ce completează Convenţia asupra Semnalizării rutiere,

deschisă semnării la Viena la 8 noiembrie 1968

PĂRŢILE CONTRACTANTE, PĂRŢI LA CONVENŢIA ASUPRA SEMNALIZĂRII RUTIERE, DESCHISĂ SEMNĂRII LA VIENA LA 8 NOIEMBRIE 1968, dorind să stabilească în Europa o mai mare uniformizare a regulilor privitoare la indicatoarele şi simbolurile rutiere, precum şi la marcajele rutiere, au convenit asupra celor ce urmează:

ARTICOLUL 1

Părţile contractante, Părţi la Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968, vor lua măsurile corespunzătoare pentru ca sistemul semnalizării rutiere şi al marcajelor rutiere aplicat pe teritoriul lor să fie conform cu dispoziţiile anexei la prezentul Acord.

ARTICOLUL 2

1. Prezentul Acord va fi deschis semnării până la 31 decembrie1 1972 de către Statele ce sunt semnatare ale Convenţiei asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968, sau care au aderat la ea şi care sunt fie membre ale Comisiei Economice pentru Europa a Naţiunilor Unite, fie admise la Comisie cu caracter consultativ conform punctului 8 din mandatul acestei Comisii.

2. Prezentul Acord este supus ratificării după ce Statul va ratifica Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968, sau va adera la ea. Instrumentele de ratificare vor fi depuse pe lângă Secretarul general al Organizaţiei Naţiunilor Unite.

3. Prezentul Acord rămâne deschis aderării oricărui Stat prevăzut la punctul 1 al prezentului articol şi care este parte în Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968. Instrumentele de aderare vor fi depuse pe lângă Secretarul general.

ARTICOLUL 3

1. Orice Stat va putea, atunci când va semna sau ratifica prezentul Acord ori va adera la el, sau oricând ulterior, să declare printr-o notificare adresată Secretarului general că Acordul intră în vigoare pentru toate teritoriile sau doar pentru unul dintre ele care asigură relaţiile internaţionale. Acordul va intra în vigoare pe teritoriul sau teritoriile prevăzute în notificare după 30 de zile de la data când Secretarul general a primit notificarea sau la data intrării în vigoare a Acordului pentru Statul ce adresează notificarea, dacă această dată este posterioară precedentei.

2. Orice Stat care face o declaraţie potrivit punctului 1 al prezentului articol va putea, oricând ulterior, prin notificare adresată Secretarului general, să declare că Acordul va înceta să mai fie în vigoare pe teritoriul prevăzut în notificare, iar Acordul va înceta să mai fie în vigoare pe acel teritoriu după un an de la data primirii acestei notificări de către Secretarul general.

ARTICOLUL 4

1. Prezentul Acord va intra în vigoare după 12 luni de la data depunerii celui de al zecelea instrument de ratificare sau de aderare.

2. Pentru fiecare Stat care va ratifica prezentul Acord sau va adera la el după depunerea celui de al zecelea instrument de ratificare sau de aderare, Acordul va intra în vigoare după 12 luni de la data depunerii, de către acest Stat, a instrumentului său de ratificare sau de aderare.

3. Dacă data intrării în vigoare, conform punctelor 1 şi 2 ale prezentului articol este anterioară aceleia ce rezultă din aplicarea art.39 din Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968, Acordul va intra în vigoare, potrivit punctului 1 al acestui articol, la această din urmă dată.

ARTICOLUL 5

La intrarea sa în vigoare, prezentul Acord va abroga şi înlocui, în relaţiile dintre Părţile contractante, dispoziţiile din Protocolul referitor la semnalizarea rutieră cuprinse în Acordul european ce completează Convenţia asupra circulaţiei rutiere şi Protocolul referitor la semnalizarea rutieră, semnate la Geneva la 16 septembrie 1950, Acordul referitor la semnalizarea lucrărilor de drumuri, semnat la Geneva la 16 decembrie 1955, şi Acordul european referitor la marcajele rutiere, semnat la Geneva la 13 decembrie 1957.

ARTICOLUL 6

1. După o perioadă de 12 luni, cu începere de la data intrării în vigoare a prezentului Acord, orice Parte contractantă va putea propune unu sau mai multe amendamente la Acord. Textul oricărei propuneri de amendament, însoţit de o expunere de motive, va fi adresat Secretarului general care îl va comunica tuturor Părţilor contractante. Părţile contractante vor avea posibilitatea de a-i face cunoscut într-un termen de 12 luni următoare datei acestei comunicări: a) că acceptă amendamentul sau b) că îl resping, ori c) că doresc să fie convocată o conferinţă pentru a-l examina. Secretarul general va transmite textul amendamentului propus şi celorlalte State prevăzute la art.2 al prezentului Acord.

2.a) Orice propunere de amendament ce va fi comunicată conform dispoziţiilor punctului 1 al prezentului articol va fi considerată acceptată dacă, în termenul de 12 luni sus-menţionat, cel puţin o treime din Părţile contractante informează Secretarul general, fie că resping amendamentul, fie că doresc să se convoace o conferinţă pentru a-l examina. Secretarul general va notifica toate Părţile contractante despre orice acceptare sau respingere a amendamentului propus şi despre orice cerere de convocare a unei conferinţe. Dacă numărul total al respingerilor şi al cererilor primite în termenul de 12 luni este mai mic de o treime din numărul total al Părţilor contractante, Secretarul general va notifica toate Părţile contractante că amendamentul va intra în vigoare după 6 luni de la expirarea termenului de 12 luni prevăzut la punctul 1 al prezentului articol pentru toate Părţile contractante, cu excepţia celor care, în termenul respectiv, au respins amendamentul sau au cerut convocarea unei conferinţe pentru a-l examina.

b) Orice Parte contractantă care, în timpul acestui termen de 12 luni, va respinge propunerea de amendament sau de convocare a unei conferinţe pentru a-l examina, va putea, oricând după expirarea acestui termen, să notifice Secretarul general că acceptă amendamentul, iar Secretarul general va comunica aceasta tuturor celorlalte Părţi contractante. Amendamentul va intra în vigoare, pentru Partea contractantă care va face cunoscută acceptarea sa, după 6 luni de la data la care Secretarul general va primi notificarea.

3. Dacă un amendament propus n-a fost acceptat conform punctului 2 al prezentului articol şi dacă, în termenul de 12 luni prevăzut la punctul 1 al prezentului articol, cel puţin jumătate din numărul total al Părţilor contractante informează pe Secretarul general că resping amendamentul propus şi dacă cel puţin o treime din numărul total al Părţilor contractante, dar nu mai puţin de cinci, îl informează că îl acceptă sau că doresc convocarea unei conferinţe pentru a-l examina, Secretarul general va convoca o conferinţă pentru a examina amendamentul propus sau orice altă propunere cu care va fi sesizat conform punctului 4 al acestui articol.

4. Dacă a fost convocată o conferinţă conform dispoziţiilor punctului 3 al prezentului articol, Secretarul general va invita la aceasta toate Părţile contractante, precum şi celelalte State prevăzute la art.2 al prezentului Acord. El va cere tuturor Statelor invitate la conferinţă să-i prezinte, cel târziu în termen de 6 luni înainte de data deschiderii, orice propunere pe care o vor dori să fie examinată de acea conferinţă în afară de amendamentul propus, comunicând aceste propuneri, în termen de 3 luni înainte de data deschiderii conferinţei, tuturor Statelor invitate la conferinţă.

5.a) Orice amendament la prezentul Acord va fi considerat ca acceptat dacă a fost adoptat cu o majoritate de două treimi a Statelor reprezentate la conferinţă, cu condiţia ca această majoritate să grupeze cel puţin două treimi a Părţilor contractante reprezentate la conferinţă. Secretarul general va notifica toate Părţile contractante despre adoptarea amendamentului, care va intra în vigoare după 12 luni de la această notificare pentru toate Părţile contractante, cu excepţia acelora care, înăuntrul acestui termen, vor notifica Secretarul general că resping amendamentul.

b) Orice Parte contractantă care va respinge un amendament în acest termen de 12 luni va putea, oricând, să notifice pe Secretarul general că îl acceptă, iar Secretarul general va transmite această notificare tuturor celorlalte Părţi contractante. Amendamentul va intra în vigoare pentru Partea contractantă care va face cunoscută acceptarea sa după 6 luni de la data la care Secretarul general va primi notificarea sau la sfârşitul termenului de 12 luni, dacă data este posterioară precedentei.

6. Dacă propunerea de amendament nu este considerată ca acceptată conform punctului 2 al prezentului articol şi dacă condiţiile prevăzute la punctul 3 al prezentului articol pentru convocarea unei conferinţe nu sunt întrunite, propunerea de amendament va fi considerată respinsă.

7. Independent de procedura de amendament prevăzută la punctele 1-6 ale prezentului articol, anexa la prezentul Acord poate fi modificată prin înţelegere între organele competente ale Părţilor contractante. Dacă organul competent al unei Părţi contractante a declarat că legislaţia sa naţională îl obligă să condiţioneze înţelegerea de o autorizare specială în acest scop sau de aprobarea unui organ legislativ, consimţământul organului competent al Părţii contractante la modificarea anexei nu va fi considerat ca dat decât atunci când acest organ va comunica Secretarului general că autorizările sau aprobările cerute au fost obţinute. Înţelegerea între organele competente va putea să prevadă că, într-o perioadă de tranziţie, vechile dispoziţii ale anexei vor rămâne în vigoare, total sau parţial, simultan cu cele noi. Secretarul general va fixa data intrării în vigoare a noilor dispoziţii.

8. Fiecare Stat, în momentul când va semna sau va ratifica acest Acord ori va adera la el, va notifica Secretarul general despre denumirea şi adresa autorităţii competente să dea Acordul prevăzut la punctul 7 al prezentului articol.

ARTICOLUL 7

Orice Parte contractantă va putea denunţa prezentul Acord prin notificare scrisă adresată Secretarului general. Denunţarea îşi va produce efectul după un an de la data la care Secretarul general va primi notificarea. Orice Parte contractantă care va înceta de a fi parte în Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968, va înceta pe aceeaşi dată să fie parte şi la prezentul Acord.

ARTICOLUL 8

Acordul va înceta de a fi în vigoare dacă numărul Părţilor contractante este mai mic de cinci într-o perioadă oarecare de 12 luni consecutive, precum şi atunci cînd va înceta de a fi în vigoare Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968.

ARTICOLUL 9

1. Orice neînţelegere între două sau mai multe Părţi contractante referitoare la interpretarea sau aplicarea prezentului Acord, pe care Părţile contractante în litigiu nu au putut-o soluţiona pe cale de negocieri sau în orice alt mod, va fi supusă arbitrajului dacă oricare dintre Părţile contractante în litigiu o cere şi va fi trimisă unuia sau mai multor arbitri aleşi de comun Acord de Părţile în litigiu. Dacă, în termen de 3 luni da la data cererii de arbitraj, Părţile în litigiu nu ajung la o înţelegere asupra alegerii arbitrului sau arbitrilor, oricare din aceste Părţi va putea cere Secretarului general al Organizaţiei Naţiunilor Unite să desemneze un singur arbitru căruia îi va trimite neînţelegerea, pentru a decide.

2. Hotărârea arbitrului sau a arbitrilor desemnaţi conform punctului 1 al prezentului articol va fi obligatorie pentru Părţile contractante în litigiu.

ARTICOLUL 10

Nici o dispoziţie a acestui Acord nu va fi interpretată ca interzicând unei Părţi contractante să ia măsurile corespunzătoare cu dispoziţiile Cartei Naţiunilor Unite şi limitate la cerinţele situaţiei pe care o apreciază necesară pentru siguranţa sa externă şi internă.

ARTICOLUL 11

1. Orice Stat va putea, în momentul când va semna acest Acord sau va depune instrumentul de ratificare sau de aderare, să declare că nu se consideră legat de art.9 al acestui Acord. Celelalte Părţi contractante nu vor fi legate de art.9 faţă de oricare din Părţile contractante care va face o asemenea declaraţie.

2. Rezervele la prezentul Acord, altele decât cea prevăzută la punctul 1 al acestui articol, sunt permise cu condiţia să fie formulate în scris şi, dacă sunt formulate înainte de depunerea instrumentului de ratificare sau de aderare, să fie confirmate în acel instrument.

3. Orice Stat, în momentul când va depune instrumentul său de ratificare a Acordului sau de aderare la acesta, va notifica în scris pe Secretarul general în ce măsură rezervele ce le va formula la Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968, se aplică prezentului Acord. Acelea dintre rezerve ce nu vor face obiectul înştiinţării efectuate în momentul depunerii instrumentului de ratificare a prezentului Acord sau de aderare la acesta vor fi considerate ca neaplicându-se prezentului Acord.

4. Secretarul general va comunica rezervele şi înştiinţările efectuate în aplicarea prezentului Acord tuturor Statelor prevăzute la art.2 al prezentului Acord.

5. Orice Stat care va face o declaraţie, o rezervă sau o notificare potrivit prezentului articol va putea, oricând, să o retragă prin notificare adresată Secretarului general.

6. Orice rezervă efectuată conform punctului 2 sau adusă la cunoştinţă conform punctului 3 al prezentului articol:

a) modifică, pentru Partea contractantă care a efectuat sau adus la cunoştinţă acea rezervă, dispoziţiile Acordului asupra cărora poartă rezerva, în limitele acesteia;

b) modifică aceste dispoziţii în aceleaşi limite pentru celelalte Părţi contractante pentru ceea ce ţine de relaţiile cu Partea contractantă ce a efectuat sau a adus la cunoştinţă rezerva.

ARTICOLUL 12

În afară de declaraţiile, notificările şi comunicările prevăzute la art.6 şi 11 ale prezentului Acord, Secretarul general va aduce la cunoştinţă Părţilor contractante şi celorlalte State prevăzute la art.2:

a) semnăturile, ratificările şi aderările, conform art.2;

b) înştiinţările şi declaraţiile, conform art.3;

c) datele de intrare în vigoare a prezentului Acord, conform art.4;

d) data de intrare în vigoare a amendamentelor la prezentul Acord, conform punctelor 2, 5 şi 7 ale art.6;

e) denunţarea, conform art.7;

f) încetarea prezentului Acord, conform art.8.

ARTICOLUL 13

După 31 decembrie2 1972, originalul prezentului Acord va fi depus pe lângă Secretarul general al Organizaţiei Naţiunilor Unite, care va transmite copii certificate conforme tuturor Statelor prevăzute la art.2 al prezentului Acord.

PENTRU CARE ÎMPUTERNICIŢII, legal autorizaţi de guvernele lor, au semnat prezentul Acord.

ÎNCHEIAT la Geneva la 1 mai 1971, într-un singur exemplar în limbile engleză, franceză şi rusă, cele trei texte fiind la fel de valabile.

ANEXĂ

1. Pentru aplicarea dispoziţiilor prezentei anexe, termenul “Convenţie” înseamnă Convenţia asupra semnalizării rutiere, deschisă semnării la Viena la 8 noiembrie 1968.

2. Prezenta anexă nu conţine decât completări şi modificări aduse dispoziţiilor corespunzătoare ale Convenţiei.

3. La Articolul 1 al Convenţiei (Definiţii)

Alineatul b)

Acest alineat se va citi astfel: “localitate” înseamnă un spaţiu care cuprinde imobile construite şi ale cărei intrări şi ieşiri sunt stabilite în mod special ca atare.”

Alineatul 1

Vehiculele cu trei roţi a căror masă în gol nu depăşeşte 400 kg se asimilează motocicletelor.

Alineat suplimentar, de adăugat la sfârşitul acestui articol

Acest alineat se va citi astfel: “Se asimilează pietonilor persoanele care împing sau trag un cărucior pentru copil, pentru bolnav sau cu nevoi speciale, sau orice alt vehicul de dimensiuni mici şi fără motor, cele care conduc cu braţul o bicicletă sau o motoretă, precum şi persoanele cu nevoi speciale, care se deplasează într-un scaun rulant, pus în mişcare de ei înşişi sau care circulă cu viteză redusă.”

4. La Articolul 3 al Convenţiei (Obligaţii ale Părţilor contractante)

Punctul 3

Acest punct se va citi astfel: “Orice indicator, simbol, instalaţie sau marcaj neconform sistemului stabilit prin Convenţie şi prezentul Acord va fi înlocuit în decurs de 10 ani cu începere de la data intrării în vigoare a Acordului. În cursul acestei perioade şi în scopul de a obişnui pe participanţii la circulaţie cu sistemul stabilit prin Convenţie şi prezentul Acord, indicatoarele, simbolurile şi inscripţiile anterioare vor putea fi menţinute alături de cele prevăzute de Convenţie şi de prezentul Acord.”

5. La Articolul 6 al Convenţiei

Punctul 4

Dispoziţiile acestui punct, care sunt recomandări în Convenţie, vor fi obligatorii.

6. La Articolul 7 al Convenţiei

Punctul 1

Frază suplimentară de adăugat la sfârşitul punctului

Această frază se va citi astfel: “Mai mult, în ce priveşte indicatoarele respective, se recomandă să nu fie folosite pe acelaşi sector de drum indicatoare iluminate sau prevăzute cu materiale sau dispozitive reflectorizante şi indicatoare care nu sunt la fel ca acestea.”

7. La Articolul 8 al Convenţiei

Punctul 3

Acest punct se va citi astfel: “În timpul perioadei tranzitorii de 10 ani arătată la pct.4 al prezentei anexe, ca şi în împrejurări deosebite, pentru a simplifica interpretarea indicatoarelor, se poate adăuga o inscripţie într-un panou dreptunghiular situat sub indicatoare sau înăuntrul unui panou dreptunghiular ce include semnalul; o atare inscripţie poate fi, de asemenea, instalată chiar pe indicator în cazul în care înţelegerea acestuia nu este stânjenitoare pentru conducătorii care nu pot înţelege inscripţia.”

8. La Articolul 9 al Convenţiei

Punctul 1

Fiecare Stat va alege modelul Aa ca indicator de avertizare.

9. La Articolul 10 al Convenţiei (Indicatoare de prioritate)

Punctul 3

Fiecare Stat va alege modelul B, 2a pentru indicatorul “Oprire”.

Punctul 6

Presemnalizarea indicatorului B, 1 se va face cu ajutorul aceluiaşi indicator completat cu un panou suplimentar al modelului 1 indicat în anexa nr.7 a Convenţiei.

Presemnalizarea indicatorului B, 2a se va face cu ajutorul indicatorului B, 1 completat cu un panou dreptunghiular ce va conţine simbolul “STOP” şi o cifră ce indică la ce distanţă se află indicatorul B, 2a.

10. La Articolul 18 al Convenţiei (Indicatoare de localizare)

Punctul 2

Acest punct se va citi astfel: “Indicatoarele E,9a şi E,9c, conforme modelelor ce figurează în anexa nr.9 a Convenţiei, înştiinţează pe participanţii la circulaţie că reglementarea generală a circulaţiei în vigoare în localităţi situate pe teritoriul Statului se aplică începând de la indicatoarele E, 9a până la indicatoarele E, 9c, în afară de cazul când o altă reglementare ar fi valabilă pe unele sectoare de drumuri din localităţi. Ele apar sub formă de inscripţii de culoare închisă pe fond alb sau de culoare deschisă şi se instalează la intrările, respectiv la ieşirile din localităţi. Totuşi, indicatorul B, 4 va trebui totdeauna să fie instalat, cât timp prioritatea încetează la traversarea localităţii, pe drumurile cu prioritate semnalizate cu indicatorul B, 3.”

Punctul 3

Acest punct se va citi astfel: “Indicatoarele de localizare folosite în alte scopuri decât cele menţionate la punctul 2 al acestui articol, astfel cum este redactat mai sus, trebuie să fie net distincte de indicatoarele prevăzute la acest punct; ele trebuie să fie sub formă de inscripţii albe sau de culoare deschisă pe fond de culoare închisă.”

11. La Articolul 23 al Convenţiei (Indicatoare pentru dirijarea circulaţiei vehiculelor)

Punct suplimentar, de adăugat imediat după punctul 3 al acestui articol

Acest punct se va citi astfel:

“a) Dispoziţiile punctelor 1, 2 şi 3 ale art.6 al Convenţiei se aplică semnalelor luminoase de circulaţie, cu excepţia celor folosite la trecerile la nivel;

b) Semnalele luminoase pentru circulaţia în intersecţii vor fi instalate înainte de intersecţie sau în mijlocul şi deasupra acesteia; ele pot fi repetate de cealaltă parte a intersecţiei;

c) În plus, se recomandă ca legislaţiile naţionale să prevadă ca semnalele luminoase de circulaţie:

i) să fie instalate încât să nu stânjenească circulaţia vehiculelor pe partea carosabilă şi, pentru cele instalate pe acostamente, să stânjenească pietonii cât mai puţin posibil;

ii) să fie vizibile cu uşurinţă de departe şi uşor înţelese la apropierea de ele;

iii) să fie standardizate pe teritoriul fiecărei Părţi contractante, având în vedere categoriile de drumuri.”

Punctul 9

Acest punct se va citi astfel: “Când lumina verde din sistemul cu trei culori are forma uneia sau mai multor săgeţi verzi pe fond negru, aprinderea acesteia sau acestor săgeţi înseamnă că vehiculele nu pot merge decât în direcţia sau direcţiile astfel indicate. Săgeţile ce permit să se meargă înainte vor avea vârful îndreptat în sus.”

Punctul 10

Începutul acestui punct se va citi astfel: “Când un semnal din sistemul cu trei culori are una sau mai multe lumini verzi suplimentare sub forma uneia sau unor săgeţi verzi pe fond rotund negru, aprinderea...”.

Punct suplimentar, de adăugat imediat după punctul 10 al acestui articol.

Acest punct se va citi astfel: “Când lumina roşie sau lumina galbenă are forma uneia sau mai multor săgeţi, indicaţia dată de aceste lumini este limitată la direcţia sau direcţiile arătate de săgeată sau de săgeţi.”

Punct suplimentar, de adăugat imediat după punctul 11 al acestui articol

Acest punct se va citi astfel: “În cazuri speciale, când nu este necesar să se folosească continuu semnale luminoase, poate fi folosit un semnal compus dintr-o lumină roşie neintermitentă precedată de o lumină galbenă neintermitentă; această ultimă lumină poate fi precedată de o lumină galbenă intermitentă.”

12. La Articolul 24 al Convenţiei (Semnale adresate numai pietonilor)

Punctul 1 alineatul a) ii)

Această dispoziţie nu va fi aplicată.

Punctul 2

Acest punct se va citi astfel: “Semnalele luminoase adresate pietonilor vor fi în sistem cu două culori având două lumini, respectiv roşu şi verde. Niciodată nu vor fi aprinse în acelaşi timp două lumini.”

Punctul 3

“1. Se recomandă să se semnalizeze prezenţa pe partea carosabilă a bornelor sau a refugiilor cu ajutorul luminilor sau dispozitivelor reflectorizante albe sau galbene.

2. Când marginile părţii carosabile sunt semnalizate cu ajutorul luminilor sau dispozitivelor reflectorizante, acestea vor fi:

a) ori toate albe sau galbene deschis;

b) ori albe sau galbene deschis pentru a semnaliza marginea părţii carosabile opusă sensului circulaţiei şi roşii sau galbene închis pentru a semnaliza marginea părţii carosabile corespunzătoare sensului circulaţiei.

 3. Fiecare Stat, Parte la prezentul Acord va adopta pentru întregul teritoriu aceeaşi culoare sau acelaşi sistem de culori pentru luminile sau dispozitivele reflectorizante prevăzute la prezentul articol.”

15. La Articolul 33 al Convenţiei

Punctul 1, alineatul a)

Acest alineat se va citi astfel:

“Dacă la o trecere la nivel este instalată o semnalizare pentru a anunţa apropierea trenurilor sau iminenţa închiderii barierelor ori semibarierelor, ea va fi alcătuită dintr-o lumină roşie intermitentă sau din două lumini roşii intermitente alternativ, astfel cum este prevăzut la punctul 1, b) al art.23 al Convenţiei. La trecerile la nivel fără bariere sau semibariere, semnalizarea va fi alcătuită, de preferinţă, din două lumini roşii intermitente alternativ. Totuşi:

i) Luminile roşii intermitente pot fi completate sau înlocuite de un semnal luminos din sistemul roşu - galben - verde, descris la punctul 2 al art.23 al Convenţiei, sau de un astfel de semnal din care lipseşte lumina verde dacă alte semnale luminoase cu trei culori se află pe drum puţin înainte de trecerea la nivel sau dacă trecerea la nivel este prevăzută cu bariere. Luminile roşii intermitente de la trecerile la nivel cu semibariere nu vor putea fi înlocuite în felul indicat în fraza anterioară; ele vor putea fi, totuşi, astfel completate cu condiţia ca alte semnale cu trei culori să se găsească pe drum cu puţin înainte de trecerea la nivel.

ii) Pe drumurile de pământ unde circulaţia este foarte redusă şi pe cărările pentru pietoni, nu poate fi folosit decât un semnal sonor.”

Punctul 2

Acest punct se va citi astfel: “Semnalele luminoase vor fi instalate la marginea părţii carosabile corespunzătoare sensului circulaţiei; atunci când împrejurările cer, de exemplu condiţiile de vizibilitate ale indicatoarelor sau intensitatea circulaţiei, indicatoarele vor fi repetate de cealaltă parte a drumului. Totuşi, dacă condiţiile locale impun, luminile vor putea fi repetate deasupra părţii carosabile sau pe un refugiu de pe partea carosabilă.”

EUROPEAN AGREEMENT

SUPPLEMENTING THE CONVENTIONON ROAD SIGNS AND

SIGNALSOPENED FOR SIGNATURE AT VIENNA

ON 8 NOVEMBER 1968

THE CONTRACTING PARTIES, BEING ALSO PARTIES TO THE CONVENTION ON ROAD SIGNS AND SIGNALS OPENED FOR SIGNATURE AT VIENNA ON 8 NOVEMBER 1968, DESIRING to achieve greater uniformity in the rules governing road

signs, signals and symbols and road markings in Europe,

HAVE AGREED as follows:

Article 1

The Contracting Parties, being also Parties to the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968, shall take appropriate measures to ensure that the system of road signs and signals and of road markings applied in their territories conforms to the provisions of the annex to this Agreement.

Article 2

1. This Agreement shall be open until 31 December1 1972 for signature by States which are signatories to the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968, or have acceded thereto, and are either members of the United Nations Economic Commission for Europe or have been admitted to the Commission in a consultative capacity in conformity with paragraph 8 of the terms of reference of the Commission.

2. This Agreement shall be subject to ratification after the State concerned has ratified the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968, or has acceded thereto.

The instruments of ratification shall be deposited with the Secretary- General of the United Nations.

3. This Agreement shall remain open for accession by any of the States referred to in paragraph 1 of this article which are Parties to the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968. The instruments of accession shall be deposited with the Secretary-General.

Article 3

1. Any State may, at the time of signing or ratifying this Agreement, or of acceding thereto, or at any time thereafter, declare by notification addressed to the Secretary-General that the Agreement shall become applicable to all or any of the territories for the international relations of which it is responsible. The Agreement shall become applicable to the territory or territories named in the notification thirty days after the receipt of the notification by the Secretary-General or on the date of entry into force of the Agreement for the State making the notification, whichever is the later.

2. Any State which has made a declaration under paragraph 1 of this article may at any time thereafter declare by notification addressed to the Secretary-General that the Agreement shall cease to be applicable to the territory named in the notification and the Agreement shall cease to be applicable to such territory one year from the date of receipt by the Secretary-General of the notification.

Article 4

1. This Agreement shall enter into force twelve months after the date of deposit of the tenth instrument of ratification or accession.

2. For each State ratifying, or acceding to, this Agreement after the deposit of the tenth instrument of ratification or accession, the Agreement shall enter into force twelve months after the date of deposit by such State of its instrument of ratification or accession.

3. If the date of entry into force applicable in pursuance of paragraphs 1 and 2 of this article precedes that resulting from the application of Article 39 of the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968, this Agreement shall enter into force within the meaning of paragraph 1 of this article on the later of those two dates.

Article 5

Upon its entry into force, this Agreement shall terminate and replace, in relations between the Contracting Parties, the provisions concerning the Protocol on Road Signs and Signals contained in the European Agreement supplementing the Convention on Road Traffic and the Protocol on Road Signs and Signals of 1949, signed at Geneva on 16 September 1950, the Agreement on Signs for Road Works signed at Geneva on 16 December 1955, and the European Agreement on Road Markings signed at Geneva on 13 December 1957.

Article 6

1. After this Agreement has been in force for twelve months, any Contracting Party may propose one or more amendments to the Agreement. The text of any proposed amendment, accompanied by an explanatory memorandum, shall be transmitted to the Secretary-General, who shall communicate it to all Contracting Parties. The Contracting Parties shall have the opportunity of informing him within a period of twelve months following the date of its circulation whether they:

(a) accept the amendment; or (b) reject the amendment; or (c) wish that a conference be convened to consider the amendment. The Secretary-General shall also transmit the text of the proposed amendment to the other States referred to in article 2 of this Agreement.

2. (a) Any proposed amendment communicated in accordance with paragraph 1 of this article shall be deemed to be accepted if within the period of twelve months referred to in the preceding paragraph less than one-third of the Contracting Parties inform the Secretary- General that they either reject the amendment or wish that a conference be convened to consider it. The Secretary-General shall notify all Contracting Parties of each acceptance or rejection of ary proposed amendment and of requests that a conference be convened. If the total number of such rejections and requests received during the specified period of twelve months is less than one-third of the total number of Contracting Parties, the Secretary-General shall notify all Contracting Parties that the amendment will enter into force six months after the expiry of the period of twelve months referred to in paragraph 1 of this article for all Contracting Parties except those which, during the period specified, have rejected the amendment or requested the convening of a conference to consider it.

(b) Any Contracting Party which, during the said period of twelve months, has rejected a proposed amendment or requested the convening of a conference to consider it may at any time after the end of such period notify the Secretary-General that it accepts the amendment, and the Secretary-General shall communicate such notification to all the other Contracting Parties. The amendment shall enter into force, with respect to the Contracting Party which has notified its acceptance, six months after the date on which the Secretary-General receives the notification.

3. If a proposed amendment has not been accepted in accordance with paragraph 2 of this article and if within the period of twelve months specified in paragraph 1 of this article less than half of the total number of the Contracting Parties inform the Secretary-General that they reject the proposed amendment and if at least one-third of the total number of Contracting Parties, but not less than five, inform him that they accept it or wish a conference to be convened to consider it, the Secretary-General shall convene a conference for the purpose of considering the proposed amendment or any other proposal which may be submitted to him in accordance with paragraph 4 of this article.

4. If a conference is convened in accordance with paragraph 3 of this article, the Secretary-General shall invite to it all the Contracting Parties and the other States referred to in article 2 of this Agreement, He shall request all States invited to the Conference to submit to him, at least six months before its opening date, any proposals which they may wish the Conference to consider in addition to the proposed amendment and shall communicate such proposals, at least three months before the opening date of the conference, to all States invited to the Conference.

5. (a) Any amendment to this Agreement shall be deemed to be accepted if it has been adopted by a two-thirds majority of the States represented at the Conference, provided that such majority comprises at least two- thirds of the Contracting Parties represented at the Conference. The Secretary-General shall notify all Contracting Parties of the adoption of the amendment, and the amendment shall enter into force twelve months after the date of this notification for all Contracting Parties except those which during that period have notified the Secretary-General that they reject the amendment.

(b) A Contracting Party which has rejected an amendment during the said period of twelve months may at any time notify the Secretary- General that it accepts the amendment, and the Secretary-General shall communicate such notification to all the other Contracting Parties.

The amendment shall enter into force, with respect to the Contracting Party which has notified its acceptance, six months after receipt by the Secretary-General of the notification or at the end of the said period of twelve months, whichever is later.

6. If the proposed amendment is not deemed to be accepted pursuant to paragraph 2 of this article and if the conditions prescribed by paragraph 3 of this article for convening a conference are not fulfilled, the proposed amendment shall be deemed to be rejected.

7. Independently of the amendment procedure prescribed in paragraphs 1-6 of this article, the annex to this Agreement may be amended by agreement between the competent administrations of all Contracting Parties. If the administration of a Contracting Party states that its national law obliges it to subordinate its agreement to the grant of a specific authorization or to the approval of a legislative body, the competent administration of the Contracting Party in question shall be considered to have consented to the amendment to the annex only at such time as it notifies the Secretary-General that it has obtained the required authorization or approval. The agreement between the competent administrations may provide that, during a transitional period, the former provisions of the annex shall remain in force, in whole or in part, simultaneously with the new provisions. The Secretary-General shall appoint the date of entry into force of the new provisions.

8. Each State shall, at the time of signing, ratifying, or acceding to, this Agreement, inform the Secretary-General of the name and address of its administration competent in the matter of agreement as contemplated in paragraph 7 of this article.

Article 7

Any Contracting Party may denounce this Agreement by written notification addressed to the Secretary-General. The denunciation shall take effect one year after the date of receipt by the Secretary- General of such notification. Any Contracting Party which ceases to be a Party to the Convention on Road Signs and Signals opened for signature at Vienna On 8 November 1968 shall on the same date cease to be a Party to this Agreement.

Article 8

This Agreement shall cease to be in force if the number of Contracting Parties is less than five for any period of twelve consecutive months, or at such time as the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968 ceases to be in force.

Article 9

1. Any dispute between two or more Contracting Parties which relates to the interpretation or application of this Agreement and which the Parties in dispute are unable to settle by negotiation or other means of settlement shall be referred to arbitration if any of the Contracting Parties in dispute so requests, and shall, to that end,

be submitted to one or more arbitrators selected by mutual agreement between the Parties in dispute. If the Parties in dispute fail to agree on the choice of an arbitrator or arbitrators within three months after the request for arbitration, any of those Parties may request the Secretary-General of the United Nations to appoint a single arbitrator to whom the dispute shall be submitted for decision.

2. The award of the arbitrator or arbitrators appointed in accordance with paragraph 1 of this article shall be binding upon the Contracting Parties in dispute.

Article 10

Nothing in this Agreement shall be construed as preventing a Contracting Party from taking such action, compatible with the provisions of the Charter of the United Nations and limited to the exigencies of the situation, as it considers necessary to its external or internal security.

Article 11

1. Any State may, at the time of signing this Agreement or of depositing its instrument of ratification or accession, declare that it does not consider itself bound by article 9 of this Agreement. Other Contracting Parties shall not be bound by article 9 with respect to any Contracting Party which has made such a declaration.

2. Reservations to this Agreement, other than the reservation provided for in paragraph 1 of this article, shall be permitted on condition that they are formulated in writing and, if formulated before the deposit of the instrument of ratification or accession, are confirmed in that instrument.

3. Any State shall, at the time of depositing its instrument of ratification of this Agreement or of accession thereto, notify the Secretary-General in writing to what extent any reservation made by it to the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968 apply to this Agreement. Any reservations to the Convention on Road Signs and Signals which have not been included in the notification made at the time of depositing the instrument of ratification of this Agreement or of accession thereto shall be deemed to be inapplicable to this Agreement.

4. The Secretary-General shall communicate the reservations and notifications made pursuant to this article to all States referred to in article 2 of this Agreement.

5. Any State which has made a declaration, a reservation or a notification under this article may withdraw it at any time by notification addressed to the Secretary-General.

6. Any reservation made in accordance with paragraph 2 or notified in accordance with paragraph 3 of this article,

(a) modifies, for the Contracting Party which has made or notified the reservation, the provisions of the Agreement to which the reservation relates, to the extent of the reservation;

(b) modifies those provisions to the same extent for the other Contracting Parties in their relations with the Contracting Party which made or notified the reservation.

Article 12

In addition to the declarations, notifications and communications provided for in articles 6 and 11 of this Agreement, the Secretary-General shall notify the Contracting Parties and the other States referred to in article 2 of the following:

(a) signatures, ratifications and accessions under article 2;

(b) notifications and declarations under article 3;

(c) the dates of entry into force of this Agreement in accordance with article 4;

(d) the date of entry into force of amendments to this Agreement in accordance with article 6, paragraphs 2, 5 and 7;

(e) denunciations under article 7;

(f) the termination of this Agreement under article 8.

Article 13

After 31 December21972, the original of this Agreement shall be deposited with the Secretary-General of the United Nations, who shall send certified true copies to all the States referred to in article 2 of this Agreement.

ANNEX

1. For the purpose of this annex, the term “Convention” means the Convention on Road Signs and Signals opened for signature at Vienna on 8 November 1968.

2. This annex contains only the additions to, and modifications of the corresponding provisions of the Convention.

3. Ad Article 1 of the Convention (Definitions)

Sub-paragraph (b)

This sub-paragraph shall be read as follows: “”Built-up area” means an area with entries and exits specially sign-posted as such;”

Sub-paragraph (l)

Three-wheeled vehicles whose unladen weight does not exceed 400 kg (900 lb) shall be treated as motor cycles.

Additional sub-paragraph to be inserted at the end of this Article

This sub-paragraph shall be read as follows: “Persons pushing or pulling a child′s carriage, a bath chair or invalid chair, or any other small vehicle without an engine, or pulling a cycle or moped and handicapped persons travelling in invalid chairs propelled by such persons or moving at walking pace shall be treated as pedestrians.”

4. Ad Article 3 of the Convention (Obligations of the Contracting Parties)

Paragraph 3

This paragraph shall be read as follows: “Any sign, symbol, installation or marking which does not conform to the system prescribed in the Convention and in this Agreement shall be replaced within ten years from the date of entry into force of this Agreement. During this period, in order to familiarize road-users with the system prescribed in the Convention and in this Agreement, previous signs, symbols and inscriptions may be retained beside those prescribed in the Convention and in this Agreement.”

5. Ad Article 6 of the Convention

Paragraph 4

The provisions of this paragraph, which are recommendations in the Convention, shall be obligatory.

6. Ad Article 7 of the Convention

Paragraph 1

Additional sentence to be inserted at the end of this paragraph

This sentence shall be read as follows: “In addition, in the case of such signs it is recommended that signs lighted or equipped with reflecting material or reflecting devices and signs not so lighted or equipped should not be used on the same section of road.”

7. Ad Article 8 of the Convention

Paragraph 3

This paragraph shall be read as follows: “During the transitional period of ten years prescribed in item 4 of this annex, and thereafter in exceptional circumstances to facilitate the interpretation of signs, an inscription may be added in a rectangular panel below the sign or in a rectangular panel containing the sign; such an inscription may also be placed on the sign itself, if this does not make the sign more difficult to understand for drivers who cannot understand the inscription.”

8. Ad Article 9 of the Convention

Paragraph 1

Each State shall select A as the model for danger warning signs.

9. Ad Article 10 of the Convention (Priority Signs)

Paragraph 3

Each State shall select B, 2a as the model for the “STOP” sign.

Paragraph 6

To give advance warning of sign B, 1, the same sign supplemented by a panel conforming to model 1 reproduced in Annex 7 to the Convention shall be used.

To give advance warning of sign B, 2a, sign B, 1, supplemented by a rectangular panel bearing the “STOP” symbol and a figure indicating the distance to the sign B, 2a , shall be used.

10. Ad Article 18 of the Convention (Place identification signs)

Paragraph 2

This paragraph shall he read as follows: “Signs E, 9a and E, 9c, conforming to the models reproduced in Annex 9 to the Convention, shall notify road-users that the general regulations governing traffic in built-up areas in the territory of the State apply from sign E, 9a to sign E, 9c except in so far as different regulations may be notified on certain sections of road in a built-up area. They shall bear inscriptions in a dark colour on a white or light-coloured ground and shall be placed respectively at the entries and exits of a built-up area. However, sign B, 4 shall always be placed on a priority road marked with sign B, 3 if that road ceases to have priority where it passes through the built-up area.”

Paragraph 3

This paragraph shall be read as follows: “Place identification signs used for purposes other than that referred to in paragraph 2 of this Article, as worded above, shall differ conspicuously from the signs referred to in that paragraph; they shall bear inscriptions in white or a light colour on a dark-coloured ground.”

11. Ad Article 23 of the Convention (Signals for vehicular traffic)

Additional paragraph to be inserted immediately after paragraph 3 of this Article

This paragraph shall be read as follows:

“(a) The provisions of Article 6, paragraphs 1, 2 and 3, of the Convention which relate to road signs shall apply to traffic light signals other than those used at level-crossings;

(b) Traffic light signals at intersections shall be placed before the intersection or in the middle of and above it; they may be repeated at the far side of the intersection;

(c) In addition, it is recommended that domestic legislation should provide that traffic light signals

(i) shall be so placed as not to impede vehicles moving in traffic on the carriageway and, in the case of signals set up on verges, as to impede pedestrians as little as possible;

(ii) shall be easily visible from a distance and readily understandable as they are approached; and

(iii) shall be standardized in the territory of each Contracting Party for the various categories of roads.”

Paragraph 9

This paragraph shall be read as follows: “Where the green light in a three-colour system has the shape of one or more green arrows on a circular, black background, the lighting of the arrow or arrows shall mean that vehicles may proceed only in the direction or directions thus indicated. Arrows meaning that traffic may proceed straight ahead shall point upwards.”

Paragraph 10

The beginning of this paragraph shall be read as follows: “Where a signal of a three-colour system includes one or more additional green lights in the shape of one or more green arrows on a circular black background, the lighting ...”

Additional paragraph to be inserted immediately after paragraph 10 of this Article

This paragraph shall be read as follows: “Where the red light or the yellow light shows the outline of one or more arrows, the meaning conveyed by the light shall apply only in respect of the direction or directions indicated by the arrow or arrows.”

Additional paragraph to be inserted immediately after paragraph 11 of this Article

This paragraph shall be read as follows: “In special cases where it is not necessary to use light signals continuously, a signal in the form of a non-flashing amber light followed by a non-flashing red light may be used; the non-flashing amber light may be preceded by a flashing amber light.”

12. Ad Article 24 of the Convention (Signals for pedestrians only)

Paragraph 1, sub-paragraph (a) (ii)

This provision shall not be applied.

Paragraph 2

This paragraph shall be read as follows: “Light signals for pedestrians shall be of the two-colour system, comprising two lights, red and green respectively. Two lights shall never be shown simultaneously.”

Paragraph 3

This paragraph shall be read as follows: “The lights shall be arranged vertically, with the red light always at the top and the green light always at the bottom. The red light shall be in the form of a standing pedestrian or of standing pedestrians and the green light in the form of a walking pedestrian or of walking pedestrians.”

13. Ad Article 31 of the Convention (Signs for road works)

Paragraph 2

The barriers shall not be painted with alternate black and white or black and yellow stripes.

14. Ad Article 32 of the Convention (Marking by lights or reflecting devices)

This article shall be read as follows:

1. It is recommended that attention should be drawn to the presence of bollards or islands on the carriageway by means of white or yellow lights or white or yellow reflecting devices.

2. If the edges of the carriageway are marked by means of lights or reflecting devices, the lights or reflecting devices shall be either

(a) all white or light yellow; or

(b) white or light yellow to mark the edge of the carriageway opposite to the direction of traffic, and red or dark yellow to mark the edge of the carriageway appropriate to the direction of traffic.

3. Each State Party to this Agreement shall adopt for the whole of its territory the same colour or the same system of colours for the lights or reflecting devices referred to in this Article.”

15. Ad Article 33 of the Convention

Paragraph 1. sub-paragraph (a)

This sub-paragraph shall be read as follows: “Where a signalling system is installed at a level-crossing to give warning of the approach of trains or of the imminent closing of the gates (barriers) or half-gates (half-barriers), it shall consist of a red flashing light or of red lights flashing alternately, as specified in Article 23, paragraph 1 (b), of the Convention. At level-crossings which have neither gates (barriers) nor half-gates (half-barriers), the signalling system shall preferably consist of two red lights flashing alternately. However:

(i) Flashing red lights may be supplemented or replaced by light signals of the three-colour red-amber-green system described in Article 23, paragraph 2, of the Convention, or by such a signal without the green light if other three-colour light signals axe installed on the road near the level-crossing or if the crossing is equipped with gates (barriers). Flashing red lights at level-crossings having half-gates (half-barriers) may not be replaced in the manner specified in the preceding sentence; they may however be supplemented in that manner on condition that other three-colour light signals are installed on the road near the level-crossing.

(ii) On earth-tracks (dirt roads) where traffic is very light, and on footpaths, only a sound signal need be used.”

Paragraph 2

This paragraph shall be read as follows: “The light signals shall be installed on the edge of the carriageway appropriate to the direction of traffic; whenever conditions such as the visibility of the signals or the density of traffic so require, the lights shall be repeated on the other side of the road. However, if it is considered preferable because of local conditions, the lights may be repeated above the carriageway or on an island in the carriageway.”

16. Ad Article 35 of the Convention

Paragraph 1

The gates (barriers) and half-gates (half-barriers) of level- crossings shall not be marked in alternate stripes of black and white or black and yellow.

17. Ad Annex 1, Section B, to the Convention

Paragraph 2 (Dangerous descent)

This paragraph shall be read as follows: “To give warning of a steep descent, symbol A, 2a shall be used.

The left-hand part of symbol A, 2 shall occupy the left-hand corner of the sign panel and its base shall extend over the whole width of the panel; the figure shows the gradient as a percentage.”

Paragraph 3 (Steep ascent)

This paragraph shall be read as follows: “To give warning of a steep ascent, symbol A, 3a shall be used.

The right-hand part of symbol A, 3a shall occupy the right-hand corner of the sign panel and its base shall extend over the whole width of the panel; the figure shows the gradient as a percentage.”

Paragraph 11 (Pedestrian crossing)

This paragraph shall be read as follows: “Warning of a pedestrian crossing shall be given by symbol A, 11a. The symbol may be reversed.”

18. Ad Annex 2, Section A, to the Convention

Paragraph 1 (“GIVE WAY” sign)

Sign B, 1 shall bear neither symbol nor inscription.

Paragraph 2 (“STOP” sign)

This paragraph shall be read as follows: “The “STOP” sign shall be sign B, 2, model B, 2a. Sign B, 2, model B, 2a shall be octagonal with a red ground, surrounded by a narrow white or light yellow border and bear the symbol “STOP” in white or light yellow; the height of the symbol shall be not less than one-third of the height of the panel.

The height of the normal-sized sign B, 2a shall be approximately 0.90 m (3 feet); the height of the small signs shall be not less than 0.60 m (2 feet).”

19. Ad Annex 2, Section B, to the Convention

Paragraph 2 (Symbols), sub-paragraph (a) (i)

This provision shall be read as follows: “Intersection where the priority is that prescribed by the general priority rule in force in the country: symbol A, 21a shall be used.”

Paragraph 2 (Symbols), sub-paragraph (a) (iii)

This provision shall be read as follows: “Intersection with a road to whose users drivers must give way. Sign B, 1 or sign B, 2a shall be used in conformity with the provisions of item 9 of this annex.”

Paragraph 2 (Symbols), Sub-paragraph (b)

This sub-paragraph shall be read as follows: “If traffic at the intersection is regulated by a light signal, a sign Aa, bearing the symbol A, 16 described in Annex 1, Section B, to the Convention, may be set up to supplement or replace the sign described in this section.”

20. Ad Annex 3. Section A. to the Convention

Introductory sub-paragraph, first sentence

This sentence shall be read as follows: “The sign to be used shall be sign A described in Annex 1, Section A, to the Convention.”

Sub-paragraph (b)

This sub-paragraph shall be read as follows: “Warning of other level-crossings shall be given by the symbol A, 27

21. Ad Annex 3, Section B, to the Convention

Model B, 7C of sign B, 7 shall not be used.

Models B, 7a and B, 7b may show red stripes on condition that neither the general appearance nor the effectiveness of the signs is impaired thereby.

22. Ad Annex 4, Section A, to the Convention

Paragraph 2 (Description of signs), sub-paragraph (a) (Prohibition and restriction of entry) (i)

Model C, 1b of sign C, 1 shall not be used.

Paragraph 2 (Description of signs), sub-paragraph (a) (Prohibition and restriction of entry) (iii) The two additional signs reproduced in the appendix to this

annex and having the following meaning may be used:

Additional sign No. 1 “NO ENTRY FOR VEHICLES CARRYING MORE THAN A CERTAIN QUANTITY OF EXPLOSIVES OR READILY INFLAMMABLE SUBSTANCES”

Additional sign No. 2 “NO ENTRY FOR VEHICLES CARRYING MORE THAN A CERTAIN QUANTITY OF SUBSTANCES LIABLE TO CAUSE WATER POLLUTION”.

The note at the end of this provision shall be read as follows: “Signs C, 3a to C, 3k as well as the additional signs No. 1 and No. 2 mentioned under this item shall not incorporate an oblique red bar.”

Paragraph 2 (Description of signs), sub-paragraph (d) (Prohibition of overtaking)

Models C, 13ab and C, 13bb of the signs C, 13a and C, 13b shall not be used.

23. Ad Annex 4, Section B, to the Convention

Paragraph 1 (General characteristics of signs and symbols), Sub-paragraph (b)

This sub-paragraph shall be read as follows: “Unless provided otherwise, the signs shall be blue and the symbols shall be white or of a light colour.”

Paragraph 2 (Description of signs), sub-paragraph (a) (Direction to be followed)

Sign D, 1b shall not be used.

Paragraph 2 (Description of signs), sub-paragraph (c) (Compulsory roundabout)

This sub-paragraph shall be read as follows: “Sign D, 3 “COMPULSORY ROUNDABOUT” shall have no meaning other than to show the prescribed direction of movement of gyratory vehicular traffic.

Where traffic keeps to the left, the direction of the arrows shall be reversed.”

24. Ad Annex 5 to the Convention

General characteristics of signs and symbols in Section A to F

Additional paragraph to be inserted immediately before Section A of this Annex

This paragraph shall be read as follows: “On advance direction signs or direction signs relating to motorways or to roads treated as motorways, the symbols used on signs E, 15 and E, 17 may be reproduced on a reduced scale.”

25. Ad Annex 5, Section A, to the Convention

Paragraph 2 (Special cases), sub-paragraph (a)

The red bar of signs E, 2a and E, 2b shall be surrounded by a white rim.

26. Ad Annex 5, Section B, to the Convention

Paragraph 1

Sign E, 5C shall not be used.

Paragraph 2

Sign E, 6C shall not be used.

27. Ad Annex 5, Section C, to the Convention

Additional paragraph to be inserted at the end of this Section

This paragraph shall be read as follows: “Signs E, 9a and E, 9c, bearing inscriptions in a dark colour on a white or light- coloured ground, shall be used in conformity with the provisions of item 10 of this annex.”

28. Ad Annex 5, Section E, to the Convention

Sign E, 11b shall not be used.

29. Ad Annex 5, Section F, to the Convention

Paragraph 2 (“ONE-WAY ROAD” sign), Sub-paragraph (b)

The arrow of sign E, 13b shall bear an inscription only if the

effectiveness of the sign is not impaired thereby.

Paragraph 3 (“NO THROUGH ROAD” sign)

The red bar of sign E, 14 shall be surrounded by a white rim.

Paragraph 4 (Signs notifying an entry to or an exit from a motorway)

Additional sub-paragraph, to be inserted immediately after the first sub-paragraph of this paragraph

This sub-paragraph shall be read as follows: “Sign E, 15 may be used, and repeated, to give warning of the approach of a motorway.

Each sign set up for this purpose shall carry either an inscription in its lower part showing the distance between the sign and the beginning of the motorway or an additional panel conforming to model 1 in Annex 7 to the Convention.”

Paragraph 5 (Signs notifying an entry to or an exit from a road on which the traffic rules are the same as on a motorway)

Additional sub-paragraph to be inserted immediately after the first sub-paragraph of this paragraph

This sub-paragraph shall be read as follows: “Sign E, 17 may be used and repeated to give warning of the approach to a road on which the traffic rules are the same as on a motorway. Each sign set up for this purpose shall carry either an inscription in its lower part showing the distance between the sign and the beginning of the road on which the traffic rules are the same as on a motorway or an additional panel conforming to model 1 in Annex 7 to the Convention.”

30. Ad Annex 3, Section G, to the Convention

Paragraph 2 (Description of symbols), sub-paragraph (a)

Symbols F, 1b and F, 1c shall not be used.

31. Ad Annex 6, Section A, to the Convention Description of signs

Paragraph 1, sub-paragraph (b)

This provision shall not be applied.

Paragraph 2. sub-paragraph (c)

This provision shall not be applied.

Paragraph 3. sub-paragraph (e)

The possibility, where the prohibition applies only over a short distance, of setting up only one sign showing in a red circle the distance on which the prohibition applies, shall not be used.

32. Ad Annex 6, Section B, to the Convention

Paragraph 1 (“PARKING” sign)

The square panel mentioned in the first sub-paragraph of this paragraph shall bear the letter “P”.

Paragraph 2 (Sign indicating the exit from a limited duration parking zone)

Additional text to be inserted at the end of this paragraph

This text shall be read as follows: “Instead of the parking disc, the signs depicted on the entry sign may be used, in light grey.

The sign indicating the exit from a limited duration parking zone may be placed on the reverse side of the sign indicating the entry to the zone and intended for oncoming traffic.”

33. Ad Annex 7 of the Convention (Additional Panels)

Additional paragraph to be inserted immediately after paragraph 1

This paragraph shall be read as follows: “The ground of additional panels should be preferably the same as the ground of the particular groups of signs with which they are used.”
