între Guvernul Republicii Moldova şi Guvernul Republicii Polone privind

aplicabilitatea, în relaţiile dintre Republica Moldova şi Republica Polonă,

a acordurilor internaţionale bilaterale încheiate între Uniunea

Republicilor Sovietice Socialiste şi Republica Polonă

(Republica Populară Polonă) în anii 1944-1991

Guvernul Republicii Moldova şi Guvernul Republicii Polone, denumite în continuare “Părţi Contractante”,

Dorind să determine scopul cadrului juridic al relaţiilor dintre cele două State,

Dorind să reglementeze statutul juridic al acordurilor încheiate în anii 1944-1991 între Uniunea Republicilor Sovietice Socialiste şi Republica Polonă (Republica Populară Polonă), în relaţiile dintre Republica Moldova şi Republica Polonă,

Au convenit asupra următoarelor prevederi:

Articolul 1

Următorul acord va continua să fie aplicat în relaţiile dintre Republica Moldova şi Republica Polonă:

Acordul între Guvernul Uniunii Republicilor Sovietice Socialiste şi Guvernul Republicii Populare Polone privind cooperarea în domeniul suprimării actelor ilegale de imixtiune în activitatea aviaţiei civile, încheiat la Moscova la 8 aprilie 1987 (cu excepţia punctului II din Protocolul la Acord).

Articolul 2

Părţile Contractante recunosc că acordurile încheiate între Uniunea Republicilor Sovietice Socialiste şi Republica Polonă (Republica Populară Polonă) în anii 1944-1991, care nu au fost menţionate la Articolul 1, nu au fost aplicate în relaţiile dintre Republica Moldova şi Republica Polonă şi, prin urmare sunt considerate ca fiind stinse.

Articolul 3

Prezentul Protocol va fi aprobat în conformitate cu legislaţia fiecărei Părţi Contractante, notificările relevante fiind efectuate printr-un schimb de note. Protocolul va intra în vigoare în următoarea zi după recepţionarea ultimei notificări.

Întocmit la Varşovia la 9 octombrie 2015, în două exemplare originale, fiecare în limbile română, poloneză şi engleză, toate textele fiind egal autentice. În caz de divergenţe la interpretarea prevederilor prezentului Protocol, textul în limba engleză va fi de referinţă.

PROTOCOL

between the Government of the Republic of Moldova and the Government of the Republic

of Poland concerning the applicability, in relations between the Republic of Moldova

 and the Republic of Poland, of bilateral international agreements concluded

between the Union of the Soviet Socialist Republics and the Republic

of Poland (the Polish People′s Republic) in the years 1944-1991

The Government of the Republic of Moldova and the Government of the Republic of Poland, hereinafter referred to as the “Contracting Parties”,

Desiring to determine the scope of treaty-based relations between the two States,

Desiring to regulate the legal status of agreements concluded in the years 1944-1991 between the Union of the Soviet Socialist Republics and the Republic of Poland (the Polish People′s Republic), in relations between the Republic of Moldova and the Republic of Poland,

Have agreed upon the following provisions:

Article 1

The following agreement shall continue to apply in relations between the Republic of Moldova and the Republic of Poland:

The Agreement between the Government of the Union of the Soviet Socialist Republics and the Government of the Polish People′s Republic concerning cooperation in the suppression of unlawful acts against the safety of civil aviation, done at Moscow on 8 April, 1987 (with exception of point II of the Protocol to the Agreement).

Article 2

The Contracting Parties acknowledge that agreements concluded between the Union of the Soviet Socialist Republics and the Republic of Poland (the Polish People′s Republic) in the years 1944-1991 which have not been referred to in Article 1, have not been applied in relations between the Republic of Moldova and the Republic of Poland and therefore are considered to be terminated.

Article 3

This Protocol shall be adopted pursuant to the laws of each of the Contracting Parties and acknowledged through an exchange of notes. The Protocol shall enter into force on the day following the day of the reception of the later note.

Done at Warsaw on 9^th October, 2015, in two original copies, each in the Romanian, Polish and English languages, all texts being equally authentic. In case of any differences in the interpretation of the provisions of this Protocol, the English text shall prevail.
