MEMORANDUM*

de înţelegere între Centrul pentru combaterea Crimelor Economice şi Corupţiei,

Serviciul Prevenire şi Combaterea Spălării Banilor şi Serviciul de analiză

financiară privind cooperarea în domeniul schimbului de informaţii

referitoare la spălarea banilor şi finanţarea terorismului

Serviciul Prevenire şi Combaterea Spălării Banilor, subdiviziune a Centrului de Combatere a Crimelor Economice şi Corupţiei al Republicii Moldova şi Serviciul de analiză financiară al Departamentului Trezoreriei Statelor Unite ale Americii (numite în continuare în singular “autoritate” sau în mod colectiv “autorităţi”) doresc, în spiritul cooperării şi interesului reciproc, în conformitate cu cadrul legislativ naţional al fiecărei autorităţi, să faciliteze schimbul de informaţii în suportul investigaţiilor referitoare la spălarea banilor, finanţarea terorismului şi la crimele asociate cu acestea.

Cu acest scop Autorităţile, fără a avea intenţia de a crea un document cu efect juridic obligatoriu, dar pentru a facilita schimbul de informaţii menţionat mai sus, în cea mai mare măsură posibilă, au ajuns la următoarea înţelegere:

Schimbul de informaţii

1. În măsura permisă de legislaţia ţărilor lor, în corespundere cu politicile şi procedurile proprii, fiecare Autoritate va acorda la cererea alteia informaţiile de care va dispune, sau la care va avea accesul potrivit, sau care vor putea fi colectate, în conformitate cu legea şi care vor putea fi relevante pentru investigarea spălării banilor, finanţării terorismului sau a altor crime asociate. În conformitate cu legislaţia ţării sale, cu procedurile şi politicile proprii, fiecare Autoritate va putea prezenta atare informaţii altei Autorităţi în mod spontan. Autoritatea care se va adresa cu o atare interpelare, va dezvălui Autorităţii în cauză, cel puţin, cauzele pentru interpelare şi scopurile în care se vor utiliza informaţiile obţinute.

Utilizarea şi Dezvăluirea Informaţiilor Prezentate conform Interpelărilor sau în Mod Spontan

2(a). Autoritatea care va iniţia interpelarea, va utiliza şi va dezvălui informaţiile primite în răspuns la interpelare doar pentru scopurile şi doar părţilor indicate în interpelare, în modul consistent cu legislaţia ţării Autorităţii care prezintă interpelarea. În cazul prezentării informaţiei în mod spontan, Autoritatea primitoare va utiliza şi va dezvălui informaţia doar pentru scopurile şi doar părţilor indicate de Autoritatea-sursă.

2(b). Utilizarea sau dezvăluirea (inclusiv utilizarea sau dezvăluirea în cadrul proceselor administrative, de urmărire sau judiciare) a informaţiei de către Autoritatea primitoare în excesul limitelor prevăzute în paragraful 2(a) sunt interzise, excepţie făcând cazurile în care Autoritatea primitoare va obţine acordul preliminar în scris de la Autoritatea-sursă.

2(c). Fiecare Autoritate va include note de avertisment privind limitările de dezvăluire a informaţiei persoanelor terţe, inclusiv persoanelor terţe indicate în interpelările respective. Notele de avertisment trebuie să fie suficiente pentru a informa părţile terţe despre faptul că informaţia nu poate fi dezvăluită oricăror altor părţi fără consimţământul preliminar al Autorităţii-surse şi că informaţia în cauză nu poate fi utilizată ca dovadă în cadrul proceselor judiciare oficiale.

Utilizarea şi Dezvăluirea Informaţiilor Conţinute în Interpelări

3(a). Nimic din ceea ce se conţine în acest Memorandum de înţelegere (“Memorandum”) nu se va interpreta ca interzicere pentru Autoritatea interpelată de a transmite altor agenţii competente din cadrul Guvernului Autorităţii interpelate (I) esenţa interpelării pentru obţinerea informaţiei aferente, sau (II) datele de identificare a Autorităţii ce prezintă interpelarea şi persoanele individuale sau unităţile ce fac obiectul interpelării, pentru facilitarea coordonării între alte agenţii ale Guvernului Autorităţii interpelate.

3(b). În cazul în care Autoritatea interpelată va utiliza informaţiile conţinute în interpelarea primită pentru a iniţia măsuri legale (cum sunt blocarea activelor sau urmărirea lor), Autoritatea interpelată imediat şi în măsura permisă de legislaţia sa naţională va informa Autoritatea ce prezintă interpelarea despre acţiunile sale.

Dezvăluirea Cerută de Lege

4. În cazul în care Autoritatea este atrasă în oricare procese judiciare care ar putea necesita dezvăluirea informaţiei primite de la cealaltă Autoritate, Autoritatea atrasă în procese imediat o va informa pe cealaltă Autoritate şi va depune eforturile rezonabile pentru limitarea dezvăluirii informaţiei primite.

Confidenţialitatea

5. Toate informaţiile oferite şi primite de Autorităţi se vor păstra în condiţii de confidenţialitate strictă, pentru a se asigura ca ele să fie utilizate exclusiv în modul autorizat şi tratate cu confidenţialitate. Informaţiile ce fac obiectul acestui Memorandum se vor bucura de aceeaşi confidenţialitate care este prevăzută de legislaţia ţării Autorităţii primitoare pentru informaţiile similare obţinute din sursele interne.

Limitările

6. Nimic din ceea ce se conţine în acest Memorandum nu se va interpreta ca interdicţie pentru oricare Autoritate să acorde asistenţă altei Autorităţi, mai ales în cazurile iniţierii proceselor judiciare în baza unor şi aceleaşi fapte, sau dacă această asistenţă este contrară intereselor ţării Autorităţii interpelate. În cazul în care oricare din Autorităţi va decide să nu răspundă la interpelarea parvenită de la cealaltă Autoritate, Autoritatea interpelată o va notifica pe cealaltă Autoritate privind faptul că nu intenţionează să răspundă.

Forma de Corespondenţă

7. În măsura posibilă, toate interpelările, toate răspunsurile la interpelări, toate informaţiile, înştiinţările şi consimţămintele prevăzute în acest Memorandum se vor perfecta în formă scrisă, se vor reduce la forma scrisă sau se vor confirma în formă scrisă.

Modificările

8. Acest Memorandum poate fi oricând modificat prin consimţământul reciproc al ambelor Autorităţi perfectat în formă scrisă.

Perioada de aplicabilitate

9. Acest Memorandum va intra în vigoare din data semnării.

10. Acest Memorandum poate fi revocat la orice timp. Memorandumul se va considera reziliat din momentul primirii înştiinţării scrise de la cealaltă Autoritate. Cu toate acestea, dacă una din Autorităţi va dezvălui sau va utiliza informaţiile prezentate de cealaltă Autoritate în modul contrar prevederilor acestui Memorandum şi fără consimţământul altei Autorităţi, cealaltă Autoritate poate rezilia acest Memorandum cu efect imediat prin orice mijloace de comunicaţie. Termenii şi condiţiile acestui Memorandum referitoare la confidenţialitatea informaţiei primite până la rezilierea acestui Memorandum vor rămâne în vigoare şi după rezilierea acestui Memorandum.

Semnat la Serviciul de Analiză Financiară în Viena, VA, SUA, în două exemplare originale, fiecare în limbile moldovenească şi engleză, ambele fiind egal autentice. În cazul apariţiei divergenţilor la interpretarea sau aplicarea prevederilor prezentului Memorandum, textul în limba engleză va fi de referinţă.

MEMORANDUM

of understanding between the Center for Combating Economic Crimes and Corruption,

it′s division the Office for Prevention and Fight Against Money Laundering and the

Financial Crimes Enforcement Network Concerning Cooperation in the Exchange

of Information Related to Money Laundering and Terrorist Financing

The Center for Combating Economic Crimes and Corruption, it′s division the Office for Prevention and Fight of Money Laundering, and the Financial Crimes Enforcement Network, a bureau of the Department of the Treasury of the United States of America (hereinafter, each referred to as an «Authority» or collectively as «the Authorities») desire, in a spirit of cooperation and mutual interest and within the framework of each Authority′s national legislation, to facilitate the exchange of information in support of investigations related to money laundering, terrorist financing, and related crimes.

To that end, the Authorities, without the intent to create a legally binding document, but with the purpose of fostering said information exchange to the fullest extent possible, have reached the following understanding:

Information Exchange

1. To the extent authorized by the laws of its country, and consistent with its own policies and procedures, each Authority will provide upon request from the other any information in its possession, that it has access to, or that it is authorized by law to collect that may be relevant to the investigation of money laundering, terrorist financing, or related crimes. In accordance with the laws of its country and its own policies and procedures, each Authority may also spontaneously provide such information to the other. The requesting Authority should disclose to the requested Authority, at the minimum, the reason for the request and the purpose for which the information will be used.

Use and Disclosure of Information Provided Pursuant to a Request or Spontaneously

2(a). The requesting Authority will use and disclose the information provided in response to the request for information only for the purposes and only to the parties set forth in the request and as consistent with the legislation of the country of the requesting Authority. With regard to the spontaneous provision of information, the receiving Authority will use and disclose the information only for the purposes and only to the parties designated by the providing Authority.

2(b). The use or disclosure (including the use or disclosure in an administrative, prosecutorial, or judicial proceeding) of the provided information by the receiving Authority beyond that discussed in paragraph 2(a) is prohibited unless the receiving Authority obtains the prior consent of the providing Authority.

2(c). Each Authority will include warning notices on any responsive information that it provides to any third party, including any third party identified in a request for information. The notices should be sufficient to place third parties on notice that the information cannot be disclosed to any other party without the prior consent of the providing Authority and that the information cannot be used as evidence in formal judicial proceedings.

Use and Disclosure of Information Contained in a Request

3(a). Nothing in this Memorandum of Understanding («Memorandum») bars the requested Authority from transmitting to other appropriate agencies of the requested Authority′s government (i) the substance of the request to obtain information responsive to the request, or (ii) the identity of both the requesting Authority and the individual or entity that is the subject of the request to facilitate coordination between other appropriate agencies of the requested Authority′s government.

3(b). In the event that the requested Authority uses information contained in a request for information to initiate legal action (such as asset freezing or prosecution), the requested Authority will immediately and to the extent permitted under its national legislation inform the requesting Authority of said action.

Disclosure Required by Law

4. If an Authority is subject to legal process or proceedings that could require the disclosure of information it has received from the other Authority, the Authority subject to such process or proceedings will immediately notify the other Authority and make reasonable efforts to limit further disclosure of the information.

Confidentiality

5. All information exchanged by the Authorities will be subjected to strict controls and safeguards to ensure that the information is used only in an authorized manner and treated in a confidential manner. Exchanged information will be protected by the same confidentiality as provided by the legislation of the country of the receiving Authority for similar information received from domestic sources.

Limitations

6. Nothing in this Memorandum compels one Authority to lend assistance to the other Authority, especially when judicial proceedings have been initiated on the same facts in, or if such assistance is contrary to the interests of, the country of the requested Authority. If an Authority decides not to respond to a request for information from the other Authority, the Authority that received the request will notify the other Authority that it does not intend to respond.

Form of Correspondence

7. To the extent possible, all requests for information, responses to requests for information, exchanged information, notices, and consents provided pursuant to this Memorandum will be written, reduced to writing, or ultimately confirmed in writing.

Amendments

8. This Memorandum may be amended at any time by mutual written consent.

Period of Operation

9. The operation of this Memorandum will begin from the date of signing.

10. This Memorandum is revocable at any time. The termination will become effective as of the receipt of the written notification from the other Authority. However, if one Authority discloses or uses information provided by the other Authority in a manner contrary to the provisions of this Memorandum and without the consent of the other Authority, the other Authority may terminate the Memorandum immediately by any means of communication. The terms and conditions of this Memorandum dealing with the confidentiality of information received prior to the termination of this Memorandum will remain in force after the termination of this Memorandum.

Signed at the Financial Crimes Enforcement Network in Vienna, VA, USA in two original copies, each in Moldavian and English languages, both being the agreed authentic texts.

In case of disagreements concerning interpretation or applications of provisions of this Memorandum, the Authorities will follow the text in English.
