ÎNTRE Guvernul Republicii Moldova, reprezentat prin Prim-ministru (în continuare “Beneficiarul”)

ŞI Guvernul Statelor Unite ale Americii, care acţionează prin intermediul Agenţiei SUA pentru Dezvoltare Internaţională (“USAID”)

1. Scopul Amendamentului

Acest al optulea amendament (“Al optulea amendament”) la Acordul de asistenşă al USAID pentru Programul de Consolidare a Instituţiilor Statului de Drept, din 22 iulie 2011 (conform modificării, “Acordul”), se încheie între USAID şi Beneficiar (“Părţi”) cu scopul de a modifica Termenul de Realizare al Acordului.

2. Termenul de Realizare

Articolul 4, paragraful (a) al Acordului se exclude, în întregime, şi se înlocuieşte cu următoarele:

“(a) Termenul de Realizare, care este 30 septembrie, 2018, sau o oricare altă dată asupra căreia părţile au convenit în scris, este data la care, conform estimărilor părţilor, toate activităţile finanţate în baza prezentului Acord vor fi realizate.”

3. Alte Termene şi Condiţii

Cu excepţia modificărilor din prezentul amendament, toate termenele şi condiţiile Acordului rămîn în vigoare şi neschimbate.

Părţile au convenit că amendamentele la acest Acord pot fi semnate separat de către fiecare din Părţi.

Guvernul Statelor Unite ale Americii şi Beneficiarul, fiecare acţionînd prin intermediul Reprezentanţilor Autorizaţi în mod corespunzător, au semnat în numele lor şi au prezentat la Chişinău, acest al Optulea Amendament, care urmează să intre în vigoare în ziua de ______________, _______.

EIGHTH AMENDMENT

TO THE

ASSISTANCE AGREEMENT

BETWEEN

THE GOVERNMENT OF THE UNITED STATES OF AMERICA

AND

THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

FOR THE

RULE OF LAW INSTITUTIONAL STRENGTHENING PROGRAM

USAID Assistance Agreement No. 117-0004-AA

DATE: April 23, 2018

BETWEEN The Government of the United States of America, acting through the United States Agency for International Development (“USAID”)

AND The Government of the Republic of Moldova, represented by Prime Minister (hereinafter referred to as the “Grantee”)

1. Purpose of the Amendment

This eighth amendment (the “Eighth Amendment”) to the USAID Assistance Agreement for the Rule of Law Institutional Strengthening Program, dated July 22, 2011 (as amended, the “Agreement”), is hereby entered into between USAID and the Grantee (the “Parties”) in order to amend the Completion Date in the Agreement.

2. Completion Date

Article 4, paragraph (a) of the Agreement is hereby deleted in its entirety and replaced by the following:

“(a) The Completion Date, which is September 30, 2018, or such other date as the Parties may agree to in writing, is the date by which the Parties estimate that all the activities funded under this Agreement will be completed.”

3. Other Terms and Conditions

Except as amended herein, all other terms and conditions of the Agreement remain in full force and effect.

The Parties agree that amendments under this Agreement may be signed in counterparts.

The Government of the United States of America and the Grantee, each acting through its duly Authorized Representatives, have caused this Eighth Amendment to be signed in their names and delivered in Chisinau, to be made effective as of the ____ day of ________________ _____.
