Guvernul Republicii Moldova şi

Guvernul Republicii Estonia, denumite în continuare Părţi,

dorind să faciliteze implementarea Acordului dintre Republica Moldova şi Comunitatea Europeană privind readmisia persoanelor aflate în situaţie de şedere ilegală (denumit în continuare Acord de Readmisie);

bazîndu-se pe prevederile articolului 19 al acestuia,

au decis după cum urmează:

Articolul 1

Desemnarea Autorităţilor Competente

În corespundere cu lit.1) a art.1 şi lit.a) a art.19 (1) ale Acordului de Readmisie, Părţile au desemnat următoarele autorităţi competente pentru implementarea acestuia:

Articolul 2

Punctele de trecere a frontierei

În corespundere cu lit.a) al art.19 (1), readmisia şi tranzitul pot avea loc în următoarele puncte de trecere a frontierei:

Articolul 3

Limba de comunicare

Părţile vor utiliza limba engleză în cadrul procedurilor înfăptuite în contextul Acordului de Readmisie şi Protocolului de Implementare.

Articolul 4

Mijloace de probă privind cetăţenia

În corespundere cu art.8 (1) şi art.19 (1) lit.d) ale Acordului de Readmisie, autoritatea competentă a statului solicitant poate remite o interpelare în scris autorităţii competente a Statului solicitat referitor la eliberarea unui document pentru dovedirea cetăţeniei a persoanei în cauză. Părţile pot reciproc recunoaşte cetăţenia ce urmează a fi stabilită dacă este dovedit de către bazele de date electronice sau biometrice că ţara ce recepţionează aplicarea a eliberat un document valabil pentru dovedirea cetăţeniei persoanei respective.

Articolul 5

Transferul persoanei ce urmează a fi readmisă

(1) Transferul persoanei ce urmează a fi readmisă va avea loc în timpul şi locul stabilit corespunzător în scris de către autorităţile competente ale Părţilor.

(2) Dacă termenele transferului au fost extinse datorită unor impedimente legale sau practice, autoritatea competentă a Statului solicitant va notifica imediat autoritatea competentă a Statului solicitat despre astfel de impedimente şi va indica un nou timp şi loc stabilit pentru transfer.

(3) Transferul persoanei ce urmează a fi readmisă trebuie să fie înregistrat într-un proces-verbal.

Articolul 6

Condiţiile pentru transferul sub escortă

În corespundere cu prevederile art.19 (1) lit.c) a Acordului de Readmisie, Părţile convin asupra următoarelor condiţii referitoare la transferurile sub escortă sau tranzitul prin teritoriul său:

- Escorta trebuie să fie responsabilă pentru escortarea persoanei ce urmează a fi readmisă şi predarea acesteia unui reprezentant al autorităţii competente a Statului de destinaţie.

- Escorta trebuie să înfăptuiască serviciul dezarmată şi în ţinută civilă şi să posede documentele ce adeveresc aprobarea efectuării readmisiei sau tranzitului şi să poată în orice timp să dovedească identitatea sa şi autorizaţia oficială.

- Statul solicitat trebuie să asigure protecţie şi asistenţă escortei în timpul exercitării atribuţiilor sale similare celei acordate propriilor oficiali autorizaţi să înfăptuiască astfel de servicii.

- Escorta va fi în toate cazurile subiect al legislaţiei Statului solicitat. Mandatul escortei în timpul escortării unei persoane ce urmează a fi readmisă sau în timpul tranzitului se va limita la autoapărare. În cazul în care oficialii din statul solicitat, autorizaţi pentru efectuarea activităţilor necesare de asistenţă escortei în situaţii de risc imediat şi sporit sunt indisponibili, escorta poate înfăptui măsuri rezonabile şi prompte în vederea prevenirii evadării, cauzării daunelor integrităţii corporale sau automutilării persoanei care urmează a fi readmisă, sau persoanelor terţe sau cauzării daunelor proprietăţii.

- Escorta va fi responsabilă pentru transportarea documentelor de călătorie şi alte certificate solicitate sau date personale ale persoanei ce urmează a fi readmisă, şi pentru transmiterea acestora reprezentanţilor autorităţii competente a statului de destinaţie. Escorta nu poate să părăsească localul stabilit pentru transfer pînă transferul persoanei ce urmează a fi readmisă nu va fi efectuat.

- Autoritatea competentă a Statului solicitant va asigura ca escorta să posede vize de intrare în Statul (Statele) de tranzit şi destinaţie dacă este necesar.

Articolul 7

Modalităţi şi asistenţă la tranzit

(1) În conformitate cu art.13 şi 14 ale Acordului de Readmisie, Părţile convin asupra următoarelor modalităţi practice pentru operaţiile de tranzit:

- O cerere pentru tranzit (conform anexei 6 la Acordul de Readmisie) trebuie să fie remisă prin fax sau în format electronic autorităţii competente a Statului solicitat cu cel tîrziu 4 zile lucrătoare anticipat tranzitului planificat.

- Autoritatea competentă a statului solicitat va răspunde prin fax sau în format electronic în timp de 4 zile lucrătoare după recepţionarea cererii de tranzit, notificînd despre acceptul tranzitului şi timpul preconizat pentru tranzit, punctul de trecere desemnat, metoda de transportare şi folosirea escortei.

- Dacă Statul solicitant consideră necesar de a solicita asistenţă din partea autorităţii competente a Statului solicitat pentru o operaţiune particulară de tranzit, aceasta urmează a fi indicată în formularul de tranzit (anexa 6 la Acordul de Readmisie). În răspunsul său la aplicaţia de tranzit, autoritatea competentă a Statului solicitat trebuie să notifice asupra faptului dacă este disponibilă să prevadă astfel de asistenţă solicitată.

- Dacă persoana ce urmează a fi readmisă este transportată pe cale aeriană şi cu escortă, autoritatea competentă a Statului solicitat va organiza paza şi debarcarea pe teritoriul său a persoanei ce urmează a fi readmisă, şi dacă este posibil cu asistenţa celeilalte Părţi.

(2) Statul solicitant preia, fără întîrziere, persoana ce urmează a fi readmisă înapoi, în corespundere cu prevederile art.13 (4) al Acordului de readmisie, dacă:

- a fost refuzat în acceptul de tranzit;

- persoana ce urmează a fi readmisă a tranzitat ilegal teritoriul Statului solicitat;

- transferul persoanei ce urmează a fi readmisă în alt Stat de tranzit sau destinaţie a eşuat; sau

- tranzitul este imposibil datorită altor circumstanţe.

Articolul 8

Reuniunile Experţilor

Autorităţile competente ale ambelor Părţi vor organiza, la necesitate, reuniuni ale experţilor privind implementarea Protocolului de Implementare. Timpul şi locul desfăşurării acestor reuniuni vor fi decise în baza acordului mutual.

Articolul 9

Notificarea

Părţile se vor notifica reciproc despre orice schimbare în datele de contact ale autorităţilor competente expuse în art.1 şi despre punctele de trecere a frontierei expuse în art.2 al Protocolului de Implementare. Modificările intră în vigoare odată cu recepţionarea notificării.

Articolul 10

Intrarea în vigoare, încetarea şi amendamentele

(1) Fiecare Parte va notifica cealaltă Parte, prin canale diplomatice, despre finalizarea procedurilor interne necesare intrării în vigoare a prezentului Protocol. Partea care recepţionează ultima notificare va informa Comitetul Mixt privind Readmisia privind încheierea Protocolului de Implementare.

(2) În corespundere cu Articolul 19(2) al Acordului de Readmisie, Protocolul de Implementare va intra în vigoare după notificarea Comitetului Mixt privind Readmisia.

(3) Protocolul de Implementare poate fi denunţat la iniţiativa oricărei Părţi în baza unei notificări în scris celeilalte Părţi, remisă cu şase luni înainte.

(4) Prezentul Protocol de Implementare încetează odată cu Acordul de Readmisie.

(5) La înţelegerea reciprocă, Părţile pot amenda Protocolul de Implementare în baza unei notificări scrise remisă prin canalele diplomatice. Amendamentele vor intra în vigoare în corespundere cu punctele 1 şi 2 ale prezentului articol.

Întocmit la Atena la 1 decembrie 2009, în două exemplare fiecare, în limbile moldovenească, estonă şi engleză, fiecare text fiind egal autentic. În caz de divergenţe la interpretare, textul în limba engleză va prevala.

PROTOCOL

between the Government of the Republic of Moldova and the

Government of the Republic of Estonia on the implementation

of the Agreement between the Republic of Moldova and

the European Community on the readmission of

persons residing without authorisation

(Implementing Protocol)

The Government of the Republic of Moldova, and

the Government of the Republic of Estonia, hereinafter the Parties,

desiring to facilitate the implementation of the Agreement between the Republic of Moldova and the European Community on the readmission of the persons residing without authorisation (hereinafter the Readmission Agreement),

based on the provisions of Article 19 thereof,

have agreed as follows:

Article 1

Designation of competent authorities

Pursuant to Article 1 lit.1) and Article 19 (1) lit.a) of the Readmission Agreement, the Parties have designated the following competent authorities for the implementation thereof:

Article 2

Border crossing points

Pursuant to Article 19(1) lit.a) of the Readmission Agreement, readmission and transit may take place in the following border crossing points:

For the Republic of Moldova:

Article 3

Language in communication

The Parties shall use the English language in the procedures carried out under the Readmission Agreement and the Implementing Protocol.

Article 4

Evidence regarding nationality

Pursuant to Article 8(1) and Article 19(1) lit.d) of the Readmission Agreement, the competent authority of the requesting State may submit an inquiry in writing to the competent authority of the requested State regarding the issuance of a document for proof of nationality to the person concerned. The Parties shall mutually deem the nationality to be established if it is ascertained on the basis of electronic or biometric evidence that the country receiving the application has issued a valid document for proof of nationality to the person concerned.

Article 5

Transfer of the person to be readmitted

(1) Transfer of the person to be readmitted shall take place at the time and location agreed upon in writing by the competent authorities of the Parties.

(2) If the term of transfer is extended due to any legal or practical impediments, the competent authority of the requesting State shall immediately notify the competent authority of the requested State of such impediments and indicate the new time and location of transfer.

(3) Transfer of the person to be readmitted shall be recorded in a protocol.

Article 6

Conditions for escorted transfers

Pursuant to Article 19(1) lit.c) of the Readmission Agreement, the Parties agree to the following conditions relating to escorted transfers to or transits through their territories:

- The escort shall be responsible for escorting the persons to be readmitted and transferring him or her to a representative of the competent authority of the State of destination.

- The escort shall perform its duties unarmed and in civilian clothing, whilst carrying documents proving that readmission or transit has been approved, the escort shall be able to prove identity and official authorisation at all times.

- The requested State shall ensure similar protection and assistance to the escort during the performance of its duties as it ensures to its own officials authorised to perform such duties.

- The escort shall in all cases be subject to the legislation of the requested State. The powers of the escort during escorting the person to be readmitted or during transit shall be limited to self-defence. In case of unavailability of officials of the requested State authorised to carry out necessary activities or in order to support such officials in situations of immediate and serious risk, the escort may take reasonable and commensurate measures to prevent the person to be readmitted from escaping, injuring himself or herself or any third persons, or causing damage to property.

- The escort shall be responsible for carrying the travel document and other required certificates or data of the person to be readmitted, and for handing over such items to the representative of the competent authority of the State of destination. The escort may not leave the agreed location of transfer before the transfer of the person to be readmitted is completed.

- The competent authorities of the requesting State shall ensure that the escort possesses visas to enter the State(s) of transit and destination, if required.

Article 7

Modalities and assistance for transit

(1) In accordance with Articles 13 and 14 of the Readmission Agreement, the Parties agree to the following practical modalities for transit operations:

- An application for transit (Annex 6 to the Readmission Agreement) shall be submitted by fax or in an electronic format to the competent authority of the requested State at least 4 working days prior to the planned transit.

- The competent authority of the requested State shall reply by fax or in an electronic format within 4 working days after the receipt of the application for transit, notifying whether it consents to the transit and the envisaged time of transit, designated border crossing point, method of transport and use of escorts.

- If the requesting State considers necessary to request assistance from the competent authority of the requested State for a particular transit operation, this shall be indicated on the transit application form (Annex 6 to the Readmission Agreement). In its reply to the transit application, the competent authority of the requested State shall notify whether it is able to provide the requested assistance.

- If the person to be readmitted is transported by air and with escort, the competent authority of the requested State shall organise guarding and boarding of the person to be readmitted on its territory, and as far as possible with the assistance of the escort.

(2) Pursuant to Article 13(4) of the Readmission Agreement the requesting State undertakes to take back the person to be readmitted without delay, if:

- consent to transit has been revoked;

- the person to be readmitted illegally entered the territory of the requested State during transit;

- transfer of the person to be readmitted to another State of transit or destination failed; or

- transit has become impossible on some other grounds.

Article 8

Meetings of experts

The competent authorities of both Parties shall arrange meetings of experts as necessary regarding the implementation of the Implementing Protocol. The time and location of such meetings shall be decided upon mutual agreement.

Article 9

Duty of notification

The Parties shall notify each other of any changes in the contact details of the competent authorities referred to in Article 1 and the border crossing points referred to in Article 2 of the Implementing Protocol. The changes shall be deemed to have entered into force as of the receipt of the notification.

Article 10

Entry into force, termination and amendments

(1) Each Party shall notify the other Party through diplomatic channels of the completion of the internal legal procedures necessary for the entry into force of this Implementing Protocol.The Party who receives the last notification shall notify the Readmission Committee of the conclusion of the Implementing Protocol.

(2) In accordance with Article 19(2) of the Readmission Agreement the Implementing Protocol shall enter into force after the Readmission Committee has been notified.

(3) The Implementing Protocol may be terminated by either Party upon six (6) months prior written notice to the other Party.

(4) The Implementing Protocol shall cease to apply at the same time as the Readmission Agreement.

(5) Subject to mutual consent, the Parties may amend the Implementing Protocol in writing through diplomatic channels. The amendments shall enter into force in accordance with paragraphs 1 and 2 of this Article.

Done at Athens on this days of December 1 in the year 2009 in duplicate in Moldovan, Estonian and English languages, each of these texts being authentic. In case of dispute in interpretation, the English text shall prevail.
