între Guvernul Republicii Moldova şi Guvernul Japoniei

privind cooperarea tehnică

Guvernul Republicii Moldova şi Guvernul Japoniei,

dorind să fortifice în continuare relaţiile amicale existente între cele două ţări prin promovarea cooperării tehnice, şi

considerând beneficiile reciproce derivate din promovarea dezvoltării economice şi sociale a ţărilor proprii,

au convenit asupra următoarelor:

Articolul 1

Cele două Guverne vor depune eforturi în vederea promovării cooperării tehnice între cele două ţări.

Articolul 2

Aranjamentele separate care vizează programele concrete de cooperare tehnică desfăşurate în conformitate cu acest Acord vor fi stabilite de comun acord între autorităţile competente ale celor două Guverne. Autoritatea competentă a Guvernului Republicii Moldova este Ministerul Economiei şi Comerţului, iar autoritatea competentă a Guvernului Japoniei este Ministerul Afacerilor Externe.

Articolul 3

Următoarele forme de cooperare tehnică vor fi desfăşurate de către Agenţia Niponă pentru Cooperare Internaţională (denumită în continuare “JICA”), din cont propriu în conformitate cu legile şi regulile în vigoare din Japonia precum şi cu aranjamentele menţionate în Articolul II:

a) instruirea tehnică a cetăţenilor Republicii Moldova;

b) detaşarea experţilor niponi (denumiţi în continuare “Experţi”) în Republica Moldova;

c) detaşarea voluntarilor niponi cu un spectru larg de abilităţi tehnice şi experienţă bogată (denumiţi în continuare "Voluntari Superiori") în Republica Moldova;

d) detaşarea misiunilor nipone (denumite în continuare "Misiuni") în Republica Moldova pentru a inspecta proiectele nipone de dezvoltare economică şi socială desfăşurate în Republica Moldova;

e) dotarea Guvernului Republicii Moldova cu echipament, utilaje şi materiale; precum şi

f) acordarea Guvernului Republicii Moldova a unor alte tipuri de asistenţă tehnică asupra cărora se va putea conveni prin comun acord între cele două Guverne.

Articolul 4

Guvernul Republicii Moldova va urmări ca tehnica şi cunoştinţele dobândite de către cetăţenii Republicii Moldova precum şi echipamentul, utilajele şi materialele obţinute în rezultatul cooperării tehnice nipone conform prevederilor Articolului III să contribuie la dezvoltarea economică şi socială a Republicii Moldova şi să nu fie utilizate în scopuri militare.

Articolul 5

În cazul detaşării de către Partea niponă a Experţilor, Voluntarilor Superiori şi Misiunilor, Guvernul Republicii Moldova:

1. (1) (a) va scuti Experţii, Voluntarii Superiori şi membrii Misiunilor de impozite şi taxe, inclusiv impozit pe venit şi de plăţi fiscale impuse sau legate de salarii sau alte plăţi parvenite din afară;

(b) va scuti Experţii, Voluntarii Superiori şi membrii Misiunilor şi familiile lor de taxe consulare, impozite şi taxe, inclusiv taxe vamale şi plăţi fiscale, precum şi de cerinţele pentru obţinerea licenţei de import şi certificatului de acoperire valutară, în legătură cu importul:

(i) bagajelor;

(ii) bunurilor personale, casnice şi de consum; şi

(iii) câte un vehicul motorizat pentru Expert, pentru familia Expertului, pentru Voluntar Superior şi pentru familia Voluntarului Superior repartizat pentru a locui în Republica Moldova;

(c) va scuti Experţii, Voluntarii Superiori şi membrii familiilor lor, care nu vor importa vreun vehicul motorizat în Republica Moldova, de impozite şi taxe, inclusiv taxa pe valoare adăugată şi plăţi fiscale, pentru procurarea pe loc a câte un vehicul motorizat pentru fiecare Expert, pentru familia Expertului, pentru Voluntar Superior şi pentru familia Voluntarului Superior; şi

(d) va scuti Experţii, Voluntarii Superiori şi membrii familiilor lor de taxa de înregistrare pentru vehiculele motorizate menţionate în punctele (b) (iii) şi (c).

(2) (a) va oferi din mijloacele proprii spaţiu potrivit şi alte facilităţi, inclusiv servicii de telefonie şi fax necesare pentru efectuarea sarcinilor Experţilor, Voluntarilor Superiori şi Misiunilor, cât şi să suporte cheltuielile legate de funcţionarea şi întreţinerea acestui spaţiu;

(b) va oferi din mijloace proprii personal local (inclusiv traducători calificaţi, în cazuri de necesitate), precum şi colaboratorii moldoveni pentru Experţi, Voluntari Superiori şi Misiuni necesari pentru efectuarea sarcinilor lor;

(c) va suporta cheltuielile Experţilor şi Voluntarilor Superiori, oricând condiţiile locale şi posibilităţile financiare a agenţiilor executoare a Guvernului Republicii Moldova vor permite, legate de:

(i) călătoriile zilnice la şi de la locul de muncă;

(ii) călătoriile oficiale pe teritoriul Republicii Moldova; şi

(iii) corespondenţa lor oficială;

(d) va oferi posibilitatea pentru achiziţia spaţiului locativ corespunzător pentru Experţi, Voluntari Superiori, membri ai Misiunilor şi familiile lor; şi

(e) va oferi posibilitate pentru primirea îngrijirii medicale pentru Experţi, Voluntari Superiori şi familiile lor.

(3) (a) va permite Experţilor, Voluntarilor Superiori, membrilor Misiunilor şi familiilor lor să intre, să părăsească şi să locuiască pe teritoriul Republicii Moldova pentru durata detaşării lor, va facilita procedurile de înregistrare a străinilor şi îi va scuti de taxele consulare;

(b) va elibera acte de identitate Experţilor, Voluntarilor Superiori şi membrilor Misiunilor pentru a asigura colaborarea cu toate organizaţiile guvernamentale necesare pentru îndeplinirea sarcinilor lor;

(c) va oferi Experţilor, Voluntarilor Superiori şi familiilor lor posibilitatea obţinerii permiselor de conducere; şi

(d) va întreprinde alte măsuri necesare pentru îndeplinirea sarcinilor Experţilor, Voluntarilor Superiori şi Misiunilor.

2. Vehiculele motorizate menţionate în paragraful 1 vor constitui subiectul impozitării, inclusiv taxele vamale, în cazul în care vor fi ulterior vândute sau transmise pe teritoriul Republicii Moldova unor persoane sau organizaţii, care nu beneficiază de astfel de scutiri de taxe şi impozite sau facilităţi similare.

3. Guvernul Republicii Moldova va oferi Experţilor, Voluntarilor Superiori, membrilor Misiunilor şi familiilor lor astfel de facilităţi, scutiri şi beneficii, care nu sunt mai puţin favorabile decât cele acordate experţilor, voluntarilor Superiori, membrilor Misiunilor şi familiilor lor din oricare altă ţară sau organizaţie internaţională care îndeplineşte o misiune similară în Republica Moldova.

Articolul 6

Guvernul Republicii Moldova va suporta reclamaţiile, în cazul apariţiei lor, contra Experţilor, Voluntarilor Superiori şi membrilor Misiunilor, rezultate din, apărute în cursul, sau legate în alt mod de îndeplinirea sarcinilor lor, cu excepţia cazurilor când cele două Guverne vor conveni că aceste reclamaţii au apărut în urma neglijenţei sau conduitei necorespunzătoare din partea Experţilor, Voluntarilor Superiori sau membrilor Misiunilor.

Articolul 7

1. (1) În cazul în care JICA va oferi Guvernului Republicii Moldova echipament, utilaj şi materiale, Guvernul Republicii Moldova va scuti acest echipament, utilaj şi materiale de taxe consulare, impozite şi taxe, inclusiv taxe vamale şi plăţi fiscale, precum şi de cerinţele pentru obţinerea licenţei de import şi certificatului de acoperire valutară, în ceea ce priveşte importul. Echipamentul, utilajul şi materialele menţionate mai sus vor deveni proprietatea Guvernului Republicii Moldova, după ce vor fi livrate c.i.f. în portul de debarcare a autorităţilor competente ale Guvernului Republicii Moldova.

(2) În cazul în care JICA va oferi Guvernului Republicii Moldova echipament, utilaj şi materiale, Guvernul Republicii Moldova va scuti acest echipament, utilaj şi materiale de impozite şi taxe, inclusiv taxa pe valoare adăugată şi plăţi fiscale în ceea ce priveşte procurarea locală.

(3) Echipamentul, utilajul şi materialele menţionate în subparagrafele (1) şi (2) va fi utilizat în conformitate cu scopul specificat în aranjamentele menţionate în Articolul II al acestui Acord, cu excepţia cazurilor când există alte înţelegeri între autorităţile competente ale celor două Guverne.

(4) Cheltuielile de transport pe teritoriul Republicii Moldova a echipamentului, utilajului şi materialelor menţionate în sub-paragrafele (1) şi (2), cât şi cheltuielile de înlocuire, întreţinere şi reparaţie vor fi suportate de Guvernul Republicii Moldova.

2. (1) Echipamentul, utilajul şi materialele pregătite de JICA, necesare pentru îndeplinirea sarcinilor Experţilor, Voluntarilor Superiori şi membrilor Misiunilor, va rămâne proprietatea JICA, cu excepţia cazurilor când există alte înţelegeri între autorităţile competente ale celor două Guverne.

(2) Guvernul Republicii Moldova va scuti Experţii, Voluntarii Superiori şi membrii Misiunilor de taxe consulare, impozite şi taxe, inclusiv taxe vamale şi plăţi fiscale în ceea ce priveşte importul echipamentului, utilajului şi materialelor menţionate în subparagraful (1).

(3) Guvernul Republicii Moldova va scuti Experţii, Voluntarii Superiori şi membrii Misiunilor de impozite şi taxe, inclusiv taxa pe valoare adăugată şi plăţi fiscale în ceea ce priveşte procurarea locală a echipamentului, utilajului şi materialelor menţionate în sub-paragraful (1).

Articolul 8

Guvernul Republicii Moldova va menţine legătură strânsă, prin intermediul organizaţiilor desemnate de acesta, cu Experţii, Voluntarii Superiori şi membrii Misiunilor.

Articolul 9

1. Guvernul Republicii Moldova va permite JICA să dispună de un oficiu în Republica Moldova (denumit în continuare “Oficiu”) şi va permite ca reprezentantul rezident şi colaboratorii săi să fie trimişi de Japonia (denumiţi în continuare “Reprezentant” şi “Colaboratori”, respectiv), pentru îndeplinirea sarcinilor stabilite de JICA, în corespundere cu programele de cooperare tehnică specificate în acest Acord.

2. Guvernul Republicii Moldova:

(1) (a) va scuti Reprezentantul, Colaboratorii şi familiile lor de impozite şi taxe, inclusiv impozit pe venit şi de plăţi fiscale impuse sau legate de salarii sau alte plăţi parvenite din afară;

(b) va scuti Reprezentantul, Colaboratorii şi familiile lor de taxe consulare, impozite şi taxe, inclusiv taxe vamale şi plăţi fiscale precum şi de cerinţele pentru obţinerea licenţei de import şi certificatului de acoperire valutară, în legătură cu importul:

(i) bagajelor;

(ii) bunurilor personale, casnice şi de consum; şi

(iii) câte un vehicul motorizat pentru Reprezentant, pentru Colaborator şi câte unul pentru familia Reprezentantului şi cea a Colaboratorului repartizat pentru a locui în Republica Moldova;

(c) va scuti Reprezentantul, Colaboratorii şi familiile lor, care nu vor importa vreun vehicul motorizat în Republica Moldova, de impozite şi taxe, inclusiv taxa pe valoare adăugată şi plăţi fiscale pentru procurarea pe loc a câte un vehicul motorizat pentru Reprezentant, pentru Colaboratori şi pentru familiile Reprezentantului şi Colaboratorilor;

(d) va scuti Reprezentantul, Colaboratorii şi familiile lor de taxa de înregistrare pentru vehiculele motorizate menţionate în punctele (b), (iii) şi (c);

(e) va permite Reprezentantului, Colaboratorilor şi familiilor lor să intre, să părăsească şi să locuiască pe teritoriul Republicii Moldova pentru durata detaşării lor, va facilita procedurile de înregistrare a străinilor şi îi va scuti de taxele consulare:

(f) va elibera acte de identitate şi permise speciale Reprezentantului şi Colaboratorilor pentru a intra în aeroport /port maritim după punctul de control al paşapoartelor pentru a întâmpina sau petrece Experţii, Voluntarii Superiori şi membrii Misiunilor;

(g) va oferi Reprezentantului, Colaboratorilor şi familiilor lor posibilitatea obţinerii permiselor de conducere; şi

(h) va întreprinde alte măsuri necesare pentru îndeplinirea sarcinilor Reprezentantului şi Colaboratorilor.

(2) (a) va scuti Oficiul de taxe consulare, impozite şi taxe. inclusiv taxe vamale şi plăţi fiscale precum şi de cerinţele pentru obţinerea licenţei de import şi certificatului de acoperire valutară, în ceea ce priveşte importul echipamentului, utilajului, vehiculelor motorizate şi materialelor necesare activităţii Oficiului;

(b) va scuti Oficiul de impozite şi taxe, inclusiv taxa pe valoare adăugată şi plăţi fiscale pentru procurarea pe loc a echipamentului, utilajului, vehiculelor motorizate şi materialelor necesare activităţii Oficiului;

(c) va scuti Oficiul de taxa de înregistrare pentru vehiculele motorizate menţionate în punctele (a) şi (b); şi

(d) va scuti Oficiul de impozite şi taxe, inclusiv impozitul pe venit şi alte plăţi fiscale, legate de cheltuielile Oficiului transferate din străinătate.

3. Vehiculele motorizate menţionate în paragraful 2 vor constitui subiectul achitării impozitelor şi taxelor, inclusiv taxe vamale, în cazul în care vor fi ulterior vândute sau transmise pe teritoriul Republicii Moldova unor persoane sau organizaţii, care nu beneficiază de astfel de scutiri de impozite şi taxe sau facilităţi similare.

4. Guvernul Republicii Moldova va oferi Reprezentantului, Colaboratorilor şi familiilor lor astfel de facilităţi, scutiri şi beneficii, care nu sunt mai puţin favorabile decât cele acordate Reprezentanţilor, Colaboratorilor şi familiilor lor din oricare altă ţară sau organizaţie internaţională care îndeplineşte o misiune similară în Republica Moldova.

Articolul 10

Guvernul Republicii Moldova va întreprinde toate măsurile necesare pentru asigurarea securităţii Experţilor, Voluntarilor Superiori, membrilor Misiunilor, Reprezentantului, Colaboratorilor şi familiilor lor pe durata aflării lor în Republica Moldova.

Articolul 11

Ambele Guverne se vor consulta reciproc în privinţa oricăror probleme care ar putea apărea în legătură cu acest Acord.

Articolul 12

1. Din momentul intrării în vigoare a Acordului dat, prevederile lui se vor extinde, de asemenea, asupra programelor concrete de cooperare tehnică, care au început până la intrarea în vigoare a Acordului dat, asupra Experţilor, Voluntarilor Superiori, membrilor Misiunilor, Reprezentantului, Colaboratorilor şi familiilor lor, aflaţi în Republica Moldova, precum şi asupra echipamentului, utilajului şi materialelor utilizate în cadrul programelor menţionate.

2. Expirarea validităţii acestui Acord nu va afecta programele specifice de cooperare tehnică în derulare, până la data finalizării programelor date, cu excepţia deciziilor de comun acord a celor două Guverne, nici nu va afecta facilităţile, scutirile şi beneficiile acordate Experţilor, Voluntarilor Superiori, membrilor Misiunilor. Reprezentantului, Colaboratorilor şi familiilor lor aflaţi în Republica Moldova pentru îndeplinirea sarcinilor lor în cadrul programelor menţionate.

Articolul 13

1. Prezentul Acord va intra în vigoare la data primirii de către Guvernul Japoniei a notificării în scris din partea Guvernului Republicii Moldova despre îndeplinirea tuturor procedurilor interne necesare pentru intrarea în vigoare a acestui Acord.

2. Prezentul Acord se încheie pe un termen de un an şi va fi reînnoit automat în fiecare an pentru o nouă perioadă de un an, cu excepţia cazului când unul din Guverne a prezentat celuilalt Guvern notificare în scris cu cel puţin şase luni până la expirare, despre intenţia de a rezilia Acordul.

Drept pentru care reprezentanţii Părţilor respective împuterniciţi au semnal prezentul Acord.

Semnat la Chişinău, la 14 mai 2008, în două exemplare originale, în limba engleză.

AGREEMENT

on technical cooperation between the Government of the

Republic of Moldova and the Government of Japan

The Government of the Republic of Moldova and the Government of Japan,

desiring to strengthen further the friendly relations existing between the two countries by the promotion of technical cooperation, and

considering mutual benefits derived from promoting the economic and social development of their respective countries,

have agreed as follows:

Article 1

The two Governments shall endeavor to promote technical cooperation between the two countries.

Article 2

Separate arrangements which govern specific technical cooperation programs carried out under this Agreement shall be agreed upon between the competent authorities of the two Governments. The competent authority of the Government of the Republic of Moldova is the Ministry of Economy and Trade, and the competent authority of the Government of Japan is the Ministry of Foreign Affairs.

Article 3

The following forms of technical cooperation will be carried out by the Japan International Cooperation Agency (hereinafter referred to as "JICA") at its own expense in accordance with the laws and regulations in force in Japan as well as with the arrangements referred to in Article II:

(a) providing technical training to Moldovan nationals;

(b) dispatching experts (hereinafter referred to as the "Experts") to the Republic of Moldova;

(c) dispatching Japanese volunteers with a wide range of technical skills and abundant experience (hereinafter referred to as the "Senior Volunteers") to the Republic of Moldova;

(d) dispatching Japanese missions (hereinafter referred to as the "Missions") to the Republic of Moldova to conduct surveys of economic and social development projects of the Republic of Moldova;

(e) providing the Government of the Republic of Moldova with equipment, machinery and materials; and

(f) providing the Government of the Republic of Moldova with other forms of technical cooperation as may be decided upon by mutual consent between the two Governments.

Article 4

The Government of the Republic of Moldova shall ensure that the techniques and knowledge acquired by Moldovan nationals as well as the equipment, machinery and materials provided as a result of the Japanese technical cooperation as set forth in Article III contribute to the economic and social development of the Republic of Moldova, and are not utilized for military purposes.

Article 5

In case JICA dispatches the Experts, the Senior Volunteers and the Missions, the Government of the Republic of Moldova shall:

1. (1) (a) exempt the Experts, the Senior Volunteers and members of the Missions from taxes including income tax, and fiscal charges imposed on or in connection with salaries and any allowances remitted to them from abroad;

(b) exempt the Experts, the Senior Volunteers, members of the Missions and their families from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of:

(i) luggage;

(ii) personal effects, household effects and consumer goods; and

(iii) one motor vehicle per Expert, per family of the Expert, per Senior Volunteer and per family of the Senior Volunteer assigned to stay in the Republic of Moldova;

c) exempt the Experts, the Senior Volunteers and their families who do not import any motor vehicle into the Republic of Moldova from taxes including value added tax and fiscal charges in respect of the local purchase of one motor vehicle per Expert, per family of the Expert, per Senior Volunteer and per family of the Senior Volunteer; and

(d) exempt the Experts, the Senior Volunteers and their families from the registration fee of the motor vehicles mentioned in (b)(iii) and (c).

(2) (a) provide at its own expense suitable office and other facilities including telephone and facsimile services necessary for the performance of the duties of the Experts, the Senior Volunteers and the Missions as well as bear the expenses for their operation and maintenance;

(b) provide at its own expense the local staff (including adequate interpreters, if necessary) as well as Moldovan counterparts to the Experts, the Senior Volunteers and the Missions necessary for the performance of their duties;

(c) bear expenses of the Experts and the Senior Volunteers, whenever local conditions and financial possibilities of the executing agencies of the Government of the Republic of Moldova may permit, for:

(i) daily transportation to and from their place of work;

(ii) their official travels within the Republic of Moldova; and

(iii) their official correspondence;

(d) provide the convenience for acquisition of appropriate housing accommodation for the Experts, the Senior Volunteers and their families; and

(e) provide the convenience for receiving medical care and facilities for the Experts, the Senior Volunteers, members of the Missions and their families.

(3) (a) permit the Experts, the Senior Volunteers, members of the Missions and their families to enter, leave and sojourn in the Republic of Moldova for the duration of their assignment therein, offer them the convenience for procedures of alien registration requirements, and exempt them from consular fees;

(b) issue identification cards to the Experts, the Senior Volunteers and members of the Missions to secure the cooperation of all governmental organizations necessary for the performance of their duties;

(c) offer the Experts, the Senior Volunteers and their families the convenience for acquisition of car driving license; and

(d) carry out other measures necessary for the performance of the duties of the Experts, the Senior Volunteers and the Missions.

2. The motor vehicles mentioned in paragraph 1. shall be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Republic of Moldova to individuals or organizations not entitled to exemption from such taxes or similar privileges.

3. The Government of the Republic of Moldova shall accord the Experts, the Senior Volunteers, members of the Missions and their families such privileges, exemptions and benefits as are no less favorable than those accorded to experts, senior volunteers, members of missions and their families of any third country or of any international organization performing a similar mission in the Republic of Moldova.

Article 6

The Government of the Republic of Moldova shall bear claims, if any arises, against the Experts, the Senior Volunteers and members of the Missions resulting from, occurring in the course of, or otherwise connected with, the performance of their duties, except when the two Governments agree that such claims arise from gross negligence or willful misconduct on the part of the Experts, the Senior Volunteers or members of the Missions.

Article 7

1. (1) In case JICA provides the Government of the Republic of Moldova with equipment, machinery and materials, the Government of the Republic of Moldova shall exempt such equipment, machinery and materials from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation. The equipment, machinery and materials mentioned above shall become the property of the Government of the Republic of Moldova upon being delivered c.i.f. at the port of the disembarkation to competent authorities of the Government of the Republic of Moldova.

(2) In case JICA provides the Government of the Republic of Moldova with equipment, machinery and materials, the Government of the Republic of Moldova shall exempt such equipment, machinery and materials from taxes including value added tax and fiscal charges in respect of the local purchase.

(3) The equipment, machinery and materials mentioned in sub-paragraph (1) and (2) shall be utilized for the purpose specified in the arrangements referred to in Article II unless otherwise agreed upon between the competent authorities of the two Governments.

(4) The expenses for the transportation within the Republic of Moldova of the equipment, machinery and materials mentioned in sub-paragraph (1) and (2) and the expenses for their replacement, maintenance and repair shall be borne by the Government of the Republic of Moldova.

2. (1) The equipment, machinery and materials, prepared by JICA, necessary for the performance of the duties of the Experts, the Senior Volunteers and members of the Missions shall remain the property of JICA unless otherwise agreed upon between the competent authorities of the two Governments.

(2) The Government of the Republic of Moldova shall exempt the Experts, the Senior Volunteers and members of the Missions from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of the equipment, machinery and materials mentioned in sub-paragraph (1).

(3) The Government of the Republic of Moldova shall exempt the Experts, the Senior Volunteers and members of the Missions from taxes including value added tax and fiscal charges in respect of the local purchase of the equipment, machinery and materials mentioned in sub-paragraph (1).

Article 8

The Government of the Republic of Moldova shall maintain close contact, through organizations designated by it, with the Experts, the Senior Volunteers and members of the Missions.

Article 9

1. The Government of the Republic of Moldova shall admit JICA to open and maintain an overseas office in the Republic of Moldova (hereinafter referred to as the "Office") and shall accept a resident representative and his/her staff to be dispatched from Japan (hereinafter referred to as the "Representative" and the "Staff” respectively) who perform the duties to be assigned to them by JICA relative to the technical cooperation programs under this Agreement in the Republic of Moldova.

2. The Government of the Republic of Moldova shall:

(1) (a) exempt the Representative, the Staff and their families from taxes including income tax and fiscal charges imposed on or in connection with salaries and any allowances remitted to them from abroad;

(b) exempt the Representative, the Staff and their families from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of:

(i) luggage;

(ii) personal effects, household effects and consumer goods; and

(iii) one motor vehicle per Representative, per Staff, per family of the Representative and per that of the Staff assigned to stay in the Republic of Moldova;

(c) exempt the Representative, the Staff and their families who do not import any motor vehicle into the Republic of Moldova from taxes including value added tax and fiscal charges in respect of the local purchase of one motor vehicle per Representative, per Staff, per family of the Representative and per that of the Staff;

(d) exempt the Representative, the Staff and their families from the registration fee of the motor vehicles mentioned in (b) (iii) and (c);

(e) permit the Representative, the Staff and their families to enter, leave and sojourn in the Republic of Moldova for the duration of their assignment therein, offer them the convenience for procedures of alien registration requirements, and exempt them from consular fees;

(f) issue identification cards and special passes to the Representative and the Staff to enter airport/seaport beyond passport control point to receive and send off the Experts, the Senior Volunteers and members of the Missions;

(g) offer the Representative, the Staff and their families the convenience for acquisition of car driving license; and

(h) carry out other measures necessary for the performance of the duties of the Representative and the Staff.

(2) (a) exempt the Office from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of the equipment, machinery, motor vehicles and materials necessary for activities of the Office;

(b) exempt the Office from taxes including value added tax and fiscal charges in respect of the local purchase of the equipment, machinery, motor vehicles and materials necessary for the functions of the Office;

(c) exempt the Office from the registration fee of the motor vehicles mentioned in (a) and (b); and

(d) exempt the Office from taxes including income tax and fiscal charges imposed on or in connection with office expenses remitted from abroad.

3. The motor vehicles mentioned in paragraph 2 shall be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Republic of Moldova to individuals or organizations not entitled to exemption from such taxes or similar privileges.

4. The Government of the Republic of Moldova shall accord the Representative, the Staff and their families as well as the Office such privileges, exemptions and benefits as are no less favorable than those accorded to representatives, staff and their families as well as offices of any third country or of any international organization performing a similar mission in the Republic of Moldova.

Article 10

The Government of the Republic of Moldova shall take necessary measures to ensure security of the Experts, the Senior Volunteers, members of the Missions, the Representative, the Staff and their families staying in the Republic of Moldova.

Article 11

The two Governments shall consult with each other in respect of any matter that may arise from or in connection with this Agreement.

Article 12

1. The provisions of this Agreement shall also apply, after the entering into force of this Agreement, to the specific technical cooperation programs which have commenced prior to the entering into force of this Agreement, and to the Experts, the Senior Volunteers, members of the Missions, the Representative, the Staff and their families staying in the Republic of Moldova as well as to the equipment, machinery and materials related to the said programs.

2. The termination of this Agreement shall neither affect the specific technical cooperation programs being carried out until the date of the completion of the said programs, unless otherwise decided upon by mutual consent between the two Governments, nor affect the privileges, exemptions and benefits accorded to the Experts, the Senior Volunteers, members of the Missions, the Representative, the Staff and their families staying in the Republic of Moldova for the performance of their duties in connection with the said programs.

Article 13

1. This Agreement shall enter into force on the date of receipt by the Government of Japan of the written notification from the Government of the Republic of Moldova of the completion of necessary domestic procedures for the entry into force of this Agreement.

2. This Agreement shall remain in force for a period of one year, and shall be automatically renewed every year for another period of one year each, unless either Government has given to the other Government at least six months' written advance notice of its intention to terminate the Agreement.
