Guvernul Republicii Moldova şi Guvernul Republicii Turcia

Guvernul Republicii Moldova şi Guvernul Republicii Turcia (denumite în continuare “Părţi”);

Având convingerea că cooperarea în domeniul tineretului şi sportului va contribui la promovarea şi consolidarea relaţiilor de prietenie între ambele ţări şi popoarele lor;

Având drept scop şi dorind să dezvolte relaţii şi cooperare în aceste domenii;

Au convenit următoarele:

SECŢIUNEA 1

OBIECTIVE

Articolul 1

Prezentul Acord are drept scop promovarea şi facilitarea comunicării şi cooperării dintre organizaţiile de tineret şi cele sportive ale ambelor ţări şi stabilirea unui cadru pentru programele de cooperare în domeniul tineretului şi sportului, care se va baza pe principiul reciprocităţii.

SECŢIUNEA 2

COOPERAREA ÎN DOMENIUL SPORTULUI

Articolul 2

Părţile se obligă să încurajeze şi să susţină dezvoltarea şi consolidarea relaţiilor în domeniul sportului între cele două ţări, prin:

1. Organizarea programelor de schimb în rândul tinerilor atleţi talentaţi;

2. Schimb de experţi şi experienţă în domeniul siguranţei în sport, organizării evenimentelor sportive, sponsorizării, promovării femeilor în sport, medicina sportivă şi anti-doping;

3. Vizite mutuale ale delegaţiilor sportive, antrenorilor şi experţilor în domenii legate de sport şi educaţie fizică, precum şi în ştiinţe aplicate în aceste domenii;

4. Invitaţii reciproce ale atleţilor şi atleţilor cu dizabilităţi pentru a participa la competiţii şi evenimente sportive internaţionale organizate în ambele ţări;

5. Schimb de informaţii şi opinii la subiecte legate de sport şi activitate fizică, precum şi în alte domenii de interes reciproc;

6. Invitaţii reciproce ale experţilor pentru a participa în cadrul întâlnirilor, conferinţelor, formărilor, seminarelor şi forumurilor academice sportive, organizate în ambele ţări;

7. Prezentarea sugestiilor pentru federaţiile naţionale de sport ale Părţilor, pentru a organiza evenimente sportive comune (la asemenea evenimente participarea şi aspectele financiare vor fi asigurate de federaţiile relevante);

8. Asigurarea că prin intermediul federaţiilor sportive, echipele naţionale ale Părţilor vor organiza antrenamente comune, inclusiv organizarea taberelor sportive comune şi participarea pe bază de reciprocitate la evenimentele sportive organizate în ambele ţări;

9. Consolidarea comunicării între federaţiile şi cluburile sportive;

10. Invitarea atleţilor talentaţi, delegaţiilor sportive şi antrenorilor, pentru a face cantonamente în centre olimpice (partea financiară a acestor activităţi de antrenament va fi acoperită de ţara gazdă).

Articolul 3

Părţile vor coopera pe dimensiunea cercetării şi dezvoltării următoarelor subiecte din domeniul sportului:

1. Programe legate de domenii sportive;

2. Promovarea şi diseminarea sportului;

3. Sportul pentru persoane cu dizabilităţi;

4. Încurajarea femeilor în sport;

5. Medicina sportivă;

6. Prevenirea, monitorizarea şi combaterea doping-ului;

7. Managementul şi mentenanţa instituţiilor sportive.

SECŢIUNEA 3

COOPERAREA ÎN DOMENIUL TINERETULUI

Articolul 4

Părţile vor încuraja şi susţine dezvoltarea şi consolidarea relaţiilor între cele două ţări în domeniul tineretului, cu condiţia că acestea corespund legislaţiei în vigoare din ţările lor.

Articolul 5

În baza cerinţelor tinerilor, Părţile vor coopera în următoarele aspecte pe bază de reciprocitate, pentru a promova şi îmbunătăţi relaţiile mutuale dintre tineri şi organizaţiile de tineret ale celor două ţări:

1. Schimbul de informaţii şi experienţă în rândul tinerilor;

2. Dezvoltarea comunicării şi înţelegerii între tineri;

3. Angajarea în câmpul muncii şi antreprenoriatul pentru tineri;

4. Participarea civică activă a tinerilor;

5. Tinerii şi drepturile omului;

6. Accesul tinerilor la drepturile sociale;

7. Crearea şi dezvoltarea organizaţiilor de tineret;

8. Sănătatea tinerilor;

9. Combaterea fenomenelor sociale periculoase, precum şi a dependenţei de nicotină şi droguri;

10. Tinerii şi protecţia mediului;

11. Tinerii şi voluntariatul;

12. Tabere pentru tineri;

13. Festivaluri şi artă/cultură pentru tineri;

14. Tehnologii informaţionale şi de comunicare;

15. Oportunităţi şi formare pentru tineri;

16. Proiecte şi activităţi în domeniul tineretului;

17. Proiecte de schimb reciproc şi mobilitate a tinerilor şi persoanelor tinere dezavantajate;

18. Proiecte comune pentru dezvoltarea psiho-socială a tinerilor;

19. Oportunităţi pentru tineri menite să asigure realizarea potenţialului de care dispun;

20. Politici care să susţină dezvoltarea personală şi socială a tinerilor;

21. Utilizarea presei scrise şi vizuale în diverse proiecte pentru familiarizare culturală.

Prin urmare, Părţile vor asigura formele menţionate de cooperare prin schimb reciproc de:

Proiecte de schimb şi programe de mobilitate pe termen scurt pentru persoane care activează în domeniul tineretului;

Proiecte şi activităţi comune privind soluţionarea problemelor tinerilor;

Implementarea modelelor care consolidează activitatea în domeniul tineretului;

Coordonare între instituţiile şi organizaţiile relevante din domeniul tineretului;

Schimbul de informaţii şi experienţă cu privire la proiectele şi activităţile realizate şi planificate spre realizare.

SECŢIUNEA 4

COOPERAREA ÎN DOMENIUL EDUCAŢIEI PENTRU TINERET ŞI SPORT

Articolul 6

Părţile îşi asumă obligaţia de a încuraja şi îmbunătăţi cunoştinţele şi preluarea experienţei prin schimbul de activităţi educaţionale şi experţi în domeniul tineretului şi sportului, prin realizarea următoarelor aspecte:

1. Desfăşurarea şi încurajarea activităţilor care oferă posibilitatea tinerilor fiecărei Părţi să cunoască tezaurul naţional, spiritual şi cultural care aparţine uneia dintre Părţi sau este împărtăşit de ambele Părţi;

2. Invitarea reciprocă a experţilor în Republica Moldova şi Republica Turcia, pentru a ţine prelegeri pe diverse teme legate de activităţile pentru tineret şi cele sportive;

3. În baza legislaţiei în vigoare a Părţilor, efectuarea schimbului de documente, cunoştinţe şi publicaţii legate direct de activităţile sportive şi interesele tinerilor (dacă este cazul);

4. Asigurarea participării reciproce a experţilor la cursuri, conferinţe, seminare, simpozioane şi evenimente similare, care sunt organizate în domeniul tineretului şi sportului la nivel naţional şi internaţional;

5. Acordarea asistenţei pentru desfăşurarea programelor de stagii, în măsura în care este posibil, pentru instituţii şi organizaţii relevante în domeniul tineretului şi sportului, precum şi în alte domenii similare.

SECŢIUNEA 5

DISPOZIŢII GENERALE

Articolul 7

Autorităţile competente antrenate în implementarea prezentului Acord trebuie să fie autorităţile oficiale la nivel de ministere ale Părţilor, responsabile pe domeniile tineretului şi sportului.

Articolul 8

Dacă nu a fost convenit altfel, schimbul de programe între Părţi trebuie să fie implementat în cadrul următoarelor clauze:

1. Toate activităţile de cooperare ce rezultă din prezentul Acord vor depinde de disponibilitatea fondurilor şi de legislaţia fiecărei Părţi;

2. Schimbul de experţi, tineri, atleţi şi formatori urmează a fi implementat în conformitate cu programele adoptate.

3. Partea gazdă va acoperi cheltuielile pentru transportul local, cazare, alimentare şi servicii medicale de urgenţă pe durata şederii.

4. Partea trimiţătoare va acoperi cheltuielile pentru transportul internaţional pentru delegaţia trimisă.

5. Alte clauze financiare care nu sunt menţionate în prezentul Acord vor fi stabilite de comun acord în limitele legislaţiei Părţilor.

6. Toate activităţile desfăşurate în conformitate cu prezentul Acord depind de disponibilitatea resurselor financiare şi a personalului desemnat în acest scop.

Articolul 9

Părţile se vor consulta reciproc pe marginea principiilor şi instrumentelor cu privire la implementarea prezentului Acord.

Părţile pot întocmi protocoale sau programe suplimentare pentru implementarea prezentului Acord, după intrarea în vigoare a acestuia.

Articolul 10

Prezentul Acord nu prejudiciază drepturile şi obligaţiile Părţilor care decurg din alte acorduri internaţionale bilaterale sau multilaterale în vigoare în ambele ţări.

Orice dispută sau conflict ce poate rezulta din implementarea prezentului Acord va fi soluţionat pe cale amiabilă prin negocieri între Părţi.

Articolul 11

Prezentul Acord va intra în vigoare la data primirii ultimei notificări în formă scrisă, prin care Părţile se vor informa reciproc, prin canale diplomatice, despre finalizarea procedurilor interne necesare pentru intrarea lui în vigoare.

Amendamentele la prezentul Acord pot fi efectuate sub forma Protocoalelor adiţionale, care vor fi parte integrantă a Acordului şi vor intra în vigoare în conformitate cu paragraful 1 al acestui Articol.

Prezentul Acord va rămâne în vigoare pe o perioadă de un (1) an. Acordul va fi extins automat pentru perioadele succesive de un an.

Prezentul Acord poate fi denunţat de oricare dintre Părţi, prin notificarea scrisă remisă prin canalele diplomatice. În acest caz, Acordul îşi va înceta valabilitatea la expirarea a 6 luni din data recepţionării notificării privind denunţarea lui.

Denunţarea prezentului Acord nu va afecta activităţile şi proiectele demarate sau în curs de derulare.

La intrarea în vigoare a prezentului Acord îşi încetează valabilitatea Acordul privind cooperarea între Departamentul Tineretului şi Sportului al Republicii Moldova şi Directoratul General al Tineretului şi Sportului al Republicii Turcia în domeniul tineretului şi sportului, semnat la Ankara la 22 mai 1996.

Semnat la __________________la ____/____/2018 în 2 (două) exemplare originale, fiecare în limbile română, turcă şi engleză, toate textele fiind egal autentice.

În cazul unor divergenţe la interpretarea prevederilor prezentului Acord, textul în limba engleză va fi de referinţă.

A G R E E M E N T

ON COOPERATION IN THE FIELD OF YOUTH AND SPORTS

BETWEEN THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

AND THE GOVERNMENT OF THE REPUBLIC OF TURKEY

The Government of the Republic of the Moldova and the Government of Turkey (hereinafter referred to as “the Parties′′),

Believing that cooperation in the fields of youth and sport will contribute to the promotion and strengthening of friendly relations between both countries and their peoples,

Aiming and desiring to develop relations and cooperation in these fields,

Have agreed as follows:

SECTION 1

OBJECTIVE

Article 1

This Agreement aims to promote and facilitate communication and cooperation between the youth and sports organizations of both countries and to set the framework for the programs of cooperation in the field of youth and sports, which are to be based on the principle of reciprocity.

SECTION 2

COOPERATION IN THE FIELD OF SPORTS

Article 2

The Parties shall commit to encourage and support the development and strengthening of the relations in the field of sports between the two countries through:

Organizing exchange programs between talented young athletes;

Exchanging experts and sharing experiences regarding the sports safety, organization of sports events, sponsorship, promotion of women in sports, sports medicine, and anti-doping;

Mutual visits by sports delegations, trainers and experts in relation to the areas of sports and physical education and the applied sciences of these areas;

Mutually inviting athletes, and disabled athletes, to participate in the competitions and international sport events organized in both countries;

Exchanging information and opinions in the subjects related to sport and physical activity and on other areas of mutual benefit;

Mutually inviting experts to participate in sport-related meetings, conferences, trainings, seminars and academic forums organized in both countries;

Making suggestions for the national sports federations of the Parties to organize joint sports events (in such events, participation and financial matters shall be under the responsibility of the relevant federations);

Ensuring that through the sports federations, the national teams of the Parties will train together including organization of joint sport camps and participation on a reciprocal basis, in the sport events organized in both countries;

Establishing communication between the sports federations and clubs;

Inviting talented athletes, sports delegations and coaches to be trained in Olympic centers (financial responsibility of these training activities shall be covered by the hosting country).

Article 3

The Parties shall cooperate in research and development within the framework of the following subjects in the field of sport:

Programs related to sport branches;

Promotion and dissemination of sport;

Sport for disabled individuals;

Encouragement of women in sport;

Sport medicine;

Preventing, controlling and combating doping;

Management and maintenance of sport facilities.

SECTION 3

COOPERATION IN THE FIELD OF YOUTH

Article 4

The Parties shall encourage and support the development and strengthening of the relations between the two countries in the field of youth, on the condition that they comply with regulations in force in their countries.

Article 5

According to the demands of young people, the Parties shall cooperate in the following issues within the framework of reciprocity with a viewˇ to promoting and enhancing mutual relations between young people and youth organizations of the two countries:

1. Exchange of information and experience among young people;

2. Developing communication and understanding between young people;

3. Youth employment and entrepreneurship;

4. Active civic participation of young people;

5. Youth and human rights;

6. Access to social rights for youth;

7. Establishing and developing youth organization;

8. Healthcare for youth;

9. Combating dangerous social phenomena, nicotine and drug addiction;

10. Youth and environmental protection;

11. Youth and volunteering;

12. Youth camps;

13. Festivals and art/culture for youth;

14. Information and communication technologies;

15. Youth opportunities and training;

16. Projects and activities in the field of youth;

17. Projects for mutual exchange and mobility of young people and disadvantaged young people;

18. Joint projects for the psycho-social development of young people;

19. Opportunities for young people to realize their potentials;

20. Policies for personal support and social development of young people;

21. Use of print and visual media in the projects for cultural familiarity.

Consequently, the Parties shall provide the below mentioned forms of the cooperation related to exchanges:

Exchange projects and short term mobility programs for people who work in the field of youth;

Joint projects and activities related to the solution of youth problems;

Model implementations that strengthen activity in the field of youth;

Coordination among relevant institutions and organizations in the field of youth;

Information and experience exchange regarding the projects and works performed and planned to be performed.

SECTION 4

COOPERATION IN THE FIELD OF EDUCATION RELATED

TO YOUTH AND SPORTS

Article 6

The Parties shall undertake to encourage and improve the knowledge and experience sharing through the exchange of educational activities and experts in the fields of youth and sports, by realizing the following subjects:

1. Carrying out and encourage activities that shall enable the young people of each Party to be aware of the national, spiritual and cultural heritages that belong to one of the Parties or are shared by both Parties;

2. Mutually inviting experts in Republic of Moldova and in Republic of Turkey for giving lectures on various subjects related to the youth and sports activities;

3. According to the legislation in force in the respective countries, to exchanging the documents, knowledge and publications directly related to the sports activities and the interests of youth (if applicable);

4. Ensuring mutual participation of experts at courses, conferences, seminars, symposiums and similar events that are held in the fields of youth and sports at national and international levels;

5. Supporting the organization of internship programs, if it is possible, for relevant institutions and organizations in the field of youth and sport and in similar fields.

SECTION 5

GENERAL PROVISIONS

Article 7

The competent authorities for the implementation of this Agreement shall be the official bodies at the level of Ministry of the Parties responsible for the fields of youth and sports.

Article 8

Unless otherwise agreed, the exchange of programs between the Parties shall be implemented within the framework of the following provisions:

1. All the cooperation activities within this Agreement shall depend on the availability of the funds and the legislation of each Party;

2. The exchange of the experts, youth delegations, athletes and trainers shall be implemented in accordance with the agreed programs;

3. The hosting Party shall cover the local transportation, accommodation, catering costs and emergency health services in the period of stay;

4. The sending Party shall cover the international transportation costs of the delegation sent;

5. Other financial provisions which are not mentioned in this Agreement shall be mutually determined within the framework of the laws and regulations of the Parties;

6. All activities undertaken according to this Agreement depends on the availability of financial resources and stuff designated for this purpose.

Article 9

The Parties shall consult each other on the principles and instruments related to the implementation of this Agreement.

The Parties may agree on additional protocols or programs for the implementation of this Agreement its the entry into force.

Article 10

This Agreement shall be without prejudice to the rights and obligations of the Parties arising from other international bilateral or multilateral agreements in force in their countries.

Any disputes or disagreements that might arise from the implementation of this Agreement will be settled amicably through negotiation between the Parties.

Article 11

This Agreement shall enter into force on the date of the receipt of the last written notification by which the Parties notify each other, through diplomatic channels, regarding the completion of their internal legal procedures required for its entry into force.

Amendments to this Agreement shall be made in the form of additional Protocols, which will be an integral part of the Agreement and will enter into force in accordance with paragraph 1 of this Article.

This Agreement shall remain in force for a period of one (1) year. Agreement will be automatically extended for successive periods of one year.

This Agreement may terminate by either Party by giving written notice through diplomatic channels. In this case, the Agreement will end upon the expiration of six months from receiving the notification of its termination.

The Termination of this Agreement shall not affect the initiated or ongoing activities and projects.

The entry into force of this Agreement shall terminate the Agreement on cooperation between the Department of Youth and Sport of the Republic of Moldova and the General Directorate of Youth and Sport of the Republic of Turkey in the field of youth and sports, signed in Ankara on May 22, 1996.

Signed in ________________ on ____/____/2018 in 2 (two) original copies in Romanian, Turkish and English languages, each text being equally authentic. In case of divergences in interpretation of the provisions of the present Agreement, the English text shall prevail.
