Protocolul opţional din 16.12.1966 la Pactul internaţional cu privire la drepturile civile şi politice

PROTOCOLUL OPŢIONAL

la Pactul Internaţional cu privire la drepturile civile şi politice

Adoptat şi deschis pentru semnare, ratificare şi aderare de către Rezoluţia Adunării Generale 2200 A (XXI) la 16 decembrie 1966.

Statele-părţi la prezentul Protocol,

considerând că, pentru o mai bună asigurare a îndeplinirii scopurilor Pactului cu privire la drepturile civile şi politice (denumit mau jos Pactul) şi aplicarea acestor prevederi, ar fi indicată împuternicirea Comitetului drepturilor omului, constituit conform părţii a patra a Pactului (denumit mai jos Comitet), să primească şi să examineze, astfel cum se prevede în prezentul Protocol, comunicări provenite de la persoanele fizice care pretind că sunt victime ale unor violări ale unuia dintre drepturile enunţate în pact,

au convenit următoarele:

Articolul 1

Orice stat-parte la Pact care devine parte la prezentul Protocol recunoaşte competenţa Comitetului de a primi şi a examina comunicări provenite de la persoane fizice ţinând de jurisdicţia sa, care pretind a fi victime ale unor violări, de către acest stat-parte, a vreunuia dintre drepturile enunţate în Pact. Comitetul nu va primi nici o comunicare privind statul-parte la Pact care nu este parte la prezentul Protocol.

Articolul 2

Sub rezerva prevederilor articolului 1, orice persoană fizică, care pretinde a fi victima unei violări a vreunui drept enunţat în Pact şi care a epuizat toate căile interne de recurs poate prezenta o comunicare scrisă Comitetului în vederea examinării sale.

Articolul 3

Comitetul va declara inadmisibil orice comunicare prezentată în temeiul prezentului Protocol, care este anonimă sau pe care el o consideră a fi un abuz al dreptului de a prezenta astfel de comunicări sau a fi incompatibilă cu prevederile Pactului.

Articolul 4

1. Sub rezerva articolului 3, Comitetul aduce orice comunicare care i se prezintă în temeiul prezentului Protocol, la cunoştinţa statului-parte la acest Protocol, despre care se pretinde că a violat o prevedere a Pactului.

2. În următoarele 6 luni statul respectiv prezintă în scris Comitetului explicaţii sau declaraţii de elucidare a problemei, cu indicarea, dacă este cazul, a măsurilor luate pentru remedierea situaţiei.

Articolul 5

1. Comitetul examinează comunicările primite în temeiul prezentului Protocol ţinând seama de toate informaţiile scrise care i-au fost puse la dispoziţie de către persoana fizică şi de către statul-parte interesat.

2. Comitetul nu va analiza nici o comunicare a unei persoane fizice fără a se fi asigurat că:

a) aceeaşi chestiune nu se află deja în curs de examinare în cadrul altei proceduri internaţionale de investigare şi soluţionare;

b) persoana fizică a epuizat toate căile interne de recurs disponibile. Această regulă nu se aplică dacă procedurile de recurs depăşesc termenele rezonabile.

3. Comitetul ţine şedinţe închise în timpul examinării comunicărilor prevăzute în prezentul Protocol.

4. Comitetul comunică constatările sale statului-parte interesat şi persoanei fizice.

Articolul 6

Comitetul include în raportul anual pe care îl întocmeşte, conform articolului 45 din Pact, un rezumat al activităţilor sale în baza prezentului Protocol.

Articolul 7

Până la îndeplinirea obiectivelor Rezoluţiei nr.1514 (XV), adoptată de Adunarea Generală a Naţiunilor Unite la 14 decembrie 1960, privind Declaraţia asupra acordării independenţei ţărilor şi popoarelor coloniale, prevederile prezentului Protocol nu restrâng cu nimic dreptul de petiţionare acordat acestor popoare de Carta Naţiunilor Unite şi de alte convenţii şi instrumente internaţionale încheiate sub auspiciile Organizaţiei Naţiunilor Unite sau ale instituţiilor sale specializate.

Articolul 8

1. Prezentul Protocol este deschis pentru semnare oricărui stat care a semnat Pactul.

2. Prezentul Protocol este supus ratificării oricărui stat care a ratificat Pactul sau care a aderat la acesta. Instrumentele de ratificare vor fi depuse la Secretarul General al Organizaţiei Naţiunilor Unite.

3. Prezentul Protocol va fi deschis aderării oricărui stat care a ratificat Pactul sau care a aderat la acesta.

4. Aderarea se va face prin depunerea unui instrument de aderare la Secretarul General al Organizaţiei Naţiunilor Unite.

5. Secretarul General al Organizaţiei Naţiunilor Unite informează toate statele care au semnat prezentul Protocol sau care au aderat la acesta despre depunerea fiecărui instrument de ratificare sau de aderare.

Articolul 9

1. Sub rezerva intrării în vigoare a Pactului, prezentul Protocol va intra în vigoare la 3 luni după data depunerii la Secretarul General al Organizaţiei Naţiunilor Unite a celui de-al zecelea instrument de ratificare sau de aderare.

2. Pentru fiecare dintre statele care vor ratifica prezentul Protocol sau care vor adera după depunerea celui de-al zecelea instrument de ratificare, Protocolul va intra în vigoare la 3 luni de la data depunerii de către acest stat a instrumentului său de ratificare sau de aderare.

Articolul 10

Prevederile prezentului Protocol se aplică, fără nici o limitare sau excepţie, tuturor părţilor constitutive ale statelor federale.

Articolul 11

1. Orice stat-parte la prezentul Protocol poate să propună un amendament şi să depună textul acestuia la Secretariatul General al Organizaţiei Naţiunilor Unite. Secretarul General transmite apoi toate proiectele de amendamente statelor-părţi la prezentul Protocol, cerându-le să-i comunice dacă doresc a le supune votării. Dacă cel puţin o treime din state se declară în favoarea acestei convocări, Secretarul General convoacă conferinţa sub auspiciile Organizaţiei Naţiunilor Unite. Orice amendament adoptat de majoritatea statelor prezente şi votante la conferinţă va fi supus pentru aprobare Adunării Generale a Naţiunilor Unite.

2. Aceste amendamente intră în vigoare după ce au fost aprobate de Adunarea Generală a Naţiunilor Unite şi acceptate de o majoritate de două treimi din statele-părţi la prezentul Protocol, conform regulilor constituţionale respective.

3. După intrarea lor în vigoare, aceste amendamente devin obligatorii pentru statele-părţi care le-au acceptat, celelalte state-părţi rămânând legate prin prevederile prezentului Protocol şi prin orice amendament anterior pe care l-au acceptat.

Articolul 12

1. Orice stat-parte poate denunţa, în orice moment prezentul Protocol pe calea unei notificări scrise adresate Secretarului General al Organizaţiei Naţiunilor Unite. Denunţarea va produce efecte la 3 luni de la data la care Secretarul General a fi primit notificarea.

2. Denunţarea nu va împiedica aplicarea prevederilor prezentului Protocol faţă de orice comunicare prezentată în temeiul articolului 2, înainte de data la care denunţarea produce efecte.

Articolul 13

Independent de notificările prevăzute la paragraful 5 al articolului 8 al prezentului Protocol, Secretarul General al Organizaţiei Naţiunilor Unite va informa toate statele la care se referă paragraful 1 al articolului 48 din Pact:

a) despre semnăturile depuse pe prezentul Protocol şi despre instrumentele de ratificare şi de aderare depuse conform articolului 8;

b) despre data la care prezentul Protocol va intra în vigoare conform articolului 9 şi data la care vor intra în vigoare amendamentele prevăzute la articolul 11;

c) despre denunţările făcute în conformitate cu articolul 12.

Articolul 14

1. Prezentul Protocol, ale cărui texte în limbile chineză, engleză, franceză, rusă şi spaniolă sunt în egală măsură autentice, va fi depus la arhivele Organizaţiei Naţiunilor Unite.

2. Secretarul General al Organizaţiei Naţiunilor Unite va transmite cîte o copie certificată a prezentului Protocol tuturor statelor la care se referă articolul 48 din Pact.

DREPT CARE subsemnaţii, fiind autorizaţi în mod corespunzător de Guvernele lor respective, au semnat prezentul Protocol, deschis spre semnare la New York, în ziua de nouăsprezece a lunii decembrie, una mie nouă sute şi şaizeci şi şase.

OPTIONAL PROTOCOL

TO THE INTERNATIONAL COVENANT

ON CIVIL AND POLITICAL RIGHTS

New York, December 16, 1966.

The States Parties to the present Protocol,

considering that in order further to achieve the purposes of the Covenant on Civil and Political Rights (hereinafter referred to as the Covenant) and the implementation of its provisions it would be appropriate to enable the Human Rights Committee set up in part IV of the Covenant (hereinafter referred to as the Committee) to receive and consider, as provided in the present Protocol, communications from individuals claiming to be victims of violations of any of the rights set forth in the Covenant,

have agreed as follows:

Article 1

A State Party to the Covenant that becomes a party to the present Protocol recognizes the competence of the Committee to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by that State Party of any of the rights set forth in the Covenant. No communication shall be received by the Committee if it concerns a State Party to the Covenant which is not a party to the present Protocol.

Article 2

Subject to the provisions of article 1, individuals who claim that any of their rights enumerated in the Covenant have been violated and who have exhausted all available domestic remedies may submit a written communication to the Committee for consideration.

Article 3

The Committee shall consider inadmissible any communication under the present Protocol which is anonymous, or which it considers to be an abuse of the right of submission of such communications or to be incompatible with the provisions of the Covenant.

Article 4

1. Subject to the provisions of article 3, the Committee shall bring any communications submitted to it under the present Protocol to the attention of the State Party to the present Protocol alleged to be violating any provision of the Covenant.

2. Within six months, the receiving State shall submit to the Committee written explanations or statements clarifying the matter and the remedy, if any, that may have been taken by that State.

Article 5

1. The Committee shall consider communications received under the present Protocol in the light of all written information made available to it by the individual and by the State Party concerned.

2. The Committee shall not consider any communication from an individual unless it has ascertained that:

(a) The same matter is not being examined under another procedure of international investigation or settlement;

(b) The individual has exhausted all available domestic remedies. This shall not be the rule where the application of the remedies is unreasonably prolonged.

3. The Committee shall hold closed meetings when examining communications under the present Protocol.

4. The Committee shall forward its views to the State Party concerned and to the individual.

Article 6

The Committee shall include in its annual report under article 45 of the Covenant a summary of its activities under the present Protocol.

Article 7

Pending the achievement of the objectives of resolution 1514 (XV) adopted by the General Assembly of the United Nations on 14 December 1960 concerning the Declaration on the Granting of Independence to Colonial Countries and Peoples, the provisions of the present Protocol shall in no way limit the right of petition granted to these peoples by the Charter of the United Nations and other international conventions and instruments under the United Nations and its specialized agencies.

Article 8

1. The present Protocol is open for signature by any State which has signed the Covenant.

2. The present Protocol is subject to ratification by any State which has ratified or acceded to the Covenant. Instruments of ratification shall be deposited with the Secretary-General of the United Nations.

3. The present Protocol shall be open to accession by any State which has ratified or acceded to the Covenant.

4. Accession shall be effected by the deposit of an instrument of accession with the Secretary-General of the United Nations.

5. The Secretary-General of the United Nations shall inform all States which have signed the present Protocol or acceded to it of the deposit of each instrument of ratification or accession.

Article 9

1. Subject to the entry into force of the Covenant, the present Protocol shall enter into force three months after the date of the deposit with the Secretary-General of the United Nations of the tenth instrument of ratification or instrument of accession.

2. For each State ratifying the present Protocol or acceding to it after the deposit of the tenth instrument of ratification or instrument of accession, the present Protocol shall enter into force three months after the date of the deposit of its own instrument of ratification or instrument of accession.

Article 10

The provisions of the present Protocol shall extend to all parts of federal States without any limitations or exceptions.

Article 11

1. Any State Party to the present Protocol may propose an amendment and file it with the Secretary-General of the United Nations. The Secretary-General shall thereupon communicate any proposed amendments to the States Parties to the present Protocol with a request that they notify him whether they favour a conference of States Parties for the purpose of considering and voting upon the proposal. In the event that at least one third of the States Parties favours such a conference, the Secretary-General shall convene the conference under the auspices of the United Nations. Any amendment adopted by a majority of the States Parties present and voting at the conference shall be submitted to the General Assembly of the United Nations for approval.

2. Amendments shall come into force when they have been approved by the General Assembly of the United Nations and accepted by a two-thirds majority of the States Parties to the present Protocol in accordance with their respective constitutional processes.

3. When amendments come into force, they shall be binding on those States Parties which have accepted them, other States Parties still being bound by the provisions of the present Protocol and any earlier amendment which they have accepted.

Article 12

1. Any State Party may denounce the present Protocol at any time by written notification addressed to the Secretary-General of the United Nations. Denunciation shall take effect three months after the date of receipt of the notification by the Secretary-General.

2. Denunciation shall be without prejudice to the continued application of the provisions of the present Protocol to any communication submitted under article 2 before the effective date of denunciation.

Article 13

Irrespective of the notifications made under article 8, paragraph 5, of the present Protocol, the Secretary-General of the United Nations shall inform all States referred to in article 48, paragraph 1, of the Covenant of the following particulars:

(a) Signatures, ratifications and accessions under article 8;

(b) The date of the entry into force of the present Protocol under article 9 and the date of the entry into force of any amendments under article 11;

(c) Denunciations under article 12.

Article 14

1. The present Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited in the archives of the United Nations.

2. The Secretary-General of the United Nations shall transmit certified copies of the present Protocol to all States referred to in article 48 of the Covenant.

IN FAITH WHEREOF the undersigned, being duly authorized thereto by their respective Governments, have signed the present Protocol, opened for signature at New York, on the nineteenth day of December, one thousand nine hundred and sixty-six.
