între Guvernul Republicii Moldova şi Guvernul Muntenegrului privind

readmisia persoanelor aflate în situaţie de şedere ilegală

Guvernul Republicii Moldova şi Guvernul Muntenegrului, numite în continuare «Părţi Contractante»,

conducându-se de dorinţa de a intensifica cooperarea între cele două Părţi Contractante şi de a asigura o aplicare mai eficientă a normelor de circulaţie a persoanelor,

considerând prioritară respectarea şi asigurarea drepturilor şi garanţiilor prevăzute de normele în vigoare,

dorind să reglementeze, în conformitate cu practica internaţională aplicată în acest domeniu şi obligaţiile internaţionale acceptate, readmisia reciprocă a persoanelor şi să determine condiţiile pentru tranzitul cetăţenilor statelor terţe şi apatrizilor, ai căror intrare sau şedere pe teritoriul Statului celeilalte Părţi Contractante este ilegală,

bazându-se pe o cooperare eficientă şi pe principiul de reciprocitate,

luând în consideraţie că migraţiunea ilegală prezintă un pericol real pentru securitatea publică şi stabilitatea economică a Părţilor Contractante,

conştiente de faptul că stoparea migraţiunii ilegale a persoanelor este parte a unui efort general în vederea cooperării europene,

au convenit asupra celor ce urmează:

Articolul 1

Definţii

În sensul prezentului Acord, următorii termeni se înţeleg după cum urmează:

a) «Partea Contractantă solicitantă» înseamnă Partea Contractantă care trimite o cerere de readmisie sau tranzit;

b) «Partea Contractantă solicitată» înseamnă Partea Contractantă căreia îi este adresată cererea de readmisie sau tranzit;

c) «Viza» înseamnă autorizaţia eliberată sau decizia luată de către autorităţile competente ale Părţilor Contractante, necesară în scopul intrării în, şederii în sau tranzitării teritoriului acesteia. Aceasta nu include viza de tranzit aeroportuar;

d) «Permis de şedere» înseamnă un permis, de orice tip, eliberat de autorităţile competente ale Părţilor Contractante, care acordă unei persoane dreptul de şedere pe teritoriul său. Acesta nu include permisiunea temporară de şedere pe teritoriul acesteia în legătură cu procesarea unei cereri de azil sau unei cereri de permis de şedere;

e) “Cetăţean al Republicii Moldova» înseamnă orice persoană care deţine cetăţenia Republicii Moldova, în conformitate cu legislaţia acesteia;

f) «Cetăţean al Muntenegrului» înseamnă orice persoană care deţine cetăţenia Muntenegrului, în conformitate cu legislaţia acestuia;

g) «Cetăţean al ţării terţe» înseamnă orice persoană care deţine o altă cetăţenie decât cea a Republicii Moldova sau a Muntenegrului;

h) «Apatrid» înseamnă orice persoană care nu deţine cetăţenia vreunui stat;

i) «Autorităti competente» înseamnă autorităţile naţionale competente ale Părţilor Contractante împuternicite să implementeze prezentul Acord, în conformitate cu Articolul 16 alineatul 1;

j) «Tranzit» înseamnă trecerea unui cetăţean al unei ţări terţe sau a unui apatrid prin teritoriul Părţii Contractante Solicitate în timpul deplasării acestuia din Partea Contractantă Solicitantă către ţara de destinaţie;

k) «Readmisie» înseamnă returnarea de către Partea Contractantă Solicitantă şi readmiterea de către Partea Contractantă Solicitată a persoanei (cetăţean al Părţii Contractante Solicitate, cetăţean al statului terţ sau apatrid) care nu corespunde, sau nu mai îndeplineşte condiţiile de intrare, de aflare, sau şedere pe teritoriile Părţilor Contractante în conformitate cu prevederile prezentului Acord.

Articolul 2

Readmisia propriilor cetăţeni

1) La cererea Părţii Contractante Solicitante, Partea Contractantă Solicitată va readmite fără careva formalităţi orice persoană care nu corespunde sau nu mai îndeplineşte condiţiile în vigoare necesare pentru intrarea sau şederea pe teritoriul suveran al Părţii Contractante Solicitante, dacă este dovedit sau presupus în baza dovezii prima facie că persoana în cauză are cetăţenia Statului Părţii Contractante Solicitate.

2) Partea Contractantă Solicitată va readmite, de asemenea:

- copiii minori necăsătoriţi ai persoanei menţionate la alineatul 1, indiferent de locul lor de naştere sau de cetăţenia acestora, cu excepţia cazului în care au un drept de şedere independent în statul Părţii Contractante Solicitante;

- soţul/soţia persoanei menţionate la alineatul 1, care deţine altă cetăţenie, cu condiţia că au dreptul de a intra şi de a se afla sau primesc dreptul de a intra sau de a se afla pe teritoriul Părţii Contractante Solicitate, cu excepţia cazului în care ei au drept de şedere independent în statul Părţii Contractante Solicitante.

3) Partea Contractantă Solicitată va readmite, de asemenea, persoanele, care au fost lipsite de, sau care au renunţat la cetăţenia Părţii Contractante Solicitate după intrarea pe teritoriul Părţii Contractante Solicitante, chiar dacă aceste persoane au primit cel puţin promisiunea naturalizării de către Partea Contractantă Solicitantă.

4) După ce Partea Contractantă Solicitată a dat un răspuns pozitiv la cererea de readmisie, oficiul consular competent al Părţii Contractante Solicitate va elibera imediat, nu mai târziu decât în trei zile lucrătoare, documentul de călătorie necesar pentru returnarea persoanei care urmează să fie readmisă, a cărui valabilitate este până la 2 luni. În cazul în care, din motive juridice sau faptice, persoana în cauză nu poate fi transferată în decursul perioadei de valabilitate a documentului de călătorie, care a fost eliberat iniţial, oficiul consular competent al Părţii Contractante Solicitate va elibera, în termen de 14 zile calendaristice, un nou document de călătorie cu aceeaşi perioadă de valabilitate. În cazul în care Partea Contractantă Solicitată nu a eliberat, în termen de 14 zile calendaristice, noul document de călătorie, se consideră că aceasta a acceptat folosirea documentului de călătorie pentru străini emis de Partea Contractantă Solicitantă pentru persoana care va fi returnată Părţii Contractante Solicitate.

5) În cazul în care persoana, care urmează să fie readmisă, deţine cetăţenia unui stat terţ adiţional cetăţeniei Republicii Moldova sau Muntenegrului, Statul Părţii Contractante Solicitante va lua în consideraţie dorinţa persoanei în cauză în ceea ce priveşte alegerea statului în care să fie readmis.

Articolul 3

Readmisia cetăţenilor ţărilor terţe şi apatrizilor

1) Partea Contractantă Solicitată va readmite, la cererea Părţii Contractante Solicitante şi fără alte formalităţi decât cele prevăzute în prezentul Acord, toţi cetăţenii statelor terţe sau apatrizii care nu corespund sau nu mai îndeplinesc condiţiile legale în vigoare pentru intrare, aflare sau şedere pe teritoriul Părţii Contractante Solicitante, cu condiţia să fie dovedit sau să poată fi prezumat în baza dovezilor prima facie prezentate, că persoanele în cauză:

a) deţin, sau la data intrării deţineau o viză valabilă sau un permis de şedere valabil eliberat de autorităţile competente ale Părţii Contractante Solicitate; sau

b) au intrat direct şi ilegal pe teritoriul Părţii Contractante Solicitante după o perioadă de şedere pe, sau tranzitării teritoriului Părţii Contractante Solicitate.

2) Obligaţia de readmisie prevăzută în alineatul 1 nu se aplică dacă:

a) cetăţeanul ţării terţe sau apatridul se afla doar în tranzit printr-un aeroport internaţional al Părţilor Contractante; sau

b) Partea Contractantă Solicitantă a eliberat cetăţeanului ţării terţe sau apatridului o viză sau un permis de şedere înainte sau după intrarea acestuia pe teritoriul său, cu excepţia cazului când:

i. persoana în cauză deţine o viză sau un permis de şedere, eliberat de Partea Contractantă Solicitată, care expiră mai târziu, sau

ii. viza sau permisul de şedere a fost obţinut prin folosirea documentelor false sau falsificate, sau prin declaraţii false şi că persoana în cauză s-a aflat sau a tranzitat teritoriul Părţii Contractante Solicitate; sau

iii. persoana menţionată nu respectă vreo condiţie legată de viză şi persoana s-a aflat pe sau a tranzitat teritoriul Părţii Contractante Solicitate.

3) După ce Partea Contractantă Solicitată a dat un răspuns pozitiv la cererea de readmisie, Partea Contractantă Solicitantă eliberează persoanei vizate documentul de călătorie pentru străini necesar pentru întoarcerea lui/ei în statul Părţii Contractante Solicitate.

Articolul 4

Principiile readmisiei

1) Sub rezerva alineatului 2 al prezentului Articol, orice transfer al unei persoane care urmează să fie readmisă pe baza uneia dintre obligaţiile prevăzute la Articolele 2 şi 3, necesită transmiterea unei cereri de readmisie autorităţii competente a Părţii Contractante Solicitate.

2) Nu este necesară prezentarea unei cereri de readmisie în cazul în care persoana care urmează să fie readmisă este în posesia unui document de călătorie valabil şi în cazul în care o astfel de persoană este cetăţean al unei ţări terţe sau apatrid şi deţine, de asemenea, o viză valabilă sau un permis de şedere eliberat de Partea Contractantă Solicitată.

Articolul 5

Cererea de readmisie

1) Cererea de readmisie va fi prezentată, în scris, de către autoritatea competentă a Părţii Contractante Solicitante autorităţii competente a Părţii Contractante Solicitate prin intermediul canalelor de comunicare securizate, în special prin poştă sau e-mail. Autoritatea competentă a Părţii Contractante Solicitate va remite imediat o confirmare privind recepţionarea cererii de readmisie.

2) Răspunsul la cererea de readmisie se prezintă în scris autorităţii competente a Părţii Contractante Solicitante de către autoritatea competentă a Părţii Contractante Solicitate prin intermediul canalelor de comunicare securizate, în special prin fax sau e-mail. În cazul în care cererea de readmisie este refuzată, motivele trebuie să fie prezentate în scris.

3) În măsura posibilităţii, cererea de readmisie va conţine următoarele informaţii:

a) datele personale ale persoanei care urmează să fie readmisă (de exemplu: numele, prenumele, data şi locul naşterii şi ultima viză de reşedinţă) şi, după caz, datele personale ale copiilor minori necăsătoriţi şi / sau soţilor/soţiilor;

b) documentele, în baza cărora se dovedeşte cetăţenia şi indicarea dovezilor prima facie ale cetăţeniei, tranzitul, condiţiile de readmisie a cetăţenilor ţărilor terţe şi apatrizilor, precum şi intrarea şi şederea ilegală vor fi indicate;

c) fotografia persoanei care urmează a fi readmisă;

d) amprentele digitale ale persoanei dacă este necesar.

4) Formularul comun folosit pentru cererile de readmisie este prevăzut în Anexa 5 la prezentul Acord.

Articolul 6

Mijloace de evidenţă a cetăţeniei

1) Dovada cetăţeniei în conformitate cu Articolul 2 (1) poate fi făcută în special prin intermediul documentelor enumerate în Anexa 1 la prezentul Acord, chiar dacă perioada de valabilitate a acestora a expirat. În cazul în care aceste documente sunt prezentate, Părţile Contractante recunosc reciproc cetăţenia fără să fie necesară efectuarea unei investigaţii adiţionale. Dovada cetăţeniei nu se poate face prin documente false.

2) Dovada prima facie a cetăţeniei în conformitate cu Articolul 2 (1) se poate face, în special, prin intermediul documentelor enumerate în Anexa 2 la prezentul Acord, chiar dacă perioada de valabilitate a acestora a expirat. În cazul în care se prezintă aceste documente, Părţile Contractante vor considera că cetăţenia este stabilită, cu excepţia cazului în care ele pot dovedi contrariul. Dovada prima facie a cetăţeniei nu se poate face prin documente false.

3) În cazul în care nici unul dintre documentele enumerate în Anexele 1 şi 2 din prezentul Acord nu pot fi prezentate, oficiile consulare ale Părţii Contractante Solicitate sau, în limita cadrului legal al Părţii Contractante Solicitate, orice altă autoritate, la solicitare, vor întreprinde măsurile necesare pentru a chestiona persoana care urmează să fie readmisă fără întârzieri nejustificate, în termen de cel mult trei zile lucrătoare de la data solicitată, în vederea stabilirii cetăţeniei persoanei.

Articolul 7

Mijloace de probă privind persoanele ţărilor terţe şi apatrizii

1) Dovada îndeplinirii condiţiilor de readmisie a cetăţenilor ţărilor terţe şi apatrizilor prevăzute la Articolul 3 (1) se face, în special, prin intermediul mijloacelor de probă enumerate în Anexa 3 la prezentul Acord; aceasta nu poate fi făcută prin documente false. Astfel de dovadă este recunoscută reciproc de către Părţile Contractante, fără efectuarea unei alte investigaţii suplimentare.

2) Dovada prima facie de îndeplinire a condiţiilor de readmisie a cetăţenilor ţărilor terţe şi apatrizilor, prevăzute la Articolul 3 (1), se face, în special, prin intermediul mijloacelor de probă enumerate în Anexa 4 la prezentul Acord; aceasta nu poate fi făcută prin documente false. În cazul în care dovada prima facie este prezentată, Părţile Contractante consideră că sunt îndeplinite condiţiile necesare, cu excepţia cazului în care ele pot dovedi contrariul.

3) Intrarea, aflarea sau şederea ilegală va fi stabilită cu ajutorul documentelor de călătorie ale persoanei în cauză, unde lipseşte viza necesară sau alt permis de şedere pe teritoriul Părţii Contractante Solicitante. O declaraţie a Părţii Contractante Solicitante conform căreia persoana în cauză a fost găsită fără a avea asupra sa documentele de călătorie, viza sau permisul de şedere necesare reprezintă, de asemenea, o dovadă prima facie a intrării, aflării sau şederii ilegale.

Articolul 8

Documente adiţionale pentru stabilirea cetăţeniei

1) Dacă Partea Solicitantă consideră că documentele adiţionale, care nu sunt enumerate în Anexele 2 şi 4 la prezentul Acord, pot fi esenţiale pentru stabilirea cetăţeniei persoanei care urmează să fie readmisă, aceste documente vor fi transmise Părţi Contractante Solicitate împreună cu cererea de readmisie.

2) Decizia de a lua în consideraţie documentele enumerate la alineatul 1 al prezentului Articol în procesarea cererii de readmisie va fi luată de către Partea Contractantă Solicitată.

Articolul 9

Limite de timp

1) Cererea de readmisie se prezintă autorităţii competente a Părţii Contractante Solicitate în termen de maximum un an după ce autorităţile competente ale Părţilor Contractante solicitante au luat cunoştinţă de faptul că un cetăţean al unei ţări terţe sau apatrid nu corespunde sau nu mai îndeplineşte condiţiile necesare în vigoare pentru intrarea, aflarea sau şederea pe teritoriul său. În cazul în care există obstacole juridice sau faptice în ceea ce priveşte transmiterea în timp a cererii, la solicitarea Părţii Contractante Solicitante, termenul-limită poate fi prelungit, dar numai până la eliminarea obstacolelor existente.

2) Răspuns la cererea de readmisie trebuie oferit în scris în termen de 12 (douăsprezece) zile lucrătoare. Acest termen-limită începe din data confirmării primirii cererii de readmisie.

3) În cazul în care există obstacole juridice sau faptice legate de răspunsul la cerere în termen de 12 (douăsprezece) zile lucrătoare, acest termen-limită, în baza unei cereri motivate, poate fi extins cu maximum 6 (şase) zile calendaristice.

4) Dacă Partea Contractantă Solicitată nu răspunde în termenele menţionate la alineatul 2 sau 3 din prezentul Articol, se consideră că transferul a fost acceptat.

5) După aprobarea cererii de către Partea Contractantă Solicitată, persoana în cauză este transferată de către Partea Contractantă Solicitantă în termen de două luni. La solicitarea Părţii Contractante Solicitante, acest termen poate fi prelungit cu o perioadă de timp necesară pentru înlăturarea obstacolelor juridice sau practice.

Articolul 10

Modalităţi de transfer şi moduri de transportare

1) Înainte de returnarea unei persoane, autorităţile competente ale Părţilor Contractante vor stabili în scris, în prealabil, detaliile privind data returnării, punctul de trecere a frontierei, eventualele escorte şi alte informaţii relevante privind returnarea.

2) În măsura posibilităţii şi, în caz de necesitate, aranjamentele scrise menţionate la alineatul 1 al prezentului Articol vor conţine, de asemenea, următoarele informaţii:

a) Declaraţie care indică că persoana care urmează să fie transferată poate avea nevoie de ajutor sau îngrijire, dacă aceasta este în interesul persoanei menţionate;

b) alte măsuri de protecţie sau securitate, care ar putea interveni în cazul unui caz de transfer individual sau informaţii privind starea sănătăţii persoanei, dacă aceasta este în interesul persoanei menţionate.

3) Transportarea poate fi efectuată pe cale aeriană sau terestră. Returnarea pe cale aeriană nu poate fi limitată la utilizarea transportatorilor naţionali ai Părţilor Contractante şi se poate efectua prin curse regulate sau zboruri charter. În cazul returnării sub escortă, personalul de escortă va fi asigurat de către Partea Contractantă Solicitantă.

4) Dacă o persoană, care este readmisă sau este în proces de tranzit, este însoţită de escortă, Partea Contractantă Solicitantă va oferi următoarele informaţii: numele, prenumele, funcţiile persoanelor din escortă, tipul, numărul şi data eliberării paşapoartelor şi legitimaţiilor de serviciu, conţinutul ordinului misiunii lor.

5) Escorta este obligată să respecte legislaţia Părţii Contractante Solicitate.

6) Escorta nu va purta uniformă de serviciu, arme şi alte obiecte restricţionate pe teritoriul Părţii Contractante Solicitate.

7) Escorta va avea paşapoarte şi legitimaţii de serviciu valabile, precum şi ordinul misiunii eliberat de autoritatea competentă a Părţii Contractante Solicitante.

8) Numărul personalului de escortă va fi convenit, în prealabil, de către autorităţile competente, în fiecare caz separat.

9) Autorităţile competente vor coopera în ceea ce priveşte aspectele legate de aflarea escortei pe teritoriul Părţii Contractante Solicitate. În caz de necesitate, autorităţile competente ale Părţii Contractante Solicitate vor acorda escortei asistenţa posibilă.

Articolul 11

Readmisia din greşeală

1) Partea Contractantă Solicitantă reprimeşte orice persoană readmisă de către Partea Contractantă Solicitată în cazul în care se constată, în termen de trei luni de la data returnării persoanei în cauză, că cerinţele prevăzute la Articolul 2 sau 3 din prezentul Acord nu au fost îndeplinite.

2) În astfel de cazuri, prevederile procedurale ale prezentului Acord se aplică mutatis mutandis şi se pun la dispoziţie toate informaţiile privind identitatea şi cetăţenia actuale ale persoanei care urmează să fie reprimită.

Articolul 12

Principiile tranzitului

1) Părţile Contractante vor restricţiona tranzitul cetăţenilor ţărilor terţe sau apatrizilor la cazurile în care aceste persoane nu pot fi returnate direct în statul de destinaţie.

2) Părţile Contractante vor permite şi autoriza tranzitul cetăţenilor ţărilor terţe sau apatrizilor, la solicitarea uneia din Părţile Contractante, în cazul în care se asigură continuarea călătoriei planificate spre alte state eventuale de tranzit şi readmisia de către statul de destinaţie.

3) Tranzitul poate fi refuzat de către Părţile Contractante:

a) dacă cetăţeanul ţării terţe sau apatridul se expune unui risc real de a fi supus torturii, unui tratament sau pedepse inumane sau degradante, pedepsei cu moartea ori persecutării pe motiv de rasă, religie, naţionalitate, apartenenţă la un anumit grup social sau convingeri politice în statul de destinaţie sau în alt stat de tranzit; sau

b) dacă cetăţeanul ţării terţe sau apatridul va fi obiectul unor sancţiuni penale în statul de destinaţie sau într-un alt stat de tranzit; sau

c) din motive de sănătate publică, de securitate naţională, de ordine publică sau alte interese naţionale ale Părţii Contractante Solicitante.

4) Părţile Contractante pot retrage orice autorizaţie eliberată, dacă apar sau se fac cunoscute circumstanţele menţionate în alineatul 3, care pot să împiedice operaţiunea de tranzit, sau dacă nu este asigurată continuarea călătoriei în eventualele state de tranzit sau readmisie de către statul de destinaţie. În acest caz, Partea Contractantă Solicitantă va reprimi cetăţeanul ţării terţe sau apatridul, după necesitate şi fără întârziere.

Articolul 13

Procedura de tranzit

1) Cererea de tranzit va fi remisă de către autoritatea competentă a Părţii Contractante Solicitante direct autorităţii competente a Părţii Contractante Solicitate prin intermediul canalelor de comunicare securizate, în special prin fax sau e-mail. Autoritatea competentă a Părţii Contractante Solicitate va confirma imediat primirea cererii de tranzit.

2) Răspunsul la cererea de tranzit va fi pus la dispoziţia autorităţii competente a Părţii Contractante Solicitante direct de către autoritatea competentă a Părţii Contractante Solicitate, în scris, prin intermediul canalelor de comunicare securizate, în special prin fax, sau e-mail, în termen de trei zile lucrătoare, confirmând punctul de intrare şi timpul preconizat pentru tranzit, sau informând despre motive în cazul în care cererea de tranzit este refuzată.

3) Cererea de tranzit va conţine următoarele informaţii:

a) tipul tranzitului (aerian sau terestru), alte state eventuale de tranzit şi destinaţia finală prevăzută;

b) datele personale ale persoanei în cauză (de exemplu: numele, prenume, numele până la căsătorie, alte nume folosite / sub care aceasta este cunoscută sau pseudonime, data naşterii, sexul şi, în cazul în care este posibil, locul naşterii, cetăţenia, limba, tipul şi numărul documentului de călătorie);

c) punctul preconizat de trecere a frontierei, data şi ora transferului şi posibila recurgere la escorte;

d) declaraţie a Părţii Contractante Solicitante, prin care se consideră că condiţiile prevăzute la Articolul 12 alineatul 2 din prezentul Acord sunt îndeplinite şi că nu se cunosc motive, care să justifice refuzul cererii în conformitate cu Articolul 12 alineatul 3 din prezentul Acord;

e) un formular comun utilizat pentru cererile de tranzit este prevăzut în Anexa 6 la prezentul Acord.

4) Dacă operaţiunea de tranzit se efectuează pe cale aeriană, persoana care urmează să fie transferată şi eventualele escorte vor fi scutite de obligaţia de a obţine viză de tranzit aeroportuar.

5) Autorităţile competente ale Părţii Contractante Solicitate, cu condiţia consultărilor reciproce, vor acorda asistenţă în cazul operaţiunilor de tranzit, în special prin supravegherea persoanelor în cauză şi prin oferirea facilităţilor corespunzătoare în acest scop.

Articolul 14

Cheltuielile de transport şi de tranzit

Fără a prejudicia dreptul autorităţilor competente la rambursarea costurilor aferente readmisiei de la persoana care urmează să fie readmisă sau de la părţi terţe, toate cheltuielile de transport efectuate în legătură cu operaţiunile de readmisie şi de tranzit în temeiul prezentului Acord, până la frontiera statului de destinaţie finală, vor fi suportate de către Partea Contractantă Solicitantă.

Articolul 15

Protecţia datelor

Comunicarea datelor cu caracter personal se efectuează numai dacă o astfel de comunicare este necesară pentru implementarea prezentului Acord de către autorităţile competente ale Părţilor Contractante, după caz. Procesarea şi prelucrarea datelor cu caracter personal, într-un caz particular, sunt supuse legislaţiei interne a Părţilor Contractante. De asemenea, se aplică următoarele principii:

a) datele cu caracter personal trebuie să fie prelucrate în mod corect şi în conformitate cu dispoziţiile legale;

b) datele cu caracter personal trebuie colectate în scopul specific, explicit şi legitim al implementării prezentului Acord şi nu trebuie prelucrate ulterior de către autoritatea care le comunică sau de autoritatea care le primeşte într-un mod incompatibil cu acel scop;

c) datele cu caracter personal trebuie să fie adecvate, relevante şi nu excesive în raport cu scopul pentru care acestea sunt colectate şi/sau prelucrate ulterior; în special, datele cu caracter personal comunicate pot să facă referinţă numai la:

- datele personale ale persoanei care urmează să fie transferată (de exemplu, numele, prenumele, alte nume anterioare, alte nume utilizate/sub care este cunoscut sau pseudonime, sex, starea civilă, data şi locul naşterii, cetăţenia actuală şi orice cetăţenie anterioară),

- paşaportul, buletinul de identitate sau permisul de conducere (numărul, perioada de valabilitate, data eliberării, autoritatea emitentă şi locul eliberării),

- escalele şi itinerarele,

- alte informaţii necesare pentru identificarea persoanei care urmează să fie transferată sau pentru examinarea cerinţelor de readmisie în temeiul prezentului Acord;

d) datele cu caracter personal trebuie să fie exacte şi, dacă este necesar, actualizate;

e) datele cu caracter personal trebuie să fie păstrate într-o formă care permite identificarea persoanelor vizate pe o durată care să nu depăşească perioada necesară scopului pentru care datele au fost colectate sau pentru care sunt prelucrate ulterior;

f) atât autoritatea care comunică, cât şi autoritatea care primeşte vor întreprinde toate măsurile rezonabile pentru a asigura, după caz, rectificarea, radierea sau blocarea datelor cu caracter personal, în cazul în care prelucrarea nu se efectuează conform prevederilor prezentului articol, în special deoarece acele date nu sunt adecvate, relevante, exacte sau sunt excesive în raport cu scopul prelucrării. Aceasta include notificarea celeilalte Părţi Contractante privind orice rectificare, radiere sau blocare;

g) la solicitare, autoritatea care primeşte datele informează autoritatea care comunică datele cu privire la utilizarea datelor comunicate şi la rezultatele obţinute urmare utilizării lor;

h) datele cu caracter personal pot fi comunicate doar autorităţilor competente. Transmiterea lor ulterioară altor organisme necesită acordul prealabil al autorităţii care le-a comunicat;

i) autorităţile care comunică şi primesc datele sunt obligate să înregistreze în scris comunicarea şi primirea datelor cu caracter personal.

Articolul 16

Autorităţile competente

1) Părţile Contractante au desemnat următoarele autorităţi responsabile de implementarea prezentului Acord.

2) Părţile Contractante se vor informa reciproc, imediat, prin canale diplomatice, despre orice modificări în ceea ce priveşte autorităţile competente sau detaliile lor.

3) Oficiile consulare ale Părţilor Contractante sunt desemnate pentru a acorda sprijin autorităţilor competente în vederea implementării prezentului Acord.

Articolul 17

Stabilirea punctelor de trecere a frontierei

1) Pentru readmisie sau tranzit, Părţile Contractante stabilesc următoarele puncte de trecere a frontierei:

a) pentru Republica Moldova: Aeroportul Internaţional Chişinău;

b) pentru Muntenegru: Aeroportul Internaţional Podgorica;

2) Părţile Contractante pot stabili, în cazuri excepţionale, alte puncte de trecere a frontierei, care vor fi determinate în funcţie de necesităţile apărute.

3) Părţile Contractante se vor informa reciproc, imediat, despre orice modificări a punctelor de trecere a frontierei prevăzute la alineatul 1 al prezentului Articol, direct prin intermediul autorităţilor competente.

Articolul 18

Limba de comunicare

În scopul implementării prezentului Acord limba de comunicare va fi engleza.

Articolul 19

Principiile bunei cooperări

1) Ambele Părţi Contractante se obligă să soluţioneze în comun orice probleme ce apar la implementarea prezentului Acord. Ele se informează constant referitor la cerinţele (condiţiile) de imigrare pentru cetăţenii ţărilor terţe.

2) Orice divergenţe apărute la interpretarea, aplicarea sau implementarea prezentului Acord vor fi soluţionate prin consultări reciproce şi schimb de opinii, verbal sau în scris, între autorităţile competente ale Părţilor Contractante.

3) Fiecare Parte Contractantă poate solicita întrunirea experţilor celor două Părţi în scopul soluţionării problemelor legate de interpretarea sau aplicarea prezentului Acord.

Articolul 20

Clauză de conformitate

1) Prezentul Acord va fi aplicat fără a prejudicia drepturile, obligaţiile şi responsabilităţile Părţilor Contractante care derivă din dreptul internaţional.

2) Prezentul Acord nu se va aplica persoanelor care sunt în procedură naţională de azil în oricare din Părţile Contractante, până la luarea deciziei finale privind solicitarea de azil.

Articolul 21

Anexe

Toate anexele la prezentul Acord sunt parte integrantă ale acestuia.

Articolul 22

Amendamente

Prezentul Acord poate fi modificat oricând cu consimţământul scris al Părţilor Contractante. Amendamentele vor intra în vigoare în conformitate cu aceleaşi proceduri legale prevăzute în Articolul 25(1) al prezentului Acord.

Articolul 23

Suspendarea temporară

Fiecare Parte Contractantă poate suspenda temporar, printr-o notificare oficială a celeilalte Părţi Contractante, implementarea prezentului Acord parţial sau complet, cu privire la cetăţenii ţării terţe şi apatrizi, pe motive de securitate, protecţie a ordinii publice sau a sănătăţii publice sau alte interese naţionale. Suspendarea va intra în vigoare în a doua zi după primirea unei astfel de notificări scrise.

Articolul 24

Denunţarea

Fiecare Parte Contractantă poate denunţa prezentul Acord printr-o notificare scrisă adresată celeilalte Părţi Contractante. Prezentul Acord încetează să fie aplicat după trei luni de la data unei astfel de notificări.

Articolul 25

Intrarea în vigoare şi durata

1) Prezentul Acord va intra în vigoare în prima zi a lunii ce urmează după data primirii ultimei notificări scrise, prin canale diplomatice, prin care Părţile Contractante se informează reciproc despre îndeplinirea procedurilor interne prevăzute de legislaţia lor naţională pentru intrarea în vigoare a prezentului Acord.

2) Prezentul Acord este încheiat pentru o perioadă nelimitată.

Întocmit la Brdo pri Kranju, la 17 mai 2012, în două exemplare, fiecare în limbile moldovenească, muntenegreană şi engleză, toate textele fiind egal autentice.

În cazul divergenţelor la interpretarea prezentului Acord, textul în limba engleză va prevala.

Anexa 1

Documentele considerate drept dovadă a cetăţeniei

(Articolele 2(1) şi 6(1) ale Acordului)

În cazul în care Statul Solicitat este Republica Moldova:

• Toate tipurile de paşapoarte ale Republicii Moldova,

• Buletinele de identitate valabile,

• Documente de călătorie eliberate de autorităţile Republicii Moldova.

În cazul în care Statul Solicitat este Muntenegru:

• Toate documentele de călătorie valabile (paşaport naţional al Muntenegrului, paşapoarte diplomatice şi de serviciu ale Muntenegrului şi laisse passé pentru cetăţenii Muntenegrului) eliberate după 5 mai 2008,

• Buletinele de identitate valabile eliberate pentru cetăţenii Muntenegrului după 5 mai 2008.

Anexa 2

Documentele considerate drept dovadă prima facie a cetăţeniei

(Articolele 2(1) şi 6(2) ale Acordului)

• orice documente menţionate în Anexa 1 a prezentului Acord, valabilitatea cărora a expirat,

• fotocopii ale oricăror documente enumerate în Anexa 1 la prezentul Acord,

• livrete şi cărţi de identitate militare,

• buletine de identitate eliberate de autorităţile de stat competente,

• carnet de marinar şi canete de serviciu a căpitanilor,

• certificate de cetăţenie şi alte documente oficiale, care menţionează sau indică clar cetăţenia,

• permise de conducere,

• certificate de naştere,

• orice alt document oficial susceptibil de a ajuta la stabilirea cetăţeniei,

• declaraţia persoanei în cauză sau a unui martor autentic introduse în raport de către autorităţile competente care pot fi confirmate de către autorităţile competente ale Statului Solicitat.

Anexa 3

Documentele considerate drept dovezi ale condiţiilor

de readmisie pentru cetăţenii ţărilor terţe sau apatrizi

(Articolele 3(1) şi 7(1) ale Acordului)

• ştampile de intrare/ieşire sau însemne similare cu dată în documentul de călătorie al persoanei în cauză,

• documente, certificate, facturi nominale de orice fel (ex. facturi de la hotel, contract de închiriere a autovehiculelor, recipise de încasări a cardurilor de credit etc.) care indică clar că persoana în cauză a stat pe teritoriul Statului solicitat la o anumită dată sau perioadă de timp,

• tichete nominale a pasagerului şi/sau listele de pasageri ale companiilor avia, feroviare, rutiere sau fluviale, care dovedesc prezenţa şi itinerarul persoanei în cauză pe teritoriul Statului solicitat la o anumită dată sau perioadă de timp,

• informaţii care indică că persoana în cauză a recurs la serviciile unei companii de transport sau agenţii de turism la o anumită dată.

Anexa 4

Documentele considerate drept dovadă prima facie a condiţiilor

de readmisie a cetăţenilor ţărilor terţe şi apatrizilor

(Articolul 3(1) şi 7(2) ale Acordului)

• declaraţia făcută de persoana în cauză în cadrul procedurilor judiciare sau administrative,

• raportul elaborat de autorităţile relevante ale Părţii Contractante Solicitante privind locul şi circumstanţele în care persoana în cauză a fost găsită după intrarea pe teritoriul acelui stat,

• date privind identitatea şi/ sau şederea unei persoane, care a fost oferită de către o organizaţie internaţională (ex. UNHCR),

• rapoarte/ confirmare a datelor de către membrii familiei, companionii de călătorie etc.,

• declaraţia persoanei în cauză.

AGREEMENT

between the Government of the Republic of Moldova and the Government of

Montenegro on the Readmission of Persons residing without authorisation

The Government of the Republic of Moldova and the Government of the Montenegro, hereinafter referred to as the «Contracting Parties»,

having the wish to improve the cooperation between the two Contracting Parties and to assure a more efficient application of rules for circulation of persons,

considering as priority the respect and assurance of rights and guarantees stipulated by the norms in force,

desiring to regulate, in accordance with the international practice governing this area and the accepted international obligations, mutual readmission of persons and to determine the conditions for transit of citizens of third States and persons without citizenship whose entry to or residence in the territory of the State of the other Contracting Party is illegal,

on the basis of an efficient cooperation and principle of reciprocity,

taking into consideration that illegal migration presents a danger to the public security and economic stability of the Contracting Parties,

aware of the fact that restricting illegal migration of persons is part of an overall effort towards European co-operation,

have agreed as follows:

Article 1

Definitions

In the sense of the present Agreement the next terms mean as it follows:

a. «Requesting Contracting Party» shall mean Contracting Party which submits a readmission or transit application;

b. “Requested Contracting Party” shall mean Contracting Party to which it is addressed the readmission or transit application;

c. “Visa” shall mean an authorisation issued or a decision taken by the competent authorities of Contracting Parties which is required with a view to entry in, stay or transit through its territory. This shall not include airport transit visa;

d. «Residence permit» shall mean a permit of any type issued by the competent authorities of Contracting Parties entitling a person to reside on its territory. This shall not include temporary permission to remain on its territory in connection with the processing of an asylum application or an application for a residence permit.

e. “Citizen of the Republic of Moldova” shall mean any person who holds the citizenship of the Republic of Moldova, in accordance with its legislation;

f. “Citizen of Montenegro” shall mean any person who holds the citizenship of Montenegro, in accordance with its legislation;

g. “Third-country citizen′ shall mean any person who holds a citizenship other than that of the Republic of Moldova or of Montenegro;

h. “Stateless person” shall mean any person who does not hold a citizenship of any State;

i. “Competent authorities” shall mean national competent authorities of the Contracting Parties entrusted with the implementation of this Agreement, pursuant with Article 16 paragraph 1 of this Agreement;

j. “Transit” shall mean the passage of a third country citizen or a stateless person through the territory of the Requested Contracting Party while travelling from the Requesting Contracting Party to the country of destination;

k. “Readmission” shall mean return by the Requesting Contracting Party and admission by the Requested Contracting Party of a person (citizen of the Requested Contracting Party, third country citizen or stateless person) who do not, or no longer, fulfil the conditions for entry to, presence in, or residence on, the territories of the Contracting Parties in accordance with the provisions of this Agreement.

Article 2

Readmission of Own Citizens

(1) At the request of the Requesting Contracting Party, the Requested Contracting Party shall admit without any formalities any person who does not fulfil or no longer fulfils the valid requirements for entry to or residence on the sovereign territory of the Requesting Contracting Party, provided that it is proved or assumed on the basis of prima facie evidence that person possesses the citizenship of the Requested Contracting Party.

(2) Requested Contracting Party shall also readmit:

- minor unmarried children of the person mentioned in paragraph 1, regardless of their place of birth or their citizenship, unless they have an independent right of residence in the Requesting Contracting Party;

- spouses of person mentioned in paragraph 1, holding another citizenship, provided they have the right to enter and stay or receive the right to enter and stay in the territory of Requested Contracting Party, unless they have an independent right of residence in the Requesting Contracting Party.

(3) The Requested Contracting Party shall also readmit persons who have been deprived of, or who have renounced, the citizenship of the Requested Contracting Party since entering the territory of the Requesting Contracting Party, unless such persons have at least been promised naturalisation by the Requesting Contracting Party.

(4) After the Requested Contracting Party has given a positive reply to the readmission application, the competent consular office of the Requested Contracting Party shall immediately and not later than within three working days, issue the travel document required for the return of the person to be readmitted, with a validity of up to 2 months. If, for legal or factual reasons, the person concerned cannot be transferred within the period of validity of the travel document that was initially issued, the competent consular office of the Requested Contracting Party shall, within 14 calendar days, issue a new travel document with a period of validity of the same duration. If the Requested Contracting has not, within 14 calendar days, issued the new travel document, it shall be deemed to accept the use of the travel document for foreigners issued by the Requesting Contracting Party for person concern return to the Requested Contracting Party.

(5) In case the person to be readmitted holds the citizenship of a third state in addition to Moldovan or Montenegrin citizenship, the Requesting Contracting Party State shall take into consideration the will of the person to be readmitted to the state of the person′s choice.

Article 3

Readmission of third-country citizens and stateless persons

1. The Requested Contracting Party shall readmit, upon application by the Requesting Contracting Party and without further formalities other than those provided for in this Agreement, all third-country citizens or stateless persons who do not, or who no longer, fulfil the legal conditions in force for entry to, presence in, or residence on the territory of the Requesting Contracting Party provided that it is proved, or may be assumed on the basis of prima facie evidence furnished, that such persons:

(a) hold, or at the time of entry held, a valid visa or a residence permit issued by the competent authorities of the Requested Contracting Party; or

(b) illegally and directly entered the territory of the Requesting Contracting Party after having stayed on, or transited through, the territory of the Requested Contracting Party.

2. The readmission obligation in Paragraph 1 shall not apply if:

(a) the third-country citizen or stateless person has only been in airside transit via an international airport of the Contracting Parties; or

(b) the Requesting Contracting Party has issued to the third-country citizen or the stateless person a visa or a residence permit before or after entering its territory unless:

i. that person is in possession of a visa or a residence permit, issued by the Requested Contracting Party, which expires later, or

ii. the visa or the residence permit has been obtained by using forged or falsified documents, or by making false statements, and that the person concerned has stayed on, or transited through, the territory of the Requested Contracting Party or

iii. that person fails to observe any condition attached to the visa and that the person has stayed on, or transited through, the territory of the Requested Contracting Party.

3. After the Requested Contracting Party has given a positive reply to the readmission application, the Requesting Contracting Party issues to the person concerned the travel document for foreigners required for his or her return to the Requested Contracting Party.

Article 4

Readmission Principles

1. Subject to Paragraph 2 of this Article, any transfer of a person to be readmitted on the basis of one of the obligations contained in Articles 2 and 3 shall require the submission of a readmission application to the competent authority of the Requested Contracting Party.

2. No readmission application shall be needed where the person to be readmitted is in possession of a valid travel document and in case such a person is a third- country citizen or stateless person, also holds a valid visa or a residence permit of the Requested Contracting Party.

Article 5

Readmission application

1. The readmission application shall be submitted in writing by the competent authority of the Requesting Contracting Party to the competent authority of the Requested Contracting Party via secured communication channels, in particular by mail or e-mail. The competent authority of the Requested Contracting Party shall send an acknowledgment immediately upon receiving the readmission application.

2. The reply to the readmission application shall be submitted in writing to the competent authority of the Requesting Contracting Party by the competent authority of the Requested Contracting Party via secured communication channels, in particular by fax or e-mail. In case the readmission application is refused, reasons shall be given in writing.

3. To the extent possible, the readmission application is to contain the following information:

(a) the particulars of the person to be readmitted (e.g. given names, surnames, date and place of birth and the last place of residence) and, where appropriate, the particulars of minor unmarried children and/or spouses;

(b) documents on the basis of which the citizenship shall be proven and the indication of the means with which prima facie evidence of citizenship, transit, the conditions for the readmission of third-country citizens and stateless persons and unlawful entry and residence will be provided;

(c) photograph of the person to be readmitted,

(d) finger prints of the person if needed.

4. A common form to be used for readmission applications is attached as Annex 5 to this Agreement.

Article 6

Means of evidence regarding citizenship

1. Proof of citizenship pursuant to Article 2(1) of this Agreement can be particularly furnished through the documents listed in Annex 1 of this Agreement, even if their period of validity has expired. If such documents are presented, the Contracting Parties shall mutually recognise the citizenship without further investigation being required. Proof of citizenship cannot be furnished through false documents.

2. Prima facie evidence of citizenship pursuant to Article 2(1) of this Agreement can be particularly furnished through the documents listed in Annex 2 of this Agreement, even if their period of validity has expired. If such documents are presented, the Contracting Parties shall deem the citizenship to be established, unless they can prove otherwise. Prima facie evidence of citizenship cannot be furnished through false documents.

3. If none of the documents listed in Annexes 1 and 2 of this Agreement can be presented, the consular offices of the Requested Contracting Party or within the legal framework of the Requested Contracting Party, any other authority shall, upon request, make arrangements to interview the person to be readmitted without undue delay, at the latest within three working days from the requesting day, in order to assist in establishing the person′s citizenship.

Article 7

Means of evidence regarding third-country citizens and stateless persons

1. Proof of the conditions for the readmission of third-country citizens and stateless persons laid down in Article 3(1) of this Agreement,shall be particularly furnished through the means of evidence listed in Annex 3 of this Agreement; it cannot be furnished through false documents. Any such proof shall be mutually recognized by the Contracting Parties without any further investigation being required.

2. Prima facie evidence of the conditions for the readmission of third-country citizens and stateless persons laid down in Article 3(1) shall be particularly furnished through the means of evidence listed in Annex 4 of this Agreement; it cannot be furnished through false documents. Where such prima facie evidence is presented, the Contracting Parties shall deem the conditions to be met, unless they can prove otherwise.

3. The unlawfulness of entry, presence or residence shall be established by means of the travel documents of the person concerned in which the necessary visa or other residence permit for the territory of the Requesting Contracting Party are missing. A statement by the Requesting Contracting Party that the person concerned has been found not having the necessary travel documents, visa or residence permit shall likewise provide prima facie evidence of the unlawful entry, presence or residence.

Article 8

Additional documents for establishing the citizenship

1. If the Requesting State considers that additional documents not listed in Annexes 2 and 4 to this Agreement may be essential for establishing the citizenship of the person to be readmitted, such documents may be submitted to the Requested Contracting Party together with the readmission application.

2. The decision as to whether the documents listed in Paragraph 1 of this Article are to be taken into account in processing the readmission application shall be made by the Requested Contracting Party.

Article 9

Time limits

1. The application for readmission must be submitted to the competent authority of the Requested Contracting Party within a maximum period of one year after the Requesting Contracting Parties competent authority has gained knowledge that a third-country citizen or a stateless person does not, or does no longer, fulfil the conditions in force for entry to, presence in or residence. Where there are legal or factual obstacles to the application being submitted in time, the time limit shall, upon request by the Requesting Contracting Party, be extended but only until the obstacles have ceased to exist.

2. A readmission application must be replied to in writing within 12 (twelve) working days. This time limit begins to run with the date of the acknowledgment of the receipt of the readmission request.

3. Where there are legal or factual obstacles to the application being replied to within 12 (twelve) working days, this time limit may, upon reasoned request, be extended with a maximum of 6 (six) calendar days.

4. If the Requested Contracting Party does not reply within the time limits mentioned in Paragraph 2 or 3 of this Article, the transfer shall be deemed to have been agreed to.

5. After positive response has been given by the Requested Contracting Party, the person concerned shall be transferred by the Requesting Contracting Party within two months. On request of the Requesting Contracting Party, this time limit may be extended by the time taken to deal with legal or practical obstacles.

Article 10

Transfer modalities and modes of transportation

1. Before returning a person, the competent authorities of the Contracting Parties shall make arrangements in writing in advance regarding the return date, the border crossing point, possible escorts and other information relevant to the return.

2. To the extent possible and if necessary, the written arrangements mentioned in Paragraph 1 of this Article should also contain the following information:

(a) a statement indicating that the person to be transferred may need help or care, if this is in the interest of the person concerned;

(b) any other protection or security measures, which may be necessary in the individual transfer case or information concerning the health of the person, if it is in the interest of the person concerned.

3. Transportation may take place by air or land. Return by air shall not be restricted to the use of the national carriers of the Contracting Parties and may take place by using scheduled or charter flights. In the event of escorted returns, the escorting personnel shall be provided by the Requesting Contracting Party.

4. If a person in the process of readmission or transit is to be accompanied by escorts, the Requesting Contracting Party shall give the following data: first names, family names, functions of escorting persons, type, number and date of issue of passports and service identification cards, contents of their mission order.

5. Escorts shall be obliged to comply with the legislation of the Requested Contracting Party.

6. Escorts shall not wear service uniform, and bear weapons and other objects restricted on the territory of the Requested Contracting Party.

7. Escorts shall carry valid passports and service identification cards, as well as mission orders issued by the competent authority of the Requesting Contracting Party.

8. The number of escort staff shall be agreed upon in advance by the competent authorities on a case-by-case basis.

9. The competent authorities shall cooperate on all issues related to the stay of escorts in the territory of the Requested Contracting Party. If necessary, the competent authorities of the Requested Contracting Party shall provide the escorts with possible assistance.

Article 11

Readmission in error

1. The Requesting Contracting Party shall take back any person readmitted by the Requested Contracting Party if it is established, within a period of three months after the return of the person concerned, that the requirements laid down in Articles 2 or 3 of this Agreement have not been met.

2. In such cases the procedural provisions of this Agreement shall apply mutatis mutandis and all available information relating to the actual identity and citizenship of the person to be taken back shall be provided.

Article 12

Transit Principles

1. The Contracting Parties should restrict the transit of third-country citizens or stateless persons to cases where such persons cannot be returned to the State of destination directly.

2. The Contracting Parties shall allow and authorise the transit of third-country citizens or stateless persons when requested by one of the Contracting Parties, if the onward journey to possible other States of transit and the readmission by the State of destination is assured.

3. Transit can be refused by the Contracting Parties:

(a) if the third-country citizen or the stateless person runs the real risk of being

subjected to torture or to inhuman or degrading treatment or punishment or the death penalty or of persecution because of his race, religion, nationality, membership of a particular social group or political conviction in the State of destination or another State of transit; or

(b) if the third-country citizen or the stateless person shall be subject to criminal sanctions in the State of Destination or in another State of transit; or

(c) on grounds of public health, domestic security, public order or other national interests of the Requesting Contracting Party.

4. The Contracting Parties may revoke any authorisation issued if circumstances referred to in Paragraph 3 of this Article subsequently arise or come to light which stand in the way of the transit operation, or if the onward journey in possible States of transit or the readmission by the State of destination is no longer assured. In this case, the Requesting Contracting Party shall take back the third-country citizen or the stateless person, as necessary and without delay.

Article 13

Transit procedure

1. The transit application shall be sent by the competent authority of the Requesting Contracting Party directly to the competent authority of the Requested Contracting Party via secured communication channels, in particular by fax, or e- mail. The competent authority of the Requested Contracting Party shall send an acknowledgment immediately upon receiving the transit application.

2. The reply to the transit application shall be provided to the competent authority of the Requesting Contracting Party directly by the competent authority of the Requested Contracting Party via secured communication channels, in particular by fax, or e-mail within three working days and in writing confirming the point of entry and the envisaged time of transit, or inform it of the reasons if the transit application is refused.

3. The transit application shall contain the following information:

(a) type of transit (by air or land), possible other States of transit and intended final destination;

(b) the particulars of the person concerned (e.g. given name, surname, maiden name, other names used/by which known or aliases, date of birth, sex and - where possible - place of birth, citizenship, language, type and number of travel document);

(c) envisaged border crossing point, time of transfer and possible use of escorts;

(d) a statement by the Requesting Contracting Party to the effect that it considers that the conditions referred to in Article 12 Paragraph 2 of this Agreement have been fulfilled and that there is no knowledge of the existence of the reasons for refusing the application under Article 12 Paragraph 3 of this Agreement.

(e) A common form to be used for transit applications is attached as Annex 6 to this Agreement.

4. If the transit operation takes place by air, the person to be transferred and possible escorts shall be exempted from having to obtain an airport transit visa.

5. The competent authorities of the Requested Contracting Party shall, subject to mutual consultations, assist in the transit operations, in particular through the surveillance of the persons in question and the provision of suitable amenities for that purpose.

Article 14

Transport and transit costs

1. Without prejudice to the right of the competent authorities to recover the costs associated with the readmission from the person to be readmitted or third parties, all transport costs incurred in connection with readmission and transit operations pursuant to this Agreement as far as the border of the State of final destination shall be borne by the Requesting Contracting Party.

Article 15

Data Protection

The communication of personal data shall only take place if such communication is necessary for the implementation of this Agreement by the competent authorities of the Contracting Parties as the case may be. The processing and treatment of personal data in a particular case shall be subject to the domestic laws of the Contracting Parties. Additionally the following principles shall apply:

(a) personal data must be processed fairly and lawfully;

(b) personal data must be collected for the specified, explicit and legitimate purpose of implementing this Agreement and not further processed by the communicating authority nor by the receiving authority in a way incompatible with that purpose;

(c) personal data must be adequate, relevant and not excessive in relation to the purpose for which they are collected and/or further processed; in particular, personal data communicated may concern only the following:

- the particulars of the person to be transferred (e.g. given names, surnames, any previous names, other names used/by which known or aliases, sex, civil status, date and place of birth, current and any previous citizenship),

- passport, identity card or driving licence (number, period of validity, date of issue, issuing authority, place of issue),

- stop-overs and itineraries,

- the information needed to identify the person to be transferred or to examine the readmission requirements pursuant to this Agreement;

(d) personal data must be accurate and, where necessary, kept up to date;

(e) personal data must be kept in a form which permits identification of data subjects for no longer than is necessary for the purpose for which the data were collected or for which they are further processed;

(f) both the communicating authority and the receiving authority shall take every reasonable step to ensure as appropriate the reviewing, erasure or blocking of personal data where the processing does not comply with the provisions of this Article, in particular because those data are not adequate, relevant, accurate, or they are excessive in relation to the purpose of their processing. This includes the notification of any reviewing, erasure or blocking to the other Contracting Party;

(g) upon request, the receiving authority shall inform the communicating authority of the use of the communicated data and of the results obtained there from;

(h) personal data may only be communicated to the competent authorities. Further communication to other bodies requires the prior consent of the communicating authority;

(i) the communicating and the receiving authorities are under an obligation to make a written record of the communication and receipt of personal data.

Article 16

2. The Contracting Parties shall immediately inform each other of any changes concerning the competent authorities or their details through diplomatic channels.

3. The consular offices of the Contracting Parties are designated to assist the competent authorities for the purposes of the implementation of this Agreement.

Article 17

Designation of border crossing points

1. For readmission and transit the Contracting Parties designate the following border crossing points:

(a) for the Republic of the Moldova: International Airport Chisinau.

(b) for Montenegro: International Airport in Podgorica.

2. The Contracting Parties may exceptionally designate other border crossing points which will be determined according to arising needs.

3. The Contracting Parties shall immediately inform each other of any changes in the list of the border crossing points provided in Paragraph 1 of this Article, through competent authorities directly.

Article 18

Language of Communication

1. For the purposes of the implementation of this Agreement the language of communication will be English.

Article 19

Principles of good cooperation

1. Both Contracting Parties undertake to solve conjointly any problems arising from the implementation of this Agreement. They keep each other constantly informed of immigration requirements (conditions) for the nationals of third states.

2. Any disputes arising out of the interpretation, application or implementation of this Agreement shall be settled through mutual consultations and exchange of views, orally or in written from, between the competent authorities of the Contracting Parties.

3. Each Contracting Party may request that the experts of the two Parties to meet for resolving any problems associated with the interpretation or the application of this Agreement.

Article 20

Conformity clause

1. This agreement shall be applied without prejudice to the rights, obligations and responsibilities of the Contracting Parties arising from international law.

2. This Agreement shall not be applied to the persons who are in the national procedure for asylum seeking in any of the Contracting Parties, until the final decision on the request for asylum is taken.

Article 21

Annexes

All the Annexes to this Agreement constitute its integral part.

Article 22

Amendments

This Agreement may be amended by mutual written consent of the Contracting Parties at any time. The amendments shall enter into force in accordance with the same legal procedure prescribed under Article 25(1) of this Agreement.

Article 23

Temporary Suspension

Each Contracting Party may suspend temporarily, by officially notifying the other Contracting Party, the implementation of this Agreement partly or completely with regard to third-country citizens and stateless persons, on grounds of security, protection of public order or public health or other national interests. The suspension shall enter into force on the second day following the day of receipt of such written notification.

Article 24

Termination

Each Contracting Party may terminate this Agreement by written notification to the other Contracting Party. This Agreement shall cease to apply three months after the date of receipt of such notification.

Article 25

Entry into force and duration

1. This Agreement shall enter into force on the first day of the month following the date of receipt of the last written notification through diplomatic channels, by which the Contracting Parties inform each other that all necessary requirements foreseen by their national legislation for the entry into force of this Agreement have been fulfilled.

2. This Agreement is concluded for an unlimited period.

Done at Brdo pri Kranju on 17.05.2011 in duplicate, each in the Moldovan, Montenegrin and English languages, all texts being equally authentic.

In case of divergence in the interpretation of this Agreement the English text shall prevail.

Annex 1

Documents considered as proof of citizenship

(Articles 2(1) and 6(1) of the Agreement)

Where the Requested State is the Republic of Moldova:

• all types of valid passports of the Republic of Moldova,

• valid national identity cards.

• travel documents issued by the authorities of the Republic of Moldova Where the Requested State is Montenegro:

• all valid travel documents (Montenegrin passport, Montenegrin service and diplomatic passports, and lassie passé for Montenegrin citizens) issued after 05 May 2008,

• valid identity cards issued to Montenegrin citizens after 05 May 2008.

Annex 2

Documents considered as prima facie evidence of citizenship

(Articles 2(1) and 6(2) of the Agreement)

• any of the documents listed in Annex 1 of this Agreement, the validity of which has expired,

• photocopies of any of the documents listed in Annex 1 of this Agreement,

• military identity cards and military service books,

• personnel identity cards issued by competent State authorities,

• seaman′s books and skippers′ service cards,

• citizenship certificates and other official documents that mention or clearly indicate citizenship,

• driving licenses,

• birth certificates,

• any other official document which can help to establish the citizenship

• statement of the person concerned or of an authentic witness that entered in official minutes report prepared by the competent authorities that can be corroborated by competent authorities of the Requested State.

Annex 3

Documents considered as proof of the conditions for the

readmission of third-country citizens and stateless persons

(Articles 3(1) and 7(1) of the Agreement)

• entry/departure stamps or similar endorsements with date in the travel document of the person concerned,

• documents, certificates and bills of any kind bearing a person′s name (e.g. hotel bills, car rental agreements, credit card receipts etc.) which clearly show that the person concerned stayed on the territory of the requested State at a certain date or period,

• passenger tickets bearing a person′s name and/or passenger lists of air, train, coach or boat passages which show the presence and the itinerary of the person concerned on the territory of the requested State at a certain date or period,

• information showing that the person concerned used the services of a transport company or a travel agency on a certain date.

Annex 4

Documents considered as prima facie evidence of the conditions

for the readmission of third-country citizens and stateless persons

(Articles 3(1) and 7(2) of the Agreement)

• statement by the person concerned given in judicial or administrative proceedings,

• report prepared by the relevant authorities of the Requesting Contracting Party, of place and circumstances under which the person concerned has been found after entering the territory of that State,

• data related to the identity and/or stay of a person which has been provided by an international organisation (e.g. UNHCR),

• reports/confirmation of data by family members, travelling companions, etc.

• statement of the person concerned.
