Oficiul Ambasadei Regatului Ţărilor de Jos în Republica Moldova prezintă salutul său Ministerului Afacerilor Externe şi Integrării Europene al Republicii Moldova şi cu referire la Acordul dintre Regatul Ţărilor de Jos şi Republica Moldova cu privire la asistenta administrativă reciprocă în domeniul vamal, semnat la Chişinău la 19 iunie 2006 ( în continuare "Acordul din 2006") are onoarea de a relata următoarele.

În conformitate cu Articolul 21, paragraful 2 şi 3 din Acordul din 2006, Guvernul Regatului Ţărilor de Jos propune extinderea aplicabilităţii Acordului din 2006 asupra teritoriilor Aruba, Curaţao şi Sint Maarten, după cum urmează:

1. Pentru Regatul Ţărilor de Jos, în ceea ce priveşte Aruba, Curacao şi Sint Maarten, termenul "administraţia vamală" din Articolul 1 lit.a) al Acordului din 2006. are următoarea semnificaţie: administraţia centrală corespunzătoare responsabilă de implementarea legislaţiei vamale.

2. Articolul 2, paragraful 4, din Acordul din 2006, se aplică doar pe teritoriul Aruba, Curacao şi Sint Maarten, după caz, în limita permisă de acorduri sau aranjamente la care se referă şi se aplică pe teritoriile menţionate ale Regatului Ţărilor de Jos.

3. în ceea ce priveşte Aruba, Curacao şi Sint Maarten, cerinţele legislaţiei naţionale în sensul Articolului 17 al Acordului din 2006, cad sub incidenţa Ordonanţei privind înregistrarea persoanelor sau a Actului Regal de asistenţă administrativă, în dependenţă de caz.

Dacă cele menţionate mai sus sunt acceptabile pentru Guvernul Republicii Moldova. Ambasada are onoarea să propună ca această Notă şi Nota de răspuns a Ministerului să constituie un Acord între Republica Moldova şi Regatul Ţărilor de Jos care va intra în vigoare în prima zi a celei de-a doua luni după data receptionării ultimei notificări prin care una din Părţile Contractante notifică celeilalte Părţi Contractante despre îndeplinirea procedurilor interne necesare pentru intrarea în vigoare a prezentului Acord.

Oficiul Ambasadei Regatului Ţărilor de Jos în Republica Moldova foloseşte acest prilej pentru a reînnoi Ministerului Afacerilor Externe şi Integrării Europene a Republicii Moldova asigurările înaltei sale consideraţii.

Ministerul Afacerilor Externe şi Integrării Europene al Republicii Moldova prezintă salutul său Oficiului Ambasadei Regatului Ţărilor de Jos în Republica Moldova şi are onoarea de a-i confirma recepţionarea Notei nr.CHS/2019/050 din 6 August 2019 cu următorul conţinut:

"Oficiul Ambasadei Regatului Ţărilor de Jos în Republica Moldova prezintă salutul său Ministerului Afacerilor Externe şi Integrării Europene al Republicii Moldova şi cu referire la Acordul dintre Regatul Ţărilor de Jos şi Republica Moldova cu privire la asistenta administrativă reciprocă în domeniul vamal, semnat la Chişinău la 19 iunie 2006 (în continuare "Acordul din 2006′′) are onoarea de a relata următoarele.

În conformitate cu Articolul 21, paragraful 2 şi 3 din Acordul din 2006, Guvernul Regatului Ţărilor de Jos propune extinderea aplicabilităţii Acordului din 2006 asupra teritoriilor Aruba, Curaşao şi Sint Maarten, după cum urmează:

Ministerul Afacerilor Externe şi Integrării Europene al Republicii Moldova are onoare să comunice că Guvernul Republicii Moldova acceptă conţinutul Notei nr.CHS/2019/050 din 6 august 2019 a onoratului Oficiu al Ambasadei Regatului Ţărilor de Jos în Republica Moldova şi consideră Nota menţionată şi prezenta Notă de răspuns drept un Acord între Republica Moldova şi Regatul Ţărilor de Jos, care va intra în vigoare în prima zi a celei de-a doua luni după data recepţionării ultimei notificări prin care una din Părţile Contractante notifică celeilalte îndeplinirea procedurilor interne necesare pentru intrarea în vigoare a prezentului Acord.

Ministerul Afacerilor Externe şi Integrării Europene al Republicii Moldova foloseşte acest prilej pentru a reînnoi Oficiului Ambasadei Regatului Ţărilor de Jos în Republica Moldova asigurările înaltei sale consideraţii.

AGREEMENT

Kingdom of the Netherlands

The Embassy Office of the Kingdom of the Netherlands to the Republic of Moldova presents its compliments to the Ministry of Foreign Affairs and European Integration of the Republic of Moldova and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Moldova on mutual administrative assistance in customs matters, signed at Chisinau on 19 June 2006 (hereinafter referred to as "the Agreement of 2006").

The Government of the Kingdom of the Netherlands proposes that, in accordance with Article 21, paragraphs 2 and 3, of the Agreement of 2006, the application of the Agreement of 2006 shall be extended to Aruba, Curacao and Sint Maarten, subject to the following:

1. For the Kingdom of the Netherlands, the term "customs administration" in Article 1, under a), of the Agreement of 2006 shall mean, as regards Aruba, Curacao and Sint Maarten, the respective central administration responsible for the implementation of customs laws.

2. Article 2, paragraph 4, of the Agreement of 2006 shall apply only to Aruba, Curacao and Sint Maarten, as the case may be, insofar as the agreements or arrangements referred to therein apply to those respective parts of the Kingdom of the Netherlands.

3. As regards Aruba, Curagao and Sint Maarten, the requirements of national law within the meaning of Article 17 of the Agreement of 2006 fall under the scope of the Ordinance on person registration or the Kingdom Act Administrative Assistance, as the case may be.

If the foregoing is acceptable to the Government of the Republic of Moldova, the Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova has the further honour to propose that this Note and the Ministry's Note in reply shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Moldova which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Contracting Party informs the other Contracting Party that the formalities required for the entry into force of this Agreement have been complied with.

The Embassy Office of the Kingdom cf the Netherlands to the Republic of Moldova avails itself of this opportunity to renew to the Ministry of Foreign Affairs and European Integration of the Republic of Moldova the assurance of its highest consideration.

The Ministry of Foreign Affairs and European Integration of the Republic of Moldova presents its compliments to the Embassy Office of the Kingdom of the Netherlands to the Republic of Moldova and has the honour to confirm the receipt of the Verbal Note No. CHS/2019/050 dated from 6 August 2019, with the following content:

"The Embassy Office of the Kingdom of the Netherlands to the Republic of Moldova presents its compliments to the Ministry of Foreign Affairs and European Integration of the Republic of Moldova and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Moldova on mutual administrative assistance in customs matters, signed at Chisinau on 19 June 2006 (hereinafter referred to as "the Agreement of 2006").
