Guvernul Republicii Moldova şi Guvernul Republicii Bulgaria, denumite în continuare “Părţi”,
convinse că migraţia de muncă este un fenomen de interes comun pentru ambele State şi poate contribui la dezvoltarea economică şi socială, facilita diversitatea culturală şi dezvolta schimbul tehnologic,
conştiente de necesitatea asigurării respectării drepturilor, obligaţiilor şi garanţiilor stipulate în legislaţiile naţionale şi tratatele internaţionale la care ambele State sunt Parte,
în scopul aprofundării cooperării între cele două Părţi în contextul politicii externe şi migraţionale ale ambelor State,
au convenit asupra următoarelor:
CAPITOLUL UNU
PREVEDERI GENERALE
ARTICOLUL 1
1. Autorităţile Părţilor responsabile de prezentul Acord (denumite în continuare ”Autorităţi Autorizate”) sunt:
a. în Republica Moldova - Ministerul Sănătăţii, Muncii şi Protecţiei Sociale;
b. în Republica Bulgaria - Ministerul Muncii şi Politicii Sociale.
2. Părţile desemnează în vederea implementării prezentului Acord următoarele instituţii (denumite în continuare ”Instituţii Competente”):
a. în Republica Moldova – Agenţia Naţională pentru Ocuparea Forţei de Muncă;
b. în Republica Bulgaria – Agenţia pentru Ocuparea Forţei de Muncă din cadrul Ministerului Muncii şi Politicii Sociale.
3. Noţiunile utilizate în prezentul Acord vor fi interpretate în conformitate cu legislaţia Statului Părţii, în care se exercită relaţia juridică care decurge din prezentul Acord şi care se referă la implementarea acestor concepte.
ARTICOLUL 2
1. Prezentul Acord se va aplica următoarelor categorii de lucrători migranţi care sunt cetăţeni ai Statului uneia dintre Părţi şi au semnat un contract individual de muncă în condiţiile prezentului Acord, precum şi deţin permis de şedere necesar pe teritoriul Statului celeilalte Părţi:
a. lucrătorilor migranţi pentru o perioadă iniţială de până la un an cu posibilitatea prelungirii consecutive a acesteia pentru o perioadă totală de pînă la trei ani;
b. lucrătorilor sezonieri pentru o perioadă maximă în conformitate cu legislaţia Statului Părţii Primitoare.
2. Categoriilor de lucrători migranţi menţionate în Alineatul 1 al prezentului Articol nu se vor solicita permise de muncă.
ARTICOLUL 3
1. Intrarea, şederea şi angajarea cetăţenilor Republicii Moldova şi Republicii Bulgaria pe teritoriul Statului celeilalte Părţi, în cadrul prezentului Acord vor fi reglementate de legislaţia Statului Părţii Primitoare.
2. Lucrătorii migranţi angajaţi pot fi însoţi de membrii familiei acestora în conformitate cu legislaţia Statului Părţii Primitoare.
CAPITOLUL DOI
DISPOZIŢII PRIVIND INTERMEDIEREA ANGAJĂRII
ARTICOLUL 4
Recrutarea şi angajarea Candidaţilor pentru ofertele de muncă propuse în cadrul prezentului Acord va fi desfăşurată de către Instituţiile Competente ale Părţilor specificate la Articolul 1, Alineatul 2.
ARTICOLUL 5
1. Instituţiile Competente ale Părţilor specificate la Articolul 1, Alineatul 2 vor realiza următoarele activităţi de intermediere a angajării, în limitele alocaţiilor bugetare de Stat:
a. realiza schimb de informaţii cu privire la ofertele de muncă recepţionate de la angajatorii stabiliţi pe teritoriul Statului uneia dintre Părţi;
b. selecta în două etape potenţialii lucrători migranţi (denumiţi în continuare ”Candidaţi”):
1) selectarea preliminară în baza documentelor prezentate;
2) selectarea finală aprobată de către angajatori.
c. acorda asistenţă în negocierea procesului de angajare şi semnarea contractelor individuale de muncă de către Candidaţii aprobaţi;
d. acorda informaţie cu privire la condiţiile de şedere, muncă, asigurare socială, asigurare medicală, cazare şi plecare în limba oficială a Statului Părţii Trimiţătoare, lucrătorilor migranţi care au semnat contracte individuale de muncă.
2. Ofertele de muncă menţionate în Alineatul 1 al prezentului Articol vor conţine următoarele informaţii indispensabile:
a. sectorul economic şi regiunea geografică unde se va desfăşura activitatea de muncă;
b. numărul lucrătorilor migranţi care urmează a fi angajaţi;
c. cerinţele faţă de lucrători migranţi pentru a fi angajaţi;
d. data limită pentru depunerea documentelor şi selectarea Candidaţilor;
e. durata angajării;
f. informaţie generală cu privire la condiţiile de muncă, salarizare şi cazare;
g. data sosirii a Candidaţilor aprobaţi la locul de muncă pe teritoriul Statului Părţii Primitoare;
h. achitarea costurilor de deplasare în şi de pe teritoriul Statului Părţii Primitoare.
3. Instituţiile Competente ale Părţilor specificate la Articolul 1, Alineatul 2 vor forma un Comitet Comun de Selectare, compus dintr-un număr egal de reprezentanţi ai Părţilor.
ARTICOLUL 6
Selectarea Candidaţilor în corespundere cu calificarea profesională, în baza actelor depuse, va fi realizată de către Instituţia Competentă a Părţii Trimiţătoare.
ARTICOLUL 7
1. Selectarea finală a Candidaţilor va fi realizată de către angajatori înainte de plecare, în corespundere cu criteriile de selectare specificate de către Comitetul Comun de Selectare.
2. Candidaţii care au promovat selectarea finală vor fi supuşi unui control medical pe teritoriul Statului Părţii Trimiţătoare. Orice examene medicale adiţionale solicitate pe teritoriul Statului Părţii Primitoare vor fi acoperite de către angajator.
3. Candidaţii aprobaţi vor semna înainte de plecare, un contract individual de muncă pe durată determinată în limbile Română şi Bulgară, în conformitate cu legislaţia Statului Părţii Primitoare.
4. O copie de pe contractele individuale de muncă va fi remisă Instituţiei Competente a Părţii Primitoare.
ARTICOLUL 8
1. Aplicarea vizei în cadrul prezentului Acord se va realiza prioritar de către oficiul consular competent a Părţii Primitoare pe teritoriul Statului Părţii Trimiţătoare în corespundere cu legislaţia Statelor Părţilor şi cu prevederile corespunzătoare ale tratatelor internaţionale aplicabile Părţilor. Viza care urmează a fi aplicată în paşaport va include tipul, scopul şi durata şederii pe teritoriul Statului Părţii Primitoare. Costurile pentru viză vor fi acoperite de către Candidaţii aprobaţi.
2. Lucrătorilor migranţi li se va elibera permise de şedere necesare în conformitate cu legislaţia Statului Părţii Primitoare.
3. Instituţia Competentă a Părţii Trimiţătoare va informa lucrătorii migranţi cu privire la data şi locul sosirii, iar Instituţia Competentă a Părţii Primitoare va coordona cu angajatorii organizarea întâlnirii/întîmpinării lucrătorilor migranţi.
ARTICOLUL 9
1. Cheltuielile de deplasare a lucrătorului migrant în şi de pe teritoriul Statului Părţii Primitoare vor fi suportate de către angajator.
2. Angajatorul va informa Instituţiile Competente ale ambelor Părţi în detaliu despre ziua, ora şi locul de plecare şi sosire, modalitatea de deplasare şi aspectele ce ţin de asigurare.
CAPITOLUL TREI
DISPOZIŢII PRIVIND CONDIŢIILE DE MUNCĂ ŞI DREPTURILE
SOCIALE ALE LUCRĂTORILOR MIGRANŢI
ARTICOLUL 10
1. Lucrătorii migranţi vor avea aceleaşi drepturi de muncă şi obligaţii precum lucrătorii locali, şi se vor bucura în mod egal de protecţie la locul de muncă în corespundere cu legislaţia Statului Părţii Primitoare.
2. Lucrătorii migranţi se vor bucura pe teritoriul Statului Părţii Primitoare de aceeaşi protecţie legală în ceea ce priveşte drepturile personale şi de proprietate, precum cetăţenii acestuia.
ARTICOLUL 11
Remunerarea muncii şi condiţiile de muncă ale lucrătorilor migranţi vor fi stabilite în contractele individuale de muncă semnate de către aceştia, care în permanenţă vor fi în conformitate cu acordurile colective în vigoare sau, în absenţa unor astfel de acorduri, cu legislaţia Statului Părţii Primitoare aplicabilă lucrătorilor locali care au aceeaşi profesie şi calificare.
ARTICOLUL 12
Părţile sunt de acord că, în domeniul securităţii sociale, se va aplica Acordul în domeniul asigurărilor sociale între Republica Moldova şi Republica Bulgaria, semnat la 5 decembrie 2008, în vigoare de la 01 septembrie 2009.
ARTICOLUL 13
Litigiile ce pot apărea între angajatori şi lucrătorii migranţi se vor soluţiona în conformitate cu legislaţia Statului Părţii Primitoare.
CAPITOLUL PATRU
DISPOZIŢII PRIVIND MODUL DE ORGANIZARE ŞI FUNCŢIONARE
A COMITETULUI COMUN DE SELECTARE
ARTICOLUL 14
1. Comitetul Comun de Selectare indicat în Articolul 5, Alineatul 3 va fi un organ permanent şi îşi va realiza atribuţiile prin intermediul mijloacelor electronice.
2. Componenţa Comitetului Comun de Selectare va fi determinată prin decizia comună a conducătorilor Instituţiilor Competente şi va fi compusă dintr-un număr egal de reprezentanţi ai Instituţiilor Competente ale Părţilor specificate la Articolul 1, Alineatul 2.
3. Comitetul Comun de Selectare va:
a. aproba criteriile de selectare pentru ofertele de muncă primite, precum este specificat în Solicitarea indicată în Articolul 15, Alineatul 1;
b. aproba un model standard a contractului individual de muncă în conformitate cu legislaţia Statului Părţii Primitoare, în limba Română şi limba Bulgară;
c. elabora şi aproba forma cererii indicate în Articolul 16 în limba Română şi limba Bulgară.
d. aproba o ofertă de muncă standard;
e. asigura acordarea informaţiei şi consultaţiei Candidaţilor într-un timp rezonabil şi într-un mod comprehensiv pe parcursul procedurii de selectare;
f. aproba forma declaraţiei prin care lucrătorul migrant se obligă să se reîntoarcă pe teritoriul Statului Părţii Trimiţătoare.
4. Contractul individual de muncă standard indicat în Alineatul 3 al prezentului Articol va include prevederi cu privire la:
a. numele şi adresa angajatorului;
b. datele personale ale lucrătorului migrant;
c. remunerarea;
d. condiţiile de muncă;
e. acomodarea;
f. asigurarea medicală;
g. condiţiile de prelungire a contractului individual de muncă sau rezilierea acestuia înainte de expirare a termenului de valabilitate;
h. responsabilitatea părţilor în cazul nerespectării termenilor contractului individual de muncă şi modalităţile de soluţionare a disputelor legale;
i. modalitate de achitare a costurilor de deplasare în şi de pe teritoriul Statului Părţii Primitoare.
5. Comitetul Comun de Selectare va lua decizii în absenţă, pentru care vor fi elaborate minute.
CAPITOLUL CINCI
DISPOZIŢII PRIVIND RECRUTAREA LUCRĂTORILOR MIGRANŢI
ARTICOLUL 15
1. Fiecare dintre Instituţiile Competente poate depune oficial în scris, prin fax sau e-mail, o Solicitare de cooperare privind recrutarea lucrătorilor migranţi de la cealaltă Parte a Acordului (în continuare denumită ”Solicitare”).
2. Solicitarea indicată în Alineatul 1 al prezentului Articol va fi efectuată în baza ofertei de muncă primite de la angajatori şi va conţine:
a. informaţia cu privire la numărul lucrătorilor migranţi solicitaţi;
b. durata angajării;
c. cerinţele privind calificarea profesională şi/sau nivelul de studii şi/sau experienţa de muncă;
d. informaţie generală privind condiţiile de trai şi de muncă pe teritoriul Statului Părţii Primitoare;
e. data Solicitării.
3. Solicitarea indicată în Alineatul 1 al prezentului Articol poate fi făcută o dată pe lună sau în cazuri excepţionale – de două ori pe lună.
4. Odată cu primirea Solicitării, Instituţia Competentă a Părţii Trimiţătoare va realiza activităţile necesare pentru a informa potenţialii lucrători migranţi despre oportunităţile de angajare pe teritoriul Statului Părţii Primitoare.
ARTICOLUL 16
1. Candidaţii vor depune cereri la Instituţia Competentă a Părţii Trimiţătoare.
2. Candidaţii vor ataşa la cererea stipulată la Alineatul 1 al prezentului Articol:
a. documentele doveditoare a nivelului de studii, specializare, competenţă, calificare profesională şi experienţă;
b. alte documente care ar fi solicitate în conformitate cu legislaţia Statului Părţii Primitoare pentru poziţia propusă de către angajator în oferta de muncă, inclusiv pentru profesiile reglementate;
c. copia de pe pagina documentului de călătorie care conţine fotografia şi datele personale;
d. două fotografii color- formatul 3,5/4,5 cm.
ARTICOLUL 17
1. Instituţia Competentă a Părţii Trimiţătoare va selecta Candidaţii potriviţi în baza verificării conformităţii documentelor cu criteriile de selectare aprobate de către Comitetul Comun de Selectare.
2. Instituţia Competentă a Părţii Trimiţătoare va pregăti refuzuri justificate pentru Candidaţii care nu corespund cerinţelor sau care au un set de documente incomplet pînă la data expirării termenului.
3. Fiecare Candidat poate primi de la Instituţia Competentă a Părţii Trimiţătoare informaţie cu privire la stadiul de examinare a cererii acestuia/acesteia.
4. Instituţia Competentă a Părţii Trimiţătoare va asigura un proces transparent de selectare a Candidaţilor.
ARTICOLUL 18
1. Instituţia Competentă a Părţii Trimiţătoare va expedia lista Candidaţilor aprobaţi Instituţiei Competente a Părţii Primitoare, şi dacă angajatorul va avea o astfel de cerinţă specificată în oferta sa, inclusiv şi documentele ataşate la cererile acestora, legalizate corespunzător şi însoţite de traducerile certificate ale acestora în limba Română sau limba Bulgară. Costurile pentru legalizarea şi traducerea cererilor vor fi acoperite de către Candidaţii aprobaţi.
2. Instituţia Competentă a Părţii Primitoare va expedia lista şi documentele specificate la Alineatul 1 al prezentului Articol angajatorilor.
3. Angajatorii vor selecta lucrătorii migranţi în baza documentelor specificate la Alineatul 1 al prezentului Articol şi vor transmite înapoi la Instituţia Competentă a Părţii Primitoare lista finală a Candidaţilor aprobaţi de către aceştia.
4. Instituţia Competentă a Părţii Primitoare va transmite lista indicată în Alineatul 3 al prezentului Articol Instituţiei Competente a Părţii Trimiţătoare.
5. Instituţia Competentă a Părţii Trimiţătoare va oferi Candidaţilor informaţia privind rezultatele selectării finale.
6. Schimbul de liste şi documente specificate în alineatele de mai sus se va realiza prin intermediul mijloacelor electronice.
ARTICOLUL 19
Instituţia Competentă a Părţii Trimiţătoare, la cerere şi din contul angajatorului, va organiza interviuri şi/sau examene practice pentru profesia respectivă în concordanţă cu oferta de muncă.
ARTICOLUL 20
1. Fiecare candidat care confirmă disponibilitatea de a fi angajat va fi direcţionat de către Instituţia Competentă a Părţii Trimiţătoare spre instituţia medicală care va realiza examinarea medicală.
2. Instituţia Competentă a Părţii Trimiţătoare va transmite Instituţiei Competente a Părţii Primitoare, lista Candidaţilor care au confirmat disponibilitatea de a pleca şi au trecut un examen medical care confirmă lipsa obstacolelor de a desfăşura activitatea/profesia pentru care aceştia au fost aprobaţi.
3. Instituţia Competentă a Părţii Primitoare va transmite informaţia indicată în Alineatul 2 al prezentului Articol angajatorilor.
ARTICOLUL 21
1. Instituţia Competentă a Părţii Trimiţătoare va organiza o şedinţă cu Candidaţii aprobaţi, imediat înainte de plecarea acestora, unde li se va acorda în scris informaţia cu privire la drepturile şi obligaţiile ce ţin de munca acestora pe teritoriul Statului Părţii Primitoare, referitor la:
a. contractul individual de muncă;
b. drepturile şi obligaţiile lucrătorilor şi angajatorilor pe teritoriul Statului Părţii Primitoare;
c. cultura şi tradiţiile Statului Părţii Primitoare;
d. datele de contact în caz de urgenţă.
2. Informaţia indicată în Alineatul 1 al prezentului Articol va fi oferită în limba Statului Părţii Trimiţătoare.
3. La sosirea pe teritoriul statului Părţii Primitoare, lucrătorii migranţi vor fi întîlniţi de către angajator sau un reprezentant al acestuia în prezenţa unui reprezentant al Instituţiei Competente a Părţii Primitoare şi le va fi asigurată transportarea către locul de cazare.
ARTICOLUL 22
Instituţia Competentă a Părţii Primitoare va întreprinde toate măsurile necesare în vederea:
a. asigurării protecţiei necesare a lucrătorilor migranţi în conformitate cu legislaţia Statelor Părţilor în privinţa condiţiilor de trai şi de muncă;
b. investigarea plîngerilor şi sesizărilor din partea lucrătorilor migranţi despre încălcarea drepturilor lor de muncă, precum şi acordarea instrucţiunilor necesare în vederea înlăturării neregularităţilor depistate.
CAPITOLUL ŞASE
DISPOZIŢII PRIVIND REÎNTOARCEREA LUCRĂTORILOR MIGRANŢI
ARTICOLUL 23
1. Odată cu semnarea contractului individual de muncă, lucrătorii migranţi vor semna, inclusiv şi o declaraţie prin care se obligă să se reîntoarcă pe teritoriul Statului Părţii Trimiţătoare la expirarea termenului legal de şedere, precum şi vor prezenta personal paşaportul în decursul unei luni de la reîntoarcere la oficiul consular al Părţii Primitoare.
2. Nerespectarea angajamentului indicat în Aliniatul 1 al prezentului Articol, se va lua în considerare în cazul depunerii unei noi cereri pentru eliberarea unui permis de şedere la autorităţile competente naţionale a Părţii Primitoare.
CAPITOLUL ŞAPTE
DISPOZIŢII PRIVIND IMPLEMENTAREA ACORDULUI
ARTICOLUL 24
1. Instituţiile Competente ale Părţilor specificate la Articolul 1, Alineatul 2 vor coordona şi monitoriza implementarea prezentului Acord pe teritoriile lor respective.
2. Instituţiile Competente ale Părţilor specificate la Articolul 1, Alineatul 2 vor coopera prin intermediul mijloacelor electronice sau prin întîlniri directe, la necesitate, şi vor:
a. efectua schimb de informaţii cu privire la reglementările existente în domeniul muncii, precum şi condiţiile de intrare, şedere şi angajare a străinilor;
b. rezolva probleme specifice ce reies din implementarea prezentului Acord şi propune soluţii în vederea depăşirii obstacolelor întîmpinate;
c. discuta orice alte subiecte care reies din implementarea prezentului Acord.
ARTICOLUL 25
1. Prezentul Acord se încheie pentru o perioadă iniţială de cinci ani, şi acţiunea acestuia se va prelungi automat pentru perioade ulterioare de trei ani.
2. Prezentul Acord va intra în vigoare din data recepţionării ultimei notificări scrise prin canale diplomatice privind îndeplinirea procedurilor interne necesare pentru intrarea în vigoare a Acordului.
3. La iniţiativa şi prin acordul comun al Părţilor în prezentul Acord pot fi introduse modificări care vor fi expuse prin Protocoale separate. Protocoalele vor intra în vigoare prin modalitatea expusă pentru intrarea în vigoare al prezentului Acord şi vor constitui parte integrantă a prezentului Acord.
ARTICOLUL 26
1. Fiecare dintre Părţi poate suspenda total sau parţial implementarea prezentului Acord pentru o anumită perioadă în cazul în care există motive de securitate naţională, ordine sau sănătate publică. Suspendarea prezentului Acord va produce efecte din data recepţionării notificării celeilalte Părţi prin canale diplomatice.
2. Prezentul Acord poate fi denunţat de către oricare dintre Părţi printr-o notificare scrisă adresată prin canale diplomatice şi îşi va înceta acţiunea după 90 de zile de la data recepţionării de către cealaltă Parte a notificării de denunţare.
3. În cazul încetării acţiunii prezentului Acord, drepturile dobândite de lucrătorii migranţi în perioada acţiunii Acordului rămîn valabile.
ARTICOLUL 27
Orice dispute care pot apărea între Părţi în implementarea prevederilor prezentului Acord, se vor soluţiona prin consultări şi negocieri între Autorităţile Autorizate.
Întocmit în Sofia, la 18 iunie 2018, în două exemplare originale, fiecare în limbile Română, Bulgară şi Engleză, textele fiind egal autentice. În cazul apariţiei unor divergenţe, textul în limba Engleză va fi de referinţă.

BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA
AND
THE GOVERNMENT OF THE REPUBLIC OF BULGARIA ON
REGULATION OF LABOUR MIGRATION
The Government of the Republic of Moldova and the Government of the Republic of Bulgaria, hereinafter referred as “Parties”,
convinced that labour migration is a phenomenon of common interest for both States that can contribute to the economic and social development, facilitate the cultural diversity and development of technological exchange,
recognizing the necessity to ensure the respect of rights, obligations and guaranties set out in the national legislations and international treaties to which both States are Parties,
with the aim to strengthen the cooperation between the two Parties in the context of the external and migration policies of both States,
agreed upon the following:
CHAPTER ONE
GENERAL PROVISIONS
ARTICLE 1
1. The bodies of the Parties which are responsible for this Agreement (hereinafter called “Authorized Bodies”) are:
a. in the Republic of Moldova – the Ministry of Health, Labour and Social Protection;
b. in the Republic of Bulgaria – the Ministry of Labour and Social Policy.
2. The Parties designate for the implementation of this Agreement the following institutions (hereinafter called “Competent Institutions”):
a. in the Republic of Moldova – the National Employment Agency;
b. in the Republic of Bulgaria– the Employment Agency at the Minister of Labour and Social Policy.
3. The concepts used in this Agreement shall be interpreted in accordance with the legislation of the State of the Party in which the legal relationship under this Agreement is arising out and in relation to the implementation of these concepts.
ARTICLE 2
1. This Agreement shall apply to the following categories of migrant workers who are nationals of the State of either of the Parties and have signed an individual labour contract under this Agreement and are provided with the necessary residence permit on the territory of the State of the other Party:
a. workers for an initial period of one year with an option for subsequent extension for a total period of up to three years;
b. seasonal workers for a maximum period in accordance with the legislation of the State of the Receiving Party.
2. For the categories of migrant workers envisaged in Paragraph 1 of this Article the work permit shall not be required.
ARTICLE 3
1. The entry, stay, and employment of nationals of the Republic of Moldova and of the Republic of Bulgaria on the territory of the State of the other Party within this Agreement shall be regulated by the legislation of the State of the Receiving Party.
2. Hired migrant workers can be accompanied by members of their families according to the legislation of the State of the Receiving Party.
CHAPTER TWO
PROVISIONS ON THE INTERMEDIATION FOR EMPLOYMENT
ARTICLE 4
The recruitment and employment of the Candidates for the job offers presented in the framework of the present Agreement shall be conducted by the Competent Institutions of the Parties under Art.1, Paragraph 2.
ARTICLE 5
1. The Competent Institutions of the Parties under Art.1, Paragraph 2 shall carry out the following activities in the intermediation for employment, within their State budget allocations:
a. exchange of information on the job offers received from the employers established on the territory of the State of one of the Parties;
b. two-phased selection of potential migrant workers (hereinafter called “Candidates”):
1) preliminary selection - based on the documentation provided,
2) final selection - approved by the employers;
c. assistance in labour negotiation process and in signing of individual labour contracts by approved Candidates;
d. providing to the migrant workers who have signed individual labour contracts, information on the conditions of stay, work, social security, medical insurance, accommodation and departure in the official language of the State of the Sending Party.
2. The job offers envisaged in Paragraph 1 of this Article shall contain the following requisite information:
a. economic sector and geographic region in which the work activity shall be carried out;
b. number of migrant workers to be employed;
c. requirements for the migrant workers in order to be employed;
d. deadline for the submission of documents and for the selection of the Candidates;
e. duration of the employment;
f. general information about the working conditions, remuneration and accommodation;
g. arrival date of the approved Candidates at the work place on the territory of the State of the Receiving Party;
h. payment of the travel expenses to and from the territory of the State of the Receiving Parties.
3. The Competent Institutions of the Parties under Art.1, Paragraph 2 shall form a Joint Selection Committee, composed of the equal number of representatives of the Parties.
ARTICLE 6
The selection of Candidates according to their professional qualification, based on the submitted documents shall be carried out by the Competent Institution of the Sending Party.
ARTICLE 7
1. The final selection of the Candidates shall be conducted by the employers before departure in compliance with the selection criteria specified by the Joint Selection Committee.
2. The Candidates who have passed the final selection shall undergo a medical examination on the territory of the State of the Sending Party. Any additional medical examinations requested on the territory of the State of the Receiving Party shall be covered by the employer.
3. Approved Candidates shall sign before departure an individual fixed-term labour contract in Romanian and Bulgarian according to the legislation of the State of the Receiving Party.
4. A copy of the individual labour contracts shall be sent to the Competent Institution of the Receiving Party.
ARTICLE 8
1. Visa applications under this Agreement shall be processed with priority by the competent consulate service of the Receiving Party on the territory of the State of the Sending Party in accordance with the legislation of the State of the Parties and with the respective provisions of the international treaties applicable to the Parties. The visa which is to be placed in the passport shall include the type, purpose and duration of stay on the territory of the State of the Receiving Party. Visa costs shall be covered by the approved Candidates.
2. Migrant workers shall be provided with the necessary residence permits in accordance with the legislation of the State of the Receiving Party.
3. The Competent Institution of the Sending Party shall inform the migrant workers about the date and place of arrival and the Competent Institution of the Receiving Party shall coordinate with the employers the organization of the meeting and accommodation of the migrant workers.
ARTICLE 9
1. The travel expenses of the migrant worker to and from the territory of the State of the Receiving Party shall be covered by the employer.
2. The employer shall inform the Competent Institutions of both Parties in detail about the day, hour and place of departure and arrival, the means of transport and insurance issues.
CHAPTER THREE
PROVISIONS ON THE WORKING CONDITIONS AND
SOCIAL RIGHTS OF THE MIGRANT WORKERS
ARTICLE 10
1. Migrant workers shall have the same labour rights and obligations as of the local workers and shall enjoy equal protection at the workplace according to the legislation of the State of the Receiving Party.
2. Migrant workers shall enjoy on the territory of the State of the Receiving Party the same legal protection in respect of personal and property rights as provided for its citizens.
ARTICLE 11
Migrant workers′ remuneration and working conditions shall be specified in their individual labour contracts signed and shall always be in accordance with the existing collective agreements or, in absence of such agreements, with the legislation of the State of the Receiving Party applicable to the local workers with the same profession and qualification.
ARTICLE 12
The Parties agree that in the area of social security the Agreement on Social Security between the Republic of Moldova and the Republic of Bulgaria, signed on the 5th of December 2008, in force from the 1st of September 2009 shall apply.
ARTICLE 13
The disputes which might arise between employers and migrant workers shall be resolved in accordance with the legislation of the State of the Receiving Party.
CHAPTER FOUR
PROVISIONS ON THE SET UP AND OPERATION
OF THE JOINT SELECTION COMMITTEE
ARTICLE 14
1. The Joint Selection Committee under Article 5, Paragraph 3 shall be a standing body and shall perform its duties electronically.
2. The composition of the Joint Selection Committee shall be determined with a joint act of the heads of the Competent Institutions and shall include equal numbers of representatives of the Competent Institutions of the Parties under Art.1, Paragraph 2.
3. The Joint Selection Committee shall:
a. approve the selection criteria for the job offers received, as specified in the Request under Article 15, Paragraph 1;
b. approve a standard individual labour contract pursuant to the legislation of the State of the Receiving Party in Romanian and Bulgarian;
c. elaborate and approve the form of the application under Article 16 in Romanian and Bulgarian;
d. approve a standard job offer;
e. assist the provision of information and consultation to Candidates during the selection procedure in a timely and comprehensive manner;
f. approve the form of the declaration by which migrant workers undertake to return to the territory of the State of the Sending Party.
4. The standard individual labour contract under Paragraph 3 of this Article shall include provisions concerning:
a. name and address of the employer;
b. personal data of the migrant worker;
c. remuneration;
d. working conditions;
e. housing;
f. health insurance;
g. conditions for extension of the individual labour contract or its termination before the expiry of its term of validity;
h. responsibility of the parties for not complying with the terms of the individual labour contract and the way of settling legal disputes;
i. way of payment of travel expenses to and from the territory of the State of the Receiving Party.
5. The Joint Selection Committee shall take decisions in absentia, of which minutes shall be drawn up.
CHAPTER FIVE
PROVISIONS ON THE RECRUITMENT OF THE MIGRANT WORKERS
ARTICLE 15
1. Each Competent Institution may submit officially in writing, by fax or e-mail, a Request for cooperation on the recruitment of the migrant workers from the other Agreement Party (hereinafter called “Request”).
2. The Request under Paragraph 1 of this Article shall be made on the basis of the job offers received from employers and shall contain:
a. information about the required number of migrant workers;
b. the period of employment;
c. requirements for professional qualification and/or educational degree and/or work experience;
d. general information about the living and working conditions on the territory of the State of the Receiving Party;
e. date of the Request.
3. A Request under Paragraph 1 of this Article may be made once a month and in exceptional cases – twice a month.
4. Upon receipt of the Request, the Competent Institution of the Sending Party shall conduct the necessary activities to inform potential migrant workers about the job opportunities on the territory of the State of the Receiving Party.
ARTICLE 16
1. The Candidates shall submit applications to the Competent Institution of the Sending Party.
2. Candidates shall enclose to the application under Paragraph 1 of this Article:
a. documents evidencing their education, specialisation, competence, professional qualifications and experience;
b. other documents as may be required under the legislation of the State of the Receiving Party for holding the position specified in the job offer by the employer, including for regulated professions;
c. a copy of their travel document′s page with the photo and personal information;
d. two colour photos – format 3,5/4,5 cm.
ARTICLE 17
1. The Competent Institution of the Sending Party shall select the appropriate Candidates on the basis of a documentary check for conformity with the selection criteria approved by the Joint Selection Committee.
2. The Competent Institution of the Sending Party shall prepare reasoned refusals for the Candidates who do not comply with the requirements or who are with incomplete set of documents by the time deadline.
3. Every Candidate may receive information on the stage of consideration of his/her application from the Competent Institution of the Sending Party.
4. The Competent Institution of the Sending Party shall ensure a transparent process of selection of Candidates.
ARTICLE 18
1. The Competent Institution of the Sending Party shall send a list of the approved Candidates to the Competent Institution of the Receiving Party and the documents accompanying their applications legalised accordingly and accompanied with certified translation in Romanian or Bulgarian, if the employer has such requirement specified in his offer. The costs for legalisation and translation of their applications shall be covered by the approved Candidates.
2. The Competent Institution of the Receiving Party shall send the list and the documents under Paragraph 1 of this Article to the employers.
3. The employers shall select migrant workers based on the documents under Paragraph 1 of this Article and shall send back to the Competent Institution of the Receiving Party the final lists of the approved by them Candidates.
4. The Competent Institution of the Receiving Party shall forward the lists under Paragraph 3 of this Article to the Competent Institution of the Sending Party.
5. The Competent Institution of the Sending Party shall provide Candidates with information about the final selection results.
6. The lists and documents under the above paragraphs shall be exchanged electronically.
ARTICLE 19
The Competent Institution of the Sending Party shall, at the request and on the expenses of the employers, organise interviews and/or practical examinations for the respective profession according to the job offer.
ARTICLE 20
1. Every Candidate who confirms the willingness to be hired shall be directed by the Competent Institution of the Sending Party to medical checks-up to be performed by a healthcare institution.
2. The Competent Institution of the Sending Party shall provide the Competent Institution of the Receiving Party with the list of Candidates who have confirmed their willingness for departure and have undergone medical checks confirming that there are no obstacles for them to execute the activity/ profession they are approved for.
3. The Competent Institution of the Receiving Party shall forward the information under Paragraph 2 of this Article to the employers.
ARTICLE 21
1. The Competent Institution of the Sending Party shall hold a meeting with the approved Candidates immediately preceding their departure where they shall be provided in written with information regarding their rights and obligations in relation to their work on the territory of the State of the Receiving Party, concerning:
a. the individual labour contract;
b. the rights and obligations of workers and employers on the territory of the State of the Receiving Party;
c. the culture and traditions of the State of the Receiving Party;
d. the emergency contact information.
2. The information under Paragraph 1 of this Article shall be provided in the language of the State of the Sending Party.
3. Upon their arrival to the territory of the State of the Receiving Party, migrant workers shall be met by the employer or a representative thereof in presence of the representative of the Competent Institution of the Receiving Party and shall be transported to their housing.
ARTICLE 22
The Competent Institution of the Receiving Party shall do everything necessary to:
a) ensure the required protection of migrant workers′ rights in accordance with the legislation of the State of the Parties regarding the living and working conditions;
b) inquire into migrant workers′ complaints and alerts about violations of their labour rights and give the necessary instructions for removal of the detected irregularities.
CHAPTER SIX
PROVISIONS ON THE RETURN OF THE MIGRANT WORKERS
ARTICLE 23
1. Upon signing of the individual labour contract, migrant workers shall sign also a declaration whereby they shall undertake to return to the territory of the State of the Sending Party upon expiry of the period of their legal stay and to present in person their passport in the consulate service of the Receiving Party within one month after their return.
2. Failure to fulfil this commitment provided for in the Paragraph 1 of this Article shall be taken into account in case of a new application for a residence permit submitted to the national competent authorities of the Receiving Party.
CHAPTER SEVEN
PROVISIONS ON THE IMPLEMENTATION OF THE AGREEMENT
ARTICLE 24
1. The Competent Institutions of the Parties under Art.1, Paragraph 2 shall coordinate and monitor the implementation of the present Agreement on their respective territory.
2. The Competent Institutions of the Parties under Art.1, Paragraph 2shall cooperate electronically or by meeting, when necessary, and shall:
a. exchange information about their existing regulations on labour relations, as well as on the entry, stay and employment of foreigners;
b. solve specific problems related to the implementation of the Agreement and propose solutions to overcome encountered obstacles;
c. discuss any other matters arising out of the implementation of the present Agreement.
ARTICLE 25
1. This Agreement shall be concluded for an initial period of five years and its effect shall be prolonged automatically for further periods of three years.
2. This Agreement shall enter into force on the date of receiving the last written notification through diplomatic channels on the fulfilment of the internal procedures necessary for its entry into force.
3. At the initiative of each of the Parties and by mutual consent amendments may be made in this Agreement which will be formed in separate protocols. The protocols shall enter into force in the manner prescribed for entry into force for this Agreement and shall become an integral part thereof.
ARTICLE 26
1. Each Party may terminate in full or in part the implementation of this Agreement for a given period wherever national security, public order or public health is concerned. The termination of this Agreement shall take effect on the date of receipt of the notification of the other Party through diplomatic channels.
2. The present Agreement can be denounced by each of the Parties by a written notification through diplomatic channels and shall terminate its effect after 90 days from the receipt of the other Party of the denouncing notification.
3. In case where the effect of this Agreement is terminated, the rights acquired by the migrant workers during its effect shall remain valid.
ARTICLE 27
Any disputes arising between the Parties in the implementation of the provisions of this Agreement shall be regulated by consultations and negotiations between the Authorized Bodies.
Done in Sofia, on 18th of June 2018, in two original copies, each in the Romanian, Bulgarian, and English languages, all texts being equally authentic. In case of divergences, the English text shall be of reference.
