şi Irlandei de Nord cu privire la transportul rutier internaţional

Guvernul Republicii Moldova şi Guvernul Regatului Unit al Marii Britanii şi Irlandei de Nord (denumite în continuare "Părţi");
Manifestîndu-şi dorinţa de a facilita transportul rutier internaţional între ţările lor şi în tranzit prin teritoriile lor;
Au convenit asupra următoarelor:
DEFINIŢII
Articolul 1
In scopurile prezentului Acord:
(1) termenul "transportator" va defini orice persoană fizică sau juridică, care pe teritoriul Republicii Moldova sau al Regatului Unit, este autorizată în conformitate cu legile şi regulamentele relevante naţionale să se ocupe de transportul rutier internaţional de pasageri sau mărfuri prin angajare sau prin remunerare, sau pe cont propriu;
(2) termenul "vehicul de pasageri" va defini orice mijloc de transport rutier cu propulsie mecanică, care:
(a) este construit sau adaptat pentru folosire şi este folosit la transportul de persoane pe reţeaua rutieră;
(b) dispune de mai mult de nouă locuri, inclusiv locul şoferului;
(c) este înregistrat pe teritoriul unei Părţi şi este posedat sau folosit de sau în numele unui transportator, autorizat să transporte pasageri pe teritoriul dat; şi
(d) se află temporar pe teritoriul celeilalte Părţi cu scopul efectuării transportului internaţional de pasageri spre, din sau în tranzit prin acest teritoriu;
(3) termenul "vehicul de mărfuri" va defini orice mijloc de transport rutier cu propulsie mecanică, care este:
(a) construit sau adaptat pentru folosire şi este folosit în scopul transportului de mărfuri pe reţeaua rutieră;
(b) înregistrat pe teritoriul unei Părţi; şi
(c) temporar aflat pe teritoriul celeilalte Părţi cu scopul efectuării transportului internaţional de mărfuri pentru livrare sau colectare în orice punct al teritoriului dat, sau în tranzit prin acest teritoriu;
şi orice remorcă sau semiremorcă care corespunde condiţiilor (a) şi (c) ale prezentului punct, şi este operată de un transportator al unei Părţi; în cazul în care remorca sau semiremorca şi vehiculul respectiv de tracţiune, ambele corespund condiţiilor punctului dat, combinaţia celor două va fi considerată ca un vehicul unic;
(4) termenul "teritoriu"
cu referinţă la Republica Moldova, va defini cel al Republicii Moldova;
cu referinţă la Regatul Unit, va defini cel al Angliei, Ţării Galilor (Wales), Scoţiei, Irlandei de Nord, Insulelor Normande, Insulei Man şi Gibraltarului;
(5) autorităţile competente sînt:
în Republica Moldova - Ministerul Transporturilor şi Gospodăriei Drumurilor;
în Regatul Unit - Departamentul Transportului.
TRANSPORTUL DE PASAGERI
Articolul 2
Servicii de transport
Transportatorilor licenţiaţi pe teritoriul Republicii Moldova sau al Regatului Unit li se va permite efectuarea serviciilor de transport, folosind vehicule de pasageri, înregistrate pe teritoriul unde sînt stabiliţi, atît între teritoriile Părţilor, cît şi în tranzit prin teritoriul fiecărei Părţi, în conformitate cu condiţiile stabilite de prezentul Acord.
Articolul 3
Autorizaţii şi scutiri
(1) Transportul de persoane cu vehicule de pasageri ale unui transportator, autorizat pe teritoriul unei Părți, spre sau din orice punct pe teritoriul celelalte Părți sau în tranzit prin acest teritoriu, cu excepția serviciilor specificate în punctul 2 al prezentului Acord, sete necesar să fie autorizat de cealaltă Parte.
(2) Următoarele servicii vor fi scutite de necesitatea autorizării, menţionate în punctul 1 al prezentului Articol:
(a) "transporturi cu uşile închise", sînt serviciile cînd acelaşi vehicul este folosit pentru transportul aceluiaşi grup de pasageri pe durata întregii călătorii şi întoarcerea lui la locul de plecare;
(b) "servicii tur" sînt serviciile cînd un grup de pasageri este adus pe teritoriul celeilalte Părţi pentru un sejur temporar şi vehiculul de pasageri părăseşte acest teritoriu deşert sau printr-un serviciu specificat în punctul (c) de mai jos;
(c) "servicii retur" sînt serviciile cînd un vehicul de pasageri este folosit pentru a intra deşert pe teritoriul celeilalte Părţi sau printr-un serviciu menţionat în punctul (b) de mai sus şi transportă spre teritoriul în care transportatorul este autorizat un grup de pasageri, din care orice pasager:
- a fost transportat pe teritoriul celeilalte Părţi de transportator;
- a încheiat înainte de călătorie un contract vizînd ambele călătorii pe teritoriul Părţii unde transportatorul este autorizat.
(d) "servicii navetă" sînt serviciile cînd prin călătorii repetate tur-retur grupurile de pasageri formate preventiv sînt transportate dintr-un anumit loc de plecare spre un anumit loc de destinaţie. Fiecare grup de pasageri care a efectuat o călătorie tur va fi ulterior transportat înapoi la locul de plecare în aceeaşi componenţă. In timpul călătoriei pasagerii nu vor fi îmbarcaţi sau debarcaţi. Prima călătorie "retur" şi ultima călătorie "tur" se vor efectua fără pasageri;
(e) tranzitul prin teritoriul celeilalte Părţi, efectuat de un vehicul deşert de pasageri în cadrul călătoriei spre sau dintr-o ţară terţă;
(f) înlocuirea unui vehicul de pasageri care a devenit inoperabil cu unul operabil.
TRANSPORTUL DE MĂRFURI
Articolul 4
Transportul autorizat de mărfuri
Sub rezerva prevederilor Articolului 5 al prezentului Acord, transportatorul, autorizat pe teritoriul unei Părţi, va avea dreptul, fără a fi obligat să obţină un permis, o licenţă sau un alt fel de autorizaţie pentru acest scop în conformitate cu legile celeilalte Părţi, să importe temporar un vehicul cu sau fără marfă pe teritoriul celeilalte Părţi pentru transportarea mărfurilor, inclusiv încărcături retur:
(a) între orice punct pe teritoriul unei Părţi şi orice punct pe teritoriul celeilalte Părţi;
(b) în tranzit prin teritoriul celeilalte Părţi; şi
(c) între orice punct pe teritoriul celeilalte Părţi şi orice punct pe teritoriul unei ţări terţe.
Articolul 5
Permise speciale
Fiecare Parte poate să ceară pe teritoriul ei un permis special pentru folosirea vehiculelor care din motive de greutate sau dimensiuni, sau ale încărcăturii transportate, nu pot în caz contrar circula legal pe teritoriul acestei Părţi.
PREVEDERI GENERALE
Articolul 6
Taxarea
(1) Vehiculele de pasageri şi mărfuri, înregistrate pe teritoriul unei Părţi şi aflate temporar pe teritoriul celeilalte Părţi, vor fi scutite de taxe şi plăţi impuse pentru folosirea drumurilor sau pentru posedarea vehiculelor, şi de taxe şi impozite pentru operaţiuni de transport, efectuate pe teritoriul celeilalte Părţi.
(2) Scutirile, menţionate în punctul 1 al prezentului Articol, vor fi acordate pe teritoriul ambelor Părţi cît timp sînt respectate prevederile expuse în Regulamentul Vamal în vigoare pe teritoriul respectiv cu privire la admiterea temporară a unor asemenea vehicule pe acest teritoriu fără plata impozitelor şi taxelor de import.
(3) Scutirile, menţionate în punctul 1 al prezentului Articol, nu se vor aplica la taxele şi plăţile incluse în preţul combustibilului sau la taxele rutiere, sau plăţile pentru folosirea unor anumitor poduri, tuneluri, feriboturi, drumuri, porţiuni de drumuri sau drumurilor de o anumită categorie.
(4) Combustibilul, păstrat în rezervoarele standard ale unui vehicul, va fi scutit de taxe şi impozite.
(5) Piesele de schimb, aduse temporar pe teritoriul celeilalte Părţi cu scopul unor eventuale depanări ale vehiculelor care operează în cadrul prezentului Acord, vor fi scutite de taxele vamale şi de alte taxe şi plăţi de import în conformitate cu Regulamentul Vamal. Piesele înlocuite urmează a fi reexportate sau distruse sub controlul autorităţilor vamale competente ale celeilalte Părţi.
Articolul 7
Neadmiterea cabotajului
Nici o prevedere a prezentului Acord nu poate fi folosită pentru a permite unui transportator autorizat să opereze pe teritoriul unei Părţi, să ia pasageri sau mărfuri într-un punct pe teritoriul celeilalte Părţi pentru a debarca pasagerii sau a livra marfa într-un alt punct de pe acest teritoriu.
Articolul 8
Respectarea legislaţiei naţionale
Cu excepţia cazurilor, cînd acordurile între Părţi, inclusiv prezentul Acord, prevăd altfel:
(a) transportatorii şi şoferii unei Părţi, şi vehiculele de pasageri, aşa cum au fost definite în Articolul 1 (2) al prezentului Acord, şi vehiculele de mărfuri, aşa cum au fost definite în Articolul 1 (3) al prezentului Acord, pe durata aflării lor pe teritoriul celeilalte Părţi, vor respecta legislaţia şi regulamentele naţionale în vigoare pe acest teritoriu cu privire la transportul rutier şi traficul rutier;
(b) nici una din Părţi nu va aplica vehiculelor de pasageri sau mărfuri ale celeilalte Părţi restricţii mai severe decît cele aplicate propriilor vehicule de legislaţia şi regulamentele naţionale.
Articolul 9
Infracţiuni
(1) În cazul oricărei încălcări ale prevederilor prezentului Acord de un vehicul sau şofer al unei Părţi, aflîndu-se pe teritoriul celeilalte Părţi, autorităţile competente ale Părţii pe teritoriul căreia a fost comisă încălcarea au dreptul (fără a afecta sancţiunile legale care instanţele judecătoreşti sau autorităţile executive ale acestei Părţi pot să le aplice) să ceară de la autorităţile competente ale celeilalte Părţi:
(a) să emită o avertizare transportatorului în cauză;
(b) să emită o astfel de avertizare însoţită de o notificare în care se va indica că o încălcare ulterioară va duce la interdicţia temporară sau permanentă de a intra pe teritoriul Părţii în care a fost comisă încălcarea pentru vehiculele care aparţin transportatorului în cauză sau sînt folosite de el; sau
(c) să emită o notificare cu o astfel de interdicţie.
(2) La primirea unei asemenea cereri autorităţile competente se vor conforma acesteia şi vor informa cît mai curînd posibil autorităţile competente ale celeilalte Părţi despre acţiunile întreprinse.
PREVEDERI FINALE
Articolul 10
Comisia mixtă
La cererea oricărei autorităţi competente, reprezentanţii ambelor se vor întruni în cadrul unei Comisii mixte pentru a revedea funcţionarea Acordului.
Articolul 11
Intrarea în vigoare şi durata
(1) Prezentul Acord va intra în vigoare după 30 de zile de la data ultimei dintre notificări prin canale diplomatice ale fiecărei Părţi despre îndeplinirea procedurilor interne, necesare intrării lui în vigoare.
(2) Prezentul Acord se încheie pe o perioadă de doi ani şi se va prelungi de fiecare dată pe aceeaşi perioadă, ori de cîte ori nici una dintre Părţi nu va notifica în scris, cu cel puţin şase luni înaintea expirării termenului menţionat, intenţia sa de a denunţa Acordul.
Întru confirmarea celor expuse subsemnaţii, autorizaţi de Guvernele lor respective, au semnat prezentul Acord.
Încheiat la 15 octombrie 1996 la Londra în două exemplare, fiecare în limbile moldovenească şi engleză, toate textele fiind egal autentice.

AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA AND
THE GOVERNMENT OF THE UNITED KINGDOM OF GREAT BRITAIN
AND NORTHERN IRELAND ON INTERNATIONAL ROAD TRANSPORT
The Government of the Republic of Moldova and the Government of the United Kingdom of Great Britain and Northern Ireland (hereinafter called "the Parties");
Desiring to facilitate international road transport between their two countries and in transit through their territories;
Have agreed as follows:
DEFINITIONS
ARTICLE 1
For the purposes of this Agreement:
(1) the term "carrier" shall mean any physical or legal person who, in either the territory of the United Kingdom or of the Republic of Moldova, is authorised in accordance with the relevant national laws and regulations to engage in the international carriage of passengers or goods by road for hire or reward or on his own account;
(2) the term "passenger vehicle" shall mean any mechanically propelled road vehicle which:
(a) is constructed or adapted for use and used on the roads for the carriage of passengers;
(b) has more than nine seats including that of the driver;
(c) is registered in the territory of one Party and is owned or operated by or on behalf of a carrier authorised in that territory to carry passengers; and
(d) is temporarily imported into the territory of the other Party for the purpose of the international carriage of passengers to, from or in transit through that territory;
(3) the term "goods vehicle" shall mean any mechanically propelled road vehicle which is:
(a) constructed or adapted for use and used on the roads for the carriage of goods;
(b) registered in the territory of one Party; and
(c) temporarily imported into the territory of the other Party for the purpose of the international carriage of goods for delivery at or collection from any point in that territory or in transit through that territory;
and any trailer or semi-trailer which fulfils conditions (a) and (c) of this paragraph and is operated by a carrier of one Party; provided that if a trailer or semi-trailer and its towing vehicle both fill the conditions of this paragraph the combination shall be regarded as one vehicle;
(4) the term "territory", in relation to the United Kingdom, shall mean England, Wales, Scotland, Northern Ireland, the Channel Islands, the Isle of Man and Gibraltar;
in relation to the Republic of Moldova, it shall mean the territory of the Republic of Moldova;
(5) the competent authorities shall be:
in the United Kingdom, the Department of Transport; in the Republic of Moldova, the Ministry of Transport and Highways Administration.
PASSENGER TRANSPORT
ARTICLE 2
Transport Services
Carriers licensed in the territory of the United Kingdom or of the Republic of Moldova shall be permitted to operate transport services using passenger vehicles registered in the territory in which they are based, either between the territories of the Parties or in transit through the territory of either Party, subject to the conditions laid down in this Agreement.
ARTICLE 3
Authorisations and Exemptions
(1) The carriage of passengers in passenger vehicles of a carrier authorised in the territory of one Party to or from any point in the territory of the other Party or in transit through that territory shall, with the exception of the services referred to in paragraph (2) of this Article, require to be authorised by that other Party.
(2) The following shall be exempted from the requirement for authorisation referred to in paragraph (1) of this Article:
(a) "closed-door tours": that is, services whereby the same vehicle is used to carry the same group of passengers throughout the journey and to bring them back to the place of departure;
(b) "inward services": that is, services on which a group of passengers is brought into the territory of the other Party for a temporary stay and the passenger vehicle leaves that territory empty or on a service covered by
(c) below;
(c) "outward services": that is, services on which a passenger vehicle is used to enter the territory of the other Party empty or on a service covered by (b) above and carries to the territory in which the carrier is authorised a group of passengers each of whom:
- has been carried to the territory of the other Party by the carrier;
- before being so carried, had concluded a contract for both journeys in the territory of the Party in which the carrier is authorised;
(d) "shuttle services": that is, services whereby, by means of repeated outward and return journeys, previously formed groups of passengers are carried from a single place of departure to a single destination. Each group of passengers who have made the outward journey together shall subseguently be carried back to the place of departure together. Passengers shall not be taken up or set down during the journey. The first return journey and the last outward journey shall be made unladen;
(e) the transit of the territory of the other Party by an empty passenger vehicle in the course of a journey to or from a third country;
(f) the replacement of a passenger vehicle which has become unserviceable by a serviceable one.
GOODS TRANSPORT
ARTICLE 4
Authorised Carriage of Goods
Subject to Article 5 of this Agreement, a carrier authorised in the territory of one Party shall be permitted, without being required to obtain a permit, licence or other authorisation for that purpose in accordance with the laws of the other Party, to import an empty or laden goods vehicle temporarily into the territory of the other Party for the purpose of the carriage of goods, including return loads:
(a) between any point in the territory of one Party and any point in the territory of the other Party;
(b) in transit across the territory of the other Party; and
(c) between any point in the territory of the other Party, and any point in the territory of a third country.
ARTICLE 5
Special Permits
Each Party may require a special permit for the use in its territory of any vehicle which by reason of its weight or dimensions or those of its load may not otherwise lawfully be used on roads in the territory of that Party.
GENERAL PROVISIONS
ARTICLE 6
Taxation
(1) Goods vehicles and passenger vehicles which are registered in the territory of one Party and are temporarily imported into the territory of the other Party shall be exempt from the taxes and charges levied on the road use or possession of vehicles and from taxes and charges levied on transport operations carried out in the territory of the other Party.
(2) The exemption referred to in paragraph (1) of this Article shall be granted in the territory of each Party so long as the conditions laid down in the Customs regulations in force in that territory for the temporary admission of such vehicles into that territory without payment of import duties and import taxes are fulfilled.
(3) The exemption referred to in paragraph (1) of this Article shall not apply to taxes and charges included in the price of fuel or to tolls or charges for the use of particular bridges, tunnels, ferries, roads, sections of road or classes of road.
(4) The fuel contained in the ordinary supply tanks of a vehicle shall be exempt from taxes and duties.
(5) Spare parts temporarily imported into the territory of the other Party, intended for the breakdown service of vehicles operating within the framework of this Agreement, shall be exempt from Customs duties and from other import charges and taxes in accordance with Customs regulations.
Replaced parts shall be re-exported or destroyed under the control of the competent Customs authorities of the other Party.
ARTICLE 7
Exclusion of Cabotage
Nothing in this Agreement shall be held to permit a carrier authorised in the territory of one Party to pick up passengers or goods at a point in the Territory of the other Party for setting down or delivery at any other point in that territory.
ARTICLE 8
Compliance with National Laws
Except where otherwise provided in Agreements between the Parties, including this Agreement:
(a) carriers and drivers of one Party and passenger vehicles as defined in Article 1(2) of this Agreement and goods vehicles as defined in Article 1(3) of this Agreement shall, when in the territory of the other Party, comply with national laws and regulations in force in that territory Concerning road transport and road traffic;
(b) neither of the Parties shall impose on passenger or goods vehicles of the other Party requirements which are more restrictive than those applied by its national laws and regulations upon its own vehicles.
ARTICLE 9
Infringements
(1) In the event of any infringement of the provisions of this Agreement by a vehicle or driver of one Party when in the territory of the other Party, the competent authority of the Party in whose territory the infringement occurred may (without prejudice to any lawful sanctions which the courts or enforcement authorities of that Party may apply) request the competent authority of the other Party to:
(a) issue a warning to the carrier in question;
(b) issue such a warning together with a notification that subsequent infringement will lead to a temporary or permanent exclusion of vehicles owned or operated by that carrier from the territory of the Party in which the infringement occurred; or
(c) issue a notice of such exclusion.
(2) The competent authority receiving any such request shall comply therewith and shall as soon as possible inform the competent authority of the other Party of the action taken.
FINAL PROVISIONS
ARTICLE 10
Joint Committee
At the request of either competent authority, representatives of both shall meet as a Joint Committee to review the operation of the Agreement.
ARTICLE 11
Entry into Force and Duration
(1) This Agreement shall enter into force on the thirtieth day after the date of the later of the notifications by diplomatic channels of each Party about the fulfilment of internal procedures necessary for its entering into force.
(2) This Agreement is concluded for a period of two years and shall be extended each time for the same period, so long as neither of the Parties gives at least six months' notice in writing before the expiry of the said period of its intention to terminate the Agreement.
In witness whereof the undersigned, duly authorised thereto by their respective Governments, have signed this Agreement.
Done in two originals at London, this 15.10.1996 , in the Moldovan and English languages, each text being egually authoritative.
