CONDIŢII SPECIALE
Uniunea Europeană, numită în continuare “UE”, reprezentată de către Comisia Europeană. numită în continuare “Comisia”,
de o parte, şi
Guvernul Republicii Moldova, numit în continuare “Beneficiar”,
pe de altă parte,
au convenit după cum urmează:
Următoarele prevederi ale Acordului de Finanţare nr.ENPI/2008/019-655, semnat la 25 februarie 2009, pentru implementarea Programului “Programul de Suport al Politicii Sectoriale de Sănătate” se modifică după cum urmează:
Articolul 1
Articolul 2 se modifică după cum urmează:
2.1 Costul total al programului este estimat la 52,600.000.00 euro, din care 46,600.000,00 de la Programul Anual de Acţiuni Moldova 2008 (ENPI/2008 019-655) şi 6,000.000,00 euro de la ENPI 2012 Condiţii Speciale “EaPIC” Programul (Parteneriatul Estic de Integrare şi Cooperare), (ENPI/2012/024-348).
Programul are următoarele componente:
2.1.1 Suportul bugetar:.............................49,450,000.00 euro
2.1.2 Suportul de asistenţă tehnică:...........3,150,000.00 euro
2.2 Uniunea Europeană se angajează să finanţeze o sumă maximă de 52,600.000.00 euro. Defalcarea contribuţiei financiare a UE în linii bugetare este prezentată în bugetul inclus în Prevederile Tehnice şi Administrative (Anexa II).
Articolul 2
Articolul 4 este înlocuit după cum urmează:
4.1 Perioada de executare a Acordului de Finanţare, după cum prevede Articolul 4 din cadrul Condiţiilor Generale, va demara la data intrării în vigoare a Acordului de Finanţare şi se va finisa după 84 luni de la această dată.
4.2 Durata de implementare a fazei operaţionale este fixată la 60 luni.
4.3 Durata fazei de închidere este fixată la 24 luni.
Articolul 3
Contractele de implementare a Acordului de Finanţare care sunt finanţate de la ENPI 2012 Condiţii Speciale “EaPIC” Programul (Parteneriatul Estic de Integrare şi Cooperare), (ENPI 2012/024-348) urmează a fi semnate de către ambele Părţi în 3 ani de la data intrării în vigoare a prezentului Addendum.
Articolul 4
Versiunea nouă a Anexei II: Prevederi tehnice şi administrative este anexată ia acest Addendum.
Toţi ceilalţi termeni şi condiţii din cadrul Acordului de Finanţare şi anexele sale anterioare rămîn neschimbaţi. Prezentul Addendum va forma o parte integrantă a Acordului de Finanţare şi va intra în vigoare la data semnării de către ultima Parte.
Întocmit în două exemplare originale în limba engleză, o copie fiind transmisă Comisiei şi una Beneficiarului.

1. INTERVENŢIE
1.1 Obiective
Obiective generale
Obiectivul general al Programului de Suport al Politicii Sectoriale este de a intensifica cooperarea între Moldova şi UE în vederea abordării priorităţilor de sănătate din Planul de Acţiuni Moldova-UE şi documentele succesoare acestuia pentru a susţine prioritizarea concretă şi implementarea Strategiei de dezvoltare a sectorului sănătăţii în Moldova pentru 2008-2017, în vederea îmbunătăţirii sănătăţii populaţiei, extinderii accesului şi sporirii eficienţei şi calităţii serviciilor medicale de bază. În conformitate cu principiul “mult pentru mai mult”, acest Program beneficiază de finanţare adiţională în cadrul Programului Parteneriatul Estic de Integrare şi Cooperare (EaPIC), cu scopul promovării avansării durabile şi favorabile şi dezvoltării economice.
Obiective specifice
Obiectivul specific al programului este de a acorda asistenţă Guvernului şi Ministerului Sănătăţii în îmbunătăţirea managementului şi gestionării sistemului de ocrotire a sănătăţii; creşterea finanţării sistemului de ocrotire a sănătăţii şi dezvoltarea mecanismelor de plată pentru serviciile de sănătate; îmbunătăţirea reglementărilor serviciilor de sănătate; îmbunătăţirea managementului resurselor.
1.2 Rezultatele scontate şi activităţile cheie
Rezultatele scontate
Rezultatele şi activităţile programului sunt activităţile şi rezultatele propriei Strategii şi Politici sectoriale ale Guvernului Republicii Moldova. Din motive practice, despre care s-a discutat, sporirea eficienţei, calităţii şi performanţei sectorului de ocrotire a sănătăţii publice, în general urmează să fie realizată prin focusarea pe sistemul de Medicină de familie şi convenirea asupra unor ţinte mai concrete. Asistenţa Tehnică va consta din expertiza tehnică şi sporirea capacităţilor.
Ministerului Sănătăţii i se va asigura un expert pe termen lung în planificarea strategică şi procesul bugetar, precum şi Companiei Naţionale de Asigurări în Medicină (CNAM) şi/sau Ministerului Finanţelor. Expertiza adiţională va susţine sistemul de monitorizare, diseminarea informaţiei şi va efectua revizuirea şi evaluarea Programului de Suport al Politicii Sectoriale.
Rezultatele şi ţintele pentru monitorizarea implementării şi debursării tranşelor sunt în creştere timp de 4 ani şi sunt incluse într-o Matrice de Politici cu titluri din propria Strategie sectorială a Ministerului Sănătăţii, ţinîndu-se cont în acelaşi timp de o agendă mai cuprinzătoare a managementului finanţelor publice şi de gestionare′ publică:
• Gestionare (1): raportare armonizată, comprehensivă pe sector şi repere de coordonare (inclusiv identificarea donatorilor (şi indicatorilor de donatori); repere de performanţă în serviciile cheie (produse) şi domeniul de îmbolnăvire (rezultat);
• Gestionare (2): Disciplina fiscală şi performanţa operaţională (resurse/produse): auditul entităţilor cheie (inclusiv CNAM) şi repere de MFP, scopuri de autonomie a prestatorului de servicii;
• Servicii de o calitate mai înaltă: Ţinte de acces, indicatori de calitate a serviciilor, indicatori de satisfacţie;
• Resurse de infrastructură umană şi fizică: Finalizarea instruirilor în domeniul medicinii de familie şi numărul generaliştilor licenţiaţi; Investiţii eficientizate în infrastructură;
• Stabilizarea şi diversificarea Finanţării: Diversitatea bugetară şi acte legislative;
• S-a creat un sistem de monitorizare, cu implicarea Guvernului relevant şi, în măsura posibilităţii, a instituţiilor neguvernamentale, precum şi a centrelor de cercetare; lecţiile învăţate în procesul de monitorizare sunt utilizate de Guvern pentru a ridica cu timpul nivelul de eficacitate şi eficienţă a strategiei.
2. IMPLEMENTARE
2.1 Bugetul şi graficul debursărilor
Bugetul Programului de Suport al Politicii Sectoriale de 52.6 milioane euro este alocat următoarelor două componente:

Perioada de implementare a programului este de 60 luni. Durata maximă de implementare este stabilită în Condiţiile Speciale din Acordul de Finanţare.
Debursarea tranşelor va fi posibilă doar dacă Moldova aplică indicatorii detaliaţi în Acordul de Finanţare.
Pe parcursul perioadei de implementare se planifică efectuarea a cinci debursări: de 12,000,000, 13,362,650, 13,611,833, 4,139,853 şi 6,000,000 euro (în principiu, o debursare pe an).
2.2 Modalităţi de susţinere bugetară
Gestionarea programului este centralizată, ceea ce înseamnă că procedura de susţinere bugetară este gestionată doar de Comisie.
Fondurile alocate nu vor fi direcţionate, şi vor fi canalizate direct în Contul Unic Trezorerial al Guvernului Republicii Moldova. Odată alocate, fondurile vor fi utilizate ca şi celelalte resurse bugetare ale Guvernului, şi gestionate în conformitate cu legislaţia Moldovei.
Debursarea fondurilor în cadrul acestui program se va efectua în următoarele tranşe:

Transferurile valutare vor fi considerate intrate în conturi la ziua notificării despre creditarea contului deschis la Banca Naţională pentru acest scop. Rata de schimb valutar va fi rata medie pe piaţa valutară interbancară la data notificării despre creditare.
2.3 Monitorizarea performanţei şi criteriile de debursare
2.3.1. Supravegherea Implementării programului
De supravegherea implementării programului va fi responsabil un Comitet de supraveghere condus de ministrul sănătăţii şi a căror membri vor fi reprezentanţi din toate ministerele şi instituţiile implicate în implementarea programului respectiv şi ai reprezentanţelor Comisiei Europene.
Membrii Comitetului de supraveghere sunt:
- Ministrul Sănătăţii, Preşedinte;
- Ministrul Finanţelor, vicepreşedinte;
- Preşedintele Curţii de Conturi;
- Directorul Agenţiei Achiziţii Publice;
- Director general al Companiei Naţionale de Asigurări în Medicină;
- Şef al Direcţiei coordonarea politicilor şi asistenţei externe, Cancelaria de Stat;
- Reprezentanţi ai societăţii civile (organizaţii de pacienţi şi de profesionişti în domeniul sănătăţii);
- Şeful Delegaţiei Uniunii Europene în Moldova sau reprezentantul delegat.
Comitetul de supraveghere se va întruni cel puţin de două ori pe an pentru a analiza progresul înregistrat şi poate să decidă să modifice sau să includă indicatori de performanţă specifici sectorului de sănătate.
Pentru a asigura implementarea adecvată a Programului de Suport al Politicii Sectoriale, Comitetul de supraveghere va asigura îndeplinirea de către Guvernul Republicii Moldova a următoarelor angajamente în perioada de implementare a programului:
1. Implicarea CE în toate discuţiile dintre Guvern şi donatori şi aranjamentele instituţionale privind elaborarea şi implementarea reformei în sectorul de ocrotire a sănătăţii şi Cadrul de Cheltuieli pe Termen Mediu în aspectele ce ţin de sectorul sănătăţii.
2. Ministerul Finanţelor şi toate ministerele şi instituţiile susţinute vor pune la dispoziţia Comisiei Europene următoarea documentaţie privind implementarea Programului de Suport al Politicii Sectoriale:
a. Extrasele de cont pentru conturile bancare menţionate în Secţiunea 2.1 şi 2.2 din Prevederile Tehnice şi Administrative prezente.
b. Declaraţiile privind cheltuielile (Trezoreria) pe sectoare relevante Programului de Suport al Politicii Sectoriale.
c. Rapoarte privind executarea bugetelor instituţiilor implicate (Ministerul Sănătăţii, Compania Naţională de Asigurări în Medicină).
d. Legi, Hotărîri de Guvern, acte legislative şi prevederi administrative, fie în variantă de proiect, fie finală, privind implementarea Programului de Suport al Politicii Sectoriale;
e. Rapoarte şi acorduri cu instituţiile Bretton Woods privind reformele în sectorul de ocrotire a sănătăţii;
f. Documente de politici şi rapoarte elaborate de Guvern şi alţi donatori, fie în variantă de proiect, fie în variantă finală, relevante pentru implementarea Programului de Suport al Politicii Sectoriale.
Înainte de fiecare şedinţă a Comitetului de supraveghere se vor elabora rapoarte de progres, sub responsabilitatea Preşedintelui Comisiei. Rapoartele de progres vor descrie cursul implementării reformei în sectorul de ocrotire a sănătăţii, a reformelor ce ţin de MFP. Acestea vor indica în special la ce nivel de implementare se află activităţile prevăzute în Matricea de politici.
Informaţia necesară pentru elaborarea rapoartelor de monitorizare/progres va fi adunată de la autorităţile responsabile de implementarea reformelor.
Dacă va considera necesar şi pînă ce va exista un mecanism funcţionabil de monitorizare care să satisfacă cerinţele programului, Comisia Europeană ar putea delega anumiţi consultanţi să efectueze o revizuire independentă a unor sau a tuturor indicatorilor de debursare. Imediat ce Guvernul va introduce un mecanism de monitorizare a sectorului de sănătate, acceptabil pentru Comisie, fondurile alocate pentru asistenţa tehnică rămase neutilizate pot fi transferate pentru componenta de susţinere bugetară a programului, iar celelalte tranşe rămase pot creşte proporţional, astfel ca şi sumele debursate să crească proporţional, dacă indicatorii relevanţi sunt respectaţi.
2.3.2. Condiţii generale pentru debursarea tranşelor valutare în cadrul Programului de Suport al Politicii Sectoriale
Debursarea fondurilor valutare în cadrul programului va fi posibilă doar cu respectarea următoarelor condiţii generale:
1. Guvernul Republicii Moldova va implementa o politică macroeconomică şi financiară care să aibă ca efect o creştere economică durabilă şi va demonstra devotament în implementarea măsurilor privind politica macro-economică din Planul de acţiuni Moldova-UE (Articolul 19 din PA). La evaluarea performanţei macro-economice Comisia Europeană va utiliza programul de creditare al FMI sau procesul de consultare, în cazul trecerii la procesul descris în Articolul IV.
2. Guvernul Republicii Moldova va implementa programul de reformare a managementului finanţelor publice în ceea ce priveşte sectorul de sănătate şi va demonstra devotament în implementarea Articolului 40 (Achiziţiile Publice) şi 42 (Management şi control eficient al finanţelor publice) din Planul de acţiuni Moldova-UE.
3. Administrarea fiscală şi a finanţelor publice eficientă de către Guvern, fiind evaluată prin cele mai recente rapoarte de evaluare disponibile (PEFA, CFAA, PER, CPAR etc.). Odată ce implementarea programului a început, continuarea acestuia va fî posibilă doar dacă se va continua respectarea condiţiilor generale.
Pentru a evalua progresul reformelor susţinute de Programul de Suport al Politicii Sectoriale, Comisia se va folosi de evaluarea făcută de propriul personal, şi în caz de necesitate, de expertiza tehnică.
Pentru a minimiza costurile de tranzacţie pentru Guvern, următoarele mecanisme de revizuire vor fi utilizate pentru a revedea cîteva condiţii generale şi speciale şi pentru a servi drept bază pentru evaluarea progresului şi performanţei Programului de Suport al Politicii Sectoriale:
Revizuirile efectuate de colaboratorii FMI (precum cele ce se efectuează în cadrul PRGF) vor servi drept bază pentru evaluarea politicii macroeconomice şi financiare. Angajamentul Guvernului Republicii Moldova de a implementa Planul de acţiuni Moldova-UE şi documentele succesoare vor fi evaluate în baza rapoartelor de implementare a Planului de acţiuni elaborate de Comisia Europeană cu cooperarea Guvernului şi a organizaţiilor interesate. Revizuirile efectuate de Banca Mondială (aşa cum CSRS) vor servi drept bază pentru evaluarea progresului şi performanţei în unele domenii ale MFP, RAP şi de sănătate.
Graficul revizuirilor
Pe cît este posibil, graficul revizuirilor trebuie să fie coordonat cu alţi donatori implicaţi în procedurile de susţinere bugetară în sector.
Debursările ulterioare vor depinde de realizarea scopurilor ce ţin de indicatorii stipulaţi în aceste Prevederi Tehnice şi Administrative şi se vor referi la activităţile enumerate mai sus în paragraful 1.2.
Indicatorii de performanţă stabiliţi şi indicatorii specificaţi în Anexa 1 se vor aplica pe toată durata Programului de Suport al Politicii Sectoriale. Cu toate acestea, în circumstanţe excepţionale, justificate, Preşedintele Comitetului organizatoric poate depune o cerere Comisiei Europene pentru modificarea scopurilor şi indicatorilor. Pentru a efectua modificările scopurilor şi indicatorilor asupra cărora s-a convenit schimbul de scrisori între cele două Părţi este suficient.
2.4 Procedurile de procurare şi financiare
Următoarele se aplică suportului complementar aşa cum AT, audit, evaluarea, asigurate în cursul programului care va fi gestionat în mod centralizat nemijlocit de către Comisie.
Toate contractele de implementare a acţiunii trebuie să fie acordate şi revizuite în conformitate cu condiţiile generale şi specifice din Acordul de Finanţare şi cu procedurile şi documentele standard elaborate şi publicate de Comisie pentru implementarea operaţiunilor externe, valabile la momentul lansării procedurii în discuţie.
Efectuarea plăţilor
Toate plăţile vor fi efectuate de Comisie în conformitate cu condiţiile generale şi specifice din Acordul de Finanţare şi cu procedurile şi documentele standard elaborate şi publicate de Comisie pentru implementarea operaţiunilor externe valabile la momentul lansării procedurii în discuţie.
3. EVALUAREA DE AUDIT
Programul va fi revizuit de către experţi independenţi, care vor evalua nivelul de conformare/realizare a condiţiilor/indicatorilor stabiliţi în Acordul de Finanţare.
În cazul neîndeplinirii unei condiţii sau nerealizării unei ţinte cantitative sau indicator din cauza situaţiilor excepţionale, condiţia sau indicatorul dat poate să fie lipsit de valoarea de determinant al tranşei variabile.
Comisia Europeană ar putea delega anumiţi consultanţi să efectueze, în cooperare strînsă cu Curtea de Conturi din Moldova, auditul unor cheltuieli ce ţin de implementarea unor activităţi selectate din strategia de dezvoltare a sistemului de ocrotire a sănătăţii.
Înainte de completarea Programului de Suport al Politicii Sectoriale, Comisia Europeană va delega anumiţi consultanţi să efectueze o evaluare finală independentă a programului.
4. COMUNICARE ŞI VIZIBILITATE
Guvernul va asigura mediatizarea contribuţiei din partea Comisiei Europene în program cel puţin la acelaşi nivel ca şi a altor donatori ce susţin implementarea reformelor guvernamentale în domeniul managementului finanţelor publice, reformei administraţiei publice şi sănătăţii.

SPECIAL CONDITIONS
The European Union, hereinafter referred to as “the EU”, represented by the European Commission, hereinafter referred to as “the Commission”,
of the one part, and
the Government of the Republic of Moldova, hereinafter referred to as “the Beneficiary”,
of the other part,
have agreed as follows:
The following provisions of the Financing Agreement No. ENPI/2008/019-655 signed on 25 February 2009 for the implementation of the Programme “Sector Policy Support Programme Health” are amended as follows:
Article 1
Article 2 is hereby replaced as follows:
2.1 The total costs of the programme is estimated at 52,600,000.00 euro, of which 46,600,000.00 euro from the ENPI 2008 Annual Action Programme in favour of the Republic of Moldova (ENPI/2008019-655) and 6,000,000.00 euro from the ENPI 2012 Special Measure “EaPIC” (Eastern Partnership Integration and Cooperation) programme (ENPI/2012/024-348).
The programme has the following components:
2.1.1 Budget support:...............................49,450,000.00 euro
2.1.2 Technical assistance support:............3,150,000.00 euro
2.2 The EU undertakes to finance a maximum of 52,600,000.00 euro. The breakdown of the EU′s financial contribution into budget headings is shown in the budget included in the Technical and Administrative Provisions (Annex II).
Article 2
Article 4 is hereby replaced as follows:
4.1 The period of execution of the financing agreement as defined in Article 4 of the General Conditions shall commence on the entry into force of the financing agreement and end at 84 months after this date.
4.2 The duration of the operational implementation phase is fixed at 60 months.
4.3 The duration of the closure phase is fixed at 24 months.
Article 3
The contracts implementing the financing agreement that are funded from the ENPI 2012 Special Measure “EaPIC” (Eastern Partnership Integration and Cooperation) programme (ENPI/2012/024-348) shall be signed by both parties within three years of the entry into force of the present addendum.
Article 4
The new version of Annex II: Technical and Administrative Provisions is attached to this addendum.
All other terms and conditions of the Financing Agreement and its previous addenda remain unchanged. This addendum shall form an integral part of the Financing Agreement and shall enter into force on the date on which it is signed by the last party.
Done in English in two original copies, one copy being handed to the Commission and one to the Beneficiary.
1. INTERVENTION
1.1 Objectives
General objectives
The overall objective of the Sector Policy Support Programme is to reinforce Moldova – EU cooperation for addressing the health priorities of the Moldova – European Union Action Plan and its successor documents in order to support the concrete prioritisation and implementation of the Moldovan Health Sector Strategy 2008-2017 towards improving the health of the population, expanding access, and improving the efficiency and quality of essential public health care services. In line with the principle of “more for more”, this Programme benefits from additional funding under the Eastern Partnership Integration and Cooperation (EaPIC) programme, with the aim of fostering sustainable and inclusive growth and economic development.
Specific objectives
The specific objectives of the programme are to support the GoM and MoH in improvement of management and stewardship of the health care system; increase funding of healthcare system and improve mechanisms of payment for healthcare services; improve provision of healthcare services; improve resource management.
1.2 Expected results and main activities
Expected results
The results and activities of the programme are those of the GoM own Sector Policy and Strategy. For practical reasons discussed, improving overall public health care sector efficiency, quality and performance is to be primarily achieved by focusing on Family Medicine and agreeing more concrete targets. Technical Assistance will consist of technical expertise and capacity building.
One long-term expert in strategic planning and budgeting will be provided to MoH and another to the National Health Insurance Company (CNAM) and/or Ministry of Finance. Additional expertise will be seeking to support the monitoring system, disseminate information and implement reviews and evaluation of the Sector Policy Support Programme.
Results and targets for monitoring implementation and disbursement are incremental over 5 years and are formulated in a Policy Matrix under the headings of the MoH own Sector Strategy but also taking into account the broader PFM and public stewardship' agenda:
• Stewardship (1): harmonized, comprehensive sector reporting and coordination benchmarks (including donor (and donor indicators) mapping); performance benchmarks in key service (output) and disease (outcome) areas;
• Stewardship (2): Fiscal discipline and operational performance (inputs/outputs): audits of key entities (including CNAM) and PFM benchmarks, service provider autonomy targets;
• Improved Services: Access targets, service quality proxies, satisfaction indicators;
• Human and Physical Infrastructure Resources: Family Medicine training completion and numbers of licensed physicians; Improved efficiency in infrastructure investment;
• Stabilization and Funding Diversification: Budget variance and legislative acts;
• A monitoring system is established, involving relevant Government and, to all possible and feasible extent, non governmental institutions as well as research centres; lessons learnt from the monitoring process are used by the Government to improve over time the effectiveness and efficiency of the strategy.
2. IMPLEMENTATION
2.1 Budget and timetable
The budget of the Sector Policy Support Programme, of EUR 52.6 million, is allocated to the following two components:

The implementation period of the programme is 60 months. The maximum duration of the implementation is set forth by the Special Conditions to the Financing Agreement,
Disbursement of instalments will be contingent on Moldova meeting the indicators detailed in the Financing Agreement.
It is anticipated that five disbursements of EUR 12,000,000, 13,362,650, 13,611,833, 4,139,853, and 6,000,000 (in principle, one per year) will take place during the implementation period.
2.2 Budget support modalities
The method of management for the programme is centralised, i.e. the budget support operation in itself is managed solely by the Commission.
The budgetary support will be untargeted and as such will be channelled directly into the Unified Treasury Account of the Government of the Republic of Moldova. Once released, the funds will be used as all other normal budgetary resources of the Government, and managed in compliance with laws and regulations of Moldova.
Disbursements under the programme will be made in the following instalments:

Foreign-exchange transfers will be entered in the accounts under the value date of the notification of credit to the account of the Central Bank opened for this purpose. The exchange rate will be the middle rate of the interbank foreign currency market on the day of the transfer.
2.3 Performance monitoring and disbursement criteria
2.3.1. Programme oversight
Oversight of the overall programme will be entrusted to a Steering Committee chaired by the Health Minister and whose members will include representatives of all ministries and institutions involved in the implementation of the present programme and of representatives of the European Commission.
The members of the Steering Committee are:
- The Minister of Health, Chairman
- The Minister of Finance, Deputy Chairman
- The President of the Courts of Accounts
- The Director of the Agency for Public Procurement
- The General-Director of the National Health Insurance Company
- Director of the Policy and External Assistance Coordination Department, Government Office
- Members of the civil society (organisations of patients and health care professionals)
- The Head of the European Union Delegation to Moldova or appointed representative
The Steering Committee will meet at least twice a year to review progress. It may decide on modification or inclusion of specific health sector performance indicators.
To guarantee sound implementation of the Sector Policy Support Programme, the Steering Committee will ensure that the Government of Moldova fulfils the following commitments throughout the programme implementation period:
1. Associate the European Commission in all Government – donor discussions and institutional arrangements on the elaboration and implementation of the health care sector reform and Medium Term Expenditure Framework as related to the health sector.
2. The Ministry of Finance and all supported ministries and institutions will make available to the European Commission the following documentation related to the implementation of the Sector Policy Support Programme:
a. Bank statements for the bank accounts referred to in Sections 2.1. and 2.2. of the present Technical and Administrative Provisions.
b. Statements of expenditures (Treasury) on sectors relevant to the Sector Policy Support Programme.
c. Reports on budget execution of the general budgets of the involved bodies (Ministry of Health, National Health Insurance Company).
d. Laws, Government Decrees, other legislative acts and administrative provisions, draft and final, related to implementation of the Sector Policy Support Programme.
e. Reports and agreements with the Bretton Woods institutions in relation to health care sector reforms.
f. Government and other donor policy documents and reports, draft and final, relevant to the implementation of the Sector Policy Support Programme.
Prior to each meeting of the Steering Committee progress reports will be prepared, under the responsibility of the Chairman. Progress reports will describe development in the implementation of the health care sector reform, the PFM reforms. They will, in particular show how far the foreseen activities of the Policy Matrix have been implemented.
Information requested to draft the monitoring / progress reports will be collected from the ministries in charge of implementing the reforms.
If considered appropriate, and until a functional monitoring mechanism satisfying the requirements of the programme is in place, the European Commission might mandate consultants to carry out an independent review of some or all disbursement indicators. As soon as the Government will have put in place a monitoring mechanism of the health sector, acceptable to the Commission, the unused balance of funds, allocated to technical assistance may be transferred to the budget support component of the programme and increase in a proportional manner the amounts of the remaining instalments, so as to increase the disbursements proportionally, if the related indicators are met.
2.3.2. General conditions for the release of the foreign exchange instalment under the Sector Policy Support Programme
The release of the foreign exchange under the programme is contingent on the following general conditions:
1. The Government of Moldova implements a macroeconomie and financial policy conductive to sustainable economic growth and demonstrates commitment to implement the measures of the EU-Moldova Action Plan related to macro-economic policy (article 19 of the AP). The European Commission will use the IMF lending programme or consultation process, in the event of graduation to the Article IV process, in its assessment of macroeconomie performance.
2. The Government of Moldova implements its PFM reform programme related to health sector and demonstrates commitment to implement article 40 (Public procurement) and 42 (Sound management and control of public finances) of the EU-Moldova Action Plan.
3. Sound public finance and fiscal management by the Government. This will be assessed through the most recent assessment reports available (PEFA, CFAA, PER, CPAR, etc.)
Once the programme has entered into implementation, its continuation is contingent on further maintaining of the general conditions.
In order to assess the progress of reforms supported by the Sector Policy Support Programme, the Commission will avail itself of the assessment made by its own staff, and need be, of external technical expertise.
In view of minimising transaction costs for the Government, the following review mechanisms will be utilised to review the several general and special conditions and serve as a basis for assessing progress and performance of the Sector Policy Support Programme:
Reviews by the IMF staff (such as those taking place under the PRGF) will serve as a basis for assessing the macroeconomie and financial policy. Commitment of the GoM to implement the EU-Moldova Action Plan and its successor documents will be assessed on the basis of the Action Plan implementation reports produced by the European Commission with cooperation of the Government and of other interested organisations. Reviews of the World Bank (such as the PRSC) will serve as a basis to assess the progress and the performance in some areas of PFM, Public Administration Reform (PAR), and health.
Schedule of reviews
To all possible extent, the schedule of reviews will be coordinated with other donors involved in sector budget support operations.
Subsequent disbursements will be conditional to the achievement of the targets related to the indicators included in these Technical and Administrative Provisions and refer to activities listed above under paragraph 1.2.
The chosen performance targets and indicators specified in Annex 1 will apply for the duration of the Sector Policy Support Programme. However, in exceptional, duly justified circumstances, the Chairman of the Steering Committee may submit a request to the European Commission for the targets and indicators to be changed. The changes agreed to the targets and indicators may be authorised by exchange of letters between the two parties.
2.4 Procurement and financial procedures
The following applies to complementary support such as TA, audit, evaluation provided under the programme which will follow direct centralised management by the Commission,
All contracts implementing the action must be awarded and implemented in accordance with the general and specific conditions of the Financing Agreement and with the procedures and standard documents drawn up and published by the Commission for the implementation of external operations in force at the time of the launch of the procedure in question.
Payments
All payments must be made by the Commission in accordance with the general and specific conditions of the Financing Agreement and with the procedures and standard documents drawn up and published by the Commission for the implementation of external operations in force at the time of the launch of the procedure in question.
3. EVALUATION AND AUDIT
The programme will be subject to independent reviews that will assess the level of compliance / performance with its conditions / indicators set forth in the Financing Agreement.
In the event of failure to fulfil a condition or achieve a quantitative target or indicator due to forces majeures it will be possible for the given condition or indicator to be neutralised as a determinant of the variable instalment.
The European Commission might mandate consultants to carry out, in close cooperation with the Court of Accounts of Moldova, an audit of a sample of expenditures related to the implementation of the selected health care system development strategy activities.
Prior to completion of the Sector Policy Support Programme, the European Commission will mandate consultants to carry out an independent final evaluation of the programme.
4. COMMUNICATION AND VISIBILITY
The Government shall ensure that the visibility of the European Commission contribution to the programme is at least equivalent to that given through media to other donors supporting the implementation of the GoM reforms in the area of PFM, PAR, and health.
