titularii paşapoartelor diplomatice şi de serviciu

Guvernul Republicii Moldova şi Consiliul de Miniştri al Bosniei şi Herţegovinei, în continuare Părţi Contractante,
în vederea promovării relaţiilor de prietenie între ambele ţări şi facilitării călătoriei cetăţenilor lor,
recunoscînd că prezentul Acord este o etapă premergătoare pentru introducerea regimului reciproc de călătorie fără viză pentru cetăţenii Părţilor Contractante,
au convenit asupra celor ce urmează.
Articolul 1
Cetăţenii oricărei Părţi Contractante, care sunt titulari ai paşapoartelor diplomatice sau de serviciu valabile, nu li se va cere să obţină viză pentru a intra, ieşi, tranzita sau şedea pe teritoriul statului altei Părţi Contractante pe o perioadă care nu depăşeşte 90 (nouăzeci) de zile.
Articolul 2
Cetăţenii oricărei Părţi Contractante, care sunt titulari ai paşapoartelor diplomatice sau de serviciu valabile şi care sunt membri ai misiunilor diplomatice, oficiului consular sau ai unei organizaţii internaţionale pe teritoriul altei Părţi Contractante, precum şi membrii familiei lor care locuiesc împreună cu ei şi sunt titulari ai paşapoartelor diplomatice sau de serviciu valabile, pot intra, şedea sau ieşi de pe teritoriul altei Părţi Contractante fără viză pentru perioada desemnării.
Articolul 3
Cetăţenii Părţilor Contractante menţionaţi în Articolele 1 şi 2 pot intra sau ieşi de pe teritoriul altei Părţi Contractante la orice punct de trecere a frontierei deschis pentru traficul internaţional de pasageri, cu condiţia că ei respectă cerinţele legilor şi regulamentelor acelei Părţi Contractante ce reglementează intrarea, deplasarea şi şederea străinilor.
Articolul 4
Părţile Contractante se vor informa reciproc, fără întîrziere, despre orice schimbări în cadrul legilor şi regulamentelor lor respective cu privire la intrarea, deplasarea şi şederea străinilor.
Articolul 5
Prezentul Acord nu afectează obligaţia cetăţenilor oricărei Părţi Contractante de a respecta legile şi regulamentele în vigoare pe teritoriul celeilalte Părţi Contractante.
Articolul 6
Prezentul Acord nu afectează dreptul autorităţilor competente ale Părţilor Contractante de a refuza permisiunea de intrare şi şedere pe teritoriul său, titularilor unui paşaport diplomatic sau de serviciu ai altei Părţi Contractante, menţionaţi în Articolele 1 şi 2, dacă ele îi consideră nedoriţi sau “persona non grata”.
Articolul 7
1. Părţile Contractante, prin canale diplomatice, vor face schimb de specimene ale paşapoartelor diplomatice sau de serviciu valabile cu cel puţin treizeci (30) de zile înainte de intrarea în vigoare a prezentului Acord.
2. În cazul introducerii unor paşapoarte diplomatice sau de serviciu noi sau modificării celor existente, Părţile Contractante, prin canale diplomatice, vor face schimb de specimene cu cel puţin treizeci (30) de zile înainte de aplicarea lor.
Articolul 8
1. Prezentul Acord este încheiat pentru o perioadă nedeterminată.
2. Fiecare din Părţile Contractante poate în orice moment să denunţe prezentul Acord, fapt care este subiect al notificării prin canale diplomatice a altei Părţi Contractante. În asemenea caz, Acordul îşi încetează acţiunea după nouăzeci (90) de zile din momentul ce altă Parte Contractantă a primit notificarea respectivă.
3. Prezentul Acord va intra în vigoare după treizeci (30) de zile de la data primirii ultimei notificări în care Părţile Contractante s-au informat reciproc prin canale diplomatice despre faptul că au fost îndeplinite toate cerinţele, prevăzute de legislaţiile lor naţionale, pentru intrarea în vigoare a prezentului Acord.
Întocmit la Istanbul la 9 octombrie 2009, în două exemplare originale, fiecare în limbile moldovenească şi engleză, ambele texte fiind egal autentice. În cazul oricăror divergenţe în interpretare, textul în limba engleză va prevala.
AGREEMENT
between the Government of the Republic of Moldova and the
Council of Ministers of Bosnia and Herzegovina on mutual abolishing
of visa requirements for holders of diplomatic and service passports
The Government of the Republic of Moldova and the Council of Ministers of Bosnia and Herzegovina hereinafter Contracting Parties,
with a view to promote friendly relations between the two countries and facilitate the travel of their citizens,
recognising that the prezent agreement is a precursory stage for the introduction of mutual visa-free travel regime for the citizens of Contracting Parties,
have agreed as follows.
Article 1
Citizens of either Contracting Party who are holders of a valid diplomatic or service passport shall not be required to obtain a visa to enter, leave, tranzit through or stay on the territory of the state of the other Contracting Party for a period not exceeding ninety (90) days.
Article 2
Citizens of either Contracting Party who are holders of a valid diplomatic or service passports and are members of a diplomatic mission, consular post or an international organization on the territory of other Contracting Party, as well as their family members who live with them in the same household and are holders of a valid diplomatic or service passport, may enter, stay in and leave the territory of the other Contracting Party without a visa during the period of the assignment.
Article 3
Citizens of the Contracting Parties from Articles 1 and 2 may enter or leave the territory of the other Contracting Party at any border crossing open for international passenger traffic, provided that they meet the requirements of laws and regulations of that Contracting Party governing the entry, movement and sojourn of foreigners.
Article 4
The Contracting Parties shall inform each other immediately on any changes in their respective laws and regulations governing the entry, movement and sojourn of foreigners.
Article 5
This Agreement does not affect the obligation of nationals of either Contracting Party to abide by the laws and regulations currently in force in the territory of the other Contracting Party.
Article 6
This Agreement does not affect the right of the competent authorities of the Contracting Parties to refuse permission to enter or stay on its territory to holders of a diplomatic or service passport of the other Contracting Party from Articles 1 and 2 if they consider them undesirable or a “persona non grata”.
Article 7
The Contracting Parties shall convey to each other, through diplomatic channels, specimens of valid diplomatic and service passport at least thirty (30) days prior to entry into force of this Agreement.
In case of introduction of new diplomatic and service passports or modification of the existing ones, the Contracting Parties shall convey to each other, through diplomatic channels, their specimens, at least thirty (30) days prior to their application.
Article 8
This Agreement has been concluded for an indefinite period.
Each of the Contracting Party may at any time terminate this Agreement, which is subject to notification through diplomatic channels of the Contracting Party. In such a case the Agreement shall cease to be in effect ninety (90) days after the other Contracting Party receives the notification thereof.
This Agreement shall enter into force thirty (30) days from the day of the receipt of the last notification in which the Contracting Parties have informed each other through diplomatic channels that all the requirements for entry into force of this Agreement stipulated by their respective national legislation have been met.
Done at Istambul on 9 of Octomber 2009 in two originals, in English language, both texts being equally autentic.
