şi Ministerul Afacerilor Externe al Republicii Elene

Acest Memorandum de Înţelegere este încheiat între Ministerul Economiei şi Comerţului al Republicii Moldova şi Ministerul Afacerilor Externe al Republicii Elene (în continuare Părţi).
recunoscînd că economiile acestora necesită energie pentru dezvoltare stabilă şi rapidă;
dorind să intensifice cooperarea bilaterală în sfera surselor noi de energie, în particular energiei regenerabile;
consimţind că cooperarea energetică între ele va contribui la dezvoltarea economiilor Părţilor şi la dezvoltarea relaţiilor bilaterale prieteneşti între Ministerul Afacerilor Externe al Republicii Elene şi Ministerul Economiei şi Comerţului al Republicii Moldova; şi
avînd în vedere că Republica Elenă trebuie sa respecte obligaţiile sale reieşind din calitatea sa de membru al Uniunii Europene.
Părţile convin să fortifice cooperarea bilaterală avînd drept scop dezvoltarea acţiunilor comune în sectorul energetic cu referinţă specifică la sursele de energie regenerabilă şi eficienţă energetică.
Pentru implementarea Memorandumului de Înţelegere, Centrul pentru Surse de Energie Regenerabilă (CRES) din numele Ministerului Afacerilor Externe al Republicii Elene, va elabora planuri de lucru detaliate pentru fiecare din următoarele activităţi care vor forma programul de lucru al Ministerului Afacerilor Externe al Republicii Elene/ USAID “Synenergy” cooperation.
• Evaluarea Energiei Regenerabile – estimarea potenţialului fizic şi tehnic al resurselor, analiza economică şi potenţialul pieţei (indicatorii sectorului, studii privind potenţialul economic, considerentele tarifare etc.).
• Evaluarea Eficienţei Energetice în clădirile rezidenţiale, identificarea şi dezvoltarea proiectelor demonstrative pilot precum şi instruirea, şi diseminarea informaţiei, metodelor etc.
• Înfiinţarea unui Centru Energetic – dezvoltarea unui centru de excelenţă în sectorul energiei regenerabile, prin atribuirea unui edificiu instituţional, schimbului de experţi, instruire, consolidare a capacităţii etc.
• Planificarea Strategică pentru Energii Regenerabile şi Eficienţă Energetică.
Grupul comun de lucru va fi instituit între Centrul Elen pentru Sursele de Energie Regenerabilă (CRES) şi autorităţile moldoveneşti responsabile pentru energia regenerabilă şi eficienţă energetică.
Grupurile de lucru vor include cîte doi membri din fiecare ţară care vor fi determinaţi de către fiecare dintre Părţi.
Grupul de lucru sus-menţionat va funcţiona în cadrul obiectivelor USAID/ Ministerului Afacerilor Externe al Republicii Elene şi/sau altor programe.
Prezentul Memorandum de Înţelegere poate fi modificat de către Părţi în cadrul consultărilor. Amendamentele vor fi anexate la prezentul Memorandum de Înţelegere şi vor fi parte integrantă a acestuia.
INTRAREA ÎN VIGOARE, DURATA ŞI DENUNŢAREA MEMORANDUMULUI
Memorandumul de Înţelegere va intra în vigoare la data semnării acestuia şi va rămîne în vigoare, în afară de cazul denunţării acestuia de către ambele Părţi.
Memorandumul de Înţelegere poate fi modificat printr-un acord mutual în scris şi poate fi denunţat în orice moment de către oricare dintre Părţi în decurs de nouăzeci de zile, preavizînd în scris cealaltă Parte.
Încetarea acţiunii Memorandumului nu va afecta activităţile cuprinse în vreun contract colaborativ între agenţiile executive şi cele deja în curs de desfăşurare la momentul denunţării.
Acest Memorandum de Înţelegere este semnat la 8 octombrie 2008, la Atena, Grecia, şi nu prevede obligaţi legale faţă de Părţi.
MEMORANDUM OF UNDERSTANDING

and the Ministry of Economy and Commerce
of the Republic of Moldova
This Memorandum of Understanding is concluded between the Ministry of Economy and Commerce of the Republic of Moldova and the Ministry of Foreign Affairs of the Hellenic Republic (collectively, the Parties).
recognizing that their economies are in need of energy for stable and rapid development;
desiring to enhance the bilateral cooperation in the new sources of energy, particularly renewable energy;
agreeing that energy cooperation between them will contribute to the development of economies of the parties and to the development of the existing amiable relations between the Ministry of Foreign Affairs of the Hellenic Republic and the Ministry of Economy and Commerce of the Republic of Moldova; and
having in mind that the Hellenic Republic shall observe its obligations arising from its membership in the European Union.
The Parties hereby agree to strengthen the bilateral cooperation with the aim of developing common actions in the energy field with specific reference to renewable energy sources and energy efficiency.
For the implementation of this Memorandum of Understanding the Centre for Renewable Energy Sources (CRES) on behalf of the Ministry of Foreign Affairs of the Hellenic Republic, will elaborate detailed work plans for each of the following activities which make up the work programme of the Ministry of Foreign Affairs of the Hellenic Republic / USAID "Synenergy" cooperation.
• Assessment of Renewable Energy – estimation of physical and technical resource potential, economic analysis and market potential (field measurements, economic potential studies, tariff considerations, etc.)
• Assessment of Energy Efficiency in Residential Buildings and identification and development of pilot demonstration projects as well as training and dissemination of information, methods, etc.
• Establishment of an Energy Center – developing a center of excellence in the field of renewable energy by providing institutional building, exchange of experts, training, capacity building etc.
• Strategic Planning for Renewables and Energy Efficiency.
A joint working group will be established between the Hellenic Centre for Renewable Energy Sources (CRES) and the Moldovan authorities responsible for renewable energy and energy efficiency.
The Working Groups are comprised of two members from each country who will be determined by each Party.
The above working group will function within the scope of the USAID/Ministry of Foreign Affairs of the Hellenic Republic and/or other programmes.
The present Memorandum of Understanding can be amended by the Parties through consultations. The amendments shall be enclosed with the present Memorandum of Understanding and shall form an integral part of it thereof.
ENTRY INTO FORCE, DURATION AND TERMINATION
The Memorandum of Understanding will enter into force on the date of signing and shall remain in force unless revoked by the consent of the Parties.
The Memorandum of Understanding may be amended by mutual written agreement and may be terminated at any time by either Party upon ninety days written notice to the other Party.
The termination will not affect activities covered by a collaborative contract between the executive agencies and already underway at the time of termination.
This Memorandum of Understanding is signed on 8 October 2008 in Athens, Greece and shall not create any legally binding obligations on either Party.
