între Guvernul Republicii Moldova şi Guvernul Republicii Elene
privind colaborarea în domeniul turismului

Guvernul Republicii Moldova şi Guvernul Republicii Elene, numite în continuare Părţi,
luând ca bază Statutul Organizaţiei Mondiale a Turismului, adoptat la 27 septembrie 1970 în Mexico,
dorind să contribuie la dezvoltarea relaţiilor în domeniul turismului între Republica Moldova şi Republica Elenă şi să promoveze cooperarea între autorităţile responsabile de turism ale ambelor ţări,
recunoscând importanţa turismului în promovarea dezvoltării economice, a înţelegerii reciproce, a bunăvoinţei şi relaţiilor apropiate între popoare,
bazate pe egalitatea deplină în drepturi şi pe beneficiile reciproce,
au convenit asupra celor ce urmează:
Articolul 1
Părţile, în cadrul acestui Acord şi în conformitate cu legislaţia lor naţională, vor promova dezvoltarea şi consolidarea colaborării în domeniul turismului între ţările lor.
Articolul 2
Părţile vor facilita traficul turistic între ţările lor în conformitate cu legislaţia şi reglementările lor fără a aduce prejudicii obligaţiilor lor internaţionale şi vor încuraja colaborarea între întreprinderile şi organizaţiile lor care activează în domeniul turismului.
Articolul 3
În vederea unei mai bune cunoaşteri a atracţiilor lor turistice de către publicul celeilalte ţări şi a creşterii circulaţiei turistice între cele două ţări, Părţile vor încuraja promovarea reciprocă a turismului prin intermediul schimbului de informaţii, publicitate, şi a altor materiale promoţionale turistice în conformitate cu legislaţia şi reglementările lor. În acest scop, Părţile vor examina posibilitatea participării la diverse târguri, expoziţii, seminare şi alte evenimente turistice care vor avea loc pe teritoriul celeilalte ţări şi organizării vizitelor de familiarizare pentru agenţi de turism, jurnalişti din domeniul turismului şi pentru alt personal mass-media.
Articolul 4
Părţile, în conformitate cu legislaţia în vigoare în ţările lor, vor încuraja şi vor facilita reciproc investiţiile antreprenorilor moldoveni şi eleni şi crearea societăţilor mixte în sectoarele lor turistice.
Articolul 5
Părţile pot institui Birouri Turistice de Informare pe teritoriul celeilalte ţări, care nu vor desfăşura activităţi comerciale şi activitatea cărora va fi reglementată printr-un acord separat încheiat în acest scop între Părţi.
Articolul 6
Părţile vor încuraja schimbul de date statistice şi informaţii în domeniul turismului, inclusiv:
- acte normative ce reglementează activitatea turistică a ambelor ţări,
- acte normative privind protecţia patrimoniului cultural şi natural ce reprezintă atracţie turistică,
- staţiuni turistice din ambele ţări,
- expertize în domeniul managementului hotelier şi a altor forme de cazare.
Articolul 7
Părţile vor examina toate formele posibile de colaborare în domeniul pregătirii profesionale a personalului angajat în sectorul turistic şi vor încuraja schimbul de know-how şi de experienţă între instituţiile de cercetare şi alte organizaţii din domeniul turismului din ambele ţări.
Articolul 8
Părţile vor încuraja colaborarea între administraţiile turistice naţionale în cadrul Organizaţiei Mondiale a Turismului şi altor organizaţii turistice internaţionale, la care ambele ţări sunt membre.
Articolul 9
În implementarea acestui Acord Republica Elenă va respecta obligaţiile sale care reies din calitatea sa de membru al Uniunii Europene.
Articolul 10
În vederea implementării Acordului prin consultări bilaterale şi prin formularea recomandărilor adresate autorităţilor competente ale Părţilor, va fi convocată periodic o Comisie Mixtă compusă dintr-un număr egal de reprezentanţi autorizaţi ai Părţilor. Părţile pot invita să participe şi alţi reprezentanţi şi experţi din sectoarele turistice public şi privat.
Şedinţele Comisiei vor avea loc alternativ în fiecare dintre cele două ţări la data care va fi stabilită de către Părţi.
Fiecare şedinţă va fi prezidată de către Şeful Delegaţiei ţării gazdă.
Articolul 11
Prezentul Acord poate fi amendat sau revăzut. Oricare din Părţi poate cere în scris amendarea sau revizuirea lui. Orice amendament sau revizuire convenită de Părţi va intra în vigoare în conformitate cu procedura stabilită în primul alineat din articolul 13.
Articolul 12
Prezentul Acord nu afectează drepturile şi obligaţiile celor două ţări care reies din alte tratate internaţionale la care ele sunt părţi contractante.
Articolul 13
Prezentul Acord intră în vigoare la data primirii prin canale diplomatice a ultimei notificări în scris despre îndeplinirea de către Părţi a procedurilor interne necesare intrării lui în vigoare.
Prezentul Acord se încheie pe un termen de cinci (5) ani. Acţiunea lui se va prelungi în mod automat pentru perioade de cinci ani, dacă nici una dintre Părţi nu va notifica în scris cealaltă Parte, cu cel puţin trei (3) luni până la expirarea perioadei iniţiale sau ulterioare, despre intenţia de a-l denunţa.
Dacă nu există o altă înţelegere între Părţi, expirarea acestui Acord nu va afecta realizarea proiectelor, programelor şi a altor iniţiative întreprinse în conformitate cu acest Acord şi care nu au fost implementate pe deplin până la expirarea lui.
Drept confirmare, subsemnaţii, fiind împuterniciţi în acest scop de către Guvernele lor, au semnat prezentul Acord.
Întocmit la Atena la 18 octombrie 2006, în două exemplare originale, fiecare în limbile moldovenească, greacă şi engleză, toate textele fiind egal autentice. În cazul apariţiei divergenţelor în interpretarea prevederilor prezentului Acord, textul în limba engleză va fi de referinţă.
AGREEMENT
between the Government of the Republic of Moldova
and the Government of the Hellenic Republic
on cooperation in the field of tourism
The Government of the Republic of Moldova and the Government of the Hellenic Republic, hereinafter referred to as the Parties,
bearing in mind the Statutes of the World Tourism Organization, adopted on September 27, 1970 in Mexico,
willing to contribute to the development of tourism relations between the Republic of Moldova and the Hellenic Republic and promote cooperation between the respective Tourism Authorities of the two countries,
recognizing the importance of tourism in promoting economic development, mutual understanding, goodwill and close relations between peoples,
based on the full equality of rights and the mutual benefits, have agreed upon the following:
Article 1
The Parties, within the framework of this Agreement and in accordance with their national legislation, shall promote the development and strengthening of cooperation in the field of tourism between their countries.
Article 2
The Parties shall endeavour to facilitate tourist traffic between their countries in accordance with their respective laws and regulations and without prejudice to their international obligations and shall encourage cooperation between their enterprises and organizations operating in the field of tourism.
Article 3
With a view to making their tourist attractions better known to the public of the other country and increasing the tourist movement between the two countries, the Parties shall encourage mutual tourism promotion through the exchange of tourism information, publicity and other promotional materials in accordance with their respective laws and regulations. For that purpose, they shall also examine the possibility of participating in tourism fairs, exhibitions, seminars and other tourism events held in the territory of the other country and of organizing familiarization trips for travel agents, travel journalists and other mass media personnel.
Article 4
The Parties, in accordance with the legislation in force in their countries, shall encourage and mutually facilitate the investments of Moldovan and Greek entrepreneurs, as well as joint ventures in their respective tourism sectors.
Article 5
The Parties may establish national Tourist Information Offices in the territory of the other country which will not conduct commercial activities and the operation of which will be regulated by a specific agreement concluded to that effect between the Parties.
Article 6
The Parties shall encourage the exchange of statistics and information in the field of tourism including:
• The national laws and regulations governing the tourist activity in both countries,
• The national legislation relating to the protection and preservation of cultural and natural sources as being tourist attractions,
• Tourist resorts in both countries,
• Expertise in the field of management of hotels and other types of tourist accommodation.
Article 7
The Parties shall examine all possible forms of cooperation in the field of vocational training of personnel employed in the tourist sector and shall encourage the exchange of know-how and practical experience between research institutions and other organizations of their countries active in the field of tourism.
Article 8
The Parties shall encourage the cooperation between their national tourist administrations within the framework of the World Tourism Organization and other international tourism organizations, to which both countries are members.
Article 9
In applying this Agreement the Hellenic Republic shall respect its obligations arising from its membership to the European Union.
Article 10
With the aim of implementing this Agreement through bilateral consultations and through the submission of recommendations to their competent authorities a Joint Commission shall be convened periodically, composed of equal number of authorised representatives of the Parties. The Parties may invite other representatives and experts both from the public and private tourist sectors to attend.
The Commission's meetings shall take place in each of the two countries alternately at a time to be agreed upon by the Parties.
Each meeting shall be presided over by the Head of the Delegation of the country in which it will take place.
Article 11
This Agreement can be amended or revised. Either Party may request in writing an amendment or revision. Any amendment or revision agreed upon by the Parties, shall enter into force in accordance with the procedure set forth in the first paragraph of article 13.
Article 12
This Agreement does not affect the rights and obligations of the two countries that result from other internationai treaties in which they are Contracting Parties.
Article 13
This Agreement shall enter into force upon receipt of the last written notification, through diplomatic channels, confirming the completion by each Party of its relevant internal procedures required for the entry into force of this Agreement.
This Agreement shall remain in force for a period of five (5) years. It shall thereafter be automatically renewed, each time for a further five-year period, unless denounced in writing, through diplomatic channels, by either Party, at least three (3) months prior to the expiration of the initial or subsequent five-year periods.
The termination of this Agreement shall not, however, affect the completion of projects, programs and any other initiatives undertaken under this Agreement and not fully implemented at the time of its termination, unless otherwise agreed by the Parties.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement
Done in duplicate at Athens on the Octomber 18, 2006 in the Moldovan, Greek and English languages, all texts being equally authentic. In case of divergence in the interpretation of the Agreement, the English text shall prevail.
