A C O R D

între Republica Moldova şi Republica Portugheză

privind colaborarea în domeniul turismului

Republica Moldova şi Republica Portugheză, numite în continuare Părţi;

dorind să contribuie la dezvoltarea relaţiilor în domeniul turismului între Republica Moldova şi Republica Portugheză, precum şi la cooperarea între autorităţile abilitate ale ambelor state;

recunoscând importanţa relaţiilor de colaborare în domeniul turismului şi considerînd aceste relaţii ca un factor important şi necesar în consolidarea raporturilor prieteneşti dintre cele două state;

tinzând să creeze o bază legală pentru extinderea relaţiilor în domeniul turismului între cele două state;

au convenit asupra celor ce urmează:

Articolul 1

Tema

Prezentul Acord stabileşte o structură legală pentru dezvoltarea cooperării instituţionale şi antreprenoriale în domeniul turismului între Părţi, la nivelul:

a) schimbului de informaţii;

b) training-ul profesional;

c) promovarea turismului;

d) promovarea investiţională;

e) cooperarea antreprenorială.

Articolul 2

Schimbul de informaţii

Părţile vor promova schimbul de informaţii privind activitatea turistică, incluzând legislaţia, date statistice, programe de dezvoltare turistică, precum şi proiecte şi produse turistice, în deosebi cele bazate pe inovaţia tehnologică.

Articolul 3

Training-ul profesional

Părţile se vor strădui să creeze condiţii pentru cooperare în domeniul training-ului profesional, şi anume:

a) training-ul profesional al experţilor din sectorul turismului;

b) schimbul de experţi şi personal specializat;

c) dezvoltarea cooperării între instituţiile ambelor ţări responsabile de colaborarea în domeniul turismului.

Articolul 4

Promovarea turismului

Părţile vor promova, într-un mod sistematic, schimbul de experienţă în comercializarea produsului turistic.

Articolul 5

Promovarea investiţională

Părţile vor încuraja investiţiile capitalului portughez, moldovenesc sau comun în domeniul turismului.

Articolul 6

Cooperarea antreprenorială

Părţile vor crea condiţiile favorabile pentru cooperarea între întreprinderi, mai ales în ceea ce priveşte informaţia referitoare la oportunităţile investiţionale a fiecărei dintre ţări, vizând:

a) construcţia noilor instalaţii, precum şi reamenajarea celor existente;

b) dezvoltarea, managementul şi protecţia resurselor turistice naturale şi culturale.

Articolul 7

Comisia comună

1. Părţile vor crea o Comisie comună, care va promova, dezvolta şi implementa prevederile prezentului Acord.

2. Comisia comună va fi compusă din reprezentanţii instituţiilor turistice ale ambelor părţi, dispunând de următoarele competenţe:

a) să discute şi să propună soluţii pentru problemele existente şi să elaboreze recomandări menite să stimuleze cooperarea în domeniul turismului;

b) să soluţioneze divergenţele apărute în procesul implementării sau aplicării prezentului Acord.

Articolul 8

Soluţionarea disputelor

Orice dispută privind interpretarea sau aplicarea acestui Acord, nesoluţionată în cadrul Comisiei comune, va fi soluţionată prin consultaţii şi negocieri pe căi diplomatice.

Articolul 9

Amendamente

1. La înţelegerea reciprocă a Părţilor în prezentul Acord pot fi introduse modificări şi completări perfectate prin protocoale separate.

2. Acestea vor intra în vigoare conform prevederilor Articolului 13 al prezentului Acord.

Articolul 10

Cheltuieli

Cheltuielile legate de realizarea prevederilor Acordului urmează a fi suportate de părţile cointeresate în limita alocaţiilor prevăzute pentru scopul dat.

Articolul 11

Raportul faţă de alte instrumente internaţionale

Prevederile prezentului Acord nu afectează drepturile şi obligaţiunile Părţilor ce decurg din alte tratate internaţionale la care acestea sunt parte.

Articolul 12

Durata şi rezilierea

1. Prezentul Acord va rămâne în vigoare pentru o perioadă de cinci (5) ani, fiind reînnoit automat pentru perioade identice.

2. Fiecare parte poate în orice moment să rezilieze prezentul Acord.

3. Rezilierea va fi înştiinţată, în formă scrisă, pe căi diplomatice, producându-şi efectul peste şase (6) luni după data primirii înştiinţării în cauză.

4. În caz de reziliere, orice programe sau proiecte iniţiate in timp ce prezentul Acord era în vigoare vor fi încheiate, doar dacă Părţile nu decid altfel.

Articolul 13

Intrarea în vigoare

Prezentul Acord va intra în vigoare peste treizeci (30) de zile după data primirii ultimei înştiinţări, în formă scrisă şi pe căi diplomatice, enunţând că toate procedurile interne ale ambelor Părţi, necesare pentru intrarea în vigoare, au fost îndeplinite.

Articolul 14

Înregistrarea

Partea, pe teritoriul căreia va fi semnat prezentul Acord, îl va prezenta pentru înregistrare la Secretariatul Naţiunilor Unite, într-un timp cît mai scurt posibil conform clauzelor articolului 102 al Cartei Naţiunilor Unite, totodată, va comunica celeilalte Părţi despre finisarea acestei proceduri, indicându-i numărul de înregistrare.

Încheiat la Lisabona, în a unsprezecea zi a lunii februarie 2009, în două exemplare originale, în limbile moldovenească, portugheză şi engleză, toate textele fiind egale autentice.

În cazul apariţiei unor divergenţe la interpretarea textelor, textul în limba engleză va fi de referinţă.

AGREEMENT

between the Republic of Moldova and the Portuguese Republic

on cooperation in the field of tourism

The Republic of Moldova and the Portuguese Republic hereinafter referred to as the Parties;

wishing to contribute to the development of the tourist relationship between the Republic of Moldova and the Portuguese Republic, as well as to the co-operation in the field of tourism between the two countries;

conscious of the importance that the development of the tourist relationship may have, not only in favor of the respective economies, but also to increase the knowledge, the understanding and the relationship between the two peoples;

recognizing the need to establish a legal framework in order to stimulate the cooperation in the field of tourism between the two countries;

have agreed as follows:

Article 1

Subject

The present Agreement establishes the legal framework for the development of the intuitional and entrepreneurial cooperation between the Parties in the field of tourism, at the level of:

a) The exchange of information;

b) The professional training;

c) The tourism promotion;

d) The investment promotion;

e) The entrepreneurial cooperation.

Article 2

Exchange of information

The Parties shall promote the exchange of information on the tourist activity, including legislation, statistic data, programmes of tourist development, as well as projects and tourist products, specially those based on technological innovation.

Article 3

Professional Training

The Parties shall endeavour to create the conditions to cooperate in the field of professional training, having in mind:

a) The professional training of experts of the tourism sector;

b) The exchange of experts and specialized personnel;

c) The development of cooperation between the institutions of both countries responsible for research in the field of tourism.

Article 4

Tourism Promotion

The Parties shall promote, in a regular basis, the exchange of experiences in domains related with the commercialization of tourist products.

Article 5

Investment Promotion

The Parties shall encourage investments of Portuguese, Moldovan joint ventures in the field of tourism.

Article 6

Entrepreneurial Cooperation

The Parties shall create the favorable conditions for the cooperation between their enterprises, namely in what concerns the information on investment opportunities of each country, concerning:

a) The construction of new equipments, as well as to the recovering of the existent ones;

b) The development, management and protection of natural and cultural tourist resources.

Article 7

Joint Commission

1. The Parties shall create Joint Commission in order to promote, develop and implement the cooperation foreseen in the present Agreement.

2. The Joint Commission shall be composed by representatives of institutions responsible for the tourism sector of both Parties, having the following competences:

a) Discuss and propose solutions for the existent problems and elaborate recommendations to estipulate the tourist cooperation;

b) Solve the disagreements resulting from the implementation or application of the present Agreement.

Article 8

Settlement of Disputes

Any dispute concerning the interpretation or application of this Agreement, not solved in the context of The Joint Commission, shall be settled through consultation or negotiation by diplomatic channels.

Article 9

Amendments

1. The present Agreement may be amended on request of one of the Parties.

2. The amendments shall enter into force in accordance with Article 13 of the present Agreements.

Article 10

Expenses

Expenses for the implementation of the present Agreement should be covered by the Parties according to the budget provided for this matter.

Article 11

Relation with other international instruments

The provisions of the present Agreement shall not affect the rights and obligations arising from other international instruments which both are Parties.

Article 12

Duration and Termination

1. The present Agreement shall remain in force for a period of five (5) years, automatically renewed for identical periods.

2. Each Party may, at any time, terminate the present Agreement.

3. The termination shall be notified, in writing, through diplomatic channels, producing its effects six (6) months after the date of reception of the respective notification.

4. In case of termination, any programs or projects initiated while the present Agreement was in force shall be concluded, unless the Parties agree otherwise.

Article 13

Entry into Force

The present Agreement shall enter into force thirty (30) days after the date of receipt of the last notification, in writing and through diplomatic channels, stating that all the internal procedures of both Parties necessary for its entry into force have been fulfilled.

Article 14

Registration

The Party in whose territory the present Agreement is to be signed, in the shortest possible time after its entry into force, shall submit it for registration to the United Nations Secretariat, in the terms of article 102 from the Chart of the United Nations, having also the duty to notify the other Party of the conclusion of this procedure, indicating its registration number.

Done at Lisbon, on the eleventh day of February 2009, in the Moldovan, Portuguese and English languages, each texts being equally authentic. In case of any divergences of interpretation, the English shall prevail.
