privind cooperarea în domeniul protecţiei plantelor
(carantinei fitosanitare)

Guvernul Republicii Moldova şi Guvernul Republicii Turcia denumite în continuare Părţi Contractante, dorind să stimuleze cooperarea reciprocă în domeniul protecţiei plantelor (carantinei fitosanitare);
tinzând sa perfecţioneze protecţia teritoriilor sale contra introducerii organismelor dăunătoare de carantină a plantelor şi de a limita eventualele pierderi ca consecinţă a existenţei acestora;
în scopul facilitării comerţului reciproc şi schimbului de plante şi produselor din plante;
au convenit asupra celor ce urmează:
Articolul 1
În scopurile prezentului Acord, se vor aplica următoarele definiţii:
a) Plante – plante vii şi părţi aparte, inclusiv cu seminţe în cazul că sunt destinate plantării şi nu pentru consum sau prelucrare;
b) Produse din plante – material neprelucrat de origine vegetală (inclusiv cereale) şi acele produse prelucrate, care prin natura prelucrării sale pot crea riscuri de răspândire a organismelor dăunătoare;
c) Organisme dăunătoare – orice formă vie de origine vegetală sau animală, sau orice agent patogen, dăunător sau potenţial dăunător plantelor sau produselor vegetale;
d) Organisme dăunătoare de carantină – dăunători care pot provoca daune esenţiale plantelor sau producţiei vegetale, care nu există în ţara importatoare sau care există, dar aria lor de răspândire pe teritoriul acestei ţari este limitată şi organele competente ale statului efectuează un control strict asupra acestor dăunători şi întreprind măsuri de combatere efectivă a lor.
Articolul 2
Părţile Contractante vor efectua schimb cu listele organismelor dăunătoare de carantină, precum şi cu cerinţele specifice de carantină referitoare la importul sau tranzitul plantelor şi produselor vegetale.
Orice schimbare în prevederile menţionate mai sus trebuie să fie adresată în scris celeilalte Părţi Contractante în termen de 60 zile de la primirea notificaţiei.
Articolul 3
Părţile Contractante se vor informa reciproc fără întârziere privind schimbările semnificative în apariţia organismelor dăunătoare de carantină, precum şi în privinţa măsurilor întreprinse pentru controlul organismelor dăunătoare.
Articolul 4
Părţile Contractante trebuie sa se asigure că exportul, reexportul şi tranzitul încărcăturilor către/prin teritoriul statului Părţii Contractante se efectuează în conformitate cu prevederile legale ale ţării importatoare sau a ţării de tranzit respectiv.
Articolul 5
Orice transport destinat exportului, care este subiect al inspecţiei fitosanitare, trebuie să fie însoţit de un certificat fitosanitar elaborat în conformitate cu modelul specificat în Convenţia Internaţională de Protecţie a Plantelor şi eliberat de autorităţile competente ale Părţii Contractante respective.
În caz de necesitate, certificatul fitosanitar va include informaţia cerută de autorităţile competente ale ţării importatoare.
Certificatul fitosanitar nu exclude dreptul ţării importatoare de a efectua inspecţia fitosanitară în modul corespunzător şi de a lua măsurile necesare. Forma certificatului fitosanitar va fi perfectată în original în limbile engleză, germană şi franceză. Certificatul va fi completat în una din limbile menţionate. Orice modificare sau corectare îl va face nevalabil.
Articolul 6
Părţile Contractante se vor informa reciproc despre punctele de intrare prin care se va efectua importul, exportul şi tranzitul încărcăturilor.
Articolul 7
Dacă cu ocazia inspecţiei fitosanitare sunt găsite organisme dăunătoare de carantină, sau au fost încălcate regulamentele statale în domeniul protecţiei plantelor (carantinei fitosanitare), Partea Contractantă are dreptul să refuze importul încărcăturii, sau să distrugă încărcătura, sau să întreprindă alte măsuri fitosanitare necesare.
Articolul 8
Părţile Contractante, în conformitate cu prevederile prezentului Acord:
a) vor efectua schimb de regulamente privind protecţia plantelor (carantina fitosanitară), nu mai târziu decât cu 60 de zile la data intrării în vigoare a prezentului Acord;
b) vor sprijini schimbul de experţi în scopul de a lua cunoştinţă cu organizarea activităţii de protecţie a plantelor (carantina fitosanitară) în ţările lor şi realizării schimbului de experienţă şi rezultate ştiinţifice în domeniul protecţiei plantelor (carantinei fitosanitare);
c) vor efectua schimb de informaţie, reviste profesionale, monografii şi publicaţii în domeniul protecţiei plantelor (carantinei fitosanitare), care sunt publicate în statele sale respective.
Articolul 9
În scopul urgentării transportului şi reducerii riscului de introducere a organismelor dăunătoare de carantină, inspecţia fitosanitară poate fi efectuată de către una din Părţile Contractante pe teritoriul celeilalte Părţi Contractante, dacă pentru aceasta a fost obţinută încuviinţarea.
Procedura şi alte condiţii ale inspecţiei fitosanitare trebuie să fie stabilite de către Părţile Contractante în fiecare caz concret.
Articolul 10
În scopul soluţionării chestiunilor specifice legate de implementarea prezentului Acord, Părţile Contractante vor convoca întâlniri comune în caz de necesitate. Întâlnirile trebuie să fie efectuate alternativ în Republica Moldova şi Republica Turcia. Data şi locul fiecărei întâlniri vor fi determinate pe bază de acord reciproc. Toate cheltuielile vor fi suportate de către Părţile Contractante pentru sine.
Articolul 11
Autorităţile competente ale Părţilor Contractante, care vor coordona şi vor fi responsabile de implementarea prezentului Acord sunt:
- Din partea Republicii Moldova – Inspectoratul Principal de Stat pentru Carantina Fitosanitară.
- Din partea Republicii Turcia – Ministerul Agriculturii şi Afacerilor Rurale.
Articolul 12
Orice dispută care poate apărea pe parcursul implementării prezentului Acord va fi soluţionată prin înţelegerea între experţii ambelor Părţi Contractante. Dacă aceasta nu duce la rezultatele dorite, disputele vor fi rezolvate pe cale diplomatică.
Articolul 13
Prezentul Acord nu aduce atingere obligaţiilor Părţilor Contractante ce decurg din alte tratate internaţionale ale căror participante sunt ambele Părţi Contractante.
Articolul 14
Prezentul Acord intră în vigoare la data ultimei înştiinţări prin canale diplomatice, despre îndeplinirea de către Părţi a procedurilor interne necesare intrării în vigoare.
Prezentul Acord se încheie pentru un termen de cinci ani. Acţiunea lui se va prelungi în mod automat pentru următoarele termene consecutive de cinci ani, dacă nici una dintre Părţi nu va înştiinţa în scris cealaltă Parte Contractantă, prin canale diplomatice, cu cel puţin şase luni până la expirarea acţiunii prezentului Acord, despre intenţia sa de a-l denunţa.
Întocmit la Ankara la 4 iunie 2003, în două exemplare originale, în limbile moldovenească, turcă şi engleză, toate textele fiind egal autentice.
În cazul apariţiei unor divergenţe în interpretarea sau aplicarea prevederilor prezentului Acord, textul în limba engleză va fi de referinţă.
AGREEMENT
between the Government of the Republic of Moldova and
the Government of the Republic of Turkey
on cooperation in plant protection field
(plant quarantine)
The Government of the Republic of Moldova and the Government of the Republic of Turkey hereafter referred to as Contracting Parties wishing to stimulate their mutual co-operation in the field of plant protection (plant quarantine);
aiming to improve the protection of their territory against the introduction of plant quarantine pests and to limit the losses occurring as a consequence of the acting thereof;
in order to facilitate the mutual trade and exchange of plants and plant products;
have entered into the following Agreement:
Article 1
For the purpose of this Agreement, the following definitions will be applied:
a) Plants – living plants and parts thereof, including seeds in so far as they are intended for planting and not for consumption or processing;
b) Plant products – unmanufactured material of plant origin (including grain) and those manufactured products that, by nature of their processing, may create a risk for the spread of pests;
c) Pests – any form of plant or animal life, or any pathogenic agent, injurious or potentially injurious to plants or plant products;
d) Quarantine pests – pests of potential national economic importance to the importing country, which are not present in the importing country, or present, but not widely distributed, and are actively controlled and efficaciously eradicated.
Article 2
The Contracting Parties shall exchange the Lists of Quarantine Pests as well as specific quarantine requirements related to import or transit of plants and plant products.
Any changes in above mentioned provisions shall be notified in writing to the other Contracting Party in 60 days after the receipt of the notification.
Article 3
The Contracting Parties shall inform each other without delay on significant changes in appearance of quarantine pests, as well as of the undertaken pest control measures.
Article 4
The Contracting Parties shall ensure that the export, re-export and transit of consignments to/through the state territory of the Contracting Parties is carried out in accordance with the legal provisions of the importing country or transit country respectively.
Article 5
Any consignment destined for export, which is subject to phytosanitary inspection shall be accompanied by a phytosanitary certificate elaborated according to the model specified in the International Plant Protection Convention and issued by the competent authority of the Contracting Party.
If necessary, the phytosanitary certificate will include information requested by the competent authority of the importing country.
The phytosanitary certificate does not exclude the right of the importing country to perform the phytosanitary inspection in appropriate manner and to undertake necessary measures. The phytosanitary certificate form will be prepared originally in English, German and French. The phytosanitary certificate will be filled in one of the above mentioned languages. Any alteration, canceling and reason will make it invalid.
Article 6
The Contracting Parties shall inform each other of the points of entry at which import-export and transit of consignments should be carried out.
Article 7
If on the occasion of the phytosanitary inspection quarantine pests are found, or a violation of importing state's regulation in plant protection field (plant quarantine) is established, the Contracting Party is entitled to refuse the import of the consignment, or to destroy the consignment, or to undertake other necessary phytosanitary measures.
Article 8
The Contracting Parties according to the provisions of the present Agreement shall:
a) Exchange legal regulations on plant protection (plant quarantine), no later than 60 days from the date of the coming into force thereof;
b) Support the exchange of experts with the purpose of getting acquainted with the organization of plant protection (plant quarantine), as well as with the experience and specific results in plant protection field (plant quarantine);
c) Exchange information on all important professional journals, monographs and publications in plant protection field (plant quarantine), which are published in their respective states.
Article 9
In order to speed up the transport and to reduce the risk of the introduction of quarantine pests, phytosanitary inspection may carried out by the Contracting Parties on the territory of the other Contracting Party, if consent is given to that effect.
The procedure and other conditions of phytosanitary inspection shall be established by the Contracting Parties for each individual case.
Article 10
In order to solve specific issues with respect to the implementation of the provisions of the present Agreement, the Contracting Parties shall convoke mutual meetings if necessary. The meetings shall take place alternatively in the Republic of Moldova and in the Republic of Turkey. The date and venue of each meeting shall be determined on the basis of the mutual agreement. All expenses shall be borne by the Contracting Parties themselves.
Article 11
The competent authorities of the Contracting Parties, which shall co-ordinate and shall be responsible for the implementation of this Agreement are:
- in the Republic of Moldova: The State Inspection for Plant Quarantine;
- in the Republic of Turkey: The Ministry of Agriculture and Rural Affairs.
Article 12
Any disputes that might occur during the implementation of this Agreement shall be solved through the conciliation of the experts of the two Contracting Parties. If this does not lead to desirable results, the disputes shall be solved by diplomatic way.
Article 13
This Agreement does not infringe on the rights and obligations of the Contracting Parties, stemming from the international agreements in which they are the Contracting Parties.
Article 14
This Agreement comes into force on the date of the receipt of the last notification through the diplomatic channels by which the Contracting Parties informs each other that all national legal requirements for the coming into force of this Agreement have been fulfilled.
The Agreement has been concluded for the period of five years and shall be automatically extended for another period of five years, unless one of the Contracting Parties denounce it in writing through the diplomatic channel at least six months before the termination of the respective validity period.
Done in Ankara, on 4 June 2003, in two original copies, in Moldavian, Turkish and English languages, each of them being equally authentic.
In case of divergences in interpretation, the English version shall prevail.
