între Guvernul Republicii Moldova şi Guvernul Republicii Coreea

privind abolirea regimului de vize pentru titularii paşapoartelor

diplomatice, oficiale şi de serviciu

Guvernul Republicii Moldova şi Guvernul Republicii Coreea (în continuare “Părţi Contractante”),

ghidate de dorinţa comună de a dezvolta în continuare relaţiile de prietenie dintre ambele State şi

dorind să simplifice procedurile de călătorie pentru cetăţenii statelor Părţilor Contractante, care deţin paşapoarte diplomatice, oficiale şi de serviciu, valabile,

au convenit asupra celor ce urmează:

Articolul 1

1. Cetăţenii statului unei Părţi Contractante, care deţin documente de călătorie valabile, specificate în Anexa la prezentul Acord, pot intra, ieşi şi tranzita teritoriul statului celeilalte Părţi Contractante fără viză.

2. Persoanele menţionate în alineatul 1 al prezentului Articol pot să se afle pe teritoriul statului celeilalte Părţi Contractante fără viză pentru o perioadă care să nu depăşească 90 (nouăzeci) de zile, de la data primei intrări, în orice perioadă de şase luni. Prelungirea perioadei de şedere se acordă de către autorităţile competente ale celeilalte Părţi Contractante, la cererea scrisă a misiunii diplomatice sau oficiului consular ale Părţii Contractante trimiţătoare.

Articolul 2

Cetăţenii statului oricărei Părţi Contractante care deţin documente de călătorie valabile, specificate în Anexa la prezentul Acord şi sunt membri ai misiunilor diplomatice, oficiului consular sau ai unei organizaţii internaţionale pe teritoriul statului celeilalte Părţi Contractante, precum şi membrii familiei lor care locuiesc împreună cu ei şi deţin documente de călătorie valabile, specificate în Anexa la prezentul Acord, pot intra, şedea, tranzita şi părăsi teritoriul statului altei Părţi Contractante fără viză pentru perioada desemnării.

Articolul 3

Persoanele menţionate în Articolele 1 şi 2 ale prezentului Acord pot intra sau părăsi teritoriul statului celeilalte Părţi Contractante prin orice punct de trecere a frontierei deschis pentru traficul internaţional de pasageri, cu condiţia respectării legilor şi regulamentelor acelei Părţi Contractante ce reglementează intrarea, tranzitarea şi şederea străinilor.

Articolul 4

1. Fiecare Parte Contractantă îşi rezervă dreptul de a refuza intrarea sau a pune capăt şederii pe teritoriul statului său oricărei persoane menţionate la Articolele 1 şi 2 ale prezentului Acord, pe care o consideră nedorită. Un astfel de refuz va fi notificat, fără întîrziere, celeilalte Părţi Contractante, prin canale diplomatice.

2. Fiecare Parte Contractantă îşi rezervă dreptul de a introduce restricţii temporare sau de a suspenda efectele prezentului Acord, în totalitate sau în parte, din motive de ordine publică, securitate naţională sau sănătate publică. Impunerea unor astfel de restricţii sau suspendări, sau ridicarea acestora, va fi notificată, celeilalte Părţi Contractante, prin canale diplomatice, cu 30 (treizeci) de zile înainte de intrarea în vigoare a acestora.

Articolul 5

1. Părţile Contractante, prin canale diplomatice, vor face schimbul specimenelor documentelor de călătorie valabile, specificate în Anexa la prezentul Acord, nu mai tîrziu de 30 (treizeci) de zile pînă la intrarea în vigoare a prezentului Acord.

2. Părţile Contractante se vor informa reciproc, prin canale diplomatice, despre orice modificări în documentele lor de călătorie valabile, specificate în Anexa la prezentul Acord, nu mai tîrziu de 30 (treizeci) de zile pînă la intrarea în vigoare a modificărilor.

Articolul 6

Orice divergenţe apărute în cursul interpretării sau implementării prezentului Acord vor fi soluţionate prin consultări şi negocieri între Părţile Contractante.

Articolul 7

Părţile Contractante, pe baza consimţămîntului reciproc, în formă scrisă, pot face completări sau modificări la prezentul Acord, care vor intra în vigoare în conformitate cu procedurile stabilite în Articolul 8 al prezentului Acord.

Articolul 8

1. Părţile Contractante se vor notifica reciproc, prin canale diplomatice, despre îndeplinirea procedurilor interne necesare pentru intrarea în vigoare a prezentului Acord. Acordul va intra în vigoare la data primirii ultimei notificări.

2. Prezentul Acord se încheie pentru o perioadă nedeterminată.

3. Oricare dintre Părţile Contractante poate în orice moment să notifice celeilalte Părţi, prin canale diplomatice, intenţia de a denunţa prezentul Acord. În asemenea caz, Acordul îşi încetează acţiunea după 90 (nouăzeci) de zile de la data primirii de către cealaltă Parte Contractantă a notificării respective.

Subsemnaţii, fiind respectiv împuterniciţi de către Guvernele lor, au semnat prezentul Acord.

Întocmit la Chişinău, la 8 mai 2012, în două exemplare, fiecare în limbile moldovenească, coreeană şi engleză, toate textele fiind egal autentice. În cazul apariţiei divergenţelor în interpretare, textul în limba engleză va prevala.

ANEXĂ

la Acordul între Guvernul Republicii Moldova şi Guvernul Republicii Coreea

privind abolirea regimului de vize pentru titularii paşapoartelor

diplomatice, oficiale şi de serviciu

Documentele de călătorie valabile ale Părţilor Contractante în sensul prezentului Acord sunt:

Pentru cetăţenii Republicii Moldova:

1. Paşapoarte diplomatice;

2. Paşapoarte de serviciu.

Pentru cetăţenii Republicii Coreea:

1. Paşapoarte diplomatice;

2. Paşapoarte oficiale.

AGREEMENT

between the Government of the Republic of Moldova and the

Government of the Republic of Korea on the waiver of visa

requirements for holders of diplomatic,

official and service passports

The Government of the Republic of Moldova and the Government of the Republic of Korea (hereinafter referred to as the “Contracting Parties”),

Guided by the common desire to further develop the friendly relations between the two States, and

Wishing to simplify the procedures of travel for citizens of the two states who are holders of valid diplomatic, official, and service passports,

Have agreed as follows:

Article 1

1. Citizens of the state of one Contracting Party holding valid travel documents, as specified in the Annex to this Agreement, may enter, leave and transit through the territory of the state of the other Contracting Party without a visa.

2. The persons referred to in paragraph 1 of this Article may stay in the territory of the State of the other Contracting Party for a period not exceeding ninety (90) days from the date of the first entry in any six-month period. Extension of the period of stay max be granted by the competent authorities of that other Contracting Party, upon a written request from the diplomatic mission or consular post of the sending Contracting Party.

Article 2

Citizens of the State of either Contracting Party holding valid travel documents, as specified in the Annex to this Agreement, and who are members of a diplomatic mission, consular post or an international organization in the territory of the State of the other Contracting Party, as well as their family members forming part of their household who are holding valid travel documents, as specified in the Annex to this Agreement, may enter, stay, transit and leave the territory of the State of the other Contracting Party without a visa during the period of the assignment.

Article 3

The persons referred to in Articles 1 and 2 of this Agreement may enter or leave the territory of the State of the other Contracting Party, through any border crossing point, opened for the international passenger traffic, respecting the laws and regulations of that Contracting Party governing the entry, transit and residence of aliens.

Article 4

1. Each Contracting Party reserves the right to refuse the entry or terminate the stay in its territory of any person referred to in Articles 1 or 2 of this Agreement whom it may consider undesirable. Such refusal shall be notified without delay to the other Contracting Party through diplomatic channels.

2. Each Contracting Party reserves the right to introduce temporary restrictions or suspend the effect of this Agreement, in whole or in part, for reasons of public order, national security or public health. The imposition of any such restriction or suspensions, or the lifting thereof, shall be notified to the other Contracting Party through diplomatic channels, thirty (30) days prior to their entry into force.

Article 5

1. The Contracting Parties shall exchange, through diplomatic channels, specimens of the valid travel documents, as specified in the Annex to this Agreement, not later than thirty (30) days before the entry into force of this Agreement.

2. The Contracting Parties shall inform each other, through diplomatic channels, of any changes to their valid travel documents, as specified in the Annex to this Agreement, not later than thirty (30) days before the entry into force of such changes.

Article 6

Any differences arising from the interpretation or implementation of this Agreement shall be settled through consultations and negotiations between the Contracting Parties.

Article 7

The Contracting Parties on the basis of mutual written consent may make additions or amendments to this Agreement, which shall enter into force in accordance with the procedures, set out in Article 8 of this Agreement.

Article 8

1. The Contracting Parties shall notify each other through diplomatic channels of the completion of their respective internal procedures necessary for the entry into force of this Agreement. The Agreement shall enter into force on the date of the receipt of the last notification.

2. This Agreement is concluded for an indefinite period.

3. Either Contracting Party may at any time notify the other Contracting Party, through diplomatic channels, of its intention to terminate this Agreement. In such case the Agreement shall terminate ninety (90) days after the date of receipt of such notification by the other Contracting Party.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have sighed this Agreement.

Done in duplicate at Chişinău on the 8 day of May, 2012, in the Moldovan, Korean and English languages all texts being equally authentic. In case of divergences in interpretation, the English text shall prevail.

ANNEX

to the Agreement between the Government of the Republic of Moldova

and the Government of the Republic of Korea on the Waiver of

Visa Requirements for the Holders of Diplomatic,

Official and Service Passports

Valid travel documents of the Contracting Parties for the purpose of this Agreement shall be:

For the citizens of the Republic of Moldova:

1. Diplomatic passports;

2. Service passports.

For the citizens of the Republic of Korea:

1. Diplomatic passports;

2. Official passports.
