SUBCOMITETUL VAMAL UE-REPUBLICA MOLDOVA,
avînd în vedere Acordul de asociere dintre Uniunea Europeană şi Comunitatea Europeană a Energiei Atomice şi statele membre ale acestora, pe de o parte, şi Republica Moldova, pe de altă parte1, în special articolul 38 din protocolul II la respectivul acord, privind definirea noţiunii de “produse originare” şi metodele de cooperare administrativă,

întrucît:
(1) Articolul 144 alineatul (2) din Acordul de asociere dintre Uniunea Europeană şi Comunitatea Europeană a Energiei Atomice şi statele membre ale acestora, pe de o parte, şi Republica Moldova, pe de altă parte (denumit în continuare “acordul”) face trimitere la Protocolul II la acord (denumit în continuare “protocolul II”), care stabileşte regulile de origine şi prevede cumulul de origine între Uniune şi Republica Moldova.
(2) Cea mai mare parte a dispoziţiilor privind comerţul şi aspectele legate de comerţ din acord, inclusiv Protocolul II,s-au aplicat cu titlu provizoriu de la 1 septembrie 2014.
(3) Conform articolului 38 din Protocolul II, Subcomitetul vamal prevăzut la articolul 200 din acord poate decide să modifice dispoziţiile respectivului protocol.
(4) Convenţia regională cu privire la regulile de origine preferenţiale pan-euro-mediteraneene2 (denumită în continuare “convenţia”) urmăreşte să înlocuiască protocoalele privind regulile de origine aflate în prezent în vigoare în ţările din zona paneuromediteraneeană cu un act juridic unic.

(5) Uniunea a semnat convenţia la 15 iunie 2011. Prin Decizia nr.2 din 21 mai 20143, Comitetul mixt al Convenţiei a hotărât că Republica Moldova ar trebui să fie invitată să adere la convenţie.

(6) Uniunea şi Republica Moldova şi-au depus instrumentele de acceptare pe lîngă depozitarul convenţiei la 26 martie 2012, respectiv la 31 iulie 2015. În consecinţă, în temeiul articolului 10 alineatul (3) din convenţie, aceasta a intrat în vigoare pentru Uniune la 1 mai 2012 şi, respectiv, pentru Republica Moldova la 1 septembrie 2015.
(7) Prin urmare, Protocolul II ar trebui modificat astfel încît să facă trimitere la convenţie,
ADOPTĂ PREZENTA DECIZIE:
Articolul 1
ProtocoluI II la Acordul de asociere dintre Uniunea Europeană şi Comunitatea Europeană a Energiei Atomice şi statele membre ale acestora, pe de o parte, şi Republica Moldova, pe de altă parte, privind definirea noţiunii de “produse originare” şi metodele de cooperare administrativă se înlocuieşte cu textul prevăzut în anexa la prezenta decizie.
Articolul 2
Prezenta decizie intră în vigoare la data adoptării.
Prezenta decizie se aplică de la 1 decembrie 2016.
Întocmită la Bruxelles la 6 octombrie 2016.

Protocolul II privind definirea conceptului de “produse
originare” şi metodele de cooperare administrativă
ARTICOLUL 1
Reguli de origine aplicabile
(1) În scopul implementării prezentului acord, se aplică apendicele I şi dispoziţiile pertinente ale apendicelui II la Convenţia regională cu privire la regulile de origine preferenţiale paneuromediteraneene1 (denumită în continuare “convenţia”).

(2) Toate trimiterile la “acordul relevant” din apendicele I şi din dispoziţiile pertinente ale apendicelui II la convenţie se interpretează ca trimiteri la prezentul acord.
ARTICOLUL 2
Soluţionarea litigiilor
(1) În cazul în care litigiile survenite în legătură cu procedurile de verificare prevăzute la articolul 32 din apendicele Ila convenţie nu pot fi soluţionate între autorităţile vamale care solicită verificarea şi autorităţile vamale responsabile cu efectuarea verificării respective, acestea sunt înaintate Subcomitetului vamal. Dispoziţiile privind mecanismul de soluţionare a diferendelor de la capitolul 14 (Soluţionarea diferendelor) din titlul V (Comerţ şi aspecte legate de comerţ) din prezentul acord nu se aplică.
(2) În toate cazurile, soluţionarea litigiilor dintre importator şi autorităţile vamale din ţara importatoare se efectuează în conformitate cu legislaţia ţării respective.
ARTICOLUL 3
Modificarea protocolului
Subcomitetul vamal poate decide modificarea dispoziţiilor prezentului protocol.
ARTICOLUL 4
Retragerea din convenţie
(1) Dacă fie Uniunea Europeană, fie Republica Moldova notifică în scris depozitarului convenţiei intenţia lor de a denunţa convenţia în conformitate cu articolul 9 al acesteia, Uniunea Europeană şi Republica Moldova încep imediat negocierile cu privire la regulile de origine în scopul punerii în aplicare a prezentului acord.
(2) Pînă la intrarea în vigoare a noilor reguli de origine negociate, acordului i se aplică în continuare regulile de origine prevăzute în apendicele I şi, după caz, dispoziţiile pertinente ale apendicelui II la convenţie, în vigoare la momentul retragerii. Cu toate acestea, începînd din momentul retragerii, regulile de origine prevăzute în apendicele I şi, după caz, dispoziţiile pertinente ale apendicelui II la convenţie se interpretează astfel încît să permită cumulul bilateral doar între Uniunea Europeană şi Republica Moldova.
ARTICOLUL 5
Dispoziţii tranzitorii – cumulul
În pofida articolului 16 alineatul (5) şi articolului 21 alineatul (3) din apendicele I la convenţie, în cazul în care cumulul implică numai statele AELS, Insulele Feroe, Uniunea Europeană, Turcia, participanţii la procesul de stabilizare şi de asociere şi Republica Moldova, dovada originii poate fi constituită de un certificat de circulaţie a mărfurilor EUR.1 sau de o declaraţie de origine.

THE EUREPUBLIC OF MOLDOVA CUSTOMS SUBCOMMITTEE,
Having regard to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part1, and in particular Article 38 of Protocol II to that Agreement concerning the definition of the concept of originating products′ and methods of administrative cooperation,

Whereas:
(1) Article 144(2) of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part (the Agreement′), refers to Protocol II to the Agreement (Protocol II′) which lays down the rules of origin and provides for cumulation of origin between the Union and the Republic of Moldova.
(2) Most of the provisions on trade and traderelated matters of the Agreement, including Protocol II, have been applied provisionally since 1 September 2014.
(3) Article 38 of Protocol II provides that the Customs Sub-Committee provided for in Article 200 of the Agreement may decide to amend the provisions of that Protocol.
(4) The Regional Convention on pan-Euro-Mediterranean preferential rules of origin1 (the Convention′) aims to replace the protocols on rules of origin currently in force among the countries of the pan-Euro-Mediterranean area with a single legal act.

(5) The Union signed the Convention on 15 June 2011. The Joint Committee of the Convention decided, by Decision No 2 of 21 May 20142, that the Republic of Moldova should be invited to accede to the Convention.

(6) The Union and the Republic of Moldova deposited their instruments of acceptance with the depositary of the Convention on 26 March 2012 and 31 July 2015, respectively. Consequently, pursuant to Article 10(3) of the Convention, the Convention entered into force in relation to the Union and the Republic of Moldova on 1 May 2012 and 1 September 2015, respectively.
(7) Protocol II should therefore be replaced by a new protocol making reference to the Convention,
HAS ADOPTED THIS DECISION:
Article 1
Protocol II to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part, concerning the definition of the concept of originating products′ and methods of administrative cooperation, shall be replaced by the text set out in the Annex to this Decision.
Article 2
This Decision shall enter into force on the date of its adoption.
It shall apply from 1 December 2016

ANNEX
Protocol II concerning the definition of the concept of originating
products′ and methods of administrative cooperation
ARTICLE 1
Applicable rules of origin
1. For the purpose of implementing this Agreement, Appendix I and the relevant provisions of Appendix II to the Regional Convention on pan-Euro-Mediterranean preferential rules of origin1 (the Convention′) shall apply.

2. All references to the relevant agreement′ in Appendix I and in the relevant provisions of Appendix II to the Convention shall be construed so as to mean this Agreement.
ARTICLE 2
Dispute settlement
1. Where disputes arise in relation to the verification procedures of Article 32 of Appendix I to the Convention that cannot be settled between the customs authorities requesting the verification and the customs authorities responsible for carrying out that verification, they shall be submitted to the Customs Sub-Committee. The provisions on the dispute settlement mechanism in Chapter 14 (Dispute Settlement) of Title V (Trade and Traderelated Matters) of this Agreement shall not apply.
2. In all cases the settlement of disputes between the importer and the customs authorities of the importing country shall take place under the legislation of that country.
ARTICLE 3
Amendments to the Protocol
The Customs Sub-Committee may decide to amend the provisions of this Protocol.
ARTICLE 4
Withdrawal from the Convention
1. Should either the European Union or the Republic of Moldova give notice in writing to the depositary of the Convention of their intention to withdraw from the Convention in accordance with Article 9 thereof, the European Union and the Republic of Moldova shall immediately enter into negotiations on rules of origin for the purpose of implementing this Agreement.
2. Until the entry into force of such newly negotiated rules of origin, the rules of origin contained in Appendix I and, where appropriate, the relevant provisions of Appendix II to the Convention, applicable at the moment of withdrawal, shall continue to apply to this Agreement. However, as of the moment of withdrawal, the rules of origin contained in Appendix I and, where appropriate, the relevant provisions of Appendix II to the Convention shall be construed so as to allow bilateral cumulation between the European Union and the Republic of Moldova only.
ARTICLE 5
Transitional provisions – cumulation
Notwithstanding Articles 16(5) and 21(3) of Appendix I to the Convention, where cumulation involves only EFTA States, the Faroe Islands, the European Union, Turkey, the participants in the Stabilisation and Association Process and the Republic of Moldova, the proof of origin may be a movement certificate EUR.1 or an origin declaration.
