Guvernul Republicii Moldova şi Guvernul Republicii Lituania, denumite în continuare “Părţi”;
Dorind să faciliteze implementarea Acordului dintre Republica Moldova şi Comunitatea Europeană privind readmisia persoanelor aflate în situaţie de şedere ilegală (denumit în continuare Acord de Readmisie), semnat la 10 octombrie 2007;
Bazate pe prevederile articolului 19 al acestuia -

Articolul 1
Desemnarea Autorităţilor Competente
Părţile au desemnat următoarele autorităţi competente pentru implementarea acestuia:

Articolul 2
Punctele de trecere a frontierei
În corespundere cu art.19 (1) al Acordului de Readmisie, readmisia şi tranzitul pot avea loc în următoarele puncte de trecere a frontierei:
Pentru Guvernul Republicii Moldova:
Aerian: Aeroportul Internaţional Chişinău
Terestru: Punctul de trecere a frontierei Leuşeni-Albiţa
Pentru Republica Lituania:
Punctul de trecere a frontierei la aeroportul internaţional din Vilnius, Kaunas, Palanga şi Zokniai.
Articolul 3
Limba de comunicare
În scopul implementării Acordului de Readmisie şi în cadrul procedurilor înfăptuite în contextul Protocolului între Guvernul Republicii Moldova şi Guvernul Republicii Lituania privind implementarea Acordului dintre Republica Moldova şi Comunitatea Europeană privind readmisia persoanelor aflate în situaţie de şedere ilegală (denumite în continuare “Protocol de Implementare"), Părţile vor utiliza limba engleză.
Articolul 4
Procedura de depunere a cererilor de readmisie
În conformitate cu Articolul 6 al Acordului de Readmisie, Părţile vor transmite o cerere de readmisie (după forma şi conţinutul menţionat în Anexa 5 al Acordului de Readmisie) reciproc prin fax sau în format electronic.
Articolul 5
Transferarea persoanelor care urmează să fi readmise
1. Transferul persoanei care urmează a fi readmisă este realizat în timpul, locul şi sub escortă coordonat în formă scrisă de către autorităţile competente ale Părţilor Contractante.
2. Dacă termenii transferului au fost extinşi datorită unor impedimente legale sau practice, autoritatea competentă a Statului solicitant va notifica imediat autoritatea competentă a Statului solicitat despre eliminarea impedimentelor şi va indica un timp şi loc stabilit nou pentru transfer, escortă şi altă informaţie cu privire la transferul persoanei care urmează a fi readmisă.
3. Transferul persoanei ce urmează a fi readmisă trebuie să fie înregistrată într-un proces-verbal.
Articolul 6
Condiţiile pentru transferul sub escortă
În corespundere cu prevederile art.19 (1) lit.c) al Acordului de Readmisie, Părţile convin asupra următoarelor condiţii referitoare la transferurile sub escortă sau tranzitul care urmează să fie readmisă pe teritoriul lor:
1) Escorta trebuie să fie responsabilă pentru escortarea persoanei ce urmează a fi readmisă şi transferul acesteia Statului de destinaţie.
2) Escorta trebuie să înfăptuiască serviciul dezarmaţi şi în ţinută civilă şi să posede documentele ce adeveresc aprobarea efectuării readmisiei sau tranzitului şi să poată în orice timp să dovedească identitatea sa.
3) Statul solicitat trebuie să asigure protecţie similară şi asistenţă escortei în timpul exercitării atribuţiilor sale, dacă este asigurat că ei sunt autorizaţi să înfăptuiască astfel de servicii.
4) Escorta va fi în toate cazurile subiect al legislaţiei Statului solicitat. Drepturile escortei în timpul escortării unei persoane ce urmează a fi readmisă sau în timpul tranzitului va fi limitată doar la autoapărare. În cazul în care oficialii din statul solicitat, autorizaţi pentru efectuarea activităţilor necesare de asistenţă escortei în situaţii de risc sporit sunt indisponibili, escorta poate înfăptui măsuri rezonabile şi prompte în vederea prevenirii persoanelor să fie readmise sau fiind transferate de la evadare, rănire personală sau a unei persoane terţe, sau cauzînd pagube proprietăţii.
5) Escorta va fi responsabilă pentru transportarea documentelor de călătorie şi alte certificate solicitate sau date personale ale persoanei ce urmează a fi readmisă, şi pentru transmiterea acestora reprezentanţilor autorităţii competente a Statului de destinaţie. Escorta nu poate părăsi locul convenit înainte ca readmisia să fie efectuată.
Articolul 7
Modalităţi şi asistenţă la tranzit
1. În conformitate cu art.13 şi 14 ale Acordului de Readmisie, Părţile convin asupra următoarelor modalităţi practice pentru operaţiile de tranzit:
1) cerere pentru tranzit (după forma şi conţinutul conform anexei 6 a Acordului de Readmisie) trebuie să fie remisă prin fax sau în format electronic autorităţii competente a Statului solicitat cu cel puţin 6 (zile) zile lucrătoare anticipat tranzitului planificat.
2) Autoritatea competentă a Statului solicitat poate răspunde prin fax sau în format electronic în timp de 4 zile lucrătoare după recepţionarea cererii de tranzit, notificînd despre acceptul tranzitului şi timpul preconizat pentru tranzit, punctul de trecere desemnat, metoda de transportare şi folosirea escortei.
3) Dacă Statul solicitant consideră necesar de a solicita asistenţă din partea autorităţii competente a Statului solicitat pentru o operaţiune particulară de tranzit, aceasta urmează a fi indicată în cererea de tranzit (anexa 6 la Acordul de Readmisie). În răspunsul său la cererea de tranzit, autoritatea competentă a Statului solicitat trebuie să notifice asupra faptului dacă este disponibil să prevadă astfel de asistenţă solicitată.
4) Dacă persoana ce urmează a fi readmisă este transportată pe cale aeriană şi cu escortă, autoritatea competentă a Statului solicitat va organiza paza şi îmbarcarea pe teritoriul său a persoanei ce urmează a fi readmisă, şi dacă este posibil cu asistenţa celeilalte Părţi.
2. Statul solicitant preia, fără întîrziere, persoana ce urmează a fi readmisă înapoi, în corespundere cu prevederile art.13 (4) al Acordului de Readmisie, dacă:
1) A fost refuzat în acceptul de tranzit în corespundere cu art.13 (3) al Acordului de Readmisie;
2) Persoana ce urmează a fi readmisă a intrat ilegal pe teritoriul Statului solicitat în timpul tranzitului;
3) Transferul persoanei ce urmează a fi readmisă în alt Stat de tranzit sau destinaţie a eşuat; sau
4) Tranzitul este imposibil datorită altor circumstanţe.
Articolul 8
Notificarea
Părţile vor notifica reciproc, prin canale diplomatice, despre orice schimbare în datele de contact ale autorităţilor competente expuse în Articolul 1 al Protocolului de Implementare şi despre punctele de trecere a frontierei expuse în Articolul 2 al Protocolului de Implementare.
Articolul 9
Intrarea în vigoare, încetarea şi amendamentele
1. Prezentul Protocol de Implementare se încheie pe un termen nelimitat şi intră în vigoare doar după notificarea de la data semnării de către Comitetul mixt privind Readmisia.
2. Protocolul de Implementare va înceta în acelaşi timp cu Acordul de Readmisie.
3. Fiecare Parte poate denunţa oricînd prezentul Protocol printr-o notificare scrisă adresată celeilalte Părţi prin canale diplomatice. În aşa cazuri, denunţarea intră în vigoare după 6 luni din data primirii notificării.
4. La înţelegerea reciprocă a Părţilor, în prezentul Protocol pot fi introduse modificări şi completări perfectate prin Protocoale separate, care sunt parte componentă a acestuia şi intră în vigoare conform prevederilor alineatului (1) Articolul 9 al prezentului Protocol de Implementare.
5. În temeiul Articolului 18 al Acordului de Readmisie, Părţile vor notifica Comitetului mixt privind Readmisia, despre intrarea în vigoare, denunţarea, modificarea prezentului Protocol, precum şi alte subiecte ce ţin de implementarea conformă a Acordului de Readmisie.
Articolul 10
Relaţiile cu alte tratate
Prezentul Protocol de Implementare trebuie să fie fără prejudicierea drepturilor, obligaţiilor şi responsabilităţilor Părţilor care decurg din alte tratate internaţionale.
Articolul 11
Soluţionarea diferendelor
1. Eventualele diferende care pot să apară în ceea ce priveşte interpretarea şi/sau aplicarea prezentului Protocol, vor fi soluţionate pe cale amiabilă prin consultări între autorităţile competente ale Părţilor Contractante în cadrul Comitetului mixt privind Readmisia.
2. În cazul în care diferendele nu pot fi soluţionate conform alineatului 1 al prezentului articol, acestea vor fi soluţionate pe cale diplomatică de către Părţile Contractante.
Semnat la Chişinău, la 29 septembrie 2010, în două exemplare originale, fiecare în limbile moldovenească, lituaniană şi limba engleză, toate textele fiind autentice. În cazul unor divergenţe la interpretare, textul în limba engleză va fi de referinţă.

between the Republic of Moldova and the European Community on
the readmission of persons residing without authorisation
(Implementing protocol)
The Government of the Republic of Moldova, and the Government of the Republic of Lithuania, hereinafter referred to as the "Parties",
desiring to facilitate the implementation of the Agreement between the Republic of Moldova and the European Community on the readmission of the persons residing without authorisation (hereinafter referred to as Readmission Agreement), done on 10 October 2007;
based on provisions of Article 19 thereof -
HAVE AGREED AS FOLLOWS:
Article 1
Designation of Competent Authorities
The Parties have designated the following competent authorities for the implementation thereof:

Article 2
Border Crossing Points
Pursuant to Article 19 (1) of the Readmission Agreement, readmission and transit may take place in the following border crossing points:
For the Republic of Moldova:
By air: International Airport Chişinău,
By land: Border crossing point Leuşeni-Albiţa.
For the Republic of Lithuania:
Border crossing points at international airports of Vilnius, Kaunas, Palanga and Zokniai.
Article 3
Language in Communication
For the purpose of the implementation of the Readmission Agreement and performance of procedures established in the Protocol between the Government of the Republic of Moldova and the Government Republic of Lithuania on the Implementation of the Agreement between the Republic of Moldova and the European Community on the readmission of the persons residing without authorisation (hereinafter referred to as the "Implementing Protocol"), The Parties shall communicate in the English language.
Article 4
Procedure for submitting readmission applications
In accordance with article 6 of the Readmission Agreement, the Parties shall transmit a readmission application (of the form and content as specified in Annex 5 of the Readmission Agreement) to each other by fax or electronic means.
Article 5
Transfer of the Person to be Readmitted
1. Transfer of the person to be readmitted shall take place at the time, location and under escort agreed upon in writing by the competent authorities of the Parties.
2. If the term of transfer was extended due to any legal or practical impediments, the competent authority of the requesting State shall immediately notify the competent authority of the requested State of the impediments as they occurs and shall indicate the envisaged location, time of transfer, escort and other information related to the transfer of the person to be readmitted.
3. Transfer of the person to be readmitted shall be recorded in an application.
Article 6
Conditions for Escorted Transfers
Pursuant to Article 19(l)(c) of the Readmission Agreement, the Parties agree to the following conditions relating to escorted transfers or transit of the person to be readmitted on their territories:
1) the escort shall be responsible for escorting the persons to be readmitted and transferring him or her to the State of destination;
2) the escort shall perform his or her duties unarmed and in civilian clothing; he or she should carry documents proving that readmission or transit has been approved, and he or she shall be able at all times to prove his or her identity and official authorisation;
3) the requested State shall ensure similar protection and assistance to the escort during the performance of his or her duties as it ensures to its own officials authorised to perform such duties;
4) the escort shall in all cases be subject to the legislation of the requested State. In discharge of the duties, the escort shall not act in excess of self-defence. The content of self-defence shall be established by the national law of the state where relevant action takes place. In the case of unavailability of officials of the requested State authorised to carry out the necessary activities or in order to support such officials in situations of immediate and serious risk, the escort may take reasonable and commensurate measures to prevent the person to be readmitted form escaping, injuring himself of herself or any third persons, or causing damage to property;
5) The escort shall be responsible for carrying the travel document and other required documents of the person to be readmitted, and for handing over such items to the State of destination. The escort may not leave the agreed location of transfer before the transfer of the person to be readmitted is completed.
Article 7
Modalities and Assistance for Transit
1. In accordance with Article 13 and 14 of the Readmission Agreement, the Parties agree to the following practical modalities for transit operations:
1) an application for transit (of the form and content as specified in Annex 6 to the Readmission Agreement) must be submitted by fax or in an electronic format to the competent authority of the requested State at least 6 (six) working days prior to the planned transit;
2) the competent authority of the requested State must reply by fax or in an electronic format within 4 (four) working days after the receipt of the application for transit, notifying whether it consents to the transit and the envisaged time of transit, designated border crossing point, method of transportation of the person to be readmitted and use of escort;
3) if the requesting State considers necessary to request assistance from the competent authority of the requested State for a particular transit operation, this must be indicated on the transit application form (Annex 6 to the Readmission Agreement). In its reply to the transit application, the competent authority of the requested State should notify whether it is able to provide the requested assistance;
4) if the person to be readmitted is transported by air and with escort, the competent authority of the requested State shall organise guarding and boarding of the person to be readmitted, and as far as possible with the assistance of the requesting State.
2. The requesting State undertakes to take back a person to be readmitted pursuant to Article 13 (4) of the Readmission Agreement without delay, if:
1) consent to transit was refused or withdrawn pursuant to Article 13 (3) of the Readmission Agreement;
2) the person to be readmitted illegally entered the territory of the requested State during transit;
3) transfer of the person to be readmitted to another State of transit or destination failed; or
4) transit is impossible on some other grounds.
Article 8
Duty of Notification
The Parties, through diplomatic channels, shall notify each other of any changes in the contact details of the competent authorities referred to in Article 1 of the Implementing Protocol and the border crossing points referred to in Article 2 of the Implementing Protocol.
Article 9
Entry into Force, Termination and Amendments
1. The Implementing Protocol is concluded for an indefinite period of time and shall enter into force only after the Joint Readmission Committee has been notified of its signing.
2. The Implementing Protocol shall cease to apply at the same time as the Readmission Agreement.
3. Subject to mutual consent, the Parties may denounce the Implementing Protocol in writing through diplomatic channels. In such case the denunciation shall enter into force after six months from the date of receipt of the notification on the denunciation.
4. Upon the mutual consent, the Parties may modify the Implementing Protocol by amendments which shall constitute a part of the Implementing Protocol and which shall enter into force in accordance with Article 9(1) of the Implementing Protocol.
5. Pursuant to article 18 of the Readmission Agreement, the Parties shall notify the Joint Readmission Committee about entering into force, denunciation and amendments to the Implementing Protocol and other things related to the implementation of the Readmission Agreement.
Article 10
Relations to other treaties
The Implementing Protocol shall not infringe any obligations of the Parties following from other international treaties.
Article 11
Settlement of disputes
1. Any disputes which may emerge in connection with the interpretation and/or application of the Implementing Protocol shall be settled by means of consultations between Parties within the Joint Readmission Committee.
2. In case when disputes can not be settled in accordance with Article 11(1) of the Implementing Protocol, those will be settled by Parties through diplomatic channels.
Done on this day of 29 September in the year 2010, Chisinau in duplicate in the Lithuanian, Moldovan and English languages, each of these texts being authentic. In case of dispute in interpretation, the English text shall prevail.
