de cooperare între Ministerul Economiei şi Comerţului al Republicii

Moldova şi Ministerul Economiei al Republicii Slovace

Ministerul Economiei şi Comerţului al Republicii Moldova şi Ministerul Economiei al Republicii Slovace (denumite în continuare “Părţi”),

dorind sa sprijine reciproc şi să fortifice cooperarea economică între ambele Părţi,

intenţionînd să dezvolte şi să intensifice cooperarea bilaterala bazată pe interesul reciproc în sfera economică, industrială, tehnică şi tehnologică,

fiind convinşi că consolidarea acestei cooperări va crea condiţii favorabile şi o bază adecvată pentru ulterioara lor dezvoltare,

conştienţi că acest Memorandum (denumit în continuare “Memorandum” va promova bunele relaţii între Părţi şi va crea condiţii favorabile pentru variate forme de cooperare între Republica Moldova şi Republica Slovacă,

fiind conştienţi de necesitatea stabilirii cadrului legal al relaţiilor bilaterale, în conformitate cu legislaţia în vigoare a statelor respective,

Au convenit următoarele:

Articolul 1

Ambele Părţi confirmă astfel interesul lor în dezvoltarea relaţiilor economice între Republica Moldova şi Republica Slovacă. În acest scop, în conformitate cu competenţele prevăzute în legislaţia statelor lor. Părţile vor sprijini reciproc continuarea unei cooperări intensive şi avantajoase între entităţile economice ale ambelor state.

Articolul 2

În conformitate cu competenţele sale, fiecare Parte va informa cealaltă Parte asupra posibilităţilor de dezvoltare a industriei şi a relaţiilor economice bilaterale, în particular în următoarele domenii:

a) resursele naturale,

b) industria constructoare de maşini,

c) sectoarele energetic şi electrotehnic,

d) cooperarea între întreprinderile mici şi mijlocii,

c) alte domenii de cooperare economică şi industrială, care pot fi stabilite pe bază de reciprocitate în temeiul prezentului Memorandum.

Articolul 3

1) În cadrul domeniilor menţionate în Articolul 2 al prezentului Memorandum, Părţile vor stabili relaţii economice reciproce referitor la următoarele activităţi şi se vor informa despre:

a) posibilităţile de cooperare în cadrul organizaţiilor internaţionale care ţin de competenţa lor,

b) legislaţia elaborată în domeniul de competenţă ale ambelor Părţi,

c) analize, evaluări şi prognoze privind dezvoltarea economiei lor,

d) măsuri elaborate privind politica de promovare a exporturilor,

e) dezvoltarea mediului investiţional şi a oportunităţilor economice şi investiţionale pe teritoriul ţărilor lor,

f) măsuri privind protecţia consumatorului,

g) condiţiile tehnice pentru produse,

h) demersuri posibile ale Republicii Moldova în raport cu aderarea la UCTE.

2) În conformitate cu priorităţile şi politica lor economică şi de dezvoltare, Părţile vor dezvolta o cooperare industrială, tehnică şi tehnologică în domeniul public, astfel, se va facilita o implicare mai activă a sectorului privat în dezvoltarea industrială şi tehnologică a ambelor state.

3) Părţile vor realiza activităţile menţionate mai sus ca relaţii normale de muncă prin intermediul schimbului de materiale corespunzătoare şi întrunirilor regulate în cadrul “Comisiei Mixte Consultative”, instituită în conformitate cu Articolul 4 al prezentului Memorandum.

Articolul 4

1) În scopul implementării prezentului Memorandum, Părţile vor crea “Comisia Mixtă Consultativă” (în continuare denumită “Comisia Consultativă”), şi vor include reprezentanţi ale ambelor Părţi. După necesitate, Comisia Consultativă, poate să includă reprezentanţi ai altor organizaţii şi instituţii, în vederea îndeplinirii obiectivelor acestui Memorandum.

2) Comisia Consultativă se va întruni după necesitate sau conform solicitării uneia dintre Părţi, pe teritoriul ţării solicitante.

3) Preşedinţii Comisiei Consultative sunt viceministrul economiei şi comerţului al Republicii Moldova şi Secretarul de Stat al Ministerului economiei al Republicii Slovace, sau un reprezentant numit de ei.

Articolul 5

În cazul apariţiei unor divergenţe în legătură cu aplicarea şi interpretarea prezentului Memorandum, acestea urmează a fi soluţionate pe calea negocierilor dintre Părţi.

Articolul 6

1) Prezentul Memorandum intră în vigoare la data primirii ultimei înştiinţări în scris, prin canale diplomatice, despre îndeplinirea de către Părţi a procedurilor interne necesare intrării în vigoare a prezentului Memorandum.

2) Prezentul Memorandum se încheie pe o perioadă de 5 ani şi va putea fi prelungit, în mod automat, pentru o altă perioadă de 5 ani, dacă nici una dintre Părţi nu-l va denunţa, cu un preaviz de cel puţin 6 luni, înainte de expirarea perioadei de valabilitate a Memorandumului.

3) Orice modificare sau completare este parte integrantă a prezentului Memorandum, care se negociază de către Părţi şi intră în vigoare conform procedurii menţionate în punctul 1 al prezentului Articol.

4) Obligaţiile asumate, neîndeplinite la data încetării acţiunii prezentului Memorandum, vor fi dirijate de prevederile acestuia pînă la îndeplinirea lor.

5) Prevederile prezentului Memorandum nu se vor aplica sau interpreta astfel încît să sublinieze sau în orice alt mod să afecteze asupra obligaţiilor Republicii Slovace, ce reies din statutul ei de membru al Uniunii Europene.

Întocmit la Bratislava, la 24 noiembrie 2008, în două exemplare originale, fiecare în limbile moldovenească, slovacă şi engleză, toate textele fiind egal autentice. În caz de divergenţe la interpretarea sau aplicarea prevederilor prezentului Memorandum, textul în limba engleză va fi de referinţă.

MEMORANDUM

on cooperation between the Ministry of Economy and Trade of the Republic

of Moldova and the Ministry of Economy of the Slovak Republic

The Ministry of Economy and Trade of the Republic of Moldova and the Ministry of Economy of the Slovak Republic (hereinafter referred to only as the “Parties”),

desirous to support and strengthen mutual economic cooperation between both Parties,

intending to develop and intensify mutual cooperation based on mutual interests in the economic, industrial, technical and technological spheres,

being convinced that the strengthening of such cooperation will create favorable conditions and suitable basis for their further development,

believing that this Memorandum (hereinafter referred to only as the “′Memorandum”) will promote good relations between the Parties and create favorable conditions for various forms of cooperation between the Republic of Moldova and the Slovak Republic,

being aware of the necessity of a corresponding legal basis for their mutual relations in accordance with the legal regulations in force in both respective states,

Have agreed as follows:

Article 1

Both Parties herby confirm their interest in the development of the economic relations between the Republic of Moldova and the Slovak Republic. For this purpose, within their competences as stipulated by legal regulations of their stales, they will mutually support the continuation of more intensive and advantageous cooperation between the economic entities of both states.

Article 2

Within its competence, each Party will inform the other Party of possible cooperation relating to the development of industry and mutual economic relations, in particular in the following areas:

a) natural resources,

b) engineering industry,

c) energy and electrical engineering industries,

d) cooperation between small-and medium-sized enterprises,

e) other areas of economic and industrial cooperation that may be mutually agreed upon on the basis of this Memorandum.

Article 3

1. Within the areas mentioned in Article 2 of this Memorandum, the Parties will develop mutual economic relations in the following activities and inform each other of:

a) possibilities of cooperation in international organizations under their competencies:

b) the prepared legislation in the area of competence of both Parties,

c) analyses, evaluations and prognoses of the development of their economies.

d) prepared measures relating to pro-export policies,

e) development of an investment environment and economic and investment opportunities within their stales,

f) measures relating to consumer protection,

g) technical requirements for products.

h) about possibilities due to the procedure of Republic of Moldova in relation to the annexation to the UCTE.

2. In accordance with their economic and development policies and priorities, the parties will develop industrial, technical and technological cooperation of the public sector and thus facilitate and develop a greater involvement of the private sector in the industrial and technological growth of both states.

3. The Parties will carry out the above activities as normal working relations by the means of exchange of appropriate materials and through regular meetings of a “Joint Consulting Commission” established in accordance with Article 4 of this Memorandum.

Article 4

1. For the purpose of implementation of this Memorandum, the Parties will establish a “Joint Consulting Commissions” (hereinafter referred to only as the “Consulting Commissions”) which consists of the representatives of both Parties. As needed, the Consulting Commissions may also include representatives of other organizations and institutions with the intention of helping to fulfill the objectives of this Memorandum.

2. The Consulting Commissions will meet as needed or as required by either of the Parties, in the territory of the state requesting the meeting.

3. The Chairmen of the Consulting Commissions are the Deputy Minister at the Ministry of Economy and trade of the Republic of Moldova and the State Secretary of the Ministry of Economy of the Slovak Republic or a representative appointed by them.

Article 5

Any eventual disputes arising from the interpretation or implementation of the provisions of the Memorandum will be addressed by mutual negotiations between the Parties.

Article 6

1. This Memorandum shall enter into force on the date of receipt of the latter notification through diplomatic channels by which either Party notifies the other Party that its internal legal requirements for the entry into force of this Memorandum have been fulfilled.

2. This Memorandum shall remain in force for a period of five (5) years and shall be extended thereafter for following five (5) years unless, six (6) months before the expiration of the initial or any subsequent period, either Party notifies the other Party of its intention to denounce the Memorandum.

3. Any amendments or additions to this Memorandum shall be an integral part hereof and shall be negotiated and enter into force as provided in Point 1 of the present Article.

4. Obligations already addressed but not yet completely fulfilled at the date of expiry of this Memorandum will be governed by the provisions hereof until completely fulfilled.

5. The provisions of this Memorandum will not be applied or interpreted so that they impair or otherwise affect the obligations of the Slovak Republic arising from its membership in the European Union.

Done and signed at Bratislava on 24 November 2008 in two originals in the Moldavian, Slovak and English languages, one for each Party.

All texts are equally authentic. In the event of divergence of interpretation of the respective provisions of this Memorandum, the English text shall prevail.
