Între Guvernul Republicii Moldova, care acţionează prin intermediul Cancelariei de Stat (în continuare “Beneficiar”)

şi Guvernul Statelor Unite ale Americii, care acţionează prin intermediul Agenţiei SUA pentru Dezvoltare Internaţională (“USAID”)

1. Scopul Amendamentului

Acest al Treilea Amendament (“Al Treilea Amendament”) la Acordul de Asistenţă privind Obiectivul de Dezvoltare al USAID pentru O Guvernare Democratică Mai Eficientă şi Mai Responsabilă, din 28 septembrie 2016 (conform modificării, “Acordul”), se încheie între USAID şi Beneficiar (“Părţile”) cu scopul de a adăuga Trei Milioane Cinci Sute Mii dolari SUA ($3,500,000) finanţare suplimentară sub formă de Grant şi de a modifica Planul Financiar. Această finanţare suplimentară va majora fondurile totale angajate până în prezent, în baza Acordului, în limita unei sume, care nu va depăşi Treizeci şi Şase de Milioane, O Sută Douăzeci şi Şapte Mii, Trei Sute Douăzeci şi Patru dolari SUA ($36,127,324)

2. Finanţarea

Articolul 3, Secţiunea 3.1, paragraful (a), “Grantul”, se exclude, prin prezentul, în întregime şi se înlocuieşte cu următoarele:

(a) Grantul. Pentru a contribui la realizarea Obiectivului definit în prezentul Acord, USAID, potrivit Legii din 1961 cu privire la Asistenţa Externă, cu modificările corespunzătoare, prin prezentul, îi acordă Beneficiarului, conform termenelor şi condiţiilor Acordului, suma care nu va depăşi Treizeci şi Şase de Milioane, O Sută Douăzeci şi Şapte Mii, Trei Sute Douăzeci şi Patru dolari SUA ($36,127,324) (“Grantul”).

3. Planul Financiar

Planul Financiar al Acordului de Asistenţă privind Obiectivul de Dezvoltare 117-0001-DG-DOAG se exclude, prin prezentul, în întregime şi se înlocuieşte cu o nouă Anexa 1, Planul Financiar, anexată la acest Amendament.

4. Alte Termene şi Condiţii

Cu excepţia modificărilor din prezentul Amendament, celelalte termene şi condiţii ale Acordului ramân în vigoare şi neschimbate.

Guvernul Statelor Unite ale Americii şi Guvernul Republicii Moldova, fiecare acţionând prin intermediul Reprezentanţilor Autorizaţi în mod corespunzător, au semnat în numele lor acest Al Treilea Amendament al Obiectivului de Dezvoltare al USAID pentru O Guvernare Democratică Mai Eficientă şi Mai Responsabilă, care urmează să intre în vigoare la data de____ ___________, 2018.

THIRD AMENDMENT

TO THE

DEVELOPMENT OBJECTIVE GRANT AGREEMENT

BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA,

AND

THE GOVERNMENT OF THE UNITED STATES OF AMERICA,

FOR

MORE EFFECTIVE AND ACCOUNTABLE DEMOCRATIC GOVERNANCE

USAID Grant Agreement 117-0001-DG-DOAG

BETWEEN The Government of the Republic of Moldova, acting through the State Chancellery (hereinafter referred to as the “Grantee”)

AND The Government of the United States of America, acting through the United States Agency for International Development (“USAID”)

1. Purpose of the Amendment

This third amendment (the “Third Amendment”) to the USAID Development Objective Grant Agreement for More Effective and Accountable Democratic Governance, dated September 28, 2016 (as amended, the “Agreement”), is hereby entered into between USAID and the Grantee (together, the “Parties”) in order to add Three Million, Five Hundred Thousand United States (“U.S.”) Dollars ($3,500,000) in incremental Grant funding; and amend the Financial Plan. This incremental addition of funds brings the total funds obligated to date under the Agreement to an amount not to exceed Thirty Six Million, One Hundred Twenty Seven Thousand and Three Hundred Twenty Four U.S. Dollars ($36,127,324).

2. Financing

Article 3, Section 3.1, paragraph (a), “The Grant,” is hereby deleted in its entirety and replaced by the following:

(a) The Grant. To help achieve the Objective set forth in this Agreement, USAID, pursuant to the Foreign Assistance Act of 1961, as amended, hereby grants to the Grantee under the terms of the Agreement an amount not to exceed Thirty Six Million, One Hundred Twenty Seven Thousand and Three Hundred Twenty Four U.S. Dollars ($36,127,324). (the “Grant”).

3. Financial Plan

The Development Objective Grant Agreement 117-0001-DG-DOAG Financial Plan is hereby deleted in its entirety and replaced with a new Financial Plan, attached hereto as Annex 1.

4. Other Terms and Conditions

Except as amended herein, all other terms and conditions of the Agreement remain in full force and effect.

In witness whereof, the Government of the United States of America and the Government of the Republic of Moldova, acting through their respective duly authorized representatives, have caused this Third Amendment of the USAID Development Objective Grant Agreement for More Effective and Accountable Democratic Governance, to be signed and made effective as of this ___day of ___________, 2018.
