Statele-membre ale GUAM, părţi ale Acordului privind crearea zonei de comerţ liber între statele-membre GUUAM, denumite în continuare Părţi contractante,
dorindu-şi să dezvolte o cooperare comercial-economică reciproc avantajoasă,
luînd în considerare necesitatea coordonării acţiunilor Părţilor contractante de a crea un mecanism adecvat şi eficient pentru funcţionarea unei zone de comerţ liber,
în conformitate cu articolul 2 al Acordului privind crearea zonei de comerţ liber între statele-membre GUUAM (în continuare – Acord),
au convenit după cum urmează:
1. Se aprobă Regulamentul privind crearea şi funcţionarea Organului de lucru care va coordona acţiunile părţilor la Acordul privind crearea zonei de comerţ liber între statele-membre ale GUUAM (se anexează), ce constituie parte integrantă a prezentului Protocol.
2. Prezentul Protocol intră în vigoare din data remiterii pentru păstrare depozitarului a ultimei notificări în scris privind îndeplinirea procedurilor interne necesare pentru intrarea în vigoare a acestui Protocol.
3. Cu acordul comun al Părţilor contractante în prezentul Protocol pot fi introduse modificări şi completări, care vor fi întocmite în protocoale separate, ce constituie parte integrantă a acestuia, şi care vor intra în vigoare în conformitate cu punctul 2 al prezentului Protocol.
4. Prezentul Protocol este valabil pe durata termenului de valabilitate a Acordului dacă Părţile nu vor lua o altă decizie.
5. Întocmit la Kiev, la 27 martie 2017, într-un singur exemplar original, în limbile engleză şi rusă, precum ambele texte fiind egal autentice. Depozitarul prezentului Protocol este Guvernul Georgiei, care va remite Părţilor contractante copia certificată al acestuia.

REGULAMENT
privind crearea şi funcţionarea Organului de lucru care va coordona
acţiunile Părţilor contractante la Acordul privind crearea zonei de
comerţ liber între statele-membre ale GUUAM din 20 iulie 2002
Organul de lucru care va coordona acţiunile Părţilor contractante la Acordului privind crearea zonei de comerţ liber între statele-membre ale GUUAM din 20 iulie 2002 (în continuare – Organ de lucru) este un organ special creat pentru a supraveghea punerea în aplicare a Acordului Părţilor contractante, să elaboreze propuneri pentru dezvoltarea cooperării comercial-economice, coordonarea problemelor, de coordonarea politicilor economice, cu scopul de a soluţiona operativ problemele actuale în comerţul reciproc între Părţile contractante.
Organul de lucru în activitatea sa se ghidează de documentele fundamentale ale GUAM, Acordul privind crearea zonei de comerţ liber între statele-membre ale GUUAM (în continuare – Acordul), de alte tratate şi acorduri încheiate în cadrul GUAM.
I. SARCINILE, FUNCŢIILE ŞI DREPTURILE ORGANULUI DE LUCRU
Principalele sarcini şi funcţii ale Organului de lucru sunt:
- organizarea interacţiunii dintre Părţile contractante, în vederea punerii în aplicare a prevederilor Acordului;
- examinarea problemelor actuale în realizarea Acordului şi elaborarea propunerilor respective urmare rezultatelor studiului lor;
- să promoveze cooperarea dintre Părţile contractante privind schimbul de informaţii referitor la implementarea prevederilor Acordului;
- examinarea situaţiei cooperării comercial-economice între Părţile contractante şi pregătirea propunerilor privind dezvoltarea acesteia.
În scopul realizării sarcinilor şi funcţiilor sale, Organul de lucru, dacă este necesar, are dreptul de a crea grupuri de lucru pentru elaborarea recomandărilor pentru soluţionarea problemelor ce decurg din punerea în aplicare a Acordului. Condiţiile, durata de funcţionare, precum şi mandatul acesor grupuri de lucru, trebuie să fie stabilite de Organul de lucru.
II. ACTIVITATEA ORGANULUI DE LUCRU
1. Componenţa Organului de lucru.
Organul de lucru este format din reprezentanţii autorizaţi ai Părţilor contractante şi care sunt membrii ai Organului de lucru.
Preşedinţia în Organul de lucru se desfăşoară succesiv de reprezentanţii Părţilor contractante prin rotaţie, în ordinea alfabetică a denumirilor Părţilor contractante, pentru o perioadă de un an calendaristic.
2. Funcţiile membrilor Organului de lucru:
- participarea la pregătirea şedinţelor Organului de lucru, inclusiv iniţierea desfăşurării reuniunii;
- luarea deciziilor privind ordinea de zi a şedinţelor Organului de lucru;
- dacă este necesar, pentru a asigura o conciliere organizată şi de lucru pe probleme de realizare a Acordului în cadrul statului, din care reprezentantul este delegat.
3. Funcţiile preşedintelui Organului de lucru:
- organizarea şedinţelor Organului de lucru;
- întocmirea şi coordonarea ordinii de zi a şedinţelor Organului de lucru;
- cooperarea cu Secretariatul GUAM, în scopul asigurării activităţii Organului de lucru.
4. Forma de muncă a Organului de lucru.
Principala formă de activitate a Organului de lucru sunt şedinţele care se desfăşoară în funcţie de necesităţi.
Organul de lucru poate lua decizii în baza notificărilor în scris. În aceste cazuri proiectul deciziei este transmis prealabil spre examinare de către preşedintele Organului de lucru tuturor reprezentanţilor părţilor participante.
Deciziile Organului de lucru se adoptă prin consens şi poartă caracter de recomandare pentru Părţile contractante.
III. FINANŢAREA ACTIVITĂŢII ORGANULUI DE LUCRU
Cheltuielile pentru desfăşurarea şedinţelor Organului de lucru se efectuează în conformitate cu Articolul 12 din Regulamentul privind Grupul de lucru sectorial al Organizaţiei pentru Democraţie şi Dezvoltare Economică - GUAM (New York, 25 septembrie 2006).
IV. DISPOZIŢII GENERALE
Limbile de lucru ale Organului de lucru sunt engleza şi rusa.

Parties of the Agreement on Establishment of Free Trade Area
among the GUUAM Participating Statesof 20 July 2002
GUAM Member States, Parties to the Agreement on Establishment of Free Trade Area among the GUUAM Participating States – hereinafter referred to as Contracting Parties,
striving to develop mutually beneficial trade and economic cooperation,
taking into account the need for the coordination of the actions of the Contracting Parties and for the establishment of a proper and effective mechanism for the functioning of a free trade area,
in accordance with Article 2 of the Agreement on Establishment of Free Trade Area among the GUUAM Participating States (hereinafter – Agreement),
have agreed as follows:
1. To approve the Regulations on the establishment and activity of the Working Body coordinating the actions of the Contracting Parties of the Agreement on Establishment of Free Trade Area among the GUUAM Participating States (annexed), which are an integral part of this Protocol.
2. This Protocol shall enter into force on the date of deposit of the last notification of the Contracting Parties on the completion of the internal procedures necessary for the entry into force of this Protocol.
3. Based on a mutual consent of the Contracting Parties this Protocol may be amended and supplemented, by means of separate protocols, being its integral part, which shall enter into force in accordance with paragraph 2 of this Protocol.
4. This Protocol shall be valid for the duration of the Agreement, unless the Contracting Parties agree otherwise.
5. Done in Kyiv 27 March 2017, in one original copy in the English and Russian languages, both texts being equally authentic. Depositary of this Protocol is the Executive Power of Georgia, which shall send a certified copy thereof to the Contracting Parties.

THE REGULATIONS
on the establishment and activity of the Working Body coordinating
the actions of the Contracting Parties of the Agreement on Establishment
of Free Trade Area among the GUUAM Participating States of 20 July 2002
The Working Body, coordinating the actions of the Contracting Parties of the Agreement on Establishment of Free Trade Area among the GUUAM Participating States (hereinafter – the Working Body), is a specially established body to monitor the implementation of the Agreement by the Contracting Parties, to elaborate proposals for the development of trade and economic cooperation, to discuss issues, to coordinate economic policy with the aim of prompt consideration of topical issues related to mutual trade among the Contracting Parties.
The Working Body is guided in its activity by the founding documents of GUAM, by the Agreement on Establishment of Free Trade Area among the GUUAM Participating States (hereinafter the Agreement), by other treaties and agreements concluded within the framework of GUAM.
I. TASKS, FUNCTIONS AND RIGHTS OF THE WORKING BODY
The main tasks and functions of the Working Body are:
– organization of interaction among the Contracting Parties with the aim of implementation of the provisions of the Agreement;
– consideration of topical issues of the implementation of the provisions of the Agreement and the preparation of relevant proposals based on the results of their study;
– promotion of the cooperation of the Contracting Parties in the exchange of information on the issues of implementation of the provisions of the Agreement;
– consideration of the state of trade and economic cooperation among the Contracting Parties and preparation of proposals concerning its development.
With the aim of realization of its tasks and functions, the Working Body, has the right to establish as necessary working groups for the elaboration of recommendations with the aim of solving issues arising in the process of implementation of the Agreement. The conditions and terms of the activity, as well as the mandate of such established working groups shall be defined by the Working Body.
II. THE ACTIVITY OF THE WORKING BODY
1. Composition of the Working Body.
The Working Body is composed of authorized representatives of the Contracting Parties, who are the members of the Working Body.
Presidency in the Working Body shall be held alternately by representatives of the Contracting Parties on the basis of the principle of rotation, in Latin alphabetical order according to the names of the Contracting Parties for a period of one calendar year.
2. Functions of the members of the Working Body:
– participation in the preparation of conducting the meetings of the Working Body, including initiation of conducting the meeting;
– decision making on the issues of the agenda of the meetings of the Working Body;
– as necessary, ensuring organizational and conciliation work concerning the issues of implementation of the Agreement within the state, from which the representative was delegated.
3. Functions of the Chair of the Working Body:
– organization of the meetings of the Working Body;
– formation and negotiation of the agenda of the meetings of the Working Body;
– interaction with the Secretariat of GUAM with the aim to ensure the operation of the Working Body.
4. Form of activity of the Working Body.
The main form of activity of the Working Body is meetings which are held as necessary.
The Working Body can make decisions based on the written procedures. In such cases, a preliminary draft decision is sent by the Chair of the Working Body to the representations of all parties involved for their consideration.
Decisions of the Working Body are taken based on consensus and have a form of recommendation for the Contracting Parties.
III. FINANCING OF THE OPERATION OF THE WORKING BODY
The costs for conducting the meetings of the Working Body are borne in accordance with Article 12 of the Provision on the Sectoral Working Group of the Organization for Democracy and Economic Development – GUAM (New York, 25 September 2006).
IV. GENERAL PROVISIONS
Working languages of the Working Body are English and Russian.
