1. Ambasada Republicii Federative a Braziliei prezintă salutul său Ambasadei Republicii Moldova şi are onoarea de a aduce la cunoştinţă că Guvernul Republicii Federative a Braziliei, în scopul facilitării călătoriilor resortisanţilor ambelor ţări, susţine propunerea de a încheia un Acord cu Guvernul Republicii Moldova privind Abolirea Parţială a Regimului de Vize.
2. În acest context, Guvernul Braziliei prezintă o contrapropunere la ceea ce a primit prin nota nr.0386 din 18 martie 2005:
“1) Resortisanţii uneia dintre Părţi, titulari ai paşapoartelor diplomatice, oficiale sau de serviciu valabile, vor intra, tranzita şi ieşi de pe teritoriul statului celeilalte Părţi, fără viză, pentru o perioadă care să nu depăşească 90 (nouăzeci) de zile.
2) Prelungirea perioadei de şedere se acordă de către autorităţile competente ale ţării gazdă în baza unei cereri în formă scrisă din partea Misiunii Diplomatice sau a Oficiului Consular ale Statului acreditat.
3) Resortisanţii uneia dintre Părţi, titulari ai paşapoartelor diplomatice, oficiale sau de serviciu valabile, care sunt membri ai unei misiuni diplomatice, oficiu consular sau reprezentanţi oficiali ai organizaţiilor internaţionale, precum şi membrii lor de familie, care locuiesc cu ei pe teritoriul Statului celeilalte Părţi şi sunt titulari ai paşapoartelor diplomatice, oficiale sau de serviciu valabile, pot intra, rămîne şi ieşi de pe teritoriul Statului celeilalte Părţi fără viză pe perioada numirii lor.
4) Resortisanţii Părţilor vor respecta legile şi reglementările în vigoare, pe parcursul şederii lor pe teritoriul Statului gazdă.
5) Părţile se vor informa reciproc despre orice modificări ale legilor şi reglementărilor corespunzătoare privind intrarea, ieşirea, tranzitarea sau şederea străinilor.
6) Prezentul Acord nu limitează dreptul fiecărei Părţi de a refuza intrarea sau de a reduce şederea resortisanţilor celeilalte Părţi consideraţi nedoriţi.
7) Părţile, prin canale diplomatice, vor face schimbul specimenelor paşapoartelor diplomatice, oficiale şi de serviciu valabile, menţionate în prezentul Acord, cel puţin după 30 (treizeci) de zile de la data semnării prezentului Acord.
8) În cazul introducerii unor noi paşapoarte diplomatice, oficiale, de serviciu sau modificarea celor existente, Părţile vor transmite reciproc prin canale diplomatice, specimenele acestor paşapoarte, nu mai tîrziu de 30 (treizeci) de zile pînă la punerea în aplicare a acestora.
9) Fiecare dintre Părţi poate oricînd denunţa prezentul Acord prin canale diplomatice. Denunţarea va intra în vigoare după 90 (nouăzeci) de zile de la primirea notificării."
3. Dacă aceste condiţii sunt acceptabile de către Guvernul Republicii Moldova, Guvernul Braziliei are onoarea să propună ca prezenta Notă şi răspunsul Guvernului Moldovei să constituie un Acord între Guvernele noastre şi să intre în vigoare după 30 (treizeci) de zile de la data primirii celei de-a doua Note diplomatice în care Părţile se notifică reciproc despre îndeplinirea procedurilor legale naţionale necesare pentru intrarea în vigoare a prezentului Acord.
Ambasada Braziliei foloseşte acest prilej pentru a reînnoi Ambasadei Republicii Moldova asigurarea înaltei sale consideraţii.

Ministerul Afacerilor Externe şi Integrării Europene al Republicii Moldova prezintă salutul său Ambasadei Republicii Federative a Braziliei în Ucraina şi are onoarea de a comunica recepţionarea Notei Ambasadei nr.113/2005 din 15 noiembrie 2005, cu următorul conţinut:

Ministerul a examinat Nota sus-menţionată a Ambasadei Republicii Federative a Braziliei în Ucraina şi are onoarea de a informa că a fost acceptată în totalitate.
În acest context, Ministerul consideră Nota nr.113/2005 din 15 noiembrie 2005 a Ambasadei Republicii Federative a Braziliei în Ucraina şi prezenta Notă de răspuns, drept Acordul între Guvernul Republicii Moldova şi Guvernul Republicii Federative a Braziliei privind Abolirea Parţială a Regimului de Vize care va intra în vigoare după 30 (treizeci) de zile de la data primirii celei de-a doua Note diplomatice prin care Părţile se informează reciproc despre îndeplinirea procedurilor legale naţionale necesare pentru intrarea în vigoare a prezentului Acord.
Ministerul Afacerilor Externe şi Integrării Europene al Republicii Moldova foloseşte acest prilej pentru a reînnoi Ambasadei Republicii Federative a Braziliei în Ucraina asigurarea înaltei sale consideraţii.

AGREEMENT
with the Government of the Republic of Moldova and the Federative
Republic of Brazil on Partial Abolition of Visa Requirements
No. 113/2005
1. The Embassy of the Federative Republic of Brazil presents its compliments to the Embassy of the Republic of Moldova and has the honor to inform that the Government of the Federative Republic of Brazil, with a view to facilitating travels by nationals of both countries, welcomes the proposal to conclude an Agreement with the Government of the Republic of Moldova on Partial Abolition of Visa Requirements.
2. In this context, the Brazilian Government presents a counter-proposal to that received through Note No. 0386, dated March 18 th , 2005:
"1) Nationals of either Party, holders of a valid diplomatic, official or service passport, shall enter, transit through and leave the territory of the State of the other Party, without a visa, for a period not exceeding 90 (ninety) days.
2) Extension of the period of stay shall be granted by the competent authorities of the host country on the basis of written request by the Diplomatic Mission or Consular Post of the accredited State.
3) Nationals of either Party, holders of a valid diplomatic, official or service passport, who are members of diplomatic mission, consular post or official representatives of international organizations, as well as their family members who live with them in the territory of the State of the other Party and are holders of a valid diplomatic, official or service passport, may enter, stay and leave the territory of the State of the other Party without a visa during the period of their assignment.
4) Nationals of either Party shall comply with the laws and regulations in force, during their stay in the territory of the hosting State.
5) The Parties shall inform each other of any changes in their respective laws and regulations concerning entry, exit, transit and stay of foreigners.
6) This Agreement does not curtail the right of either Party to deny entry or shorten stay of nationals of the other Party considered undesirable.
7) The Parties shall exchange, through diplomatic channels, specimens of their valid diplomatic, official and service passports, mentioned in this Agreement, at least 30 (thirty) days after the date of signature of this Agreement.
8) In case of introduction of new diplomatic, official or service passports or modification of the existing ones, the Parties shall convey to each other, through diplomatic channels, specimens of these passports, not later than 30 (thirty) days prior to its application.
9) Each of the Parties may at any time denounce this Agreement through diplomatic channels. The denunciation will be effective 90 (ninety) days after the receipt of the notification."
3. If these arrangements are acceptable to the Government of the Republic of Moldova, the Brazilian Government has the honor to propose that the present Note and the reply of the Government of Moldova constitute an Agreement between our two Governments and shall enter into effect 30 (thirty) days from the date of the receipt of the second diplomatic Note in which the Parties inform each other that the national legal requirements for entry into force of this Agreement have been met.
The Embassy of Brazil avails itself of this opportunity to renew to the Embassy of the Republic of Moldova the assurances of its highest considerations.

The Ministry has examined the above-mentioned Note of the Embassy of the Federative Republic of Brazil in Ukraine and has the honor to inform that it has been fully accepted.
In this context, the Ministry considers the Note No.113/2005 from 15 November 2005 of the Embassy of the Federative Republic of Brazil in Ukraine and the present Note of reply as constituting the Agreement between the Government of the Republic of Moldova and the Government of the Federative Republic of Brazil on Partial Abolition of Visa Requirements that shall enter into effect 30 (thirty) days from the date of the receipt of the second diplomatic Note in which the Parties inform each other that the national legal requirements for entry into force of this Agreement have been met.
The Ministry of Foreign Affairs and European Integration of the Republic of Moldova avails itself of this opportunity to renew to the Embassy of the Federative Republic of Brazil in Ukraine the assurances of its highest consideration.
