PROGRAM DE COOPERARE

între Ministerul Culturii şi Turismului al Republicii Moldova

şi Ministerul Culturii şi Turismului al Republicii Turcia

Ministerul Culturii şi Turismului al Republicii Moldova şi Ministerul Culturii şi Turismului al Republicii Turcia, în continuare denumite Părţi,

acţionând în conformitate cu “Acordul de colaborare culturală între Guvernul Republicii Moldova şi Guvernul Republicii Turcia”, semnat la Chişinău la 3 iunie 1994,

dorind să dezvolte schimburile reciproce în domeniul culturii şi artei, să consolideze relaţiile de prietenie dintre ambele state şi dintre popoarele lor, în scopul promovării, prin intermediul schimburilor de idei şi cooperare, a înţelegerii cât mai depline a tradiţiilor, realizărilor şi vocaţiilor ţărilor lor,

consultând şi cooperând, unde este posibil, în special pentru proiecte concrete, în cadrul Organizaţiei Naţiunilor Unite pentru Cultură, Ştiinţă şi Educaţie (UNESCO), Organizaţiei pentru Securitate şi Cooperare în Europa (OSCE), Consiliului Europei (CoE), şi a altor organizaţii internaţionale relevante,

au convenit asupra următorului Program de Cooperare:

Articolul 1

Părţile vor examina posibilitatea instituirii centrelor culturale în ţările lor, în scopul de a contribui la promovarea în viitor a cooperării în domeniul culturii, artei, educaţiei, ştiinţei şi informaţiei.

Articolul 2

2.1. Părţile vor face schimb de informaţii despre organizarea festivalurilor, celebrărilor, diverselor evenimente culturale şi artistice cu caracter internaţional şi vor încuraja reciproc participarea artiştilor săi şi a grupurilor artistice la manifestările internaţionale în domeniul muzicii, operei, baletului, filmului, dansului, precum şi la acţiuni şi festivaluri folclorice care se vor desfăşura în fiecare ţară.

2.2. Părţile vor facilita participarea poporului găgăuz la diverse evenimente culturale şi festivaluri artistice care vor fi organizate în Turcia.

Articolul 3

3.1. Părţile vor încuraja contactele şi cooperarea dintre instituţiile şi organizaţiile artistice din ţările lor şi vor susţine schimbul reciproc de artişti, solişti sau grupuri artistice, în special între instituţiile de stat ce ţin de operă, balet şi orchestrele simfonice.

3.2. Părţile vor încuraja schimbul reciproc între instituţii şi organizaţii artistice de CD-uri, casete audio, imprimări ale soliştilor renumiţi şi, după caz, a notelor muzicale şi a imprimărilor, în conformitate cu legislaţia naţională a fiecărei ţări referitoare la drepturile de autor şi conexe.

Articolul 4

Părţile vor face schimb de compozitori, muzicieni în scopul cercetării, directori, artişti şi grupuri artistice, coregrafi, dirijori, decoratori şi solişti pentru stagii de performanţă comune.

Articolul 5

Părţile vor invita ansambluri folclorice şi artişti de performanţă să participe la festivaluri folclorice internaţionale care vor fi organizate în ţările respective, vor încuraja schimbul în domeniul dansurilor populare.

Articolul 6

Părţile se vor informa reciproc în domeniul patrimoniului cultural imaterial (folclor, cultură populară), despre conferinţele ştiinţifice internaţionale şi alte activităţi similare ce vor fi organizate în ţările lor, vor invita reciproc experţi în domeniu să participe la aceste evenimente, vor face schimb de publicaţii şi vor colabora în domeniul cercetării cu instituţiile de cercetare a folclorului.

Articolul 7

Părţile vor realiza proiecte comune prin intermediul instituţiilor ce ţin de patrimoniul cultural imaterial şi vor încuraja aceste instituţii să facă schimb de publicaţii şi de alte materiale.

Articolul 8

Părţile vor sprijini schimburile de artişti şi de specialişti în domeniul artelor frumoase şi se vor informa reciproc despre evenimentele internaţionale din domeniul artelor plastice, în scopul de a încuraja cooperarea şi schimbul de experienţă dintre instituţiile de artă din ambele ţări.

Articolul 9

9.1. Părţile vor încuraja contactele directe şi cooperarea în domeniul teatrului în scopul realizării punerii în scenă de către regizori renumiţi a versiunilor traduse a unor piese selective din ambele ţări, vor promova schimbul reciproc de administratori şi artişti de teatru.

9.2. Părţile vor invita şi vor facilita participarea reciprocă la festivalurile internaţionale de teatru, care vor fi organizate în fiecare ţară.

Articolul 10

10.1. Părţile vor promova schimbul reciproc de expoziţii de fotografie, sculptură şi pictură contemporană, vor sprijini schimbul reciproc de expoziţii, vor acorda anumite facilităţi artiştilor pentru a vizita partenerii şi instituţiile de artă din cealaltă ţară.

10.2. Părţile vor susţine participarea reciprocă la expoziţii de artefact şi alte genuri de expoziţii, de asemenea la bienale şi simpozioane de arte frumoase, care vor avea loc în cele două ţări.

10.3. Părţile vor promova deschiderea unor expoziţii de cultură populară.

Articolul 11

Părţile vor intensifica relaţiile în domeniul publicaţiei de carte, vor promova traducerea lucrărilor artistice ale autorilor şi poeţilor săi eminenţi, vor face schimb de informaţii referitoare la organizaţiile specializate în publicaţia de carte şi comerţul cu cărţi din ambele ţări.

Articolul 12

12.1. Părţile vor proteja, în concordanţă cu legislaţia naţională în vigoare şi acordurile internaţionale la care ele sunt membre, drepturile de autor şi conexe ale cetăţenilor şi instituţiilor din fiecare Parte, în măsura în care aceste drepturi se referă la realizarea prezentului Program.

12.2. Părţile vor face schimb de informaţii, documentaţie şi publicaţii referitoare la legislaţiile naţionale respective şi, după caz, de expertize în cazul apariţiei dezacordurilor în domeniul protecţiei drepturilor la proprietatea intelectuală.

12.3. Părţile se vor informa reciproc despre conferinţele internaţionale, discuţiile în cadrul meselor rotunde, simpozioanele şi alte întruniri referitoare la drepturile la proprietatea intelectuală care se vor desfăşura în ţările respective.

12.4. Părţile se vor consulta reciproc şi vor coopera în cadrul Organizaţiei Mondiale a Comerţului (OMC), Organizaţiei Mondiale a Proprietăţii Intelectuale (OMPI), altor organizaţii internaţionale specializate, în scopul promovării intereselor comune în domeniul protecţiei drepturilor la proprietatea intelectuală, în general, şi a reproducerii textelor, în particular.

Articolul 13

13.1. Părţile vor sprijini organizarea reciprocă a săptămânilor şi a retrospectivelor de film în fiecare ţară, vor face, cu aceste ocazii, schimb de delegaţii, compuse din nu mai mult de trei (3) specialişti.

13.2. Detaliile de ordin tehnic şi altele referitoare la organizarea săptămânilor şi a retrospectivelor de film vor fi specificate în contactele directe dintre autorităţile competente ale ambelor ţări, transmise pe cale diplomatică, cu acordul reciproc al Părţilor.

Articolul 14

Părţile vor sprijini participarea producătorilor de filme artistice, de scurt şi lung metraj la festivalurile internaţionale, care vor fi organizate în ţările respective.

Articolul 15

Părţile vor coopera în domeniul cinematografiei, în bază de coproducţie, ţinându-se cont de prevederile Convenţiei Europene pentru Coproducţia Cinematografică şi de facilităţile existente în acest domeniu în fiecare din ţările respective.

Articolul 16

16.1. Părţile vor coopera în prevenirea traficului ilegal al operelor de artă, luând toate măsurile de prevenire şi contracarare, în concordanţă cu legislaţia lor naţională, ţinând cont de Convenţiile relevante pentru domeniu ale UNESCO, CoE, alte tratate internaţionale la care ele fac parte.

16.2. Părţile vor coopera pentru facilitarea identificării şi restituirii către proprietarii legali din fiecare Parte a lucrărilor de artă, artefact şi relictelor, comercializate ilicit pe teritoriile lor respective.

Articolul 17

Părţile vor încuraja schimburile de informaţii şi publicaţii ştiinţifice în domeniile arheologiei, muzeologiei, istoriei artei, conservării şi restaurării patrimoniului cultural şi al operelor de artă. În acest scop, Părţile vor face schimb reciproc de câte doi (2) experţi pe o perioadă de o (1) săptămână pentru fiecare.

Articolul 18

Părţile vor efectua, în domeniile patrimoniului cultural şi a culturii folclorice, schimburi de materiale informative, filme şi publicaţii disponibile, vor facilita cercetările ştiinţifice a experţilor din instituţiile ştiinţifice respective.

Articolul 19

Părţile vor promova contactele directe şi cooperarea între bibliotecile publice, în special, dintre Bibliotecile Naţionale ale celor două ţări, şi anume Biblioteca Naţională a Moldovei şi Biblioteca Naţională a Turciei, având ca scop schimbul de materiale informative şi de alte publicaţii.

Articolul 20

20.1. Părţile vor încuraja schimbul de cărţi, publicaţii şi periodice referitoare la cultura, literatura şi istoria fiecăreia din ele, dintre biblioteci, academii şi instituţii de cultură din ţările respective.

20.2. Părţile vor face schimb de microfilme, manuscrise şi cărţi rare în cadrul bibliotecilor sale publice, cu scopul de a-şi îmbogăţi colecţiile, în măsura în care aceasta prevede legislaţia naţională din ţara respectivă.

20.3. Părţile, în cadrul prezentului Program, vor face schimb reciproc de câte un (1) expert bibliotecar pentru o perioadă de o (1) lună, şi vor susţine aceşti experţi în scopul realizării studiilor de cercetare în bibliotecile din ţara respectivă.

Articolul 21

Părţile vor face schimb reciproc de invitaţii pentru participarea la târgurile şi expoziţiile internaţionale de carte, precum şi la seminare, conferinţe, simpozioane care vor fi organizate în ţările lor, vor încuraja şi vor facilita, cu aceste ocazii, schimbul reciproc de autori şi de alţi reprezentanţi din domeniu.

Articolul 22

Schimbul de persoane

22.1. Partea trimiţătoare va anunţa Partea primitoare, de regulă, cu cel puţin 6 săptămâni înainte de data planificată, despre intenţia sa de a trimite persoane în cadrul prezentului Program, indicând numele lor, calificarea/ titlul profesional/ academic/ artistic, limbile de comunicare (limba ţării gazdă sau engleza), scopul vizitei, programul de lucru şi durata vizitei.

22.2. Partea primitoare va comunica Părţii trimiţătoare în scris, de regulă, cu 3 săptămâni înainte de data planificată pentru sosire, acordul său pentru vizita propusă.

22.3. Partea trimiţătoare va comunica în scris Părţii primitoare data exactă a sosirii şi mijlocul de transport, de regulă, cu nu mai puţin de zece (10) zile înainte de data planificată a sosirii.

22.4. Partea trimiţătoare va acoperi, dacă nu există o altă înţelegere, cheltuielile pentru călătorie aeriană internaţională spre şi de la locul activităţii (sau, în cazul când aceasta nu e posibil, se va specifica cel mai apropiat oraş deţinător de transport aerian internaţional) pentru participanţii la prezentul Program.

22.5. Vizitatorii care vor face schimb de experienţă în cadrul prezentului Program pentru o perioadă ce nu va depăşi 15 zile vor beneficia, dacă nu a fost făcută o altă înţelegere, de cazare şi întreţinere, precum şi, în măsura posibilităţilor, de transport intern pe teritoriul celeilalte ţări, cheltuielile fiind acoperite, în corespundere cu reglementările naţionale, de entităţile care îi găzduiesc în interesul Părţii primitoare.

22.6. Părţile vor asigura, pe bază de reciprocitate, în conformitate cu legislaţia naţională a fiecărei ţări, tratamentul medical ambulatoriu de urgenţă în condiţiile facilităţilor de sănătate publică din ţara respectivă, pentru vizitatorii din cealaltă Parte care activează în cadrul prezentului Program. Cheltuielile pentru tratamentul de lungă durată, intervenţiile chirurgicale şi protezarea dentară nu vor fi acoperite.

Articolul 23

Schimbul de colective

23.1. Partea trimiţătoare va acoperi cheltuielile de călătorie şi transportul rechizitelor colectivelor spre prima destinaţie în ţara gazdă, iar înapoi, de la ultima destinaţie spre ţara de origine, sau spre o ţară terţă.

23.2. Partea primitoare va suporta cheltuielile pentru şedere şi călătoriile interne ale colectivelor, va acoperi orice alte cheltuieli legate de organizarea spectacolelor. Partea primitoare va asigura sălile de concert cu infrastructura necesară (condiţii climaterice, măsuri de securitate etc.).

23.3. Partea trimiţătoare va asigura informaţia necesară referitoare la ansambluri (numele soliştilor, data sosirii şi plecării, programul, materialele promoţionale tipărite etc.) cu cel puţin 3 luni înaintea primului spectacol.

23.4. Orice alte probleme financiare referitoare la schimbul de colective vor fi negociate direct între organizatorii spectacolului găzduit.

Articolul 24

Schimbul de expoziţii

24.1. În organizarea expoziţiilor în cadrul prezentului Program, cu excepţia celor de patrimoniu istoric, termenele şi condiţiile generale vor fi următoarele, dacă nu a fost făcută o altă înţelegere:

24.1.1. Responsabilităţile Părţii trimiţătoare sunt:

- De a prezenta propuneri cât mai detailate pentru organizarea expoziţiei, specificând datele tehnice necesare, de regulă, cu 12 luni înainte de data planificată a deschiderii;

- Să asigure transportul internaţional către prima destinaţie în ţara primitoare şi transportul internaţional de la ultima sa locaţie spre ţara de origine sau spre o ţară terţă;

- Să facă asigurarea transportului “din poartă în poartă”;

- Să pună la dispoziţie informaţiile şi materialele necesare pentru tipărirea unui catalog în limba Părţii primitoare sau în limba engleză, cu şase (6) luni înainte de deschiderea expoziţiei.

24.1.2. Responsabilităţile Părţii primitoare sunt:

- De a asigura, în mod gratuit, săli de expoziţie potrivite, dotate cu infrastructura de securitate necesară (climatizare, paznici etc.);

- Să accelereze şi să faciliteze procedurile de perfectare a vizelor pentru comisarii expoziţiei, şi procedurile vamale pentru importul şi exportul de materiale expoziţionale;

- Să asigure cu personal necesar pentru încărcare şi descărcare, ambalare şi dezambalare, montare şi demontare a exponatelor şi a altor materiale expoziţionale;

- Să imprime cataloage, şi, dacă este necesar, afişe şi invitaţii;

- De a promova expoziţia în rândul publicului larg, în special, prin intermediul presei şi mass-media;

- Să pună la dispoziţia ţării de origine copiile tuturor materialelor promoţionale emise în legătură cu expoziţia (cataloage, postere, invitaţii, comentarii etc.);

- Să prezinte, în caz de daune, toate documentele relevante, inclusiv raportul oficial privind daunele, şi să acorde asistenţă pentru a permite Părţii trimiţătoare să depună cereri de despăgubire la societăţile de asigurare relevante.

24.1.3. Toate celelalte condiţii vor fi convenite de la caz la caz.

24.2. În caz de daună, Partea primitoare nu va purcede la restaurarea exponatelor, cu excepţia cazului dacă şi până în momentul în care va fi primită prin canale diplomatice permisiunea explicită în scris a Părţii trimiţătoare.

24.3. Toate condiţiile legate de organizarea expoziţiei se negociază şi se specifică într-un acord separat care urmează să fie încheiat între instituţia organizatoare a expoziţiei şi instituţia trimiţătoare a expoziţiei.

24.4. Costurile de organizare pe bază comercială a evenimentelor se stabilesc între agenţiile interesate ale celor două ţări, de la caz la caz.

Articolul 25

Regimul de vize şi a permiselor de reşedinţă,

exportul/importul temporar de materiale

25.1. Nici o prevedere din prezentul Program nu va afecta obligaţia fiecărei persoane de a se supune legilor şi reglementărilor în vigoare pe teritoriul celeilalte Părţi referitoare la intrarea, reşedinţa sau plecarea străinilor din ţară.

25.2. Părţile vor facilita reciproc şi vor urgenta perfectarea vizelor pentru persoane, ansambluri şi diverse grupuri ce vor participa la prezentul Program, precum şi a permiselor de reşedinţă, în caz de necesitate.

25.3. Părţile vor facilita reciproc şi vor urgenta importul/exportul temporar de obiecte şi materiale necesare pentru realizarea activităţilor în cadrul prezentului Program.

Articolul 26

26.1. Pentru implementarea prezentului Program, Părţile se vor întruni, când vor considera necesar, alternativ în Turcia şi Moldova, sub forma unei Comisii mixte care, în caz de necesitate, îşi va stabili reguli şi proceduri de activitate.

26.2. Pentru realizarea prezentului Program, Părţile pot întocmi Planuri de Acţiuni în viitor.

26.3. Toate activităţile realizate în cadrul prezentului Program vor fi aduse la cunoştinţa Ministerelor Afacerilor Externe ale ambelor ţări, respectând principiul de reciprocitate, reieşind din limitele financiare şi mijloacele disponibile ale Părţilor.

26.4. Părţile vor implementa prezentul Program în corespundere cu tratatele internaţionale relevante la care ele fac Parte şi în baza legislaţiei lor naţionale în vigoare.

26.5. Prezentul Program nu exclude posibilitatea de a conveni, în cadrul Acordului de colaborare culturală, referitor la realizarea altor activităţi care vor fi agreate de către Părţi prin canale diplomatice.

Articolul 27

27.1. Prezentul Program va intra în vigoare la data ultimei notificări, prin canale diplomatice, privind îndeplinirea de către Părţi a tuturor procedurilor interne necesare pentru intrarea lui în vigoare.

27.2. Planurile de acţiuni sau alte anexe, care urmează a fi stabilite de comun acord separat, în cadrul prezentului Program, vor intra în vigoare conform condiţiilor stabilite în Art.27.1 al acestui Program.

27.3. Prezentul Program va rămâne valabil pentru o perioadă de un (1) an de la data intrării sale în vigoare, şi se va reînnoi automat pentru o perioadă succesivă de un (1) an.

27.4. Fiecare din Părţi poate oricând să înceteze sau să suspendeze aplicarea prezentului Program, prezentând o notificare în scris celeilalte Părţi, prin canale diplomatice. Încetarea sau suspendarea prezentului Program se va efectua în timp de şaizeci de zile de la primirea notificării privind îndeplinirea procedurilor interne. Programul va înceta în cazul încetării Acordului de colaborare culturală.

27.5. În cazul încetării Programului, toate activităţile începute în cadrul acestui Program vor fi realizate în termenele şi condiţiile stabilite.

Întocmit la Chişinău, la 17 decembrie 2007, în două exemplare originale, fiecare în limbile moldovenească, turcă şi engleză, toate textele fiind egal autentice. În caz de divergenţe la interpretarea prevederilor prezentului Program, textul în limba engleză va fi de referinţă.

COOPERATION PROGRAMME

between the Ministry of Culture and Tourism of the

Republic of Moldova and the Ministry of Culture

and Tourism of the Republic of Turkey

The Ministry of Culture and Tourism of the Republic of Moldova and the Ministry of Culture and Tourism of the Republic of Turkey, hereinafter referred to as the Parties,

acting in accordance with the "Agreement on Culture between the Government of the Republic of Moldova and the Government of the Republic of Turkey", signed in Chisinau, on 3rd June, 1994,

wishing to develop mutual exchanges in the fields of culture, arts, and to strengthen the ties of friendship between the two countries and their peoples, for the purpose of promoting by friendly interchange and cooperation the fullest possible understanding in each of their respective countries of the main traditions, achievements and vocations of the other Party in those fields,

consulting, and cooperating, wherever possible, in particular for concrete projects, within the framework of the United Nations Educational, Scientific and Cultural Organization (UNESCO), the Organization on Security and Cooperation in Europe (OSCE), the Council of Europe (CoE), and of other relevant international organizations,

Article 1

The Parties shall consider possibilities for establishing cultural centres in each other's country in order to contribute to the further promotion of cooperation in the fields of culture, arts, education, science and information.

Article 2

2.1. The Parties shall exchange information on international festivals, celebrations and various cultural and artistic events, and mutually encourage the participation of their artists and artistic groups in international music, opera, ballet, theatre, cinema, song, dance and folklore contests and festivals to be held in their respective countries.

2.2. The Parties shall facilitate the participation of the artists of Gagauz origin in various cultural and artistic festivals and events to be held in Turkey.

Article 3

3.1. The Parties shall encourage contacts and cooperation between their respective artistic institutions and societies, and arrange the exchange of artists, soloists and artistic groups, in particular, between their respective State institutions for opera and ballet as well as symphony orchestras.

3.2. The Parties shall also encourage the exchange of CDs, audiocassettes and records of their renowned soloists, also, if requested, music notes and records between their institutions in compliance with their respective national legislation on intellectual property rights.

Article 4

The Parties shall exchange composers and musicologists to carry out researches, also directors, producers, artists and artistic groups, choreographers, conductors, decorators and soloists to stage joint performances.

Article 5

The Parties shall invite folklore groups and performing artists to participate in international folklore festivals to be organised in their respective countries, and encourage exchanges in the field of folk dances.

Article 6

The Parties shall, in the field of intangible heritage (folklore, folk culture), inform each other about international scientific conferences and other such activities to be organized in their respective countries, and mutually invite experts to participate in those international events, also exchange publications and conduct research with the institutions studying folklore.

Article 7

The Parties shall carry out joint projects through their institutions studying intangible heritage, and encourage those institutions to exchange publications and other materials.

Article 8

The Parties shall support the exchange of artists and specialists in the field of fine arts, and inform each other about international arts events, with a view to encouraging cooperation and exchanges between their arts institutions.

Article 9

9.1. The Parties shall, in the field of theatre, encourage direct contacts, and cooperation, with a view to enabling the staging of translated versions of selected plays by eminent playwrights from both countries, and the exchange of theatre administrators and artists.

9.2. The Parties shall extend invitations for, and facilitate mutual participation in, international theatre festivals to be held in their respective countries.

Article 10

10.1. The Parties shall mutually promote the exchange of personal exhibitions of contemporary photography, sculpture and painting, support the exchange of exhibitions by their artists, and provide facilities for their artists to visit and meet their counterparts and arts institutions in the other country.

10.2. The Parties shall also support mutual participation in international artefact and other exhibitions, also in biennials and symposia on fine arts, to be held in the two countries.

10.3. The Parties shall promote opening of exhibitions on folk culture.

Article 11

The Parties shall support the strengthening of relations in the field of book publishing, promote the translation of literary works of their eminent authors and poets, and exchange information about the organisation of book publishing and trade in the two countries.

Article 12

12.1. The Parties shall protect, in accordance with their respective national law as well as the international agreements to which they are both Parties, the copyrights of the citizens and the institutions of the other Party in so far as those rights are related to this Programme.

12.2. The Parties shall exchange information, documentation and publications on their respective national law, and, upon request, expertise on the settlement of disputes in the field of intellectual property rights.

12.3. The Parties shall inform each other of international conferences, panel discussions, symposia and other meetings on intellectual property rights to be held in their respective countries.

12.4. The Parties shall consult, and cooperate, as appropriate, within the World Trade Organization (WTO), the World Intellectual Property Organization (WIPO), and other related international organizations, as regards issues of common interest in the field of the protection of intellectual property rights, in general, and copyrights, in particular.

Article 13

13.1. The Parties shall support the mutual organization of film weeks and film retrospectives in their respective countries, and exchange on these occasions delegations composed of up to three (3) specialists.

13.2. Technical and other details regarding the organization of film weeks and film retrospectives shall be specified through direct contacts between the competent authorities of the two countries, and settled through diplomatic or other channels to be mutually agreed upon.

Article 14

The Parties shall support the participation of filmmakers of short and feature films in international film festivals to be organised in their respective countries.

Article 15

The Parties shall cooperate in the area of film-making on the basis of co-production, taking into consideration the provisions of the European Convention on Cinematographic Co-Production, and their own film-making facilities.

Article 16

16.1. The Parties shall cooperate against the illegal trafficking of cultural objects by taking all the necessary prevention, repression and remedial measures, in accordance with their respective national legislation and in compliance with the relevant Conventions of UNESCO, the CoE, and with other international agreements of which they are both contracting Parties.

16.2. The Parties shall cooperate in facilitating the identification, and restitution to legal owners, of works of art, artefacts and relics of the other Party, illicitly traded in their respective territories.

Article 17

The Parties shall encourage the exchange of scientific information and publications in the fields of archaeology, history of art, museology, restoration and conservation of cultural heritage and works of art.To this end, the Parties shall exchange two (2) experts for a period of one (1) week each.

Article 18

The Parties shall, in the fields of cultural heritage and folk culture, exchange information materials on available films and publications, and facilitate researches of experts at their respective scientific institutions.

Article 19

The Parties shall promote direct contacts, and cooperation between public libraries, in particular, the National Libraries of the two countries, namely the National Library of Turkey and the National Library of Moldova, for the purpose of exchanging information materials and other publications.

Article 20

20.1. The Parties shall encourage the exchange of books, publications and periodicals concerning their respective cultures, literature and history between their libraries, academies and cultural institutions.

20.2. The Parties shall exchange microfilms of manuscripts and rare books in their public libraries to enrich their collections, so far as provided by their respective national legislation.

20.3. The Parties, within the framework of this Programme, shall mutually exchange one (1) expert librarian for a period of one (1) month, and provide those experts with the opportunity to conduct studies in their respective libraries.

Article 21

The Parties shall extend invitations to each other for participation in international book fairs, book exhibitions as well as seminars, conferences and symposia to be organized in their respective countries, and mutually encourage and facilitate the exchange of authors and other representatives on those occasions.

Article 22

Exchange of Individuals

22.1. The sending Party shall notify the receiving Party, in principle, at least six (6) weeks prior to the planned date of arrival of its intention to send individuals under this Programme, providing their names, professional/ academic/ artistic titles/qualifications, languages spoken (the language of the host country or English), the purpose of the visit, the proposed work programme and the duration of stay.

22.2. The receiving Party shall convey to the sending Party its consent to the proposed visit in writing, in principle, at least three (3) weeks prior to the planned date of arrival.

22.3. The sending Party shall notify the receiving Party of the exact date of arrival and the means of transport, in principle, at least ten (10) days prior to the planned date of arrival.

22.4. The sending Party shall cover, if not otherwise agreed, the cost of the international return airfare to and from the venue of activity (or, in case this is not feasible, the nearest city accessible by international air transport) for visitors to be exchanged under this Programme.

22.5. Visitors to be exchanged under this Programme for periods not exceeding fifteen (15) days shall have, if not agreed otherwise, their accommodation and board, also, to the extent possible, expenses for domestic travel in the other country paid for, in keeping with domestic regulations, by the entities that shall be hosting them on behalf of the receiving Party.

22.6. The Parties shall provide, on a reciprocal basis, and in accordance with their respective national legislation, emergency outpatient medical treatment in public health facilities of their respective countries for visitors from the other Party under this Programme. The cost of long-term treatment, major surgical operations, and of dental prostheses shall not be covered.

Article 23

Exchange of Ensembles

23.1. The sending Party shall cover the travel and transportation costs of requisites of ensembles to the first destination in the host country and back from the last one to the country of origin or to a third country.

23.2. The receiving Party shall bear the costs of the stay and internal travel of ensembles, and cover all other expenses related to the organization of the performances. The receiving Party shall also provide suitable concert halls with necessary infrastructure (climatic conditions, guards, etc.).

23.3. The sending Party shall provide all the necessary information regarding the ensembles (names of performers, dates of arrival and departure, programmes, printed materials, etc.) at least three months prior to the first performance.

23.4. Any other financial issues concerning the exchange of ensembles shall directly be negotiated between the organizers of the guest performances.

Article 24

Exchange of Exhibitions

24.1. In arranging exhibitions under this Programme, except those of historical heritage, the general terms and conditions to be complied with by the institutions concerned shall be as follows, unless agreed otherwise:

24.1.1. Responsibilities of the sending Party are:

- Submitting detailed proposals for the exhibition, including the necessary technical data, in principle, twelve (12) months prior to the planned date of opening;

- Providing for international transport to the first destination in the receiving country and the international transport from its last location to the country of origin or to a third country;

- Providing for insurance for door to door, nail to nail, transport;

- Submitting the necessary information and materials for the printing of a catalogue in the language of the receiving Party, and/or in the English language, six (6) months before the opening of the exhibition.

24.1.2. Responsibilities of the receiving Party are:

- Providing, free of charge, suitable exhibition halls with the necessary security infrastructure (climatic conditions, guards, etc.);

- Expediting and facilitating visa procedures for the exhibition commissioners, and customs procedures for the importation and exportation of exhibition materials;

- Providing the necessary staff for loading and unloading, packing and unpacking, mounting and dismantling of the exhibits and the other exhibition materials;

- Printing the catalogue, and, if necessary, the posters and invitations;

- Promoting the exhibition to the wider public, in particular, by means of the press and the media;

- Providing the country of origin with copies of all the promotional materials issued in connection with the exhibition (catalogue, posters, invitations, reviews, etc.);

- Providing, in case of damage, all the relevant documentation, including the official damage report, and assistance to enable the sending Party to file claims for compensation on the relevant insurance company.

24.1.3. All other conditions shall be agreed on a case-by-case basis.

24.2. In case of damage, the receiving Party shall not proceed with the restoration of the exhibits unless and until explicit written permission of the sending Party is received through diplomatic channels.

24.3. All the conditions related to the organisation of the exhibition shall be negotiated and specified in a separate agreement to be concluded between the institution arranging the exhibition and the institution sending the exhibition.

24.4. The costs of organizing events on a commercial basis shall be determined between the interested agencies of the two countries, on a case-by-case basis.

Article 25

Issuance of Visas and Residence Permits,

Temporary Importation/Exportation of Materials

25.1. Nothing in this Programme shall be deemed to affect the obligation of any person to comply with the laws and regulations in force in the territory of either Party concerning the entry, residence and departure of foreigners.

25.2. The Parties shall mutually facilitate and expedite the issuance of visas for individuals, ensembles and groups to be exchanged under this Programme, also of residence permits, as necessary.

25.3. The Parties shall mutually facilitate and expedite the temporary importation/exportation of objects and materials necessary to carry out missions or activities under this Programme.

Article 26

26.1. For the purpose of the application of the present Programme, the Parties may convene, when deemed necessary, alternately in Turkey and in Moldova, in the form of a Joint Commission that shall make, as necessary, its own rules of procedure.

26.2. For the implementation of this Programme, the Parties may conclude Action Plans in the future.

26.3. All activities under this Programme shall be conducted with the knowledge of the Ministries of Foreign Affairs of the two countries, with due regard to the principle of reciprocity, and within the limits of available financial and other means of the Parties.

26.4. The Parties shall implement this Programme in line with the relevant international agreements of which they are both contracting Parties, and on the basis of their respective national legislation, as applicable.

26.5. This Programme does not preclude the possibility of undertaking, within the framework of the Cultural Agreement, any other activity to be agreed by the Parties through diplomatic channels.

Article 27

27.1. This Programme shall enter into force after both Parties have notified each other through diplomatic channels that they have completed their internal procedures concerned.

27.2. The action plans or other annexes to be agreed separately under this Programme and shall enter into force on the conditions fixed in the Article 27.1 of this Programme.

27.3. The present Program shall remain valid for a period of one (1) year from the date of its entry into force, renewable automatically for successive periods of one (1) year.

27.4. Each Party may at any time terminate this Programme by giving to the other Party a written notice to that effect through diplomatic channels.

Termination or suspension of the Programme shall be effective sixty (60) days following the date of the notice. The Programme shall be terminated in case of the termination of the Cultural Agreement.

27.5. In case the Programme is terminated, all activities started under this Programme shall be carried out under the terms and conditions thereof.

Done in duplicate, in Chisinau, on 17 December 2007, in the Moldavian, Turkish and English languages. In case of divergence in interpretation, the English text shall prevail.
