al Republicii Moldova şi Ministerul Economiei
al Republicii Slovenia

Ministerul Economiei şi Comerţului al Republicii Moldova şi Ministerul Economiei al Republicii Slovenia, denumite în continuare Părţi Contractante,
reafirmând relaţiile de prietenie dintre cele două state şi cetăţenii acestora;
dorind să promoveze dezvoltarea colaborării lor economice pe bază de interes reciproc şi egalitate;
luând în consideraţie beneficiul reciproc rezultat din creşterea relaţiilor comercial-economice şi dorind să întărească viitoarele relaţii de colaborare, în special prin intermediul susţinerii comerţului bilateral, legăturilor economice strânse şi a unei cooperări cât mai intense; şi
luând în consideraţie obligaţiile statelor rezultate din acordurile internaţionale la care sunt parte,
au convenit asupra celor ce urmează:
Articolul 1
Părţile Contractante vor depune maximum efort pentru a dezvolta şi întări la cel mai înalt nivel şi în toate domeniile colaborarea economică, care prezintă interes şi avantaj reciproc, ţinând cont de legile şi reglementările interne ale ambelor state precum şi obligaţiile asumate în baza tratatelor internaţionale la care subiecţi sunt ambele Părţi Contractante.
Articolul 2
1. Părţile Contractante vor contribui la crearea de condiţii favorabile pentru aprofundarea cooperării economice, în mod special prin:
- facilitarea şi susţinerea schimburilor şi contactelor dintre agenţii economici,
- încurajarea activităţii şi cooperării în domeniul turismului,
- promovarea şi atragerea investiţiilor străine,
- facilitarea schimbului economic şi informaţional,
- asistenţa reciprocă în organizarea târgurilor, expoziţiilor, simpozioanelor etc.;
- facilitarea schimbului de informaţii privind activităţile de pe piaţa internă, inclusiv normele referitor la protecţia consumatorului,
- crearea de condiţii favorabile pentru cooperarea în domeniul întreprinderilor mici şi mijlocii şi dezvoltării antreprenoriatului.
Articolul 3
În baza prezentului Memorandum, Părţile Contractante vor crea Comisia mixtă moldo-slovenă de competenţa căreia va ţine implementarea prevederilor prezentului Memorandum şi, în particular va exercita următoarele activităţi:
- identifica domeniile la care ar trebui să se extindă relaţiile de colaborare dintre Părţi, înainta propuneri de activitate şi recomandări pentru punerea lor în aplicare;
- elabora propuneri pentru ameliorarea posibilităţilor de cooperare dintre agenţii economici ale celor două state;
- face schimb de informaţii privind situaţia economică a celor două state, privind normele, programele economice şi alte informaţii de interes mutual;
- identifica problemele care împiedică desfăşurarea normală a comerţului bilateral şi a cooperării economice şi propune măsuri pentru soluţionarea lor; şi
- realizarea altor activităţi de interes reciproc.
Articolul 4
Comisia Mixtă este creată din reprezentanţii Părţilor Contractante, şi, în caz dacă e necesar pot fi invitaţi să participe de asemenea şi alţi reprezentanţi al sectorului privat sau public.
Articolul 5
1. Comisia Mixtă se va convoca o dată pe an sau când este necesar la cererea uneia dintre Părţile Contractante.
2. Părţile Contractante vor conveni perioada desfăşurării şi ordinea de zi a şedinţei Comisiei.
3. Partea gazdă va elabora un protocol privind desfăşurarea şi concluziile adoptate în cadrul şedinţei Comisiei Mixte, care se semnează de către preşedinţii ambelor delegaţii la sfârşitul întrunirii Comisiei.
Articolul 6
Fiecare din Părţile Contractante poate propune oricând amendamente la prezentul Memorandum prin canale diplomatice. Amendamentele vor intra în vigoare în conformitate cu punctul 1 al articolului 7.
Articolul 7
1. Prezentul Memorandum va intra în vigoare în prima zi a celei de a doua luni care urmează ultimei notificări, prin canale diplomatice, privind îndeplinirea de către Părţile Contractante a procedurilor interne necesare pentru intrarea lui în vigoare.
2. Prezentul Memorandum se încheie pe o perioadă de un an şi acţiunea lui se va prelungi automat pentru perioade consecutive de un an, dacă nici una dintre Părţile Contractante nu va notifica, prin canale diplomatice, cu şase luni înainte despre intenţia sa de a-l denunţa.
Întocmit la Ljubljana la 18 aprilie 2007, în două exemplare originale, fiecare în limbile moldovenească, slovenă şi engleză, toate textele fiind egal autentice. În caz de divergenţe la interpretarea sau aplicarea prevederilor prezentului Memorandum, textul în engleză va fi de referinţă.

on cooperation between the Ministry of the Economy and
Trade of the Republic of Moldova and the Ministry
of the Economy of the Republic of Slovenia
The Ministry of the Economy and Trade of the Republic of Moldova and the Ministry of the Economy of the Republic of Slovenia hereinafter referred to as the Contracting Parties.
confirming friendly relations between their states and their inhabitants;
wishing to promote the development of their economic cooperation in the fields of mutual interest on the basis of equality, mutual benefit and reciprocity:
taking into account mutual benefit arising from increased trade and the wish to strengthen further the relations, especially through the promotion of bilateral trade, economic ties and closer cooperation; and
taking into account the obligations of their states arising from international agreements,
have agreed as follows:
Article 1
The Contracting Parties shall, within the framework of their laws, regulations and other provisions and taking into account their international obligations and agreements, make their best efforts to develop and strengthen economic cooperation on the widest possible basis and in all the fields they deem to be of mutual interest and benefit.
Article 2
1. The Contracting Parties shall strive to create favorable conditions to strengthen economic cooperation, especially by:
- facilitating and supporting the exchange and contacts between their economic operators,
- encouraging cooperation and activities in the field of tourism, promoting and encouraging foreign investments,
- facilitating exchange of business and economic information,
- helping each other in the organization of fairs, exhibitions, symposiums etc.,
- facilitating the exchange of information on activities in the domestic market, including the rules regarding consumer protection,
- creating a favorable climate for the cooperation in the field of small and medium size enterprises and development of the entrepreneurship.
Article 3
To this end the Contracting Parties hereby establish the Joint Moldovan-Slovenian Commission which shall deal with the fields covered by this Memorandum and:
- identify the fields to which cooperation between the Contracting Parties is to be extended, propose measures and give recommendations for their implementation;
- prepare proposals for improving the possibilities of cooperation between the economic operators of the two states;
- exchange information on the economic situation in both states, on regulations, economic programs and other information of mutual interest;
- identify problems which hinder bilateral trade and economic cooperation and propose measures for their solution; and
- carry out other activities of mutual interest.
Article 4
The Joint Commission shall be composed of the representatives of the Contracting Parties and, where necessary, representatives of other establishments in the private or public sector may also be invited to participate.
Article 5
1. The Joint Commission shall meet as a rule once a year or when necessary on the request of either of the Contracting Parties.
2. The date of meeting and the agenda of the Joint Commission shall be agreed upon by both Contracting Parties.
3. The host Contracting Party shall prepare a final protocol based on the minutes of the course and conclusions of the meeting of the Joint Commission, which shall be signed by heads of both delegations at the end of the meeting.
Article 6
Either of the Contracting Parties may propose amendments to this Memorandum through diplomatic channels at any time. The amendments shall enter into force as provided in Article 7(1).
Article 7
1. This Memorandum shall enter into force on the first day of the second month after the day of receiving the last of the notes with which the Contracting Parties inform each other on the fulfillment of internal legal procedures required for this Memorandum to enter into force.
2. This Memorandum shall be valid for one year and shall be automatically extended for equal periods, unless either Contracting Parties notifies the other, through diplomatic channels, about its intention to terminate it, at least six months prior to the date of the said termination.
Done in duplicate in Ljubljana on april 18, 2007 in the Moldovan, Slovene and English languages, all text being equally authentic. In case of any divergence the English text shall prevail.
