Your Excellency,
I have the honour to acknowledge the receipt of Your Excellency's letter of 22 December 2016, which reads as follows:
“We have received a letter from the State Chancellery of the Republic of Moldova requesting to extend the target date for the achievement of the third variable tranche performance criteria of the Financing Agreement "Support to the implementation of the Vocational Education and Training Strategy" (ENPI/2013/024-404).
We take note of the request of considering the 2015 and beginning of 2016 situation of the country as an exceptional and duly substantiated case for the exceptional extension of the target date for the achievement of the third variable tranche performance criteria.
Indeed, the paragraph 2.3 of Annex II of the Financing Agreement of the programme states that "in duly justified circumstances, the Government of Moldova may submit a request to the Commiss/on for the targets and indicators to be changed. The changes agreed to the targets and indicators may be authorized by exchange of letters between the two parties".
We would like to point out that the 2014 and 2015 review missions for the disbursement of the 1st and 2nd tranches of the Budget Support for VET reform identified areas where further action and improvement from your side would be needed. We recognize that the implementation of the VET strategy has proceeded slowly during 2015: On the one hand, there has been a concrete governmental commitment in the development and adoption of the legal procedures towards renewing the VET system in the country, but on the other hand we encourage you to focus on the implementation of concrete actions (as set in the relevant Action Plan).
Based on the letter of the State Chancellery of 5 August 2016 and of the Ministry of Education of 17 October 2016 which commits to achieve 2016 indicators of performance till 10 July 2017, and the discussions regarding this project carried out during the session of the National Coordination Council in VET held on 30 October 2016 in presence of Minister of Education FUSU and the main internal and external actors of the sector, I agree to postpone the target date for the achievement of the third variable tranche performance criteria from 31 December 2016 to 10 July 2017 for the related Financing Agreement and consequently to extend the duration of the operational implementation phase and the period of the execution of the related Financing Agreement by 5 month. As a result:
a) indicative assessment date of the third variable tranche will be 3rd quarter 2017;
b) indicative disbursement date of the third and last variable tranche will be 4th quarter 2017;
c) the duration of the operational implementation phase of the Financing Agreement will be 41 months;
d) the period of the execution of the Financing Agreement will be 65 months.
All other conditions of the Financing Agreement remain unchanged.
However, considering the challenges identified in the implementation of the VET reform, we would kindly urge your Government to make sure that the whole Government makes its utmost to deliver tangible progress on the VET reform in year 2017.
If you agree with the proposed amendment, I would be grateful to receive from you a letter in reply making reference to the present letter. These two letters will comprise Addendum No.l to the Financing Agreement between European Commission, acting on behalf of the European Union, and the Government of the Republic of Moldova "Support to the implementation of the Vocational Education and Training Strategy" (ENPI/2013/024-404) in the form of an exchange of letters. This Addendum will enter into force on the date of signature of your reply letter."
I have the honour to confirm that the Government of the Republic of Moldova agrees with the proposed amendment to the Financing Agreement. Accordingly, your letter and this reply letter shall therefore constitute the Addendum no. 1 to the Financing Agreement between the European Commission, acting on behalf of the European Union, and the Government of the Republic of Moldova for the "Support to the implementation of the Vocational Education and Training Strategy" (ENPI/2013/024-404). This Addendum will enter into force on the date of this reply letter.
