cu privire la asistenţă reciprocă între administraţiile lor vamale

Guvernul Republicii Moldova şi Guvernul Republicii Elene, denumite în continuare Părţi Contractante,

luînd în considerare importanţa evaluării exacte a drepturilor de import şi de export şi asigurării aplicării corecte de către Administraţiile Vamale a măsurilor specifice de prohibiţie, restricţie şi control,

recunoscînd că încălcările legislaţiei vamale prejudiciază interesele sociale, economice, fiscale şi alte interese ale ţărilor lor,

fiind convinse că consolidarea cooperării între Administraţiile lor Vamale va contribui la acţiuni mult mai eficiente în vederea prevenirii, investigaţiei şi reprimării încălcărilor legislaţiei vamale, inclusiv a traficului ilicit de stupefiante, substanţe psihotrope sau substanţe ce le substituie, arme, substanţe explozive şi muniţii, materiale nucleare, precum şi obiecte de valoare culturală şi arheologică,

ţinînd cont de prevederile Convenţiei unice asupra stupefiantelor din 1961 şi Protocolului de modificare a acestei Convenţii din 1972, ale Convenţiei asupra substanţelor psihotrope din 1971 şi ale Convenţiei Organizaţiei Naţiunilor Unite contra traficului ilicit de stupefiante şi substanţe psihotrope din 1988,

ţinînd cont de asemenea de prevederile Convenţiilor internaţionale în vigoare ce încurajează asistenţa bilaterală reciprocă şi ale Recomandărilor Consiliului de Cooperare Vamală,

ţinînd cont de obligaţiile ce reies din calitatea Republicii Elene de membru a Uniunii Europene,

au convenit următoarele:

Articolul 1

Definiţii

În scopurile prezentului Acord:

a) “legislaţie vamală” va însemna totalitatea actelor normative şi reglementărilor aplicate de către Administraţiile Vamale ale Părţilor Contractante ce reglementează importul, exportul şi tranzitul mărfurilor, precum şi plasarea lor sub orice alt regim vamal, inclusiv măsurile de prohibiţie, restricţie şi control;

b) “Administraţie Vamală” va însemna pentru Republica Moldova – Serviciul Vamal, şi pentru Republica Elenă – Directoratul General al Vămilor şi Accizelor de pe lîngă Ministerul Economiei şi Finanţelor;

c) “încălcare a legislaţiei vamale” va însemna orice încălcare sau tentativă de încălcare a legislaţiei vamale;

d) “drepturi de import şi de export” va însemna taxele vamale şi toate alte taxe, impozitele sau alte plăţi percepute la sau în legătură cu importul sau exportul mărfurilor, dar care nu includ plăţile ce sunt limitate la cuantumul costului aproximativ al serviciilor prestate;

e) “persoană” va însemna orice persoană fizică sau juridică;

f) “date personale” va însemna toată informaţia referitoare la persoana fizică identificată sau care se identifică;

g) “stupefiante” va însemna orice substanţe, naturale sau sintetice, enumerate în Listele I şi II ale Convenţiei unice asupra stupefiantelor din 1961, cu amendamentele respective;

h) “substanţe psihotrope” va însemna orice substanţe, naturale sau sintetice, enumerate în Listele I, II, III şi IV ale Convenţiei asupra substanţelor psihotrope din 1971;

i) “Administraţie solicitată” va însemna Administraţia Vamală de la care se solicită asistenţă;

j) “Administraţie solicitantă” va însemna Administraţia Vamală care solicită asistenţă.

Articolul 2

Domeniul de aplicare a Acordului

1. În baza prezentului Acord, Părţile Contractante stabilesc asistenţa reciprocă între Administraţiile lor Vamale, în scopul prevenirii, investigaţiei şi combaterii încălcărilor legislaţiei vamale şi în vederea aplicării corecte a legislaţiei vamale.

2. Asistenţa reciprocă între Părţile Contractante se acordă în conformitate cu prevederile legislaţiei în vigoare pe teritoriul statelor sale, în limitele competenţei şi capacităţilor lor disponibile.

3. Aplicarea prezentului Acord nu va afecta obligaţiile Părţilor Contractante ce reies din orice alte tratate internaţionale la care ele sunt Părţi Contractante.

Articolul 3

Domeniul de aplicare a asistenţei reciproce

1. La solicitare, Administraţiile Vamale ale Părţilor Contractante se informează reciproc:

a) dacă mărfurile introduse pe teritoriul statului Părţii Contractante solicitante au fost scoase legal de pe teritoriul statului Părţii Contractante solicitate;

b) dacă mărfurile scoase de pe teritoriul statului Părţii Contractante solicitante au fost introduse legal pe teritoriul statului Părţii Contractante solicitate.

La solicitare, informaţia va conţine datele privind procedurile vamale utilizate la vămuirea mărfurilor.

2. Administraţia Vamală a unei Părţi Contractante, la solicitarea Administraţiei Vamale a celeilalte Părţi Contractante şi în limitele posibilităţilor sale, va prezenta informaţia referitoare la:

a) mijloacele de transport în privinţa cărora există motive întemeiate de a presupune că ele au fost utilizate, se utilizează sau pot fi utilizate la încălcarea legislaţiei vamale;

b) mărfurile cunoscute sau suspectate de către Administraţia solicitantă ca fiind obiectul activităţilor ilegale;

c) persoanele cunoscute sau suspectate de către Administraţia solicitantă ca fiind implicate în activităţi ilegale;

d) metodele şi canalele noi cunoscute sau suspectate de către Administraţia solicitantă ca fiind utilizate în activităţi ilegale.

Astfel de informaţie va fi transmisă la iniţiativa Administraţiei Vamale a unei Părţi Contractante, în cazurile cînd poate fi cauzat prejudiciu substanţial economiei, sănătăţii publice, securităţii naţionale sau oricărui alt interes vital al statului celeilalte Părţi Contractante, cum ar fi traficul ilicit de stupefiante, substanţe psihotrope sau substanţe ce le substituie, arme, substanţe explozive şi muniţii, materiale nucleare, valori arheologice, obiecte de artă şi alte valori culturale.

3. Administraţia Vamală a unei Părţi Contractante, la solicitarea Administraţiei Vamale a celeilalte Părţi Contractante, va prezenta toată informaţia disponibilă privind activităţile care pot avea ca rezultat încălcări ale legislaţiei vamale şi alte activităţi ilegale pe teritoriul statului Administraţiei solicitante.

4. Administraţiile Vamale ale Părţilor Contractante, la solicitare, vor transmite datele necesare referitoare la transportarea şi expedierea mărfurilor, cum ar fi documentele administrative, de transport şi comerciale sau orice altă informaţie privind valoarea, originea şi destinaţia acestor mărfuri.

5. Administraţiile Vamale ale Părţilor Contractante, la solicitare şi în limitele competenţei şi posibilităţilor lor, exercită supraveghere specială, într-o anumită perioadă de timp, asupra deplasării mărfurilor cunoscute sau suspectate ca fiind obiectul încălcărilor legislaţiei vamale, inclusiv asupra deplasării persoanelor şi mijloacelor de transport implicate în acestea.

Articolul 4

Canalele de comunicare

1. Asistenţa reciprocă se efectuează direct prin intermediul colaboratorilor desemnaţi de către conducerea Administraţiilor Vamale.

2. În cazul cînd Administraţia solicitată nu este competentă să execute solicitarea, aceasta va transmite solicitarea autorităţii competente.

3. Corespondenţa, conform prezentului Acord, va fi realizată în limbile oficiale ale Părţilor Contractante, în limba engleză sau în alte limbi acceptate de către Părţile Contractante.

Articolul 5

Forma şi conţinutul solicitărilor de asistenţă

1. Solicitările de asistenţă, în baza prezentului Acord, vor fi prezentate în scris. Documentele necesare pentru executarea lor vor fi anexate. Ca excepţie, în situaţii de urgenţă, pot fi acceptate solicitările verbale, însă acestea vor fi confirmate în scris cît de curînd posibil.

2. Solicitările de asistenţă vor include următoarea informaţie:

a) denumirea Administraţiei solicitante;

b) obiectul şi motivul solicitării;

c) numele şi adresele persoanelor care sunt obiectul investigaţiilor, dacă sunt cunoscute;

d) descrierea succintă a cazului în examinare şi elementele lui juridice.

Articolul 6

Executarea solicitărilor

1. Administraţia solicitată va întreprinde toate măsurile rezonabile pentru executarea solicitării. Informaţia prezentată poate fi remisă prin mijloace electronice. Informaţia va conţine explicaţiile necesare pentru interpretarea şi utilizarea acesteia.

2. Solicitările de asistenţă, transmise în baza prezentului articol, vor fi executate în conformitate cu legislaţia în vigoare pe teritoriul statului Administraţiei solicitate. În cazul cînd executarea solicitării este imposibilă, Administraţia solicitată informează Administraţia solicitantă despre aceasta.

3. Administraţia Vamală a unei Părţi Contractante, la solicitarea Administraţiei Vamale a celeilalte Părţi Contractante, poate efectua toate investigaţiile vamale necesare, inclusiv interogarea experţilor, martorilor sau persoanelor suspectate de comiterea încălcărilor legislaţiei vamale.

4. Administraţia Vamală a unei Părţi Contractante, la solicitarea Administraţiei Vamale a celeilalte Părţi Contractante, va începe verificarea, controlul şi investigaţia în scopul depistării faptelor referitoare la problemele din domeniul de aplicare a prezentului Acord, asupra cărora Administraţia solicitată este competentă.

5. Cu consimţămîntul Administraţiei solicitate, colaboratorii Administraţiei solicitante pot avea consultări cu colaboratorii pe teritoriul statului Administraţiei solicitate, în legătură cu investigaţiile vamale sau rapoartele privind încălcările legislaţiei vamale, ce prezintă interes pentru Administraţia solicitantă, şi pot examina datele respective.

6. În cazurile cînd Administraţia solicitantă remite o solicitare de asistenţă pe care ea însuşi ar fi incapabilă s-o execute, ulterior va fi la aprecierea Administraţiei solicitate să decidă asupra executării acesteia şi să informeze Administraţia solicitantă despre faptul în cauză.

Articolul 7

Confidenţialitatea

1. Datele, documentele şi altă informaţie, primite în baza prevederilor de asistenţă reciprocă, pot fi utilizate de către Partea Contractantă ce le primeşte doar în scopurile menţionate în prezentul Acord şi doar de către autorităţile competente, inclusiv folosirea acestora în procesele judiciare sau administrative. Aceste date, documente şi altă informaţie pot fi utilizate în alte scopuri de către Partea Contractantă ce le primeşte doar cu consimţămîntul Părţii Contractante ce le prezintă.

2. Datele, documentele şi altă informaţie, primite conform prezentului Acord, vor fi tratate ca confidenţiale şi nu vor fi comunicate oricărei persoane, cu excepţia cazurilor prevăzute de prezentul Acord.

3. Datelor, documentelor şi altei informaţii, transmise în baza prezentului Acord, le va fi acordat acelaşi grad de confidenţialitate, pe care Partea Contractantă ce le primeşte îl aplică în privinţa datelor, documentelor şi altei informaţii obţinute pe teritoriul statului său.

4. Prevederile punctului 2 al prezentului articol nu vor fi aplicate în cazurile referitoare la încălcările legislaţiei vamale ce ţin de stupefiante, substanţe psihotrope sau substanţe ce le substituie. Asemenea informaţie poate fi comunicată altor autorităţi ale Părţii Contractante solicitante, direct implicate în combaterea traficului ilicit de stupefiante, substanţe psihotrope sau substanţe ce le substituie.

5. În cazurile cînd potrivit prezentului Acord se efectuează schimbul datelor personale, Părţile Contractante le vor acorda aceiaşi protecţie ca şi cea aplicată de către Partea Contractantă ce le prezintă, în conformitate cu legislaţia în vigoare pe teritoriul statelor lor.

Articolul 8

Dosare şi documente

1. Originalele dosarelor, documentelor şi altor date vor fi solicitate doar în cazul cînd copiile certificate sunt insuficiente. La o solicitare specială, copiile acestor dosare, documente şi altor date vor fi certificate în modul cuvenit.

2. Dosarele, documentele şi alte date transmise vor fi restituite cît de curînd posibil.

3. Drepturile Administraţiei solicitate sau a părţilor terţe, menţionate în dosare şi documente, vor rămîne neafectate.

Articolul 9

Experţi şi martori

1. Administraţia Vamală a unei Părţi Contractante, la solicitarea Administraţiei Vamale a celeilalte Părţi Contractante, poate autoriza colaboratorii săi să participe în calitate de experţi sau martori în procesele judiciare sau administrative, ce ţin de problemele specificate în prezentul Acord, pe teritoriul statului celeilalte Părţi Contractante, şi să prezinte dosare, documente sau copiile lor certificate, în măsura în care pot fi necesare pentru aceste procese. Astfel de solicitare trebuie să specifice în faţa cărei autorităţi judiciare sau administrative urmează a fi audiat colaboratorul, asupra cărui caz, cu ce statut sau în ce calitate colaboratorul va fi audiat.

2. Administraţia solicitantă este obligată să întreprindă toate măsurile necesare pentru protecţia deplină a securităţii personale a colaboratorilor în timpul aflării lor pe teritoriul statului său, precum şi a confidenţialităţii mărturiilor, conform punctului 1 al prezentului articol. Cheltuielile de transport şi diurnele pentru aceşti colaboratori vor fi suportate de către Administraţia solicitantă.

3. Solicitarea de participare a colaboratorilor vamali în calitate de experţi şi martori va fi formulată în conformitate cu legislaţia statelor Părţilor Contractante.

Articolul 10

Excepţii de la obligaţia de a acorda asistenţă

1. În cazurile cînd Partea Contractantă solicitată consideră că executarea solicitării poate prejudicia suveranitatea, securitatea, ordinea publică sau orice alte interese esenţiale ale statului său sau poate încălca un secret industrial, comercial sau profesional, asistenţa poate fi refuzată sau acordată în funcţie de anumite condiţii şi cerinţe.

2. Asistenţa poate fi amînată, dacă există motive de a presupune că aceasta va împiedica o investigaţie, urmărire sau dezbatere judiciară demarată, în acest caz, Administraţia solicitată se va consulta cu Administraţia solicitantă pentru a determina dacă asistenţa poate fi acordată în funcţie de termenele şi condiţiile, pe care Administraţia solicitată le poate cere.

3. În cazurile cînd asistenţa este refuzată sau amînată, motivele respective vor fi comunicate Administraţiei solicitante în scris fără întîrzieri.

Articolul 11

Cheltuielile de asistenţă

Părţile Contractante renunţă reciproc la orice pretenţii privind rambursarea cheltuielilor suportate în timpul implementării prezentului Acord, cu excepţia cheltuielilor pentru martori şi plăţilor pentru experţi şi translatori, ce nu sunt funcţionari publici, care vor fi suportate de către Partea Contractantă solicitantă.

Articolul 12

Implementarea Acordului

1. Autorităţile competente privind implementarea prezentului Acord sunt Administraţiile Vamale ale Părţilor Contractante, care vor comunica direct în vederea soluţionării problemelor stipulate în prezentul Acord şi care după consultări, în caz de necesitate, vor emite dispoziţii administrative pentru implementarea lui, precum şi vor încerca să soluţioneze de comun acord problemele apărute în legătură cu interpretarea prezentului Acord sau în timpul implementării lui.

2. Părţile Contractante convin să se întrunească cel puţin o dată pe an, în scopul revizuirii implementării prezentului Acord, cu excepţia cazurilor cînd ele convin reciproc în scris că astfel de întruniri nu sunt necesare.

3. Cu consimţămîntul reciproc al Părţilor Contractante, în prezentul Acord pot fi introduse modificări şi completări. Aceste modificări şi completări vor intra în vigoare conform procedurii stabilite în articolul 14 al prezentului Acord.

Articolul 13

Aplicarea teritorială

Prezentul Acord va fi aplicabil pe teritoriile statelor ambelor Părţi Contractante în conformitate cu legislaţia lor naţională.

Articolul 14

Intrarea în vigoare şi încetarea acţiunii

1. Prezentul Acord va intra în vigoare în cea de-a treizecea zi după data în care Părţile Contractante s-au notificat reciproc, în scris, prin canale diplomatice, că toate procedurile interne necesare intrării lui în vigoare au fost îndeplinite.

2. Prezentul Acord se încheie pentru o perioadă nedeterminată de timp.

3. Acţiunea prezentului Acord va înceta la o notificare, în scris, a unei Părţi Contractante, prin canale diplomatice. În acest caz, prezentul Acord îşi va pierde valabilitatea la expirarea a şase luni după primirea notificării respective, însă procesele demarate în timpul încetării acţiunii, vor fi finisate în conformitate cu prevederile prezentului Acord.

Întocmit la Atena la 12 iunie 2007, în două exemplare originale, în limbile moldovenească, elenă şi engleză, toate textele fiind egal autentice. În cazul divergenţelor de interpretare, textul în limba engleză va fi de referinţă.

AGREEMENT

between the Government of the Republic of Moldova and

the Government of the Hellenic Republic on mutual

assistance between their customs administrations

The Government of the Republic of Moldova and the Government of the Hellenic Republic, hereinafter referred to as the Contracting Parties,

considering the importance of accurate assessment of Customs duties and other taxes and of ensuring proper enforcement by Customs Administrations of specific measures of prohibition, restriction and control,

recognizing that the offences of Customs legislation are prejudicial to the social, economic, fiscal and other interests of their countries,

confident that the reinforcement of the cooperation between their Customs Administrations will contribute to a more effective action for the prevention, investigation and suppression of the Customs offences, including the illicit traffic in narcotic drugs, psychotropic substances or substances substituted for them, arms, explosives and ammunition, nuclear material, as well as objects of cultural value and archaeological treasures,

having regard to the provisions of the Single Convention on Narcotic Drugs of 1961, amended by the Protocol of 1972, the Convention on Psychotropic Substances of 1971 and the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances of 1988,

having regard also to the provisions of the relevant international Conventions in force encouraging bilateral mutual assistance and the Recommendations of the Customs Cooperation Council,

Having regard to the obligations arising from the Hellenic Republic's membership in the European Union,

have agreed as follows:

Article 1

Definitions

For the purposes of this Agreement:

a) "Customs legislation" shall mean all legislative and regulatory provisions applied by the Customs Administrations of the Contracting Parties governing the import, export and transit of goods and their placement under any customs regime, including measures of prohibition, restriction and control;

b) "Customs Administration" shall mean for the Republic of Moldova -the Customs Service, and for the Hellenic Republic – the Directorate General of Customs and Excise at the Ministry of Economy and Finance;

c) "Customs offence" shall mean any breach or attempted breach of the Customs legislation;

d) "Customs duties and taxes" shall mean Customs duties and all other duties, taxes, fees or other charges which are collected on or in connection with the importation or exportation of goods but not including fees and charges which are limited in amount to the approximate cost of services rendered;

e) "person" shall mean either a natural person or a legal entity;

f) "personal data" shall mean all information concerning an identified or identifiable individual;

g) "narcotic drugs" shall mean any substances, natural or synthetic, enumerated in Schedules I and II of the Single Convention on Narcotic Drugs of 1961 with the relevant amendments;

h) "psychotropic substances" shall mean any substances, natural or synthetic, enumerated on the Lists I, II, III and IV of the Convention on Psychotropic Substances of 1971;

i) "requested Administration" shall mean the Customs Administration from which assistance is requested;

j) "requesting Administration" shall mean the Customs Administration which requests assistance.

Article 2

Scope of the Agreement

1. By this Agreement the Contracting Parties establish mutual assistance between their Customs Administrations for the prevention, investigation and combating of Customs offences and for the proper application of Customs legislation.

2. The mutual assistance between the Contracting Parties is provided in accordance with the provisions of the legislation in force in the territory of its States and in the framework of their competence and available resources.

3. The application of this Agreement shall not affect the obligations of the Contracting Parties under any other international Agreements in which they are Contracting Parties.

Article 3

Scope of mutual assistance

1. Upon request, the Customs Administrations of the Contracting Parties inform each other:

a) whether goods imported into the territory of the State of the requesting Contracting Party have been lawfully exported from the territory of the State of the requested Contracting Party;

b) whether goods exported from the territory of the State of the requesting Contracting Party have been lawfully imported into the territory of the State of the requested Contracting Party.

Upon request, the information shall contain the customs procedures used in the clearance of the goods.

2. The Customs Administration of one Contracting Party shall provide, upon request of the Customs Administration of the other Contracting Party and to the extent of its ability, information concerning:

a) means of transport for which there are reasonable grounds for believing that they have been, are or may be used in the contravening of Customs legislation;

b) goods known or suspected by the requesting Administration to be the object of illegal activities;

c) persons known or suspected by the requesting Administration of being involved in illegal activities;

d) new methods and channels known or suspected by the requesting Administration of being involved in illegal activities.

Such information shall be supplied, by the initiative of the Customs Administration of a Contracting Party, in cases which could involve substantial damage to the economy, public health, public security or any other vital interest of the State of the other Contracting Party, such as the illicit traffic in narcotic drugs, psychotropic substances or substances substituted for them, arms, explosives and ammunition, nuclear material, archaeological treasures, works of art or other cultural treasures.

3. The Customs Administration of one Contracting Party shall provide, upon request of the Customs Administration of the other Contracting Party all available information regarding activities which may result in Customs offences and other illegal activities within the territory of the State of the requesting Administration.

4. The Customs Administrations of the Contracting Parties shall provide upon request the necessary data relating to the transportation and shipment of goods such as administrative, shipping, commercial documents or any other information regarding the value, origin and the destination of these goods.

5. The Customs Administrations of the Contracting Parties, upon request and within the scope of their competence and capacity, exert special surveillance for a certain period of time on the movements of goods, known or suspected to be the object of Customs offences, including movements of persons and means of transport involved in them.

Article 4

Channels of communication

1. Mutual assistance is realized through direct communication between the officials designated by the Heads of the corresponding Customs Administrations.

2. In case that the requested Administration is not competent to respond to the request, it shall transmit the request to the competent authority.

3. Correspondence exchanged under this Agreement shall be conducted in the official languages of the Contracting Parties, in the English language or in other languages accepted by the Contracting Parties.

Article 5

Form and content of requests for assistance

1. Requests for assistance under this Agreement shall be submitted in writing. Documents necessary for its execution shall accompany the request. By exception, when required, because of urgency of the situation, oral requests may be accepted, but these shall be confirmed in writing, as soon as possible.

2. Requests for assistance shall include the following information:

a) the name of the requesting Administration;

b) the object and the reason of the request;

c) the names and addresses of the persons which are target of investigations, if known;

d) a brief description of the case under consideration and the relevant legal elements involved.

Article 6

Execution of requests

1. The requested Administration shall take all reasonable measures to execute the request. The provided information may be transmitted by electronic means. The transmission shall contain explanations, necessary for the interpretation and use of this information.

2. Requests for assistance submitted under this Article, shall be executed in accordance with the legislation in force in the territory of the State of the requested Administration. In case that the execution of the request is not possible, the requested Administration informs the requesting Administration in relation to that.

3. The Customs Administration of one Contracting Party may, following a request submitted by the Customs Administration of the other Contracting Party, carry out all necessary customs investigations, including the questioning of experts, witnesses or persons suspected of having committed Customs offences.

4. The Customs Administration of one Contracting Party may, following a request submitted by the Customs Administration of the other Contracting Party, proceed to verification, control and investigation in order to find out facts related to cases falling under the scope of this Agreement and for which the requested Administration is competent.

5. With the consent of the requested Administration, officials of the requesting Administration may have consultation with officials in the territory of the State of the requested Administration in relation to customs investigations or reports about Customs offences of interest to the requesting Administration and may examine the relevant data.

6. In cases where the requesting Administration submits a request for assistance which itself would be unable to execute, it shall then be to the discretion of the requested Administration to decide about its execution and inform the requesting Administration about this fact.

Article 7

Confidentiality

1. Intelligence, documents and other information received in the framework of the provisions of mutual assistance may be used by the receiving Contracting Party solely for the purposes defined in the present Agreement and only by the competent authorities, including their use in judicial or administrative proceedings. Such intelligence, documents and other information may be used by the receiving Contracting Party for other purposes only with the consent of the providing Contracting Party for that.

2. Intelligence, documents and other information received under this Agreement shall be treated as confidential and shall not be communicated to any person, except as provided for in this Agreement.

3. Intelligence, documents or other information provided on the basis of this Agreement shall be accorded the same degree of confidentiality that the receiving Contracting Party applies as regards intelligence, documents and other information obtained in its territory.

4. The provisions of paragraph 2 of this Article shall not apply to cases concerning offences relating to narcotic drugs, psychotropic substances or substances substituted for them. Such information may be communicated to other authorities of the requesting Contracting Party directly involved in combating illicit traffic in narcotic drugs, psychotropic substances or substances substituted for them.

5. In cases where personal data are exchanged under this Agreement, the Contracting Parties shall provide the same protection as that applied by the Contracting Party furnishing them, in accordance with the legislation in force in the territory of its State.

Article 8

Files and documents

1. Originals of files, documents and other data shall be requested only in case where certified copies are insufficient. Upon specific request, copies of such files, documents and other data shall be properly certified.

2. Files, documents and other data which have been transmitted shall be returned at the earliest opportunity.

3. The rights of the requested Administration or of third Parties mentioned in the files and documents shall remain unaffected.

Article 9

Experts and witnesses

1. The Customs Administration of one Contracting Party may authorize its officials, upon request of the Customs Administration of the other Contracting Party, to appear as experts or witnesses in judicial or administrative proceedings relating to the issues covered by the present Agreement in the territory of the State of the other Contracting Party and produce files, documents or certified copies there of, as may be needed for the proceedings. The request for appearance must indicate specifically before which judicial or administrative authority the official will have to appear, on what matters and by virtue of what title or qualification the official will be questioned.

2. The requesting Administration is duty bound to take all necessary measures for the full protection of the personal security of the officials during their stay in its territory and the confidentiality of the testimony, under paragraph 1 of this Article. The transport and the daily expenses of these officials shall be covered by the requesting Administration.

3. The request for appearance of Customs officials as experts and witnesses shall be made in accordance with the legislation of the States of the Contracting Parties.

Article 10

Exceptions to the obligation to provide assistance

1. In cases where the requested Contracting Party considers that execution of the request might infringe the sovereignty, security, public order or any other substantial interests of its State or violate an industrial, commercial or professional secret, assistance may be refused or provided subject to certain conditions or requirements.

2. Assistance may be postponed if there are grounds to believe that it will interfere with an ongoing investigation, prosecution or proceedings. In such a case the requested Administration shall consult with the requesting Administration to determine if assistance can be given subject to such terms or conditions as the requested Administration may require.

3. In cases where assistance is refused or postponed, the reasons for the refusal or postponement shall be given in written form to the requesting Administration without delay.

Article 11

Costs of assistance

The Contracting Parties mutually waive any claim for reimbursement of costs incurred during the implementation of this Agreement, except for expenses for witnesses and fees for experts and translators who are not government officials, which shall be covered by the requesting Contracting Party.

Article 12

Implementation of the Agreement

1. Competent authorities for the implementation of this Agreement are the Customs Administrations of the Contracting Parties which shall communicate directly in order to settle matters arising from this Agreement and which after consultations, if necessary, issue administrative directives for the implementation of this Agreement and endeavour by mutual accord to resolve problems or questions arising from its interpretation or during its implementation.

2. The Contracting Parties agree to meet at least once a year in order to review the implementation of this Agreement, unless they mutually agree, in writing, that such meetings are not necessary.

3. Upon the Contracting Parties mutual consent, amendments or additions may be introduced to this Agreement. These amendments or additions shall enter into force according to the procedure described in Article 14 of this Agreement.

Article 13

Territorial application

This Agreement shall be applicable in the territories of the States of both Contracting Parties in accordance with their national legislation.

Article 14

Entry into force and termination

1. This Agreement shall enter into force on the thirtieth day following the date on which the Contracting Parties have notified each other in writing through diplomatic channels that all internal requirements for its entry into force have been met.

2. This Agreement is concluded for an unspecified period of time.

3. This Agreement shall be terminated on written notification of one of the Contracting Parties, through diplomatic channels. In this case it shall cease to be in force six months after receipt of such notification. Ongoing proceedings at the time of termination shall nonetheless be completed in accordance with the provisions of this Agreement.

Done at Atena on June 12, 2007 in two originals, in the Moldavian, Greek and English languages, all texts being equally authentic. In case of divergence in interpretation the English text shall prevail.
