Serviciul Vamal de pe lîngă Ministerul Finanţelor al Republicii Moldova (denumit în continuare SV) şi Departamentul Apărării al Statelor Unite ale Americii (denumit în continuare DoD), ambele denumite în continuare “Părţi”,
dorind să consolideze securitatea frontierelor Republicii Moldova în scopul prevenirii transferurilor şi transporturilor neautorizate de arme de distrugere în masă (denumite în continuare ADM) şi de tehnologii, materiale şi cunoştinţe de specialitate aferente, prin teritoriul Republicii Moldova,
acţionînd în conformitate cu prevederile Acordului între Guvernul Republicii Moldova şi Guvernul Statelor Unite ale Americii cu privire la cooperarea în vederea facilitării acordării asistenţei, semnat la Chişinău la 21 martie 1994 (denumit în continuare “Acordul Umbrelă”),
au convenit următoarele:
Articolul I
1) În temeiul Acordului Umbrelă şi în conformitate cu prevederile prezentului Acord, DoD sau reprezentanţii săi autorizaţi pentru implementare pot acorda asistenţă SV sau reprezentanţilor săi autorizaţi pentru implementare cu scopul sporirii securităţii frontierelor în vederea prevenirii, detectării, descurajării şi interzicerii traficului cu ADM şi materiale şi tehnologii aferente prin teritoriul Republicii Moldova. Această asistenţă poate fi acordată sub formă de echipamente, accesorii, materiale, tehnologii, instruiri şi servicii, în conformitate cu prevederile prezentului Acord. SV va supraveghea importurile, distribuirea şi utilizarea prevăzută pentru echipamentele, accesoriile, materialele şi tehnologiile furnizate.
2) SV sau reprezentanţii săi autorizaţi pentru implementare vor folosi toate echipamentele, accesoriile, materialele, tehnologiile, instruirile şi celelalte servicii pertinente furnizate de DoD în concordanţă cu scopurile formulate în prezentul Acord şi în conformitate cu Acordul Umbrelă.
Articolul II
Fiecare Parte la prezentul Acord va avea dreptul, în urma unei înştiinţări scrise către cealaltă Parte, să desemneze un reprezentant tehnic sau reprezentanţi tehnici de legătură, care să coordoneze materialele, instruirile şi serviciile furnizate în temeiul prezentului Acord. Fiecare Parte va avea dreptul, în concordanţă cu legile şi reglementările sale şi în urma unei înştiinţări scrise către cealaltă Parte, să autorizeze alte agenţii, departamente, unităţi ale guvernului său sau organizaţii neguvernamentale să îndeplinească anumite sarcini referitoare la prezentul Acord.
Articolul III
1) SV sau reprezentanţii săi autorizaţi pentru implementare se vor coordona cu alte ministere, agenţii şi organizaţii respective ale Guvernului Republicii Moldova pentru a garanta că materialelor, inclusiv accesoriilor, echipamentelor şi instrumentelor, furnizate Guvernului Republicii Moldova în temeiul prezentului Acord, li se asigură o procesare prioritară pentru a fi livrate cu promptitudine agenţiilor corespunzătoare din Republica Moldova. SV sau reprezentanţii săi autorizaţi pentru implementare vor coordona cu alte ministere, agenţii şi organizaţii respective ale Guvernului Republicii Moldova pentru a garanta că personalului şi contractorilor DoD li se asigură măsuri de securitate corespunzătoare pe teritoriul Republicii Moldova. De asemenea, SV sau reprezentanţii săi autorizaţi pentru implementare vor lua toate măsurile rezonabile ca materialele, inclusiv accesoriile, echipamentele şi instrumentele, să fie în siguranţă la instalaţiile legate de activităţile desfăşurate conform prezentului Acord.
2) SV sau reprezentanţii săi autorizaţi pentru implementare vor facilita inspectarea de către ministerele, agenţiile şi organizaţiile pertinente ale Guvernului Republicii Moldova a tuturor materialelor, inclusiv accesoriilor, echipamentelor şi instrumentelor, primite conform prezentului Acord şi vor confirma DoD că acestea sunt acceptabile, în decurs de zece zile de la primirea rezultatelor inspecţiilor. Materialele, inclusiv accesoriile, echipamentele şi instrumentele, considerate necorespunzătoare specificaţiilor convenite vor fi restituite DoD în decurs de 30 de zile de la primirea lor, prin intermediul Ambasadei Statelor Unite la Chişinău, pentru a fi înlocuite pe cheltuiala DoD.
3) SV sau reprezentanţii săi autorizaţi pentru implementare vor colabora anual cu DoD la elaborarea unui plan care să descrie premizele de bază, cerinţele, responsabilităţile şi metodele de utilizare ale echipamentelor pentru fiecare proiect iniţiat în temeiul prezentului Acord, iar SV sau reprezentanţii săi autorizaţi pentru implementare vor atesta ca fiecare asemenea plan este exact.
4) În conformitate cu legislaţia Republicii Moldova, SV sau reprezentanţii săi autorizaţi pentru implementare se vor coordona cu ministerele, agenţiile şi organizaţiile corespunzătoare ale Guvernului Republicii Moldova pentru a dobîndi drepturile de administrare a imobilelor şi să asigure eliberarea autorizaţiilor relevante în funcţie de necesităţi, în vederea facilitării activităţilor desfăşurate conform prezentului Acord, permiţînd astfel DoD să furnizeze asistenţa tehnică, inclusiv echipamentele, accesoriile şi instructajele, în timp util.
Articolul IV
SV va fumiza la timp Guvernului Statelor Unite ale Americii (denumit în continuare Guvernul S.U.A.) informaţii despre orice detectare sau confiscare de materiale legate de ADM, efectuate ca urmare a folosirii echipamentelor sau tehnologiilor de monitorizare şi detectare fumizate de Guvernul S.U.A. sau prin utilizarea oricăror altor materiale, procedee sau cunoştinţe de specialitate oferite de Guvernul S.U.A. De asemenea, SV va fumiza la timp Guvernului S.U.A. informaţii despre toate datele colectate.
Articolul V
1) Prezentul Acord şi toate activităţile desfăşurate în temeiul acestuia vor cădea sub incidenţa prevederilor Acordului Umbrelă şi vor fi reglementate de prevederile Acordului Umbrelă.
2) În cazul oricăror neconcordanţe între prevederile prezentului Acord şi prevederile Acordului Umbrelă, vor prevala prevederile Acordului Umbrelă.
3) Pe lîngă drepturile de inspecţie şi audit, conform Articolul ui III al Acordului Umbrelă, reprezentanţii autorizaţi de DoD pentru implementare vor avea şi dreptul de a monitoriza implementarea condiţiilor din contracte şi desfăşurarea lucrărilor la instalaţiile pe teritoriul Republicii Moldova, care cad sub incidenţa prezentului Acord.
Articolul VI
1) Prezentul Acord va intra în vigoare la data semnării şi rămîne în vigoare pe durata Acordului Umbrelă, dacă nu este reziliat de Părţi conform prevederilor prezentului Acord.
2) Prezentul Acord poate fi amendat prin acordul scris al Părţilor şi poate fi reziliat prin acordul comun exprimat în scris de ambele Părţi sau de către oricare din Părţi prin notificarea în scris a celeilalte Părţi cu cel puţin 90 de zile înainte de reziliere.
DREPT CARE, subsemnaţii, fiind împuterniciţi în mod corespunzător de guvernele lor, au semnat prezentul Acord.
ÎNCHEIAT la Chişinău, în dublu exemplar, în ziua de 21 a lunii decembrie a anului 2012, în limbile moldoveană şi engleză, fiecare text fiind în egală măsură autentic.
IMPLEMENTING AGREEMENT
between Customs Service under the Ministry of Finance of the Republic of Moldova
and the Department of Defense of the United States of America concerning
cooperation in border security assistance and preventing the
proliferation of weapons of mass destruction
The Customs Service under the Ministry of Finance of the Republic of Moldova (hereinafter referred to as CS) and the Department of Defense of the United States of America (hereinafter referred to as DoD), jointly referred to as the Parties;
Desiring to strengthen the border security of the Republic of Moldova in order to prevent the unauthorized transfer and transportation of weapons of mass destruction (hereinafter referred to as WMD) and related technology, materials and expertise through the territory of the Republic of Moldova;
Acting under the provisions of the Agreement Between the Government of Moldova and the Government of the United States of America Regarding Cooperation to Facilitate the Provision of Assistance, done at Chisinau on March 21, 1994 (hereinafter referred to as the Umbrella Agreement);
Have agreed as follows:
Article I
1) Pursuant to the Umbrella Agreement, and under the provisions of this Agreement, DoD or its authorized implementing representatives may provide to the CS or its authorized implementing representatives assistance for the purposes of enhancing border security in order to prevent, detect, deter, and interdict trafficking in WMD and related materials and technologies through the territory of the Republic of Moldovi. Such assistance may take the form of equipment, supplies, materials, technology, training, and services, in accordance with the provisions of this Agreement. The CS shall oversee imports, distribution, and targeted usage of equipment, supplies, materials, and technologies provided.
2) The CS or its authorized implementing representatives shall use all equipment, supplies, materials, technology, training, and other relevant services that are provided by DoD in accordance with the purposes stated in this Agreement and in compliance with the Umbrella Agreement.
Article II
Each Party to this Agreement shall have the right, following written notification to the other Party, to designate a technical liaison representative or representatives to coordinate material, training, and services provided pursuant to this Agreement. Each Party shall have the right, consistent with its laws and regulations, and following written notification to the other Party, to authorize other agencies, departments, units of its respective government, or non-governmental organizations to implement specific tasks related to this Agreement.
Article IIl
1) The CS or its authorized implementing representatives shall coordinate with other appropriate Government of the Republic of Moldova ministries, agencies, and organizations to ensure that materials, including supplies, equipment, and instruments, provided to the Government of the Republic of Moldova under this Agreement, are afforded priority processing to allow prompt delivery to appropriate agencies within the Republic of Moldova. The CS or its authorized implementing representatives shall coordinate with the appropriate Government of the Republic of Moldova ministries, agencies, and organizations to ensure that appropriate security measures are provided for DoD personnel and contractors in the territory of the Republic of Moldova. The CS or its authorized implementing representatives shall also take all reasonable measures for securing materials, including supplies, equipment, and instruments, at those facilities associated with activities under this Agreement.
2) The CS or its authorized implementing representatives shall facilitate the examination by the appropriate ministries, agencies, and organizations of the Government of the Republic of Moldova of all materials, including supplies, equipment, and instruments received pursuant to this Agreement, and provide confirmation of their acceptability to DoD within ten days of receipt of the results of such examinations. Materials, including supplies, equipment, and instruments, that fail to conform to agreed-upon specifications shall be returned within 30 days of receipt to DoD, through the Embassy of the United States in Chisinau, for replacement at DoD expense.
3) The CS or its authorized implementing representatives shall cooperate with DoD annually to develop a plan describing the underlying assumptions, requirements, responsibilities, and methods of utilization of equipment for each project being undertaken pursuant to this Agreement, and the CS or its authorized implementing representatives shall certify each such plan as accurate.
4) The CS or its authorized implementing representatives, in accordance with the laws of the Republic of Moldova, shall coordinate with the appropriate ministries, agencies, and organizations of the Government of the Republic of Moldova to acquire rights to manage real property and to secure issuance of authorization documents as may be necessary to facilitate activities under this Agreement, thereby enabling DoD to provide technical assistance including equipment, supplies, and training in a timely fashion.
Article IV
The CS shall furnish the Government of the United States of America (hereinafter referred to as the U.S. Government) with timely information on any detection or seizure of material related to WMD made as a result of using U.S. Government-supplied monitoring and detection equipment or technology, or through any other materials, devices, or expertise provided by the U.S. Government. The CS shall also furnish the U.S. Government with timely information on all data collected.
Article V
1) This Agreement and all activities undertaken pursuant to this Agreement shall be subject to and governed by the provisions of the Umbrella Agreement.
2) In case of any inconsistency between the provisions of this Agreement and the provisions of the Umbrella Agreement, the provisions of the Umbrella Agreement shall prevail.
3) In addition to the inspection and audit rights under Article III of the Umbrella Agreement, DoD-authorized implementing representatives shall have the right to monitor the implementation of the terms of contracts and progress of work performed at facilities on the territory of the Republic of Moldova under this Agreement.
Article VI
1) This Agreement shall enter into force on the date of signature and shall remain in force for the duration of the Umbrella Agreement unless terminated by the Parties under the provisions of this Agreement.
2) This Agreement may be amended by the written agreement of the Parties, and may be terminated by mutual consent of the Parties in writing or by either Party upon at least 90 days prior written notification to the other Party.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
DONE at Chisinau, in duplicate, this 21 day of December 2012, in the Moldovan and English languages, each text being equally authentic.
