şi alte dispoziţii legale care se referă la domeniul securităţii sociale menţionat în articolul 2;
c) autoritate competentă: ministerele responsabile de domeniul securităţii sociale menţionat în articolul 2;
d) instituţie competentă: instituţiile responsabile de aplicarea unei părţi sau a întregii legislaţii menţionate în articolul 2 şi responsabile de plata prestaţiilor;
e) persoană asigurată: persoana care este sau a fost supusă legislaţiei menţionate în articolul 2;
f) perioadă de asigurare: perioadă în care au fost achitate contribuţii de asigurări sociale sau perioade asimilate, realizate în conformitate cu legislaţia menţionată în articolul 2;
g) prestaţie: toate prestaţiile în natură şi în bani stabilite de legislaţia naţională relevantă menţionată în articolul 2;
h) domiciliu: locul de şedere permanentă;
i) reşedinţă: locul de şedere temporară;
j) urmaş: persoană definită ca persoană îndreptăţită de legislaţia Statelor Contractante;
k) organism de legătură: instituţiile desemnate de autorităţile competente pentru a asigura legătura directă în scopul implementării prezentului Acord.
(2) Ceilalţi termeni şi expresii utilizate în prezentul Acord au semnificaţia atribuită acestora în legislaţia aplicabilă a fiecărui Stat Contractant.
Articolul 2
Domeniul material de aplicare
(1) Prezentul Acord se aplică legislaţiei în domeniul securităţii sociale care reglementează:
pentru Republica Moldova:
a) indemnizaţiile pentru incapacitate temporară de muncă cauzată de afecţiuni generale sau de accidente în afara muncii;
b) indemnizaţiile pentru incapacitate temporară de muncă cauzată de boli profesionale sau accidente de muncă;
c) indemnizaţiile de maternitate;
d) pensiile pentru limită de vârstă;
e) pensiile de dizabilitate cauzată de afecţiuni generale;
f) pensiile şi indemnizaţiile de dizabilitate cauzată de accidente de muncă şi boli profesionale;
g) pensiile de urmaş;
h) ajutoarele de deces;
i) ajutoarele de şomaj.
În ceea ce priveşte Republica Moldova, prestaţiile în caz de boală, maternitate şi şomaj se acordă în conformitate cu legislaţia pe care instituţiile competente o aplică.
pentru Republica Turcia:
a) asigurările în caz de invaliditate, limită de vârstă, de urmaş, asigurările pe termen scurt, asigurările generale de sănătate şi asigurările în caz de şomaj pentru persoanele angajate în baza unui contract de muncă de către unul sau mai mulţi angajatori;
b) asigurările în caz de invaliditate, limită de vârstă, de urmaş, asigurările pe termen scurt şi asigurările generale de sănătate pentru lucrătorii independenţi care lucrează din nume şi pe cont propriu fără un contract de muncă;
c) asigurările în caz de invaliditate, limită de vârstă, de urmaş pentru persoanele care lucrează în administraţiile publice.
În ceea ce priveşte Turcia, asigurările generale de sănătate, asigurările în caz de boală şi maternitate şi asigurările în caz de şomaj se aplică doar pe perioada de timp în care persoana asigurată domiciliază în bază legală în Turcia şi este supusă legislaţiei turce în domeniul securităţii sociale.
(2) Prezentul Acord se aplică, de asemenea, oricărei legislaţii care modifică, revizuieşte, înlocuieşte sau completează legislaţia menţionată în alineatul (1) al prezentului articol.
(3) Prezentul Acord nu se aplică legislaţiei care instituie un nou sistem de securitate socială, cu excepţia cazului în care autorităţile competente ale Statelor Contractante convin altfel.
Articolul 3
Domeniul personal de aplicare
Prezentul Acord se aplică:
a) persoanelor care sunt sau au fost supuse legislaţiei unuia sau ambelor State Contractante;
b) persoanelor ale căror drepturi derivă de la drepturile persoanelor menţionate în punctul a) al prezentului articol, în conformitate cu legislaţia aplicabilă.
Articolul 4
Egalitate de tratament
Dacă prezentul Acord nu prevede altfel, persoanele care domiciliază pe teritoriul unui Stat Contractant şi cărora li se aplică dispoziţiile prezentului Acord, au aceleaşi drepturi şi obligaţii prevăzute de legislaţia Statului Contractant pe teritoriul căruia ei domiciliază, ca şi cetăţenii acelui Stat Contractant.
Articolul 5
Exportul prestaţiilor
(1) Dacă prezentul Acord nu dispune altfel, prestaţiile acordate în baza legislaţiei Statului Contractant responsabil pentru plată vor fi plătite în acelaşi cuantum persoanelor menţionate în articolul 3 al prezentului Acord, chiar şi atunci când aceştia domiciliază pe teritoriul celuilalt Stat Contractant. În cazul în care persoanele domiciliază pe teritoriul unui Stat terţ, prestaţiile vor fi plătite în conformitate cu legislaţia Statului Contractant responsabil pentru plată.
(2) Totuşi, alineatul (1) al prezentului articol nu se aplică în cazul asigurărilor generale de sănătate, asigurărilor în caz de boală şi maternitate şi asigurărilor în caz de şomaj.
Articolul 6
Micşorarea, suspendarea şi anularea prestaţiilor
(1) În cazul suprapunerii unei prestaţii cu oricare altă prestaţie de securitate socială sau cu un venit obţinut în urma unei activităţi profesionale, dispoziţiile referitoare la micşorarea, suspendarea şi anularea prestaţiilor în conformitate cu legislaţia unui Stat Contractant se aplică în acelaşi mod şi atunci când dreptul la prestaţii de securitate socială în conformitate cu legislaţia celuilalt Stat Contractant este dobândit sau atunci când venitul obţinut din activitatea profesională este realizat pe teritoriul celuilalt Stat Contractant.
(2) Dispoziţiile alineatului (1) al prezentului articol nu se aplică în cazul cumulului prestaţiilor de acelaşi tip calculate proporţional cu perioadele realizate în ambele State Contractante.
PARTEA a II-a
DISPOZIŢII PRIVIND LEGISLAŢIA APLICABILĂ
Articolul 7
Prevederi generale
Dacă prezentul Acord nu prevede altfel,
(1) Persoanele angajate pe teritoriul unui Stat Contractant sau lucrătorii independenţi care desfăşoară o activitate pe teritoriul unui Stat Contractant, în ceea ce priveşte activitatea de muncă, se vor supune legislaţiei Statului Contractant unde îşi desfăşoară activitatea, chiar dacă domiciliază pe teritoriul celuilalt Stat Contractant sau dacă angajatorul lor sau sediul înregistrat al angajatorului este situat pe teritoriul celuilalt Stat Contractant.
(2) Funcţionarii publici şi persoanele asimilate acestora al unui Stat Contractant se vor supune legislaţiei Statului Contractant în a cărei administraţie sunt angajaţi.
(3) O persoană care este angajată de către o filială sau o reprezentanţă permanentă a unei întreprinderi pe teritoriul unui Stat Contractant, altul decât Statul Contractant în care este înregistrat sediul său, se vor supune legislaţiei Statului Contractant pe teritoriul căruia este situată această filială sau reprezentanţă permanentă.
Articolul 8
Detaşare
(1) Dacă o persoană angajată pe teritoriul unui Stat Contractant este detaşată de către angajatorul său pentru a desfăşura o anumită activitate pe teritoriul celuilalt Stat Contractant, aceasta se va supune în continuare legislaţiei primului Stat Contractant pentru o perioadă ce nu va depăşi 24 de luni, cu condiţia că îşi va păstra statutul de angajat la acelaşi angajator.
(2) Dacă lucrătorul independent care desfăşoară o activitate pe teritoriul unui Stat Contractant se deplasează pe teritoriul celuilalt Stat Contractant pentru a-şi exercita temporar activitatea, se va supune în continuare legislaţiei primului Stat Contractant pentru o perioadă ce nu va depăşi 24 de luni.
(3) Perioada menţionată în alineatele (1) şi (2) ale prezentului articol poate fi extinsă pentru o perioadă suplimentară ce nu depăşeşte 36 de luni doar cu acordul prealabil al autorităţilor competente sau instituţiilor competente desemnate de către autorităţile competente ale ambelor State Contractante.
Articolul 9
Personalul întreprinderilor de transport internaţional
(1) O persoană angajată la bordul unei nave care navighează sub pavilionul unui Stat Contractant se supune legislaţiei acestui Stat Contractant.
(2) Dacă o persoană care este angajată într-un port sau în apele teritoriale ale unui Stat Contractant, dar care nu este membru al echipajului navei, este angajată în lucrări de încărcare, descărcare şi reparare a unei nave aeriene sub pavilionul celuilalt Stat Contractant sau supraveghează aceste lucrări, aceasta se va supune legislaţiei Statului Contractant căruia îi aparţine portul sau apele teritoriale.
(3) O persoană care este membru al personalului întreprinderii transportului rutier sau aerian şi care, fiind angajată sau desfăşurând o activitate pe cont propriu, efectuează servicii de transport internaţional de pasageri sau mărfuri pe căile rutiere, ferate sau aeriene, sediul înregistrat al căruia este situat pe teritoriul unui Stat Contractant, se va supune legislaţiei Statului Contractant pe teritoriul căruia este situat sediul înregistrat al întreprinderii.
Articolul 10
Misiuni diplomatice şi oficii consulare
(1) Funcţionarii misiunilor diplomatice şi oficiilor consulare ai unui Stat Contractant, precum şi persoanele aflate în serviciul particular al funcţionarilor, detaşate de către Statul Contractant căruia îi aparţine misiunea diplomatică sau oficiul consular, se vor supune legislaţiei Statului Contractant care detaşează.
(2) Alţi membri ai misiunilor diplomatice şi oficiilor consulare şi personalul de serviciu menţionat în alineatul (1) al prezentului articol se vor supune legislaţiei Statului Contractant în care sunt detaşaţi, dacă aceştia sunt angajaţi local. Ei pot opta pentru aplicarea legislaţiei Statului Contractant angajator în termen de trei luni de la data angajării sale, cu condiţia că sunt cetăţenii acestui Stat.
Articolul 11
Excepţii
Autorităţile competente ale Statelor Contractante pot conveni asupra excepţiilor de la dispoziţiile articolelor 7-10 ale prezentului Acord, cu privire la legislaţia aplicabilă unei persoane sau unor categorii de persoane.
PARTEA a III-a
DISPOZIŢII SPECIALE
SECŢIUNEA I
PRESTAŢII PENTRU LIMITĂ DE VÂRSTĂ, INVALIDITATE ŞI DE URMAŞ
Articolul 12
Totalizarea perioadelor de asigurare
(1) Dacă legislaţia unui Stat Contractant condiţionează dreptul la prestaţii de realizarea unor perioade de asigurare, instituţia competentă care aplică această legislaţie va lua în considerare, dacă este necesar, perioadele de asigurare realizate conform legislaţiei celuilalt Stat Contractant, în măsura în care acestea nu se suprapun, ca şi cum ar fi perioade de asigurare realizate conform legislaţiei proprii.
(2) Dacă persoana nu întruneşte condiţiile pentru a beneficia de o prestaţie în baza dispoziţiilor alineatului (1) al prezentului articol, instituţia competentă va totaliza, de asemenea, perioadele de asigurare realizate în baza legislaţiei statelor terţe cu care Statul Contractant are încheiat un Acord în domeniul securităţii sociale, în măsura în care aceste perioade nu se suprapun.
(3) Dacă dreptul de a beneficia de prestaţii în baza legislaţiei unui Stat Contractant este condiţionat de realizarea unei anumite perioade într-o profesie supusă unui regim special sau într-o profesie sau muncă determinată, doar perioadele realizate în baza unui regim similar sau, în lipsa acestuia, în aceeaşi profesie sau, după caz, în aceeaşi muncă, vor fi luate în considerare pentru stabilirea dreptului la aceste prestaţii în baza legislaţiei celuilalt Stat Contractant.
(4) Dacă legislaţia unui Stat Contractant prevede că perioada de plată a unei pensii poate fi luată în considerare pentru dobândirea dreptului la prestaţii, instituţia competentă a acestui Stat Contractant va lua în considerare, în acest scop, orice perioadă în care pensia a fost plătită conform legislaţiei celuilalt Stat Contractant.
(5) În scopul calculării perioadelor de asigurare se aplică legislaţia relevantă a fiecărui Stat Contractant.
Articolul 13
Perioadele de asigurare mai mici de un an
(1) Dacă perioada totală de asigurare realizată conform legislaţiei unui Stat Contractant este mai mică de 12 luni, prestaţia nu se va acorda, cu excepţia cazului când, conform acestei legislaţii, există dreptul la o prestaţie ţinând cont doar de această perioadă de asigurare.
(2) În conformitate cu dispoziţiile alineatului (1) al prezentului articol, instituţia competentă a celuilalt Stat Contractant va lua în considerare aceste perioade ca şi cum acestea ar fi fost realizate în conformitate cu legislaţia pe care o aplică, pentru dreptul la menţinerea şi restabilirea dreptului la prestaţii, precum şi determinarea cuantumului actual.
Articolul 14
Calcularea prestaţiilor
(1) Dacă dreptul la prestaţii poate fi acordat în conformitate cu legislaţia unui Stat Contractant fără a ţine cont de dispoziţiile articolului 12 al prezentului Acord, instituţia acestui Stat Contractant va calcula cuantumul prestaţiilor care urmează a fi acordate doar în baza perioadelor de realizate în conformitate cu legislaţia pe care o aplică.
(2) Dacă persoana vizată dobândeşte dreptul la prestaţii în conformitate cu legislaţia unui Stat Contractant doar prin implementarea articolului 12 al prezentului Acord, instituţia acestui Stat Contractant va calcula prestaţiile după cum urmează:
a) instituţia competentă va calcula cuantumul teoretic luând în considerare toate perioadele de asigurare realizate în conformitate cu legislaţia ambelor State Contractante, ca şi cum acestea ar fi fost realizate doar în conformitate cu legislaţia pe care această instituţie o aplică;
b) în baza cuantumului calculat menţionat mai sus, cuantumul real al prestaţiei se va calcula ca raport între perioadele de asigurare realizate exclusiv în conformitate cu legislaţia proprie şi totalul perioadelor de asigurare luate în considerare la calcularea prestaţiei.
(3) Dacă prestaţiile în conformitate cu legislaţia unui Stat Contractant sunt calculate în baza veniturilor sau contribuţiilor plătite conform legislaţiei acestui Stat Contractant, instituţia competentă va lua în considerare veniturile şi contribuţiile plătite exclusiv în baza legislaţiei pe care o aplică.
(4) Dacă cuantumul prestaţiilor depinde de numărul persoanelor din familie în conformitate cu legislaţia unui Stat Contractant, instituţia competentă ia în considerare şi persoanele din familie care domiciliază pe teritoriul celuilalt Stat Contractant.
SECŢIUNEA a II-a
AJUTOR DE DECES
Articolul 15
Totalizarea perioadelor de asigurare şi acordarea ajutorului de deces
(1) Dacă dreptul la ajutorul de deces conform legislaţiei unui Stat Contractant este condiţionat de realizarea unei perioade de asigurare, instituţia competentă a acestui Stat Contractant va lua în considerare, dacă este necesar, perioadele de asigurare realizate conform legislaţiei celuilalt Stat Contractant, în măsura în care acestea nu se suprapun, ca şi cum ar fi perioade de asigurare realizate în baza legislaţiei proprii.
(2) Dacă o persoană care este asigurată în baza legislaţiei unui Stat Contractant decedează pe teritoriul celuilalt Stat Contractant, se consideră ca şi cum aceasta ar fi decedat pe teritoriul Statului Contractant în care a fost asigurată şi urmaşii vor fi îndreptăţiţi la un ajutor de deces.
(3) Dacă dreptul la o prestaţie în caz de deces există conform legislaţiei ambelor State Contractante, se va aplica doar legislaţia acelui Stat Contractant pe teritoriul căruia decedatul a domiciliat.
(4) Dacă decesul a survenit pe teritoriul unui Stat terţ, prestaţia va fi plătită în conformitate cu legislaţia Statului Contractant în care persoana a fost asigurată ultima dată înaintea survenirii decesului.
SECŢIUNEA a III-a
PRESTAŢII ÎN CAZ DE ACCIDENTE DE MUNCĂ ŞI BOLI PROFESIONALE
Articolul 16
Prestaţii în caz de accidente de muncă şi boli profesionale acordate unei
persoane care a fost expusă aceloraşi riscuri în fiecare Stat Contractant
(1) Dreptul la prestaţii în caz de accidente de muncă şi boli profesionale se determină în conformitate cu legislaţia aplicabilă la data producerii accidentului sau la momentul desfăşurării activităţii care a cauzat boala profesională.
(2) Dacă legislaţia unui Stat Contractant condiţionează dreptul la prestaţie de o primă diagnosticare a bolii pe teritoriul său, această condiţie se consideră îndeplinită chiar dacă diagnosticarea s-a realizat pe teritoriul celuilalt Stat Contractant.
(3) Dacă legislaţia unui Stat Contractant condiţionează, explicit sau implicit, dreptul la prestaţii de diagnosticarea bolii într-un anumit termen de la încetarea activităţii susceptibile a fi cauza acesteia, instituţia competentă ia, de asemenea, în considerare, dacă este necesar, orice altă activitate care implică riscuri similare, desfăşurată în baza legislaţiei celuilalt Stat Contractant.
(4) Dacă legislaţia unui Stat Contractant condiţionează, explicit sau implicit, dreptul la prestaţii în caz de boli profesionale de exercitarea pe o perioadă de timp determinată a unei activităţi susceptibile a fi cauza bolii în cauză, pentru calculul prestaţiilor sunt luate în considerare şi perioadele în care a fost desfăşurată o astfel de activitate pe teritoriul celuilalt Stat Contractant.
Articolul 17
Acordarea unei prestaţii în caz de agravare a bolii profesionale
Dacă persoana a beneficiat sau beneficiază de o prestaţie din partea instituţiei competente a unui Stat Contractant din cauza unei boli profesionale şi, în caz de agravare a bolii, solicită drepturile la prestaţie de la instituţia competentă a celuilalt Stat, se aplică următoarele dispoziţii:
a) dacă persoana vizată nu a exercitat în baza legislaţiei celuilalt Stat Contractant o activitate susceptibilă să provoace sau să agraveze boala în cauză, instituţia competentă a primului Stat Contractant va suporta plata pentru prestaţie, ţinând cont de agravare, în conformitate cu legislaţia pe care o aplică;
b) dacă persoana vizată a exercitat o astfel de activitate în baza legislaţiei celuilalt Stat Contractant, instituţia competentă a primului Stat Contractant va suporta plata pentru prestaţie, fără a ţine cont de agravare, conform dispoziţiilor legislaţiei pe care o aplică; instituţia competentă a celui de-al doilea Stat Contractant acordă persoanei vizate un supliment al cărui cuantum este egal cu diferenţa dintre cuantumul prestaţiei datorate după agravare şi cuantumul prestaţiei care ar fi fost datorată înainte de agravare, în conformitate cu dispoziţiile legislaţiei care s-a aplicat.
SECŢIUNEA a IV-a
ŞOMAJ
Articolul 18
Prestaţii în caz de şomaj
Dreptul la prestaţie, cuantumul, durata şi modalitatea de plată a prestaţiilor vor fi determinate în conformitate cu legislaţia pe care instituţia competentă o aplică.
PARTEA a IV-a
DISPOZIŢII DIVERSE
Articolul 19
Măsuri administrative şi metode de cooperare
(1) Autorităţile competente ale Statelor Contractante vor conveni aranjamentele administrative necesare pentru implementarea prezentului Acord.
(2) Autorităţile competente ale Statelor Contractante vor desemna organismele de legătură în scopul facilitării implementării prezentului Acord.
(3) Autorităţile competente ale Statelor Contractante îşi vor comunica reciproc, în cel mai scurt timp posibil, informaţia necesară asupra măsurilor luate pentru implementarea prezentului Acord şi se vor informa asupra oricăror modificări aduse legislaţiei sale naţionale, în măsura în care acestea pot afecta implementarea prezentului Acord.
(4) Autorităţile şi instituţiile competente ale Statelor Contractante îşi vor acorda asistenţă reciprocă în orice întrebări legate de implementarea prezentului Acord, ca şi cum acestea afectează aplicarea legislaţiei lor proprii. Această asistenţă administrativă este gratuită.
(5) Expertiza medicală efectuată exclusiv pentru aplicarea legislaţiei unui Stat Contractant şi care se referă la persoanele care domiciliază sau reşedinţa cărora se află pe teritoriul celuilalt Stat Contractant, va fi efectuată la solicitare şi pe cheltuiala instituţiei competente, de către instituţia de la locul de domiciliu sau reşedinţă a sa. Expertiza medicală ce ţine de aplicarea legislaţiei ambelor State Contractante va fi efectuată pe cheltuiala instituţiei competente a Statului Contractant în care persoana domiciliază sau pe teritoriul căruia îşi are reşedinţa.
Articolul 20
Protecţia datelor cu caracter personal
(1) Orice date cu caracter personal care sunt expediate de către un Stat Contractant sunt prelucrate numai în scopul implementării prezentului Acord. Prelucrarea datelor cu caracter personal se efectuează în conformitate cu Convenţia de la Strasbourg pentru protecţia persoanelor referitor la prelucrarea automatizată a datelor cu caracter personal din 28 ianuarie 1981 şi cu legislaţia naţională a Statelor Contractante care reglementează protecţia datelor cu caracter personal.
(2) Datele cu caracter personal transmise trebuie să fie exacte şi în volumul necesar pentru realizarea unui scop sau a unei sarcini determinate, luând în considerare dispoziţiile prezentului Acord. În caz de necesitate, datele inexacte sau incomplete vor fi rectificate, completate, distruse sau prelucrarea acestora va fi stopată.
(3) După realizarea scopului pentru care au fost transmise, datele vor fi distruse. Statul care a transmis datele va fi informat despre distrugerea datelor şi motivul pentru care au fost distruse.
(4) Autorităţile şi instituţiile competente ale Statelor Contractante întreprind măsuri adecvate de securitate tehnică şi de organizare, în vederea împiedicării distrugerii, modificării, pierderii incidentale sau nesancţionate a datelor cu caracter personal, precum şi pentru prevenirea prelucrării nesancţionate a acestora.
(5) Persoana vizată este în drept să solicite informaţia privind datele sale cu caracter personal existente, scopul cu care acestea sunt sau au fost prelucrate. Dreptul persoanei vizate la acest tip de informaţie este reglementat de legislaţia cu privire la protecţia datelor a Statului Contractant de la care această informaţie se solicită. Acordarea acestui tip de informaţie poate fi refuzată în scopul implementării prezentului Acord, asigurării securităţii statului, a ordinii publice, prevenirii acţiunilor criminale şi protecţiei drepturilor şi libertăţilor fundamentale ale persoanelor terţe.
Articolul 21
Scutirea de taxe şi de autentificare
(1) Scutirea sau reducerea de taxe sau impozite pentru fişierele scrise şi documentele anexate în scopul aplicării legislaţiei unui Stat Contractant se va aplica, de asemenea, pentru orice declaraţie sau alt document care este depus în conformitate cu legislaţia celuilalt Stat Contractant sau pentru implementarea prezentului Acord.
(2) Orice declaraţie de identitate, document sau declaraţie depusă în scopul implementării prezentului Acord se scuteşte de autentificare.
Articolul 22
Depunerea unui cereri
(1) O cerere pentru prestaţie depusă în conformitate cu legislaţia unui Stat Contractant în scopul prezentului Acord se consideră ca fiind depusă în conformitate cu legislaţia celuilalt Stat Contractant.
(2) În cazul în care depunerea unei cereri este condiţionată de legislaţia unui Stat Contractant de depunerea acesteia într-un anumit termen, această condiţie se consideră îndeplinită, dacă cererea se depune la instituţia competentă a celuilalt Stat Contractant în acelaşi termen. În acest caz, instituţia competentă a Statului Contractant va transmite, fără întârziere, cererea instituţiei competente a primului Stat Contractant, fie direct, fie prin intermediul organismelor de legătură ale celor două State Contractante.
Articolul 23
Plăţi
(1) Plata oricărei prestaţii în conformitate cu prezentul Acord se efectuează în valuta Statului Contractant care efectuează plata, în Dolari SUA sau în Euro.
(2) Modalităţile de rambursare dintre instituţiile competente sunt convenite prin Aranjamentul Administrativ.
Articolul 24
Recuperarea plăţilor necuvenite
În cazul în care instituţia unui Stat Contractant a plătit unui beneficiar prestaţii în cuantumul care depăşeşte suma la care acesta era îndreptăţit, această instituţie va solicita de la instituţia celuilalt Stat Contractant care datorează prestaţii acestui beneficiar, în condiţiile stabilite de legislaţia pe care o aplică, reţinerea sumei plătite în exces şi necuvenit beneficiarului din sumele datorate. Această instituţie reţine suma în condiţiile în care asemenea deducere se permite de către legislaţia pe care o aplică, ca şi cum aceste sume ar fi fost plătite în exces şi necuvenit de către însăşi instituţia care efectuează transferul sumelor astfel deduse celeilalte instituţii competente.
Articolul 25
Soluţionarea disputelor
Autorităţile competente ale celor două State Contractante vor soluţiona orice dispută privind interpretarea sau implementarea prezentului Acord prin intermediul consultărilor directe.
PARTEA a V-a
DISPOZIŢII TRANZITORII ŞI FINALE
Articolul 26
Dispoziţii tranzitorii
(1) Prezentul Acord nu conferă nici un drept pentru orice perioadă anterioară intrării sale în vigoare.
(2) Toate perioadele de asigurare realizate în baza legislaţiei unui Stat Contractant înainte de intrarea în vigoare a prezentului Acord sunt luate în considerare pentru stabilirea drepturilor care rezultă din prezentul Acord.
(3) Orice prestaţie datorată doar pe baza prezentului Acord, inclusiv drepturile acordate anterior, va fi plătită la cererea persoanei vizate şi în conformitate cu dispoziţiile prezentului Acord, având efect de la intrarea în vigoare a prezentului Acord, cu excepţia plăţilor unice efectuate.
(4) Dacă cererea menţionată în alineatul (3) al prezentului articol se depune în termen de doi ani de la intrarea în vigoare a prezentului Acord, drepturile ce rezultă în conformitate cu dispoziţiile prezentului Acord vor fi dobândite din această dată şi acele dispoziţii ale legislaţiei unui Stat Contractant care se referă la pierderea sau stingerea drepturilor după expirarea termenului nu vor fi aplicabile persoanei vizate. Data depunerii cererii va fi luată în considerare pentru cererea depusă într-un termen mai mare de doi ani.
Articolul 27
Revizuirea dreptului la pensie
(1) Dreptul de a beneficia de pensie dobândit anterior intrării în vigoare a prezentului Acord poate fi revizuit, la cerere, în conformitate cu dispoziţiile prezentului Acord.
(2) Drepturile dobândite după revizuire se vor realiza din data depunerii cererii.
(3) Dacă revizuirea drepturilor la pensie va conduce la micşorarea cuantumului pensiei, se va plăti în continuare cuantumul pensiei stabilit anterior revizuirii.
Articolul 28
Ratificarea şi intrarea în vigoare
Prezentul Acord, fiind supus ratificării în conformitate cu legislaţia naţională a celor două State Contractante, va intra în vigoare în prima zi a celei de-a doua luni care urmează data recepţionării ultimei notificări scrise prin care Statele Contractante îşi notifică reciproc, prin canale diplomatice, despre îndeplinirea procedurilor legale interne, necesare pentru intrarea sa în vigoare.
Articolul 29
Modificarea Acordului
Prezentul Acord poate fi modificat în orice timp, la convenirea reciprocă în scris a celor două State Contractante. Modificările vor intra în vigoare în conformitate cu procedurile stabilite în articolul 28 al prezentului Acord.
Articolul 30
Durata Acordului
(1) Prezentul Acord se încheie pentru o perioadă nedeterminată.
(2) Fiecare Stat Contractant poate să-l denunţe, expediind, prin canale diplomatice, o notificare scrisă celuilalt Stat Contractant cu cel puţin şase luni înainte de sfârşitul anului calendaristic în curs.
Articolul 31
Menţinerea drepturilor dobândite
(1) În cazul denunţării prezentului Acord, toate drepturile dobândite în conformitate cu prezentul Acord vor fi menţinute.
(2) În cazul denunţării prezentului Acord, procesarea tuturor cererilor legată de drepturile la prestaţii care nu au fost încă stabilite va fi finalizată în conformitate cu dispoziţiile prezentului Acord.
DREPT CONFIRMARE, subsemnaţii, având deplinele puteri, au semnat prezentul Acord.
Întocmit la Chişinău la 5 mai 2017, în două exemplare originale în limbile română, turcă şi engleză, toate textele fiind egal autentice. În caz de divergenţe de interpretare, textul în limba engleză va prevala.

AGREEMENT ON SOCIAL SECURITY
BETWEEN THE REPUBLIC OF MOLDOVA
AND THE REPUBLIC OF TURKEY
The Republic of Moldova and the Republic of Turkey hereinafter referred to as “Contracting States”, being desirous of regulating and developing the relations between the two Contracting States in the field of social security, agreed as follows:
PART I
GENERAL PROVISIONS
Article 1
Definitions
(1) For the purpose of this Agreement, the following terms and expressions shall mean:
a) territory:
In relation to the Republic of Moldova, the territory within the existing boundaries where its legislation applies,
In relation to Turkey, the Republic of Turkey;
b) legislation: the laws, regulations and other legal provisions related to social security field, specified in Article 2;
c) competent authority: the ministries responsible for social security field specified in Article 2;
d) competent institution: institutions responsible for the application of part or all of the legislation specified in Article 2 and responsible for the payment of the benefits;
e) insured person: the person who is or has been subject to the legislation mentioned in Article 2;
f) period of insurance: the period over which insurance contributions have been paid or are considered as contributed periods under the legislation specified in Article 2;
g) benefit: all benefits in kind and cash benefits provided by relevant national legislation specified in Article 2;
h) residence: a place of permanent residence;
i) stay: a place of temporary stay;
j) survivor: person defined as entitled person by the legislation of the Contracting States;
k) liaison body: the institutions designated by the competent authorities to provide directly liaison in the view of implementing this Agreement.
(2) All other terms and expressions used in this Agreement have the meaning assigned to them in the applicable legislation of either Contracting State.
Article 2
Material scope
(1) This Agreement shall apply to the legislation on social security regulating:
for the Republic of Moldova:
a) benefits for temporary incapacity for work determined by general diseases or accidents outside of work place;
b) benefits for temporary incapacity for work determined by occupational diseases or work accidents;
c) benefits for maternity;
d) old age pensions;
e) disability pensions determined by general diseases;
f) disability pensions and indemnities determined by work accidents and occupational diseases;
g) survivors′ pensions;
h) death grants;
i) unemployment benefits.
In relation to the Republic of Moldova the benefits in case of sickness, maternity and unemployment shall be provided according to the legislation that competent institutions apply.
for the Republic of Turkey:
a) Invalidity, old age, survivors′ insurances, short term insurance branches, general health insurance and unemployment insurance in respect of persons employed under a contract of employment by one or more employer;
b) Invalidity, old age, survivors′ insurances, short term insurance branches and general health insurance in respect of self-employed persons working on their own name and account without a contract of employment;
c) Invalidity, old age, survivors′ insurances in respect of persons working in public administrations.
In relation to Turkey, general health insurance, sickness and maternity insurances and unemployment insurances shall be only applied as long as the insured person legally resides in Turkey and she/he is subject to Turkish Social Security legislation.
(2) This Agreement shall also be applied to any legislation which amends, revises, replaces or supplements the legislation specified in paragraph (1) of this Article.
(3) This Agreement shall not be applied to the legislation introducing a new social security scheme, unless the competent authorities of both Contracting States agree upon otherwise.
Article 3
Personal scope
This Agreement shall be applied with respect to:
a) persons who are or have been subject to the legislation of either or both Contracting States;
b) persons, whose rights derive from the rights of persons, stipulated in point a) of this Article, according to the applicable legislation.
Article 4
Equal treatment
Unless otherwise provided in this Agreement, the persons who are resident on the territory of either Contracting State and to whom the provisions of this Agreement apply, shall have the same rights and obligations provided by the legislation of the Contracting State the territory of which they reside, on the same grounds as the nationals of that Contracting State.
Article 5
Export of benefits
(1) Unless otherwise provided in this Agreement, benefits awarded under the legislation of the Contracting State which is responsible for payment shall be paid at the same rate to persons within the scope of Article 3 of this Agreement even when they are resident on the territory of the other Contracting State. In case these persons are resident on the territory of a third State, benefits shall be paid in accordance with the legislation of the Contracting State which is responsible for payment.
(2) However, the paragraph (1) of this Article shall not be applied in case of general health insurance, sickness and maternity insurances and unemployment insurance.
Article 6
Reduction, suspension and cancellation of benefits
(1) Where an entitled benefit coincides with any other social security benefit or with an income yielding occupational activity, provisions regarding the reduction, suspension and cancellation of benefits according to the legislation of either Contracting State, shall also be applied in the same way when right to social security benefits under the legislation of the other Contracting State is acquired or when an income yielding occupational activity is carried out on the territory of the other Contracting State.
(2) The provision specified in paragraph (1) of this Article shall not be applied in case of aggregation of the same kind of benefits calculated proportionally according to period completed in both Contracting States.
PART II
PROVISIONS ON APPLICABLE LEGISLATION
Article 7
General provisions
Unless otherwise provided in this Agreement,
(1) Persons employed on the territory of either Contracting State or self-employed persons who perform their occupation on the territory of either Contracting State shall, with respect to that employment, be subject to the legislation of the Contracting State where they work even if they reside on the territory of the other Contracting State or if their employer or the registered office of their employer is located on the territory of the other Contracting State.
(2) Civil servants and persons treated as such of either Contracting State shall be subject to the legislation of the Contracting State in the administration of which they are employed.
(3) A person who is employed by a branch or permanent representation of an undertaking on the territory of a Contracting State other than the Contracting State in which it has its registered office shall be subject to the legislation of the Contracting State where such branch or permanent representation is located.
Article 8
Posting
(1) Where a person employed on the territory of either Contracting State is posted by her/his employer to perform certain work on the territory of the other Contracting State she/he shall continue to be subject to the legislation of the first Contracting State for a period not exceeding 24 months provided that she/he maintains the employee status of the same employer.
(2) Where a self-employed person who performs an occupation on the territory of either Contracting State moves to the territory of the other Contracting State to carry out her/his occupation temporarily, she/he shall continue to be subject to the legislation of the first Contracting State, for a period not exceeding 24 months.
(3) The period referred in paragraphs (1) and (2) of this Article may be extended for an additional period not exceeding 36 months upon prior approval of the competent authorities or the competent institutions designated by the competent authorities of both Contracting States.
Article 9
Personnel of international transport undertakings
(1) A person who is employed on board a vessel flying the flag of either Contracting State shall be subject to the legislation of that Contracting State.
(2) If a person, who is employed in a port or the territorial waters of a Contracting State but who is not a member of the crew on a vessel, is engaged in loading, unloading and repairing a vessel flying the flag of the other Contracting State or supervises such activities, he shall be subject to the legislation of the Contracting State of the port or territorial waters.
(3) A person who is a member of the traveling or flying personnel of an undertaking which, hired or on its own account, operates international transport services for passengers or goods by road, rail or air and has its registered office on the territory of any Contracting State shall be subject to the legislation of the Contracting State where the registered office of the undertaking is situated.
Article 10
Diplomatic missions and consular posts
(1) Officials of diplomatic missions or consular posts of either Contracting State as well as those posted by the Contracting State which the diplomatic mission or consular post belongs to, to work in the private service of officials shall be subject to the legislation of the posting Contracting State.
(2) The other members of the diplomatic missions or consular posts and the service personnel referred to in paragraph (1) of this Article shall be subject to the legislation of the receiving Contracting State if they are engaged locally. They may opt for the application of the legislation of the employing Contracting State within three months following the date of their engagement provided that they are nationals of that State.
Article 11
Exceptions
The competent authorities of the Contracting States may agree on exceptions to Articles 7 to 10 of this Agreement, regarding the legislation applicable to a person or category of persons.
PART III
SPECIAL PROVISIONS
SECTIΟΝ I
OLD AGE, INVALIDITY AND SURVIVORS′ BENEFITS
Article 12
Aggregation of periods of insurance
(1) Where the legislation of either Contracting State makes entitlement to benefits conditional upon the completion of periods of insurance, the competent institution which applies that legislation shall, where necessary, take into account periods of insurance completed under the legislation of the other Contracting State, as far as they do not overlap, as if they were periods of insurance completed under its legislation.
(2) Where a person does not qualify for a benefit in pursuance of the provisions of paragraph (1) of this Article, the competent institution shall also aggregate the insurance periods completed under the legislation of third states with which the Contracting State concluded an Agreement on Social Security as far as these periods do not overlap.
(3) Where the right to receive benefits under the legislation of either Contracting State is conditional upon the completion of a certain period in an occupation covered by a special scheme or in a specified occupation or employment, only periods completed under the scheme concerned or in the absence of such a scheme, in the same occupation or employment, as appropriate, shall be taken into account for determining entitlement to such benefits under the legislation of the other Contracting State.
(4) Where the legislation of a Contracting State provides that the period of payment of a pension may be taken into consideration for the acquisition of entitlement to benefits, the competent institution of that Contracting State shall, to that end, take into account any period during which a pension was paid under the legislation of any other Contracting State.
(5) For the purposes of calculating the periods of insurance, relevant legislation of each of the Contracting State shall apply.
Article 13
Periods of insurance less than one year
(1) Where the total period of insurance completed under the legislation of one Contracting State is shorter than 12 months, the benefit shall not be granted, except when, according to that legislation, there exists a right to benefit based exclusively on that period of insurance.
(2) In pursuance of paragraph (1) of this Article the competent institution of other Contracting State shall take into account these periods as if they had been completed under the legislation it applies, for the entitlement to, maintenance of and re-entitlement to benefits as well as the determination of the actual amount.
Article 14
Calculation of benefits
(1) Where entitlement to benefits under the legislation of either Contracting State is to be acquired regardless of the provisions of Article 12 of this Agreement, the institution of that Contracting State shall calculate the benefits to be awarded solely on the basis of the periods completed under the legislation it applies.
(2) Where the person concerned acquires the right to benefits under the legislation of either Contracting State only through implementation of Article 12 of this Agreement, the institution of this Contracting State shall calculate the benefits as follows:
a) the competent institution shall calculate the theoretical amount taking into account all the insurance periods completed under the legislation of both Contracting States as if they had been completed solely under the legislation which that institution applies;
b) on the basis of the amount calculated as referred to above, the actual amount of benefit shall be computed as a proportion between the insurance periods completed exclusively according to its legislation and the total insurance periods taken into account for calculating the benefit.
(3) Where benefits under the legislation of a Contracting State are calculated on the basis of earnings or contributions paid under the legislation of that Contracting State, the competent institution shall take into account the earnings or contributions paid exclusively under the legislation it applies.
(4) Where the amount of benefits depends on the number of persons in the family in accordance with the legislation of either Contracting State, the competent institution shall also take into account the persons in the family residing on the territory of the other Contracting State.
SECTION II
DEATH GRANT
Article 15
Aggregation of periods of insurance and award of death grant
(1) Where entitlement to death grant under the legislation of either Contracting State is conditional upon the completion of a period of insurance, the competent institution of that Contracting State shall take into account, if necessary, periods of insurance completed under the legislation of the other Contracting State, as far as they do not overlap, as if they were periods of insurance completed under its legislation.
(2) Where a person who is insured under the legislation of one Contracting State dies on the territory of the other Contracting State, it shall be assumed that she/he died on the territory of the Contracting State where she/he was insured and the survivors shall be entitled to a death grant.
(3) Where entitlement to benefit in case of death exists pursuant to legislation of both Contracting States, only the legislation of that Contracting State on the territory of which the deceased had resided shall apply.
(4) In case of death occurred on the territory of a third State, the benefit shall be paid in accordance with the legislation of the Contracting State to which the insured person was subject before occurrence of death.
SECTION III
BENEFITS IN CASE OF WORK ACCIDENTS AND OCCUPATIONAL DISEASES
Article 16
Benefits for work accidents and occupational diseases provided for
to a person exposed to similar risks in each of the Contracting States
(1) The right to benefits in respect of work accidents and occupational diseases shall be determined pursuant to the legislation applicable at the date the incident took place or at the time the work resulting in an occupational disease was performed.
(2) Where the legislation of a Contracting State makes entitlement to benefit conditional upon the disease in question being first diagnosed on its territory, this condition is deemed to be fulfilled, even if the diagnosis has been carried out on the territory of the other Contracting State.
(3) Where the legislation of a Contracting State explicitly or implicitly makes entitlement to benefits conditional upon the disease in question being diagnosed within a specified period after the termination of the occupation liable to have caused it, the competent institution shall also take into account, if needed, any other activity that involves similar risks carried out under the legislation of the other Contracting State.
(4) Where the legislation of a Contracting State explicitly or implicitly makes entitlement to benefits for occupational diseases conditional upon an occupation liable to cause the disease in question having been followed for a specified period, for the purpose of calculating the benefits, the periods in which such work was performed on the territory of the other Contracting State shall also be taken into account.
Article 17
Granting of a benefit in case of aggravation of occupational disease
When a beneficiary has received or is receiving benefit from the competent institution of a Contracting State because of an occupational disease, and, in case of aggravation of the disease, applies for the rights to benefit from the competent institution of the other State, the following provisions shall be applied:
a) where the person concerned has not carried out an activity under the legislation of the other Contracting State liable to cause or aggravate the disease in question, the competent institution of the first Contracting State shall bear the cost of the benefit, taking into account the aggravation, in accordance with the legislation it applies;
b) where the person concerned has carried out such an activity under the legislation of the other Contracting State, the competent institution of the first Contracting State shall bear the payment of the benefit, without taking into account the aggravation, according to the provisions of the legislation it applies; the competent institution of the second Contracting State provides the concerned person with a supplement in the amount equal to the difference between the benefit level owed after aggravation and the amount of the benefit that would have been owed before aggravation, in accordance with the provisions of the legislation applied.
SECTION IV
UNEMPLOYMENT
Article 18
Unemployment benefits
The entitlement, amount, duration and way of payment of the benefits shall be determined according to the legislation that the competent institution applies.
PART IV
MISCELLANEOUS PROVISIONS
Article 19
Administrative measures and co-operation methods
(1) The competent authorities of the Contracting States shall make the administrative arrangements necessary for the implementation of this Agreement.
(2) The competent authorities of the Contracting States shall designate liaison bodies for the purpose of facilitating the implementation of this Agreement.
(3) The competent authorities of the Contracting States shall communicate to each other as soon as possible the necessary information on the measures taken for the implementation of this Agreement and inform of any changes in their national legislation as far as these changes affect the implementation of this Agreement.
(4) The competent authorities and institutions of the Contracting States shall assist each other on any matters relating to the implementation of this Agreement as if these matters affect the application of their own legislation. Such administrative assistance shall be free of charge.
(5) Medical examination performed exclusively for the application of the legislation of one Contracting State and referring to persons having place of residence or stay on the territory of the other Contracting State, shall be performed at the request and at the expense of the competent institution, by the institution of its place of residence or stay. Medical examinations related to the application of the legislation of both Contracting States shall be performed at the expense of the competent institution of the Contracting State where the person stays or resides.
Article 20
Protection of personal data
(1) Any personal data sent by one Contracting State shall be processed solely for the purpose of implementation of this Agreement. The processing of personal data shall be subject to the Strasbourg Convention of 28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data and the national legislation on the personal data protection of the Contracting States.
(2) Personal data sent shall be accurate and adequate for a certain purpose or task, taking into account the provisions of this Agreement. If necessary, data which are inaccurate or incomplete, shall be rectified, supplemented, destroyed or the data processing shall be stopped.
(3) When the purpose for which they were submitted is fulfilled, the data will be destroyed. The State which transmitted the data will be informed about data destruction and the reason for which they were destroyed.
(4) Appropriate technical security and organizational measures shall be taken by the competent authorities and institutions of the Contracting States to protect personal data against destruction, alteration, accidental or unauthorised loss of the personal data as well as their unauthorised processing.
(5) The person concerned has the right to request information as to its personal data, the purpose for which they are or where processed. The right of the person concerned to such information shall be subject to the data protection legislation of the Contracting State from which that information is requested. The request for such information can be rejected for the purposes of this Agreement, state security, public order, prevention of the criminal offences and protection of the rights and fundamental freedoms of other persons.
Article 21
Exemption from charges and authentication
(1) Exemption from or reduction in the dues and charges of the written files and documents enclosed for the purpose of application of the legislation of a Contracting State shall also apply to any declaration or other document which is submitted under the legislation of the other Contracting State or for the implementation of this Agreement.
(2) Any identity statement, document and declaration submitted for the purpose of implementation of this Agreement need not be authenticated.
Article 22
Submission of a claim
(1) A claim for a benefit submitted under the legislation of either Contracting State in pursuance of this Agreement shall be deemed to be submitted under the legislation of the other Contracting State.
(2) If submission of a claim is conditional upon to be made in a settled period of time according to the legislation of one of the Contracting States, this condition shall be deemed to be fulfilled, if it is made within the same period of time, to the competent institution of the other Contracting State. In such a case, the competent institution of the Contracting State shall forward the claim, without delay, to the competent institution of the first Contracting State, either directly, or through liaison bodies of both Contracting States.
Article 23
Payments
(1) Payment of any benefit in accordance with this Agreement shall be made in the currency of the Contracting State making the payment, in US Dollar or in Euro.
(2) The means of reimbursements between the competent institutions shall be agreed through the Administrative Arrangement.
Article 24
Recovery of undue payments
If the institution of one Contracting State has paid to a beneficiary the benefits in the amount that exceeds the sum that has been entitled to, this institution shall request, from the institution of the other Contracting State that owes benefits to this beneficiary, under the conditions stipulated by the legislation it applies, to withhold the extra and undue amount paid to the beneficiary, from the amounts owed. This institution withholds the amount under the conditions in which such an offset is allowed by the legislation it applies, as if these extra and undue amounts have been paid by the institution itself, executing the transfer of the amount thus deducted to the other competent institution.
Article 25
Settlement of disputes
The competent authorities of both Contracting States shall resolve any dispute about the interpretation or implementation of this Agreement through direct consultations.
PART V
TRANSITIONAL AND FINAL PROVISIONS
Article 26
Transitional provisions
(1) This Agreement shall confer no rights for any period prior to its entry into force.
(2) All periods of insurance completed under the legislation of one Contracting State, prior to entering into force of this Agreement, shall be taken into account for the purpose of determination of the rights, arising from this Agreement.
(3) Any benefit, due only by virtue of this Agreement, including the rights previously granted, shall be paid, at the request of the person concerned and in accordance with the provisions of this Agreement, with effect from the entry into force of this Agreement, unless a lump-sum payment has been made.
(4) Where the request referred to in paragraph (3) of this Article is submitted within two years of the entry into force of this Agreement, the rights arising in accordance with the provisions of this Agreement shall be acquired as from that date, and those provisions of the legislation of either Contracting State which concern the loss or extinction of rights by lapse of time shall not be raised against the person concerned. The date of submission of the request shall be taken into account for the request submitted after two years.
Article 27
Revision of eligibility to pensions
(1) The acquired right to receive a pension prior to entry into force of this Agreement, may be revised upon request, according to the provisions of this Agreement.
(2) The rights acquired after being revised, shall be proceeded upon the date of submitting the claim.
(3) If the revision of the rights to a pension shall lead to a decrease in the amount of the pension, the amount of the pension which was determined prior to the revision shall continue to be paid.
Article 28
Ratification and entry into force
This Agreement, being subject to ratification pursuant to national legislation of both Contracting States, shall enter into force on the first day of the second month following the date of the receipt of the last written notification by which the Contracting States notify each other, through diplomatic channels, of the completion of their internal legal procedures required for its entry into force.
Article 29
Amendment of the Agreement
This Agreement may be amended at any time upon the mutual written consent of both Contracting States. Amendments shall enter into force in accordance with the procedures determined in Article 28 of this Agreement.
Article 30
Duration of the Agreement
(1) This Agreement shall be concluded for an indefinite term.
(2) Either Contracting State may denounce it, by sending, through diplomatic channels, a written notification to the other Contracting State, but not later than six months prior to the end of the respective calendar year.
Article 31
Maintenance of acquired rights
(1) In the event of denunciation of this Agreement, all rights acquired under this Agreement shall be maintained.
(2) In the event of denunciation of this Agreement, all processing related to the rights to benefits on which no determination has been made yet shall be concluded in accordance with the provisions of this Agreement.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed this Agreement.
Done at Chişinău on 5 May 2017 in two originals in Romanian, Turkish and English languages, all the texts being equally authentic. In case of discrepancy in the interpretation, the English text shall prevail.
