ACORD

Privind privilegiile şi imunităţile Agenţiei Internaţionale

pentru Energie Atomică

Considerând, că conform articolului XV.C al Statutului Agenţiei Internaţionale pentru Energia Atomică, capacitatea juridică, privilegiile şi imunităţile indicate în articolul menţionat vor fi definite într-un alt acord sau acorduri separate între Agenţie, reprezentată în acest scop de către Directorul general, care acţionează conform indicaţiilor Consiliului Guvernatorilor, şi Membrii săi;

considerând, că un Acord ce reglementează relaţiile dintre Agenţie şi Organizaţia Naţiunilor Unite a fost adoptat în conformitate cu articolul XVI al Statutului; şi

considerând, că Asambleea Generală a Organizaţiei Naţiunilor Unite, intenţionând unificarea posibilă a privilegiilor şi imunităţilor, de care beneficiază Organizaţia Naţiunilor Unite şi diferite instituţii specializate care au intrat în relaţii cu Naţiunile Unite, a adoptat Convenţia privind Privilegiile şi Imunităţile Agenţiilor Specializate, de asemenea faptul, că un număr de Membri ai Organizaţiei Naţiunilor Unite au aderat la această Convenţie.

CONSILIUL GUVERNATORILOR

1. A ADOPTAT, neaplicând obligaţiuni faţă de Guvernele reprezentate în Consiliu, textul ce urmează, care în general este întocmit, în conformitate cu Convenţia despre Privilegiile şi Imunităţile Agenţiilor Specializate, şi

2. INVITĂ Membrii Agenţiei să examineze prezentul Acord şi să-l adopte dacă îl vor considera acceptabil pentru ei.

Articolul I

Definiţii

Secţiunea 1. În prezentul Acord:

I. Expresia “Agenţia” înseamnă Agenţia Internaţională pentru Energie Atomică;

II. În scopul Articolului III cuvintele “proprietatea şi activele” include de asemenea proprietatea şi fondurile, ce se află în custodia Agenţiei sau sunt administrate de Agenţie in timpul îndeplinirii funcţiilor prevăzute in statutul său;

III. În articolele V şi VIII expresia “reprezentanţii Membrilor” include toţi Guvernatorii, reprezentanţii, locţiitorii, consilierii, experţii tehnici şi secretarii delegaţiilor;

IV. În Secţiunile 12, 13, 14 şi 27, expresia “şedinţele convocate de către Agenţie” înseamnă şedinţele:

1. Conferinţei Generale a Agenţiei şi a Consiliului Guvernatorilor Agenţiei;

2. oricăror conferinţe internaţionale, simpozioanelor, seminarelor sau grupurilor de experţi, convocaţi de Agenţie; şi

3. oricăror comitete create de către unul dintre organele nominalizate.

V. În scopul articolelor VI şi IX expresia “persoanele oficiale ale Agenţiei" includ Directorul General şi tot personalul Agenţiei, cu excepţia persoanelor, angajate de pe loc şi care primesc salariu pe oră.

Articolul II

Persoana juridică

Secţiunea 2. Agenţia posedă statut de persoană juridică. Ea dispune de capacitate folosinţă de: a) încheiere a contractelor, b) procurare şi dispunere de bunurile imobile şi mobile şi c) intentare a acţiunilor în justiţie.

Articolul III

Proprietatea, fondurile şi activele

Secţiunea 3. Agenţia, proprietatea şi activele sale, oriunde şi în dispoziţia cui nu s-ar afla, se bucură de imunitate în privinţa oricărei forme de procedură judiciară, cu excepţia cazului când ea refuză de la imunitate într-un caz particular. Totodată, se subînţelege că nici un refuz de la imunitate nu se referă la măsurile de executare.

Secţiunea 4. Încăperile Agenţiei sunt inviolabile. Bunurile şi activele Agenţiei, indiferent de faptul unde şi la dispoziţia cui nu s-ar afla, dispun de imunitate în privinţa percheziţiei, rechiziţiei, confiscării, exproprierii, şi oricăror alte forme de implicare atât prin intermediul acţiunilor de executare, administrative şi judiciare, cât şi prin intermediul acţiunilor legale.

Secţiunea 5. Arhivele Agenţiei şi în general toate documentele ce-i aparţin sau le deţine, se bucură de inviolabilitate oriunde nu s-ar afla.

Secţiunea 6. Nefiind limitată prin control financiar, prin reguli sau prin moratoriu de orice fel:

a. Agenţia poate dispune de fonduri, aur sau valută de orice gen şi poate gestiona conturi în orice valută;

b. Agenţia poate transfera liber fondurile sale, aurul sau valuta, dintr-o ţară în alta, sau în cadrul oricărei ţări, şi poate converta orice valută deţinută de ea în oricare altă valută.

Secţiunea 7. În exercitarea drepturilor prevăzute în secţiunea 6, Agenţia trebuie să ia în consideraţie orice propuneri făcute de Guvernul oricărui Stat-parte la prezentul Acord, în măsura în care se consideră, că asemenea propuneri pot fi satisfăcute fără careva daune pentru interesele Agenţiei.

Secţiunea 8. Agenţia, activele ei, veniturile şi altă avere vor fi:

a. scutite de toate taxele directe; se subînţelege, totuşi, că Agenţia nu va cere scutirea de taxele care nu sunt altceva decât achitări pentru serviciile comunale;

b. scutite de taxele vamale, interdicţiile de import şi export şi de orice limitări la importul de către Agenţie a obiectelor pentru folosire în scop de serviciu, se subînţelege totuşi, că obiectele, importate cu aceste scutiri nu vor fi realizate în ţara în care ele sunt importate, cu excepţia condiţiilor convenite cu Guvernul acelei ţări;

c. scutite de taxele vamale şi restricţii şi limitări la importul şi exportul publicaţiilor sale.

Secţiunea 9. Deşi Agenţia de regulă nu va cere scutirea de plăţile şi impozitele ce se includ în preţul de cost la comercializarea bunurilor mobile şi imobile, totuşi în cazurile în care Agenţia cumpără pentru scopuri oficiale un număr impunător de bunuri, supuse sau care trebuie supuse unor asemenea plăţi şi impozite, Statele părţi ale prezentului Acord vor aplica în caz de posibilitate, măsurile administrative corespunzătoare pentru scutirea de plata plăţilor şi impozitelor sau pentru returnarea celor achitate.

Articolul IV

Facilităţi privind mijloacele de comunicare

Secţiunea 10. Agenţia se va bucura, în teritoriul oricărui Stat parte la prezentul Acord, şi în măsura în care poate fi compatibil cu oricare convenţii internaţionale, regulamente, obligaţiuni, la care acel stat este parte, pentru comunicările sale oficiale, de tratament nu mai puţin favorabil decât cel acordat de către Guvernul acestui Stat oricărui alt Guvern, inclusiv misiunilor diplomatice al acestuia din urmă, în privinţa priorităţilor, ratelor şi taxelor pentru poştă şi telecomunicaţii, şi ratelor impuse pentru informarea în presă şi a radioului.

Secţiunea 11. Corespondenţa şi alte comunicări oficiale ale Agenţiei nu sunt supuse cenzurii.

Agenţia are dreptul să se folosească de cifru şi să primească şi să expedieze corespondenţă şi alte informaţii oficiale prin intermediul curierilor sau valizelor sigilate, faţă de care se aplică aceleaşi imunităţi şi privilegii care se aplică faţă de curierii şi valizele diplomatice.

Nimic în această secţiune nu va afecta adoptarea măsurilor corespunzătoare de precauţie ce vor fi determinate în acordul dintre Statul parte la prezentul Acord şi Agenţie.

Articolul V

Reprezentanţii Membrilor

Secţiunea 12. Reprezentanţii Membrilor, care participă la şedinţele convocate de Agenţie, în timpul îndeplinirii obligaţiilor sale şi în timpul călătoriei spre locul petrecerii şedinţelor şi înapoi se bucură de următoarele privilegii şi imunităţi:

a. Imunitate în privinţa arestului personal sau detenţie şi în privinţa arestului bagajelor personale, şi de asemenea în privinţa celor spuse, scrise sau îndeplinite de către ei în timpul îndeplinirii obligaţiilor sale în calitate de persoane oficiale, imunitate în privinţa proceselor judiciare de orice fel;

b. Inviolabilitatea tuturor actelor şi documentelor;

c. Dreptul de a se folosi de cifru şi de a primi acte şi corespondenţă prin intermediul curierilor sau valizelor sigilate;

d. Excluderea lor personală şi a soţilor de la restricţiile de imigrare, de înregistrare a străinilor, de la serviciul militar obligatoriu în Statele pe care le vizitează sau prin care se află în trecere îndeplinind funcţiile sale;

e. De aceleaşi înlesniri în privinţa valutei sau restricţiilor de schimb valutar, care se aplică reprezentanţilor statelor străine ce se află în misiuni oficiale temporare;

f. De aceleaşi imunităţi şi înlesniri în privinţa bagajelor personale, care se acordă reprezentanţilor diplomatici de rangul respectiv.

Secţiunea 13. Pentru asigurarea libertăţii depline a cuvântului şi a independenţei depline, în îndeplinirea obligaţiilor sale, reprezentanţilor Agenţiei, care participă în şedinţele convocate de aceasta, se acordă imunitate procesual-judiciară în privinţa celor spuse sau scrise de către ei, şi de asemenea în privinţa tuturor acţiunilor îndeplinite în timpul îndeplinirii obligaţiilor sale, chiar şi după momentul în care acestea încetează îndeplinirea acestor obligaţii.

Secţiunea 14. În cazul când aplicarea unor forme de impozitare depinde de locuirea în ţara dată, perioadele în care, reprezentanţii Membrilor Agenţiei, care participă la şedinţele convocate de Agenţie, se află în limita hotarelor unui Stat Membru pentru îndeplinirea obligaţiilor sale, nu se consideră drept perioade de locuire în această ţară.

Secţiunea 15. Privilegiile şi imunităţile se acordă reprezentanţilor Agenţiei nu pentru beneficii proprii, sau pentru individ personal, dar pentru asigurarea îndeplinirii in mod independent a funcţiilor sale, legate de activitatea Agenţiei. De aceea, un Membru, nu numai că are dreptul, dar şi este obligat să refuze de la imunitatea reprezentanţilor săi în orice caz când, în opinia Membrului, imunitatea va împiedica săvârşirii justiţiei şi când imunitatea poate fi retrasă fără careva daune scopului pentru care imunitatea a fost acordată.

Secţiunea 16. Prevederile titlurilor 12, 13 şi 14 nu se aplică în privinţa autorităţilor statului, al cărui cetăţean este această persoană sau reprezentant al căruia este sau a fost.

Articolul VI

Persoanele oficiale

Secţiunea 17. Agenţia periodic va aduce la cunoştinţa Guvernelor statelor părţi ale prezentului Acord numele persoanelor oficiale în privinţa cărora se vor aplica prevederile prezentului Articol şi a Articolului IX.

Secţiunea 18.

a) Persoanele oficiale ale Agenţiei:

I. Dispun de imunitate în privinţa procedurii judiciare în privinţa celor spuse sau scrise şi celor săvârşite de ei în calitate de persoane oficiale;

II. Se bucură de aceleaşi excepţii de la impozitarea salariului şi a recompenselor achitate de către Agenţie şi în aceleaşi condiţii, care sunt acordate persoanelor în funcţie a Organizaţiei Naţiunilor Unite;

III. Sunt scutiţi împreună cu soţii şi rudele, aflate la întreţinerea sa de la restricţiile de imigrare şi de înregistrare a străinilor;

IV. Se bucură de aceleaşi privilegii în privinţa schimbului, care se acordă persoanelor în funcţie de rangul respectiv ce fac parte din componenţa misiunilor diplomatice;

V. Se bucură, împreună cu soţii şi rudele ce se află la întreţinere, de aceleaşi privilegii de repatriere în timpul crizelor internaţionale, de care se bucură persoanele de rangul respectiv, al misiunilor diplomatice;

VI. Se bucură de dreptul de a importa, fără careva taxe, mobila şi bunurile la momentul intrării pentru prima oară în funcţie în ţara respectivă.

b) persoanele oficiale ale Agenţiei, care îndeplinesc funcţiile de inspectori în conformitate cu Articolul XII al Statutului Agenţiei sau obligaţiile de examinare a proiectelor în conformitate cu Articolul XI al Statutului şi care călătoresc în calitate de persoane oficiale către locul şi de la locul îndeplinirii funcţiilor sale, se bucură de privilegiile şi imunităţile suplimentare prevăzute la Articolul VII al prezentului Acord, în măsura în care este necesar pentru îndeplinirea eficientă a unor asemenea funcţii.

Secţiunea 19. Persoanele oficiale ale Agenţiei sunt scutite de serviciul militar obligatoriu cu condiţia că în privinţa statelor, cetăţeni ai cărora ei sunt, de asemenea scutiri se folosesc numai persoanele oficiale ale Agenţiei, numele cărora în virtutea funcţiilor îndeplinite, sunt introduse în lista, întocmită de Directorul General al Agenţiei şi care este aprobată de către Statul respectiv.

În cazul recrutării altor persoane oficiale ale Agenţiei pentru îndeplinirea serviciului militar obligatoriu, statul respectiv, la solicitarea Agenţiei, acordă în privinţa acestor persoane oficiale amînare pe durata necesară pentru evitarea întreruperilor în activitatea lor.

Secţiunea 20. Suplimentar privilegiilor şi imunităţilor specificate în secţiunea 18 şi 19 de mai sus, Directorul General al Agenţiei, inclusiv orice persoană oficială ce îndeplineşte obligaţiile lui în perioada absenţei, se bucură în privinţa sa, a soţiilor şi copiilor minori, de privilegii şi imunităţi acordate conform dreptului internaţional reprezentanţilor diplomatici. Aceleaşi privilegii şi imunităţi, excepţii şi înlesniri vor fi acordate de asemenea, adjunctului Directorului General sau persoanei oficiale de rang echivalent al Agenţiei.

Secţiunea 21. Privilegiile şi imunităţile se acordă persoanelor oficiale numai în interesul Agenţiei şi nu pentru beneficiul personal. Agenţia are dreptul şi este obligată să retragă imunităţile acordate oricărei persoane oficiale, în orice cazuri când în opinia sa, imunitatea împiedică săvârşirii justiţiei şi când retragerea imunităţii poate fi efectuată fără prejudicii pentru interesele Agenţiei.

Secţiunea 22. Agenţia colaborează permanent cu autorităţile respective ale Statelor Membre în scopul facilitării înfăptuirii justiţiei, asigurării îndeplinirii reglementărilor poliţiei şi preîntâmpinării apariţiei oricăror abuzuri în legătură cu privilegiile, imunităţile şi înlesnirile, menţionate în prezentul Articol.

Articolul VII

Experţi în Misiunile Agenţiei

Secţiunea 23. Experţilor (alţii decât persoanele oficiale, prevăzute în scopul Articolului VI), care activează în comitetele Agenţiei sau care se află în misiuni din numele Agenţiei, inclusiv în calitate de inspectori conform Articolului XII al Statutului Agenţiei şi în calitate de experţi pentru studierea proiectelor conform Articolului XI, se acordă următoarele privilegii şi imunităţi, în măsura în care aceasta este necesar pentru îndeplinirea eficientă a obligaţiilor sale, inclusiv timpul petrecut în deplasările legate de lucrul în comitetele menţionate sau in misiuni:

a. Imunitate în privinţa arestului sau reţinerii personale şi în privinţa confiscării bagajului personal;

b. Imunitate judiciar-procesuală în privinţa celor spuse, scrise sau săvârşite în timpul îndeplinirii funcţiilor sale oficiale, imunitate în privinţa oricăror procese legale, totodată această imunitate se păstrează indiferent de faptul dacă aceste persoane încetează sau nu să îndeplinească obligaţiile sale în comitete sau în vremea misiunilor din numele Agenţiei;

c. Inviolabilitatea tuturor actelor şi documentelor;

d. În scopul comunicării lor cu Agenţia, dispun de dreptul de a se folosi de cifru şi să primească acte sau corespondenţă prin intermediul curierilor sau valizelor sigilate;

e. De aceleaşi înlesniri în privinţa valutei şi restricţiilor de schimb, care se acordă reprezentanţilor Guvernelor străine, ce se află în deplasări de serviciu temporare;

f. De aceleaşi înlesniri în privinţa valutei şi restricţiilor de schimb, care se acordă reprezentanţilor diplomatici de rangul respectiv.

Secţiunea 24. Prevederile ce se conţin în subparagrafele c) şi d) ale secţiunii 23, în nici o măsură nu împiedica adoptarea măsurilor respective de securitate, prevăzute în acordul dintre Statul parte la prezentul Acord şi Agenţie.

Secţiunea 25. Privilegiile şi imunităţile se acordă experţilor Agenţiei în interesul Agenţiei, dar nu pentru beneficiul propriu al persoanelor. Agenţia are dreptul şi este obligată de a retrage imunitatea acordată oricărui expert în orice caz când, în opinia Agenţiei, această imunitate va afecta săvârşirea justiţiei şi dacă acest lucru poate fi efectuat fără careva daune intereselor Agenţiei.

Articolul VIII

Abuzuri în folosirea privilegiilor

Secţiunea 26. În cazul în care un oarecare Stat parte la prezentul Acord consideră că a avut loc un abuz în folosirea privilegiilor şi imunităţilor, acordate de prezentul Acord, între acest stat şi Agenţie se vor petrece consultări pentru a stabili dacă a avut loc un asemenea abuz, şi în caz că e aşa, atunci se vor căuta posibilităţi pentru a preveni repetarea unor asemenea abuzuri. Dacă asemenea consultări nu sau soldat cu un rezultat satisfăcător pentru acest Stat şi Agenţie, întrebarea dacă a avut loc un abuz de privilegii şi imunităţi, se soluţionează în conformitate cu procedura prevăzută la secţiunea 34. În cazul stabilirii abuzului, Statul parte la prezentul Acord, interesele căruia sunt afectate prin abuzul respectiv, are dreptul, după înştiinţarea Agenţiei despre aceasta, să refuze beneficiile privilegiilor sau imunităţilor care constituie obiectul abuzului. Totodată, refuzul de a acorda privilegii şi imunităţi nu trebuie să servească drept obstacol în calea exercitării activităţii de bază a Agenţiei sau să împiedice Agenţia de a îndeplini funcţiile sale de bază.

Secţiunea 27. Reprezentanţii Membrilor, care participă la şedinţele convocate de Agenţie, în îndeplinirea funcţiilor sale şi în timpul călătoriei către locul petrecerii şedinţelor şi întoarcerii în ţările sale, de asemenea persoanele în funcţie prevăzute la secţiunea 1(V), nu pot fi expulzate la cererea autorităţilor teritoriale a ţării, în care ei îşi îndeplinesc obligaţiile sale, din cauza unor anumite activităţi, efectuate în exercitarea funcţiilor de serviciu. Totuşi, în cazul abuzului din partea unor asemenea persoane în folosirea privilegiilor în legătură cu locuirea în ţara dată prin acţiunile în această ţară, care nu intră în obligaţiile de serviciu, Guvernul poate cere expulzarea acestor persoane din ţară, cu condiţia că:

a. reprezentanţii Membrilor, sau persoanele ce se bucură de imunităţile prevăzute în secţiunea 20, se expulzează numai în conformitate cu procedurile diplomatice, aplicate reprezentanţilor diplomatici, acreditaţi în această ţară;

b. ordinul de expulzare a persoanelor oficiale, faţă de care prevederile secţiunii 20 nu se aplică, este emis de către autorităţile teritoriale numai după aprobarea de către Ministrul Afacerilor Externe al acestei ţări, iar această aprobare se efectuează numai după consultarea cu Directorul General al Agenţiei; şi, când expulzarea este aplicată unei asemenea persoane oficiale. Directorul General al Agenţiei are dreptul de a reprezenta această persoană.

Articolul IX

Permise

Secţiunea 28. Persoanelor oficiale ale Agenţiei li se acordă dreptul de a se folosi de permisele Organizaţiei Naţiunilor Unite în conformitate cu acordurile administrative, încheiate între Directorul General al Agenţiei şi Secretarul General al Organizaţiei Naţiunilor Unite. Directorul General al Agenţiei înştiinţează fiecare Stat parte la prezentul Acord despre acordurile administrative încheiate.

Secţiunea 29. Statele părţi la prezentul Acord recunosc şi acceptă permisele Organizaţiei Naţiunilor Unite, eliberate persoanelor în funcţie ale Agenţiei, drept acte legale pentru călătorie.

Secţiunea 30. Cererile de acordare a vizelor, când este prevăzut, a persoanelor oficiale ale Agenţiei, care deţin permisele Organizaţiei Naţiunilor Unite, însoţite de adeverinţe că aceste persoane călătoresc în legătură cu activitatea Agenţiei, sunt examinate în regim de urgenţă. în afară de aceasta, acestor persoane trebuie să fie asigurate condiţii privilegiate pentru călătorie în mod de urgenţă.

Secţiunea 31. Aceleaşi facilităţi, prevăzute la Secţiunea 30, trebuie să fie acordate experţilor şi altor persoane, care nu dispun de permisele Organizaţiei Naţiunilor Unite, dar care au confirmare că călătoresc în legătură cu activitatea Agenţiei.

Secţiunea 32. Directorul General, Locţiitorii Directorului General şi alte persoane oficiale, care au rangul nu mai mic de şef secţie al Agenţiei, care călătoresc cu legitimaţiile Organizaţiei Naţiunilor Unite în legătură cu activitatea Agenţiei, se bucură de aceleaşi privilegii în timpul călătoriilor, care se acordă reprezentanţilor diplomatici de rangul respectiv.

Articolul X

Soluţionarea disputelor

Secţiunea 33. Agenţia stabileşte prevederi pentru modalităţi de soluţionare a:

a. Disputelor, ce reies din contracte, sau alte dispute cu caracter particular, la care Agenţia este parte.

b. Disputelor, care se referă la vre-o oarecare persoană oficială sau oarecare expert al Agenţiei, care în virtutea poziţiei sale oficiale se bucură de imunitate, dacă nu există refuz la această imunitate în conformitate cu prevederile secţiunilor 21 şi 25.

Secţiunea 34. Dacă părţile nu au convenit asupra altor modalităţi de soluţionare, atunci toate disputele, ce apar la interpretarea sau aplicarea prezentului Acord, sunt îndreptate Curţii Internaţionale de Justiţie, în conformitate cu Statutul Curţii. Dacă divergenţele au apărut între Agenţie şi un Membru, şi părţile nu au ajuns la un oarecare alt mod de soluţionare, atunci o concluzie consultativă pe oricare chestiune juridică legată de această dispută va fi cerută în conformitate cu Articolul 96 al Statutului Organizaţiei Naţiunilor Unite şi articolului 65 al Statutului Curţii şi cu prevederile respective ale Acordului, încheiat între Organizaţia Naţiunilor Unite şi Agenţie. Concluzia Curţii este recunoscută de către părţi drept definitivă.

Articolul XI

Interpretarea

Secţiunea 35. Prevederile prezentului Acord se vor interpreta în lumina funcţiilor care sunt atribuite Agenţiei prin Statut.

Secţiunea 36. Prevederile prezentului Acord în nici un fel nu limitează sau nu prejudiciază privilegiile şi imunităţile care sunt acordate sau pot fi acordate Agenţiei de către un oarecare Stat, în legătură cu aflarea pe teritoriul acestui Stat a Cartierului General al Agenţiei, sau oficiilor regionale, sau persoanelor oficiale, experţilor, materialelor, utilajului şi a mijloacelor tehnice în legătură cu proiectele sau activităţile Agenţiei, incluzând aplicarea garanţiilor în proiectele Agenţiei sau alte măsuri. Prezentul Acord nu împiedică încheierea unor Acorduri suplimentare între Agenţie şi Statele părţi la prezentul Acord, care ajustează prevederile prezentului Acord, sau extind, sau limitează imunităţile şi privilegiile acordate.

Secţiunea 37. Prezentul Acord se aplică în aşa mod ca să nu minimizeze sau anuleze oricăror prevederi din Statutul Agenţiei sau a oricăror drepturi şi obligaţiuni, pe care Agenţia le poate avea, obţine sau asuma.

Articolul XII

Dispoziţii finale

Secţiunea 38. Prezentul Acord se comunică tuturor Membrilor Agenţiei pentru acceptare. Acceptarea va intra în vigoare la data transmiterii spre depozitare Directorului general a documentului de acceptare şi va intra în vigoare în privinţa oricărui Membru la data depozitării documentului de acceptare. Se subînţelege, că Statul, din numele căruia se depozitează documentul de acceptare, va fi în stare în baza legislaţiei proprii să pună în vigoare prevederile prezentului Acord. Directorul General transmite copia certificată a prezentului Acord Guvernului fiecărui Stat, care este sau ulterior va deveni Membru al Agenţiei, şi va informa toţi Membrii despre fiecare transmitere a unui asemenea document de acceptare sau despre primirea oricărei notificări despre denunţarea, prevăzută la Secţiunea 39.

Membrul poate formula rezerve la prezentul Acord. Rezervele pot fi formulate numai în timpul depozitării de către Membru a instrumentului despre acceptare, şi vor fi comunicate imediat de către Directorul general tuturor Membrilor Agenţiei.

Secţiunea 39. Prezentul Acord rămâne în vigoare în privinţa Agenţiei şi fiecărui Membru, care a depozitat instrumentul de acceptare, atât timp, cât acest Membru va rămâne Membru al Agenţiei, sau, până când Consiliul Guvernatorilor nu va aproba Acordul revizuit, şi acest Membru nu va deveni parte la Acordul revizuit, cu condiţia, că, dacă Membrul va îndrepta notificarea despre denunţare Directorului General, prezentul Acord va rămâne în vigoare pentru acest Membru pe parcursul unui an de la primirea de către Directorul General a unei asemenea notificări.

Secţiunea 40. La cererea unei treimi din numărul Statelor părţi la prezentul Acord, Consiliul Guvernatorilor Agenţiei va considera necesitatea introducerii Amendamentelor. Amendamentele, aprobate de către Consiliu, vor intra în vigoare după acceptarea lor în conformitate cu procedura prevăzută în secţiunea 38.

AGREEMENT

on the Privileges and Immunities of the International

Atomic Energy Agency

Vienna, july 1,1959

Whereas Article XV.C of the Statute of the International Atomic Energy Agency provides that the legal capacity, privileges and immunities referred to in that Article shall be defined in a separate agreement or agreements between the Agency, represented for this purpose by the Director General acting under the instructions of the Board of Governors, and the Members;

whereas an Agreement Governing the Relationship between the Agency and the United Nations has been adopted in accordance with Article XVI of the Statute; and

whereas the General Assembly of the United Nations, contemplating the unification as far as possible of the privileges and immunities enjoyed by the United Nations and by the various agencies brought into relationship with the United Nations, has adopted the Convention on the Privileges and Immunities of the Specialized Agencies, and a number of Members of the United Nations have acceded thereto.

THE BOARD OF GOVERNORS

1. HAS APPROVED, without committing the Governments represented on the Board, the text below, which in general follows the Convention on the Privileges and Immunities of the Specialized Agencies; and

2. INVITES the Members of the Agency to consider and, if they see fit, to accept this Agreement.

Article 1

Definitions

Section 1. In this Agreement:

i. The expression "the Agency" means the International Atomic Energy Agency;

ii. For the purposes of Article III, the words "property and assets" shall also include property and funds in the custody of the Agency or administered by the Agency in furtherance of its statutory functions;

iii. For the purposes of Articles V and VIII, the expression "representatives of Members" shall be deemed to include all Governors, representatives, alternates, advisers, technical experts and secretaries of delegations;

iv. In sections 12, 13, 14 and 27, the expression "meetings convened by the Agency" means meetings:

1. of its General Conference and of its Board of Governors;

2. of any international conference, symposium, seminar or panel convened by it; and

3. of any committee of any of these bodies;

v. For the purposes of Articles VI and IX, the expression "officials of the Agency" means the Director General and all members of the staff of the Agency except those who are locally recruited and assigned to hourly rates.

Article 2

Juridical Personality

Section 2. The Agency shall possess juridical personality, it shall have the capacity (a) to contract, (b) to acquire and dispose of immovable and movable property and (c) to institute legal proceedings.

Article 3

Property, Funds and Assets

Section 3. The Agency, its property and assets, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except in so far as in any particular case it has expressly waived its immunity. It is, however, understood that no waiver of immunity shall extended to any measure of execution.

Section 4. The premises of the Agency shall be inviolable. The property and assets of the Agency, wherever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action.

Section 5. The archives of the Agency, and in general all documents belonging to it or held by it, shall be inviolable, wherever located.

Section 6. Without being restricted by financial controls, regulations or moratoria of any kind:

a. The Agency may hold funds, gold or currency of any kind and operate accounts in any currency;

b. The Agency may freely transfer its funds, gold or currency from one country to another or within any country and convert any currency held by it into any other currency.

Section 7. The Agency shall, in exercising its rights under section 6, pay due regard to any representations made by the Government of any State party to this Agreement in so far as it is considered that effect can be given to such representations without detriment to the interests of the Agency.

Section 8. The Agency, its assets, income and other property shall be:

a. Exempt from all direct taxes; it is understood, however, that the Agency will not claim exemption from taxes which are, in fact, no more than charges for public utility services;

b. Exempt from customs duties and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Agency for its official use; it is understood, however, that articles imported under such exemption will not be sold in the country into which they were imported except under conditions agreed to with the Government of that country;

c. Exempt from duties and prohibitions and restrictions on imports and exports in respect of its publications.

Section 9. While the Agency will not, as a general rule, claim exemption from excise duties and from taxes on the sale of movable and immovable property which form part of the price to be paid, nevertheless when the Agency is making important purchases for official use of property on which such duties and taxes have been charged or are chargeable, States parties to this Agreement will, whenever possible, make appropriate administrative arrangements for the remission or return of the amount of duty or tax.

Article 4

Facilities in Respect of Communications

Section 10. The Agency shall enjoy, in the territory of each State party to this Agreement and as far as may be compatible with any international conventions, regulations and arrangements to which that State is a party, for its official communications, treatment not less favourable than that accorded by the Government of such a State to any other Government, including the latter's diplomatic mission, in the matter of priorities, rates and taxes for posts and telecommunications, and press rates for information to the press and radio.

Section 11. No censorship shall be applied to the official correspondence and other official communications of the Agency.

The Agency shall have the right to use codes and to dispatch and receive correspondence and other official communications by courier or in sealed bags, which shall have the same immunities and privileges as diplomatic couriers and bags.

Nothing in this section shall be construed to preclude the adoption of appropriate security precautions to be determined by agreement between a State party to this Agreement and the Agency.

Article 5

Representatives of Members

Section 12. Representatives of Members at meetings convened by the Agency shall, while exercising their functions and during their journeys to and from the place of meeting, enjoy the following privileges and immunities:

a. Immunity from personal arrest or detention and from seizure of their personal baggage, and in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

b. Inviolability for all papers and documents;

c. The right to use codes and to receive papers or correspondence by courier or in sealed bags;

d. Exemption in respect of themselves and their spouses from immigration restrictions, aliens' registration or national service obligations in the State which they are visiting or through which they are passing in the exercise of their functions;

e. The same facilities in respect of currency or exchange restrictions as are accorded to representatives of foreign Governments on temporary official missions;

f. The same immunities and facilities in respect of their personal baggage as are accorded to members of comparable rank of diplomatic missions.

Section 13. In order to secure for the representatives of Members of the Agency at meetings convened by the Agency complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Section 14. Where the incidence of any form of taxation depends upon residence, periods during which the representatives of Members of the Agency at meetings convened by the Agency are present in a Member State for the discharge of their duties shall not be considered as periods of residence.

Section 15. Privileges and immunities are accorded to the representatives of Members, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions in connexion with the Agency. Consequently, a Member not only has the right but is under a duty to waive the immunity of its representatives in any case where, in the opinion of the Member, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose of which the immunity is accorded.

Section 16. The provisions of sections 12, 13 and 14 are not applicable in relation to the authorities of a State of which the person is a national or of which he is or has been a representative.

Article 6

Officials

Section 17. The Agency shall from time to time make known to the Governments of all States parties to this Agreement the names of the officials to whom the provisions of this Article and of Article 9 apply.

Section 18.

a. Officials of the Agency shall:

i. Be immune from legal process in respect of words spoken or written and all acts performed by them in their official capacity;

ii. Enjoy the same exemptions from taxation in respect of the salaries and emoluments paid to them by the Agency and on the same conditions as are enjoyed by officials of the United Nations;

iii. Be immune, together with their spouses and relatives dependent on them, from immigration restrictions and alien registration;

iv. Be accorded the same privileges in respect of exchange facilities as are accorded to officials of comparable rank of diplomatic missions;

v. Be given, together with their spouses and relatives dependent on them, the same repatriation facilities in time of international crises as officials of comparable rank of diplomatic missions;

vi. Have the right to import free of duty their furniture and effects at the time of first taking up their post in the country in question.

b. Officials of the Agency shall, while exercising the functions of an inspector under Article XII of the Statute of the Agency or those of a project examiner under Article XI thereof, and while travelling in their official capacity en route to and from the performance of these functions, enjoy all the additional privileges and immunities set forth in Article VII of this Agreement so far as is necessary for the effective exercise of such functions.

Section 19. The officials of the Agency shall be exempt from national service obligations, provided that, in relation to the States of which they are nationals, such exemption shall be confined to officials of the Agency whose names have, by reason of their duties, been placed upon a list compiled by the Director General of the Agency and approved by the State concerned.

Should other officials of the Agency be called up for national service, the State concerned shall, at the request of the Agency, grant such temporary deferments in the call-up of such officials as may be necessary to avoid interruption in the continuation of essential work.

Section 20. In addition to the privileges and immunities specified in sections 18 and 19 above, the Director General of the Agency, including any official acting on his behalf during his absence from duty, shall be accorded on behalf of himself, his spouse and minor children, the privileges and immunities, exemptions and facilities accorded to diplomatic envoys on behalf of themselves, their spouses and minor children, in accordance with international law. The same privileges and immunities, exemptions and facilities shall also be accorded to a Deputy Director General or official of equivalent rank of the Agency.

Section 21. Privileges and immunities are granted to officials in the interest of the Agency only and not for the personal benefit of the individuals themselves. The Agency shall have the right and the duty to waive the immunity of any official in any case where, in its opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the Agency.

Section 22. The Agency shall co-operate at all times with the appropriate authorities of Member States to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuses in connexion with the privileges, immunities and facilities mentioned in this Article.

Article 7

Experts on Missions for the Agency

Section 23. Experts (other than officials coming within the scope of Article VI) serving on committees of the Agency or performing missions for the Agency, including missions as inspectors under Article XII of the Statute of the Agency and as project examiners under Article XI thereof, shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connexion with service on such committees or missions:

a. Immunity from personal arrest or detention and from seizure of their personal baggage;

b. In respect of words spoken or written or acts done by them in the performance of their official functions, immunity from legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Agency;

c. Inviolability for all papers and documents;

d. For the purposes of their communications with the Agency, the right to use codes and to receive papers or correspondence by courier or in sealed bags;

e. The same facilities in respect of currency and exchange restrictions as are accorded to representatives of foreign Governments on temporary official missions;

f. The same facilities in respect of currency and exchange restrictions as are accorded to members of comparable rank of diplomatic missions.

Section 24. Nothing in sub-paragraphs (c) and (d) of section 23 shall be construed to preclude the adoption of appropriate security precautions to be determined by agreement between a State party to this Agreement by the Agency.

Section 25. Privileges and immunities are granted to the experts of the Agency in the interests of the Agency and not for the personal benefit of the individuals themselves. The Agency shall have the right and duty to waive the immunity of any expert in any case where, in its opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the Agency.

Article 8

Abuses of Privilege

Section 26. If any State party to this Agreement considers that there has been an abuse of a privilege or immunity conferred by this Agreement, consultations shall be held between that State and the Agency to determine whether any such abuse has occurred and, if so, to attempt to ensure that no repetition occurs. If such consultations fail to achieve a result satisfactory to the State and the Agency, the question whether an abuse of a privilege or immunity has occurred shall be settled by a procedure in accordance with section 34. If it is found that such an abuse has occurred, the State party to this Agreement affected by such abuse has the right, after notification to the Agency, to withhold from the Agency the benefits of the privilege or immunity so abused. However, the withholding of privileges or immunities must not interfere with the Agency's principal activities or prevent the Agency from performing its principal functions.

Section 27. Representative of Members at meetings convened by the Agency, while exercising their functions and during their journeys to and from the place of meeting, and officials within the meaning of section l(v), shall not be required by the territorial authorities to leave the country in which they are performing their functions on account of any activities by them in their official capacity. In the case, however, of abuse of privileges of residence committed by any such person in activities in that country outside his official functions, he may be required to leave by the Government of that country, provided that:

a. Representatives of Members, or persons who are entitled to the immunities provided in section 20, shall not be required to leave the country otherwise than in accordance with the diplomatic procedure applicable to diplomatic envoys accredited to that country;

b. In the case of an official to whom section 20 is not applicable, no order to leave the country shall be issued by the territorial authorities other than with the approval of the Foreign Minister of the country in question, and such approval shall be given only after consultation with the Director General of the Agency; and, if expulsion proceedings are taken against an official, the Director General of the Agency shall have the right to appear in such proceedings on behalf of the person against whom they are instituted.

Article 9

Laissez-passer

Section 28. Officials of the Agency shall be entitled to use the United Nations laissez-passer in conformity with administrative arrangements concluded between the Directory General of the Agency and the Secretary General of the United Nations. The Director General of the Agency shall notify each State party to this Agreement of the administrative arrangements so concluded.

Section 29. States parties to this Agreement shall recognize and accept the United Nations laissez-passer issued to officials of the Agency as valid travel documents.

Section 30. Applications for visas, where required, from officials of the Agency holding United Nations laissez-passe, when accompanied by a certificate that they are travelling on the business of the Agency, shall be dealt with as speedily as possible. In addition, such person shall be granted facilities for speedy travel.

Section 31. Similar facilities to those specified in section 30 shall be accorded to experts and other persons who, though not holders of United Nations laissez-passer, have a certificate that they are travelling on the business of the Agency.

Section 32. The Director General, the Deputy Director General and other officials of a rank not lower than head of division of the Agency, travelling on United Nations laissez-passer on the business of the Agency, shall be granted the same facilities for travel as are accorded to officials of comparable rank in diplomatic missions.

Article 10

Settlement of Disputes

Section 33. The Agency shall make provision for appropriate modes of settlement of:

a. Disputes arising out of contracts or other disputes of a private character to which the Agency is a party;

b. Disputes involving any official or expert of the Agency who by reason of his official position enjoys immunity, if immunity has not been waived in accordance with sections 21 or 25.

Section 34. Unless in any case it is agreed by the parties to have recourse to another mode of settlement, all differences arising out of the interpretation or application of the present Agreement shall be referred to the International Court of Justice, in accordance with the Statute of the Court. If a difference arises between the Agency and a Member and they do not agree on any other mode of settlement, a request shall be made for an advisory opinion on any legal question involved, in accordance with Article 96 of the Charter of the United Nations and Article 65 of the Statute of the Court and the relevant provisions of the agreement concluded between the United Nations and the Agency. The opinion given by the Court shall be accepted as decisive by the parties.

Article 11

Interpretation

Section 35. The provisions of this Agreement shall be interpreted in the light of the functions with which the Agency is entrusted by its Statute.

Section 36. The provisions of this Agreement shall in no way limit or prejudice the privileges and immunities which have been, or may hereafter be, accorded to the Agency by any State by reason of the location in the territory of that State of the Agency's Headquarters or regional offices, or of officials, experts, materials, equipment or facilities in connection with Agency projects or activities, including the application of safeguards to an Agency project or other arrangement. This Agreement shall not be deemed to prevent the conclusion between the Agency and any State party thereto of supplemental agreements adjusting the provisions of this Agreement or extending or curtailing the privileges and immunities thereby granted.

Section 37. This Agreement shall not itself operate so as to abrogate, or derogate from, any provisions of the Statute of the Agency or any rights or obligations which the Agency may otherwise have, acquire or assume.

Article 12

Final Provisions

Section 38. This Agreement shall be communicated to every Member of the Agency for acceptance. Acceptance shall be effected by the deposit with the Director General of an instrument of acceptance, and the Agreement shall come into force as regards each Member on the date of deposit of that Member's instrument of acceptance. It is understood that, when an instrument of acceptance is deposited on behalf of any State, that State will be in a position under its own law to give effect to the terms of this Agreement. The Director General shall transmit a certified copy of this Agreement to the Government of every State now or hereafter becoming a Member of the Agency, and shall inform all Members of the deposit of each instrument of acceptance and of the filing of any notification of denunciation provided for in section 39.

It shall be permissable for a Member to make reservations to this Agreement. Reservations may be made only at the time of the deposit of the Member's instrument of acceptance, and shall immediately be communicated by the Director General to all Members of the Agency.

Section 39. This Agreement shall continue in force as between the Agency and every Member which has deposited an instrument of acceptance for so long as that Member remains a Member of the Agency, or until a revised agreement has been approved by the Board of Governors and that Member has become a party to this revised agreement, provided that if a Member files a notification of denunciation with the Director General this Agreement shall cease to be in force with respect to such Member one year after the receipt of such notification by the Director General.

Section 40. At the request of one-third of the States parties to this Agreement, the Board of Governors of the Agency shall consider whether to approve amendments thereto. Amendments approved by the Board shall enter into force upon their acceptance in accordance with the procedure provided in section 38.
