MEMORANDUM

de înţelegere între  Centrul  Naţional  Anticorupţie al Republicii Moldova şi

Serviciul de Monitorizare Financiară din cadrul Băncii Centrale a Republicii

Azerbaidjan privind cooperarea în schimbul de informaţii în scopul

prevenirii legalizării mijloacelor băneşti obţinute ilegal sau

altor bunuri şi finanţării terorismului

Centrul Naţional Anticorupţie al Republicii Moldova şi Serviciul de Monitorizare Financiară din cadrul Băncii Centrale a Republicii Azerbaidjan, denumite în continuare Părţi, doresc, în spiritul cooperării şi al interesului reciproc, în conformitate cu prevederile legislaţiei naţionale a fiecărei Părţi, să coopereze în scopul prevenirii legalizării mijloacelor băneşti sau altor bunuri obţinute ilegal şi finanţării terorismului (denumite în continuare ca «spălarea banilor sau finanţarea terorismului»), inclusiv schimbul de informaţii cu privire la crimele comise de spălare a banilor.

În acest scop, Părţile au convenit asupra următoarelor:

1. SCHIMBUL DE INFORMAŢII

Părţile vor colabora pe baza reciprocităţii la etapa colectării, prelucrării şi analizei informaţiei privind operaţiunile cu mijloace băneşti sau alte bunuri, în privinţa cărora există suspiciunea că sunt obţinute în rezultatul spălării banilor sau altor activităţi conexe infracţiunii de spălare a banilor sau finanţare a terorismului. Astfel, pentru obţinerea informaţiei Părţile vor transmite o cerere şi, totodată, vor oferi informaţii în cazul parvenirii unei cereri de la cealaltă Parte.

2. JUSTIFICARE SOLICITĂRII

Sub rezerva dreptului naţional, Partea solicitantă trebuie să informeze Partea solicitată referitor la motivul cererii sale, scopul în care va fi utilizată informaţia şi alte date necesare pentru stabilirea legalităţii informaţiei transmise. Solicitarea de informaţie va fi argumentată succint şi va conţine expunerea faptelor necesare.

3. TRANSMITEREA INFORMAŢIEI

(a) Sub rezerva 3 (b), informaţia obţinută de la una din Părţi nu poate fi transmisă unei părţi terţe, nu poate fi folosită în scopuri administrative, de învinuire sau judiciare fără consimţămîntul expres al Părţii interpelate. Informaţia obţinută în baza prezentului Memorandum poate fi utilizată în scopul de a sprijini investigaţiile care au legătură cu infracţiunea de spălare a banilor sau finanţarea terorismului şi alte activităţi criminale, în conformitate cu legislaţia naţională a fiecăreia dintre Părţi.

(b) În cazul în care o Parte este implicată într-un proces judiciar sau proceduri care ar cere divulgarea de informaţii pe care le-a primit de la altă Parte, Partea implicată în acest proces sau proceduri va notifica imediat şi va solicita acordul expres scris al celeilalte Părţi de a divulga informaţiile, şi dacă acordul nu a fost primit, vor fi luate eforturi rezonabile pentru a se asigura că informaţiile nu vor fi diseminate la orice terţ sau că limitările corespunzătoare sunt plasate vizavi de divulgare,

(c) Dacă se constată cazuri de lezare a confidenţialităţii informaţiei, Partea prejudiciată are dreptul de a recurge la procedurile prezentate în standardele Grupului Egmont pentru rezolvarea conflictului.

4. CONFIDENŢIALITATEA

Informaţia obţinută în baza prezentului Memorandum este secretă, fiind protejată cu acelaşi grad de confidenţialitate prevăzut de legislaţia naţională a Părţii solicitante pentru informaţia similară de la sursele naţionale.

5. LIMBA OFICIALĂ DE COMUNICARE

Cooperarea dintre Părţi se va efectua în limba engleză.

6. REFUZUL ACORDĂRII ASISTENŢEI

Părţile vor refuza acordarea asistenţei dacă:

(i) Informaţia solicitată prejudiciază suveranitatea, securitatea, interesul naţional sau alte interese importante a ţării Părţii solicitate.

(ii) Cererea de informaţii este contradictorie cu principiile generale ale sistemului legal al Părţii solicitate.

(iii) Partea solicitată stabileşte că furnizarea informaţiei solicitate ar putea prejudicia nejustificat investigaţia sau procedurile judiciare desfăşurate în ţara Părţii solicitate.

Dacă Partea solicitată consideră că cererea de informaţii nu poate fi satisfăcută, în termen de 15 zile, va notifica în scris Partea solicitantă.

7. COOPERAREA SUPLIMENTARĂ

Părţile vor discuta şi alte modalităţi de cooperare în scopul prevenirii, identificării şi curmării infracţiunilor de spălare a banilor şi finanţare a terorismului şi se vor consulta reciproc în vederea implementării prezentului Memorandum de înţelegere.

8. AMENDAMENTE

Prezentul Memorandum de înţelegere poate fi modificat de comun acord în orice moment, care vor lua forma unor protocoale separate şi care vor constitui o parte integranta a prezentului Memorandum.

9. DATA INTRĂRII ÎN VIGOARE

Prezentul Memorandum este încheiat pe un termen nelimitat şi intră în vigoare la data recepţionării ultimei notificări, prin canale diplomatice, despre îndeplinirea de către Părţi a procedurilor interne necesare intrării lui în vigoare.

10. ÎNCETAREA

Prezentul Memorandum poate fi denunţat în termen de trei (3) luni de la data primirii de către una din Părţi, prin canale diplomatice, a notificării scrise din partea celeilalte Părţi cu privire la intenţia sa de a denunţa prezentul Memorandum.

Termenii şi condiţiile prezentului Memorandum care ţin de confidenţialitatea informaţiilor primite înainte de încetarea prezentului Memorandum vor rămîne în vigoare după încetarea prezentului Memorandum.

Semnat la Strasbourg, la 4 decembrie 2012, în două exemplare originale, fiecare în limbile moldovenească, azeră şi engleză, toate textele fiind autentice. În cazul apariţiei divergenţelor de interpretare a prevederilor prezentului Memorandum, textul în limba engleză va fi de referinţă.

MEMORANDUM

of understunding between the National Anticorruption Centre of the Republic of Moldova

and the Financial Monitoring Service under the Central Bank of the Republic of

Azerbaijan on cooperation in the exchange of information related to the

prevention of the legalization of criminally obtained funds or other

property and the financing of terrorism

The National Anticorruption Centre of the Republic of Moldova and the Financial Monitoring Service under the Central Bank of the Republic of Azerbaijan, hereafter called «the Parties», desire, in a spirit of cooperation and mutual interest, and within the spirit of the framework of each Party′s national legislation, to cooperate in support of the prevention of the legalization of criminally obtained funds or other property and the financing of terrorism (hereafter referred to as «money laundering or the financing of terrorism»), as well as the exchange of information on committed crimes in respect of money laundering.

To these purposes the Parties have reached the following understanding;

1. EXCHANGE OF INFORMATION

The Parties will cooperate on the basis of reciprocity to assemble, develop and analyze information in their possession concerning financial transactions suspected of being related to money laundering or criminal activities connected with money laundering or the financing of terrorism. To that end, the Parties will make a request for the purpose mentioned in first sentence of this paragraph as well as provide mentioned information upon request or on their own initiative.

2. JUSTIFICATION OF REQUEST

Subject to national legislation, the Requesting Party should disclose to the Requested Party, as a rule, the reason for the request, the purpose for which the information will be used and enough information to enable the receiving party to determine whether the request complies with national legislation. Any request for information will be justified by a brief statement of the underlying facts.

3. DISCLOSURE OF INFORMATION

(a) Subject to 3(b), the information obtained from the Requesting Party upon the request will not be disseminated to any third party, nor be used for administrative, prosecutorial or judicial purposes without the express prior consent of the Requested Party. It is understood that information obtained in accordance with this Memorandum of Understanding can only be used in respect to money laundering or the financing of terrorism and for the prosecution as specified in the national legislation of the Parties.

(b) If Requesting Party is subject to legal process or proceedings that would require the disclosure of information it has received from the Requested Party, the Requesting Party subject to such process or proceedings will immediately notify and seek the express written consent of other Party to disclose the information, and if written consent has not been provided, reasonable efforts will be taken to ensure that the information will not be disseminated to any third party or that appropriate limitations are placed upon the disclosure.

(c) If there is a breach of confidentiality the aggrieved Party shall have the right to resort to the procedures set forth in the Egmont Group standards for resolving disputes.

4. CONFIDENTIALITY

The information acquired in application of the present Memorandum of Understanding is confidential. It is subject to official secrecy and is protected as a rule by the same confidentiality as provided by the national legislation of the Requesting Party for similar information from national sources.

5. OFFICIAL LANGUAGE

Communication between the Parties shall take place in the English language.

6. REFUSAL FOR PROVIDING INFORMATION

The Parties are under no obligation to give assistance if:

(i) Provision of such information would be likely to prejudice the sovereignty, security, national interest or other essential interests of the country of the Requested Party;

(ii) The request is contrary to the main principles of legal system of the country of the Requested Party;

(iii) The Requested Party determines that the release of the information or documents requested may unduly prejudice an investigation or proceeding in its country.

If the Requested Party is of the opinion that the request cannot be acceded, it will notify in 15 days the Requesting Party in writing.

7. FURTHER COOPERATION

The Parties will discuss other avenues of cooperation between them in prevention, detection and deterrence of money laundering and financing of terrorism and consult each other with the purpose of implementing this Memorandum of Understanding.

8. AMENDMENT

This Memorandum of Understanding may be amended at any time by mutual consent which shall be arranged as separate protocols, which would be an integral part of this Memorandum of Understanding.

9. EFFECTIVE DATE

This Memorandum of Understanding is concluded for an indefinite period and will become effective upon receiving of the last written notification through diplomatic channels, concerning the fulfillment by the Parties of internal procedures needed for their entering into force.

10. TERMINATION

This Memorandum of Understanding may be terminated three (3) months after the date of receiving by one Party of a written notification from the other Party through diplomatic channels concerning its intention to terminate this Memorandum of Understanding.

The terms and conditions of this Memorandum of Understanding dealing with confidentiality of information received during its implementation will remain in effect after the termination of this Memorandum of Understanding.

Signed at Strasburg, on 4 December 2012, in duplicate, each one in Moldavian, Azerbaijani and English languages, all texts being equally authentic. In case of any divergence in interpretation of provisions of the present Memorandum of Understanding, the English text shall prevail.
