Republicii Moldova şi Ministerul Afacerilor Interne al Georgiei

Serviciul Grăniceri al Republicii Moldova şi Ministerul Afacerilor Interne al Georgiei (denumite în continuare “Părţi»),
- Recunoscînd importanţa dezvoltării şi consolidării bunelor relaţii şi cooperării mutuale în domeniul de frontieră;
- Dorind să stabilească şi să dezvolte relaţii de prietenie, să realizeze o cooperare mutuală şi echitabilă în probleme de frontieră între Republica Moldova şi Georgia;
- Luînd în considerare normele şi principiile unanim recunoscute ale dreptului internaţional şi confirmînd aspiraţia în vederea determinării principiilor şi scopurilor de cooperare în limita competenţelor sale;
- Ţînînd cont de prevederile Tratatului de prietenie şi colaborare între Republica Moldova şi Georgia, semnat la Tbilisi, la 28 noiembrie 1997;
- În conformitate cu acordurile internaţionale şi legislaţia naţională a fiecărei Părţi;
au convenit asupra celor ce urmează:
Articolul 1
Domeniile de cooperare
În conformitate cu prezentul Acord şi în limita competenţelor lor, reglementate de către legislaţia naţională a statelor lor, Părţile vor stabili şi dezvolta cooperarea în următoarele domenii:
a) Schimb de informaţii de interes reciproc, cu excepţia informaţiei atribuite la secretul de stat;
b) Activităţi operative de investigaţii cu privire la controlul frontierei;
c) Asigurarea regimului frontierei de stat şi organizarea controlului frontierei, reţinerea infractorilor frontierei de stat, precum şi familiarizarea cu metodele de coordonare şi organizare a operaţiunilor comune la frontieră;
d) Combaterea migraţiei ilegale şi traficului de fiinţe umane la frontiera de stat, în punctele de trecere a frontierei pe căile de trafic (tranzit) internaţional;
e) Combaterea criminalităţii organizate transfrontaliere, terorismului internaţional, contrabandei cu armament, arme şi muniţii explozive, otrăvitoare, radioactive, chimice şi biologice, mărfurilor şi obiectelor interzise, lucrărilor de artă şi valorilor istorice, precum şi combaterea traficului ilegal de droguri şi substanţelor psihotrope la frontiera de stat;
f) Prevenirea şi combaterea activităţilor ilegale şi altor ameninţări potenţiale, în limita competenţelor lor, în corespundere cu legislaţia naţională a statelor Părţilor;
g) Schimb de experienţă în depistarea actelor ilegale la frontiera de stat şi în punctele de trecere a frontierei;
h) Efectuarea schimbului de experienţă şi informaţii cu privire la controlul frontierei de stat, regimul frontierei de stat, precum şi realizarea activităţilor de control de frontieră prin utilizarea mijloacelor tehnice şi logistice necesare, şi instruirea/perfecţionarea specialiştilor;
i) Efectuarea schimbului de experienţă în domeniile analizei de risc, activităţilor analitice, stocării informaţiei operative şi implementării activităţilor operative de investigaţii;
j) Schimb de experienţă în activităţi chinologice;
k) Schimb de experienţă în domeniul suportului logistic mutual;
l) Schimb de acte juridice relevante cu privire la controlul frontierei de stat, precum şi schimb de publicaţii ştiinţifice, informaţii şi altor materiale relevante de interes reciproc;
m) Efectuarea schimbului de experienţă şi cunoştinţe în domeniul ajustării activităţii Părţilor la standardele şi cerinţele internaţionale şi cele mai bune practici ale statelor membre UE, precum şi în implementarea Strategiilor Managementului Integrat de Frontieră şi Planurilor de Acţiuni;
n) Efectuarea schimbului de experienţă în elaborarea programelor de instruire a instituţiilor de învăţămînt ale Părţilor;
o) Alte aspecte de interes comun, cu acordul reciproc al Părţilor.
Articolul 2
Formele cooperării
1. Cooperarea între Părţi va fi desfăşurată prin următoarele activităţi:
a) Vizite reciproce oficiale şi de lucru;
b) Organizarea cursurilor, activităţilor de instruire, seminarelor, întrevederilor de lucru şi vizitelor de studiu în scopul sporirii nivelului profesional al personalului de frontieră;
c) Implementarea şi participarea la proiectele şi programele comune.
2. În scopul coordonării cooperării pe probleme de frontieră, Părţile, periodic, vor organiza întrevederi ale conducătorilor şi reprezentanţilor Părţilor.
3. Componenţa delegaţiei, perioadele întrevederilor şi agenda consultărilor vor fi convenite de către Părţi în regim de lucru. Întrevederile reprezentanţilor Părţilor vor fi organizate, alternativ, în Republica Moldova şi Georgia.
4. Pentru implementarea prevederilor prezentului Acord, conducătorii Părţilor pot conveni încheierea protocoalelor relevante în scopul intensificării şi stabilirii direcţiilor şi formelor de cooperare stipulate în prezentul Acord.
Articolul 3
Schimbul de informaţii
1. Unităţile structurale ale Părţilor, în limita competenţelor lor, sînt în drept să solicite de la şi/sau să transmită periodic sau la necesitate celeilalte Părţi informaţia cu privire la cazurile de activităţi ilegale, care reprezintă interesul reciproc al Părţilor.
2. În anumite circumstanţe neprevăzute şi necesităţi particulare ambele Părţi sînt în drept, în limita competenţelor lor, să solicite de la şi/sau să transmită informaţia celeilalte Părţi, care nu este specificată în punctul 1 al prezentului articol, cu excepţia informaţiei atribuite la secretul de stat.
3. Părţile nu vor divulga informaţia furnizată lor pentru implementarea prevederilor prezentului Acord. Această informaţie va fi utilizată doar în scopul pentru care a fost transmisă.
4. Orice informaţie şi documente primite de către Părţi menţionate în prezentul Acord vor fi clasate ca confidenţiale şi nu vor fi divulgate unei Părţi terţe fară acordul preventiv scris al celeilalte Părţi.
Articolul 4
Unităţile structurale responsabile pentru cooperare
În corespundere cu direcţiile de cooperare determinate de către conducătorii Părţilor, unităţile autorizate ale Părţilor, menţionate mai jos, vor organiza şi implementa activităţile necesare.
Din Partea moldovenească:
a) Aparatul Central al Serviciului Grăniceri.
Din Partea georgiană:
a) Secţia cooperare internaţională de frontieră a Oficiului afaceri juridice, Poliţia de Frontieră a Ministerului Afacerilor Interne al Georgiei;
b) Secţia relaţii internaţionale a celei de-a doua Direcţii a Departamentului Poliţiei de Patrulare;
c) Departamentul Informaţional-Analitic al Ministerului Afacerilor Interne;
d) Centrul de Combatere a Terorismului al Ministerului Afacerilor Interne;
e) Academia Ministerului Afacerilor Interne.
Articolul 5
Cheltuielile
1. Fiecare Parte va suporta cheltuielile pentru punerea în aplicare a prezentului Acord pe teritoriul statului său, cu excepţia cazurilor speciale, cînd Părţile convin altfel.
2. Cheltuielile legate de vizitele delegaţiilor, cu excepţia celor pentru transportul internaţional vor fi suportate de către Partea primitoare, dacă Părţile nu vor conveni altfel.
Articolul 6
Limba oficială de lucru pe timpul cooperării
În scopul implementării prezentului Acord, Părţile vor coopera în limba engleză, dacă Părţile nu vor conveni altfel.
Articolul 7
Amendarea prezentului Acord
La înţelegerea reciprocă a Părţilor în prezentul Acord pot fi operate completări şi modificări, perfectate în modul cuvenit în protocoale separate, care vor deveni parte integrantă a Acordului şi vor intra în vigoare în conformitate cu prevederile art.10 al prezentului Acord.
Articolul 8
Soluţionarea diferendelor
Orice diferend apărut cu privire la interpretarea sau aplicarea prezentului Acord se va soluţiona de către Părţi prin consultări sau canale diplomatice.
Articolul 9
Relaţia cu alte Acorduri
1. Prevederile prezentului Acord nu vor afecta drepturile şi obligaţiile Părţilor ce reies din alte tratate internaţionale, la care Părţile sînt parte.
2. Prezentul Acord nu va prejudicia dezvoltarea altor forme de cooperare între Părţi.
Articolul 10
Intrarea în vigoare a prezentului Acord
Prezentul Acord se încheie pe un termen nelimitat şi va intra în vigoare la data ultimei notificări în scris, prin canale diplomatice, prin care Părţile se informează reciproc privind îndeplinirea procedurilor interne necesare pentru intrarea lui în vigoare.
Articolul 11
Încetarea acţiunii prezentului Acord
Fiecare dintre Părţi poate notifica în scris cealaltă Parte despre intenţia sa de a denunţa prezentul Acord. Încetarea acţiunii Acordului va surveni în a 30-a zi de la data primirii unei asemenea notificări.
Semnat la Chişinău, la 13 iunie 2011, în două exemplare originale, în limbile moldovenească, georgiană şi engleză, toate textele fiind egal autentice.
În cazul divergenţelor în interpretarea şi implementarea prevederilor prezentului Acord, textul în limba engleză va fi de referinţă.
AGREEMENT
on border cooperation between the Border Guard Service of the Republic
of Moldova and the Ministry of Internal Affairs of Georgia
The Border Guard Service of the Republic of Moldova and the Ministry of Internal Affairs of Georgia (hereinafter referred to as Parties),
- Recognising the importance of development and strengthening good relations and mutual cooperation in border guard field;
- Desiring to establish and develop friendly relations, conduct equitable and mutual cooperation on border issues between the Republic of Moldova and Georgia;
- Considering generally accepted norms and principles of the international law, confirming aspiration to define cooperation principles and aims within the scope of their competencies;
- Having regard to the provisions of the Treaty on friendship and collaboration between the Republic of Moldova and Georgia, signed in Tbilisi on 28 November 1997;
- In compliance with international agreements and the national legislation of each Parties;
have agreed on the following:
Article 1
Areas of Cooperation
The Parties, in accordance with this Agreement and their competences regulated by national legislation of their states, shall establish and develop cooperation in the following areas:
a) Exchange of information of mutual interests, with exception of information considered as the state secret;
b) Operative-investigative activities, related to border control;
c) Ensuring of state border regime and the organization of border control detention of the state border violators, as well as familiarization with the methods of coordination and organization of Joint Border Operations;
d) Fighting against illegal migration and human trafficking on state border, in border check points on international traffic (transit) roads;
e) Fighting against trans-border organized crime, international terrorism, smuggling in weapons, explosives, poisonous, radioactive, chemical, biological weapons and ammunitions, forbidden goods and objects, piece of art and historical values, as well as fight against illegal trafficking of drugs and psychotropic substances at the state border;
f) Prevent and fight against illegal activities and other potential threats within the scope of their competences in accordance with the national legislation of the Parties;
g) Exchange of experience in the detection of illegal acts on the state border and border checking points;
h) Sharing experience and exchange of information on border control, state border regime, as well as in performing border control activities through the use of necessary technical and logistical means and in training/ retraining of specialists;
i) Exchange of experience in the fields of risk analysis, analytical activities, gathering of operative information and implementation of operative-investigative activities;
j) Exchange of experience in dog handling activities;
k) Exchange of experience in mutual technical means support;
l) Sharing the relevant legal acts related to border control, as well as exchange of scientific publications, information and other related materials of mutual interest;
m) Sharing the knowledge and experience in the area of adjusting the activity of the Parties to the international requirements and best EU practices in the border field, as well as in implementation of Integrated Border Management Strategies and Action Plans;
n) Sharing experience in elaboration of training curriculum of educational institutions of the Parties;
o) Other issues of common interest, upon mutual consent of the Parties.
Article 2
Cooperation Forms
1. Cooperation between the Parties shall be carried out through the following activities:
a) Mutual official and working visits;
b) Organizing courses, trainings, seminars, working meetings and study visits in order to raise the professional level of border guard personnel;
c) Implementation of joint projects and programs.
2. In order to coordinate the cooperation on border issues the Parties shall periodically organize meetings of the heads and representatives of the Parties.
3. Composition of delegation, meeting dates and agenda of the consultations shall be agreed by Parties in working process. The meetings of the representatives of the Parties shall be organized alternatively in the Republic of Moldova and Georgia.
4. For the implementation of the provisions of this Agreementthe heads of the Parties may agree to conclude the relevant protocols in order to intensify and specify the directions and forms of cooperation stipulated in this Agreement.
Article 3
Information Exchange
1. The structural units of the Parties are entitled within the scope of their competences permanently or if necessary one-time, to request from and/or transfer to the other Party the information concerning the cases of illegal activities that represent mutual interest of the Parties.
2. In certain unforeseen circumstances and in particular needs both Parties are entitled within the scope of their competences request from and/or transfer to the other Party the information that are not listed in paragraph 1 of this Article, with exception of information considered as the state secret.
3. The Parties shall not disclose the information provided to them for the implementation of the provisions of this Agreement. This information shall be used only for the purpose for which it has been provided.
4. Any information and documents received by the Parties under this Agreement shall be treated as confidential and shall not be disclosed to a third party without the prior written consent of the providing Party.
Article 4
The Structural Units Responsible for Cooperation
According to the directions of co-operation determined by the Chiefs of the Parties, the authorized units of the Parties mentioned below shall organize and implement the necessary activities:
From Moldavian Party:
a) Headquarters of the Border Guard Service.
From Georgian Party:
a) International Border Cooperation Division of Legal Affairs Office,MIA Border Police of Georgia;
International Relations Unit of the second Division of the Patrol Police Department;
Information-Analytical Department of the Ministry of Internal Affairs;
d) Coimterterrorist Centre of the Ministry of Internal Affairs;
e) Academy of the Ministry of Internal Affairs.
Article 5
Expenses
Each Party shall bear the expenses, on its own territory, incurred in implementing this Agreement, but in special cases the Parties may agree on different arrangements.
The expenses for the delegation visits, except those for the international transport, shall be borne by the Receiving Party, unless the Parties agree otherwise.
Article 6
Official Working Language for the Cooperation
For the purpose of implementing this Agreement, the Parties shall cooperate in the English language, unless the Parties agree otherwise.
Article 7
Amendment of this Agreement
The Parties on the basis of mutual consent may make additions and amendments, in the form of separate protocols being integral parts of this Agreement and entering into force in accordance with provisions of art.10 of this Agreement.
Article 8
Settlement of Disputes
Any dispute concerning the interpretation or application of this Agreement shall be resolved by the Parties through consultations or diplomatic channels.
Article 9
Relation to other Agreements
The provisions of this Agreement shall not affect the rights and obligations arising from other international Treaties binding upon the Parties.
This Agreement shall be without prejudice to the development of other forms of cooperation of the Parties.
Article 10
Entry into Force of this Agreement
This Agreement shall be concluded for an unlimited term and enter into force following the date of the receipt of the last written notification through diplomatic channels, by which the Parties notify each other of the completion of their internal procedures for the entry into force of this Agreement.
Article 11
Termination of this Agreement
Either of the Parties can submit a written notification to the other Party on the intention of termination of this Agreement. The Agreement shall be ceased on the 30th day from the date of the receipt of such kind of notification.
Signed Chisinau on 13 June 2011 in two original copies in Moldavian, Georgian and English languages, all texts being equally authentic.
In case of divergence of interpretation and implementation of the provisions of this Agreement, the English text shall prevail.
