între Guvernul Republicii Moldova şi Guvernul Republicii Italiene
privind colaborarea în domeniul turismului

Guvernul Republicii Moldova şi Guvernul Republicii Italiene, numite în continuare Părţi,
luând ca bază statutul Organizaţiei Mondiale a Turismului, aprobat la 27 septembrie 1970 în Mexic,
dorind să contribuie la dezvoltarea relaţiilor în domeniul turismului între Republica Moldova şi Republica Italiană şi la cooperarea între autorităţile abilitate ale ambelor state în domeniul turismului,
recunoscând că colaborarea în domeniul Turismului este considerată un element important şi necesar pentru consolidarea şi dezvoltarea raporturilor prieteneşti între popoarele ambelor ţări,
tinzând să creeze temelia pentru extinderea relaţiilor în domeniul turismului între Republica Moldova şi Republica Italiană,
au convenit asupra celor ce urmează:
Articolul 1
Părţile, în conformitate cu legislaţia naţională a ambelor state şi cu normele dreptului internaţional, vor contribui la dezvoltarea relaţiilor în domeniul turismului.
Articolul 2
Părţile vor facilita dezvoltarea turismului în diverse forme, acceptate de practica internaţională, inclusiv:
- turism cultural,
- turism de afaceri,
- turism academic,
- turism balnear şi de tratament,
- turism rural,
- turism ecologic,
- călătorii turistice în vederea participării la expoziţii, târguri, activităţi culturale şi sportive etc.,
- turism în grup şi individual,
- turism pentru tineret etc.
Articolul 3
Colaborarea în conformitate cu prevederile prezentului Acord se va realiza prin favorizarea dezvoltării cooperării dintre instituţiile publice şi agenţii economici în domeniul turismului din Republica Moldova şi Republica Italiană prin:
- crearea condiţiilor favorabile pentru atragerea investiţiilor în scopul susţinerii şi dezvoltării turismului;
- susţinerea întreprinderilor mixte în domeniul turismului;
- facilitarea schimburilor de specialişti, a grupurilor de experţi în domeniul turismului;
- organizarea expoziţiilor comune, congreselor, seminarelor, conferinţelor, simpozioanelor, meselor rotunde;
- acordarea serviciilor de consulting;
- alte forme de colaborare convenite de Părţi.
Articolul 4
În scopul dezvoltării relaţiilor bilaterale în domeniul turismului, Părţile vor acorda ajutor reciproc în deschiderea birourilor de informare turistică pe teritoriul Republicii Moldova şi al Republicii Italiene.
Birourile menţionate vor activa în baza legislaţiei naţionale a fiecărui stat şi în conformitate cu normele dreptului internaţional.
Articolul 5
Părţile, în conformitate cu legislaţia naţională ale ambelor state şi acordurile internaţionale, cu referire specială la Acordurile Schengen în cazul Italiei, vor contribui la simplificarea formalităţilor controlului la frontieră pentru turiştii ambelor state.
Articolul 6
Părţile vor contribui la realizarea condiţiilor necesare, care vor favoriza încheierea şi realizarea contractelor de colaborare între companiile şi instituţiile turistice, acordînd o atenţie deosebită la:
- dezvoltarea, gestionarea şi protejarea resurselor turistice culturale şi naturale;
- extinderea serviciilor turistice.
Articolul 7
În scopul dezvoltării turismului, dintre ambele state, Părţile vor coopera pentru organizarea unor acţiuni de informare şi promovare turistică, şi anume:
- expoziţii, târguri, conferinţe de presă, mese rotunde;
- prezentarea filmelor documentare turistice;
- schimb de materiale promoţionale şi materiale informative despre turism, schimb de reviste de specialitate şi publicaţii ştiinţifice oferite de biblioteci şi edituri din cele două state;
- schimb de informaţii privind cadrul legal care reglementează activitatea în domeniul turismului;
- schimb de experienţă şi informaţii privind problemele construcţiei, cercetărilor ştiinţifice în domeniul turismului, participării cu statut de membru în organizaţiile turistice internaţionale, şi din alte domenii legate de dezvoltarea turismului.
Formele concrete, calendarul şi condiţiile financiare de organizare a acestor acţiuni, precum şi volumul materialelor de informare şi publicitate turistică, ce urmează a fi puse reciproc la dispoziţie, vor fi stabilite prin programe convenite între Părţi.
Condiţiile stipulate în Acord vor fi implementate în dependenţă de disponibilitatea resurselor.
Articolul 8
Părţile vor extinde, în conformitate cu legislaţia naţională, colaborarea în domeniul pregătirii şi perfecţionării personalului pentru industria turismului.
În acest scop Părţile vor conveni asupra unui proiect separat privind:
a) schimbul reciproc de studenţi la specialităţile respective în vederea studierii în instituţiile de învăţământ superior din ambele state;
b) acordarea reciprocă a posibilităţilor de pregătire şi perfecţionare a personalului de conducere şi specialiştilor autorităţilor abilitate din domeniul turismului, agenţilor economici şi organizaţiilor turistice, precum şi a lucrătorilor hotelurilor, restaurantelor şi altor categorii de specialişti ce prestează servicii turistice.
Articolul 9
În scopul examinării operative a acţiunilor îndreptate spre realizarea prezentului acord, se instituie un grup mixt de lucru, constituit din reprezentanţi ai autorităţilor turistice ale ambelor Părţi.
Acest grup de lucru va:
- studia problemele apărute în procesul de implementare a prezentului Acord,
- discuta şi va propune soluţii pentru aceste probleme,
- elabora recomandări menite sa stimuleze schimbul şi cooperarea în domeniul turismului.
Articolul 10
Autorităţile responsabile de realizarea prezentului Acord sunt:
- în Republica Moldova: Ministerul Culturii şi Turismului;
- în Republica Italiană: Preşedinţia Consiliului de Miniştri, Departamentul pentru Dezvoltarea şi Competitivitatea Turismului.
Articolul 11
Prezentul Acord nu afectează drepturile şi obligaţiile Părţilor, ce decurg din alte tratate internaţionale la care Republica Moldova şi Republica Italiană sunt parte.
Articolul 12
Părţile vor soluţiona divergenţele care pot apărea în legătură cu interpretarea şi implementarea prezentului Acord prin negocieri şi consultări.
Articolul 13
Părţile, de comun acord, pot completa prezentul Acord cu completările şi modificările necesare, perfectate în protocoale separate ca parte integrantă a prezentului Acord.
Protocoalele menţionate vor intra în vigoare potrivit prevederilor art.14 al prezentului Acord.
Articolul 14
Prezentul Acord va intra în vigoare la data primirii, prin canale diplomatice, a ultimei notificări în scris prin care Părţile îşi vor notifica reciproc una celeilalte despre îndeplinirea procedurilor interne necesare pentru intrarea în vigoare.
Prezentul Acord se încheie pentru un termen de cinci ani. Acţiunea lui se va prelungi în mod automat pentru următorii termeni de cinci ani, dacă nici una dintre Părţi nu va notifica în scris celeilalte Părţi, cu cel puţin şase luni până la expirarea efectelor prezentului Acord, despre intenţia sa de a-l denunţa.
Drept pentru care, Reprezentanţii subsemnaţi, corespunzător autorizaţi de către Guvernele respective, au semnat acest Acord.
Întocmit la Roma, la 7 decembrie 2006, în doua exemplare originale, fiecare în limbile moldovenească, italiană şi engleză, toate textele fiind egal autentice.
În cazul apariţiei divergenţelor în interpretarea prevederilor prezentului Acord, va prevala versiunea engleză.
AGREEMENT
between the Government of the Republic of Moldova
and the Government of the Italian Republic on
tourism collaboration
The Government of the Republic of Moldova and the Government of the Italian Republic hereinafter called Parties,
taking as basis the statute of the World Tourism Organization, approved on September 27, 1970 in Mexico,
willing to contribute to the development of tourism relations between the Republic of Moldova and the Italian Republic and to the co-operation between the empowered authorities in the field of tourism of both states,
recognizing the fact that the collaboration in the field of tourism is considered an important and necessary element for the consolidation and development of friendly relationships between the people of both countries,
tending to create a basis for the extension of tourism relations between the Republic of Moldova and the Italian Republic,
have agreed on the following:
Article 1
The Parties pursuant to the national legislation of both states and in accordance with the international legal regulations will contribute to the development of relations in the field of tourism.
Article 2
The Parties will facilitate tourism development in its diverse forms, which are accepted by international practice, including:
• cultural tourism
• business tourism
• academic tourism
• balneal and health recovering tourism
• rural tourism
• ecological tourism
• event trips while attending exhibitions, fairs, cultural and sport events, etc.
• group and individual tourism
• youth tourism, etc.
Article 3
The collaboration defined by this Agreement will be achieved by favouring cooperative development between the public establishments and economic agents that activate in the field of tourism in the Republic of Moldova and in the Italian Republic by means of:
• creating favourable conditions for attracting investments aiming to support and develop tourism;
• supporting joint ventures in the field of tourism;
• facilitate the exchange of professionals, groups of experts in the field of tourism;
• organizing common exhibitions, congresses, seminars, conferences, symposiums, round tables;
• offering consulting services;
• and other forms of cooperation settled by Parties.
Article 4
Aiming at developing bilateral relationships in the field of tourism the Parties will offer mutual assistance in setting up tourism information bureaus on the territory of the Republic of Moldova and of the Italian Republic.
The above mentioned bureaus will operate on the basis of the current national legislation of each of the states, and pursuant to international law.
Article 5
The Parties, in accordance with the current legislation of both states and international agreements, with special reference to Schengen Agreements in case of Italy, will contribute to the simplification of the border control formalities for the tourists of both states.
Article 6
The Parties will contribute to the realization of necessary conditions, which will favour the conclusion and implementation of the collaboration contracts between companies and tourist institutions, paying special attention to:
• the development, management and protection of cultural and natural tourist resources;
• the enlargement of tourist services.
Article 7
In order to develop the tourism in both countries the Parties will cooperate to the organization of informative and tourism promotion activities, namely:
• exhibitions, trade fairs, press conferences, round tables;
• presentation of tourism documentaries;
• exchange of promotional and informative materials on tourism, exchange of specialized magazines and scientific publications offered by libraries and printing houses from both states;
• exchange of information regarding the legal framework that regulates tourist activity;
• exchange of experience and information regarding construction problems, scientific research in the field of tourism, membership in international tourism organizations, as well as other fields related to the development of tourism.
The specific forms, the agenda and the financial terms of these actions, as well as the volume of tourist information and promotional materials that shall be mutually made available, will be established by the Parties through dually agreed programs.
The conditions stipulated in the Agreement will be implemented according to the available resources.
Article 8
The Parties will extend, in accordance with national legislation, the collaboration: in training and developing professionals for tourism industry.
For this purpose the Parties will agree with a separate project on:
a) mutual exchange of students in the related specialties, with the purpose of studying at higher education establishments of both states;
b) offering mutual possibilities of training and improving the skills of executive personnel and specialists of tourism authorities; of economic entities and institutions; as well as of the hotel and restaurant personnel and of other specialists that provide tourist services.
Article 9
In order to efficiently examine the actions directed to the accomplishment of this Agreement, a mixed working group will be established, consisting of representatives of tourism authorities of both Parties.
This working group will;
• study the problems that appear during the accomplishment of this Agreement;
• discuss and propose solutions for these problems;
• elaborate recommendations aiming at stimulating the exchange and co-operation in the field of tourism.
Article 10
The authorities responsible for the accomplishment of this Agreement are:
• in the Republic of Moldova: Ministry of Culture and Tourism
• in the Italian Republic: Presidency of the Council of Ministers – Department for the development and the competitiveness of Tourism.
Article 11
This Agreement does not affect the rights and obligations of the Parties that result from other international treaties to which the Republic of Moldova and the Italian Republic are signatories.
Article 12
The Parties will settle disputes that could appear concerning the interpretation and the accomplishment of this Agreement by means of negotiations and consultations.
Article 13
The Parties, in common understanding, can complement this Agreement with required riders and modifications, drafted in separate protocols as integrate parts of this Agreement.
The above mentioned protocols will come into effect in accordance with the provisions of Art.14 of this Agreement.
Article 14
This Agreement shall enter into force at the date of receipt, through diplomatic channels, of the last written notification by which the Parties have officially notified each other that the respective internal procedures for its entry into force have been fulfilled.
This Agreement is concluded for a period of five years. It will be automatically renewed for the next five years period, unless either of the two Parties will notify in written to the other Party, at least six months prior to the expiration of the effect of this Agreement, on its intention to terminate it.
In witness whereof, the undersigned Representatives, duly authorized by their respective Governments, have signed this Agreement.
Done in Rome, on 7 December 2006, in two original documents, each in Moldovan, Italian and English languages, all texts being equally authentic.
In the event of any dispute on interpretation of this Agreement, the English version shall prevail.
