între Republica Moldova şi Regatul Suediei privind

cooperarea pentru dezvoltare 2011–2014

Întrucît Guvernul Suediei a decis să adopte o Strategie de cooperare pentru dezvoltare cu Republica Moldova (în continuare Moldova) pentru perioada anilor 2011–2014, obiectivul general este ca Republica Moldova să fie bine integrată în Uniunea Europeană, incluzând valorile fundamentale ale UE.

Suedia, reprezentată de Agenţia Suedeză pentru Cooperare Internaţională pentru Dezvoltare (Asdi), şi Moldova, reprezentată de Ministerul de Finanţe, au convenit după cum urmează:

Articolul 1

Scopul şl obiectivele Acordului

Scopul prezentului Acord este de a reglementa programul suedez de cooperare pentru dezvoltare (Program) gestionat de Asdi în conformitate cu Strategia suedeză de cooperare pentru perioada 2011–2014.

Obiectivul general al Programului este ca Republica Moldova să fie bine integrată în Uniunea Europeană, incluzând valorile fundamentale ale UE.

Moldova va fi responsabilă pentru elaborarea proiectelor/programelor în cadrul prezentului Acord. Rolul Suediei se limitează la contribuţia cu resurse pentru o asemenea cooperare pentru dezvoltare.

Articolul 2

Contribuţia Suediei

Suedia va face disponibile resursele financiare pentru implementarea Programului pe perioada 1 ianuarie 2011 – 31 decembrie 2014.

Contribuţia cu resurse va fi efectuată în conformitate cu cerinţele prevăzute în acordurile specifice dintre Părţi privind proiectele/programele de cooperare pentru dezvoltare, şi va fi oferită sub forma de grant.

Articolul 3

Utilizarea contribuţiei Suediei

3.1 Principalele domenii de cooperare în cadrul Programului vor fi următoarele:

• Democraţia, drepturile omului şi egalitatea de gen

• Infrastructura durabilă

• Dezvoltarea pieţei

Următoarele subiecte constituie principale domenii în dialogul general asupra politicilor între Părţi:

- Integrarea europeană

- Lupta împotriva corupţiei

3.2 Părţile vor revizui Programul în baza anuală.

În procesul acestor revizuiri, Moldova şi Suedia vor urmări implementarea Programului, cât şi progresul programelor/proiectelor individuale.

Articolul 4

Referinţe la alte acorduri

Cooperarea pentru dezvoltare a Părţilor este reglementată la fel de următoarele acte:

- Acordul cu privire la cadrul general şi condiţiile pentru cooperare în dezvoltare între Guvernul Republicii Moldova şi Guvernul Regatului Suediei, din octombrie 2003, prelungit în decembrie 2008; şi

- acorduri specifice pentru proiecte/programe de cooperare pentru dezvoltare.

Articolul 5

Intrarea în vigoare şl încetarea

Prezentul Acord va intra în vigoare la data semnării acestuia de către ambele Părţi şi va rămîne în vigoare pînă la 31 decembrie 2014. Acordul poate fi reziliat înainte de finalizarea perioadei de valabilitate a acestuia la iniţiativa oricărei Părţi cu o notificare în scris a celeilalte Părţi cu cel puţin şase luni în prealabil.

Încetarea prezentului Acord nu va afecta valabilitatea nici unuia din acordurile specifice în vigoare dintre Părţi.

Prezentul Acord a fost întocmit în limbile moldovenească şi engleză, în două exemplare. Toate textele sunt egal autentice. În caz de divergenţe la interpretarea prevederilor prezentului Acord de către Părţi, textul în limba engleză va prevala.

AGREEMENT

between the Republic of Moldova and Sweden

on development cooperation 2011-2014

Whereas the Swedish Government has decided to adopt a Strategy for development cooperation with the Republic of Moldova (hereinafter Moldova) for the period 2011-2014, the overall objective is that Moldova be well integrated with the European Union (EU), including the fundamental values of the EU.

Sweden, represented by the Swedish International Development Cooperation Agency, (Sida), and Moldova, represented by the Ministry of Finance have agreed as follows.

Article 1

Scope and objectives of the Agreement

The scope of this Agreement is to regulate the Swedish development cooperation programme (the Programme) managed by Sida under the Swedish cooperation strategy 2011-2014.

The overall objective of the Programme is that Moldova be well integrated with the European Union, including the fundamental values of the EU.

The responsibility for the development of projects/programmes under this Agreement rests with Moldova. The role of Sweden is limited to the contribution of resources to such development cooperation.

Article 2

The swedish contribution

Sweden shall keep available financial resources for the Programme during the period 1 January 2011 to 31 December 2014.

The contribution of resources shall be made in accordance with the requirements laid down in specific agreements between the Parties on projects/programmes of development cooperation, and shall be made available on a grant basis,

Article 3

Utilisation of the swedish contribution

3.1 The main areas of cooperation under the Programme shall be the following:

• Democracy, human rights and gender equality

• Sustainable infrastructure

• Market development

The following issues shall constitute the key areas for overall policy dialogue between the Parties:

- EU integration

- Fight against corruption

3.2 The parties shall annually review the Programme.

At these reviews Moldova and Sweden shall follow up on the Programme and on the progress of the individual programmes/projects.

Article 4

References to other agreements

The development cooperation between the Parties is also governed by:

- the Agreement on General Terms and Conditions for Development Cooperation between the Republic of Moldova and the Kingdom of Sweden, dated October 2003, prolonged in December 2008; and

- specific agreements for projects/programmes of development cooperation.

Article 5

Entry into force and termination

This Agreement shall enter into force when signed by both parties, and remain valid until 31 December 2014. The Agreement may be terminated prior to the end of the agreement period by either party giving the other party at least six months written notice.

The termination of this Agreement shall not affect the validity of any specific agreements that are in force between the Parties.

This agreement was drawn up in Moldovan and English language, each in duplicate. All texts are equally authentic. In case of different interpretation of provisions of this Agreement by the Parties, the English text shall prevail.
