CONSILIUL DE ASOCIERE UE – REPUBLICA MOLDOVA,

având în vedere Acordul de Asociere între Uniunea Europeană şi Comunitatea Europeană a Energiei Atomice şi statele membre ale acestora, pe de o parte, şi Republica Moldova, pe de altă parte, în special articolul 436 alineatul (3),

întrucât:

(1) Acordul de asociere dintre Uniunea Europeană şi Comunitatea Europeană a Energiei Atomice şi statele membre ale acestora, pe de o parte, şi Republica Moldova, pe de altă parte¹, (denumit în continuare “acordul”) a fost semnat la 27 iunie 2014.

(2) Articolul 201 din acord prevede ca apropierea progresivă de legislaţia Uniunii în domeniul vamal şi de anumite instrumente juridice internaţionale să fie realizată în conformitate cu anexa XXVI la acord.

(3) Anexa XXVI la acord precizează că apropierea de dispoziţiile din Regulamentul (CEE) nr.2913/92 al Consiliului² urmează să fie realizată de Republica Moldova în termen de trei ani de la intrarea în vigoare a acordului.

(4) Regulamentul (CEE) nr.2913/92 a fost abrogat şi, de la 1 mai 2016, în Uniune sunt în vigoare dispoziţiile de fond din Regulamentul (UE) nr.952/2013al Parlamentului European şi al Consiliului³.

(5) În cadrul reuniunii Subcomitetului vamal UE – Republica Moldova din 6 octombrie 2016 s-a convenit că anexa XXVI la acord ar trebui modificată în consecinţă,

ADOPTĂ PREZENTA DECIZIE:

Articolul 1

Anexa XXVI la acord se modifică în conformitate cu anexa la prezenta decizie.

Articolul 2

Prezenta decizie intră în vigoare la data adoptării.

ANEXĂ

Prima secţiune din anexa XXVI la acord se modifică după cum urmează:

Menţiunea “Regulamentul (CEE) nr.2913/92 al Consiliului din 12 octombrie 1992 de instituire a Codului Vamal Comunitar” se înlocuieşte cu menţiunea “Regulamentul (UE) nr.952/2013 al Parlamentului European şi al Consiliului din 9 octombrie 2013 de stabilire a Codului vamal al Uniunii”.

as regards the amendment of Annex XXVI to the Association Agreement between

the European Union and the European Atomic Energy Community and their

Member States, of the one part, and the Republic of Moldova,

of the other part

THE EU-REPUBLIC OF MOLDOVA ASSOCIATION COUNCIL,

Having regard to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part, and in particular Article 436(3) thereof,

Whereas:

(1) The Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part¹ (the 'Agreement') was signed on 27 June 2014.

(2) Article 201 of the Agreement provides for the gradual approximation to the Union's customs law and certain international law to be carried out as set out in Annex XXVI to the Agreement.

(3) Annex XXVI to the Agreement specifies that approximation with the provisions of Council Regulation (EEC) No 2913/92² is to be carried out by the Republic of Moldova within three years following the entry into force of the Agreement.

(4) Regulation (EEC) No 2913/92 has been repealed and, since 1 May 2016, the substantive provisions of Regulation (EU) No 952/2013³ of the European Parliament and of the Council are in application in the Union.

(5) At the meeting of the EU – Republic of Moldova Customs Sub-Committee held on 6 October 2016, it was concluded that Annex XXVI to the Agreement should be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XXVI to the Agreement is amended as set out in the Annex to this Decision.

Article 2

This Decision shall enter into force on the date of its adoption.

The first section of Annex XXVI to the Agreement is amended as follows:

The reference 'Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code' is replaced by the reference 'Regulation (EU) No 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code'.
