Guvernul Republicii Moldova şi Guvernul Statului Israel, denumite în continuare Părţi,
exprimându-şi dorinţa de a consolida relaţiile de prietenie şi înţelegere reciprocă între popoarele celor două ţări, de a promova schimbul în domeniile culturii, educaţiei şi ştiinţei,
fiind convinse că cooperarea va contribui la aprofundarea cunoştinţelor, în deosebi printre tineret, despre istoria şi cultura ambelor state,
în scopul realizării Acordului între Guvernul Republicii Moldova şi Guvernul Statului Israel privind cooperarea în domeniul culturii, învăţământului, ştiinţei, tineretului şi sportului semnat la 22 iunie 1997,
au convenit asupra următorului Program de cooperare pentru anii 2008, 2009, 2010.
Articolul 1
Educaţie
Părţile vor susţine şi promova colaborarea în domeniul educaţiei, contribuind la consolidarea înţelegerii şi prieteniei reciproce între cele două ţări.
1.1. Părţile vor realiza schimb de informaţii şi acte normative referitoare la domeniul educaţiei.
1.2. Părţile vor contribui la dezvoltarea relaţiilor de colaborare directe între instituţiile de învăţământ de toate nivelurile ale ambelor ţări.
1.3. Părţile, în limita disponibilităţilor financiare, vor susţine schimbul de informaţii, experienţă şi materiale în următoarele domenii:
• Modernizarea sistemelor educaţionale ale ambelor ţări;
• Stagii de perfecţionare pentru cadre didactice;
• Managementul instituţiilor de învăţământ;
• Acte legislative şi normative cu referire la învăţământ;
• Educaţia copiilor cu necesităţi speciale;
• Descentralizare şi autonomie în învăţământ;
• Educaţia civică;
• Finanţarea învăţământului;
• Integrarea religioasă şi culturală a grupurilor minoritare;
• Programe antidrog (inclusiv proiecte comune);
• Predarea limbilor străine;
• Educaţia formală şi neformală;
• Învăţământul în colaborare;
• Învăţământ inclusiv;
• Cultura şi Patrimoniul;
• Educaţia adulţilor (învăţământul pe parcursul întregii vieţi);
• Învăţământ vocaţional/tehnologic;
• Contribuţia tineretului pentru dezvoltarea comunităţii;
• Dezvoltarea capacităţilor de viaţă;
• Educaţia artistică.
În Israel informaţia privind sistemul educaţional poate fi obţinută de pe site-ul www.education.gov.il.
În Republica Moldova informaţia referitoare la sistemul educaţional poate fi obţinută de pe site-ul: http://www.edu.md.
1.4. Părţile se angajează să prevină publicarea materialelor care încurajează rasismul, antisemitismul şi xenofobia pentru a contracara prejudiciu şi stereotipuri negative. Fiecare Parte va aduce la cunoştinţa celeilalte dacă astfel de publicaţii vor fi detectate.
1.5. Părţile vor susţine şi promova activităţi educaţionale şi de cercetare privind soarta tragică a comunităţii evreieşti în Republica Moldova în timpul celui de-al Doilea Război Mondial.
Partea moldovenească va contribui la includerea aspectelor ce ţin de Holocaust în curriculumul şcolar.
1.6. Părţile vor crea posibilitate tinerilor să studieze despre Holocaust în perioada şcolarizării, bazându-se pe Declaraţia de la Stockholm (în limitele Conferinţei Internaţionale asupra Holocaustului din ianuarie 2000). în acest context, Părţile vor susţine activităţile educaţionale efectuate în şcoli, la toate nivelele, în scopul combaterii rasismului şi antisemitismului.
1.7. Părţile vor încuraja participarea profesorilor şi, în particular, a profesorilor de istorie la cursuri ce ţin de istoria Holocaustului şi Antisemitism, care sunt organizate de Yad Veshem Martirii Holocaustului şi Autoritatea de Memorie a Eroilor în Ierusalim. Cursurile vor fi organizate în fiecare an în ianuarie şi iulie. Durata cursurilor va fi de trei săptămâni şi se vor organiza în limba engleză.
1.8. Părţile vor promova predarea limbii, literaturii, istoriei şi culturii celeilalte ţări în instituţiile de învăţământ primar, general şi superior. În acest scop, experţii din ţara parteneră vor fi invitaţi să ţină lecţii, seminare şi să acorde asistenţă pentru alte activităţi educative. Condiţiile, conform cărora profesorii îşi vor desfăşura activităţile în ţara gazdă vor fi negociate de instituţiile respective ale ambelor ţări sau pe căi diplomatice.
1.9. Părţile vor încuraja cooperarea dintre şcoli bazată pe realizarea diverselor proiecte privind Tehnologiile Informaţionale şi Comunicaţiile în educaţie.
1.10. Părţile menţionează importanţa recunoaşterii reciproce a actelor de studii din învăţământ de toate nivelurile, diplomelor şi meritelor academice. Părţile vor face schimb de informaţie şi documente referitoare la recunoaştere şi vor purta negocieri în conformitate cu legislaţia şi actele normative în vigoare ale fiecărei Părţi.
Articolul 2
Burse
2.1. Partea israeliană va oferi anual Cursuri de limbă ebraică modernă pe perioada verii sau/şi burse de specializare pentru un (1) an academic (opt luni fiecare) pentru studenţii ce optează pentru studii postuniversitare sau de cercetare la o universitate din Israel.
Informaţia pentru înscriere (data-limită de depunere a formularelor, limita de vărstă, documentele necesare, formularele, detaliile asupra alocaţiei băneşti etc.) vor fi disponibile în internet pe site-ul Ministerului Afacerilor Externe: http://www.mfa.gov.il şi vor fi remise anual pe căi diplomatice.
2.2. Partea moldovenească va oferi anual 3 burse de studii specializate de masterat, ciclul II, pentru cetăţenii Statului Israel în instituţiile de învăţământ superior din Republica Moldova.
Informaţia privind condiţiile de înmatriculare la studii va fi disponibilă pe site-ul Ministerului Educaţiei şi Tineretului al Republicii Moldova, http://www.edu.md.
2.3. Bursele reprezintă subiectul cadrului bugetar al Părţilor.
2.4. Selecţia candidaţilor la studii se va realiza de partea trimiţătoare.
Articolul 3
Ştiinţa
3.1. Părţile vor încuraja schimbul reciproc de specialişti din domeniile ştiinţific şi de cercetări, obiectul fiind cercetări, studieri, consultări şi discuţii legate de disciplinele ştiinţifice. Durata şi condiţiile schimbului vor fi discutate pe căi diplomatice.
3.2. Părţile vor încuraja cercetarea ştiinţifică şi tehnologică comună, proiectele de cercetare şi dezvoltare în domeniile de interes comun, precum şi schimbul de informaţie tehnică şi ştiinţifică, de publicaţii.
3.3. Părţile vor încuraja cooperarea directă între universităţi, academii de ştiinţă şi alte instituţii de cercetare ştiinţifică.
Articolul 4
Cooperarea între universităţi
4.1. Părţile vor face schimb de publicaţii, literatură, materiale ştiinţifice şi alte informaţii în domeniul învăţământului superior.
4.2. Părţile vor favoriza participarea a trei academicieni la conferinţele și seminarele naţionale şi internaţionale şi la alte evenimente similare, care vor avea loc în ambele ţări pentru o perioadă de maximum (5) zile fiecare, pe parcursul valabilităţii prezentului program. Taxele de înregistrare pentru participanţi vor fi determinate de către instituţia gazdă.
4.3. Părţile vor coopera în promovarea studiilor în domeniul culturii, limbilor şi istoriei contemporane a fiecărei dintre ţări în universităţile respective.
Articolul 5
Schimb de tineret
5.1. Părţile vor încuraja schimbul dintre tineret şi tinerii adulţi, care constituie o contribuţie majoră la relaţiile de cooperare dintre cele două ţări. Părţile vor susţine aceste programe. Accentul urmează să fie plasat pe participarea activă a tinerilor înşişi şi pe promovarea cooperării şi stabilizării relaţiilor prin activităţi specifice tinerilor.
5.2. Părţile vor încuraja proiectele comune ale profesioniştilor şi experţilor în domeniul tineretului. Detaliile în această privinţă vor fi determinate între Consiliul de Schimb a Tineretului din Israel şi Ministerul Educaţiei şi Tineretului din Republica Moldova.
Articolul 6
Cooperarea în cadrul organizaţiilor internaţionale
Părţile vor colabora în domeniul educaţiei, ştiinţei, culturii, sportului, tineretului şi comunicaţiilor în cadrul UNESCO, Uniunii Europene, Consiliului Europei şi altor organizaţii internaţionale, în scopul schimbului de informaţii şi implementării programelor comune de acţiune.
Articolul 7
Schimb cultural şi de experţi în domeniul artelor
Privire generală
Părţile apreciază dezvoltarea continuă a activităţilor de colaborare culturală reciprocă, subliniind rolul important care revine culturii şi artei în consolidarea relaţiilor dintre cele două ţări. Părţile îşi reafirmă intenţiile de a încuraja şi în continuare cooperarea directă între instituţiile de cultură, organizaţiile obşteşti şi persoane interesate ale ambelor ţări.
Părţile vor încuraja iniţiativele privind acordarea asistenţei organizaţiilor de stat, private şi persoanelor individuale antrenate în promovarea şi sponsorizarea activităţilor culturale în Moldova, originari din Israel şi a activităţilor culturale în Israel, originari din Moldova.
7.1. Părţile vor susţine colaborarea în domeniul muzicii, teatrului, coregrafiei, artelor vizuale şi plastice, design, stimulând participarea grupurilor artistice şi persoanelor interesate la festivaluri, turnee, diverse evenimente culturale, inclusiv conferinţe, simpozioane, spectacole, ateliere. Părţile, pentru realizarea acestui scop, vor acorda anual douăzeci (20) de zile, în limita disponibilităţilor financiare.
7.2. Festivaluri: Părţile vor face schimb reciproc de artişti de performanţă în scopul participării la festivalurile de muzică, dans şi teatru. Condiţiile de participare, inclusiv numărul artiştilor, durata şederii vor fi efectuate pe principii de reciprocitate.
Părţile vor face schimb de maximum trei (3) experţi în organizarea festivalurilor, pentru o perioadă de cinci (5) zile, în scopul schimbului de informaţii şi de promovare a cooperării în acest domeniu.
Părţile se vor informa reciproc referitor la cele mai importante festivaluri internaţionale ce vor avea loc în ţările lor. Informaţia va fi publicată pe site-urile autorităţilor competente corespunzătoare.
Partea israeliană invită Partea moldovenească să participe la următoarele festivaluri internaţionale din Israel:
• Festivalul din Israel, Ierusalim (anual, mai-iunie);
• Concursul Internaţional al pianiştilor Artur Rubinstein (trienal, datele variază);
• Festivalul Internaţional de Dans Carmiel (anual, iulie);
• Festivalul Internaţional al Centrului pentru Dans Suzanne Dellal, Tel-Aviv (anual, decembrie);
• Conferinţa Internaţională Isra-Darma şi manifestarea internaţională în domeniul teatrului (anual, decembrie);
• Festivalul Internaţional de Jaz Marea Roşie (anual, august);
• Târgul Internaţional de Carte din Ierusalim (bienal, februarie);
• Festivalul Internaţional de Teatru pentru Copii şi Tineret Haifa (anual, aprilie);
• Festivalul Internaţional Klezmer (anual, iulie sau august);
• Dans-Europa la Centrul pentru Dans şi Teatru Suzanne Dellal (anual, octombrie-noiembrie);
• Festivalul Internaţional de Muzică Felicia Blumental (anual, mai);
• Festivalul Internaţional pentru Teatrul de Păpuşi din Ierusalim (anual, august);
• Cursurile Internaţionale pentru Violonişti Keshet Eilon în Galileea de vest (anual, septembrie);
• Festivalul de Muzică Camerală Kfar Blum (anual, aprilie).
Partea moldovenească invită Partea israeliană să participe la următoarele festivaluri internaţionale:
• Festivalul Internaţional de Muzică “Mărţişor” (anual, martie);
• Festivalul Internaţional de Muzică clasică “CRESCENDO” (anual, aprilie);
• Festivalul Internaţional al Interpreţilor de Operă “BELCANTO” (anual, mai);
• Festivalul Internaţional “Nopţile pianistice” (anual, iunie);
• Festivalul Internaţional al Vedetelor de Operă şi Balet “Invită Măria Bieşu” (anual, septembrie);
• Festivalul Internaţional “ETNO-JAZZ” (anual, septembrie);
• Festivalul-concurs Internaţional de Muzică Uşoară “Două inimi gemene” (anual, noiembrie);
• Concursul Internaţional al Tinerelor Interpreţi “E.Coca” (anual, iunie);
• Festivalul Muzicii Noi (anual, iunie);
• Festivalul Internaţional de Teatru “Bienala Teatrului Eugene Ionesco” (bienal, mai).
7.3. Arte plastice, arhitectură, fotografie şi design:
Părţile vor dezvolta cooperarea în domeniul artelor plastice şi artizanat.
Părţile vor încuraja schimbul reciproc de expoziţii de artă, colaborarea între artişti plastici, meşteri populari şi specialişti în domeniul folclorului. Părţile vor face schimb reciproc de muzeografi sau restauratori pentru o perioadă ce nu va depăşi patru (4) zile. Proiectele vor fi coordonate pe căi diplomatice.
Părţile vor sprijini colaborarea directă între arhitecţi şi instituţiile de domeniu, schimbul reciproc de arhitecţi. În acest scop, Părţile vor efectua schimb de un (1) expert pentru maximum (5) zile.
7.4. Muzee şi Expoziţii: Părţile vor încuraja colaborarea directă dintre muzee şi galerii, instituţii similare din ambele ţări, inclusiv schimbul de specialişti, custode, materiale, exponate şi informaţii.
7.5. Muzica: Părţile vor susţine promovarea reciprocă a operelor compozitorilor în ambele ţări. Vor încuraja relaţiile directe între muzicieni (dirijori, solişti etc.), organizaţii muzicale, instituţii de învăţământ artistic, asociaţii, orchestre de muzică clasică şi contemporană, prin schimbul de înregistrări şi delegaţii pe bază comercială şi necomercială.
Părţile vor facilita participarea reciprocă a muzicienilor, membrilor juriului şi observatorilor la festivalurile, concursurile şi alte evenimente importante organizate în ambele ţări.
7.6. Dansul: Părţile vor încuraja schimbul de colective de dans, coregrafi, profesori şi organizatori ai festivalurilor de dans. Părţile vor contribui la dezvoltarea cooperării culturale multilaterale.
7.7. Teatrul: Părţile vor încuraja schimbul de actori, regizori, dramaturgi, critici de teatru şi alţii. Părţile vor contribui la dezvoltarea cooperării culturale multilaterale.
7.8. Părţile, în scopul promovării şi înţelegerii mai bine a evenimentelor sociale şi culturale ce au loc în cealaltă ţară, vor stimula schimbul reciproc de critici de artă, scriitori şi jurnalişti. În acest scop vor fi acordate patru (4) zile.
7.9. Cultura gastronomică: Părţile, în scopul promovării tradiţiilor gastronomice, vor contribui la cooperarea în domeniul culturii gastronomice. Părţile vor face schimb reciproc de 1-3 experţi pentru patru (4) zile pe parcursul valabilităţii prezentului Program.
Articolul 8
Literatura şi târgul de carte
8.1. Părţile vor activa în comun la promovarea traducerii prozei contemporane, poeziei şi altor genuri literare din ţara lor în limba celeilalte ţări. Părţile, de asemenea, vor încuraja distribuirea lucrărilor traduse în limbile acestora.
Părţile vor face schimb de trei (3) persoane (scriitori, poeţi sau traducători) fiecare pentru o şedere de maximum cinci (5) zile, pe perioada valabilităţii prezentului Program.
8.2. Părţile vor încuraja participarea reciprocă a scriitorilor şi editorilor la seminare, ateliere. Părţile vor susţine participarea poeţilor şi scriitorilor la festivaluri şi evenimente literare. în acest scop vor fi destinate anual cinci (5) zile.
8.3. Părţile vor încuraja legăturile directe între edituri şi bibliotecile naţionale.
8.4. Părţile se vor invita reciproc la Târgurile Internaţionale de Carte pe bază comercială sau necomercială.
Partea israeliană invită Partea moldovenească să participe la Târgul Internaţional de Carte din Ierusalim, care se organizează o dată la doi ani în Ierusalim.
Partea moldovenească invită partea israeliană să participe la Salonul Internaţional de Carte (anual, august) şi Salonul Internaţional de Carte pentru Copii (anual, aprilie), care se organizează la Chişinău.
Articolul 9
Arhive şi biblioteci
9.1. Părţile vor promova cooperarea reciprocă între arhivele de stat, bibliotecile publice, în conformitate cu legislaţia în vigoare, prin schimbul de experţi, publicaţii ştiinţifice, cărţi, informaţie digitală, microfilme, copii de documente, baze de date şi regulamente. Schimburile vor avea loc în conformitate cu legislaţia naţională în vigoare şi în limita disponibilităţilor financiare ale Părţilor.
9.2. Părţile vor face schimb de un (1) arhivar sau bibliotecar pentru o şedere de cinci (5) zile pentru a obţine informaţii referitor la organizarea arhivelor/bibliotecilor, precum şi a studiilor de cercetare.
Articolul 10
Cinematografie şi audiovizual
10.1. Partea israeliană informează Partea moldovenească despre următoarele festivaluri de film, organizate pe teritoriul Israelului:
• Festivalul Internaţional de Film din Ierusalim (anual, iulie);
• Festivalul Internaţional de Film Haifa (anual, octombrie);
• Festivalul Internaţional de Film pentru Studenţi, Tel-Aviv (bienal, iunie);
• Festivalul Internaţional de Film pentru Femei, Rehovot (anual, septembrie);
• Festivalul Internaţional de Film Documentar Doc-Aviv în Tel-Aviv (anual, aprilie);
• Festivalul Mondial de Film Evreiesc, în Beer-Sheva (anual, noiembrie).
10.2. Părţile vor sprijini organizarea reciprocă a săptămânilor de film în ambele state. Peliculele cinematografie vor fi derulate în ambele ţări şi vor fi însoţite de subtitre în limba engleză.
Părţile vor încuraja schimbul reciproc de delegaţii din domeniul cinematografiei. Părţile vor efectua, anual, schimb de doi (2) experţi în domeniul cinematografiei şi audiovizualului pentru o perioadă de cinci (5) zile cu scopul de a participa la festivaluri, conferinţe, întruniri, retrospective de filme şi la alte evenimente internaţionale.
10.3. Părţile vor încuraja colaborarea între instituţiile din domeniile cinematografiei şi televiziunii ale ambelor ţări.
Părţile vor promova cooperarea între instituţiile de învăţământ, specializate în instruirea cadrelor din domeniul cinematografiei şi televiziunii. Părţile vor înainta propuneri pentru schimbul reciproc de studenţi şi profesori din ambele state.
10.4. Părţile vor promova coproducţiile cinematografice între Moldova şi Israel. În scopul facilitării coproducţiilor de film pe viitor, Părţile vor discuta un contract de coproducţie (filme şi video).
10.5. Părţile vor încuraja cooperarea între autorităţile din domeniul radioului şi televiziunii ale ambelor ţări, prin semnarea unor acorduri de colaborare, schimbului de informaţii (articole, filme documentare), experţi în acest domeniu pe bază comercială şi necomercială. Părţile vor contribui la perfecţionarea cadrelor din domeniu prin organizarea atelierelor de creaţie şi trainingurilor.
Articolul 11
Sport
Părţile vor încuraja cooperarea în domeniul sportului, în special prin schimbul de echipe sportive, antrenori şi experţi. Condiţiile vor fi stabilite prin consultaţii reciproce între organizaţiile interesate ale ambelor ţări.
Articolul 12
Patrimoniul cultural şi arheologic
12.1. Părţile vor încuraja cooperarea în domeniul protecţiei patrimoniului cultural, informându-se reciproc despre legile şi regulamentele naţionale relevante. Părţile vor colabora la păstrarea patrimoniului cultural al celeilalte ţări, aflate pe teritoriul lor.
12.2. Părţile vor susţine colaborarea directă între instituţiile ce ţin de domeniul protecţiei patrimoniului cultural, vor efectua schimb reciproc de specialişti, colaboratori ştiinţifici, materiale publicitare şi de informare, se vor informa reciproc despre seminare, conferinţe şi alte activităţi ce vor fi organizate în ţările lor.
12.3. Părţile, în conformitate cu angajamentele internaţionale şi cu legislaţiile naţionale, vor colabora în prevenirea importului şi exportului ilegal al valorilor culturale ale ambelor ţări.
12.4. Părţile vor încuraja cooperarea în domeniul săpăturilor arheologice, conservării urbane şi cercetărilor în domeniul arhitecturii. Detaliile vor fi stabilite pe căi diplomatice.
12.5. Părţile vor realiza proiecte comune prin intermediul instituţiilor ce ţin de domeniul arheologic, vor încuraja aceste instituţii să facă schimb de informaţii şi de alte materiale, vor susţine organizarea comună a seminarelor pe teme de interes reciproc. Condiţiile vor fi determinate de Autoritatea Israeliană pentru Antichităţi şi Ministerul Culturii şi Turismului al Republicii Moldova.
12.6. Părţile vor face schimb de un (1) expert din domeniul arheologiei, protejării antichităţilor, restaurării patrimoniului cultural şi conservării monumentelor şi arhitecturii pentru o perioadă de patru (4) zile pe parcursul prezentului Program. Detaliile în această privinţă vor fi determinate de către Autoritatea Israeliană pentru Antichităţi şi Ministerul Culturii şi Turismului al Republicii Moldova.
Articolul 13
Proprietatea intelectuală
13.1. Părţile vor proteja, în conformitate cu legislaţia naţională în vigoare şi acordurilor internaţionale la care sunt parte, drepturile la proprietatea intelectuală ale cetăţenilor şi instituţiilor din fiecare Parte, în măsura în care aceste drepturi se referă la realizarea prezentului Program.
13.2. Drepturile la proprietatea intelectuală dobândite în rezultatul activităţii comune vor fi distribuite conform condiţiilor acceptate reciproc, formulate în contracte separate între partenerii activităţii respective.
13.3. Părţile nu vor transmite unei a treia Parte informaţii protejate de legislaţia naţională şi obţinute în urma executării prezentului Program, fără consimţământul prealabil în formă scrisa a celeilalte Părţi.
Articolul 14
Prevederi financiare
14.1. Condiţiile financiare şi alte prevederi, precum şi programul activităţilor vor fi stabilite prin consultaţii reciproce între autorităţile interesate ale ambelor state.
În cazul în care nu există alte înţelegeri speciale, colaborarea între Părţi în cadrul prezentului Program se va efectua conform următoarelor condiţii:
• Partea trimiţătoare va suporta cheltuielile de transport internaţional pentru membrii delegaţiilor, inclusiv pentru recuzite şi exponate.
• Partea primitoare va acoperi cheltuielile de cazare şi hrană în conformitate cu legislaţia în vigoare.
14.2. Schimbul de persoane (artişti, experţi etc.) se va efectua după cum urmează:
• Părţile vor pune la dispoziţie nu mai târziu de două (2) luni de la data planificată a sosirii numele membrilor delegaţiei, curriculum vitae, scopul vizitei, limbile vorbite, itinerarul propus, data sosirii şi data plecării (în limba engleză).
• Partea primitoare va confirma acceptarea propunerii în timp de o (1) lună.
• Persoana(ele) invitate sau delegaţia trebuie să cunoască limba ţării gazdă ori limba engleză sau orice altă limbă stabilită reciproc.
• Partea trimiţătoare va suporta cheltuielile de transport internaţional tur-retur.
• Partea primitoare va suporta cheltuielile legate de cazare.
• Asigurarea medicală din cont propriu.
14.3. Burse:
Durata şi condiţiile financiare ale burselor de specializare oferite de Partea israeliană pentru un an academic va fi publicată anual pe căi guvernamentale, precum şi pe site-ul Ministerului Afacerilor Externe din Israel: http://www.mfa.gov.il.
Partea israeliană va asigura participanţii la Cursul de Vară a Şcolii de Limbi ULPAN, acceptaţi în baza acestui Program, cu următoarele:
a) învăţământ gratuit;
b) acoperirea cheltuielilor de trai conform condiţiilor şcolii de predare a limbilor;
c) asigurarea medicală cu excepţia tratamentului dentar şi bolilor cronice.
Partea moldovenească, în conformitate cu legislaţia şi actele normative în vigoare, va asigura participanţii la schimbul academic cu următoarele:
a) studii gratuite;
b) cazare în cămin;
c) asigurare medicală.
14.4. Schimb de expoziţii: Schimbul de expoziţii se va efectua conform următoarelor condiţii:
a. Partea trimiţătoare va suporta cheltuielile de transport internaţional a exponatelor până în ţara primitoare şi retur.
b. Partea primitoare va acoperi cheltuielile pentru transportul exponatelor pe teritoriul său şi costurile legate de organizarea expoziţiei, inclusiv instalarea/demontarea expoziţiei şi, dacă nu este stabilit altfel de către Părţi, va asigura publicitatea.
c. Partea trimiţătoare va suporta cheltuielile de asigurare a exponatelor.
d. Partea primitoare va asigura cazarea şi masa pentru persoanele (artişti/muzeografi) care însoţesc expoziţia în conformitate cu prevederile financiare ale prezentului Program. Numărul de persoane care vor însoţi expoziţia şi durata şederii lor vor fi coordonate de către Părţi suplimentar.
Articolul 15
Prevederi finale
15.1. Acest Program nu exclude realizarea altor schimburi în domeniile culturii, ştiinţei şi educaţiei.
15.2. Părţile convin, că toate acţiunile menţionate în prezentul Program vor fi realizate în limita disponibilităţilor financiare stabilite în bugetele respective.
15.3. Activităţile şi schimburile realizate în baza acestui Program vor fi implementate în conformitate cu legislaţia în vigoare a Părţilor.
15.4. Litigiile legate de aplicarea şi interpretarea prezentului Program, vor fi soluţionate pe căi oficiale.
15.5. Părţile încredinţează autorităţilor competente implementarea acestui Program.
15.6. În prezentul Program pot fi introduse amendamente sau modificări prin consensul reciproc al Părţilor. Amendamentele şi modificările vor fi efectuate în formă scrisă.
15.7. Următoarea întrunire a Comisiei Mixte va avea loc în Republica Moldova la sfârşitul anului 2010.
15.8. Prezentul Program intră în vigoare la data semnării şi rămâne valabil până la 31 decembrie 2010. Acţiunea lui se va prelungi automat pe următoarele termene de trei (3) ani, dacă nici una din Părţi nu va notifica prin Note Diplomatice despre intenţia sa de a-l denunţa, cu cel puţin nouăzeci de zile înainte de expirarea termenului.

PROGRAM
of cultural, educational and scientific cooperation between
the Government of the State of Israel and the Government
of the Republic of Moldova for the years 2008-2010
The Government of the Republic of Moldova and the Government of the State of Israel, hereinafter referred to as the Parties,
guided by their desire to strengthen their friendly relations and to promote exchanges in the spheres of cultural and education and science,
convinced that this cooperation will contribute to the development of awareness, particularly among youth, of the history and culture of both countries,
willing to develop their relationship in pursuance of the Agreement between the Government of the Republic of Moldova and the Government of the State of Israel on Cooperation in the fields of Culture, Education, Science, Youth and Sport, signed on 22 June 1997 in Jerusalem,
have agreed on the following program of Cooperation for the years 2008, 2009, 2010.
Article 1
Education
The Parties agree to promote cooperation in order to improve and strengthen mutual understanding and friendship between the two countries.
1.1. The Parties shall promote exchange of information and constructive contacts between to the countries, in various aspects of education.
1.2. The Parties shall encourage the development of cooperation between educational institutions of both sides.
1.3. The Parties shall, in accordance with their budgetary means, promote the exchanges of information, experiences, documentation and experts in the following areas:
• The education system of both countries
• Teacher training and life-long training for teachers
• School organization and management
• Education regulation(such as service regulation for teachers etc)
• Special need education
• Decentralization and school autonomy
• Civic Education
• Gifted children education
• Cultural and religious integration of minority groups (including joint projects)
• Anti-drugs programs (including joint programs)
• Foreign languages teachers
• Informal and formal education
• Collaborative learning
• Inclusive education
• Cultural and Heritage
• Adult education (life long education)
• Technology learning
• Youth contribution to the community
• Development of life skills
• Arts education

1.4. The Parties are committed to preventing the publication of text books which encourage racism, anti-Semitism, and xenophobia, in order to counter prejudice and negative stereotypes. Each Party wills to the attention of the other if such publications are detected.
1.5. Both Parties shall put special emphasis on research and educational work related to the tragic fate of the Jewish community of Republic of Moldova during the Second World War under the Nazi occupation.
The Moldavian party shall continue to include the issue of the Holocaust in the school curriculum.
1.6. The Parties stress the importance of enabling young people to learn about the Holocaust during their schooling, based on the Stochholm Declaration (within the framework of the International Conference on the Holocaust held in January 2000). In this context the Parties shall support educational activities undertaken at schools of all levels that aim at combating racism and anti-semitism.
1.7. The Parties shall encourage participation of teachers and, particularly, history teachers, in course dealing with the history of the Holocaust and Anti-Semitism which are organized by Yad Vashem Holocaust Martyrs' and Heroes' Remembrance Authority in Jerusalem. The three-week courses for English speaking participants shall be conducted every year in January and July.
1.8. The Parties shall act to promote the teaching of the language, literature, history and cultural of the other country at the respective primary, secondary and higher education institutions. For this purpose, the corresponding experts from the partner country will be invited to deliver lectures, hold seminars and conduct other educational activities. The conditions under which the activities shall perform their respective activities in the receiving country shall be negotiated between the respective institutions of both countries or through diplomatic channels.
1.9. Both Parties shall encourage cooperation among schools on various projects based on Informal and Communications Technology (ICT).
1.10. The Parties underscore the importance of reciprocal recognition of educational certificates, diplomas and academic degrees of all levels. The Parties shall exchange information and documentation on this matter, and are ready to hold negotiation in accordance to the laws and regulations of each Party.
Article 2
Scholarship
2.1. The Israel Party shall annually Modern Hebrew summer language courses or/and specialization scholarships for one (1) academic year (eight month each) for post-graduate or research students who wish to undertake studies at an Israeli university.
Information for applicants (closing date for submitting application, age limit, necessary documents, application forms, details on grant benefits etc.) will be available on the internet through the website of the Ministry of Foreign Affairs: www.mfa.gov.il and will be published annually through diplomatic channels.
2.2. The Moldavian Party shall offer annually 3 scholarships of one academic year for Israeli postgraduate students, corresponding to a second cycle in Moldavian higher education institutions.
Information for applicants will be available on the internet through the website of the Ministry of Education and Youth of the Republic of Moldova, www.edu.md.
2.3. The scholarships are subjected to the budgetary framework of the Parties.
2.4. The sending party will be responsible for the selection of the candidates participating to the program.
Article 3
Science
3.1. The Parties shall encourage mutual exchange appointments of scientific and research workers with the objective of research, studies, consultations and discussions in scientific disciplines. The terms and conditions of such exchanges appointments shall be agreed upon through diplomatic channels.
3.2. The Parties will encourage mutual exchange of scientific and research specialists with the objective of research, studies, consultations and discussions. The terms and conditions of such exchanges will be established by the relevant scientific institutions of both states.
3.3. The Parties shall encourage joint scientific and technological research and development projects in areas of mutual interest, as well as exchange of scientific and technical information and publications.
3.4. The Parties shall encourage direct cooperation between universities, academies of sciences, and other scientific research institutions.
Article 4
Cooperation between universities
4.1. The Parties shall exchange publications, literature, research materials and other information in the field of higher education.
4.2. The Parties shall enable participation of three academic in national and international conferences/seminars and other similar events to be held in both countries for a period of up to five (5) days each, while this program is in force. The registration charges/fees in respect of such participants shall be borne by the host institution.
4.3. The parties shall cooperate in the promotion of studies relating to the culture, languages and modern history of each other's country in the respective universities.
Article 5
Youth exchange
5.1. The Parties agree that the exchange of youth and young adults constitute a major contribution to the relations between the two countries. They shall therefore support these programs.The emphasis should be placed on the active participation of young people themselves and the promotion of youth cooperation and networking through the specific youth activities.
5.2. The Parties shall encourage mutual projects of professionals and experts in the field of youth. Details in this regard shall be determined between the Israel Youth Exchange Council and the relevant association in the Republic of Moldova.
Article 6
Cooperation in the framework of international organization
The Parties shall cooperate in the field of education, science, culture, sports, youth and communications in the framework of UNESCO and other international organizations, such as the European Union and the Council of Europe, with the purpose of exchanging information and the implementation of common programs of action.
Article 7
Excenge of culture and at experts
General review
The Parties welcome the continuing level of reciprocal cultural activities, noting the valuable role played by the cultural ties between the countries. The Parties reaffirm their intentions to continue to encourage direct cooperation between cultural institutions, organizations and individuals in the two countries.
The Parties shall encourage initiatives designed to assist public and private organizations and individuals engaged in promoting and sponsoring cultural activities of Israeli origin in Republic of Moldova and cultural activities of Moldova origin in Israel.
7.1. The Parties shall support the exchange of music, theatre, dance, visual and plastic arts, design, dance and all other artistic groups or individuals participating in tours, festivals and other cultural events, including conferences, symposia, mutual performances, workshops, artistic exposures and meeting involving the exchange of information and experiences. Up to twenty (20) man days will be allotted annually for this purpose, subject to budgetary limitations.
7.2. Festivals: The Parties shall encourage the exchange of experts and artist for performances and participation in their festivals of music; dance and theatre. The details relating to these exchanges, such as the number of artists and length of stays, will be based on principle of reciprocity.
The Parties shall exchange up to three (3) experts in the sphere of festivals, for a period of up to five (5) days, in order to share information and promote the cooperation in the field.
The Parties shall inform each other in advance about major international festivals to be held in their respective countries, in order to facilitate such participation. The information will be published on the website of the respective competent authorities.
The Israeli Party invites the Republic of Moldova to participate in major festivals held in Israel such as:
• The Israel festival, Jerusalem (in May/June, Annual)
• Artur Rubinshtein International Piano Master Competition (Triennial, dates variable)
• Carmiel International Dance Festival (Annual, in July)
• International Exposure at the Suzanne Dellal Centre for Dance Tel-Aviv (Annual, in December)
• International conferences, Isra-Darma and international exposure for theatre (Annual in December)
• Red Sea International Jazz Festival (Annual, in August)
• Jerusalem International Book Fair (Biennial, in February)
• Haifa International Theatre Festivals and Youth (annual, in April)
• Safed International Klezmer Festival (annual, in July or August)
• Dance-Europe at the Suzanne Dellal Centre for Dance and Theatre (annual, Oct-Nov)
• Felicia Blumenthal International Music Festival(annual, in May)
• The International festival for Puppet Theatre in Jerusalem (annual, in August)
• The Keshed Eilon International Violin Master courses in western Galilee (annual, September)
• The kfar Blum Chamber Music Festivals (annual, July)
The Moldavian Party invites the Israeli Party to participate in the following international festivals:
• The International Music Festival "Martisor" (annually, March);
• The International Classic Music Festival "CRESCENDO" (annually, April);
• The International Festival of opera interpreters "BELCANTO" (annually, May);
• The International Festival "Noptile Pianiste" (annually, June)
• The International Festival of Opera and Ballet Star "Invites Maria Biesu" (annually, September);
• The International Festival "ETNO-JAZZ" (annually, September);
• The International Festival-competition of pop music "Two twin hearts" (annually, November);
• The International Competition of Youth Interprets "E.Coca"(annually, June);
• The New Music Festival (annually, June);
• The theatre international festival "The Theatre Biennial Eugene Ionesco" (biennial, May);
7.3. Plastic Art, architecture, photography and design:
The Parties shall develop cooperation in the field of fine arts and handicraft fairs.
They shall encourage exchange of exhibitions and cooperation between artistic, folk craftsmen, art experts and specialists in traditional folk works. The Parties shall support the exchange of exhibitions while this program is in force and shall promote exhibition curators or experts in the restoration of art, for a total period not exceeding four (4) days, projects shall agreed upon the Parties through the diplomatic channels.
The Parties shall encourage the direct cooperation between architects and their institutions and the exchange of architects as well as the sharing of information and promotion of exhibitions. For this purpose both parties shall exchange one (1) expert for up to five (5) days while this Program is in force.
7.4. Museum and Exhibitions: The Parties shall encourage the direct contacts between museums and galleries and similar institutions of both countries, including exchanges of specialists, curators, materials, special exhibits and information.
7.5. Music: The Parties shall support the presentation of the work of their composers in the other country. They shall also support direct contacts between musicians (conductors, soloists, etc.), music organizations, institutions, associations, orchestras and conservatories in the area of classical and contemporary music, including the exchange of recording and personal visits on a commercial and non commercial basis.
The Parties shall strive to facilitate the participation of their musicians as well as juror and observers in major festivals, competitions and events organized in both countries.
7.6. Dance: The Parties shall encourage the exchange of dancers, choreographers, dance experts, teachers and producers of dance festivals. The Parties shall also jointly participate in developing multilateral cultural cooperation.
7.7. Theatre: The Parties shall encourage the exchange of actors, directors, playwriting, critics and others. The Parties shall also jointly participate in developing multilateral cultural cooperation.
7.8. The Parties shall encourage visits of arts critics, sciences writers and journalists dealing with culture, with the aim of promoting a better understanding of the sociological and cultural developments taking place in the other country. Four (4) days shall be allotted for this purpose.
7.9. Gastronomic culture: The Parties shall welcome the possibilities to cooperate in domain of gastronomic culture, in order to promote their respective gastronomic traditions. For this purpose both Parties shall exchange 1-3 experts for up to four (4) days, while this program is in force.
Article 8
Literature and book fairs
8.1. The Parties shall work jointly to promote the translation of contemporary prose, poetry and other literary works of their country into the languages of the other Party. The Parties shall also encourage the distribution of the work thus translated in their respective languages.
The Parties shall exchange three (3) persons (writers, poets and translators) each for stay of up to five (5) days, while this program is in force.
8.2. The Parties shall encourage writers and editors to participate in seminars, workshops and poetry reading aimed at promoting greater understanding between the two literary communities. The Parties shall support participation of poets and writers in festivals and literary events. Five (5) days shall be allotted annually for this purpose.
8.3. The Parties shall encourage direct contacts between book publishers and national libraries.
8.4. Each Party shall extend invitation to the other for participation in their respective International Book fairs on a commercial basis and non commercial basis, while the Program is in force.
The Israeli Party invites the Moldavian Party to participate in the Jerusalem International Book Fair that takes place every two years in Jerusalem.
The Moldavian Party invites the Israeli Party to participate in the International Book Art Exhibition (annually, in August), and in the International Art Exhibition of Book for Children.
Article 9
Archives and libraries
9.1. The Parties shall promote the reciprocal cooperation between the archive departments of state, public institutions and libraries, in accordance with their respective legislation, through exchanges of experts, scientific publication, microfilms, book, digital information, documents copies, databases and regulations. The exchanges shall take place in accordance with domestic legal provisions and will be subject to the budgetary framework of the Parties.
9.2. The Parties shall consider the exchange of one (1) archivist or librarian for up to five (5) days on each occasion in order to acquire information on the organization of the respective archives/libraries as well as study and research missions.
Article 10
Cinema and audio-visuals
The Israeli Party notifies the Moldavian Party of the following major film festivals that are held in Israel:
• Jerusalem International Film Festival (annual, in July)
• Haifa International Film Festival (annual, in October)
• International Student Festival, Tel-Aviv (biennial, in June)
• International Women's Film Festival, Rehovot ( annual, in September)
• The Doc-Aviv International Documentary Film Festival in Tel-Aviv (annually, in April)
• World Jewish Film Festival, in Beer-Sheva (annual, in November)
10.2. The Parties shall encourage the holding of film weeks of the other Party in their own country. Film should be screened by both countries and have English sub-titles, if the language of the film is not English.
Each Party shall encourage mutual visits of an expert or figure in the field of cinema. For those purpose the Parties shall exchange annually two (2) experts in the fields of cinema and audiovisual for a period of up to five (5) days to participate in festivals, conferences, reviews, meetings, retrospective and other prestigious international events.
10.3. The Parties shall encourage cooperation between cinema and television institutes of two countries.
The Parties welcome the proposal for cooperation between the Film and Television School as well as between their national cinemas in both countries and will formulate proposal for exchange students and teachers of both film schools.
10.4. The Parties express their interest in promoting co-production between Moldavian and Israeli film producers. The Parties shall discuss a co-production (of films and video) agreement, with the aim to facilitate future film co-productions.
10.5. The Parties shall encourage cooperation between the television and radio authorities of both countries, as well as the exchange of materials (feature and documentary) and experts in this area, on a commercial and non commercial basis. In addition, the Parties shall encourage the holding of workshops on the topic of educational television, staff training and background material aimed at enhancing each country's knowledge and understanding of the other country.
Article 11
Sports
The Parties shall encourage cooperation in sports, mainly by exchange sports teams, trainers and experts in diverse disciplines. Details shall be worked out through mutual consultations between interested organizations of both countries. The terms and conditions of these exchanges shall be agreed upon between interested organizations of both countries.
Article 12
Cultural heritage and archeology
12.1. The Parties shall encourage cooperation in the protection of cultural heritage, keeping each other informed on relevant national laws and regulations. In addition they shall encourage activities aimed at preserving location of mutual interest.
12.2. The Parties shall encourage direct cooperation between institutions in the field of the protection of cultural heritage. They shall also exchange professionals, academic experts, information and publicity material as well as information on seminars.
12.3. The Parties shall encourage cooperation with a view to preventing the illegal trade in cultural heritage goods in accordance with international law and their respective Law.
12.4. The Parties shall encourage cooperation in the field of archeological excavations, urban conservation and architecture research. Details of this cooperation shall be agreed upon through diplomatic channels.
12.5. The Parties shall encourage the relevant authorities in their respective countries to exchange information and publications of archeological content. They shall also encourage the organization of joint seminars on subjects of mutual interest to held during the courses of this Program. Details in this regard shall be determined by the Israel Antiquities Authority and the Republic of Moldova.
12.6. During the course of this Program, the Parties shall exchange one (1) expert from the fields of archaeology, preservation of antiquities, restoration of cultural heritage and conservation of monuments and architecture, for a period of up to four (4) days, in order to exchange information on matters of their specialization. Details in this regard shall be determined by the Israel Antiquities Authority and the Republic of Moldova.
Article 13
Intelectual property
13.1. The Parties shall ensure appropriate and efficient protection of intellectual property rights of all materials obtained on the basis of this program, in accordance with the laws and regulations in force in their respective countries and in accordance with the international agreements to which they are both Parties.
13.2. Intellectual property rights acquired as a result of joint activity shall be allocated by mutually agreed conditions set out in separate contracts and agreements between the partners of the respective joint activity.
13.3. No Party shall transmit any information protected by intellectual property law and obtained in pursuance of this program to any third party without prior written consent of the other Party.
Article 14
Financial provisions
14.1. Financial and other provisions, as well as the schedule of the events shall be agreed upon by mutual consultations between the interested agencies of both countries. All decisions regarding the budget will be subject to funds availability.
Failing any special agreements, the financial provisions will be adjusted on the basis of reciprocity, namely:
• The sending Party shall cover the international travel expenses of their delegations and representatives, including the transporting of the professional equipment and exhibits.
• The receiving Party shall cover the cost of accommodation within its country.
14.2. Exchange of individuals (artists, experts, etc.): The exchange shall be regulated as follows:
• Each party shall send to the other Party data (names, curricula vitae, objectives of the visits, languages spoken, proposed itinerary and schedule arrival and departure dates) in English at least two (2) months in advance of the expected date of visit of the delegation or individuals.
• The receiving Party shall confirm the acceptance of the proposal within one (1) month.
• The invited persons or delegation should know either the language of the receiving cooperation or English or any other language mutually agreed upon.
• The sending Parties shall cover travel expenses to and from both countries.
• The receiving Party shall provide the individuals of the sending Party with the appropriate accommodations.
• Each individual must have medical insurance that will be under his/her responsibility.
14.3. Scholarships:
The term and financial conditions of the specialization scholarships granted by the Israeli Party for one academic year shall be published yearly through governmental channels as well as websites of the Israeli Ministry of Foreign Affairs: www.mfa.gov.il.
The Israeli Party shall provide participants in the Summer Course of the ULPAN Language School accepted within this Program with the following:
a) free tuition;
b) allowance to cover the living expenses in accordance with the conditions of the language school;
c) health insurance with the exception of dental care and chronic diseases.
The Moldavian Party shall provide Israeli holders of one academic year scholarships with the following:
a) free tuition;
b) allowance to cover the living expenses;
c) health insurance
14.4. Exchange of exhibitions: The exchanges of exhibitions shall be implemented under the followings:
a. The sending Party shall cover the cost of transport of exhibits to and from the receiving country.
b. The receiving Party shall cover the cost of transport of exhibits within its territory and costs related to the organization of the exhibition, including costs connected with its installation and dismantlement unless agreed differently by the Parties. The receiving Party shall provide publicity for the exhibition.
c. The sending Party shall bear the cost of insurance of the exhibits.
d. The receiving Party shall provide accommodation and board allowances for the specialists (artists/curators) accompanying the exhibition according to the financial provisions of the present Program. The Parties shall agree upon the number of persons accompanying the exhibition and on the duration of their stay.
Article 15
Final provision
15.1. This program does not exclude the realization of other exchanges in the cultural, scientific and educational fields.
15.2. The Parties agree that all initiative mentioned in this Program shall be carried out within the limits of the funds allocated in their respective annual budgets.
15.3. All activities and exchanges realized under this Program shall be implemented in accordance with the Law of the Parties.
15.4. All differences that might arise in the course of this Program shall be settled through governmental channels.
15.5. The Parties entrust their competent authorities with the implementation of this Program.
15.6. This Program can be amended or modified by mutual consent of the Parties. The amendments or modifications shall be made in writing.
15.7. The next meeting of the Joint Committee shall take place in the Republic of Moldova at the end of the year 2010.
15.8. This Program shall come into force on the date of signature and shall be in force until 31 December 2010. It shall be automatically extended for an additional period of three (3) years, unless either Party notifies the other by a Diplomatic Note of its intention to terminate it, at least ninety (90) days prior to the date of its intended termination.
