sociale între Republica Moldova şi Republica Portugheză

În scopul aplicării Acordului în domeniul securităţii sociale între Republica Moldova şi Republica Portugheză, semnat la Lisabona la 11 februarie 2009, denumit în continuare “Acord”,
Autorităţile competente moldave şi portugheze, în conformitate cu litera a) alineatul 1 al Articolului 23 al Acordului, au convenit asupra următoarelor prevederi:
PARTEA I
DISPOZIŢII GENERALE
Articolul 1
Definiţii
În scopul aplicării prezentului Aranjament, termenii şi expresiile utilizate în acesta au semnificaţia care le-a fost atribuită în Articolul 1 al Acordului.
Articolul 2
Organele de legătură
1. În conformitate cu litera d) alineatul 1 al Articolului 23 al Acordului, următoarele organe sunt desemnate ca “organe de legătură”:
a) Pentru Republica Moldova: Casa Naţională de Asigurări Sociale;
b) Pentru Republica Portugheză: Direcţia Generală de Securitate Socială.
2. Organele de legătură vor:
a) Stabili de comun acord colectarea documentelor necesare pentru aplicarea Acordului şi a prezentului Aranjament;
b) Întreprinde de comun acord măsuri de natură administrativă necesare pentru aplicarea prezentului Aranjament;
c) Întreprinde măsuri pentru informarea persoanelor interesate asupra drepturilor lor şi procedurilor potrivite pentru exercitarea drepturilor acestora.
Articolul 3
Admiterea la asigurarea benevolă – aplicarea Articolului 5 al Acordului
1. Pentru aplicarea prevederilor alineatului 1 al Articolului 5 al Acordului, persoana interesată trebuie să prezinte instituţiei competente un certificat cu privire la perioadele de asigurare realizate în conformitate cu legislaţia căreia a fost supus ultima dată.
2. Certificatul se eliberează, la cererea persoanei interesate, de către instituţia competentă a Statului Contractant legislaţiei căruia aceasta a fost supusă ultima dată.
3. În cazul în care solicitantul nu prezintă certificatul menţionat, instituţia competentă îl va obţine de la instituţia competentă a celuilalt Stat Contractant.
Articolul 4
Evitarea cumulului de prestaţii – aplicarea Articolului 7 al Acordului
În cazul în care, conform alineatului 3 al Articolului 7 al Acordului, prestaţiile datorate sunt simultan micşorate, suspendate sau sistate în conformitate cu legislaţia ambelor State Contractante, micşorarea, suspendarea sau sistarea fiecărei prestaţii nu va depăşi o jumătate din suma corespunzătoare cu cea care ar fi trebuit să fie micşorată, suspendată sau sistată din prestaţie.
Articolul 5
Reguli de totalizare a perioadelor de asigurare
Pentru totalizarea perioadelor de asigurare realizate conform legislaţiei celor două State Contractante în temeiul Acordului, instituţia competentă va aplica următoarele reguli:
a) În cazul în care o perioadă de asigurare, realizată în sistemul de asigurări obligatoriu în conformitate cu legislaţia unui Stat Contractant, integral sau parţial coincide cu o perioadă de asigurare realizată în sistemul de asigurări benevol în conformitate cu legislaţia celuilalt Stat Contractant, instituţia competentă va lua în considerare numai perioada realizată în sistemul de asigurări obligatoriu;
b) În cazul cînd o perioadă de asigurare, alta decît perioada asimilată, realizată în conformitate cu legislaţia unui Stat Contractant coincide cu o perioadă asimilată realizată în conformitate cu legislaţia celuilalt Stat Contractant, instituţia competentă va lua în considerare numai acea parte a perioadei de asigurare care nu se suprapune;
c) Orice perioadă considerată ca fiind simultan echivalentă, în întregime sau parţial, în conformitate cu legislaţia celor două State Contractante, este luată în considerare numai de către instituţia Statului Contractant în conformitate cu legislaţia căruia persoana a fost asigurată obligatoriu ultima dată înainte de perioada menţionată, în partea în care nu se suprapune;
d) În cazul menţionat în litera c), dacă persoana asigurată nu a fost asigurată obligatoriu conform legislaţiei unui Stat Contractant înainte de perioada menţionată, aceasta din urmă va fi luată în considerare de către instituţia competentă a Statului Contractant conform legislaţiei căruia persoana a fost asigurată obligatoriu pentru prima dată după perioada în cauză;
e) În cazul în care nu este posibilă determinarea cu exactitate a perioadei de timp în care anumite perioade de asigurare au fost realizate conform legislaţiei unui Stat Contractant, aceste perioade se prezumă a nu se suprapune cu perioadele de asigurare realizate în conformitate cu legislaţia celuilalt Stat Contractant şi, în caz că sunt avantajoase, sunt luate în considerare.
PARTEA a II-a
APLICAREA DISPOZIŢIILOR GENERALE ALE ACORDULUI
PENTRU DETERMINAREA LEGISLAŢIEI APLICABILE
Articolul 6
Formalităţile în caz de detaşare a unui lucrător în conformitate
cu alineatele 1, 2 şi 4 ale Articolului 9 al Acordului
1. În cazurile prevăzute la alineatele 1 şi 4 ale Articolului 9 al Acordului, autoritatea competentă sau instituţia competentă în care lucrătorul este asigurat trimite angajatorului sau lucrătorului, în dependenţă de faptul dacă el este un lucrător angajat sau un lucrător independent, la cererea acestuia, un certificat care să confirme că persoana în cauză continuă a fi supusă legislaţiei pe care o aplică această autoritate sau instituţie, indicînd anticipat perioada de detaşare.
2. Certificatul menţionat în alineatul 1 conţine toată informaţia referitoare la lucrător şi angajatorul său, precum şi durata perioadei de detaşare, denumirea şi adresa întreprinderii sau organului în care va fi desfăşurată activitatea, ştampila autorităţii competente sau a instituţiei competente, precum şi data emiterii certificatului.
3. În cazul prevăzut la alineatul 1 al Articolului 9 al Acordului, angajatorul, înainte de finisarea primei perioade de 24 luni, solicită acordul autorităţii sau organului desemnat al Statului Contractant de la locul de detaşare, în formularul stabilit pentru acest scop.
4. Autoritatea sau organul desemnat al Statului Contractant de la locul de detaşare, prevăzute la alineatul 3, indică în formularul menţionat decizia luată, trimite o copie angajatorului şi o altă copie autorităţii celuilalt Stat Contractant, păstrînd-o a treia copie pentru sine însăşi.
5. În cazul în care detaşarea lucrătorului încetează înainte de data stabilită iniţial, întreprinderea care îl angajează în mod normal comunică despre situaţia creată autorităţii competente sau instituţiei Statului Contractant pe teritoriul căruia lucrătorul este asigurat, care fără întîrziere va informa autoritatea sau instituţia competentă a celuilalt Stat Contractant.
Articolul 7
Exercitarea dreptului la opţiune de către personalul angajat de către misiunile diplomatice
şi oficiile consulare – aplicarea alineatului 3 al Articolului 10 al Acordului
1. Persoana angajată care a exercitat dreptul la opţiune prevăzut la alineatul 3 al Articolului 10 al Acordului va informa instituţia competentă a Statului Contractant pentru legislaţia cărui Stat a optat şi, concomitent, va notifica angajatorul său despre acest fapt.
2. Instituţia prevăzută la alineatul 1 va înmîna lucrătorului angajat un certificat care să ateste faptul că acesta este supus legislaţiei pe care această instituţie o aplică şi va informa instituţia competentă a celuilalt Stat Contractant.
PARTEA a III-a
APLICAREA DISPOZIŢIILOR ACORDULUI REFERITOARE
LA DIFERITELE CATEGORII DE PRESTAŢII
Capitolul I
BOALĂ ŞI MATERNITATE, PATERNITATE ŞI ADOPŢIE – PRESTAŢII ÎN BANI
Articolul 8
Certificatul privind perioadele de asigurare – aplicarea Articolului 12 al Acordului
1. Pentru aplicarea prevederilor Articolului 12 al Acordului, lucrătorul trebuie să prezinte instituţiei competente un certificat în care să fie menţionate perioadele de asigurare realizate în conformitate cu legislaţia căreia acesta a fost supus ultima dată.
2. Acest certificat se eliberează la cererea lucrătorului de către instituţia competentă a Statului Contractant pe teritoriul căruia acesta a fost ultima dată asigurat.
3. Dacă lucrătorul nu prezintă certificatul, instituţia competentă îl va obţine de la instituţia competentă a celuilalt Stat Contractant.
Articolul 9
Prestaţii în bani în cazul domiciliului într-un Stat Contractant, altul
decît cel competent – aplicarea Articolului 13 al Acordului
1. Pentru a beneficia de prestaţii în bani în conformitate cu Articolul 13 al Acordului, lucrătorul trebuie să depună fără întîrziere o cerere la instituţia competentă, fie direct fie prin intermediul instituţiei de la locul de domiciliu, care o va transmite instituţiei competente.
2. Lucrătorul menţionat la alineatul 1 care cade sub incidenţa Articolului 25 al prezentului Aranjament, la cererea instituţiei competente, poate fi supus controlului administrativ şi investigărilor medicale în conformitate cu regulile prevăzute de legislaţia aplicabilă de către instituţia de la locul de domiciliu.
Capitolul II
PENSII DE INVALIDITATE, BĂTRÎNEŢE ŞI DE URMAŞ
ŞI PRESTAŢII ÎN CAZ DE DECES
Secţiunea I
Pensii de invaliditate, bătrîneţe şi de urmaş
Articolul 10
Depunerea cererilor pentru prestaţii – aplicarea Articolelor 15 şi 16 ale Acordului
1. Pentru a beneficia de pensii de invaliditate, bătrîneţe şi de urmaş în conformitate cu Articolele 15 şi 16 ale Acordului, un lucrător sau urmaşul acestuia, care domiciliază în Moldova sau în Portugalia, vor depune o cerere la instituţia competentă a Statului Contractant pe teritoriul căruia persoana interesată domiciliază, în conformitate cu procedurile prevăzute de legislaţia pe care o aplică această instituţie.
2. În cazul în care solicitantul domiciliază pe teritoriul unui Stat terţ, acesta va prezenta cererea instituţiei competente a Statului Contractant legislaţiei căruia lucrătorul a fost supus ultima dată.
3. Dacă cererea este prezentată instituţiei, alta decît cea menţionată la alineatele 1 şi 2 ale prezentului Articol, această instituţie va transmite fără întîrziere cererea instituţiei la care aceasta trebuia depusă, indicînd data în care cererea a fost recepţionată.
4. Data menţionată la alineatul 3 va fi considerată data depunerii cererii la cea din urmă instituţie.
Articolul 11
Documente şi informaţii
Depunerea cererilor prevăzute la Articolul 10 al prezentului Aranjament este supusă următoarelor reguli:
a) Cererea trebuie să fie însoţită de documente justificative solicitate şi trebuie întocmită în modul stabilit de legislaţia:
i) Statului Contractant pe al cărui teritoriu solicitantul domiciliază în cazul prevăzut la alineatul 1 al Articolului 10;
ii) Statului Contractant legislaţiei căruia lucrătorul a fost supus ultima dată în cazul prevăzut la alineatul 2 al Articolului 10.
b) Exactitatea informaţiei prezentate de către solicitant trebuie să fie justificată de documente oficiale anexate la formularul cererii sau confirmată de către organele competente ale Statului Contractant cărui aparţine instituţia care a primit cererea;
c) Solicitantul trebuie să indice, în măsura posibilităţii, instituţia sau instituţiile ale celor două State Contractante în care lucrătorul a fost asigurat, precum şi angajatorul sau angajatorii pentru care a desfăşurat activitatea în acele State Contractante.
Articolul 12
Formularele utilizate pentru instrumentarea cererilor
1. La instrumentarea cererilor pentru prestaţii instituţia care a primit cererea va utiliza un formular de legătură, duplicatul căruia îl va transmite instituţiei competente a celuilalt Stat Contractant.
2. Transmiterea formularului de legătură substituie documentele justificative atîta timp cît datele care se conţin în formular sunt autentificate de instituţia trimiţătoare care va confirma că documentele originale conţinute în dosar corespund datelor prezentate în formular.
Articolul 13
Proceduri care trebuie urmate de către instituţiile competente
1. Instituţia care recepţionează cererea va indica în formularul prevăzut în Articolul 12 al prezentului Aranjament data în care a fost depusă cererea, perioadele de asigurare realizate de către lucrător în conformitate cu legislaţia pe care o aplică, precum şi drepturile posibile care rezultă din aceste perioade.
2. În cazul în care cererea se referă la prestaţii de invaliditate, instituţia prevăzută la alineatul 1 anexează la formularul de legătură rapoartele medicale de care dispune, pentru aplicarea propriei legislaţii.
3. Instituţia competentă a celuilalt Stat Contractant completează formularul de legătură indicînd perioadele de asigurare realizate în conformitate cu legislaţia pe care o aplică şi drepturile posibile dobîndite de către solicitant, recurgînd, dacă este necesar, la totalizarea perioadelor de asigurare prevăzută în Articolul 15 al Acordului. Această instituţie va returna fără întîrziere o copie a formularului astfel completată instituţiei care a recepţionat cererea.
4. La recepţionarea copiei formularului de legătură, instituţia care a primit cererea, după stabilirea dreptului la prestaţii, recurgînd, în măsura în care este necesar, la totalizarea perioadelor de asigurare prevăzută în Articolul 15 al Acordului, va informa despre decizia sa instituţia competentă a celuilalt Stat Contractant.
Articolul 14
Notificarea deciziilor
Instituţia competentă al fiecărui Stat Contractant va înştiinţa solicitantul despre decizia luată, menţionînd temeiul şi termenele de atac şi va trimite o copie instituţiei competente a celuilalt Stat Contractant,
Articolul 15
Convertirea valutei
Pentru aplicarea dispoziţiilor alineatului 5 al Articolului 16 al Acordului, convertirea sumelor de pensie în valuta naţională a celor două State Contractante se efectuează la cursul oficial valabil la data cînd această prevedere trebuie să fie aplicată.
Secţiunea II
Ajutor de deces
Articolul 16
Certificatul privind perioadele de asigurare – aplicarea Articolului 17 al Acordului
În cazurile de aplicare a Articolului 17 al Acordului, instituţia competentă a unui Stat Contractant va obţine de la instituţia competentă a celuilalt Stat Contractant un certificat privind perioadele de asigurare realizate în conformitate cu legislaţia celui din urmă Stat Contractant.
Capitolul III
ŞOMAJ
Articolul 17
Plata prestaţiilor – aplicarea Articolului 18 al Acordului
Prestaţiile de şomaj prevăzute în Articolul 18 al Acordului sunt plătite în conformitate cu procedurile şi termenele prevăzute de legislaţia pe care o aplică fiecare Stat Contractant.
Capitolul IV
ACCIDENTE DE MUNCĂ ŞI BOLI PROFESIONALE – PRESTAŢII ÎN BANI
Articolul 18
Prestaţii în bani în cazul domiciliului în Statul Contractant, altul
decît cel competent – aplicarea Articolului 19 al Acordului
1. Pentru a beneficia de prestaţiile în bani prevăzute la Articolul 19 al Acordului, un lucrător sau urmaşii acestuia trebuie să depună o cerere instituţiei competente fie direct, fie prin intermediul instituţiei de la locul de domiciliu, care o va transmite instituţiei competente.
2. Instituţia competentă verifică dreptul lucrătorului sau a urmaşilor săi în conformitate cu legislaţia pe care o aplică şi stabileşte cuantumul prestaţiilor.
3. Aceeaşi instituţie informează în mod direct solicitantul despre decizia sa, justificată în mod corespunzător, menţionînd temeiul şi termenele de atac.
Articolul 19
Evaluarea gradului de incapacitate – aplicarea
alineatului 1 al Articolului 20 al Acordului
1. Pentru evaluarea gradului de incapacitate în cazurile prevăzute la alineatul 1 al Articolului 20 al Acordului, lucrătorul trebuie să prezinte instituţiei competente toată informaţia privind accidentele de muncă sau bolile profesionale contractate în perioada cînd acesta a fost supus legislaţiei celuilalt Stat Contractant, indiferent de gradul de incapacitate rezultat din aceste cazuri.
2. Informaţia menţionată la alineatul 1 va fi confirmată, în măsura posibilităţii, de către instituţia competentă a Statului Contractant, pe teritoriul căruia a survenit accidentul sau a fost diagnosticată boala profesională.
Articolul 20
Procedurile în cazul expunerii aceluiaşi risc al unei boli profesionale
în ambele State Contractante – aplicarea Articolului 21 al Acordului
1. În cazurile prevăzute la Articolul 21 al Acordului, notificarea cu privire la boala profesională este transmisă instituţiei competente a Statului Contractant pe teritoriul căruia persoana care a suferit o boală profesională a desfăşurat pentru ultima dată o activitate susceptibilă a fi cauza bolii profesionale respective sau instituţiei de la locul de domiciliu, care va expedia, fără întîrziere, notificarea instituţiei competente.
2. În cazul cînd instituţia competentă a Statului Contractant pe teritoriul căruia lucrătorul ultima dată a desfăşurat activitatea susceptibilă a fi cauza bolii profesionale respective constată că lucrătorul sau urmaşii lui nu întrunesc condiţiile legislaţiei pe care instituţia o aplică, chiar luînd în considerare dispoziţiile alineatelor 2 şi 3 ale Articolului 20 al Acordului, instituţia va:
a) trimite, fără întîrziere, instituţiei Statului Contractant pe teritoriul căruia persoana care a suferit boala a desfăşurat anterior o activitate susceptibilă a fi cauza bolii certificatul şi documentele de însoţire, precum şi o copie a deciziei la care se face referire în litera b);
b) notifica simultan persoana interesată despre decizia sa de a respinge cererea, menţionînd anume condiţiile necesar a fi întrunite pentru deschiderea dreptului la prestaţii, motivele şi termenele de atac, precum şi data transmiterii certificatului instituţiei de investigare.
Articolul 21
Agravarea unei boli profesionale – aplicarea Articolului 22 al Acordului
1. Pentru aplicarea Articolului 22 al Acordului, lucrătorul trebuie să furnizeze instituţiei Statului Contractant de la locul nou de domiciliu toată informaţia necesară cu privire la prestaţiile acordate anterior pentru boala profesională în cauză. Instituţia poate să se adreseze instituţiei anterior competente pentru a obţine informaţie suplimentară.
2. În cazul prevăzut la litera a) a Articolului 22 al Acordului, dacă lucrătorul nu a desfăşurat pe teritoriul Statului Contractant de la locul nou de domiciliu o activitate susceptibilă să cauzeze agravarea bolii profesionale respective, instituţia de la locul nou de domiciliu va expedia instituţiei competente a celuilalt Stat Contractant o copie a deciziei de respingere a cererii despre care persoana interesată a fost deja notificată, aplicînd, la necesitate, dispoziţiile alineatului 2 al Articolului 20 al prezentului Aranjament.
3. În cazul prevăzut la litera b) a Articolul 22 al Acordului, dacă lucrătorul a desfăşurat efectiv pe teritoriul Statului Contractant de la locul nou de domiciliu o activitate susceptibilă a cauza agravarea bolii profesionale respective, instituţia de la locul nou de domiciliu va informa instituţia competentă a celuilalt Stat Contractant despre obligaţiile de care este responsabilă.
Articolul 22
Contestarea împotriva unei decizii de respingere a cererii
În cazul în care a fost înaintată o contestare împotriva unei decizii de respingere a cererii luate de instituţia competentă a Statului Contractant pe teritoriul căruia persoana care a suferit o boală profesională a desfăşurat pentru ultima dată o activitate susceptibilă să cauzeze boala profesională respectivă, această instituţie va informa instituţia celuilalt Stat Contractant despre acest fapt şi despre decizia finală.
Articolul 23
Desemnarea instituţiilor competente
Pentru aplicarea Articolelor 19-22 ale Acordului, următoarele organe sunt desemnate ca instituţii competente:
a) Pentru Republica Moldova: Casa Naţională de Asigurări Sociale;
b) Pentru Republica Portugheză: Institutul de Securitate Socială prin intermediul Centrului Naţional de Protecţie contra Riscurilor Profesionale.
PARTEA a IV-a
DISPOZIŢII DIVERSE
Articolul 24
Obligaţia de informare
Instituţiile competente ale unui Stat Contractant vor informa fără întîrziere instituţiile competente ale celuilalt Stat Contractant despre toate faptele de care au luat cunoştinţă, relevante pentru aplicarea Acordului şi a prezentului Aranjament, în special cele legate de menţinerea dreptului la prestaţii.
Articolul 25
Controalele administrative şi investigaţiile medicale
1. Controalele administrative şi investigaţiile medicale ale persoanelor îndreptăţite la prestaţii în conformitate cu legislaţia unui Stat Contractant, care domiciliază pe teritoriul celuilalt Stat Contractant, sunt efectuate la cererea instituţiei competente, de către instituţia de la locul de domiciliu sau de către organul de legătură care poate utiliza serviciile instituţiei desemnate de aceasta.
2. Instituţia competentă totodată rezervă dreptul ca persoana îndreptăţită la prestaţii să fie examinată de către un medic la opţiunea aceleiaşi instituţii competente.
Articolul 26
Determinarea gradului şi grupei de invaliditate
1. Pentru stabilirea gradului şi grupei de invaliditate, instituţiile celor două State Contractante iau în considerare rapoartele medicale şi informaţia de natură administrativă obţinute de către instituţia celuilalt Stat Contractant, fiecare instituţie rezervînd totodată dreptul, ca prin intermediul unui medic ales de ea să solicite examinarea beneficiarului,
2. Costurile rezultate din controlul administrativ şi investigaţiile medicale, necesare pentru acordarea sau revizuirea prestaţiilor sunt rambursate de către instituţia în numele căreia a fost efectuat controlul, instituţiei care a fost responsabilă de acesta, în baza tarifelor aplicate de cea din urmă instituţie.
3. Rambursările prevăzute la alineatul 2 vor fi efectuate prin intermediul următoarelor instituţii:
a) În Republica Moldova: Casa Naţională de Asigurări Sociale;
b) În Republica Portugheză: Institutul de Securitate Socială prin intermediul Departamentului de Administrare Financiară.
Articolul 27
Restabilirea plăţii prestaţiilor
În cazul în care, după suspendarea unei prestaţii acordate în conformitate cu legislaţia unui Stat Contractant, persoana în cauză redobîndeşte dreptul său la aceeaşi prestaţie avînd domiciliul pe teritoriul celuilalt Stat Contractant, instituţiile în cauză vor efectua schimbul de informaţii relevante, în scopul reluării plăţii prestaţiei respective.
Articolul 28
Plata prestaţiilor
Prestaţiile în bani datorate de către instituţiile competente ale celor două State Contractante vor fi plătite direct persoanei interesate, indiferent de faptul dacă domiciliază pe teritoriul unuia sau celuilalt Stat Contractant, fără reţineri din suma datorată de taxe poştale şi bancare, care sunt suportate de către instituţia responsabilă pentru plată.
Articolul 29
Confirmarea vieţii şi statutului civil
Instituţiile competente ale celor două State Contractante pot solicita de la persoana în cauză direct, fie prin intermediul instituţiei de la locul de domiciliu, certificatul privind aflarea în viaţă a persoanei şi confirmarea statutului civil, precum şi alte documente necesare pentru verificarea dreptului la prestaţii sau menţinerea acestora.
Articolul 30
Cereri, declaraţii sau cereri de contestare introduse în Statul Contractant,
altul decît cel competent – aplicarea Articolului 26 al Acordului
Pentru aplicarea Articolului 26 al Acordului, autoritatea, instituţia sau instanţa de judecată care a recepţionat cererea, declaraţia sau cererea de contestare o va transmite fără întîrziere autorităţii, instituţiei sau instanţei de judecată a celuilalt Stat Contractant, indicînd data recepţionării.
Articolul 31
Comitetul mixt
Autorităţile competente vor constitui un comitet mixt cu caracter tehnic care se va întruni alternativ în Moldova şi în Portugalia, pentru a:
a) expune opinii motivate asupra problemelor de interpretare şi aplicare a Acordului şi a prezentului Aranjament;
b) stabili modelul formularelor prevăzute în prezentul Aranjament, precum şi procedurile necesare pentru aplicarea Acordului şi a prezentului Aranjament;
c) reglementa conturile existente între instituţiile Statelor Contractante;
d) se pronunţa asupra oricărei probleme prezentate spre examinare autorităţilor competente.
Articolul 32
Intrarea în vigoare
Prezentul Aranjament va intra în vigoare la data semnării, va produce efecte juridice începînd cu data intrării în vigoare a Acordului şi va rămîne în vigoare pe perioada valabilităţii acestuia.
ÎNTOCMIT în două exemplare la Lisabona, la 26 octombrie 2011, în limbile moldovenească, portugheză şi engleză, toate textele fiind egal autentice. În caz de divergenţe la interpretarea textelor în limbile moldovenească şi portugheză, textul în limba engleză va fi de referinţă.
ADMINISTRATIVE ARRANGEMENT
laying down the procedure for implementing the Agreement
on Social Security between the Republic of Moldova
and the Republic of Portugal
For the purpose of implementing the Agreement on Social Security between the Republic of Moldova and the Republic of Portugal, signed at Lisbon on 11 February 2009, hereinafter referred to as the “Agreemenr”,
The Moldovan and Portuguese competent authorities, in accordance with Article 23(1) (a) of the Agreement, have agreed on the following provisions:
TITLE I
GENERAL PROVISIONS
Article 1
Definitions
For the purposes of this Arrangement, the terms and expressions used in it shall have the meaning assigned to them in Article 1 of the Agreement.
Article 2
Liaison bodies
1. In accordance with Article 23(1)(d) of the Agreement, the following bodies shall be designated as «liaison bodies»:
a) For the Republic of Moldova, the National Office of Social Insurance;
b) For the Portuguese Republic, the General-Directorate for Social Security.
2. The liaison bodies shall, namely:
a) Establish, by mutual agreement, the collection of documents necessary for the application of the Agreement and of this Arrangement;
b) Take, by mutual agreement, measures of an administrative nature for the application of this Arrangement;
c) Take measures in order to inform the persons concerned of their rights and of the appropriate procedures for the exercise of those rights.
Article 3
Admission to voluntary insurance – implementation of Article 5 of the Agreement
1. In order to invoke the provisions of Article 5(1) of the Agreement, the person concerned shall submit to the competent institution a certified statement relating to the periods of insurance completed under the legislation to which he was last subject.
2. The certified statement shall be issued, at the request of the person concerned, by the competent institution of the Contracting State to whose legislation he was last subject.
3. If the claimant does not submit the said certified statement, the competent institution shall obtain it from the competent institution of the other Contracting State.
Article 4
Prevention of overlapping of benefits – implementation of Article 7 of the Agreement
Where in accordance with Article 7(3) of the Agreement benefits due are simultaneously reduced, suspended or withdrawn under the legislation of both Contracting States, the reduction, suspension or withdrawal of each of them shall not exceed half the amount corresponding to the one that should have been reduced, suspended or withdrawn from the benefit.
Article 5
Rules on the aggregation of periods of insurance
For the aggregation of periods of insurance completed under the legislation of both Contracting States by virtue of the Agreement, the competent institution shall apply the following rules:
a) Where a period of insurance completed under a compulsory insurance under the legislation of a Contracting State wholly or partly coincides with a period of insurance completed under a voluntary insurance under the legislation of the other Contracting State, only the period completed under the compulsory insurance shall be taken into account by the competent institution;
b) Where a period of insurance, other than an equivalent period, completed under the legislation of a Contracting State coincides with an equivalent period completed under the legislation of the other Contracting State, only the period of insurance in the part where it does not coincide shall be taken into account by the competent institution;
c) Any period treated as equivalent simultaneously, wholly or partly, under the legislations of both Contracting States shall be taken into account only by the institution of the Contracting State under whose legislation the insured person was last compulsorily insured prior to the said period in the part where it does not coincide;
d) In the case mentioned in subparagraph c), where the insured person has not been compulsorily insured under the legislation of a Contracting State before the said period, the latter shall be taken into account by the competent institution of the Contracting State under whose legislation the person was compulsorily insured for the first time after the period in question;
e) Where it is not possible to determine accurately the period of time in which certain periods of insurance were completed under the legislation of a Contracting State, such periods shall be presumed not to overlap with periods of insurance completed under the legislation of the other Contracting State and shall, where advantageous, be taken into account.
TITLE II
IMPLEMENTATION OF THE GENERAL PROVISIONS OF THE AGREEMENT
FOR THE DETERMINATION OF THE LEGISLATION APPLICABLE
Article 6
Formalities in cases of posting of an employed person
pursuant to Article 9 (1) (2) and (4) of the Agreement
1. In the cases covered by Article 9(1) and (4) of the Agreement, the competent authority or the competent institution where the worker is insured shall send to the employer or to the worker, according to whether he is an employed or self-employed worker, at his request, a certificate stating that he remains subject to the legislation which they administers, indicating the anticipated period of posting.
2. The certificate referred to in paragraph 1 contains all information regarding the worker and his employer, as well as the duration of the period of posting, the name and address of the undertaking or body where the work shall be performed, the stamp of the competent authority or of the competent institution and the date of issue.
3. In the case covered by Article 9(1) of the Agreement, the employer, before the term of the first period of twenty four months, shall apply for the consent of the authority or of the designated body of the Contracting State of the place of posting, in a form established for this purpose.
4. The authority or the designated body of the Contracting State of the place of posting referred to in paragraph 3 shall indicate in the mentioned form the decision taken, send a copy to the employer and send another copy to the authority of the other Contracting State, keeping a third copy for itself.
5. If the worker ceases the posting before the date established for its term, the undertaking which normally employs him shall communicate this new situation to the competent authority or institution of the Contracting State in which the worker is insured, which immediately informs the competent authority or institution of the other Contracting State.
Article 7
Exercise of right of option by persons employed by diplomatic missions
and consular posts – implementation of Article 10(3) of the Agreement
1. The employed person who has exercised the right of option provided for in Article 10(3) of the Agreement shall inform the competent institution of the Contracting State for whose legislation he has opted and, at the same time, notify his employer thereof.
2. The institution referred to in paragraph 1 shall hand in to the employed person a certificate stating that he is subject to the legislation it administers and inform the competent institution of the other Contracting State.
TITLE III
IMPLEMENTATION OF THE PROVISIONS OF THE AGREEMENT
RELATING TO THE DIFFERENT KINDS OF BENEFITS
Chapter I
SICKNESS AND MATERNITY, PATERNITY AND ADOPTION – CASH BENEFITS
Article 8
Certified statement of periods of insurance – implementation of Article 12 of the Agreement
1. In order to invoke the provisions of Article 12 of the Agreement, the worker shall submit to the competent institution a certified statement specifying the periods of insurance completed under the legislation to which he was last subject.
2. This certified statement shall be issued at the request of the worker by the competent institution of the Contracting State with which he was last insured.
3. If the worker does not submit the certified statement the competent institution shall obtain it from the competent institution of the other Contracting State.
Article 9
Cash benefits in the case of residence in a Contracting State other than the
competent one – Implementation of Article 13 of the Agreement
1. In order to receive cash benefits under Article 13 of the Agreement, the worker shall forthwith submit his claim to the competent institution, directly or through the institution of the place of residence, which shall forward it to the competent institution.
2. Subject to Article 25 of this Arrangement, the worker referred to in paragraph 1 may, at the request of the competent institution, be submitted to administrative checks and medical examinations according to the rules provided for in the legislation applicable by the institution of the place of residence.
Chapter II
INVALIDITY, OLD AGE AND SURVIVORS′ PENSIONS AND DEATH BENEFITS
Section I
Invalidity, old age and survivors′ pensions
Article 10
Submission of claims for benefits – implementation of
Articles 15 and 16 of the Agreement
1. In order to receive invalidity, old age and survivors′ pensions under Articles 15 and 16 of the Agreement, a worker or his survivor, residing in Moldova or in Portugal, shall submit the claim to the competent institution of the Contracting State in whose territory the person concerned resides, in accordance with the procedures provided for by the legislation administered by that institution.
2. Where a claimant resides in the territory of a third State, he shall submit the claim to the competent institution of the Contracting State to whose legislation the worker was last subject.
3. If the claim is submitted to an institution other than those referred to in paragraphs 1 and 2 of this Article, this institution shall immediately forward the claim to the institution to which it should have been submitted, indicating the date in which the claim was received.
4. The date mentioned in paragraph 3 shall be considered as the date on which the claim was submitted to the latter institution.
Article 11
Documents and informations
The submission of claims referred to in Article 10 of the Arrangement shall be subject to the following rules:
a) The claim must be accompanied by the required supporting documents and must be made on the form provided for by the legislation:
i) Of the Contracting State in whose territory the claimant resides in the case referred to in paragraph 1 of that Article 10;
ii) Of the Contracting State to which the worker was last subject in the case referred to in paragraph 2 of the same Article 10.
b) The accuracy of the information supplied by the claimant must be established by official documents attached to the claim form, or confirmed by the competent bodies of the Contracting State to which the institution that received the claim belongs;
c) The claimant must indicate, as far as possible, the institution or institutions of both Contracting States with which the worker has been insured, as well as the employer or employers for whom he has worked in those Contracting States.
Article 12
Forms to be used for the investigation of claims
1. When investigating claims for benefits the institution that receives the claim shall use a liaison form and forward it in duplicate to the competent institution of the other Contracting State.
2. The transmission of the liaison form shall take the place of the supporting documents as long as the data contained in the form are authenticated by the sending institution which shall certify that the original documents contained in the file match the data given in the form.
Article 13
Procedures to be followed by the competent institutions
1. The institution that receives the claim shall enter on the form provided for in Article 12 of the Arrangement the date on which the claim was submitted, the periods of insurance completed by the worker under the legislation which it administers, as well as the possible rights arising from those periods.
2. When the claim concerns invalidity benefits the institution referred to in paragraph 1 shall enclose to the liaison form the medical reports available for the application of its own legislation.
3. The competent institution of the other Contracting State shall complete the liaison form by indicating the periods of insurance completed under the legislation which it administers and the possible rights acquired by the claimant, if necessary, resorting to the aggregation of periods of insurance provided for in Article 15 of the Agreement. This institution shall, without delay, return a copy of the form thus completed to the institution that received the claim.
4. On receipt of the copy of the liaison form, the institution that received the claim, after having determined the entitlement to benefits, if necessary, resorting to the aggregation of periods of insurance provided for in Article 15 of the Agreement, shall notify its decision to the competent institution of the other Contracting State.
Article 14
Notification of decisions
The competent institution of either Contracting States shall notify the claimant of its decision, specifying the grounds and the time limits for appeal and send a copy to the competent institution of the other Contracting State.
Article 15
Currency conversion
For the purposes of Article 16(5) of the Agreement, the conversion of the pension amounts in the currencies with legal course of both Contracting States shall be made at the official rate of exchange of the day in which that provision shall apply.
Section II
Death grants
Article 16
Certified statement of periods of insurance – implementation of Article 17 of the Agreement
In the cases where Article 17 of the Agreement apply the competent institution of a Contracting State shall obtain from the competent institution of the other Contracting State a certified statement on the periods of insurance completed under the legislation of the latter Contracting State.
Chapter III
UNEMPLOYMENT
Article 17
Payment of benefits – implementation of Article 18 of the Agreement
The unemployment benefits provided for in Article 18 of the Agreement shall be paid according to the procedures and the time limits laid down by the legislation applicable in either Contracting State.
Chapter IV
ACCIDENTS AT WORK AND OCCUPATIONAL DISEASES – CASH BENEFITS
Article 18
Cash benefits in the case of residence in a Contracting State other than
the competent one – implementation of Article 19 of the Agreement
1. In order to receive cash benefits under Article 19 of the Agreement, a worker or his survivor shall submit the claim directly to the competent institution or through the institution of the place of residence which shall forward it to the competent institution.
2. The competent institution shall verify the right of the worker and of his survivors in accordance with the legislation which it administers and shall establish the amount of the benefits.
3. The same institution shall notify directly the claimant of its duly justified decision specifying the grounds and the time limits for appeal.
Article 19
Assessment of the degree of incapacity – implementation
of Article 20 (1) of the Agreement
1. In order to assess the degree of incapacity in the cases referred to in Article 20(1) of the Agreement, the worker shall supply the competent institution with all information on the accidents at work sustained or the occupational diseases contracted when he was subject to the legislation of the other Contracting State, whatever the degree of incapacity caused by those contingencies.
2. The information referred to in paragraph 1 shall, as far as possible, be confirmed by the competent institution of the Contracting State in whose territory the accident occurred or the occupational disease was diagnosed.
Article 20
Procedures in the case of exposure to the same risk of an occupational disease
in both Contracting States – implementation of Article 21 of the Agreement
1. In the case covered by Article 21 of the Agreement, notification of the occupational disease shall be forwarded to the competent institution of the Contracting State in whose territory the person suffering from the occupational disease last pursued an activity liable to cause the occupational disease in question, or to the institution of the place of residence, which shall forward it, without delay, to the competent institution.
2. When the competent institution of the Contracting State in whose territory the worker last pursued an activity liable to cause the occupational disease in question ascertains that the worker or his survivors do not meet the conditions of the legislation it administers, even taking into account the provisions of Article 20(2)(3) of the Agreement, the said institution shall:
a) Forward, without delay, to the institution of the Contracting State in whose territory the person suffering from the disease previously pursued an activity liable to cause the disease in question, the certified statement and the accompanying documents as well as a copy of the decision referred to under (b);
b) Simultaneously notify the person concerned of its decision to reject the claim, indicating namely, the conditions that need to be met for the entitlement to benefits, the grounds and time limits for appeal, and the date on which the certified statement was forwarded to the investigating institution.
Article 21
Aggravation of an occupational disease – Implementation
of Article 22 of the Agreement
1. For the purposes of Article 22 of the Agreement, the worker shall provide the institution of the Contracting State of his new residence with all necessary information relating to benefits previously granted in respect of the occupational disease in question. The institution may apply to the institution which has previously been competent in order to obtain further information.
2. In the case covered by Article 22(a) of the Agreement, where the worker has not pursued, in the territory of the Contracting State of his new residence, an activity liable to aggravate the occupational disease in question, the institution of his new residence shall send to the competent institution of the other Contracting State a copy of the decision to reject the claim of which the person concerned has already been notified, being applicable, if necessary, the provision of Article 20(2) of the Arrangement.
3. In the case covered by Article 22(b) of the Agreement, where the worker has actually pursued in the territory of the Contracting State of his new residence an activity liable to aggravate the occupational disease in question, the institution of his new residence shall inform the competent institution of the other Contracting State of the charge for which it is responsible.
Article 22
Appeal against a decision to reject a claim
Where an appeal is lodged against a decision to reject a claim taken by the competent institution of the Contracting State in whose territory the person suffering from the disease last pursued an activity liable to aggravate the occupational disease in question, that institution shall inform the institution of the other Contracting State of that fact and of the final decision.
Article 23
Designation of the competent institutions
For the purposes of Articles 19 to 22 of the Agreement, the following bodies shall be designated as competent institutions:
a) For the Republic of Moldova, the National Office of Social Insurance;
b) For the Portuguese Republic, the Social Security Institute, through the National Centre for the Protection of Occupational Risks.
TITLE IV
MISCELLANEOUS PROVISIONS
Article 24
Duty of information
The competent institutions of either Contracting State shall immediately inform the competent institutions of the other Contracting State of all facts that they take notice, which are relevant for the application of the Agreement and of the present Arrangement, namely those related to the maintenance of the right to the benefits.
Article 25
Administrative checks and medical examinations
1. Administrative checks and medical examinations of persons entitled to benefits under the legislation of a Contracting State who reside in the territory of the other Contracting State shall be carried out at the request of the competent institution, by the institution of the place of residence or by the liaison body, which may use the services of an institution designated by them.
2. The competent institution shall, however, reserve the right to have the person entitled to benefits examined by a doctor of choice of the same competent institution.
Article 26
Determination of the degree and group of invalidity
1. In order to determine the degree and group of invalidity, the institutions of both Contracting States shall take into account the medical reports and the information of an administrative nature obtained by the institution of the other Contracting State, reserving, however, the right to have the claimant examined by a doctor of its own choice.
2. The costs entailed in administrative and medical control necessary for the provision or review of benefits shall be refunded by the institution on whose behalf they were made to the institution which has been responsible therefore, on the basis of the charges applied by the latter institution.
3. The refunds referred to in paragraph 2 shall be made through the following institutions:
a) In the Republic of Moldova: the National Office of Social Insurance.
b) In the Republic of Portugal: the Social Security Institute through the Department for Financial Management;
Article 27
Reinstatement of the payment of benefits
When, after the suspension of a benefit granted under the legislation of a Contracting State, the person concerned recovers his right to the same benefit whilst residing in the territory of the other Contracting State, the institutions concerned shall exchange all relevant information with a view to the resumption of the payment of the said benefit.
Article 28
Payment of benefits
The cash benefits due by the competent institutions of the Contracting States shall be paid directly to the person concerned, regardless of his residence being in one or the other Contracting State, without the deduction to that amount of postal and bank fees which shall be borne by the institution responsible for payment.
Article 29
Life and civiI status certification
The competent institutions of both Contracting States may ask the person concerned, directly or through the institution of the place of residence, for a life and civil status certificate, as well as other documents necessary to verify the right to or the maintenance of the benefits.
Article 30
Claims, declarations or appeals submitted in the Contracting State other than
the competent State – implementation of Article 26 of the Agreement
For the purposes of Article 26 of the Agreement, the authority, institution or tribunal of the Contracting State which has received the claim, declaration or appeal, shall forward it without delay to a corresponding authority, institution or tribunal of the other Contracting State, indicating the date of receipt.
Article 31
Joint committee
The competent authorities shall establish a technical joint committee that shall meet alternatively in Moldova and in Portugal, in order to:
a) Deliver reasoned opinions on questions concerning the interpretation and implementation of the Agreement and of the Arrangement;
b) Establish the model forms provided for in the Arrangement, as well as the procedures necessary for the implementation of the Agreement and the Arrangement;
c) Settle up the accounts existing between the institutions of the Contracting States;
d) Deliver reasoned opinions on any question submitted for analysis by the competent authorities.
Article 32
Entry into force
This Arrangement shall enter into force on the day of its signature, shall produce legal effects since the date of entry into force of the Agreement and shall have the same duration that of the latter.
DONE in two copies at Lisbon this 26 th day of October 2011, in the Portuguese, Moldovan and English languages, all texts being equally authoritative. In the event of a divergent interpretation of the Portuguese and the Moldovan texts, the English text shall prevail.
