pentru Dezvoltarea Antreprenoriatului

Ministerul Economiei şi Comerţului al Republicii Moldova şi Agenţia Poloneză pentru Dezvoltarea Antreprenoriatului, denumite în continuare Părţi,
dorind să dea un nou impuls cooperării bilaterale între Republica Moldova şi Republica Polonă;
reafirmând şi întărind relaţiile de prietenie între Părţi, operând în bază egală şi reciprocă;
bazându-se pe principiile şi angajamentele care reies din Tratatul de prietenie şi cooperare între Republica Moldova şi Republica Polonă, semnat la Varşovia la 15 noiembrie 1994, şi Acordului de Parteneriat şi Cooperare dintre Comunităţile Europene şi statelor lor membre, pe de o parte, şi Republica Moldova, pe de altă parte, semnat la Bruxelles la 28 noiembrie 1994;
au convenit asupra următoarelor:
Articolul 1
Părţile vor implementa cooperarea în domeniul susţinerii antreprenoriatului în conformitate cu reglementările legislaţiilor statelor Părţi şi în cadrul competenţei acestora.
Părţile vor promova dezvoltarea relaţiilor economice şi de parteneriat reciproce între instituţiile care susţin dezvoltarea antreprenoriatului în Moldova şi Polonia, la fel şi între întreprinderile Statelor Părţi, cu un accent asupra întreprinderilor mici şi mijlocii.
Articolul 2
Părţile vor face schimb de experienţă şi practici, în special în domeniile:
a) Dezvoltarea întreprinderilor mici şi mijlocii;
b) Exporturi;
c) Dezvoltarea regională;
d) Promovarea tehnologiilor moderne;
e) Crearea locurilor de muncă;
f) Combaterea şomajului şi dezvoltarea resurselor umane.
Părţile vor face schimb de informaţii privind legislaţia ce ţine de susţinerea întreprinderilor mici şi mijlocii, la fel şi altă informaţie în ceea ce priveşte scopul activităţilor Părţilor.
Părţile vor face schimb şi vor promova rezultatele cercetărilor şi realizărilor în domeniile ce sunt subiecte ale activităţilor Părţilor.
Articolul 3
Părţile vor face schimb de informaţii în domeniile transferului inovaţiilor şi tehnologiilor moderne.
Articolul 4
Părţile vor organiza şi vor petrece seminare comune, întruniri şi conferinţe cu participarea reprezentanţilor mediului de afaceri şi instituţiilor care susţin dezvoltarea antreprenoriatului al ambelor Părţi.
Articolul 5
Părţile vor face schimb de informaţii şi vor încuraja antreprenorii, la fel şi reprezentanţii instituţiilor care susţin dezvoltarea antreprenoriatului în scopul participării lor în expoziţiile şi iarmaroacele internaţionale, naţionale şi specializate şi alte evenimente care vor avea loc pe teritoriul Statelor Părţi.
Articolul 6
Acest Memorandum poate fi modificat sau extins la înţelegerea reciprocă a Părţilor în formă de anexe separate care vor intra în vigoare conform Articolului 8 al prezentului Memorandum.
Articolul 7
Disputele privind implementarea sau interpretarea acestui Memorandum vor fi soluţionate de către Părţi prin consultări şi negocieri.
Articolul 8
Prezentul Memorandum va intra în vigoare la data semnării.
Prezentul Memorandum va fi denunţat în termen de trei luni după primirea de către o Parte a notificării în scris despre intenţia de a denunţa acest Memorandum.
Denunţarea prezentului Memorandum nu va influenţa implementarea proiectelor şi programelor lansate în baza prevederilor Memorandumului. Nu vor fi influenţate nici programele nefinalizate la momentul denunţării acestuia sau alte contracte sau acorduri încheiate în scopul de a implementa prevederile prezentului Memorandum.
Semnat la Varşovia la 11 iunie 2008, în două exemplare originale, în limba moldovenească, polonă şi engleză, toate textele fiind egal autentice.
În cazul apariţiei divergenţelor la interpretarea sau aplicarea prevederilor prezentului Memorandum, textul în limba engleză va fi de referinţă.
MEMORANDUM
of Understanding and Cooperation between the Ministry of Economy
and Trade of the Republic of Moldova and the Polish Agency
for Enterprise Development
The Ministry of Economy and Trade of the Republic of Moldova and the Polish Agency for Enterprise Development,
hereinafter referred to as Parties
wishing to give a new impulse to bilateral cooperation between the Republic of Moldova and the Republic of Poland,
operating on equal and mutual basis,
based on the principles and obligations specified in the "Cooperation and partnership Agreement between the Republic of Moldova and Poland" signed in Warsaw, on November 15, 1994 and "Partnership and cooperation agreement between European Communities and their member state on one side, and the Republic of Moldova on another side", signed in Brussels on November 28, 1994,
have agreed as follows:
Article 1
The Parties shall implement the cooperation in the area of supporting entrepreneurship in line with the regulations of the legislation of the States of the Parties and within the framework of their competencies.
The Parties shall promote the development of mutually beneficial economic and partner relations between institutions that support enterprise development in Moldova and Poland as well as between enterprises of the States of the Parties, with particular focus on small and medium-sized enterprises.
Article 2
The Parties shall exchange experience and practices, especially in the areas of:
a) Small and medium-size enterprises development;
b) Exports;
c) Regional Development;
d) Promotion of modern technologies;
e) Job creation,
f) Counteracting unemployment and human resources development.
The Parties will also exchange information concerning the legislation regarding support to small and medium-sized enterprises, as well as other information concerning the scope of the Parties' activities.
The Parties will also exchange and promote the results of research and achievements in the areas that are subjects to the Parties' activities.
Article 3
The Parties will exchange information in the areas of transfer of innovations and modern technologies.
Article 4
The Parties shall organise and hold joint seminars, meetings and conferences with the participation of the representatives of businesses and institutions that support enterprise development of both Parties.
Article 5
The Parties will exchange information and encourage entrepreneurs, as well as representatives of institutions that support enterprise development to participate in international, national and specialist exhibitions, fairs and other events to be held in the area of the States of both Parties.
Article 6
This Memorandum can be amended or extended on mutual agreement of the Parties in the form of separate annexes that come into force according to the Article 8 of this Memorandum.
Article 7
Disputes concerning the implementation or interpretation of provisions of this Memorandum shall be settled by the Parties through consultations and negotiations.
Article 8
This Memorandum shall come into force from the date of signing by the Parties.
The Memorandum shall be terminated three months after one of the Parties receives a written notice from the other Party on its intention to terminate the Memorandum. The termination of this Memorandum shall not influence either the implementation of the projects and programmes agreed upon on the basis of its provisions and not completed at the moment of its termination or any contracts and agreements concluded with a view to implement the provisions of the Memorandum.
Done in Warsaw on 11 of June 2008 in two originals, each in Moldavian, Polish and English languages, all text being equally valid.
In case of differences concerning the interpretation of provisions of the Memorandum, the English version shall prevail.
