MEMORANDUM DE ÎNŢELEGERE

între Centrul pentru Combaterea Crimelor Economice şi Corupţiei al Republicii

Moldova şi Unitatea de Investigaţii  Financiare pe lingă  Ministerul de Finanţe

şi Credit Public al Statelor Unite Mexicane privind cooperarea în schimbul de

informaţii financiare referitoare la spălarea banilor şi finanţarea terorismului

Unitatea de Investigaţii Financiare pe lingă Ministerul de Finanţe şi Credit Public al Statelor Unite Mexicane şi Centrul pentru Combaterea Crimelor Economice şi Corupţiei al Republicii Moldova, denumite în continuare “Părţi”, iar individual “Parte” doresc, în spiritul cooperării şi al interesului reciproc şi, în conformitate cu prevederile legislaţiei naţionale a fiecărei Părţi, să coopereze în scopul investigării şi acuzării persoanelor suspecte de spălarea banilor sau finanţarea terorismului şi alte activităţi criminale conexe cu infracţiunile de spălarea banilor sau finanţarea terorismului. în acest scop, Părţile au convenit asupra următoarelor:

1. PĂRŢILE

Părţile intră în prezentul Memorandum şi îl vor aplica în funcţie de competenţele pe care legislaţia lor naţională le conferă pentru schimbul, cererea, primirea şi păstrarea documentaţiei financiare şi informaţiilor pentru desfăşurarea activităţilor de investigaţii în prevenirea spălării banilor şi finanţării terorismului. În mod special:

a) Unitatea de Investigaţii Financiare pe lîngă Ministerul de Finanţe şi Credit Public al Statelor Unite Mexicane este Partea competentă de a se subscrie acestui Memorandum, în conformitate cu Regulamentul intern al Ministerului Finanţelor Creditului Public.

b) Centrul pentru Combaterea Crimelor Economice şi Corupţiei al Republicii Moldova este Partea competentă pentru a se subscrie la Memorandumul prezent, potrivit legii.

2. SCHIMBUL DE INFORMAŢII

În sensul prezentului Memorandum, “Parte solicitantă” este cel care face o cerere pentru furnizarea de informaţii, sau pentru care informaţiile sunt divulgate în mod unilateral, şi “Parte solicitată una către care o cerere de informaţii a fost formulată, sau care prezintă în mod unilateral informaţiile.

Părţile vor colabora în baza reciprocităţii la etapa colectării, prelucrării şi analizei informaţiei pe care o deţin cu privire la operaţiunile financiare în privinţa cărora există suspiciunea că au legătură cu spălarea banilor sau activităţi criminale conexe cu spălarea banilor sau finanţarea terorismului. În acest scop, Părţile, spontan sau la solicitare, vor efectua schimb de informaţii cu privire la orice informaţie disponibilă care ar fi relevantă pentru efectuarea de către Părţi a investigaţiei privind tranzacţiile financiare care au legătură cu spălarea banilor sau finanţarea terorismului şi a persoanelor sau întreprinderilor implicate.

În limitele competenţei sale legale şi cu respectarea strictă a cadrului său juridic, fiecare dintre Părţi, atunci când primeşte o cerere de informaţii, va depune toate eforturile pentru obţinerea şi furnizarea informaţiilor solicitate.

3. JUSTIFICAREA SOLICITĂRII

Sub rezerva dreptului naţional, Partea solicitantă va divulga Părţii solicitate cel puţin motivul solicitării, scopul pentru care informaţiile vor fi utilizate şi informaţii suficiente pentru a permite Părţii destinatare să stabilească dacă cererea este conformă cu dreptul intern. Orice solicitare de informaţii va fi argumentată printr-o declaraţie succintă a faptelor care stau la baza acesteia.

4. DIVULGAREA INFORMAŢIEI

(a) Sub rezerva paragrafului 4(b) al prezentului punct, informaţiile obţinute de la Părţile respective nu vor fi transmise niciunei Părţi terţe, nici nu va fi utilizată în scopuri administrative, de învinuire sau în scopuri judiciare fără consimţămîntul prealabil expres în scris al Părţii care face divulgarea. Se înţelege că informaţiile obţinute în conformitate cu prezentul Memorandum pot fi utilizate doar în desfăşurarea investigaţiilor.

(b) În cazul în care o Parte este implicată într-un proces judiciar sau proceduri care ar cere divulgarea informaţiilor pe care le-a primit de la altă Parte, Partea implicată în acest proces sau proceduri va notifica imediat şi va solicita acordul expres în scris al celeilalte Părţi de a divulga informaţiile şi, dacă acordul nu a fost primit, informaţiile nu vor fi divulgate.

(c) Dacă se constată cazuri de încălcare a confidenţialităţii informaţiei, Partea prejudiciată, în vederea rezolvării conflictului, va avea dreptul să recurgă la procedurile prevăzute de standardele Grupului Egmont.

5. UTILIZAREA INFORMAŢIEI DIVULGATE

Informaţia conţinută în cerere poate fi utilizată doar în cazurile de investigare sau cercetare a infracţiunilor de spălarea banilor sau finanţarea terorismului. Partea solicitată, fără acordul prealabil expres şi scris al Părţii solicitante, nu poate să divulge conţinutul cererii în alt scop decât ce! de a obţine informaţia necesară pentru a răspunde solicitării.

6. CONFIDENŢIALITATEA

Informaţia obţinută în baza prezentului Memorandum este secretă. Aceasta fiind supusă secretului de stat şi este protejată cel puţin cu acelaşi grad de confidenţialitate după cum este prevăzut de legislaţia naţională a Părţii solicitante pentru informaţia similară obţinută de la sursele naţionale,

7. PROCEDURI DE COMUNICARE

Părţile vor stabili de comun acord, în conformitate cu legislaţia statelor respective, modalităţile acceptabile de comunicare şi se vor consulta reciproc în vederea implementării prezentului Memorandum.

Fiecare dintre Părţi o va informa pe cealaltă în timp util cu privire la orice modificare a cadrului juridic precedent care ar putea afecta punerea în aplicare a prezentului Memorandum.

În cazul în care ambele Părţi sunt membri ai Grupului Egmont comunicare va avea loc prin intermediul sistemului Egmont Secure Web.

8. LIMBA ENGLEZĂ LIMBĂ OFICIALĂ DE COMUNICARE

Comunicarea dintre Părţi se va efectua în limba engleză.

9. REFUZUL ACORDĂRII ASISTENŢEI

Părţile nu au obligaţia de a oferi asistenţă în cazul în care:

(i) furnizarea de informaţii ar fi de natură să aducă atingere suveranităţii, securităţii, interesul naţional sau altor interese esenţiale ale ţării a Părţii solicitate.

(ii) Partea stabileşte că furnizarea informaţiei sau a documentelor solicitate ar putea prejudicia nejustificat investigaţia sau procedurile judiciare desfăşurate în ţara Părţii solicitate.

10. OBSERVAŢIE

În cazul în care Partea solicitată consideră că cererea nu poate fi satisfăcută, Partea solicitată va notifica în scris Partea solicitantă cît mai curând posibil despre decizia de a nu oferi informaţia sau pentru furnizarea parţială a ei.

11. COOPERAREA SUPLIMENTARĂ

Părţile vor discuta alte căi de cooperare între ele în prevenirea, detectarea şi descurajarea de spălare a banilor şi finanţării terorismului, cum ar fi schimbul de informaţii generice şi documentaţie privind spălarea banilor, finanţării terorismului şi alte infracţiuni conexe; analiza datelor şi informaţiilor privind tipologii, tendinţele în comiterea de infracţiunile menţionate; cele mai bune practici şi training-uri.

12. AMENDAMENTE

Prezentul Memorandum poate fi modificat de comun acord exprimat în scris al Părţilor, în orice moment, în care vor fi specificate amendamentele şi data la care vor intra in vigoare.

13. DATA INTRĂRII ÎN VIGOARE

Prezentul Memorandum este încheiat pe un termen nedeterminat şi intră în vigoare odată cu finalizarea procedurilor interne necesare intrării lui în vigoare de către Partea moldovenească şi trimiterii unei notificări în scris Părţii mexicane.

14. ÎNCETAREA

Prezentul Memorandum poate fi revocat în termen de trei (3) luni de la data primirii de către una dintre Părţi a notificării scrise din partea celeilalte Părţi cu privire la intenţia sa de a denunţa prezentul Memorandum.

Termenii şi condiţiile prezentului Memorandum care ţin de confidenţialitatea informaţiilor primite înainte de încetarea prezentului Memorandum vor rămâne în vigoare după încetarea prezentului Memorandum.

Semnat în două copii originale, în limbile spaniolă, engleză şi moldovenească, toate textele fiind egal autentice. În cazul apariţiei divergenţelor la interpretarea sau aplicarea prevederilor prezentului Memorandum, textul în limba engleză va fi de referinţă.

MEMORANDUM OF UNDERSTANDING

between the Center for Combating Economic Crimes and Corruption

of the Republic of Moldova and the Ministry of Finance and Public

Credit of the United Mexican States through the financial

intelligence unit and concerning cooperation in the

exchange of financial intelligence related to

money laundering and terrorist financing

The Center for Combating Economic Crimes and Corruption of the Republic of Moldova and the Ministry of Finance and Public Credit of the United Mexican States through the Financial Intelligence Unit, hereafter referred to as “the Parties” and individually “the Party”, desire, in a spirit of cooperation and mutual interest, and within the spirit of the framework of each Party′s national legislation, to cooperate in support of the investigation and prosecution of persons suspected of money laundering or the financing of terrorism and criminal activities related to money laundering or the financing of terrorism. To these purposes the Parties have reached the following understanding:

1. PARTIES

The Parties enter into the present Memorandum of Understanding (MOU) and will apply it according to the powers that their respective national legislation grants them for exchanging, requiring, receiving and keeping financial documentation and information for the development of intelligence activities in the prevention of money laundering and terrorism financing. Specifically:

a) The Ministry of Finance and Public Credit of the United Mexican States through the Financial Intelligence Unit is the competent Party to subscribe the present MOU, according with the Internal Rules of the Ministry of Finance and Public Credit.

b) The Center for Combating Economic Crimes and Corruption of the Republic of Moldova is the competent Party to subscribe the present MOU according to Law,

2. EXCHANGE OF INFORMATION

For the purposes of this MOU, “requesting Party” is the one that makes a request for the provision of information, or to which information is unilaterally disclosed, and “requested Party”, the one to which a request for information has been made, or which unilaterally discloses information.

The Parties will cooperate on the basis of reciprocity to assemble, develop and analyze information in their possession concerning financial transactions suspected of being related to money laundering or criminal activities connected with money laundering or the financing of terrorism. To that end, the Parties will exchange spontaneously or upon request presented by either one of the Parties, any available information that may be relevant to the investigations being developed by the requesting Party, on transactions, persons or entities, that could be involved in money laundering, terrorism financing or other crimes related to such offenses.

Within the limits of its legal power and with strict adherence to its legal framework, each one of the Parties, when receiving a request for information, will do its best efforts for obtaining and supplying the requested information.

3. JUSTIFICATION OF REQUEST

Subject to national legislation, the Requesting Party should disclose to the Requested Party at a minimum the reason for the request, the purpose for which the information will be used and enough information to enable the Requested Party to determine whether the request complies with national legislation. Any request for information will be justified by a brief statement of the underlying facts and sufficient elements for the identification of the transaction, person or entity referred to in the request.

4. DISCLOSURE OF INFORMATION

(a) Subject to 4(b), the information obtained from the Requested Parties will not be disseminated to any third party, nor be used for administrative, prosecutorial or judicial proceedings without the express prior and written consent of the Requested Party. The information and documentation exchanged by the Parties in application of this MOU may only be used for the development of intelligence.

(b) If a Party is subject to legal process or proceedings that would require the disclosure of information it has received from the Requested Party, the Party subject to such process or proceedings will immediately notify and seek the express and written consent of the other Party to disclose the information, and if consent has not been provided, such information shall not be disseminated.

(c) If there is a breach of confidentiality the aggrieved Party shall have the right to resort to the procedures set forth in the Egmont Group standards for resolving disputes and through consultation between the Parties.

5. USES OF DISCLOSED INFORMATION

Information contained in a request will only be used for purposes relevant to investigating or prosecuting a money laundering or terrorist financing offence. The Requested Party may not, without the express prior and written consent of the Requesting Party disclose information contained in the request for any purpose other than to obtain information in order to respond to the Request.

6. CONFIDENTIALITY

The information acquired in application of the present MOU is confidential. It is subject to official secrecy and is protected by at least the same confidentiality and applicable safeguards as provided by the national legislation of the Requesting Party for similar information obtained from national sources.

7. COMMUNICATION PROCEDURES

The Parties will jointly arrange, consistent with the legislation of their respective countries, for acceptable procedures of communication and will consult each other with the purpose of implementing this MOU,

Each one of the Parties will inform the other on a timely manner on any amendment to the former legal framework that could affect the application of this MOU.

If both Parties are members of the Egmont Group the communication will take place via the Egmont Secure Web system.

8. ENGLISH OFFICIAL LANGUAGE FOR COMMUNICATIONS

Communication between the Parties shall take place in the English Language.

9. REFUSAL FOR PROVIDING INFORMATION

The Parties are under no obligation to give assistance if:

(i) Provision of such information would be likely to prejudice the sovereignty, security, national interest or other essential interests of the country of the Requested Party.

(ii) The Party determines that the release of the information or documents requested may unduly prejudice an ongoing investigation or proceeding in the country of the Requested Party.

10. NOTICE

If the Requested Party is of the opinion that the request cannot be acceded to, the Requested Party will notify the Requesting Party in writing as soon as possible, its decision of not to provide the information or to provide only part of it.

11. FURTHER COOPERATION

The Parties will discuss other avenues of cooperation between them in prevention, detection and deterrence of money laundering and financing of terrorism such as the exchange of generic information and documentation on money laundering, terrorism financing and other related crimes; the analysis of data and information on typologies; trends in the commission of said crimes; best practices and training.

12. AMENDMENT

This MOU may be amended at any time by mutual written agreement of the Parties, in which the respective amendments and the date of their entry into force will be specified.

13. ENTERING INTO FORCE

This MOU is concluded for an indefinite period and shall enter into force, once the Moldovan Party fulfill their own internal procedures and send the Mexican Party a written notification.

14. TERMINATION

This MOU may be terminated three (3) months after the date of receiving by one Party of a written notification from the other Party concerning its intention to terminate this MOU.

The terms and conditions of this MOU dealing with confidentiality of information received prior to the termination of this MOU will remain in effect after the termination of this MOU and according with the national legislation applicable for each case.

Signed in three original copies in the Spanish, Moldovan and English languages, all texts being equally authentic. In case of disagreements concerning interpretation or applications of provision of this MOU, the Parties will follow the text in English.
