Bulgaria privind cooperarea în situaţii excepţionale

Guvernul Republicii Moldova şi Guvernul Republicii Bulgaria – părţi la prezentul Acord, denumite în continuare “Părţi”;

Considerînd creşterea caracterului transfrontalier al situaţiilor excepţionale cu caracter natural şi tehnogen, necesitatea soluţionării prompte şi efective a problemelor legate de acestea, prin intermediul cooperării internaţionale şi importanţa coordonării eforturilor comune ale celor două state în acest domeniu;

Recunoscînd eforturile Naţiunilor Unite în domeniul prevenirii situaţiilor excepţionale şi diminuării consecinţelor lor, precum şi principalele documente internaţionale adoptate în acest domeniu;

Susţinînd eforturile Organizaţiei Tratatului Atlanticului de Nord şi ale Consiliului Parteneriatului Euro-atlantic în domeniul asistenţei în cazul situaţiilor excepţionale;

Luînd în consideraţie principiile Acordului dintre guvernele ţărilor membre la Cooperarea Economică a Mării Negre (CEMN) privind interacţiunea la acordarea ajutorului în situaţii excepţionale cu caracter natural şi tehnogen şi lichidarea consecinţelor acestora;

Luînd în consideraţie concluziile Consiliului UE referitor la consolidarea capacităţii de răspuns la situaţii excepţionale – spre o abordare integrată a managementului situaţiilor excepţionale, inclusiv prevenirea, pregătirea, reacţionarea şi restabilirea în cazul situaţiilor excepţionale cu caracter natural şi tehnogen, care se produc pe teritoriul UE sau a părţilor terţe;

Ţinînd cont de Mecanismul Comunitar pentru Protecţie Civilă şi contribuţia acestuia la dezvoltarea capacităţilor de reacţionare rapidă şi efectivă prin utilizarea echipelor de salvare;

Subliniind că, în decursul ultimilor ani s-a înregistrat o creştere a frecvenţei şi gravităţii situaţiilor excepţionale cu caracter natural şi tehnogen;

Decise să susţină şi să dezvolte cooperarea în caz de situaţii excepţionale între cele două state, în conformitate cu legislaţia lor naţională;

Au convenit asupra următoarelor:

Articolul 1

Obiectul

Prezentul Acord stabileşte cadrul general al cooperării în domeniul prevenirii, pregătirii şi reacţionării la situaţii excepţionale, precum şi termenii şi procedura de acordare a asistenţei voluntare între Părţi în cazul unei situaţii excepţionale pe teritoriul oricăreia dintre Părţile menţionate.

Articolul 2

Noţiuni

Pentru scopurile prezentului Acord se vor aplica următoarele noţiuni:

“Situaţie excepţională”: un eveniment sau un şir de evenimente, produse ca rezultat al fenomenelor naturale, incidentelor, accidentelor sau altor circumstanţe excepţionale, care pot cauza sau au cauzat prejudicii semnificative vieţii sau sănătăţii populaţiei, proprietăţii sau mediului ambiant la o astfel de scară, care solicită luarea măsurilor sau implicarea forţelor specializate şi folosirea resurselor speciale;

“Partea solicitantă”: Partea, a cărei Autoritate competentă, după cum este specificat în alineatul 2 al Articolului 3 din prezentul Acord, se adresează celeilalte Părţi cu o solicitare de asistenţă;

“Partea ofertantă”: Partea, a cărei autoritate competentă, după cum este specificat în alineatul 2 al Articolului 3 din prezentul Acord, oferă asistenţă Părţii solicitante;

“Echipă de salvare”: subdiviziunea nonmilitară, instruită expres în acest scop, a Părţii ofertante, echipată cu echipament respectiv, cîini de salvare şi articole de asistenţă;

“Echipament”: materiale, mijloace tehnice şi de transport, medicamente şi echipament medical, precum şi echipament individual al membrilor echipelor de salvare şi/sau experţilor;

“Articole de asistenţă”: resursele materiale alocate Părţii solicitante, destinate distribuirii gratuite şi fără de taxe populaţiei sinistrate;

“Expert”: specialist în domeniul managementului situaţiilor excepţionale, cu echipament respectiv şi articole de asistenţă, trimis pentru acordarea asistenţei Părţii solicitante;

“Lucrări de salvare”: orice acţiune întreprinsă în caz de situaţie excepţională, în scopul salvării vieţilor omeneşti, protecţiei proprietăţii, sau livrării articolelor de asistenţă şi care are drept scop controlul efectelor imediate ale situaţiilor excepţionale;

“Autoritate competentă”: autoritatea desemnată de fiecare dintre Părţi să gestioneze şi să coordoneze activităţile în baza prezentului Acord;

“Punct focal”: punctul de contact sau organul responsabil de realizarea prezentului Acord;

“Stat tranzit”: stat prin a cărui teritoriu sunt transportate echipele de salvare, echipamentul şi articolele de asistenţă, în scopul oferirii ajutorului unei ţări terţe.

Articolul 3

Autorităţile competente şi punctele de contact

(1) Pentru scopurile prezentului Acord, Părţile vor coopera direct, în limita competenţelor sale, în conformitate cu legislaţia sa naţională.

(2) Autorităţile competente în scopul prezentului Acord vor fi:

- pentru Guvernul Republicii Moldova: Ministerul Afacerilor Interne

- pentru Guvernul Republicii Bulgaria: Ministerul de Interne.

(3) Întru implementarea prezentului Acord, Autorităţile competente ale Părţilor, după cum este specificat în alineatul 2 al prezentului Articol, vor fi autorizate să intre imediat în contact direct.

(4) Părţile la prezentul Acord vor desemna unul sau mai multe puncte de contact, în scopul notificării şi schimbului de informaţie în caz de situaţii excepţionale. Autorităţile competente vor asigura funcţionarea neîntreruptă a punctelor focale:

- pentru Guvernul Republicii Moldova: Ministerul Afacerilor Interne, Serviciul Protecţiei Civile şi Situaţiilor Excepţionale;

- pentru Guvernul Republicii Bulgaria: Ministerul de Interne, Directoratul Principal Securitate Antiincendiară şi Protecţie Civilă.

(5) În cazul schimbării Autorităţilor competente şi punctelor focale, Părţile se vor notifica imediat, în scris, prin canale diplomatice.

Articolul 4

Formele de cooperare

(1) În cadrul prezentului Acord şi în conformitate cu legislaţia sa naţională, Părţile vor coopera în baza principiilor de egalitate, reciprocitate şi beneficii mutuale, prin:

a) acordarea asistenţei voluntare şi oferirea informaţiei la solicitare, în caz de situaţie excepţională sau a unui pericol de producere a unei astfel de situaţii;

b) schimbul de informaţii, documentaţie tehnică şi juridică, metodologică şi altă literatură, materiale video şi foto privind prevenirea, pregătirea şi reacţionarea;

c) înzestrarea echipelor de salvare cu echipament;

d) organizarea şi desfăşurarea în comun a întrunirilor, conferinţelor, seminarelor, sesiunilor şi exerciţiilor;

e) schimbul de experienţă şi bunelor practici;

f) organizarea schimbului de experţi şi instruirii acestora, inclusiv schimbul de lectori şi instructori din cadrul centrelor şi instituţiilor respective, la solicitarea fiecăreia din Părţi;

g) planificarea, desfăşurarea şi implementarea în comun a proiectelor şi lucrărilor de cercetare în domeniul prevenirii, pregătirii şi reacţionării în cazul unei situaţii excepţionale;

(2) Autorităţile competente ale Părţilor, în conformitate cu alineatul 2 al Articolului 3 din prezentul Acord pot, de asemenea, stabili şi alte forme de cooperare şi pot forma grupuri de lucru, în conformitate cu legislaţia naţională a Părţilor.

(3) Părţile îşi vor oferi asistenţă reciprocă în caz de situaţie excepţională, în limita capacităţilor respective.

(4) Cheltuielile pentru schimbul de experţi etc. vor fi suportate de către Partea trimiţătoare, dacă Părţile nu au convenit altfel.

(5) Schimbul de echipament, materiale, alte provizii sau servicii necesare realizării scopurilor şi implementării programelor, asupra cărora s-a convenit, vor fi realizate în conformitate cu legile şi prevederile normative în vigoare ale fiecăreia dintre Părţi.

Articolul 5

Procedura de oferire a asistentei voluntare

(1) Lucrările de salvare pot fi oferite prin detaşarea echipelor de salvare şi/sau experţi, precum şi prin livrarea articolelor de asistenţă pentru necesităţile populaţiei afectate.

(2) Solicitarea de asistenţă se va efectua în formă scrisă, în limba engleză, şi Partea solicitantă va menţiona obligatoriu în aceasta:

a) tipul, scara, locul, timpul şi statutul curent al situaţiei excepţionale din teritoriul Părţii solicitante;

b) informaţia privind acţiunile întreprinse şi planificate pentru a face faţă situaţiei excepţionale;

c) tipul şi priorităţile asistenţei solicitate, în ceea ce ţine de echipe de salvare şi/sau experţi, echipament, precum şi articole de asistenţă.

(3) În conformitate cu solicitarea menţionată în paragraful de mai sus, Partea ofertantă va trimite o echipă instruită şi echipată pentru a face faţă situaţiei excepţionale.

(4) Echipele de salvare şi/sau experţii trimişi să ofere asistenţă, precum şi echipamentul şi articolele de asistenţă, pot fi transportate pe cale terestră, aeriană sau acvatică. Cheltuielile de transport vor fi suportate de către Partea ofertantă.

Articolul 6

Procedurile de trecere a frontierei şi regulile de şedere

ale echipelor de salvare şi/sau experţilor

(1) Partea solicitantă va asigura efectuarea operativă a formalităţilor legate de control la frontieră şi vamale stabilite de legislaţia naţională relevantă, la trecerea frontierei de către echipele de salvare şi/sau experţii Părţii ofertante.

(2) Conducătorul echipei de salvare va prezenta reprezentantului organelor de frontieră şi vamale ale Părţii solicitante următoarele documente, în limba engleză, confirmate de către autoritatea competentă a Părţii ofertante:

a) documentul completat în forma standard aprobată de către Autorităţile competente ale Părţilor, cu specificarea mandatului echipelor de salvare şi/sau experţilor şi scopul sosirii lor pe teritoriul Părţii solicitante;

b) lista membrilor echipelor de salvare şi/sau experţilor şi lista echipamentului şi vehiculelor;

c) lista articolelor de asistenţă.

(3) Conducătorii auto vor prezenta permisele de conducere pentru vehiculele cu motor şi paşapoartele tehnice ale acestora.

(4) Cerinţele legate de vize, în scopul prezentului Acord, sunt următoarele:

a) Membrii echipelor de salvare şi/sau experţii pot intra/ieşi din teritoriul Părţilor în baza documentelor de călătorie pentru străinătate valabile cu respectarea regimului de vize prevăzut pentru Părţi, şi în baza documentelor stipulate în alineatul 2 al Articolului 6.

b) Membrii echipelor de salvare şi/sau experţii au prioritate la obţinerea vizelor conform prevederilor Acordului între Comunitatea Europeană şi Republica Moldova privind facilitarea eliberării vizelor.

(5) Procedura de trecere a frontierei Părţii solicitante de către echipele de salvare cu cîini de salvare şi staţionarea lor pe teritoriul acestei Părţi va fi determinată în conformitate cu regulile de carantină ale acestei Părţi.

(6) Membrii echipelor de salvare pot purta uniforme pe teritoriul Părţii solicitante. Echipele de salvare pot utiliza semne distinctive pe vehiculele sale pe teritoriul Părţii solicitante.

(7) Procedura de trecere a frontierei, în conformitate cu condiţiile stabilite de prezentul Articol, se va aplica şi în cazul, când una dintre Părţi este Stat tranzit către o ţara terţă, care solicită asistenţă în caz de situaţie excepţională. Autorităţile competente, menţionate în alineatul 2 al Articolului 3 din prezentul Acord, se vor notifica reciproc despre necesitatea tranzitării pentru acordarea asistenţei unei ţări terţe şi vor coordona procedura de tranzitare a echipamentului şi articolelor de asistenţă.

Articolul 7

Trecerea frontierei pentru echipament şi articole de asistenţă

(1) Părţile vor asigura o procedură simplificată la trecerea frontierei pentru echipament şi articole de asistenţă.

(2) Membrilor echipei de salvare şi/sau experţilor trimişi pentru acordarea asistenţei nu li se permite să poarte arme şi muniţii pe teritoriul Părţii solicitante.

(3) Pe bază de reciprocitate, Părţile convin că echipamentul va fi utilizat pe teritoriul Părţii solicitante gratuit, cu condiţia că o astfel de utilizare este temporară. In ceea ce priveşte formalităţile vamale legate de plasarea sub regimul de import temporar, reexport şi securizare, se va aplica legislaţia vamală corespunzătoare.

(4) Restricţiile sau interzicerile aplicate la trecerea peste frontieră a bunurilor nu se vor aplica echipamentului şi articolelor de asistenţă în baza prezentului Acord, respectînd, în acelaşi timp, obligaţiile ce reies din reglementările juridice imperative care au prioritate în raport cu legislaţia naţională. Echipamentul va fi returnat de către Partea solicitantă, cu excepţia dacă acest echipament a fost distrus în timpul utilizării sale. Orice echipamente, lăsate ca articole de asistenţă, vor fi descrise detaliat într-un proces-verbal, de către conducătorul echipei de salvare, fiind specificate tipul, cantitatea şi locaţia, confirmat de către Autoritatea competentă a Părţii solicitante, menţionată în alineatul 2 al Articolului 3 din prezentul Acord. Autorităţile menţionate vor fi obligate să notifice serviciile vamale competente, prin prezentarea procesului-verbal reprezentanţilor organelor vamale, după încheierea misiunii. Admiterea pentru libera circulaţie şi utilizare finală a acestui echipament va fi efectuată în conformitate cu legislaţia aplicabilă a Părţii solicitante.

(5) Aceleaşi prevederi se vor aplica şi la introducerea, pe teritoriul Părţii solicitante, a medicamentelor care conţin substanţe narcotice şi psihotrope, precum şi la scoaterea, de către Partea ofertantă, a cantităţilor nefolosite. Orice astfel de mişcare a bunurilor nu va fi tratată ca import sau export, din punctul de vedere al acordurilor internaţionale privind medicamentele ce conţin substanţe narcotice şi psihotrope. Medicamentele menţionate pot fi introduse numai în cantităţile necesare în scopurile îngrijirii medicale şi pot fi utilizate numai de către personalul medical calificat, în conformitate cu legislaţia Părţii solicitante. În acest caz, conducătorul echipei de salvare va prezenta organelor de frontieră o declaraţie ce conţine nomenclatorul şi cantitatea medicamentelor ce conţin substanţe narcotice şi psihotrope. În privinţa cantităţilor neutilizate, conducătorul echipei de salvare va întocmi un proces-verbal, care va fi confirmat de către Autoritatea competentă a Părţii solicitante menţionate în alineatul 2 al Articolului 3 din prezentul Acord şi va fi prezentat organelor de control vamal, după încheierea misiunii.

(6) Partea solicitantă are dreptul de verificare a utilizării şi stocării medicamentelor, echipamentului şi articolelor de asistenţă sus-menţionate.

(7) Echipele şi/sau articolele de asistenţă acordate în calitate de ajutor vor fi scutite de orice taxe percepute pentru trecerea frontierei.

Articolul 8

Utilizarea aeronavei

(1) Aeronava poate fi utilizată pentru transportarea rapidă a echipelor de salvare, în conformitate cu alineatul 4 al Articolului 5 din prezentul Acord, precum şi pentru asigurarea lucrărilor de salvare în baza prezentului Acord.

(2) Zborurile aeronavei se efectuează în conformitate cu prevederile Organizaţiei Internaţionale a Aviaţiei Civile (ICAO) şi legislaţiei naţionale a fiecărei Părţi.

(3) Aeronava, menţionată în alineatul de mai sus, poate traversa teritoriul altei Părţi, precum şi ateriza şi decola în afara aeroporturilor internaţionale şi pistelor înregistrate, în locurile specificate de către autorităţile menţionate în alineatul 2 al Articolului 3 din prezentul Acord, în conformitate cu regulile de efectuare a zborurilor pentru fiecare caz în parte, conform legislaţiei relevante a Republicii Moldova şi Republicii Bulgaria.

(4) Organele de securitate şi siguranţă a zborurilor ale ambelor Părţi ale prezentului Acord se vor notifica reciproc despre utilizarea aeronavei în timpul operaţiunilor de salvare, indicînd datele exacte referitor la modelul şi numărul de înmatriculare al aeronavei, echipajul, caracterul încărcăturii, ora decolării, ruta şi locul aterizării solicitate.

(5) Articolul 6 al prezentului Acord se va aplica echipajului aeronavei şi membrilor echipei de salvare transportate de către aceasta.

(6) Articolul 7 al prezentului Acord se va aplica aeronavei, echipamentului şi articolelor de asistenţă transportate de către aceasta.

(7) Controlul vamal şi de frontieră al aeronavei va fi întreprins de către reprezentanţii organelor vamale şi de control la frontieră ale Părţii solicitante la locul aterizării respectivei aeronave.

(8) Utilizarea aeronavei militare va fi posibilă numai cu acordul în scris al Părţii solicitante.

Articolul 9

Cooperarea şi managementul operaţiunilor de asistenţă în caz de dezastru

(1) Coordonarea şi gestionarea operaţiunilor de asistenţă în caz de situaţie excepţională ţine de responsabilitatea Autorităţii competente a Părţii solicitante.

(2) Partea solicitantă va informa conducătorii echipelor de salvare şi/sau experţii despre evoluţia situaţiei în zona situaţiei excepţionale şi în locurile destinate activităţilor, precum şi va asigura, unde va fi necesar, cu traducători şi mijloace de comunicare în cadrul centrului operativ.

(3) Echipele de salvare şi/sau experţii, precum şi echipamentul acestora, trebuie să fie capabile de acţiuni autonome şi independente timp de 24 de ore după sosirea la locul situaţiei excepţionale.

Articolul 10

Cheltuielile operaţiunilor de salvare în caz de situaţie excepţională

(1) Partea ofertantă nu va avea dreptul la rambursarea, de către Partea solicitantă, a cheltuielilor suportate în timpul acordării asistenţei. Aceasta se va aplica şi oricăror cheltuieli suportate în rezultatul utilizării, distrugerii sau pierderii echipamentului, cu excepţia dacă distrugerea sau pierderea echipamentului este cauzată exclusiv din vina oficialităţilor sau cetățenilor Părţii solicitante.

(2) Alineatul 1 al prezentului Articol nu se va aplica dacă cheltuielile asistenţei sunt compensate în întregime sau parţial. Partea ofertantă va avea prioritate la rambursarea cheltuielilor menţionate.

(3) Partea solicitantă va suporta cheltuielile pentru operaţiunile de salvare realizate, la solicitarea sa, de către persoane fizice sau juridice, care au fost posibile prin intermedierea de către Partea ofertantă.

(4) Partea solicitantă va asigura securitatea şi îngrijirea medicală gratuită a echipelor de salvare şi/sau experţilor trimişi de către Partea ofertantă. Asigurarea logistică pe durata misiunii personalului Părţii ofertante va fi coordonată cu Partea solicitantă pentru fiecare caz aparte.

Articolul 11

Prejudicii şi compensaţii

(1) Partea ofertantă va refuza orice pretenţii legate de prejudiciile, care pot apărea către această Parte sau către experţii trimişi să ofere asistenţă în ceea ce priveşte:

a) prejudiciul adus proprietăţii de către echipele de salvare sau experţi urmare executării obligaţiilor lor;

b) vătămarea fizică, agravarea sănătăţii sau decesul unui membru al echipei de salvare şi/sau expert, care s-au produs în timpul executării obligaţiilor lor.

(2) Dacă un membru al echipei de salvare şi/sau expert al Părţii ofertante cauzează prejudicii unei terţe părţi, pe teritoriul Părţii solicitante, în timpul activităţilor realizate în baza prezentului Acord, prejudiciile menţionate vor fi reparate de către Partea solicitantă, în conformitate cu legislaţia în vigoare pentru cazurile, cînd astfel de prejudicii au fost cauzate de către cetăţenii acestei Părţi, în timpul executării obligaţiilor de serviciu.

(3) Prejudiciile cauzate intenţionat sau prin neglijenţă de către oricare membru al echipelor de salvare şi/sau experţi vor fi reparate de către Partea ofertantă, cu condiţia că faptul cauzării prejudiciului intenţionat a fost dovedit în judecată de către Partea solicitantă.

(4) Părţile, în conformitate cu Articolul 3 al prezentului Acord, vor interacţiona în scopul facilitării soluţionării oricăror pretenţii legate de prejudicii şi compensaţii. Părţile menţionate vor face schimb de informaţii disponibile în toate cazurile legate de prejudicii, în sensul prezentului Articol.

Articolul 12

Comunicarea în timpul operaţiunilor de salvare în caz de situaţie excepţională

Autorităţile competente menţionate în alineatul 2 al Articolului 3 din prezentul Acord vor asigura toate măsurile necesare întru stabilirea comunicării eficiente pentru necesităţile echipelor de salvare şi/sau experţilor, la locul operaţiunilor de salvare în cazul unei situaţii excepţionale.

Articolul 13

Finalizarea operaţiunilor de salvare în caz de situaţie excepţională

Echipele de salvare şi/sau experţii vor finisa activităţile respective imediat, la solicitarea scrisă a Autorităţii competente a Părţii solicitante, menţionate în alineatul 2 al Articolului 3.

Articolul 14

Soluţionarea diferendelor

Diferendele apărute la implementarea prezentului Acord, care nu pot fi soluţionate prin negocieri dintre Autorităţile competente, menţionate în alineatul 2 al Articolului 3 din prezentul Acord, vor fi soluţionate prin canale diplomatice.

Articolul 15

Alte acorduri internaţionale

Prezentul Acord nu afectează drepturile şi obligaţiile Părţilor care reies din orice alte acorduri internaţionale la care statele acestora sunt părţi.

Articolul 16

Dispoziţii finale

(1) Prezentul Acord va intra în vigoare la data recepţionării ultimei notificări în scris, prin care Părţile se informează reciproc despre îndeplinirea procedurilor interne necesare intrării sale în vigoare.

(2) Prezentul Acord poate fi modificat şi completat, la acordul comun al Părţilor, prin încheierea unor protocoale adiţionale. Aceste protocoale vor constitui parte integrantă a prezentului Acord şi vor intra în vigoare în conformitate cu prevederile alineatului 1 al prezentului Articol.

(3) Prezentul Acord se încheie pentru o perioadă nedeterminată. Fiecare Parte poate denunţa prezentul Acord în orice moment, printr-o notificare scrisă adresată celeilalte Părţi, prin canale diplomatice. Denunţarea va avea efect după expirarea a şase luni din data recepţionării de către cealaltă Parte a notificării de denunţare.

Semnat la Sofia, la 19 aprilie 2012, în două exemplare originale, fiecare în limbile moldovenească, bulgară şi engleză, toate textele fiind egal autentice. În caz de divergenţe la interpretare, textul în limba engleză va prevala.

AGREEMENT

between the Government of the Republic of Moldova

and the Government of the Republic of Bulgaria

on cooperation in case of disasters

The Government of the Republic of Moldova and the Government of the Republic of Bulgaria – parties to the present Agreement hereinafter referred to as “the Parties”;

Considering the increasingly manifest trans-boundary nature of natural and man-made disasters, the need of timely and effective addressing of the questions related to disasters through international co-operation and the importance of coordinating the joint efforts of the two states in this sphere;

Recognizing the efforts of the United Nations in the field of disaster prevention and consequences mitigation, as well as the main international documents adopted in the sphere;

Supporting the efforts of the North Atlantic Treaty Organization and the Euro- Atlantic Partnership Council in the field of assistance in case of disaster;

Taking into consideration the principles of the Agreement among the Governments of the Participating States of the Black Sea Economic Cooperation (BSEC) on Collaboration in Emergency Assistance and Emergency Response to Natural and Man-made Disasters;

Taking into consideration the conclusions of the Council of EU regarding the strengthening of the capacity for disaster response – towards an integrated approach for disaster management including prevention, preparedness, response and recovery in case of natural and man-made disasters within the EU or third parties;

Considering Community Civil Protection Mechanism and its contribution to the development of capacities for rapid and effective reaction using rescue teams;

Emphasizing that in recent years an increase of frequency and seriousness of natural and man-made disasters is seen;

Decided to foster and develop the cooperation in case of disasters between the two states according to their national legislations;

Have agreed as follows:

Article 1

Subject

The present Agreement establishes the general framework of co-operation in the area of disaster prevention, preparedness and response, as well as the terms and procedure for rendering voluntary assistance between the Parties in case of disaster within the territory of any of the said Parties.

Article 2

Definitions

For the purposes of the present Agreement, the following definitions shall apply:

“Disaster”: an event or a sequence of events that have occurred as a result of natural phenomena, incidents, accidents or other emergency circumstances, which may or have caused significant damage to the life or health of the population, property or the environment on a scale requiring the taking of measures or the commitment of specialized forces and the use of special resources;

“Requesting party”: the Party whose Competent authority, as specified in Article 3, Paragraph 2 herein, has approached the other Party with a request for assistance;

“Assisting party”: the Party whose Competent authority, as specified in Article 3, Paragraph 2 herein, renders assistance to the Party which has made the request;

“Rescue team”: an expressly trained non-military unit of the Assisting party, with appropriate equipment, rescue dogs and relief items;

“Equipment”: materials, technical and transport means, medicines and medical equipment, and individual equipment of the members of the rescue team and/or the experts;

“Relief items”: material resources allocated for free of charge and taxes-free distribution among the disaster affected population in the Requesting party;

“Expert”: a specialist in the field of disaster management, with appropriate equipment and relief items, sent to provide assistance to the Requesting party;

“Disaster relief”: any action undertaken in case of disaster or thereafter aimed at saving life, protecting property, or delivering relief items, and intended to control the immediate effects of the disaster;

“Competent authority”: the authority designated by each of the Parties to manage and co-ordinate the activities under this Agreement;

“Focal point”: the point of contact or body responsible for fulfillment of this Agreement;

“Transit state”: the state through whose territory the rescue team, equipment, and relief items are transported in order to render assistance to a third country.

Article 3

Competent Authorities and Contact Points

(1) For the purposes of this Agreement, the Parties shall co-operate directly within their competences under the national legislation thereof.

(2) The following shall be the Competent authorities under this Agreement:

- For the Government of the Republic of Moldova: Ministry of Internal Affairs;

- For the Government of the Republic of Bulgaria: Ministry of Interior.

(3) In implementation of this Agreement, the Competent authorities of the Parties as specified in Paragraph 2 of this Article shall be authorized to enter immediately into direct contact.

(4) The Parties to this Agreement shall designate one or several contact points for the purpose of notification and exchange of information in case of disaster. The Competent authorities shall ensure the uninterrupted functioning of the focal points:

- For the Government of the Republic of Moldova: Ministry of Internal Affairs, Civil Protection and Emergency Situations Service;

- For the Government of the Republic of Bulgaria: Ministry of Interior, Chief Directorate Fire Safety and Civil Protection.

(5) The Parties shall notify immediately each other in writing through diplomatic channels of any changes in the Competent authorities and the focal points.

Article 4

Forms of Co-operation

(1) Within the framework of this Agreement and in accordance with the national legislation thereof, the Parties shall co-operate on the basis of equality, reciprocity and mutual benefit by means of:

a) Rendering voluntary assistance and providing information upon request in case of disaster or a threat of occurrence of disaster;

b) Exchanging information, technical and legal documentation, methodological and other literature, video and photographic materials related to disaster prevention, preparedness and response;

c) Supplying the rescue teams with equipment;

d) Organizing and holding joint expert meetings, conferences, seminars, sessions and exercises;

e) Exchanging experience and good practices;

f) Organizing exchange and training of experts, including exchange of lecturers and trainers from the respective training centers and institutions at the request of each of the Parties;

g) Joint planning, development and implementation of projects and research works in the area of disaster prevention, preparedness and response.

(2) The Competent authorities of the Parties, according to Article 3, Paragraph 2 herein, may establish other forms of co-operation as well, and may form working groups in accordance with the national legislation of the Parties.

(3) The Parties shall render each other assistance in case of disaster within the capacities thereof.

(4) The costs of the exchange of experts etc. shall be covered by the sending Party, unless the Parties agree otherwise.

(5) The exchange of equipment, materials, other supplies and services necessary for attainment of the purposes and implementation of the programs on which agreement has been reached shall be carried out in accordance with the effective laws and statutory provisions of each of the Parties.

Article 5

Procedure for Rendering Voluntary Assistance

(1) Disaster relief may be provided by the deployment of rescue teams and/or experts, as well as by provision of relief items for the needs of the affected people.

(2) A request for assistance shall be made in writing in English language, and the Requesting party shall obligatorily state therein:

a) Type, scale, location, time and current status of the disaster in the Requesting party;

b) Information on the action undertaken and planned to cope with the disaster;

c) Type and priorities of the assistance requested in terms of rescue teams and/or experts, equipment, as well as relief items.

(3) The Assisting party must send a team trained and equipped for coping with the disaster, according to the request referred to in the above Paragraph.

(4) The rescue teams and/or the experts, sent to render assistance, as well as the equipment and the relief items, may be transported by land, air or water. The costs of transport shall be covered by the Assisting party.

Article 6

Border-Crossing Procedures and Rules for Stay of Rescue Teams and/or Experts

(1) The Requesting party shall ensure expeditious completion of the border and customs control formalities required under the national legislation thereof upon crossing of the border by the rescue teams and/or experts of the Assisting party.

(2) The leader of the rescue team shall present to the border official and customs authorities of the Requesting party the following documents in English language, certified by the competent authority of the Assisting party:

a) A document completed in a standard form approved by the Competent authorities of the Parties, specifying the powers of the rescue teams and/or experts and the purpose of their arrival on the territory of the Requesting party;

b) A list of the members of the rescue teams and/or experts and a list of the equipment and the vehicles;

c) A list of relief items.

(3) The drivers shall present driving licenses for the respective motor vehicles and the registration certificates thereof.

(4) The visa requirements under this Agreement shall be as follows:

a) Members of the rescue teams and/or the experts can enter/exit the territory of the Parties on the basis of valid travel documents abiding visa arrangement procedures foreseen by the Parties, and according to the documents covered under Article 6, Paragraph 2.

b) Members of rescue teams and/or experts have priorities in getting visas according to the Agreement between the Republic of Moldova and the European Community on the facilitation of the issuance of visas.

(5) The procedure for border crossing of the Requesting party by the rescue teams with rescue dogs and the stay thereof within the territory of the said Party shall be determined according to the quarantine rules of the said Party.

(6) The members of the rescue teams may wear uniforms in the Requesting party. The rescue teams may use distinctive signs on the vehicles thereof within the territory of the Requesting party.

(7) The border-crossing procedure, according to the terms established by this Article, shall furthermore apply where one of the Parties is a Transit state in respect of a third country requesting assistance in case of disaster. The Competent authorities referred in the Article 3, Paragraph 2 of this Agreement shall notify each other of the need of transit passage for rendering assistance to a third country and shall coordinate the procedure for the transit of the equipment and relief items.

Article 7

Border-crossing of Equipment and Relief Items

(1) The Parties shall ensure a facilitated procedure upon the crossing of the border by the equipment and the relief items.

(2) The members of the rescue team and/or the experts sent to render assistance shall not be allowed to carry arms and ammunition within the territory of the Requesting party.

(3) On a basis of reciprocity, the Parties hereby agree that the equipment shall be used within the territory of the Requesting party free of charge under the condition that such usage is temporary. With regard to customs formalities connected with placing under regime of temporary import, the re-export and securing, the relevant customs legislation shall apply.

(4) The restrictions or prohibitions applicable to the border-crossing of goods shall not apply to the equipment and relief items under this Agreement, at the same time observing the obligations arising from imperative legal regulations which have priority over national legislation. The equipment must be returned from the Requesting party, unless the said equipment has been destroyed during the use thereof. Any equipment left as relief items shall be described in detail in a protocol by the leader of the rescue team specified by type, quantity and location, and shall be certified by the Competent authority of the Requesting party referred to in Article 3, Paragraph 2 of this Agreement. The said authorities shall be obliged to notify the competent customs services, with submitting the protocol to the customs control officials after completion of the mission. The admittance for free circulation and end use of that equipment shall be performed in accordance with the applicable legislation of the Requesting party.

(5) The same provisions shall furthermore apply for the importation of medicines containing narcotic and psychotropic substances on the Requesting party′s territory and for the exit of the unused quantities by the Assisting party. Any such movement of goods shall not be treated as import and export from the point of view of the international agreements on medicines containing narcotic and psychotropic substances. The said medicines may be imported solely in quantities needed for the purposes of medical care and may be used solely by qualified medical personnel in accordance with the legislation of the Requesting party. In such case, the leader of the rescue team shall present to the border officials a declaration listing the nomenclature and quantities of the medicines containing narcotic and psychotropic substances. In respect of any unused quantities, a protocol shall be drawn up by the leader of the rescue team, shall be certified by the Competent authority of the Requesting party referred to in Article 3, Paragraph 2 of this Agreement, and shall be presented to the customs control officials after completion of the mission.

(6) The Requesting party may control the use and storage of the aforementioned medicines, equipment and relief items.

(7) There shall be no fees for border-crossing of teams and/or relief items rendered as assistance.

Article 8

Use of Aircraft

(1) Aircraft may be used for the fast transportation of rescue teams according to Article 5, Paragraph 4 herein, as well as for ensuring the disaster relief under this Agreement.

(2) The flights of the aircraft shall be executed according to the provisions of the International Civil Aviation Organization (ICAO) and the national legislation of the Parties.

(3) The aircraft referred to in the foregoing Paragraph may over-fly the territory of the other Party, as well as land and take off outside international airports and registered runways, in places specified by the authorities referred to in Article 3, Paragraph 2 herein, in conformity with the flight execution rules for each particular case, according to the statutory framework of the Republic of Moldova and of the Republic of Bulgaria.

(4) The aviation safety and security bodies of both Parties to the present Agreement shall notify each other for the use of aircraft during rescue operations providing exact data regarding type and registration number of the aircraft, the crew and cargo, time of departure and requested route and place of landing.

(5) Article 6 of this Agreement shall apply to the crew of the aircraft and to the members of the rescue team transported thereby.

(6) Article 7 of this Agreement shall apply to the aircraft, the equipment and the relief items transported thereby.

(7) The border-crossing and customs control of the aircraft shall be carried out by the border and customs control officials of the Requesting party at the place of landing of the said aircraft.

(8) The use of military aircraft shall be subject to an express written consent by the Requesting party.

Article 9

Co-ordination and Management of Disaster Relief Operations

(1) The co-ordination and management of disaster relief operations shall be the responsibility of the Competent authority of the Requesting party.

(2) The Requesting party shall inform the leaders of the rescue teams and/or the experts about the development of the situation in the disaster area and in the places designated for activity and shall ensure, where necessary, interpreters and means of communication with the operational headquarters.

(3) The rescue teams and/or the experts, as well as the equipment thereof, must be capable of self-contained and independent operation within 24 hours after the time of their arrival in the disaster area.

Article 10

Costs of Disaster Relief Operations

(1) The Assisting party shall not have the right of reimbursement by the Requesting party of any costs incurred while providing assistance. This shall furthermore apply to any costs incurred as a result of the use, damage or loss of equipment, unless the damage or loss of equipment is due to the exclusive fault of officials or citizens of the Requesting party.

(2) Paragraph 1 of this Article shall not apply if the costs of assistance are refunded in whole or in part. The Assisting party shall enjoy priority upon the reimbursement of the said costs.

(3) The Requesting party shall bear the costs of rescue operations carried out at its request by individuals or legal persons which had become possible through the intermediation of the Assisting party.

(4) The Requesting party shall ensure safety and free medical care to the rescue teams, and/or the experts sent by the Assisting party. Logistic support for the time of mission of the staff of the Assisting party shall be coordinated with the Requesting party in each case separately.

Article 11

Damages and Compensations

(1) The Assisting party shall waive any claims for damages which may arise to the said Party or to any experts sent thereby to render assistance in respect of:

a) Damage to property caused by the rescue teams or experts upon the execution of the duties thereof;

b) Physical injury, health impairment or death of a member of a rescue team and/or expert, which were caused at the execution of the duties thereof.

(1) If any member of the rescue team and/or expert of the Assisting party inflicts any damages on third party within the territory of the Requesting party during the activities under this Agreement, the said damages shall be restored by the Requesting party according to the effective legislation in the cases where any such damage has been caused by citizens of the said Party at the execution of official duties.

(2) Any damages inflicted by any member of the rescue teams and/or expert acting willfully or by gross negligence shall be restored by the Assisting party, provided that the fact of the malicious damages has been proved in court by the Requesting party.

(3) The Parties shall interact, according to Article 3 herein, in order to facilitate the settlement of any claims for damages and compensations. The said Parties shall exchange all available information in all cases of damages within the meaning given by this Article.

Article 12

Communications upon Disaster Relief Operation

The Competent authorities referred to in Article 3, Paragraph 2 of this Agreement shall ensure all necessary measures for the establishment of reliable communications for the needs of the rescue teams and/or experts in the place of the disaster relief operations.

Article 13

Terminating Disaster Relief Operations

The rescue teams, and/or experts shall terminate the activities thereof immediately upon a written request by the Competent authority of the Requesting party referred to in Article 3, Paragraph 2.

Article 14

Settlement of Disputes

Any disputes which may arise from the implementation of this Agreement and which cannot be settled by means of negotiations between the Competent authorities referred to in Article 3, Paragraph 2 of the Agreement, shall be settled through diplomatic channels.

Article 15

Other International Agreements

This Agreement shall be without prejudice to the rights and obligations of the Parties arising from any other international agreements to which their states are parties.

Article 16

Final Provisions

(1) This Agreement shall enter into force on the date of receipt of the last written notification whereby the Parties inform each other of the completion of the necessary national procedures for entry into force.

(2) This Agreement may be amended and supplemented by mutual consent of the Parties, by means of additional protocols. These protocols shall constitute an integral part of this Agreement and shall enter into force according to the provision of Paragraph 1 of this Article.

(3) This Agreement shall be concluded for an indefinite time period. Each of the Parties may denounce this Agreement at any moment by giving the other Party a written notification through diplomatic channels. Denunciations shall take legal effect after six months following the date of receipt by the other Party of such notice of termination.

Signed in Sofia on 19 April 2012 in two original copies, in Moldavian, Bulgarian, and English languages, all the texts being equally authentic. In the event of conflicting interpretation, the English text shall prevail.
