Guvernul Republicii Moldova, denumit în continuare Partea Moldovenească şi Guvernul Republicii Austria, denumit în continuare Partea Austriacă,
intenţionând să consolideze relaţiile de prietenie între cele două state,
dorind să fortifice aceste relaţii prin dezvoltarea, lărgirea şi adâncirea cooperării lor de dezvoltare,
având drept obiectiv contribuirea la reformele politice, economice şi sociale care sunt necesare pentru asigurarea creşterii economice şi a unei dezvoltări durabile şi echitabile sub aspect social, ecologic şi economic în Republica Moldova,
având drept obiectiv contribuirea la obiectivele fundamentale ale Cooperării Austriece de Dezvoltare stipulate în Actul Cooperării de Dezvoltare din 2002, reducerea sărăciei, asigurarea păcii şi a securităţii umane şi protejarea mediului înconjurător,
reafirmând angajamentul lor pentru promovarea valorilor şi standardelor europene pe întreaga durată a cooperării lor în conformitate cu Planul de Acţiuni Republica Moldova – UE în cadrul Politica de Vecinătate Europeană, în particular, democraţie, supremaţia legii, protecţia drepturilor omului şi respectul drepturilor fundamentale, inclusiv drepturile minorităţilor, precum şi o economie de piaţă funcţională,
au căzut de acord asupra următoarelor:
Articolul 1
Scopul Acordului
Acest Acord stabileşte termenii generali şi condiţiile pentru cooperarea de dezvoltare între Guvernul Republicii Moldova şi Guvernul Republicii Austria finanţată în mod nerambursabil şi fiind atribuită Asistenţei Oficiale de Dezvoltare.
Articolul 2
Obiectivele şi principiile cooperării
2.1. Ambele Părţi vor promova în cadrul legislaţiei lor naţionale respective programe şi proiecte de dezvoltare comune în Republica Moldova. Programele şi proiectele vor contribui la susţinerea proceselor de reformă în Republica Moldova, precum şi la reducerea costurilor sociale şi economice asociate perioadei de tranziţie. Ele vor contribui, de asemenea, la diminuarea dificultăţilor celor mai vulnerabile pături ale societăţii moldoveneşti.
2.2. Ambele Părţi îşi vor baza cooperarea pe angajamentele Declaraţiei de la Paris cu privire la Eficienţa Asistenţei şi vor întreprinde acţiuni în vederea realizării principiilor proprietăţii, alinierii, armonizării, managementului orientat spre rezultate şi responsabilităţii reciproce.
2.3. Ambele Părţi vor depune eforturi pentru a mobiliza un volum maxim de resurse pentru cofinanţarea programelor şi proiectelor comune în scopul realizării prezentului Acord, Ca principiu de bază, partenerii din ambele ţări vor contribui cu resursele lor proprii la implementarea fiecărui program şi proiect.
2.4. Ambele Părţi împărtăşesc o îngrijorare comună în lupta împotriva corupţiei, care pune în pericol buna guvernare şi utilizarea adecvată a resurselor necesare pentru dezvoltare şi adiţional pune în pericol concurenţa deschisă şi corectă bazată pe preţ şi calitate. Se declară, prin urmare, intenţia lor de consolidare a eforturilor în lupta contra corupţiei, şi se declară în special că nici o ofertă, cadou, plată, consideraţiune sau beneficiu de orice fel, care constituie un act ilegal sau o practică coruptă, nu a fost făcut şi nu va fi făcut în mod direct sau indirect ca stimulare sau recompensă pentru executarea prezentului Acord. Orice act de acest gen constituie un motiv suficient pentru încetarea prezentului Acord sau pentru luarea oricăror altor măsuri de corecţie prevăzute de legislaţia în vigoare.
Articolul 3
Formele de cooperare
3.1. Cooperarea de dezvoltare poate avea forma unei cooperări tehnice, financiare, umanitare sau a asistenţei de urgenţă. Aceasta poate fi realizată sub formă bilaterală sau în cooperare cu alţi donatori şi/sau organizaţii multilaterale.
3.2. Asistenţa umanitară Părţii Moldoveneşti va fi acordată de Partea Austriacă sub formă de bunuri, servicii, experţi sau contribuţii financiare. O astfel de asistenţă va contribui la rândul ei la consolidarea capacităţii organizaţiilor umanitare locale şi naţionale.
3.3. Cooperarea tehnică cu Partea Moldovenească va fi realizată de Partea Austriacă sub forma transferului de cunoştinţe practice (know-how) prin intermediul instruirii şi consultanţei şi sub formă de servicii, precum şi echipament şi materiale necesare pentru implementarea cu succes a proiectelor.
Articolul 4
Delegarea autorităţii şi dialogul politic
Ambele Părţi vor reprezenta Guvernele lor în aspecte ce vizează implementarea prezentului Acord. Reprezentanţii ambelor Părţi se vor întâlni în mod regulat pentru a stabili priorităţile şi principiile comune de cooperare, a oferi ghidare în implementarea programelor şi proiectelor viitoare de dezvoltare, a menţine un dialog politic şi a evalua progresul programelor. Rezultatele fiecărei întâlniri vor fi formulate în scris şi vor fi semnate de reprezentanţii ambelor Părţi.
Articolul 5
Stipulări generale cu privire la scutirile vamale şi fiscale
În scopul facilitării implementării oricărui proiect vizat de prezentul Acord, Partea Moldovenească:
(a) Va scuti toate bunurile, inclusiv echipamentele şi materiale, lucrările şi serviciile, oferite sau finanţate în bază de grant de Republica Austria, de impozite, taxe vamale, fiscale (inclusiv TVA) şi alte plăţi,
(b) Va acorda toate permisele, autorizările, licenţele, aprobările sau alte documente similare, necesare pentru importul (inclusiv importul temporar) şi reexportarea echipamentului necesar pentru implementarea proiectelor.
Articolul 6
Condiţii pentru instituţiile, ONG-urile şi companiile străine
Când instituţiile străine, organizaţiile nonguvernamentale, companiile sau alte persoane juridice din alte ţări decât Republica Moldova sunt contractate de Republica Austria pentru realizarea lucrărilor în Republica Moldova în cadrul cooperării de dezvoltare între Guvernul Republicii Moldova şi Guvernul Republicii Austria, următoarele vor fi aplicabile în Republica Moldova:
(a) Aceste persoane juridice nu vor fi trase la răspundere pentru neîndeplinirea sarcinilor lor dacă aceasta se datorează instrucţiunilor de securitate sau recomandărilor emise de Partea Austriacă.
(b) Ei vor avea dreptul să importe şi să reexporte fără taxe vamale şi alte plăţi similare, echipament profesional şi bunuri care sunt necesare pentru îndeplinirea sarcinilor lor, sau să predea acest echipament instituţiilor beneficiare ale proiectului, să comercializeze pe teritoriul Părţii Moldoveneşti acest echipament după plata taxelor vamale şi altor plăţi similare atunci când acesta nu mai este necesar pentru oferirea serviciilor.
(c) Ei vor fi scutiţi de taxe/impozite şi alte plăţi pe profiturile companiei, pe cifra de afaceri sau pe alte obiecte similare ale impozitării, şi pe retribuţiile şi remunerările plătite de Partea Austriacă pentru serviciile acordate în cadrul programelor/proiectelor cooperării de dezvoltare.
(d) Ei vor avea dreptul să deschidă conturi bancare în Republica Moldova şi să le opereze pentru realizarea sarcinilor delegate în conformitate cu legislaţia Republicii Moldova. Partea Moldovenească nu va impune plăţi sau va împiedica operarea eficientă a acestor conturi. Balanţa acestor conturi va fi liber transferabilă în orice valută străină.
(e) Ei vor fi scutiţi de orice obligaţie de a se înregistra în Republica Moldova în scopuri de autorizare profesională, impozite sau alte motive şi nu vor fi obligaţi să prezinte informaţii autorităţilor fiscale ale Părţii Moldoveneşti, cu excepţia cazurilor în care se realizează activităţi de afaceri în Republica Moldova care nu cad sub incidenţa prezentului Acord.
Articolul 7
Condiţii pentru personalul nerezident
7.1. Următoarele condiţii vor fi aplicabile în Republica Moldova acelor persoane nerezidente în Republica Moldova, inclusiv cetăţeni ai Republicii Moldova, care:
(a) realizează sarcini în Republica Moldova în cadrul programelor/proiectelor cooperării de dezvoltare finanţate de Republica Austria, cu condiţia că ei sau angajatorul lor are un contract cu Republica Austria;
(b) sunt soţi sau membri ai familiei angajatului la punctul (a) de mai sus.
7.2. Legile Părţii Moldoveneşti se aplică persoanelor menţionate în literele a) şi b) ale paragrafului de mai sus, dacă nu există altfel de prevederi stipulate în alte Acorduri între cele două Părţi.
7.2.1. Partea Moldovenească va garanta persoanelor menţionate în literele a) şi b) ale primului paragraf din acest articol următoarele:
(a) Examinarea şi eliberarea rapidă, gratuită a vizelor cu intrări multiple, de intrare repetată şi ieşire pentru întreaga durată a activităţii lor;
(b) Mişcarea liberă pe teritoriul ţării şi dreptul de a intra şi a părăsi ţara atât cât va fi nevoie pentru implementarea programului/proiectului;
(c) Eliberarea rapidă a tuturor permiselor şi licenţelor, cum ar fi permisele de reşedinţă, permisele de muncă, permisele de cercetare şi permisele profesionale, precum şi scutirea de restricţiile de imigrare şi înregistrare a străinilor în perioadele în care cad sub incidenţa prezentului Acord;
(d) Privilegii echivalente de repatriere pe timpuri de criză naţională şi internaţională ca şi cele acordate experţilor similari de dezvoltare a cooperării ale altei ţări sau organizaţii internaţionale.
7.2.2. Partea Moldovenească va garanta personalului următoarele:
(a) Scutirea de la impozitul personal pe venit şi orice alte impozite directe ce vizează retribuţiile plătite acestora de Partea Austriacă sau de un angajator care şi-a asumat responsabilitatea de a acorda servicii sau a furniza bunuri printr-un contract cu Partea Moldovenească sau Partea Austriacă în mod direct sau în calitate de subcontractor;
(b) Dreptul de a importa şi reexporta, fără taxe vamale şi alte plăţi echipament profesional şi bunuri necesare pentru realizarea sarcinilor de lucru.
7.2.3. Personalului nerezident angajat pentru o perioadă mai mare de şase luni se vor garanta următoarele:
(a) Dreptul de a deschide şi opera conturi bancare în Republica Moldova pentru necesităţi personale în concordanţă cu legislaţia Republicii Moldova. Partea Moldovenească nu va impune careva plăţi în raport cu aceste conturi sau vor împiedica operarea eficientă a acestor conturi. Balanţa acestor conturi va fi liber transferabilă în orice valută străină.
(b) Scutirea de Ia taxele de import şi export, tarife vamale şi de altă natură, alte taxe, contribuţii sau plăţi, inclusiv TVA, pentru obiectele personale şi de uz casnic inclusiv, dar nefiind limitate la obiecte de gospodărie, obiecte personale şi vehicule. Articolele astfel importate pot fi comercializate altor persoane care cad şi ei sub incidenţa scutirilor. Dacă articolele astfel importate sunt comercializate altor persoane decât celor care cad sub incidenţa scutirilor, vor fi achitate toate impozitele/taxele corespunzătoare.
7.3. Securitatea
7.3.1. Partea Moldovenească va informa misiunea diplomatică a Părţii Austriece acreditată pentru Republica Moldova cu privire la orice situaţie extraordinară sau stare de urgenţă în ţară. În cazul unor astfel de situaţii calificate de oricare din Părţi ca fiind condiţii de forţă majoră sau punând în pericol implementarea proiectelor sau programelor de cooperare, oricare dintre Părţi poate solicita consultaţii imediate. În cadrul acestor consultaţii Partea Moldovenească va oferi informaţii cu privire la orice reglementări de securitate sau alte restricţii care trebuie urmate de personalul străin.
7.3.2. În caz de urgenţă, Partea Moldovenească va ti responsabilă pentru securitatea personalului nerezident al Părţii Austriece, a experţilor străini şi personalului entităţilor stipulate în Articolul 7 finanţate de Partea Austriacă, precum şi a familiilor lor.
7.3.3. Partea Austriacă îşi rezervă dreptul, din motive de securitate, să ofere instrucţiuni specifice personalului. Aceste instrucţiuni ar putea include ordinul de a părăsi Republica Moldova. Personalul care se conformează acestor instrucţiuni sau ia alte măsuri de precauţie care sunt justificate în astfel de circumstanţe nu trebuie să fie considerat ca abandonându-şi responsabilităţile contractuale.
7.4. Detenţie sau arest
7.4.1. În cazul detenţiei sau arestului, pentru orice motiv, a oricărei persoane vizate de prezentul Acord, sau în cazul instituirii procedurilor penale asupra unei astfel de persoane, misiunea diplomatică a Republicii Austria acreditată pentru Republica Moldova va fi notificată fără întârziere şi va avea dreptul să viziteze persoana deţinută sau arestată. Persoana deţinută sau arestată va avea dreptul să contacteze ambasada sau consulatul său şi va avea dreptul de a beneficia de acces la un avocat numit de ambasada sa sau de persoana în cauză.
7.4.2. Partea Moldovenească va oferi oricărei persoane vizate de acest Acord condiţii de trai nu mai puţin favorabile în condiţii de detenţie sau arest, în comparaţie cu condiţiile oferite cetăţenilor săi sau cetăţenilor altor state, oricare din acestea sunt mai rezonabile.
7.5. Partea Moldovenească poate solicita rechemarea sau schimbarea oricărui membru al personalului numit de Republica Austria, a cărui activitate sau conduită este considerată nesatisfăcătoare. Republica Austria poate rechema orice membru al personalului.
Articolul 8
Implementarea
8.1. Din partea Republicii Moldova, coordonarea proiectelor este responsabilitatea Ministerului Economiei şi Comerţului. Din partea Republicii Austria, responsabilitatea pentru implementarea Programului Cooperării Austriece de Dezvoltare al Ministerului Austriei pentru Afaceri Externe aparţine Agenţiei Austriece de Dezvoltare (ADA). Coordonarea proiectelor va fi asigurată de reprezentantul Cooperării Austriece de Dezvoltare în Chişinău/Moldova. Ei se vor informa reciproc în mod regulat cu privire la progresul în implementarea proiectelor vizate de prezentul Acord.
8.2. Fiecare proiect ce cade sub incidenţa scopului prezentului Acord va fi subiect al unui contract aparte între parteneri specifici cu stipularea în detaliu a drepturilor şi obligaţiilor fiecărui partener al proiectului.
8.3. Regulile şi procedurile aplicabile pentru procurarea bunurilor, serviciilor şi lucrărilor vor fi stipulate în contracte care acoperă programele/proiectele vizate de prezentul Acord.
Articolul 9
Amendamente, interpretări
9.1. Orice amendament Ia prezentul Acord va fi făcut în scris. Astfel de amendamente vor intra în vigoare în conformitate cu procedura stipulată în Articolul 10.1.
9.2. Orice dispută cu plivire la interpretarea sau aplicarea prezentului Acord va fi soluţionată în mod amiabil prin intermediul canalelor diplomatice.
Articolul 10
Intrarea în vigoare, terminarea
10.1. Acest Acord va intra în vigoare în prima zi a lunii care urmează luna în care ambele Părţi s-au notificat reciproc cu privire la finalizarea tuturor procedurilor necesare în ţările respective. Acordul va fi aplicat provizoriu din data semnării. Atât aplicarea provizorie cât şi aplicarea propriu-zisă a Acordului vor acoperi toate proiectele în proces de implementare şi proiectele în faza de pregătire.
10.2. Acordul poate fi denunţat în formă scrisă de oricare din Părţi în orice moment. Terminarea va intra în vigoare în prima zi a lunii a treia după notificare prin intermediul canalelor diplomatice. Aceasta nu va afecta programele şi proiectele care sunt în faza de implementare la momentul notificării de terminare a Acordului.
Semnat la 21 octombrie 2008 la Viena, în două exemplare originale, fiecare în limbile moldovenească, germană şi engleză. Ambele texte fiind egal autentice. În caz de divergenţe de interpretare, textul în limba engleza va prevala.
AGREEMENT
between the Government of the Republic of Moldova
and the Government of the Republic of Austria
on Development Cooperation
The Government of the Republic of Moldova, hereinafter referred to as the "Moldovan Party", and the Government of the Republic of Austria, hereinafter referred to as the "Austrian Party",
intending to reinforce the ties of friendship between the two countries,
desirous of strengthening these relations by developing, extending and deepening their development cooperation.
aiming at contributing to the political, economic and social reforms necessary to attain economic growth and a sustainable, socially, economically and ecologically equitable development in Moldova,
aiming at contributing to the overarching objectives of the Austrian Development Cooperation as laid down in the Development Cooperation Act 2002, poverty reduction, safeguarding peace and human security and preserving the environment,
reaffirming their commitment to promote European values and standards throughout their cooperation as referred to in the EU-Moldova Action Plan in the framework of the European Neighbourhood Policy, in particular democracy, the rule of law, protection of human rights and fundamental freedoms, including the rights of persons belonging to minorities as well as a functioning market economy,
have agreed as follows;
Article 1
Scope of Agreement
This Agreement sets out the general terms and conditions for development cooperation between the Government of the Republic of Austria and the Government of the Republic of Moldova funded on a grant basis and attributable as Official Development Aid.
Article 2
Objectives and Principles of Cooperation
2.1. Both Parties shall promote within the framework of their respective national legislation common development programmes and projects in the Republic of Moldova. Programmes and projects shall contribute to support the reform process in the Republic of Moldova and to mitigate the social and economic costs of adjustment. They shall also contribute to alleviate hardship of most vulnerable segments of Moldovan society.
2.2. Both Parties shall base their cooperation on the commitments of the Paris Declaration on Aid Effectiveness and take action towards realizing the principles of ownership, alignment, harmonization, managing for results and mutual accountability.
2.3. Both Parties endeavour to mobilize a maximum of resources for cofunding common programmes and projects for the purpose of this Agreement. As a principle, partners form both countries shall contribute with their own resources to the implementation of each programme and project.
2.4. Both Parties share a common concern in the fight against corruption, which jeopardizes good governance and the proper use of resources needed for development and, in addition, endangers fair and open competition based on price and quality. They declare, therefore, their intention of combining their efforts to fight corruption and declare, in particular, that no offer, gift, payment, consideration or benefit of any kind, which constitutes an illegal act or corrupt practice, has been or will be made directly or indirectly as an inducement or reward for the execution of this Agreement. Any act of this kind constitutes sufficient ground to terminate this Agreement or for taking any other corrective measures foreseen by the applicable law.
Article 3
Forms of Cooperation
3.1. Development cooperation may take the form of technical or financial cooperation, humanitarian or emergency assistance, It may be carried out either on a purely bilateral basis, or also in co-operation with other donors and/or multilateral organizations.
3.2. Humanitarian assistance to the Moldovan Party shall be carried out by the Austrian Part) in form of goods, services, provision of experts or financial contribution. Such assistance shall concurrently contribute to capacity building of local and national humanitarian organisations.
3.3. Technical co-operation with the Moldovan Party shall be carried out by the Austrian Party in form of know-how transfer through training and consulting and in form of services as well as related equipment and materials necessary for the successful implementation of the projects.
Article 4
Delegation of Powers and Policy Dialogue
Both Parties shall represent their respective Governments in matters concerning the implementation of this Agreement. Representatives of both Parties shall meet regularly in order to establish common priorities and principles of cooperation provide guidance for the implementation of future development programmes and projects engage in policy dialogue and evaluate programme progress. The results of each meeting shall be recorded in writing and be signed by the representatives of both Parties.
Article 5
General Provisions for Customs and Tax Exemptions
In order to facilitate the implementation of any project under this Agreement, the Moldovan Party shall
(a) Exempt all goods including equipment and material, works and services provided or financed on a grant basis by Austria from taxes, customs duties, fiscal (including VAT) and other charges.
(b) Grant all permits, authorizations, licenses, approvals or any similar documents necessary for the import (including the temporary import) and re-export of equipment required for the implementation of the projects.
Article 6
Conditions for Expatriate Institutions, NGOs and Companies
When expatriate institutions, Non Governmental Organisations, companies or other legal persons from countries other than the Republic of Moldova, are contracted by Austria to perform tasks in Moldova within the framework of development cooperation between the Government of the Republic of Moldova and the Government of the Republic of Austria, the following shall apply in the Republic of Moldova:
(a) Such legal persons shall not be held responsible for failure to fulfil their undertakings if this is due to security instructions or recommendations issued by the Austrian Party.
(b) They shall have the right to import and re-export, free of customs duty and other similar charges, professional equipment and goods that they need to accomplish their undertaking, to hand over this equipment to the beneficiary of the project or to sell such equipment within Moldova upon payment of customs and similar charges, when no longer needed to provide the services.
(c) They shall be exempted from taxes and similar levies on company profits, turnover or any similar ground, and on fees and remuneration paid to them by Austria for their services within the programme/projects of development cooperation.
(d) They shall have the right to open bank accounts in the Republic of Moldova and to operate them for the fulfilment of their undertaking according to the legislation of the Republic of Moldova. The Moldovan Party shall not impose fees on these accounts or hamper the efficient handling of the accounts. Balances in these accounts shall be freely transferable to any foreign currency.
(e) They shall be exempted from all obligations to register themselves in the Republic of Moldova for professional authorisation, taxes or other reasons, and shall be under no obligation to present information to the tax authorities of Moldova unless they conduct business activities in the Republic of Moldova that do not fall under this Agreement.
Article 7
Conditions for Expatriate Personnel
7.1. The following conditions shall apply in the Republic of Moldova to those natural persons not permanently resident in Moldova, including citizens of the Republic of Moldova, who:
(a) are performing tasks in the Republic of Moldova within programmes/projects of development cooperation financed by Austria, provided that they or their employer has a contract with Austria;
(b) are spouses or dependants of the personnel in (a) above.
7.2. The laws of the Republic of Moldova apply to the persons referred to in lit a) and b) of the above paragraph, unless otherwise agreed in this or other Agreements between the two Parties.
7.2.1. The Moldovan Party shall guarantee persons referred to in lit a) and b) of the first paragraph of this article the following:
(a) Prompt clearance and issue, free of charge, of multiple entry, re-entry and exit visas for the entire duration of the assignment of the personnel concerned.
(b) Free movement within the country and the right to enter and leave the country to the extent necessary for the implementation of the programme/project.
(c) Prompt issue of all required permits or licences such as residence permits and, where applicable work permits, research permits and professional permits as well as exemption from immigration restrictions and alien registration during the periods they are covered by this Agreement.
(d) Equivalent repatriation facilities in times of national or international crisis as are provided for similar experts of development cooperation of any other country or international organisation.
7.2.2. The Moldovan Party shall guarantee the personnel the following:
(a) Exemption from personal income tax and any other direct tax in respect of emoluments paid to them by Austria, or by an employer who has undertaken to perform services or deliver goods in a contract with Austria or Moldova directly or as a sub-contractor.
(b) A right to import and re-export, free of customs duty and other charges, professional equipment and goods needed to accomplish the assignment.
7.2.3. The non-resident personnel serving more than six months shall also be guaranteed the following:
(a) The right to open and operate bank accounts in the Republic of Moldova for their personal needs according to the legislation of the Republic of Moldova The Moldovan Party shall not impose fees on these accounts or hamper the efficient handling of the accounts. Balances in these accounts shall be freely transferable to any foreign currency.
(b) Exemption from import and export duties, customs tariffs and other duties, fees, levies or any other similar charges, including VAT, on personal and domestic effects, including but not limited to household appliances, personal effects and vehicles. Articles thus imported may be sold to other persons who are themselves entitled to exemption. If articles thus imported are disposed of otherwise, appropriate duty and/or charges shall be paid on them.
7.3. Security
7.3.1. Moldova shall inform the diplomatic mission of the Republic of Austria accredited to the Republic of Moldova of any extraordinary situation or state of emergency in the country. In the event of such developments being deemed by either of the Parties as constituting force majeure or likely to endanger the implementation of projects or programmes of cooperation, either Party may request immediate consultations. In such consultations the Moldovan Party shall provide information about any security regulations or other restrictions to be observed by expatriate personnel.
7.3.2. In case of emergency, the Moldovan Party shall be responsible for the security of the expatriate personnel of the Austrian Party, the foreign experts and the personnel of the entities referred to in this Article funded by Austria, as well as their spouses or dependants.
7.3.3. Austria may, for reasons of security, give specific instructions to the personnel. These instructions may include orders to leave the Republic of Moldova. Personnel complying with the instructions or otherwise taking precautions that are warranted under the circumstances shall not be considered to be in dereliction of duty under their contract.
7.4. Detention or arrest
7.4.1. In the event of detention or arrest, for any reason whatsoever, of any person covered by this Agreement, or in the event of criminal proceedings being instituted against such a person, the diplomatic mission of the Republic of Austria accredited to the Republic of Moldova shall be notified without delay and shall have the right to visit the detained or arrested person. The detained or arrested person shall have the right to contact his/her embassy or consulate and to have access to a lawyer assigned by his/her embassy or by the person him/herself
7.4.2. The Moldovan Party shall, provide to any person covered by this Agreement no less favourable living conditions in detention or arrest than provided to its citizens or to citizens of other countries whichever are more reasonable.
7.5. The Moldovan Party may request the recall or replacement of any member of the personnel made available by Austria whose work or conduct is deemed unsatisfactory. Austria may recall any member of the personnel.
Article 8
Implementation
8.1. On the Austrian side, the responsibility for the implementation of the Austrian Development Cooperation Programme of the Austrian Ministry for Foreign Affairs lies with the Austrian Development Agency (ADA). The coordination of projects will be ensured by the representative of the Austrian Development Cooperation in Chisinau/Moldova. On the Moldovan side, the coordination of the projects lies with the Ministry of Economy and Trade. They shall keep each other regularly informed on progress concerning the implementation of projects undertaken under this Agreement. Each project under the scope of this Agreement shall be subject to a particular contract between the specific partners of the project stipulating in detail the rights and obligations to be borne by each partner of the project.

8.3. Applicable rules and procedures for procurement of goods, services and works shall be laid down in contracts covering programmes/projects under this Agreement.
Article 9
Amendments, Interpretation
9.1. Any amendment to this Agreement shall be made in writing. Any such amendment shall enter into force according to the procedure set forth in Article 10.1.
9.2. Any dispute concerning the interpretation or application of this Agreement shall be settled amicably through diplomatic channels.
Article 10
Final Provisions
10.1. This Agreement shall enter into force on the first day of the month following the month in which both Parties have notified each other of the fulfilment of all procedures necessary in their respective countries. The Agreement shall be provisionally applied from the date of its signing. Both the provisional application and the application of the Agreement shall cover all ongoing projects and projects under preparation.
10.2. The Agreement may be terminated in writing by either Part at any time. Termination shall take effect on the first day of the third month after notification through diplomatic channels. It shall not affect programmes and projects ongoing at the time of the notification of termination.
Signed in Viena on Octomber 21, 2008, in two original copies, each of them in Moldovan, German and English, all texts being equally authentic. In case of any divergences in interpretation, the English text shall prevail.
