Protocol din 27.02.2009 între Guvernul Republicii Moldova şi Guvernul Republicii Bulgaria cu privire la colaborarea în domeniul dezvoltării societăţii informaţionale şi tehnologiei informaţiei

între Guvernul Republicii Moldova şi Guvernul Republicii Bulgaria

cu privire la colaborarea în domeniul dezvoltării societăţii

informaţionale şi tehnologiei informaţiei

Guvernul Republicii Moldova şi Guvernul Republicii Bulgaria, denumite în continuare Părţi,

recunoscând dezvoltarea rapidă şi continuă a tehnologiei informaţiei şi creşterea influenţei ei asupra economiei şi bunăstării sociale a populaţiei,

acceptând semnificaţia societăţii informaţionale şi a serviciilor acesteia pentru dezvoltarea durabilă a ambelor ţări,

luând în consideraţie politicile ambelor ţări pentru dezvoltarea oportună şi favorabilă a societăţii informaţionale şi tehnologiei informaţiei, reflectate în structura instituţională curentă a ambelor state,

dorind să accentueze noile domenii de colaborare apărute în domeniul menţionat,

referindu-se la articolele 6 şi 13 ale Acordului dintre Guvernul Republicii Moldova şi Guvernul Republicii Bulgaria de colaborare în domeniul serviciilor poştale, telecomunicaţiilor şi tehnologiei informaţiei, semnat la 20 mai 2004 la Sofia,

au convenit asupra următoarelor:

Articolul 1

Relaţiile dintre Părţi în domeniul societăţii informaţionale şi tehnologiei informaţiei vor fi realizate în conformitate cu prevederile propriilor legislaţii, Acordului de colaborare în domeniul serviciilor poştale, telecomunicaţiilor şi tehnologiei informaţiei în vigoare şi a prezentului Protocol.

Articolul 2

Colaborarea în domeniul societăţii informaţionale şi tehnologiei informaţiei se va efectua în următoarele domenii şi nu doar:

2.1. Dezvoltarea infrastructurii informaţionale.

2.2. Schimbul de experienţă în domeniul e-guvernare.

2.3. Schimbul de experienţă privind integrarea sistemelor informaţionale, inclusiv aria registrelor naţionale.

2.4. Armonizarea cadrului naţional de interoperabilitate cu cadrul european de interoperabilitate.

2.5. Schimbul de informaţii şi experienţă privind măsurile orientate pentru micşorarea decalajului digital.

2.6. Încurajarea parteneriatului public-privat în domeniul tehnologiei informaţiei.

2.7. Încurajarea participării în comun în proiecte ştiinţifice şi de cercetare în domeniul societăţii informaţionale şi tehnologiei informaţiei în cadrul programelor Uniunii Europene.

2.8. Transferul de experienţă a Republicii Bulgaria privind procesul de integrare europeană în domeniul tehnologiilor informaţionale şi de comunicaţii.

2.9. Schimbul de experienţă în domeniul securităţii informatice.

Articolul 3

3.1. Părţile vor desfăşura colaborarea prin:

3.1.1. Schimbul de informaţii şi documente în domeniul societăţii informaţionale şi tehnologiei informaţiei.

3.1.2. Organizarea şi/sau participarea la conferinţe, expoziţii, mese rotunde şi alte întruniri de lucru.

3.1.3. Atragerea investiţiilor în vederea realizării proiectelor comune în domeniile de colaborare, nominalizate în articolul 2 al prezentului Protocol.

3.1.4. Alte forme de colaborare convenite reciproc.

3.2. Prin prezentul Protocol şi Acordul dintre Guvernul Republicii Bulgaria şi Guvernul Republicii Moldova în domeniul serviciilor poştale, telecomunicaţiilor şi tehnologiei informaţiei şi în scopul coordonării activităţii de colaborare, părţile pot crea un Grup comun de lucru.

Articolul 4

Pentru corespondenţa legată de implementarea prezentului Protocol, ambele Părţi vor utiliza limbile engleză şi rusă, după cum vor stabili reciproc înainte de începerea fiecărei activităţi comune.

Articolul 5

Litigiile privind interpretarea şi aplicarea prezentului Protocol vor fi soluţionate de către Părţi pe calea negocierilor.

Articolul 6

Modificări şi/sau completări la prezentul Protocol pot fi făcute numai în urma unei propunerii în scris a uneia dintre părţi cu condiţia că au fost reciproc aprobate şi vor intra în vigoare conform alin.1 al articolului 8 al prezentului Protocol.

Articolul 7

7.1. Autorităţile competente responsabile de implementarea prezentului Protocol vor fi:

- În Republica Moldova: Ministerul Dezvoltării Informaţionale;

- În Republica Bulgaria: Agenţia de Stat pentru Tehnologia Informaţiei şi Comunicaţiilor.

7.2. În cazul intervenirii unor schimbări privind aceste autorităţi competente, Părţile se vor informa reciproc pe parcurs.

Articolul 8

8.1. Prezentul Protocol va intra în vigoare la data primirii, prin canale diplomatice, a ultimei notificări în scris privind îndeplinirea de către Părţi a procedurilor naţionale, necesare intrării lui în vigoare.

8.2. Prezentul Protocol se încheie pentru un termen de 5 ani şi acţiunea lui se va prelungi în mod automat pentru următoarele termene asemănătoare, dacă nici una din Părţi nu-l va denunţa în scris, prin canale diplomatice, cu cel puţin 6 luni înainte de expirarea acestei perioade.

8.3. Încetarea valabilităţii prezentului Protocol nu va afecta implementarea proiectelor care au fost convenite în timpul perioadei sale de valabilitate.

Întocmit la Chişinău la 27 februarie 2009, în două exemplare originale, fiecare în limbile moldovenească, bulgară şi engleză, toate textele fiind egal autentice. În cazul apariţiei unor divergenţe de interpretare sau aplicare a prevederilor prezentului Protocol, textul în limba engleză va prevala.

PROTOCOL

between the Government of the Republic of Moldova

and the Government of the Republic of Bulgaria on

cooperation in the field of information society

and information technology development

 

The Government of the Republic of Moldova and the Government of the Republic of Bulgaria hereinafter referred to as the Parties,

recognising the fast and continuing development of the information technology and its growing influence on the economy and the social welfare of the people,

acknowledging the significance of the information society and its services for the overall advanced development of the countries,

considering the policies of both countries for opportune and favourable development of the information society and information technology, reflected in the current institutional structure of the countries,

willing to emphasize newly emerged areas of cooperation in the abovementioned field,

referring to Articles 6 and 13 of the Agreement between the Government of the Republic of Moldova and the Government of the Republic of Bulgaria on Cooperation in the field of Postal Services, Telecommunications and Information Technology, signed on 20 May 2004 at Sofia,

have agreed on the following:

Article 1

The relations between the Parties in the field of information society and information technology shall be carried out according to the provisions of their national legislation, the Agreement between the Government of the Republic of Moldova and the Government of the Republic of Bulgaria on Cooperation in the field of Postal Services, Telecommunications and Information Technology in force and the present Protocol.

Article 2

Cooperation in the field of information society and information technology shall focus, without limitation, on the following:

2.1. Information infrastructure development.

2.2. Exchange of experience in e-governance.

2.3. Exchange of information and experience regarding the integration of information systems, including the area of national registers.

2.4. Harmonization on national interoperability framework with the European interoperability framework.

2.5. Exchange of information and experience on measures orientated to bridging the digital divide.

2.6. Encouraging the public-private partnership in the field of information technology.

2.7. Encouraging the joint participation in scientific and research projects in the field of information society and information technology in the European research programmes.

2.8. Sharing the Bulgarian experience in the European integration process in the field of information technology and communications.

2.9. Exchange of experience in cyber security.

Article 3

3.1. The Parties will develop co-operation by:

3.1.1. Exchange of information and documentation in the field of information society and information technology development.

3.1.2. Organization of and/or participation in conferences, exhibitions, round tables and other work meetings.

3.1.3. Attraction of investments in order to realize common projects in the fields of cooperation as stated in Article 2 of this Agreement.

3.1.4. Other types of cooperation as mutually agreed.

3.2. In order to coordinate the cooperation activities under this Protocol and the Agreement in force between the Government of the Republic of Moldova and the Government of the Republic of Bulgaria on cooperation in the field of postal services, telecommunications and information technology the Parties may establish a Joint Working Group for cooperation.

Article 4

For correspondence related to the implementation of the present Protocol the two Parties shall use English or Russian language as mutually agreed before commencement of each joint activity.

Article 5

The Parties shall settle all disputes that may arise concerning the interpretation and application of this Protocol by means of negotiation.

Article 6

Amendments and/or supplements to the present Protocol can be made only upon written proposal of any party provided that they have been mutually agreed and shall enter into force in accordance with Paragraph 1 of Article 8 of this Protocol.

Article 7

7.1. The competent authorities responsible for the implementation of this Protocol shall be:

- In the Republic of Moldova: the Ministry of Information Development;

- In the Republic of Bulgaria: the State Agency for Information Technology and Communications.

7.2. In case of any change relating to these competent authorities the Parties shall notify each other in due course.

Article 8

8.1. This Protocol shall become effective on the day of receipt of the second of the diplomatic notes by which the Parties notify each other on the completion of their respective national procedures for enforcing the Protocol.

8.2. This Protocol shall be valid for a period of 5 years and shall be automatically renewed for further periods of the same duration, unless either Party denounces it in writing, through diplomatic channels, at least 6 months before expiry of each period.

8.3. The termination of this Protocol shall not affect the duration or validity of any activities or projects, which are in progress at the time of the notification of termination of the Protocol.

Done at Chisinau in 27 February 2009 in two original copies, each in Moldavian, Bulgarian and English languages, all texts being equally authentic and having the same value. In case of divergences of interpretation or application of this Protocol, the English text shall prevail.
