de modificare a acordului privind achiziţiile publice

Părţile la Acordul privind achiziţiile publice, semnat la Marrakech la 15 aprilie 1994 (denumit în continuare “Acordul 1994”),
Purtând negocieri ulterioare în temeiul articolului XXIV:7 (b) şi (c) din Acordul 1994
Prin prezentul convenim după cum urmează:
1. Preambulul, articolele I până la XXIV şi Apendicele la Acordul 1994 se elimină şi se înlocuiesc cu dispoziţiile aşa cum sunt incluse în Anexă la prezentul.
2. Prezentul Protocol este deschis spre acceptare de către Părţile la Acordul 1994.
3. Prezentul Protocol intră în vigoare pentru acele Părţi la Acordul 1994 care au depus instrumentele lor de acceptare a acestui Protocol, în a 30-a zi de la depunere de către două treimi din Părţile la Acordul 1994. După aceea, prezentul Protocol va intra în vigoare pentru fiecare Parte la Acordul 1994 care a depus instrumentul său de acceptare a acestui Protocol, în a 30-a zi de la data depunerii.
4. Prezentul Protocol va fi depus la Directorul General al OMC, care va trimite cu promptitudine fiecărei părţi la Acordul 1994 o copie adevărată certificată a acestui Protocol, precum şi o notificare despre fiecare acceptare a acestora.
5. Prezentul Protocol se înregistrează în conformitate cu dispoziţiile articolului 102 din Carta Naţiunilor Unite.
Încheiat la Geneva, în ziua a 30-a a lunii martie anul două mii doisprezece într-un singur exemplar, în limbile engleză, franceză şi spaniolă, fiecare text fiind autentic, cu excepţia cazului în care se prevede altfel în ceea ce priveşte Apendicele la acesta.
Protocol Amending the Agreement
on Government Procurement
The Parties to the Agreement on Government Procurement, done at Marrakesh on 15 April 1994, (hereinafter referred to as „the 1994 Agreement”),
Having undertaken further negotiations pursuant to Article XXIV:7(b) and (c) of the 1994 Agreement;
Hereby agree as follows:
1. The Preamble, Articles I through XXIV, and Appendices to the 1994 Agreement shall be deleted and replaced by the provisions as set forth in the Annex hereto.
2. This Protocol shall be open for acceptance by the Parties to the 1994 Agreement.
3. This Protocol shall enter into force for those Parties to the 1994 Agreement that have deposited their respective instruments of acceptance of this Protocol, on the 30th day following such deposit by two thirds of the Parties to the 1994 Agreement. Thereafter this Protocol shall enter into force for each Party to the 1994 Agreement which has deposited its instrument of acceptance of this Protocol, on the 30th day following the date of such deposit.
4. This Protocol shall be deposited with the Director-General of the WTO, who shall promptly furnish to each Party to the 1994 Agreement a certified true copy of this Protocol, and a notification of each acceptance thereof.
5. This Protocol shall be registered in accordance with the provisions of Article 102 of the Charter of the United Nations.
Done at Geneva this 30th day of March two thousand and twelve in a single copy, in the English, French and Spanish languages, each text being authentic, except as otherwise specified with respect to the Appendices hereto.
