Primul Amendament

la Acordul de asistenţă privind obiectivul de dezvoltare

pentru creşterea comerţului şi a investiţiilor în sectoarele-cheie

între

Guvernul Republicii Moldova, care acţionează prin intermediul Cancelariei de Stat

(în continuare “Beneficiar”)

şi

Guvernul Statelor Unite ale Americii, care acţionează prin intermediul

Agenţiei SUA pentru Dezvoltare Internaţională (“USAID”)

1. Scopul Amendamentului

Acest prim amendament (“Primul Amendament”) la Acordul de Asistenţă privind Obiectivul de Dezvoltare al USAID pentru Creşterea Comerţului şi a Investiţiilor în Sectoarele-Cheie, din 28 septembrie 2016 (conform modificării, “Acordul”), se incheie între USAID şi Beneficiar (“Părţi”) cu scopul de a adăuga Cinci Sute de Mii dolari SUA ($500,000), finanţare suplimentară sub formă de Grant şi de a modifica Planul Financiar. Această finanţare suplimentară va majora fondurile totale angajate pînă în prezent, în baza Acordului, în limita unei sume, care nu va depăşi Zece Milioane Opt Sute Şaptezeci şi Şapte de mii, Patru Sute Şaptezeci şi Şase dolari SUA ($10,877,476).

2. Finanţarea

Articolul 3, Secţiunea 3.1, paragraful (a), “Grantul”, se exclude, prin prezentul, în întregime, şi se înlocuieşte cu următoarele:

“(a) Grantul. Pentru a contribui la realizarea Obiectivelor definite în prezentul Acord, USAID, potrivit Legii din 1961 cu privire la Asistenţa Externă, cu modificările corespunzătoare, prin prezentul, îi acordă Beneficiarului, conform termenelor şi condiţiilor Acordului, suma care nu va depăşi Zece Milioane Opt Sute Şaptezeci şi Şapte de mii, Patru Sute Şaptezeci şi Şase dolari SUA ($10,877,476) (“Grantul”).”

3. Planul financiar

Planul Financiar al Acordului de Asistenţă privind Obiectivul de Dezvoltare 117-0002-EG-DOAG se exclude, prin prezentul, în întregime, şi se înlocuieşte cu o nouă Anexa 1, Planul Financiar, anexată la acest Amendament.

4. Alte Termene şi Condiţii

Cu excepţia modificărilor din prezentul Amendament, celelalte termene şi condiţii ale Acordului ramîn în vigoare şi neschimbate.

Guvernul Statelor Unite ale Americii şi Guvernul Republicii Moldova, fiecare acţionînd prin intermediul Reprezentanţilor Autorizaţi în mod corespunzător, au semnat în numele lor acest prim Amendament, care urmează să intre în vigoare la data de 15 martie 2017.

FIRST AMENDMENT TO THE

DEVELOPMENT OBJECTIVE GRANT AGREEMENT FOR I

NCREASED TRADE AND INVESTMENT TARGETED SECTORS

BETWEEN

The Government of the Republic of Moldova, acting through the State Chancellery

(hereinafter referred to as the “Grantee”)

AND

The Government of the United States of America, acting through the

United States Agency for International Development (“USAID”)

1. Purpose of the Amendment

This first amendment (the “First Amendment”) to USAID Development Objective Grant Agreement for Increased Trade and Investment in Targeted Sector, dated September 28, 2016 (as amended, the “Agreement”), is hereby entered into between USAID and the Grantee (the “Parties”) in order to add Five Hundred Thousand United States (“U.S.”) Dollars ($500,000) in incremental Grant funding; and amend the Financial Plan. This incremental addition of funds brings the total funds obligated to date under the Agreement to an amount not to exceed Ten Million, Eight Hundred Seventy Seven Thousand and Four Hundred Seventy Six United States (“U.S.”) Dollars ($10,877,476).

2. Financing

Article 3, Section 3.1, paragraph (a), “The Grant,” is hereby deleted in its entirety and replaced by the following:

“(a) The Grant. To help achieve the Objective set forth in this Agreement, USAID, pursuant to the Foreign Assistance Act of 1961, as amended, hereby grants to the Grantee under the terms of the Agreement not to exceed Ten Million, Eight Hundred Seventy Seven Thousand and Four Hundred Seventy Six United States (“U.S.”) Dollars ($10,877,476) (the “Grant”). “

3. Financial Plan

The Development Objective Grant Agreement 117-0002-EG-DOAG Financial Plan is hereby deleted in its entirety and a new Annex 1 Financial Plan, which is attached hereto, is hereby substituted with.

4. Other Terms and Conditions

Except as amended herein, all other terms and conditions of the Agreement remain in full force and effect.

In witness whereof, the Government of the United States of America and the Government of the Republic of Moldova, each acting through its respective duly authorized representatives, have caused this First Amendment to be signed and made effective as of the 15 day of March 2017.
