Subsemnaţii, plenipotenţiari ai Guvernelor Ţărilor-membre ale Uniunii, conform articolului 22.3 al Constituţiei Uniunii Poştale Universale adoptată la Viena la data de 10 iulie 1964, au hotărât, de comun acord şi sub rezerva articolului 25.4 din cadrul Constituţiei menţionată mai sus, în prezenta Convenţie, regulile aplicabile serviciului poştal internaţional.

Reguli comune aplicabile serviciului poştal internaţional
Articolul 1
Definiţii
1. Pentru scopurile Convenţiei poştale universale, următorii termeni sunt definiţi după cum urmează:
1.1 trimitere a poştei de scrisori: trimitere descrisă în Convenţia poştală universală şi Regulament şi transportată în condiţiile prevăzute în aceste texte;
1.2 colet poştal: trimitere descrisă în Convenţia poştală universală şi Regulament şi transportată în condiţiile prevăzute în aceste texte;
1.3 trimitere EMS: trimitere descrisă în Convenţia poştală universală, Regulament şi în instrumentele corespondente ale EMS şi transportată în condiţiile prevăzute în aceste texte;
1.4 document: trimitere a poştei de scrisori, colet poştal sau trimitere EMS constând din orice suport de informaţie scrisă, desenată, imprimată sau digitală, cu excepţia articolelor de marfă, a căror specificaţii fizice rămân în limitele precizate prin Regulament;
1.5 marfă: trimitere a poştei de scrisori, colet poştal sau trimitere EMS constând din orice obiect fizic şi material în afară de bani, inclusiv articole de marfă, ce nu se înscriu în definiţia de ”document” din art.1.4 şi a căror specificaţii fizice rămân în limitele precizate în Regulament;
1.6 depeşă închisă: sac(i) etichetat(ţi), plombat(ţi) sau sigilat(ţi), conţinând trimiteri poştale;
1.7 depeşe îndrumate greşit: recipient primit de către un birou de schimb altul decât cel indicat pe etichetă (a sacului);
1.8 date personale: informaţii necesare pentru a identifica un utilizator al serviciilor poştale;
1.9 trimiteri îndrumate greşit: trimiterile primite de către un birou de schimb, dar care au fost destinate pentru un birou de schimb într-o altă Ţară-membru;
1.10 cheltuieli de tranzit: remuneraţie pentru prestaţiile efectuate de către un organism transportator al ţării traversate (operator desemnat, alt serviciu sau combinarea celor două) privind tranzitul teritorial, maritim şi/sau aerian al trimiterilor poştei de scrisori;
1.11 cheltuieli terminale: remuneraţie datorată operatorului desemnat din ţara de destinaţie de către operatorul desemnat din ţara expeditoare cu titlu de compensare a cheltuielilor de prelucrare a trimiterilor poştei de scrisori primite în ţara de destinaţie;
1.12 operator desemnat: orice entitate guvernamentală sau neguvernamentală desemnată oficial de Ţara-membru pentru a asigura exploatarea serviciilor poştale şi a îndeplini obligaţiile aferente care decurg din actele Uniunii pe teritoriul său;
1.13 pachet mic: trimitere expediată în condiţiile Convenţiei şi ale Regulamentului;
1.14 cota-parte teritorială de sosire: remuneraţie datorată operatorului desemnat din ţara de destinaţie de către operatorul desemnat din ţara expeditoare cu titlu de compensare a cheltuielilor de prelucrare a unui colet poştal în ţara de destinaţie;
1.15 cota-parte teritorială de tranzit: remuneraţie datorată pentru prestaţiile efectuate de un organism transportator în ţara traversată (operator desemnat, alt serviciu sau combinarea celor două) privind tranzitul teritorial şi/sau aerian, pentru îndrumarea unui colet poştal pe teritoriul său;
1.16 cota-parte maritimă: remuneraţie datorată pentru prestaţiile efectuate de un organism transportator (operator desemnat, alt serviciu sau combinarea celor două) care participă la transportul maritim al unui colet poştal.
1.17 reclamaţie: plângere sau pretenţie legată de utilizarea serviciului poştal furnizat în condiţiile enunţate în Convenţie şi Regulament;
1.18 serviciu poştal universal: furnizarea permanentă către clienţi de servicii poştale de bază de calitate, în orice punct de pe teritoriul unei ţări, la preţuri accesibile;
1.19 tranzit deschis: tranzitul, printr-o ţară intermediară, a trimiterilor numărul sau greutatea cărora nu justifică formarea unei depeşe închise pentru ţara de destinaţie.
Articolul 2
Desemnarea entităţii sau entităţilor responsabile de
îndeplinirea obligaţiilor ce rezultă din aderarea la Convenţie
1. Ţările-membre notifică Biroului Internaţional, in termen de şase luni de la încheierea Congresului, numele şi adresa organismului guvernamental însărcinat să supravegheze activitatea poştală. În plus, Ţările-membre vor comunica Biroului Internaţional, în termen de şase luni de la încheierea Congresului, numele şi adresa operatorului sau operatorilor oficial desemnaţi să asigure exploatarea serviciilor poştale şi să îndeplinească obligaţiile care decurg din Actele Uniunii pe teritoriul său sau pe teritoriile lor. Între două Congrese, Ţările-membre informează Biroul Internaţional despre orice modificare referitoare la organismele guvernamentale cât mai repede posibil. Orice modificare ce vizează operatorii desemnaţi oficial, trebuie de asemenea să fie notificată Biroului Internaţional în cel mai scurt timp, şi de preferinţă cu cel puţin trei luni înainte de data de intrare în vigoare a modificărilor.
2. În cazul în care o Ţară-membră desemnează oficial un nou operator poştal, aceasta indică spectrul de servicii poştale ce vor fi asigurate de către acest operator poştal în conformitate cu Actele Uniunii, precum şi zona teritorială acoperită de către operator.
Articolul 3
Serviciul poştal universal
1. Pentru a întări conceptul de unicitate a teritoriului poştal al Uniunii, Ţările-membre veghează ca toţi utilizatorii/clienţii să se bucure de dreptul la un serviciu poştal universal care corespunde unei oferte de servicii poştale de bază de calitate, furnizate în mod permanent în orice punct de pe teritoriul lor, la tarife accesibile.
2. În acest scop, Ţările-membre stabilesc, în cadrul legislaţiei lor poştale naţionale sau prin alte mijloace uzuale, dimensiunea serviciilor poştale corespunzătoare, precum şi condiţiile de calitate şi preţuri accesibile, ţinând cont în acelaşi timp de nevoile populaţiei şi de condiţiile lor naţionale.
3. Ţările-membre veghează ca oferta de servicii poştale şi normele de calitate să fie respectate de către operatorii însărcinaţi să asigure serviciul poştal universal.
4. Ţările-membre veghează ca furnizarea serviciului poştal universal să fie asigurată într-o maniera viabilă, garantându-se astfel continuitatea lui.
Articolul 4
Libertatea de tranzit
1. Principiul libertăţii de tranzit este enunţat în primul articol al Constituţiei. El antrenează obligaţia, pentru fiecare Ţară-membru, pentru a se asigura că operatorii săi desemnaţi îndrumă permanent pe cele mai rapide căi şi prin mijloacele cele mai sigure, pe care le utilizează pentru propriile trimiteri, depeşele închise şi trimiterile poştei de scrisori expediate în tranzit deschis, care îi sunt predate de către un alt operator desemnat. Acest principiu se aplică de asemenea trimiterilor direcţionate greşit şi depeşelor îndrumate greşit.
2. Ţările-membre, care nu participă la schimbul de trimiteri poştale conţinând substanţe infecţioase sau materii radioactive, au posibilitatea să nu admită aceste trimiteri în tranzit deschis să traverseze teritoriul lor. Aceasta se aplică de asemenea imprimatelor, periodicelor, revistelor, pachetelor mici şi sacilor M al căror conţinut nu îndeplineşte dispoziţiile legale care reglementează condiţiile publicării lor sau circulaţiei lor în ţara traversată.
3. Libertatea de tranzit a coletelor este garantată pe întreg teritoriu al Uniunii.
4. Dacă o Ţară-membru nu respectă dispoziţiile referitoare la libertatea de tranzit, celelalte Ţări-membre au dreptul să înceteze prestarea serviciilor poştale cu această Ţară-membru.
Articolul 5
Apartenenţa trimiterilor poştale. Retragerea. Modificarea sau corectarea
adresei şi/sau a numelui persoanei fizice, a numelui, prenumelui sau, după caz,
a patronimicului destinatarului. Reexpedierea. Returnarea către expeditor a
trimiterilor ce nu au fost distribuite
1. Orice trimitere poştală aparţine expeditorului atâta timp cât nu a fost distribuită celui în drept, cu excepţia cazului în care trimiterea a fost reţinută prin aplicarea legislaţiei naţionale a ţării de origine sau destinaţie şi, in cazul aplicării articolului 19.2.1.1 sau 19.3, în conformitate cu legislaţia naţională a ţării de tranzit.
2. Expeditorul unei trimiteri poştale poate să o retragă din serviciu, sau poate să modifice sau să corecteze adresa şi/sau a numele persoanei fizice, a numele, prenumele sau, după caz, a patronimicul destinatarului. Taxele şi celelalte condiţii sunt prevăzute în Regulament.
3. Ţările-membre se asigură că operatorii lor desemnaţi reexpediază trimiterile poştale, în cazul în care adresa destinatarului s-a schimbat, şi returnează către expeditor trimiterile ce nu au fost distribuite. Taxele şi celelalte condiţii sunt prevăzute în Regulament.
Articolul 6
Mărci poştale
1. Termenul “marcă poştală” este protejat in virtutea prezentei Convenţii şi este rezervat exclusiv mărcilor ce îndeplinesc condiţiile acestui articol şi ale Regulamentului.
2. Marca poştală:
2.1 este emisă şi pusă în circulaţie exclusiv de autoritatea Ţării-membru sau a teritoriului, în conformitate cu Actele Uniunii;
2.2 este un atribut al suveranităţii şi constituie o dovadă a plăţii francării corespunzătoare valorii sale intrinsecă, atunci când este aplicată pe o trimitere poştală în conformitate cu Actele Uniunii;
2.3 trebuie să fie în circulaţie în Ţara-membru sau în teritoriul emitent, pentru o utilizare în scopul francării poştale sau în scop filatelic, în conformitate cu legislaţia sa naţională;
2.4 trebuie să fie accesibilă tuturor locuitorilor din Ţara-membru sau din teritoriul emitent.
3. Marca poştală include:
3.1 numele Ţării-membru sau al teritoriului emitent, în caractere latine1, sau, la cererea Ţării-membre sau a teritoriului emitent către Biroul Internaţional, un acronim sau iniţialele ce reprezintă oficial Ţara-membră sau teritoriul emitent, în conformitate cu condiţiile specificate în Regulamentul Convenţiei;
3.2 valoarea nominală exprimată:
3.2.1 în principiu, în moneda oficială a Ţării-membru sau a teritoriului emitent, sau prezentată în forma unei litere sau a unui simbol;
3.2.2 prin alte semne de identificare specifică.
4. Stemele de Stat, semnele oficiale de control şi emblemele organizaţiilor interguvernamentale care figurează pe mărcile poştale sunt protejate conform Convenţiei de la Paris pentru protecţia proprietăţii industriale.
5. Subiectele şi motivele mărcilor poştale trebuie:
5.1 să fie în conformitate cu spiritul din preambulul la Constituţia Uniunii şi a deciziilor luate de către organele Uniunii;
5.2 să fie în strânsă legătură cu identitatea culturală a Ţării-membru sau a teritoriului sau să contribuie la promovarea culturii sau la menţinerea păcii;
5.3 să aibă, în cazul comemorării personalităţilor sau evenimentelor străine în Ţara-membru sau teritoriu, o legătură directă cu respectiva Ţară-membru sau teritoriu;
5.4 sa fie lipsite de caracter politic sau ofensator pentru o personalitate sau o ţară;
5.5 sa aibă o semnificaţie importantă pentru Ţara-membru sau pentru teritoriu.
6. Semnele francării poştale, amprentele maşinilor de francare şi amprentele preselor de tipografie sau ale altor procedee tipografice sau de ştampilare conforme cu Actele Uniunii, nu pot fi utilizate decât cu autorizaţia Ţării-membru sau a teritoriului.
7. Înainte de emiterea mărcilor poştale, folosind materiale şi tehnologii noi, Ţările-membre trebuie să furnizeze Biroului Internaţional informaţiile necesare cu privire la compatibilitatea acestora cu funcţionarea maşinilor destinate prelucrării poştei. Biroul Internaţional va informa despre aceasta celelalte Ţări-membre şi operatorii lor desemnaţi.
Articolul 7
Dezvoltare durabilă
1. Ţările-membre şi/sau operatorii lor desemnaţi trebuie să adopte şi să pună în practică o strategie de dezvoltare durabilă dinamică în special cu toate acţiunile de mediu, sociale şi economice la toate nivelele de exploatare poştală şi să promoveze sensibilizarea faţă de problemele de dezvoltare durabilă.
Articolul 8
Securitatea poştală
1. Ţările-membre şi operatorii lor desemnaţi trebuie să se conformeze cerinţelor în materie de securitate, definite în standardele de securitate ale Uniunii Poştale Universale şi să adopte şi să pună în aplicare o strategie de acţiune în materie de securitate, la toate nivelele exploatării poştale, pentru a păstra şi a creşte încrederea publicului în serviciile poştale furnizate de operatorii desemnaţi, şi în interesul tuturor agenţilor implicaţi. Această strategie include obiectivele definite în Regulament precum şi principiul de conformare cu cerinţele referitoare la furnizarea de date electronice prealabile pentru trimiterile poştale identificate în dispoziţiile de punere în aplicare a prevederilor (inclusiv tipul trimiterilor poştale implicate şi criteriile de identificare ale acestora), adoptate de către Consiliul de Administraţie şi Consiliul de Exploatare Poştală, în conformitate cu standardele tehnice ale UPU despre schimbul de mesaje. Această strategie include, de asemenea, schimbul de informaţii referitoare la menţinerea siguranţei şi securităţii de transportare şi de tranzit a depeşelor între Ţările-membre şi operatorii lor desemnaţi.
2. Toate măsurile de securitate aplicate în cadrul lanţului internaţional de transport poştal trebuie să fie proporţionale riscurilor sau ameninţărilor contra cărora ele sunt îndreptate, şi trebuie să fie puse în aplicare fără împiedicarea fluxurilor de poştă sau a comerţului mondial, luând în considerare caracteristicile specifice ale reţelei poştale. Măsurile de securitate care au un impact potenţial global asupra operaţiunilor poştale trebuie să fie implementate într-o manieră coordonată şi echilibrată pe plan internaţional, cu implicarea tuturor părţilor interesate.
Articolul 9
Infracţiuni
1. Trimiteri poştale
1.1 Ţările-membre se angajează să ia toate măsurile necesare pentru a preveni actele de mai jos şi pentru a urmări şi pedepsi pe autorii lor:
1.1.1 introducerea în trimiterile poştale de stupefiante, substanţe psihotrope sau mărfuri periculoase, neautorizate în mod expres de Convenţie şi de Regulament;
1.1.2 introducerea în trimiterile poştale de obiecte cu caracter pedofil sau pornografic reprezentând copii.
2. Francarea în general şi mijloacele de francare în particular.
2.1 Ţările-membre se angajează să ia toate măsurile necesare pentru a preveni, reprima şi pedepsi infracţiunile referitoare la mijloacele de francare prevăzute în prezenta Convenţie, respectiv:
2.1.1 mărcile poştale, în circulaţie sau retrase din circulaţie;
2.1.2 semnele de francare poştală;
2.1.3 amprentele maşinilor de francare sau ale preselor de tipografie;
2.1.4 cupoanele-răspuns internaţionale.
2.2 În scopurile prezentei Convenţii, prin infracţiune referitoare la mijloacele de francare se înţelege unul dintre actele de mai jos, comise de orice persoană care n-ar fi, cu intenţia de a obţine un câştig ilegal pentru autorul actului sau pentru o terţă persoană. Trebuie pedepsite:
2.2.1 falsificarea, imitarea sau contrafacerea mijloacelor de francare, sau orice act ilicit sau care constituie un delict, legat de fabricarea lor neautorizată;
2.2.2 fabricarea, utilizarea, punerea în circulaţie, comercializarea, distribuirea, difuzarea, transportul, prezentarea sau expunerea (inclusiv sub formă de cataloage sau în scopuri publicitare) de mijloace de francare falsificate, imitate sau contrafăcute;
2.2.3 utilizarea sau punerea în circulaţie în scopuri poştale de mijloace de francare deja utilizate;
2.2.4 tentativele care vizează comiterea uneia dintre infracţiunile prezentate mai sus.
3. Reciprocitate
3.1 În ceea ce priveşte sancţiunile, nici o distincţie nu va fi făcută între actele prevăzute la paragraful 2, fie că este vorba despre mijloace de francare naţionale sau străine; această dispoziţie nu poate fi supusă nici unei condiţii de reciprocitate legală sau convenţională.
Articolul 10
Prelucrarea datelor cu caracter personal
1. Datele cu caracter personal referitoare la utilizatori pot fi folosite numai în scopul pentru care au fost acumulate, în conformitate cu legislaţia naţională aplicabilă.
2. Datele cu caracter personal referitoare la utilizatori vor fi divulgate numai terţilor autorizaţi de legislaţia naţională aplicabilă pentru a le accesa.
3. Ţările-membre şi operatorii lor desemnaţi trebuie să asigure confidenţialitatea şi securitatea datelor cu caracter personal referitoare la utilizatori, în conformitate cu legislaţia lor naţională.
4. Operatorii desemnaţi informează clienţii săi despre utilizarea datelor lor cu caracter personal şi de scopul pentru care au fost colectate.
5. Fără prejudiciu la ceea ce precedă, operatorii desemnaţi pot transfera electronic date personale operatorilor desemnaţi ai ţărilor de destinaţie sau de tranzit, care au nevoie de aceste date pentru a asigura serviciul lor.
Articolul 11
Schimbul de depeşe închise cu unităţile militare
1. Depeşele închise ale poştei de scrisori pot fi schimbate prin intermediul serviciilor teritoriale, maritime sau aeriene ale altor ţari:
1.1 între oficiile poştale ale uneia dintre Ţările-membre şi comandanţii unităţilor militare puse la dispoziţia Organizaţia Naţiunilor Unite;
1.2 între comandanţii acestor unităţi militare;
1.3 între oficiile poştale ale uneia dintre Ţările-membre şi comandanţii diviziilor navale, aeriene sau terestre, de nave de război sau de avioane militare ale aceleiaşi ţări staţionate în străinătate;
1.4 între comandanţii de divizii navale, aeriene sau terestre, de nave de război sau de avioane militare ale aceleiaşi ţări.
2. Trimiterile poştei de scrisori cuprinse în depeşele vizate la paragraful 1 trebuie să fie exclusiv pe adresa sau provenite de la membrii unităţilor militare sau ai statelor majore şi echipajelor de vapoare sau avioane de destinaţie sau expeditori ai depeşelor. Tarifele şi condiţiile de expediere la care sunt supuse sunt determinate, conform propriei reglementări, de câtre operatorul desemnat al Ţării-membru care a pus la dispoziţie unitatea militară sau căreia îi aparţin navele sau avioanele.
3. Cu excepţia unei înţelegeri speciale, operatorul desemnat al Ţării-membru care a pus la dispoziţie unitatea militară sau căreia îi aparţin vapoarele de război sau avioanele militare este datoare, faţă de operatorii desemnaţi implicaţi, pentru cheltuielile de tranzit al depeşelor, cheltuielile terminale şi cheltuielile de transport aerian.
Articolul 12
Depunerea în străinătate a trimiterilor poştei de scrisori
1. Nici un operator desemnat nu este obligat să îndrume, nici să distribuie destinatarilor trimiterile poştei de scrisori pe care expeditorii rezidenţi pe teritoriul Ţării-membru le depun sau fac să fie depuse într-o ţară străină, cu scopul de a beneficia de condiţiile tarifare mai favorabile care sunt aplicabile acolo.
2. Dispoziţiile prevăzute la paragraful 1 se aplică fără distincţie fie trimiterilor poştei de scrisori pregătite în ţara de rezidenţă a expeditorului şi transportate apoi peste frontieră, fie trimiterilor poştei de scrisori confecţionate într-o ţară străină.
3. Operatorul desemnat de destinaţie are dreptul să solicite operatorului desemnat de depunere plata tarifelor sale interne. Dacă operatorul desemnat de depunere nu acceptă să plătească aceste tarife într-un termen fixat de către operatorul desemnat de destinaţie, acesta poate fie să returneze trimiterile operatorului desemnat de depunere, având dreptul să-i fie rambursate cheltuielile de retur, fie să le trateze conform legislaţiei naţionale.
4. Nici un operator desemnat nu este obligat nici să îndrume nici să distribuie destinatarilor trimiterile poştei de scrisori pe care expeditorii le-au depus sau au făcut să fie depuse în cantitate mare în altă ţară decât aceea în care sunt rezidenţi dacă valoarea cheltuielilor terminale de încasat se dovedeşte mai mică decât aceea care ar fi trebuit încasată în cazul în care trimiterile ar fi fost depuse în ţara de rezidenţă a expeditorului. Operatorii desemnaţi de destinaţie au dreptul de a cere operatorului desemnat de depunere o remuneraţie în raport cu costurile suportate, ce nu va putea fi superioară valorii celei mai ridicate din următoarele două formule: fie 80% din tariful intern aplicabil trimiterilor echivalente, fie ratele aplicabile în virtutea articolelor 29.5 - 29.11, 29.12 – 29.15 sau 30.9, după caz. Dacă operatorul desemnat de depunere nu acceptă să plătească suma reclamată, într-un termen fixat de către operatorul desemnat de destinaţie, acesta poate fie să returneze trimiterile operatorului desemnat de depunere având dreptul să-i fie rambursate cheltuielile de retur, fie să le trateze conform legislaţiei naţionale.
Articolul 13
Utilizarea formularelor UPU
1. Cu excepţia cazurilor prevăzute în Actele Uniunii, doar operatorii desemnaţi ai Ţărilor-membre ale Uniunii utilizează formularele şi documentele UPU pentru exploatarea serviciilor poştale şi pentru schimbul de trimiteri poştale în conformitate cu Actele Uniunii.
2. Operatorii desemnaţi pot utiliza formularele şi documentele UPU pentru exploatarea birourilor de schimb extrateritoriale precum şi a centrelor de prelucrare a poştei internaţionale stabilite de către operatorii desemnaţi în afara teritoriului lor naţional respectiv, după cum este definit în paragraful 6, pentru facilitarea exploatării serviciilor poştale şi a schimbului de trimiteri poştale susmenţionate.
3. Exercitarea posibilităţii expuse în paragraful 2 este supusă legislaţiei sau politicii naţionale a Ţării-membre sau a teritoriului în care biroul de schimb extrateritorial sau centrul de prelucrare a poştei internaţional este stabilit. În acest sens, şi fără a prejudicia obligaţiunile de desemnare enunţate în articolul 2, operatorii desemnaţi garantează executarea continuă a obligaţiunilor lor înscrise în Convenţie şi sunt deplin responsabili de toate relaţiile lor cu alţi operatori desemnaţi şi cu Biroul Internaţional.
4. Cerinţa enunţată în paragraful 3 se aplică de asemenea faţă de Ţara-membră de destinaţie pentru acceptarea trimiterilor poştale ce provin din astfel de birouri de schimb extrateritoriale şi din centre de prelucrare a poştei internaţionale.
5. Ţările-membre informează Biroul Internaţional despre politica lor cu referire la trimiterile poştale expediate şi/sau recepţionate prin intermediul birourilor de schimb extrateritoriale şi a centrelor de prelucrare a poştei internaţionale. Aceste informaţii sunt pusă la dispoziţie pe pagina web a Uniunii.
6. Exclusiv în scopurile prezentului articol, prin birou de schimb extrateritorial se înţelege un birou sau o instituţie stabilită în scopuri comerciale şi exploatată de un operator desemnat sau cu responsabilităţi de operator desemnat pe teritoriul unei Ţări-membre sau pe un teritoriu diferit decât cel al operatorului desemnat cu scopul de a obţine clientela de pe piaţa situată în afara propriului teritoriu naţional. Prin centru de prelucrare a poştei internaţionale se înţelege o instituţie pentru prelucrarea poştei internaţionale destinată prelucrării poştei internaţionale schimbate, fie pentru confecţionarea ori recepţionarea depeşelor poştale, fie pentru a fi oficiată în calitate de centru de tranzit pentru poşta internaţională schimbată între alţi operatori desemnaţi.
7. Nimic în acest articol nu poate fi interpretat ca implicând faptul că birourile de schimb extrateritoriale sau centrele de prelucrare a poştei internaţionale (inclusiv operatorii desemnaţi responsabili de stabilirea şi de exploatarea acestora în afara teritoriilor lor respective naţionale) se află în aceeaşi situaţie vis-a-vis de Actele Uniunii ca şi operatorii desemnaţi a ţării gazdă, ori ca impunând altor Ţări-membre o obligaţie legală de a recunoaşte aceste birouri de schimb extrateritoriale sau aceste centre de prelucrare a poştei internaţionale drept operatori desemnaţi pe teritoriul unde acestea sunt stabilite şi operează.
Partea a doua
Norme şi obiective în materie de calitate a serviciului
Articolul 14
1. Ţările-membre sau operatorii lor desemnaţi trebuie să fixeze şi să publice normele şi obiectivele lor in materie de distribuire a trimiterilor poştei de scrisori şi coletelor de intrare.
2. Aceste norme şi obiective, mărite cu timpul cerut în mod normal pentru vămuire, nu trebuie să fie mai puţin favorabile decât cele aplicate trimiterilor comparabile din serviciul lor intern.
3. Ţările-membre sau operatorii lor desemnaţi de origine trebuie de asemenea să fixeze şi să publice normele în totalitate pentru trimiterile prioritare şi trimiterile-avion ale poştei de scrisori cât şi pentru coletele şi coletele economice/de suprafaţă.
4. Ţările-membre sau operatorii lor desemnaţi evaluează aplicarea normelor privind calitatea serviciului.
Partea a treia
Taxe, suprataxe şi scutirea de taxe poştale
Articolul 15
Taxe
1. Taxele referitoare la diferite servicii poştale definite în Convenţie sunt fixate de către Ţările-membre sau operatorii lor desemnaţi, în funcţie de legislaţia naţională şi în conformitate cu principiile enunţate în Convenţie şi în Regulamentul său. Ele trebuie în principiu să fie corelate cu costurile aferente furnizării acestor servicii.
2. Ţara-membru de origine sau operatorul ei desemnat fixează, în funcţie de legislaţia naţională, taxele de francare pentru transportul trimiterilor poştei de scrisorii şi a coletelor poştale. Taxele de francare cuprind distribuirea trimiterilor la domiciliul destinatarilor, dacă acest serviciu de distribuire este organizat în ţara de destinaţie pentru trimiterile în cauză.
3. Taxele aplicate, inclusiv cele menţionate cu titlu indicativ în Acte, trebuie să fie cel puţin egale cu cele aplicate trimiterilor din regimul intern care prezintă aceleaşi caracteristici (categorie, cantitate, timp de îndrumare, etc.).
4. Ţările-membre sau operatorii lor desemnaţi, în funcţie de legislaţia naţională, sunt autorizate să depăşească toate taxele indicative care figurează în Acte.
5. Peste limita minimă a taxelor fixate în paragraful 3, Ţările-membre sau operatorii lor desemnaţi au posibilitatea de a acorda taxe reduse bazate pe legislaţia lor naţională pentru trimiterile din categoria poştei de scrisori şi pentru coletele poştale depuse pe teritoriul Ţării-membru. Ele au mai ales posibilitatea de a acorda tarife preferenţiale clienţilor lor care au un trafic poştal important.
6. Este interzis să se perceapă de la clienţi taxe poştale de indiferent ce natură altele decât cele care sunt prevăzute în Acte.
7. În afara cazurilor prevăzute în Acte, fiecare operator desemnat păstrează taxele pe care el le-a perceput.
Articolul 16
Scutirea de taxe poştale
1. Principiu
1.1 Cazurile de scutire de taxe poştale, ca scutire de la plata de francare, sunt prevăzute în mod expres în Convenţie. Cu toate acestea, Regulamentul poate fixa dispoziţii care prevăd scutirea de la plata francării, de la plata taxelor de tranzit, a cheltuielilor terminale şi a cotelor-părţi de sosire pentru trimiterile poştei de scrisori şi coletele poştale expediate de către Ţările-membre, operatorii desemnaţi şi Uniunile restrânse şi referitoare la serviciile poştale. În plus, trimiterile poştei de scrisori şi colete poştale expediate de către Biroul Internaţional al UPU cu destinaţia către Uniunile restrânse, Ţările-membre şi operatorii desemnaţi sunt scutite de toate taxele poştale. Totuşi, Ţara-membru de origine sau operatorul ei desemnat are posibilitatea de a percepe suprataxe aeriene pentru aceste ultime trimiteri.
2. Prizonieri de război şi internaţii civili
2.1 Sunt scutite de toate taxele poştale, cu excepţia suprataxelor aeriene, trimiterile poştei de scrisori, coletele poştale şi trimiterile serviciilor poştale de plată adresate prizonierilor de război sau expediate de către aceştia, fie direct, fie prin intermediul birourilor menţionate în Regulamentele Convenţiei şi ale Acordului privind serviciile poştale de plată. Beligeranţii primiţi şi internaţii într-o ţară neutră sunt asimilaţi prizonierilor de război propriu-zişi în ceea ce priveşte aplicarea dispoziţiilor precedente.
2.2 Dispoziţiile prevăzute la paragraful 2.1 se aplică şi trimiterilor poştei de scrisori, coletelor poştale şi trimiterilor serviciilor poştale de plată provenind din alte ţări, adresate persoanelor civile internate prevăzute de Convenţia de la Geneva din data de 12 august 1949 referitoare la protecţia persoanelor civile în timp de război, sau expediate de către ele fie direct, fie prin intermediul birourilor menţionate în Regulamentele Convenţiei şi Aranjamentului privind serviciile poştale de plată.
2.3 Birourile menţionate în Regulamentele Convenţiei şi Aranjamentului privind serviciile poştale de plată beneficiază de asemenea şi de scutire de taxe poştale pentru trimiterile poştei de scrisori, coletele poştale şi trimiterile serviciilor poştale de plată în ceea ce priveşte persoanele vizate la punctele 2.1 şi 2.2, care le expediază sau le primesc, fie direct, fie cu titlu de intermediari.
2.4 Coletele sunt admise cu scutire de taxe poştale până la greutatea de 5 kilograme. Limita de greutate este extinsă la 10 kilograme pentru trimiterile al căror conţinut este indivizibil şi pentru cele care sunt adresate unui lagăr sau oamenilor săi de încredere pentru a fi distribuite prizonierilor.
2.5 In cadrul reglării conturilor între operatorii desemnaţi, coletele de serviciu şi coletele pentru prizonierii de război şi internaţii civil nu determină alocarea vreunei cote-părţi, excepţie făcând taxele de transport aerian aplicabile coletelor-avion.
3. Trimiterile pentru nevăzători
3.1 Toate trimiterile pentru nevăzători, expediate către sau de către o organizaţie pentru persoane nevăzătoare sau expediate către sau de către o persoană nevăzătoare, sunt scutite de toate taxele poştale, cu excepţia suprataxelor aeriene, în măsura în care aceste trimiteri sunt admisibile în serviciul intern al operatorului desemnat de origine.
3.2 In prezentul articol:
3.2.1 termenul “persoană nevăzătoare” înseamnă o persoană care este înregistrată în ţara sa ca orb sau parţial văzător sau care îndeplineşte definiţia unei persoane oarbe sau unei persoane cu vedere slabă a Organizaţiei Mondiale a Sănătăţii;
3.2.2 o organizaţie pentru persoane nevăzătoare înseamnă o instituţie sau asociaţie care deserveşte sau care reprezintă oficial persoanele nevăzătoare;
3.2.3 trimiterile pentru nevăzători includ corespondenta, publicaţie în orice format (inclusiv înregistrări audio) şi orice echipament sau material produs sau adaptat pentru a ajuta persoanele nevăzătoare în depăşirea problemelor care decurg din orbirea lor, aşa cum se specifică în Regulament.

Servicii de bază şi servicii suplimentare
Articolul 17
Servicii de bază
1. Ţările-membre trebuie să vegheze ca operatorii lor desemnaţi să asigure acceptarea, prelucrarea, transportul şi distribuirea trimiterilor poştei de scrisori.
2. Trimiterile poştei de scrisori ce conţin doar documente includ:
2.1 trimiteri prioritare şi non-prioritare până la 2 kilograme;
2.2 scrisori, cărţi poştale şi imprimate până la 2 kilograme;
2.3 trimiterile pentru nevăzători până la 7 kilograme;
2.4 saci speciali conţinând ziare, publicaţii periodice, cărţi şi documente tipărite similar, pe adresa aceluiaşi destinatar şi aceleiaşi destinaţii, denumiţi “saci M”, cu greutatea de până la 30 de kilograme.
3. Trimiterile poştei de scrisori conţinând marfă cuprind:
3.1 pachete mici prioritare şi neprioritare până la 2 kilograme.
4. Trimiterile poştei de scrisori sunt clasificate în acelaşi timp în funcţie de rapiditatea prelucrării lor şi în funcţie de conţinutul lor, conform Regulamentului.
5. În cadrul sistemelor de clasificare prevăzute la articolul 4, trimiterile poştei de scrisori pot fi, de asemenea, clasificate în funcţie de formatul lor ca scrisori de format mic (P), scrisori de format mare (G), scrisori de format voluminos (E) sau pachetele mici (E). Limitele de mărime şi greutate sunt specificate în Regulament.
6. Limite de greutate superioare celor indicate în paragraful 2 se aplică facultativ anumitor categorii de trimiteri ale poştei de scrisori, în condiţiile specificate de Regulament.
7. Ţările-membre trebuie, de asemenea, să vegheze că operatorii lor desemnaţi asigură acceptarea, prelucrarea, transportul şi distribuirea coletelor poştale până la 20 de kilograme.
8. Limitele de greutate superioară a 20 de kilograme se aplică facultativ anumitor categorii de colete poştale, în condiţiile specificate de Regulament.
Articolul 18
Servicii suplimentare
1. Ţările-membre asigură prestarea de servicii suplimentare obligatorii, după cum urmează:
1.1 serviciu de recomandare pentru trimiterile-avion şi trimiterile prioritare de ieşire ale poştei de scrisori;
1.2 serviciu de recomandare pentru toate trimiterile poştei de scrisori recomandate de intrare.
2. Ţările-membre sau operatorii lor desemnaţi pot asigura următoarele servicii suplimentare facultative în cadrul relaţiilor dintre operatorii desemnaţi care au convenit să asigure aceste servicii:
2.1 serviciul de trimiteri cu valoare declarată pentru trimiterile poştei de scrisori şi colete;
2.2 serviciul de trimiteri contra ramburs pentru trimiterile poştei de scrisori şi colete;
2.3 serviciul de distribuire cu urmărire pentru trimiterile poştei de scrisori;
2.4 serviciul de predare în mână proprie pentru trimiterile recomandate ale poştei de scrisori sau trimiterile cu valoare declarată;
2.5 serviciul de distribuire a trimiterilor scutite de taxe şi comisioane pentru trimiterile poştei de scrisori şi colete;
2.6 serviciul de colete fragile şi colete voluminoase;
2.7 serviciul de trimiteri grupate “Consignaţie” pentru trimiterile grupate de la un singur expeditor destinate în străinătate;
2.8 serviciul de returnare a mărfurilor, care înseamnă returnarea mărfurilor de către destinatar expeditorului ţării de origine cu autorizarea acestuia din urmă.
3. Următoarele trei servicii suplimentare au şi aspecte obligatorii şi aspecte facultative:
3.1 serviciul de corespondentă comercială-răspuns internaţională (CCRI), care este în esenţă facultativ; dar toate Ţările-membre sau operatorii lor desemnaţi sunt obligaţi de a asigura serviciul de retur pentru trimiterile CCRI;
3.2 serviciul de cupoane-răspuns internaţionale; aceste cupoane pot fi schimbate în orice Ţară-membru, dar vânzarea lor este facultativă;
3.3 confirmare de primire pentru trimiterile poştei de scrisori recomandate, colete şi trimiterile cu valoare declarată; toate Ţările-membre sau operatorii lor desemnaţi acceptă confirmările de primire pentru trimiterile de intrare; totuşi, prestarea unui serviciu de confirmare de primire pentru trimiterile de ieşire este facultativă.
4. Aceste servicii şi taxele corespunzătoare sunt descrise în Regulament.
5. Daca elementele serviciilor indicate mai jos fac obiectul unor taxe speciale în regimul intern, operatorii desemnaţi sunt autorizaţi sa perceapă aceleaşi taxe pentru trimiterile internaţionale, în condiţiile descrise în Regulament:
5.1 distribuirea pachetelor mici cu greutatea mai mare de 500 de grame;
5.2 depunerea de trimiteri ale poştei de scrisori după ultimă limită de oră;
5.3 depunerea de trimiteri în afara orelor de program al ghişeelor;
5.4 colectarea trimiterilor la domiciliul expeditorului;
5.5 retragerea unei trimiteri a poştei de scrisori în afara orelor de program al ghişeelor;
5.6 post restant;
5.7 magazinajul trimiterilor poştei de scrisori cu greutatea mai mare de 500 de grame (cu excepţia trimiterilor pentru nevăzători) şi al coletelor poştale;
5.8 livrarea coletelor ca răspuns la avizul de sosire;
5.9 asigurarea împotriva riscurilor de forţă majoră;
5.10 livrarea trimiterilor poştei de scrisori în afara orelor de program al ghişeelor.
Partea a cincea
Interdicţii şi chestiuni vamale
Articolul 19
Trimiteri neadmise. Interdicţii
1. Dispoziţii generale
1.1 Trimiterile care nu îndeplinesc condiţiile cerute de Convenţie şi Regulament nu sunt admise. Trimiterile expediate în vederea unui act fraudulos sau cu intenţia de neplată integrală a sumelor datorate, nu sunt admise.
1.2 Excepţiile de la interdicţiile anunţate de prezentul articol sunt prevăzute în Regulament.
1.3 Toate Ţările-membre sau operatorii lor desemnaţi au posibilitatea extinderii interdicţiilor enunţate în prezentul articol, care pot fi aplicate imediat după includerea lor în culegerea de acte corespunzătoare.
2. Interdicţii care vizează toate categoriile de trimiteri
2.1 Introducerea obiectelor menţionate mai jos este interzisă în toate categoriile de trimiteri:
2.1.1 stupefiante şi substanţe psihotrope, astfel cum sunt definite de către Organul Internaţional de Control al Stupefiantelor (OICS), sau alte droguri ilicite interzise în ţara de destinaţie;
2.1.2 obiectele obscene sau imorale;
2.1.3 obiecte contrafăcute şi piratate;
2.1.4 alte obiecte de import sau circulaţie care sunt interzise în ţara de destinaţie;
2.1.5 obiecte care, prin natura lor sau a ambalajului lor, pot prezenta pericol pentru agenţi sau marele public, pot păta sau deteriora celelalte trimiteri, echipamentul poştal sau bunurile care aparţin terţilor;
2.1.6 documentele ce au caracter de corespondenţă actuală şi personală schimbate între persoane altele decât expeditorul şi destinatarul sau persoanele care locuiesc cu aceştia;
3. Mărfuri periculoase
3.1 Introducerea de mărfuri periculoase descrise în Convenţie şi Regulament este interzisă în toate categoriile de trimiteri.
3.2 Introducerea de dispozitive explozive şi echipamente militare inerte, inclusiv grenade inerte, obuze inerte şi alte articole analogice, precum şi replicile de astfel de dispozitive şi articole, este interzisă în toate categoriile de trimiteri.
3.3 In mod excepţional, mărfurile periculoase pot fi admise în schimbul dintre Ţările membre ce se declară de acord pentru a le admite fie pe bază reciprocă, fie într-o singură direcţie, cu condiţia că regulile şi regulamentele naţionale şi internaţionale în domeniul transportării să fie respectate.
4. Animale vii
4.1 Introducerea de animale vii este interzisă în toate categoriile de trimiteri.
4.2 In mod excepţional, animalele menţionate mai jos sunt admise în trimiterile poştei de scrisori altele decât trimiterile cu valoare declarată:
4.2.1 albinele, lipitoarele şi viermii de mătase;
4.2.2 paraziţii şi distrugătorii de insecte nocive destinaţi controlului acestor insecte şi schimbului între instituţiile oficial recunoscute;
4.2.3 muştele din familia drosophilidae utilizate pentru cercetarea biomedicală şi schimbate între instituţii recunoscute oficial;
4.3 In mod excepţional, următoarele animale vor fi admise în colete:
4.3.1 animalele vii al căror transport prin poştă este autorizat prin regulamentele poştale şi legislaţia naţională a ţărilor interesate.
5. Introducerea corespondenţei în colete
5.1 Introducerea obiectelor menţionate mai jos este interzisă în coletele poştale:
5.1.1 corespondenţa, cu excepţia materialelor arhivate, schimbată între persoane altele decât expeditorul şi destinatarul sau persoanele ce locuiesc cu aceştia.
6. Monede, bancnote şi alte obiecte de valoare
6.1 Este interzisă introducerea de monede, bancnote, bilete de credit sau valori la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase, bijuterii şi alte obiecte preţioase:
6.1.1 în trimiterile poştei de scrisori fără valoare declarată;
6.1.1.1 totuşi, dacă legislaţia naţională a ţării de origine şi de destinaţie permite, aceste obiecte pot fi expediate într-un plic închis ca trimiteri recomandate;
6.1.2 în coletele fără valoare declarată, cu excepţia cazului în care legislaţia naţională a ţărilor de origine şi destinaţie o permite;
6.1.3 în coletele fără valoare declarată schimbate între două ţări care admit declaraţia de valoare;
6.1.3.1 în plus, fiecare Ţară-membru sau operator desemnat are dreptul să interzică introducerea de lingouri de aur în coletele cu sau fără valoare declarată, care provin din sau au ca destinaţie teritoriul său sau transmise în tranzit deschis prin teritoriul său; el poate limita valoarea reală a acestor trimiteri.
7. Imprimate şi trimiteri pentru nevăzători
7.1 imprimatele şi trimiterile pentru nevăzători nu pot purta nici o adnotaţie nici să conţină vreun element de corespondenţă;
7.2 ele nu pot conţine nici o marcă poştală, nici un formular de francare, obliterat sau nu, nici o hârtie reprezentând o valoare, exceptând cazul în care trimiterea include o carte poştală, un plic sau o banda prefrancată pentru returul său şi pe care este imprimată adresa expeditorului trimiterii sau a agentului său în ţara de depunere sau de destinaţie a trimiterii originale.
8. Prelucrarea trimiterilor admise din greşeală
8.1 Prelucrarea trimiterilor admise din greşeala este prevăzută în Regulament. Totuşi, trimiterile care conţin obiecte menţionate la 2.1.1, 2.1.2, 3.1 şi 3.2 nu sunt în nici un caz îndrumate la destinaţie, nici distribuite destinatarilor, nici returnate la origine. Dacă obiectele menţionate la 2.1.1 sunt descoperite intre trimiterile în tranzit, acestea din urmă vor fi prelucrate în conformitate cu legislaţia naţională a ţării de tranzit. Dacă obiectele menţionate la 3.1 şi 3.2 sunt descoperite în momentul transportării, operatorul desemnat vizat este autorizat să extragă aceste obiecte din trimitere şi să le distrugă. Operatorul desemnat poate apoi să direcţioneze restul trimiterii către destinaţie, transmiţând informaţii despre eliminarea obiectului neadmis.
Articolul 20
Control vamal. Drepturi vamale şi alte drepturi
1. Operatorul desemnat al ţării de origine şi al ţării de destinaţie sunt autorizaţi să supună trimiterile controlului vamal, conform legislaţiei din aceste ţări.
2. Trimiterile supuse controlului vamal pot fi supuse, cu titlu poştal, unor taxe de prezentare la vamă a cărei valoare indicativă este fixată de Regulament. Aceste taxe nu sunt percepute decât cu titlul de prezentare la vamă şi de vămuire a trimiterilor care au fost supuse drepturilor vamale sau oricărui alt drept de aceeaşi natură.
3. Operatorii desemnaţi care au obţinut autorizaţia de a efectua vămuirea în numele clienţilor lor, fie în numele clientului, fie în numele operatorului desemnat al ţării de destinaţie, sunt autorizaţi să perceapă de la aceştia o taxă bazată pe costurile reale ale operaţiei. Această taxă poate fi percepută, pentru toate trimiterile declarate la vamă, în conformitate cu legislaţia naţională, inclusiv a celor scutite de drepturi vamale. Clienţii trebuie să fie informaţi corespunzător în prealabil despre taxa aferentă.
4. Operatorii desemnaţi sunt autorizaţi să perceapă de la expeditorii sau destinatarii trimiterilor, după caz, drepturile vamale şi orice alte eventuale drepturi.
Partea a şasea
Responsabilitate
Articolul 21
Reclamaţii
1. Fiecare operator desemnat este obligat sa accepte reclamaţiile referitoare la colete şi trimiteri recomandate sau cu valoarea declarată, depuse în serviciul său propriu sau în cadrul unui alt operator desemnat, cu condiţia ca aceste reclamaţii să fie prezentate de către clienţi într-un interval de şase luni începând cu ziua a doua de la data de depunere a trimiterii. Reclamaţiile sunt transmise şi examinate între operatorii desemnaţi în conformitate cu modalităţile enunţate în Regulament. Perioada de şase luni priveşte relaţiile între reclamanţi şi operatorii desemnaţi şi nu include transmiterea reclamaţiilor între operatorii desemnaţi.
2. Prelucrarea reclamaţiilor este gratuită. Totuşi, cheltuielile suplimentare ocazionate de o cerere de transmisie prin serviciul EMS, sunt în principiu în sarcina solicitantului.
Articolul 22
Responsabilitatea operatorilor desemnaţi. Despăgubiri
1. Generalităţi
1.1 În afara cazurilor prevăzute la articolul 23, operatorii desemnaţi răspund pentru:
1.1.1 pierderea, spolierea sau avarierea trimiterilor recomandate, a coletelor ordinare (cu excepţia categoriei de distribuire a trimiterilor provenite din comerţul electronic, denumit în continuare “colet ECOMPRO”, a cărui specificări sunt definite suplimentar în Regulament) şi a trimiterilor cu valoare declarată;
1.1.2 returnarea trimiterii recomandate, trimiterii cu valoarea declarată şi a coletului ordinar al cărui motiv de nedistribuire nu a fost precizat.
1.2 Operatorii desemnaţi nu îşi asumă responsabilitatea daca este vorba de alte trimiteri decât cele menţionate la punctele 1.1.1 şi 1.1.2 sau dacă este vorba despre coletul ECOMPRO.
1.3 În toate celelalte cazuri ce nu au fost prevăzute de prezenta Convenţie, operatorii desemnaţi nu îşi asumă responsabilitatea.
1.4 Atunci când pierderea sau avaria totală a unei trimiteri recomandate, a unui colet ordinar sau a unei trimiteri cu valoare declarată ce rezultă dintr-un caz de forţă majoră ce nu permite despăgubiri, expeditorul are dreptul la restituirea taxelor achitate pentru depunerea trimiterii, cu excepţia taxei de asigurare.
1.5 Sumele de despăgubire ce trebuie plătite nu pot fi superioare sumelor menţionate în Regulament.
1.6 În caz de responsabilitate, pierderile indirecte, beneficiile nerealizate sau daune morale nu sunt luate în considerare în suma despăgubirii ce trebuie plătită.
1.7 Toate dispoziţiile legate de responsabilitatea operatorilor desemnaţi sunt stricte, obligatorii şi exhaustive. Operatorii desemnaţi nu îşi asumă în nici un caz responsabilitatea – chiar în caz de greşeala gravă (de eroare gravă) – în afara limitelor stabilite în cadrul Convenţiei şi al Regulamentului.
2. Trimiteri recomandate
2.1 În caz de pierdere, de spoliere totală sau de avariere totală a unei trimiteri recomandate, expeditorul are dreptul la o despăgubire stabilită de Regulament. Dacă expeditorul reclamă o sumă inferioară celei fixate în Regulament, operatorii desemnaţi au posibilitatea de a plăti această sumă mai mică şi de a fi rambursate pe această bază de către ceilalţi operatori desemnaţi eventual implicaţi.
2.2 În caz de spoliere parţială sau de avarie parţială a unei trimiteri recomandate, expeditorul are dreptul la o despăgubire care corespunde, în principiu, valorii reale a spolierii sau avariei.
3. Colete ordinare
3.1 În caz de pierdere, de spoliere totală sau de avarie totală a unui colet ordinar, expeditorul are dreptul la o despăgubire fixată de Regulament. Dacă expeditorul reclamă o sumă inferioară celei fixate în Regulament, operatorii desemnaţi au posibilitatea de a plăti această sumă mai mică şi de a fi rambursată pe această bază de către ceilalţi operatori desemnaţi eventual implicaţi.
3.2 În caz de spoliere parţială sau de avarie parţială a unui colet ordinar, expeditorul are dreptul la o despăgubire care corespunde, în principiu, valorii reale a spolierii sau avariei.
3.3 Operatorii desemnaţi pot conveni să aplice în relaţiile lor reciproce valoarea per colet fixată de Regulament, fără să ia în considerare greutatea coletului.
4. Trimiteri cu valoare declarată
4.1 În caz de pierdere, de spoliere totală sau de avarie totală a unei trimiteri cu valoare declarată, expeditorul are dreptul la o despăgubire ce corespunde, în principiu, sumei în DST, a valorii declarate.
4.2 În caz de spoliere parţială sau de avariere parţială a unei trimiteri cu valoare declarată, expeditorul are dreptul la o despăgubire ce corespunde, în principiu, valorii reale a spolierii sau avarierii. Ea nu poate totuşi în nici un caz să depăşească suma în DST, a valorii declarate.
5. În caz de returnare a unei trimiteri a poştei de scrisori recomandate sau cu valoarea declarată, al cărei motiv de nedistribuire nu a fost indicat, expeditorul are dreptul la restituirea doar a taxelor plătite pentru depunerea trimiterii.
6. În caz de returnare a unui colet, al cărui motiv de nedistribuire nu a fost indicat, expeditorul are dreptul la restituirea taxelor plătite pentru depunerea coletului în ţara de origine şi a cheltuielilor suportate pentru returnarea coletului din ţara de destinaţie.
7. În cazurile vizate de paragrafele 2, 3 şi 4, despăgubirea este calculată în funcţie de preţul curent, convertit în DST, al obiectelor sau mărfurilor de aceeaşi natură, în momentul şi locul în care trimiterea a fost acceptată pentru transport. În absenţa preţului curent, despăgubirea este calculată în funcţie de valoarea normală a obiectelor sau mărfurilor evaluate pe aceeaşi bază.
8. Când o despăgubire este datorată pentru pierderea, spolierea totală sau avarierea totală a unei trimiteri recomandate, a unui colet ordinar sau a unei trimiteri cu valoare declarată, expeditorul sau, după caz, destinatarul are dreptul, în plus, la restituirea taxelor şi drepturilor achitate pentru depunerea trimiterii, cu excepţia taxei de recomandare sau de asigurare. La fel se procedează şi pentru trimiterile recomandate, coletele ordinare sau trimiterile cu valoare declarată refuzate de către destinatari din cauza stării proaste, dacă acest fapt este imputabil operatorului desemnat şi angajează responsabilitatea acestuia din urmă.
9. Prin derogare de la dispoziţiile prevăzute la paragrafele 2, 3 şi 4, destinatarul are dreptul la o despăgubire pentru o trimitere recomandată, un colet ordinar sau o trimitere cu valoare declarată spoliat, avariat sau pierdut, dacă expeditorul renunţă la drepturile sale în scris, în favoarea destinatarului. Această renunţare nu este necesară în cazul în care expeditorul şi destinatarul sunt aceleaşi persoane.
10. Operatorul desemnat de origine are posibilitatea de a plăti expeditorilor din ţara sa despăgubirile prevăzute de legislaţia sa naţională pentru trimiterile recomandate şi coletele fără valoare declarată, cu condiţia ca ele să nu fie inferioare celor care sunt fixate la punctele 2.1 şi 3.1. Se aplică aceleaşi prevederi pentru operatorul desemnat de destinaţie, atunci când despăgubirea este plătită destinatarului. Sumele fixate la 2.1 şi 3.1 rămân totuşi aplicabile:
10.1 în caz de recurs împotriva operatorului desemnat responsabil;
10.2 daca expeditorul renunţă la drepturile sale în favoarea destinatarului.
11. Nici o rezervă privind depăşirea termenelor pentru reclamaţii şi plata despăgubirilor către operatorii desemnaţi, inclusiv perioadele şi condiţiile enunţate în Regulament, nu se aplică, cu excepţia cazului unui acord bilateral.
Articolul 23
Neresponsabilitatea Ţărilor-membre şi a operatorilor desemnaţi
1. Operatorii desemnaţi încetează să fie responsabili pentru trimiterile recomandate, coletele şi trimiterile cu valoare declarată cărora ei le-a făcut livrarea în condiţiile prevăzute de reglementarea lor pentru trimiterile de aceeaşi natură. Responsabilitatea este totuşi menţinută:
1.1 atunci când o spoliere sau avarie se constată fie înainte de livrare, fie în timpul livrării trimiterii;
1.2 atunci când, reglementările naţionale o permit, destinatarul, eventual expeditorul dacă este cazul unui retur la origine, formulează rezerve la preluarea unei trimiteri spoliate sau avariate;
1.3 atunci când, reglementările naţionale o permit, trimiterea recomandată a fost distribuită într-o cutie poştală şi când destinatarul reclama că nu a primit-o;
1.4 când destinatarul sau, în caz de retur la origine, expeditorul unui colet sau al unei trimiteri cu valoare declarată, în ciuda predării făcute în mod reglementar, declară fără întârziere operatorului desemnat care i-a livrat trimiterea şi că a constatat o pagubă; el trebuie să aducă dovada că spolierea sau avarierea nu s-a produs după livrarea trimiterii; termenul “fără întârziere” este interpretat conform legislaţiei naţionale.
2. Ţările-membre şi operatorii desemnaţi nu sunt responsabili:
2.1 în caz de forţă majoră, sub rezerva articolului 18.5.9;
2.2 când, proba responsabilităţii lor nefiind administrată altfel, ei nu pot să-şi dea seama de trimiteri, ca urmare a distrugerii documentelor de serviciu ca rezultat al unui caz de forţă majoră;
2.3 când paguba a fost cauzată din greşeala sau neglijenţa expeditorului sau provine de la natura conţinutului;
2.4 când este vorba de trimiteri care intră sub incidenţa interdicţiilor prevăzute în articolul 19;
2.5 în caz de reţinere, în virtutea legislaţiei naţionale a ţării de destinaţie, conform notificării Ţării-membru sau a operatorului desemnat al acestei ţări;
2.6 când este vorba de trimiteri cu valoare declarată care fac obiectul unei declarări frauduloase declarând valori superioare în raport cu valoarea reală a conţinutului;
2.7 când expeditorul nu a formulat nici o reclamaţie în termen de şase luni începând cu ziua a doua după depunerea trimiterii;
2.8 când este vorba de colete ale prizonierilor de război şi ale internaţilor civili;
2.9 când se bănuieşte că expeditorul a acţionat cu intenţii frauduloase în scopul de a primi o despăgubire.
3. Ţările-membre şi operatorii desemnaţi nu îşi asumă nici o răspundere cu privire la declaraţiile vamale, indiferent sub ce formă ar fi făcute, şi de deciziile luate de către serviciile vamale cu ocazia verificării trimiterilor supuse controlului vamal.
Articolul 24
Responsabilitatea expeditorului
1. Expeditorul unei trimiteri este responsabil pentru prejudiciile corporale suportate de către agenţii poştali şi pentru toate pagubele cauzate celorlalte trimiteri poştale precum şi echipamentului poştal ca urmare a expedierii de obiecte neadmise în cadrul transportului sau al nerespectării condiţiilor de admitere.
2. În caz de pagube cauzate altor trimiteri poştale, expeditorul este responsabil în aceleaşi limite ca şi operatorii desemnaţi pentru fiecare trimitere avariată.
3. Expeditorul rămâne responsabil chiar dacă oficiul de depunere a acceptat o astfel de trimitere.
4. In schimb, când condiţiile de acceptare au fost respectate de către expeditor, acesta nu este responsabil în măsura în care a existat o greşeală sau neglijenţă a operatorilor desemnaţi sau a transportatorilor, în prelucrarea trimiterilor după ce au fost acceptate.
Articolul 25
Plata despăgubirii
1. Sub rezerva dreptului de recurs împotriva operatorului desemnat responsabil, obligaţia de a plăti despăgubirea şi de a restitui taxele şi drepturile revine, după caz, operatorului desemnat de origine sau operatorului desemnat de destinaţie.
2. Expeditorul are posibilitatea să renunţe la drepturile sale de despăgubire în favoarea destinatarului. În cazul renunţării, expeditorul sau destinatarul pot autoriza o terţă persoană să primească despăgubirea dacă legislaţia naţională permite acest lucru.
Articolul 26
Recuperarea eventuala a despăgubirii de la expeditor sau de la destinatar
1. Dacă, după plata despăgubirii, o trimitere recomandată, un colet sau o trimitere cu valoare declarată sau o parte a conţinutului considerat anterior ca fiind pierdut a fost găsit, expeditorul său, după caz, destinatarul, este avizat că trimiterea este ţinută la dispoziţia sa o perioadă de trei luni, contra rambursării valorii despăgubirii plătite. În acelaşi timp este întrebat cui trebuie să fie predată trimiterea. În caz de refuz sau în lipsa răspunsului în termenul prevăzut, acelaşi demers este efectuat pe lângă destinatar sau expeditor, după caz, acordându-i aceiaşi perioadă de răspuns.
2. Dacă expeditorul şi destinatarul renunţă să preia trimiterea, sau nu răspund în limitele de timp fixate în paragraful 1, aceasta devine proprietatea operatorului desemnat sau, dacă este cazul, a operatorului desemnat care au suportat paguba.
3. În caz de descoperire ulterioară a unei trimiteri cu valoare declarată al cărei conţinut este recunoscut ca fiind de valoare inferioară în raport cu suma despăgubirii plătite, expeditorul sau destinatarul, după caz, trebuie să ramburseze suma acestei despăgubiri contra preluării trimiterii, fără prejudicierea consecinţelor care decurg din declararea frauduloasă a valorii.

A. Cheltuieli de tranzit
Articolul 27
Cheltuieli de tranzit
1 Depeşele închise şi trimiterile în tranzit deschis schimbate între doi operatori desemnaţi sau între două oficii ale aceleiaşi Ţări-membru prin intermediul serviciilor unuia sau al mai multor operatori desemnaţi (servicii terţe) sunt supuse plăţii cheltuielilor de tranzit. Acestea constituie o remuneraţie pentru prestaţiile privind tranzitul teritorial, tranzitul maritim şi tranzitul aerian. Acest principiu la fel se aplică pentru trimiterile greşit direcţionate şi pentru depeşele greşit îndrumate.
B. Cheltuieli terminale
Articolul 28
Cheltuieli terminale. Dispoziţii generale
1. Sub rezerva excepţiilor prevăzute în Regulament, fiecare operator desemnat care primeşte de la un alt operator desemnat trimiteri din categoria poştei de scrisori are dreptul de a percepe de la operatorul desemnat expeditor o remuneraţie pentru cheltuielile ocazionate a poştei internaţionale primite.
2. Pentru aplicarea dispoziţiilor referitoare la remunerarea cheltuielilor terminale de către operatorii lor desemnaţi, ţările şi teritoriile sunt clasificate conform listelor stabilite pentru acest scop de către Congres prin rezoluţia sa C 7/2016, cum este indicat mai jos:
2.1 ţări şi teritorii care fac parte din sistemul final înainte de 2010 (grupul I);
2.2 ţări şi teritorii care fac parte din sistemul final din 2010 şi 2012 (grupul II);
2.3 ţări şi teritorii care fac parte din sistemul final din 2016 (grupul III);
2.4 ţări şi teritorii care fac parte din sistemul tranzitoriu (grupul IV).
3. Dispoziţiile prezentei Convenţii referitoare la plata cheltuielilor terminale constituie măsuri tranzitorii ce conduc la adoptarea unui sistem de plăţi care ţine cont de elementele proprii ale fiecărei ţări după perioada de tranziţie.
4. Accesul la regimul intern. Acces direct
4.1 În principiu, fiecare operator desemnat al unei ţări care făcea parte din sistemul final înainte de 2010 va pune la dispoziţia celorlalţi operatori desemnaţi ansamblul de tarife, termene şi condiţii pe care le oferă în regimul său intern, în condiţii identice oferite clienţilor săi naţionali. Operatorului desemnat de destinaţie îi aparţine sarcina de a decide dacă operatorul desemnat de origine a îndeplinit sau nu condiţiile şi modalitatea cu privire la accesul direct.
4.2 Operatorii desemnaţi din ţările care au aderat la sistemul final înainte de 2010 trebuie să pună la dispoziţia altor operatori desemnaţi ai ţărilor care făceau parte din sistemul final înainte de 2010 tarifele, termenele şi condiţiile pe care le oferă în serviciul lor intern, în condiţii identice oferite clienţilor săi naţionali.
4.3 Operatorii desemnaţi ai ţărilor care au aderat la sistemul final din 2010 pot, cu toate acestea, alege să pună la dispoziţia unui număr limitat de operatori desemnaţi condiţiile pe care le oferă în serviciul lor intern, pe bază de reciprocitate, pentru o perioadă de probă de doi ani. După acest timp, ei trebuie să aleagă între două opţiuni: opri punerea la dispoziţie condiţiile pe care le oferă în serviciul lor intern sau de a continua pe această cale şi să facă accesibile condiţiile oferite în serviciul lor intern pentru toţi operatorii desemnaţi. Totuşi, în cazul în care operatorii desemnaţi ai ţărilor care au aderat la sistemul final din 2010 solicită operatorilor desemnaţi ai ţărilor care făceau parte din sistemul final înainte de 2010 să aplice condiţiile oferite în cadrul serviciului lor intern, aceştia trebuie să pună la dispoziţia tuturor celorlalţi operatori desemnaţi tarifele, termenele şi condiţiile pe care le oferă în serviciul lor intern, în condiţii identice celor propuse clienţilor săi naţionali.
4.4 Operatorii desemnaţi din ţările în tranziţie pot alege să nu pună la dispoziţia altor operatori desemnaţi condiţiile pe care le oferă în serviciul lor intern. Cu toate acestea, ei pot alege să pună la dispoziţia unui număr limitat de operatori desemnaţi condiţiile pe care le oferă în serviciul lor intern, pe bază de reciprocitate, pentru o perioadă de probă de doi ani. După această perioadă, ei trebuie să aleagă între două opţiuni: fie să înceteze punerea la dispoziţie a condiţiilor regimului său intern sau de a continua să facă disponibile condiţiile regimului său intern pentru toţi operatorii desemnaţi.
5. Remuneraţia pentru cheltuielile terminale se va baza pe performanţele de calitate ale serviciului în ţara de destinaţie. Consiliul de Exploatare Poştală va fi, prin urmare, autorizat să acorde bonusuri de remunerare indicate în articolele 29 şi 30, cu scopul de a încuraja participarea la sistemul de control şi pentru a recompensa operatorii desemnaţi care îşi ating obiectivul lor de calitate. Consiliul de Exploatare Poştală poate, de asemenea, să fixeze penalităţi în cazul unei calităţi insuficiente, dar remuneraţia nu poate sa fie sub remuneraţia minimală indicata în articolele 29 şi 30.
6. Orice operator desemnat poate renunţa total sau parţial la remuneraţia prevăzută la paragraful 1.
7. Sacii M de mai puţin de 5 kg sunt consideraţi ca fiind de 5 kg pentru remunerarea cheltuielilor terminale. Pentru sacii M, rata cheltuielilor terminale care urmează să fie aplicată va fi:
7.1 pentru anul 2018: 0,909 DST per kilogram;
7.2 pentru anul 2019: 0,935 DST per kilogram;
7.3 pentru anul 2020: 0,961 DST per kilogram;
7.4 pentru anul 2021: 0,988 DST per kilogram,
8. Pentru trimiterile recomandate, este de aşteptat o remuneraţie suplimentară de 1,100 DST per trimitere pentru 2018, de 1,200 DST per trimitere pentru 2019, de 1,300 DST per trimitere pentru 2020 şi de 1,400 DST per trimitere pentru 2021. Pentru trimiterile cu valoare declarată, este de aşteptat o remuneraţie suplimentară de 1,400 DST per trimitere pentru 2018, de 1,500 DST per trimitere pentru 2019, de 1,600 DST per trimitere pentru 2020 şi de 1,700 DST per trimitere pentru 2021. Consiliul de Exploatare Poştală este autorizat să acorde bonusuri de remuneraţie pentru aceste servicii şi alte servicii suplimentare în cazul în care serviciile furnizate includ elemente adiţionale care trebuie să fie specificate în Regulament.
9. În lipsa unei înţelegeri bilaterale în sens contrar, o plată suplimentară de 0,5 DST per trimitere este prevăzută pentru trimiterile recomandate şi cele cu valoare declarată fără un identificator cu cod de bare sau cu un identificator cu cod de bare care nu corespunde Standardului tehnic S10 al UPU.
10. În scopurile plăţii cheltuielilor terminale, trimiterile poştei de scrisori expediate în număr mare de către acelaşi expeditor în aceiaşi depeşă sau în depeşe separate, în conformitate cu condiţiile specificate în Regulament, sunt denumite “curier în număr” şi se remunerează în conformitate cu dispoziţiile articolelor 29 şi 30.
11. Orice operator desemnat poate, prin acorduri bilaterale sau multilaterale, să aplice alte sisteme de remuneraţie pentru reglarea conturilor cu titlu de cheltuieli terminale.
12. Operatorii desemnaţi pot, cu titlu facultativ, să facă schimb de poşta non-prioritară prin acordarea unei reduceri de 10% la rata de cheltuieli terminale aplicabilă la poşta prioritară.
13. Dispoziţiile dintre operatorii desemnaţi din sistemul final se aplică oricărui operator desemnat din sistemul tranzitoriu care a declarat că va adera la sistemul final. Consiliul de Exploatare Poştală poate fixa măsuri tranzitorii în Regulament. Dispoziţiile din sistemul final poate fi aplicat în totalitate noilor operatori desemnaţi din sistemul final care au declarat că se vor supune pe deplin acestor dispoziţii, fără măsuri tranzitorii.
Articolul 29
Cheltuieli terminale. Dispoziţii aplicabile fluxului de poştă
dintre operatorii desemnaţi ai ţărilor din sistemul final
1. Remuneraţia pentru trimiterile poştei de scrisori, inclusiv curierul în număr, cu excepţia sacilor M şi a trimiterilor CCRI, este stabilită în funcţie de aplicarea taxelor per trimitere şi per kilogram care reflectă costurile de prelucrare în ţara de destinaţie. Taxele corespunzătoare trimiterilor prioritare în serviciul intern care fac parte din prestarea serviciului universal se folosesc ca bază pentru calcularea ratelor de cheltuieli terminale.
2. Ratele de cheltuieli terminale din sistemul final se calculează luând în considerare clasificarea trimiterilor în funcţie de formatul lor, în conformitate cu prevederile specificate la articolul 17.5, dacă aceasta se aplică în serviciul intern.
3. Operatorii desemnaţi din sistemul final fac schimb de trimiteri separate pe format, în conformitate cu condiţiile specificate în Regulament.
4. Remuneraţia pentru trimiterile CCRI se efectuează în conformitate cu dispoziţiile relevante din Regulament.
5. Taxele per trimitere şi per kilogram sunt separate pentru trimiterile poştei de scrisori de format mic (P) şi de format mare (G) şi pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E). Ele sunt calculate pornind de la 70% din plata pentru o trimitere a poştei de scrisori de format mic de 20 de grame (P) şi pentru o trimitere a poştei de scrisori de format mare de 175 de grame (G), fără TVA şi a alte taxe. Pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E), ele sunt calculate în baza taxelor pentru trimiterile de format P şi de format G până la 375 de grame, fără TVA şi alte taxe.
6. Consiliul de Exploatare Poştală va defini condiţiile de calculare a ratelor, precum şi procedurile operaţionale, statistice şi contabile necesare pentru schimbul de trimiteri separate pe format.
7. Ratele aplicate pentru fluxurile între ţările din sistemul final într-un anumit an nu trebuie să conducă la o creştere de peste 13% a veniturilor din cheltuielile terminale pentru o trimitere a poştei de scrisori de format P şi de format G de 37,6 de grame şi pentru o trimitere de format E de 375 de grame, în raport cu anul precedent.
8. Taxele aplicate fluxului între ţările ce au aderat la sistemul final înainte de 2010 pentru trimiterile poştei de scrisori de format mic (P) şi de format mare (G) nu pot depăşi:
8.1 pentru 2018: 0,331 DST per trimitere şi 2,585 DST per kilogram;
8.2 pentru 2019: 0,341 DST per trimitere şi 2,663 DST per kilogram;
8.3 pentru 2020: 0,351 DST per trimitere şi 2,743 DST per kilogram;
8.4 pentru 2021: 0,362 DST per trimitere şi 2,825 DST per kilogram.
9. Taxele aplicabile pentru fluxurile între ţările care au aderat la sistemul final înainte de 2010 pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E) nu pot depăşi:
9.1 pentru 2018: 0,705 DST per trimitere şi 1,584 DST per kilogram;
9.2 pentru 2019: 0,726 DST per trimitere şi 1,632 DST per kilogram;
9.3 pentru 2020: 0,748 DST per trimitere şi 1,681 DST per kilogram;
9.4 pentru 2021: 0,770 DST per trimitere şi 1,731 DST per kilogram.
10. Taxele aplicate fluxului între ţările care au aderat la sistemul final înainte de 2010, în 2010, în 2012 sau în 2016 pentru trimiterile poştei de scrisori de format mic (P) şi de format mare (G) nu vor putea fi inferioare taxelor specificate în continuare:
10.1 pentru 2018: 0,227 DST per trimitere şi 1,774 DST per kilogram;
10.2 pentru 2019: 0,233 DST per trimitere şi 1,824 DST per kilogram;
10.3 pentru 2020: 0,240 DST per trimitere şi 1,875 DST per kilogram;
10.4 pentru 2021: 0,247 DST per trimitere şi 1,928 DST per kilogram.
11. Taxele aplicate fluxului între ţările care au aderat la sistemul final înainte de 2010, în 2010, în 2012 sau în 2016 pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E) nu pot fi inferioare taxelor specificate în continuare:
11.1 pentru 2018: 0,485 DST per trimitere şi 1,089 DST per kilogram;
11.2 pentru 2019: 0,498 DST per trimitere şi 1,120 DST per kilogram;
11.3 pentru 2020: 0,512 DST per trimitere şi 1,151 DST per kilogram;
11.4 pentru 2021: 0,526 DST per trimitere şi 1,183 DST per kilogram.
12. Taxele aplicate fluxului de poştă între ţările care fac parte din sistemului final din 2010 şi 2012 şi între aceste ţări şi cele care au făcut parte din sistemului final înainte de 2010 pentru trimiterile poştei de scrisori de format mic (P) şi de format mare (G) nu pot depăşi:
12.1 pentru 2018: 0,264 DST per trimitere şi 2,064 DST per kilogram;
12.2 pentru 2019: 0,280 DST per trimitere şi 2,188 DST per kilogram;
12.3 pentru 2020: 0,297 DST per trimitere şi 2,319 DST per kilogram;
12.4 pentru 2021: 0,315 DST per trimitere şi 2,458 DST per kilogram.
13. Taxele aplicate fluxului de poştă între ţările care fac parte din sistemului final din 2010 şi 2012 şi între aceste ţări şi cele care au făcut parte din sistemului final înainte de 2010 pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E) nu pot depăşi:
13.1 pentru 2018: 0,584 DST per trimitere şi 1,313 DST per kilogram;
13.2 pentru 2019: 0,640 DST per trimitere şi 1,439 DST per kilogram;
13.3 pentru 2020: 0,701 DST per trimitere şi 1,577 DST per kilogram;
13.4 pentru 2021: 0,770 DST per trimitere şi 1,731 DST per kilogram.
14. Taxele aplicate fluxului de poştă între ţările care fac parte din sistemului final din 2016 şi între aceste ţări şi cele care au aderat la sistemului final înainte de 2010, în 2010 sau în 2012 pentru trimiterile poştei de scrisori de format mic (P) şi de format mare (G) nu pot depăşi:
14.1 pentru 2018: 0,234 DST per trimitere şi 1,831 DST per kilogram;
14.2 pentru 2019: 0,248 DST per trimitere şi 1,941 DST per kilogram;
14.3 pentru 2020: 0,263 DST per trimitere şi 2,057 DST per kilogram;
14.4 pentru 2021: 0,279 DST per trimitere şi 2,180 DST per kilogram.
15. Taxele aplicate fluxului de poştă între ţările care fac parte din sistemului final din 2016 şi între aceste ţări şi cele care au aderat la sistemului final înainte de 2010, în 2010 sau în 2012 pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E) nu pot depăşi:
15.1 pentru 2018: 0,533 DST per trimitere şi 1,198 DST per kilogram;
15.2 pentru 2019: 0,602 DST per trimitere şi 1,354 DST per kilogram;
15.3 pentru 2020: 0,680 DST per trimitere şi 1,530 DST per kilogram;
15.4 pentru 2021: 0,770 DST per trimitere şi 1,731 DST per kilogram.
16. Pentru fluxurile inferioare a 50 de tone pe an între ţările care au aderat la sistemul final în 2010 sau în 2012, precum şi între aceste ţări şi ţările care făceau parte din sistemul final înainte de 2010, componentele per kilogram şi per trimitere sunt convertite într-o taxă totală per kilogram, pe baza compoziţiei tip a 1 kilogram de poştă la nivel mondial, potrivit căreia trimiterile de format P şi G reprezintă 8,16 trimiteri pentru greutatea de 0,31 kilograme şi trimiterile de format E reprezintă 2,72 trimiteri pentru greutatea de 0,69 kilograme.
17. Pentru fluxurile inferioare a 75 de tone pe an în 2018, 2019 şi 2020, şi inferioare a 50 de tone în 2021, între ţările care au aderat la sistemul final în 2016 sau ulterior, precum şi între aceste ţări şi ţările care au aderat la sistemul final înainte de 2010, în 2010 sau în 2012, componentele per kilogram şi per trimitere sunt convertite într-o taxă totală per kilogram pe baza compoziţiei tip a 1 kilogram de poştă la nivel mondial menţionată în paragraful 16.
18. Remuneraţia pentru curierul în număr expediat în ţările care făceau parte din sistemul final înainte de 2010 este determinată pe baza aplicării taxelor pe trimitere şi per kilogram prevăzute la paragrafele 5 - 11.
19. Remuneraţia pentru curierul în număr expediat în ţările care făceau parte din sistemul final din 2010, 2012 şi 2016 este stabilită pe baza aplicării taxelor pe trimitere şi per kilogram prevăzute la paragrafele 5 şi 10 - 15.
20. Nici o rezervă, cu excepţia cazului unui acord bilateral, nu este aplicabilă acestui articol.
Articolul 30
Cheltuieli terminale. Dispoziţii aplicabile fluxului de curierat spre,
de la şi între operatorii desemnaţi din ţările aflate în sistemul tranzitoriu
1. Pentru operatorii desemnaţi din ţările din sistemul de cheltuieli terminale tranzitorii (în curs de pregătire pentru aderarea lor la sistemul final), remuneraţia privind trimiterile poştei de scrisori, inclusiv curierul în număr, dar cu excepţia sacilor M şi trimiterilor CCRI, este stabilită pe baza unei taxe per trimitere şi a unei taxe per kilogram.
2. Remuneraţia pentru trimiterile CCRI se efectuează în conformitate cu dispoziţiile relevante din Regulament.
3. Taxele aplicate fluxurilor de poştă spre, din şi între ţările din sistemul tranzitoriu pentru trimiterile poştei de scrisori de format mic (P) şi de format mare (G) sunt:
3.1 pentru 2018: 0,227 DST per trimitere şi 1,774 DST per kilogram;
3.2 pentru 2019: 0,233 DST per trimitere şi 1,824 DST per kilogram;
3.3 pentru 2020: 0,240 DST per trimitere şi 1,875 DST per kilogram;
3.4 pentru 2021: 0,247 DST per trimitere şi 1,928 DST per kilogram.
4. Taxele aplicate fluxurilor de poştă spre, din şi între ţările din sistemul tranzitoriu pentru trimiterile poştei de scrisori de format voluminos (E) şi pachetele mici (E) sunt:
4.1 pentru 2018: 0,485 DST per trimitere şi 1,089 DST per kilogram;
4.2 pentru 2019: 0,498 DST per trimitere şi 1,120 DST per kilogram;
4.3 pentru 2020: 0,512 DST per trimitere şi 1,151 DST per kilogram;
4.4 pentru 2021: 0,526 DST per trimitere şi 1,183 DST per kilogram.
5. Pentru fluxurile inferioare pragului de fluxuri fixat în articolul 29.16 sau 29.17, componentele per kilogram şi per trimitere sunt convertite într-o taxă totală per kilogram pe baza compoziţiei tip a 1 kilogram de poştă la nivel mondial. Se vor aplica următoarele taxe:
5.1 pentru 2018: 4,427 DST per kilogram;
5.2 pentru 2019: 4,592 DST per kilogram;
5.3 pentru 2020: 4,724 DST per kilogram;
5.4 pentru 2021: 4,858 DST per kilogram.
6. Pentru fluxurile superioare pragului de fluxuri fixat prin articolul 29.17, taxele fixate per kilogram menţionate mai sus sunt aplicate dacă nici operatorul desemnat de origine, nici operatorul desemnat de destinaţie, nu cere, în cadrul mecanismului de revizuire, o revizuire a taxelor pe baza numărului real de trimiteri per kilogram, mai degrabă decât pe baza numărului mediu mondial. Prelevarea de probe în sensul aplicării mecanismului de revizuire se aplică, în conformitate cu condiţiile specificate în Regulament.
7. Revizuirea diminuării taxei totale indicate în paragraful 5 nu poate fi invocată de o ţară din sistemul final împotriva unei ţări din sistemul tranzitoriu, cu condiţia ca aceasta din urmă să nu ceară o revizuire în sens invers.
8. Operatorii desemnaţi din ţările din sistemul de cheltuieli terminale tranzitoriu pot expedia şi recepţiona trimiterile poştale separate pe format pe bază opţională, în conformitate cu condiţiile stipulate în Regulament. Pentru acest tip de schimb separat pe format sunt aplicabile taxele menţionate la paragrafele 3 şi 4.
9. Remuneraţia pentru curierul în număr îndreptat spre operatorii desemnaţi din ţările din sistemul final este stabilită pe baza aplicării taxelor per trimitere şi per kilogram prevăzute la articolul 29. Pentru curierul în număr primit, operatorii desemnaţi din ţările din sistemul tranzitoriu pot solicita o remuneraţie în temeiul dispoziţiilor menţionate la paragraful 3 şi 4.
10. Nici o rezervă, cu excepţia cazurilor de acord bilateral, nu este aplicabilă acestui articol.
Articolul 31
Fondul pentru ameliorarea calităţii serviciului
1. Cu excepţia sacilor M, a trimiterilor CCRI şi trimiterilor în număr, cheltuielile terminale achitate de către toate tarile şi teritoriile ţărilor clasate în categoria ţărilor slab dezvoltate şi incluse în grupul IV pentru cheltuielile terminale şi pentru Fondul pentru ameliorarea calităţii serviciului, fac obiectul unei majorări ce corespunde la 20% din taxele indicate în articolul 30, cu titlu de alimentare a Fondului pentru ameliorarea calităţii serviciului în aceste ţări. Nici o plată de această natură nu are loc între ţările din grupa IV.
2. Cu excepţia sacilor M, trimiterilor CCRI şi a trimiterilor în număr, cheltuielile terminale, achitate de către ţările şi teritoriile clasificate în categoria ţărilor din grupul I către ţările clasificate în categoria ţărilor din grupul IV, cu excepţia ţărilor slab dezvoltate menţionate în paragraful 1, fac obiectul unei majorări ce corespunde la 10% din taxele indicate la articolul 30, cu titlul de alimentare a Fondului pentru ameliorarea calităţii serviciului în aceste ţări.
3. Cu excepţia sacilor M, trimiterilor CCRI şi a trimiterilor în număr, cheltuielile terminale, achitate de către ţările şi teritoriile clasificate în categoria ţărilor de grupul II către ţările clasificate în categoria ţărilor din grupul IV, cu excepţia ţărilor slab dezvoltate menţionate în paragraful 1, fac obiectul unei majorări ce corespunde la 10% din taxele indicate la articolul 30, cu titlul de alimentare a Fondului pentru ameliorarea calităţii serviciului în aceste ţări.
4. Cu excepţia sacilor M, trimiterilor CCRI şi a trimiterilor în număr, cheltuielile terminale, achitate de către ţările şi teritoriile clasificate în categoria ţărilor de grupul III către ţările clasificate în categoria ţărilor din grupul IV, cu excepţia ţărilor slab dezvoltate menţionate în paragraful 1, fac obiectul unei majorări ce corespunde cu 5% din taxele indicate la articolul 30, cu titlul de alimentare a Fondului pentru ameliorarea calităţii serviciului în aceste ţări.
5. Cu excepţia sacilor M, trimiterilor CCRI şi a trimiterilor în număr, cheltuielile terminale, achitate de către ţările şi teritoriile clasificate în categoria ţărilor din grupurile I la III 2 către ţările clasificate în categoria ţărilor din grupul III, fac obiectul unei majorări de 1%, ce este vărsată în fondul comun creat pentru ameliorarea calităţii serviciului în ţările clasificate în categoriile de ţări din grupurile II – IV şi gestionat conform procedurilor stabilite de către Consiliul de Exploatare Poştală.
6. Sub rezerva procedurilor aplicabile fixate de către Consiliul de Exploatare Poştală, orice sumă neutilizată vărsată cu titlul dispoziţiilor din punctele 1 - 4 şi acumulată pe parcursul a patru ani de referinţă anteriori a Fondului pentru ameliorarea calităţii serviciului (2018 fiind anul de referinţă cel mai depărtat) este transferată în fondul comun menţionat în paragraful 5. În scopul prezentului paragraf, doar fondurile ce nu au fost utilizate, pentru proiectele de ameliorare a calităţii serviciului aprobate de către Fondul pentru ameliorarea calităţii serviciului, timp de doi ani după recepţionarea ultimei plăţi a sumelor contribuite pentru o perioadă cvadrienală oricare definită mai sus sunt transferate în fondul comun.
7. Cheltuielile terminale cumulate, achitate cu titlul de alimentare a Fondului pentru ameliorarea calităţii serviciului în ţările din grupul IV, sunt supuse la un nivel minim de 20 000 DST pe an pentru fiecare ţară beneficiară. Sumele suplimentare necesare pentru a atinge acest nivel sunt facturate pentru ţările din grupurile I - III, proporţional cantităţilor tranzacţionate.
8. Consiliul de Exploatare Poştală va adopta sau actualiza, în 2018 cel mai târziu, proceduri pentru finanţarea proiectelor Fondului pentru ameliorarea calităţii serviciului.
C. Cote-părţi pentru coletele poştale
Articolul 32
Cote-părţi teritoriale şi maritime ale coletelor poştale
1. Cu excepţia coletelor ECOMPRO, coletele schimbate între doi operatori desemnaţi sunt supuse cotelor-părţi teritoriale de sosire calculate prin combinarea taxei de bază per colet şi taxei de bază per kilogram, stabilite prin Regulament.
1.1 Ţinând cont de taxele de bază de mai sus, operatorii desemnaţi pot în plus să fie autorizaţi să beneficieze de taxe suplimentare per colet şi per kilogram, conform dispoziţiilor prevăzute în Regulament.
1.2 Cotele-părţi vizate la paragraful 1 şi 1.1 sunt în sarcina operatorului desemnat al ţării de origine, doar dacă Regulamentul nu prevede derogări de la acest principiu.
1.3 Cotele-părţi teritoriale de intrare trebuie să fie uniforme pentru ansamblul teritoriului fiecărei ţări.
2. Coletele schimbate între doi operatori desemnaţi sau între două birouri ale aceleiaşi ţări prin intermediul serviciilor terestre ale unuia sau ale mai multor operatori desemnaţi sunt supuse, în profitul operatorilor desemnaţi ale căror servicii participă la transportul teritorial, la cotele-părţi teritoriale de tranzit fixate prin Regulament conform treptei de distanţă.
2.1 Pentru coletele în tranzit deschis, operatorii desemnaţi intermediari sunt autorizaţi să reclame cota-parte forfetară per trimitere fixată prin Regulament.
2.2 Cotele-părţi teritoriale de tranzit sunt în sarcina operatorului desemnat al ţării de origine, doar dacă Regulamentul privind coletele poştale nu prevede derogări de la acest principiu.
3. Fiecare operator desemnat ale cărui servicii participă la transportul maritim al coletelor este autorizat să solicite cotele-părţi maritime. Aceste cote-părţi sunt în sarcina operatorului desemnat al ţării de origine, doar dacă Regulamentul nu prevede derogări de la acest principiu.
3.1 Pentru fiecare serviciu maritim utilizat, cota-parte maritimă este stabilită prin Regulament conform treptei de distanţă.
3.2 Operatorii desemnaţi au dreptul de a majora cu maximum 50% cota-parte maritimă calculată conform 3.1. Din contra, ei o pot reduce cât doresc.
D. Cheltuieli de transport aerian
Articolul 33
Taxe de bază şi dispoziţii privind cheltuielile de transport aerian
1. Taxa de bază ce va fi aplicată în reglarea conturilor între operatorii desemnaţi pentru transporturi aeriene este aprobată de către Consiliul de Exploatare Poştală şi calculată de către Biroul Internaţional conform unei formule specificate în Regulament. Taxele aplicabile transportului aerian al coletelor expediate prin serviciul de returnare a mărfurilor sunt calculate conform prevederilor definite în Regulament.
2. Calculul cheltuielilor de transport aerian al depeşelor închise, al trimiterilor prioritare, al trimiterilor par avion, al coletelor par avion în tranzit deschis, al trimiterilor greşit direcţionate şi depeşelor greşit îndrumate, precum şi metodele de decontare aferente, este descris în Regulament.
3. Cheltuielile de transport pentru tot parcursul aerian sunt:
3.1 în cazul depeşelor închise, în sarcina operatorului desemnat al ţării de origine, inclusiv atunci când aceste depeşe tranzitează unul sau mai mulţi operatori desemnaţi intermediari;
3.2 în cazul trimiterilor prioritare şi trimiterilor par avion în tranzit deschis, inclusiv cele care sunt greşit îndrumate, în sarcina operatorului desemnat care predă trimiterile unui alt operator desemnat.
4. Aceleaşi reguli sunt aplicabile trimiterilor scutite de cheltuieli de tranzit teritorial şi maritim dacă sunt îndrumate par avion.
5. Fiecare operator desemnat de destinaţie care asigură transportul aerian al poştei internaţionale în interiorul ţării sale are dreptul la rambursarea costurilor suplimentare ocazionate de acest transport, cu condiţia ca distanţa medie ponderată a parcursurilor efectuate să depăşească 300 kilometri. Consiliul de Exploatare Poştală poate înlocui distanţa medie ponderată prin alt criteriu pertinent. În afara unui acord prealabil privind gratuitatea, cheltuielile trebuie să fie uniforme pentru toate depeşele prioritare şi depeşele par avion care provin din străinătate, fie ca această poştă este reîndrumată sau nu pe cale aeriană.
6. Totuşi, când compensarea cheltuielilor terminale percepute de către operatorul desemnat de destinaţie este bazată în special pe costurile sau pe tarifele interne, nu se efectuează nici o rambursare suplimentară pentru cheltuielile de transport aerian intern.
7. Operatorul desemnat de destinaţie exclude, în vederea calculării distanţei medii ponderate, greutatea tuturor depeşelor pentru care calculul compensării cheltuielilor terminale se bazează în special pe costurile sau tarifele interne ale operatorului desemnat de destinaţie.
E. Reglementarea conturilor
Articolul 34
Dispoziţii specifice privind reglementarea conturilor
şi a plăţilor pentru schimburile poştale internaţionale
1. Reglementările conturilor în ceea ce priveşte operaţiunile efectuate în conformitate cu prezenta Convenţie (inclusiv reglementări pentru transportarea (expedierea) trimiterilor poştale, reglementări pentru prelucrarea trimiterilor poştale în ţara de destinaţie şi reglementări în calitate de compensaţie pentru orice pierdere, furt sau deteriorare a trimiterilor poştale) sunt bazate pe dispoziţiile Convenţiei şi alte acte ale Uniunii şi efectuate în conformitate cu Convenţia şi alte Acte ale Uniunii şi nu necesită elaborarea oricăror documente de către un operator desemnat, cu excepţia cazurilor prevăzute în Actele Uniunii.
F. Stabilirea cheltuielilor şi taxelor
Articolul 35
Competenţa Consiliului de Exploatare Poştală
de a fixa suma cheltuielilor şi cotelor-părţi
1. Consiliul de Exploatare Poştala are autoritatea de a fixa următoarele cheltuieli şi cote-părţi, care trebuie plătite de către operatorii desemnaţi conform condiţiilor enunţate în Regulament:
1.1 cheltuieli de tranzit pentru prelucrarea şi transportul depeşelor poştei de scrisori de către cel puţin o ţară terţă;
1.2 taxa de baza şi cheltuielile de transport aerian aplicabile curierului-avion;
1.3 cotele-părţi teritoriale de sosire pentru prelucrarea coletelor sosite, cu excepţia coletelor ECOMPRO;
1.4 cotele-părţi teritoriale de tranzit pentru prelucrarea şi transportul coletelor de către o ţară terţă;
1.5 cotele-părţi maritime pentru transportul maritim al coletelor;
1.6 cotele-părţi teritoriale de ieşire pentru prestarea serviciului de returnare a mărfurilor pentru colete poştale.
2. Revizuirea, care va putea fi făcută, graţie unei metodologii care asigură o remuneraţie echitabilă operatorilor desemnaţi care efectuează serviciile, va trebui să se bazeze pe date economice şi financiare fiabile şi reprezentative. Eventuala modificare care ar putea fi decisă va intra în vigoare la o dată stabilită de către Consiliul de Exploatare Poştală.

Servicii facultative
Articolul 36
EMS şi logistică integrată
1. Ţările-membre sau operatorii lor desemnaţi pot conveni între ei să participe la următoarele servicii, care sunt descrise în Regulament:
1.1 EMS, care este un serviciu poştal expres destinat documentelor şi mărfurilor, şi care constituie, pe cât este posibil, cel mai rapid dintre serviciile poştale prin mijloace fizice; acest serviciu poate fi furnizat pe baza Acordului standard EMS multilateral sau pe baza acordurilor bilaterale;
1.2 serviciul de logistică integrată, care răspunde pe deplin nevoilor clienţilor în materie de logistică şi cuprinde etapele care preced şi care urmează transmiterii fizice a mărfurilor şi a documentelor.
Articolul 37
Servicii poştale electronice
1. Ţările-membre sau operatorii desemnaţi pot conveni între ei să participe la următoarele servicii poştale electronice, care sunt descrise în Regulament:
1.1 poşta electronică, un serviciu poştal electronic care implică transmiterea mesajelor electronice şi a informaţiilor de către operatorii desemnaţi;
1.2 poşta electronică recomandată, care este un serviciu poştal electronic securizat care furnizează dovada expedierii şi dovada livrării unui mesaj electronic şi care trece printr-un canal de comunicare protejat între utilizatorii autentificaţi;
1.3 ştampilă poştală electronică de certificare, care prezintă o dovada concludentă a existenţei unui fapt electronic, într-o anumită formă, la un moment dat, şi la care au participat una sau mai multe părţi;
1.4 cutie poştală electronică, care permite trimiterea de mesaje electronice de către un expeditor autentificat precum şi distribuirea şi stocarea mesajelor şi a informaţiilor electronice pentru un destinatar autentificat.

Dispoziţii finale
Articolul 38
Condiţii de aprobare a propunerilor privind Convenţia şi Regulamentul
1. Pentru a deveni executorii, propunerile supuse Congresului şi referitoare la prezenta Convenţie trebuie să fie aprobate de către majoritatea Ţărilor-membre prezente şi votante care au dreptul de vot . Cel puţin jumătate dintre Ţările-membre reprezentate în Congres care au dreptul de vot trebuie să fie prezente în momentul votului.
2. Pentru a deveni executorii, propunerile referitoare la Regulament trebuie să fie aprobate de către majoritatea membrilor Consiliului de Exploatare Poştală care au drept de vot.
3. Pentru a deveni executorii, propunerile introduse între două Congrese şi referitoare la prezenta Convenţie şi Protocolul său final trebuie să reunească:
3.1 două treimi din voturi, cel puţin jumătate dintre Ţările-membre ale Uniunii care au dreptul de vot şi au participat la votare, în cazul de modificări;
3.2 majoritatea voturilor în cazul de interpretare a dispoziţiilor.
4. Contrar dispoziţiilor prevăzute la paragraful 3.1., orice Ţară-membru a cărei legislaţie naţională este încă incompatibilă cu modificarea propusă are posibilitatea să facă o declaraţie scrisă Directorului General al Biroului Internaţional în care să indice faptul că nu este posibil să accepte această modificare, în nouăzeci de zile începând din ziua notificării acesteia.
Articolul 39
Rezerve prezentate în timpul Congresului
1. Orice rezervă incompatibilă cu obiectul şi scopul Uniunii nu va fi autorizată.
2. Ca regulă generală, Ţările-membre care nu pot să împărtăşească punctul lor de vedere cu a celorlalte Ţări-membre trebuie sa facă eforturi, în măsura posibilului, sa se alăture opiniei majorităţii. Rezerva trebuie să se facă în caz de necesitate absolută şi să fie motivata în mod corespunzător.
3. Rezerva cu privire la articolele prezentei Convenţii trebuie să fie supusă Congresului sub forma unei propuneri scrise într-una dintre limbile de lucru ale Biroului Internaţional conform dispoziţiilor referitoare la acest lucru ale Regulamentului intern al Congresului.
4. Ca să devină efectivă, rezerva supusă Congresului trebuie să fie aprobată de majoritatea cerută în acest caz pentru modificarea articolului la care se referă rezerva.
5. În principiu, rezerva este aplicabilă pe o baza de reciprocitate între Ţara-membru care a emis-o şi celelalte Ţări-membre.
6. Rezerva la prezenta Convenţie va fi introdusă în Protocolul final pe baza propunerii aprobate de către Congres.
Articolul 40
Punerea în aplicare şi durata Convenţiei
1. Prezenta Convenţie va fi pusă în aplicare la 1 ianuarie 2018 şi va rămâne în vigoare până la punerea în aplicare a Actelor următorului Congres.
Drept pentru care, Plenipotenţiarii Guvernelor Ţărilor-membre au semnat prezenta Convenţie într-un exemplar care este depus la Directorul General al Biroului Internaţional. O copie va fi predată fiecărei Părţi de către Biroul Internaţional al Uniunii Poştale Universale.

Articolul I
Apartenenţa trimiterilor poştale. Retragerea.
Modificarea sau corectarea adresei
1. Dispoziţiile articolului 5.1 şi 2 nu se aplică pentru Antigua şi Barbuda, Bahrain (Regat), Barbados, Belize, Botswana, Brunei Darussalam, Canada, Hong Kong, China, Dominica, Egipt, Fiji, Gambia, Regatul Unit al Marii Britanii şi Irlandei de Nord, Teritoriile de peste mare dependente de Marea Britanie, Grenada, Guyana, Irlanda, Jamaica, Kenya, Kiribati, Kuwait, Lesotho, Malaiezia, Malawi, Mauritius, Nauru, Nigeria, Noua Zeelandă, Uganda, Papua-Noua Guinee, Saint-Cristophe-et-Nevis, St. Lucia, St. Vincent şi Grenadine, Insulele Solomon, Samoa, Seychelles, Sierra Leone, Singapore, Swaziland, Tanzania (Rep. Unită), Trinidad-Tobago, Tuvalu, Vanuatu şi Zambia.
2. Dispoziţiile articolului 5.1 şi 2 nu se aplică nici pentru Austria, Danemarca şi Iran (Rep. islamică) a căror legislaţie nu permite retragerea sau modificarea adresei trimiterilor poştei de scrisori la solicitarea expeditorului începând din momentul în care destinatarul a fost informat de sosirea unei trimiteri pe adresa sa.
3. Articolul 5.1 nu se aplică pentru Australia, Ghana şi Zimbabwe.
4. Articolul 5.2 nu se aplică pentru Bahamas, Belgia, Irak, Myanmar şi Republica Populară Democrată Coreeană a căror legislaţii nu permit retragerea sau modificarea adresei trimiterilor poştei de scrisori la cererea expeditorului.
5. Articolul 5.2 nu se aplică în America (Statele Unite).
6. Articolul 5.2 se aplică Australiei în măsura în care este compatibil cu legislaţia internă a acestei ţări.
7. Prin derogare de la articolul 5.2 , El Salvador, Panama (Rep.), Filipine, Rep. Dem. Congo şi Venezuela (Rep. bolivariană) sunt autorizate să nu returneze coletele poştale după ce destinatarul a cerut vămuirea lor, dat fiind ca legislaţia lor vamală se opune acestui lucru.
Articolul II
Mărci poştale
1. Prin derogare de la articolul 6.7, Australia, Regatul Unit al Marii Britanii şi Irlandei de Nord, Malaysia şi Noua Zeelanda tratează trimiterile poştei de scrisori sau coletele poştale care poartă mărci poştale fabricate din materiale noi sau prin utilizarea de noi tehnologii incompatibile cu maşinile lor de tratament al curierului unic după un acord prealabil cu operatorii desemnaţi de origine respectivi.
Articolul III
Depunerea în străinătate a trimiterilor poştei de scrisori
1. America (Statele Unite), Australia, Austria, Regatul Unit al Marii Britanii şi Irlandei de Nord, Grecia şi Noua Zeelandă îşi rezervă dreptul de a percepe o taxă, în raport cu costurile de muncă ocazionate, de la orice operator desemnat care, în virtutea articolului 12.4, le returnează obiecte care, la origine, nu au fost expediate ca trimiteri poştale de către serviciile lor.
2. Prin derogare de la articolul 12.4, Canada îşi rezervă dreptul de a percepe de la operatorul desemnat de origine o remuneraţie care să îi permite să recupereze cel puţin costurile care i-au fost ocazionate de prelucrarea unor astfel de trimiteri.
3. Articolul 12.4 autorizează operatorul desemnat de destinaţie să reclame de la operatorul desemnat de depunere o remuneraţie corespunzătoare pentru distribuirea de trimiteri din poşta de scrisori depuse în străinătate în cantitate mare. Australia şi Regatul Unit al Marii Britanii şi Irlandei de Nord îşi rezervă dreptul de a limita această plată la suma corespunzătoare tarifului intern al ţării de destinaţie, aplicabil trimiterilor echivalente.
4. Articolul 12.4 autorizează operatorul desemnat de destinaţie să reclame de la operatorul desemnat de depunere o remuneraţie corespunzătoare pentru distribuirea trimiterilor poştei de scrisori depuse în străinătate în cantitate mare. Următoarele Ţări-membre îşi rezervă dreptul să limiteze această plată la limitele autorizate în Regulament pentru curierul în număr: America (Statele Unite), Bahamas, Barbados, Brunei Darussalam, China (Rep. Pop.), Regatul Unit al Marii Britanii şi Irlandei de Nord, Teritoriile de dincolo de mare dependente de Regatul Unit, Grenada, Guyana, India, Malaysia, Nepal, Noua Zeelandă, Olanda, Antilele olandeze şi Aruba, St. Lucia, Saint-Vincent şi Grenadine, Singapore, Sri Lanka, Surinam şi Tailanda.
5. Contrar rezervelor de la paragraful 4, următoarele Ţări-membre îşi rezervă dreptul de a aplica integral dispoziţiile articolului 12 al Convenţiei poştei primite din Ţările-membre ale Uniunii: Germania, Arabia Saudită, Argentina, Australia, Austria, Azerbaidjan, Benin, Brazilia, Burkina Faso, Camerun, Canada, Cipru, Coasta de Fildeş (Rep.), Danemarca, Egipt, Franţa, Grecia, Guineea, Iran (Rep. islamică), Israel, Italia, Japonia, Iordania, Liban, Luxemburg, Mali, Maroc, Mauritania, Monaco, Norvegia, Pakistan, Portugalia, Federaţia Rusă, Senegal, Elveţia, Siria (Rep. arabă), Togo şi Turcia.
6. În scopul aplicării articolului 12.4, Germania îşi rezervă dreptul de a solicita de la ţara de depunere a trimiterilor o remuneraţie cu o valoare echivalentă celei pe care ea ar primi-o de la ţara în care expeditorul este rezident.
7. În ciuda rezervelor făcute articolului XII, China (Rep. Pop.) îşi rezerva dreptul de a limita orice plată pentru distribuţia trimiterilor poştei de scrisori depuse în străinătate în cantitate mare, la limitele autorizate de Convenţia UPU şi Regulamentul pentru curierul în număr.
8. În ciuda dispoziţiilor articolului 12.3, Germania, Austria, Regatul Unit al Marii Britanii şi Irlandei de Nord, Liechtenstein şi Elveţia îşi rezervă dreptul de a cere expeditorului şi, în lipsa acestuia, operatorului desemnat de depunere, plata tarifelor interne.
Articolul IV
Taxe
1. Prin derogare de la articolul 15, Australia, Belarus, Canada şi Noua Zeelandă sunt autorizate să perceapă taxe poştale altele decât cele prevăzute în Regulament, atunci când taxele respective sunt admisibile conform legislaţiei ţării lor.
2. Prin derogarea de la articolul 15, Brazilia este autorizată să perceapă o taxă suplementară de la destinatarii ce primesc trimiteri ordinare conţinând mărfuri şi care au trebuit să fie transformate în trimiteri care fac obiectul unei urmăriri în temeiul exigenţelor în domeniul vamal şi al securităţii.
Articolul V
Excepţie de la scutirea de taxe poştale în favoarea trimiterilor pentru nevăzători
1. Prin derogare de la articolul 16, Indonezia, Saint-Vincent-şi-Grenadine şi Turcia, care nu acordă în serviciul lor intern scutirea de francare poştală a trimiterilor pentru nevăzători, au posibilitatea de a percepe taxele de francare şi taxele pentru serviciile speciale, care nu pot fi totuşi superioare celor din serviciul lor intern.
2. Franţa va aplica prevederile articolul 16 privind trimiterile pentru nevăzători sub rezerva reglementării sale naţionale.
3. Prin derogare de la articolul 16.3 şi în conformitate cu legislaţia sa internă, Brazilia îşi rezervă dreptul de a lua în considerare ca trimiterile pentru nevăzători doar cele la care expeditorul şi destinatarul sunt orbi sau organizaţii pentru nevăzători. Trimiterile care nu îndeplinesc aceste condiţii vor fi supuse la plata taxelor poştale.
4. Prin derogare de la articolul 16, Noua Zeelanda va accepta să distribuie în Noua Zeelandă doar acele trimiteri pentru nevăzători care sunt scutite de taxe poştale în serviciul său intern.
5. Prin derogare de la articolul 16, Finlanda, care nu acordă scutiri de la plata taxelor poştale referitoare la trimiterile pentru nevăzători în serviciul său intern astfel cum sunt definite la articolul 16, adoptate de Congres, este în drept să perceapă taxe în regimul intern pentru trimiterile pentru nevăzători cu destinaţia în străinătate.
6. Prin derogare de la articolul 16, Canada, Danemarca şi Suedia acordă scutiri de la plata taxelor poştale referitoare la trimiterile pentru nevăzători numai în măsura în care legislaţia lor internă permite acest lucru.
7. Prin derogare de la articolul 16, Islanda acordă scutiri de la plata taxelor poştale referitoare la trimiterile pentru nevăzători numai în limitele prevăzute de legislaţia sa internă.
8. Prin derogare de la articolul 16, Australia va accepta să distribuie în Australia doar acele trimiteri pentru nevăzători care sunt scutite de taxe poştale în serviciul său intern.
9. Prin derogare de la articolul 16, Germania, America (Statele Unite), Australia, Austria, Azerbaidjan, Canada, Regatul Unit al Marii Britanii şi Irlandei de Nord, Japonia şi Elveţia au posibilitatea de a percepe taxele pentru serviciile speciale care sunt aplicate trimiterilor pentru nevăzători în serviciul lor intern.
Articolul VI
Servicii de bază
1. Contrar dispoziţiilor articolului 17, Australia nu aprobă extinderea serviciilor de bază la coletele poştale.
2. Dispoziţiile articolului 17.2.4 nu se aplică Regatul Unit al Marii Britanii şi Irlandei de Nord, a cărei legislaţie naţională impune o limită de greutate inferioară. Legislaţia referitoare la sănătate şi securitate în Regatul Unit al Marii Britanii şi Irlandei de Nord limitează la 20 de kilograme greutatea sacilor cu poştă.
3. Prin derogare de la articolul 17.2.4, Azerbaidjan, Kazahstan, Kîrghizstan, Uzbekistan sunt autorizate să limiteze la 20 kg greutatea maximă a sacilor M de intrare şi de ieşire.
Articolul VII
Confirmare de primire
1. Canada şi Suedia sunt autorizate să nu aplice articolul 18.3.3 în ceea ce priveşte coletele, dat fiind că ele nu oferă serviciul de confirmare de primire pentru colete în regimul lor intern.
2. Prin derogare de la articolul 18.3.3, Danemarca şi Regatul Unit al Marii Britanii şi Irlandei de Nord îşi rezervă dreptul de a nu accepta confirmarea de primire de intrare, dat fiind faptul că acestea nu oferă serviciul de confirmare de primire în regimul lor interior.
3. Prin derogare de la articolul 18.3.3, Brazilia este autorizată de a nu admite conformările de recepţie sosite decât în cazul când acestea pot fi returnate pe cale electronică.
Articolul VIII
Interdicţii (poşta de scrisori)
1. În mod excepţional, Liban şi Republica Populară Democrată Coreeană nu acceptă trimiteri recomandate care conţin monede sau bancnote sau orice valoare la purtător sau cecuri de călătorie sau platină, aur sau argint, prelucrate sau nu, pietre preţioase, bijuterii şi alte obiecte preţioase. Ele nu sunt obligate prin dispoziţiile Regulamentului, într-un mod riguros, în ceea ce priveşte responsabilitatea lor în caz de spoliere sau de avarie a trimiterilor recomandate, la fel şi pentru trimiterile care conţin obiecte din sticlă sau fragile.
2. Cu titlu excepţional, Arabia Saudită, Bolivia, China (Rep. Pop.), cu excepţia regiunii administrative speciale Hong Kong, Irak, Nepal, Pakistan, Sudan şi Vietnam nu acceptă trimiteri recomandate conţinând monede, bilete de bancă, bancnote sau valori la purtător, cecuri de călătorie, platină, aur, argint, prelucrate sau nu, pietre preţioase, bijuterii şi alte obiecte preţioase.
3. Myanmar îşi rezervă dreptul de a nu accepta trimiteri cu valoare declarată conţinând obiectele preţioase menţionate la articolul 19.6, pentru că legislaţia sa internă se opune admiterii acestui gen de trimiteri.
4. Nepal nu acceptă trimiteri recomandate sau cu valoare declarată conţinând monede sau bancnote, fără un acord special încheiat în acest caz.
5. Uzbekistan nu acceptă trimiteri recomandate sau cu valoare declarată care conţin monede, bancnote, cecuri, mărci poştale sau monede străine şi îşi declină orice responsabilitate în caz de pierdere sau de avarie a acestui gen de trimiteri.
6. Iran (Republica Islamică) nu acceptă trimiteri care conţin obiecte ce contravin religiei islamice şi îşi rezervă dreptul de a nu accepta trimiterile poştei de scrisori (simple, recomandate, cu valoare declarată) care conţin monede, bancnote, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase, bijuterii sau alte obiecte de valoare, şi declină orice responsabilitate pentru pierderi sau deteriorare a unor astfel de trimiteri.
7. Filipine îşi rezervă dreptul de a nu accepta trimiteri din poşta de scrisori (simple, recomandate sau cu valoare declarată) care conţin monede, bancnote sau orice valoare la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase sau alte obiecte preţioase.
8. Australia nu acceptă nici o trimitere poştală care conţine lingouri sau bilete de bancă. În plus, ea nu acceptă trimiterile recomandate având ca destinaţie Australia, nici trimiterile în tranzit deschis care conţin obiecte de valoare, precum bijuterii, metale preţioase, pietre preţioase sau semi-preţioase, titluri, monede sau alte efecte negociabile. Ea îşi declină orice responsabilitate în ceea ce priveşte trimiterile depuse şi care violează prezenta rezervă.
9. China (Rep. Pop.), exceptând regiunea administrativă specială Hong Kong, nu acceptă trimiteri cu valoare declarată care conţin monede, bancnote, bilete de bancă, valori la purtător sau cecuri de călătorie, în conformitate cu reglementările sale interne.
10. Letonia şi Mongolia îşi rezervă dreptul de a nu accepta trimiteri simple, recomandate sau cu valoare declarată care conţin monede, bancnote, valori la purtător şi cecuri de călătorie, dat fiind că legislaţia lor naţională se opune acestui lucru.
11. Brazilia îşi rezervă dreptul de a nu accepta curierul simplu, recomandat sau cu valoare declarată ce conţine monede, bancnote în circulaţie şi orice valori la purtător.
12. Vietnam îşi rezervă dreptul de a nu accepta scrisori conţinând obiecte şi mărfuri.
13. Indonezia nu acceptă trimiteri recomandate sau cu valoare declarată care conţin monede, bancnote, cecuri, mărci poştale, valută străină sau valori la purtător şi declină orice responsabilitate pentru pierderea sau deteriorarea acestor trimiteri.
14. Kârghâzstan îşi rezervă dreptul de a nu accepta trimiterile poştei de scrisori (simple, recomandate sau cu valoarea declarată şi pachete mici) care conţin monede, bancnote sau valori la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase, bijuterii şi alte obiecte de valoare. El declină orice responsabilitate pentru pierdere sau deteriorare a astfel de trimiteri.
15. Azerbaidjan şi Kazahstan nu acceptă trimiteri recomandate sau cu valoare declarată care conţin monede, bilete de bancă, bancnote sau orice valoare la purtător, cecuri, metale preţioase, fabricate sau nu, pietre preţioase, bijuterii şi alte obiecte preţioase, precum şi valută străină şi declină orice responsabilitate pentru pierdere sau deteriorare a astfel de trimiteri.
16. Moldova şi Rusia (Federaţia) nu acceptă trimiteri recomandate şi cele cu valoare declarată care conţin bancnote în circulaţie titluri de valoare (cecuri) la purtător sau valută străină şi declină orice responsabilitate pentru pierderea sau deteriorare a astfel de trimiteri.
17. Fără a aduce atingere articolului 19.3, Franţa îşi rezervă dreptul de a refuza trimiterile care conţin mărfuri în cazul în care aceste trimiteri nu sunt în conformitate cu reglementările sale naţionale sau cu reglementările internaţionale sau cu instrucţiunile tehnice de ambalare referitoare la transportul aerian.
18. Cuba îşi rezervă dreptul de a nu accepta, prelucra, îndruma sau distribui trimiteri ale poştei de scrisori ce conţin monede, bilete de bancă, bancnote sau orice valoare la purtător, cecuri, metale preţioase, fabricate sau nu, pietre preţioase, bijuterii şi alte obiecte preţioase, precum şi orice tip de documente, mărfuri sau obiecte, dacă aceste trimiteri nu sunt conforme cu legislaţia sa naţională, legislaţiei internaţionale sau instrucţiunilor tehnice şi de ambalaj legate de transportul aerian şi declină orice responsabilitate în caz de spoliere, de pierdere sau avariere a acestui tip de trimiteri. Cuba îşi rezervă dreptul de a nu accepta trimiteri a poştei de scrisori pasibile de drepturi vamale ce conţin mărfuri importate în ţară dacă valoarea lor nu este conformă legislaţiei sale naţionale.
Articolul IX
Interdicţii (colete poştale)
1. Myanmar şi Zambia sunt autorizate să nu accepte colete cu valoare declarată ce conţin obiectele preţioase menţionate în articolul 19.6.1.3.1, dat fiind că reglementările lor interne se opun acestui lucru.
2. În mod excepţional, Liban şi Sudan nu acceptă colete care conţin monede, bancnote, şi orice tip de valori la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase şi alte obiecte preţioase, sau care conţin lichide şi elemente uşor lichefiabile sau obiecte din sticlă sau asemănătoare sau fragile. Ele nu sunt obligate să respecte dispoziţiile respective din Regulament.
3. Brazilia este autorizată să nu accepte colete cu valoare declarată care conţin monede şi bancnote în circulaţie, precum şi orice valoare la purtător, dat fiind că reglementările sale interne se opun acestui lucru.
4. Ghana este autorizată să nu accepte colete cu valoare declarată care conţin monede sau bancnote în circulaţie, dat fiind că reglementările sale interne se opun acestui lucru.
5. În plus faţă de obiectele menţionate în articolul 19, Arabia Saudită nu acceptă colete care conţin monede, bancnote sau valori la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre şi alte obiecte preţioase. Ea nu acceptă nici colete care conţin medicamente de orice fel, decât dacă ele sunt însoţite de o reţetă medicală emisă de o autoritate oficială competentă, nu acceptă nici produse destinate stingerii focului, lichide chimice sau obiecte care contravin principiilor religiei islamice.
6. În afara obiectelor citate în articolul 19, Oman nu acceptă colete ce conţin:
6.1 medicamente de orice tip, decât dacă ele sunt însoţite de o reţetă medicală emisă de o autoritate medicală competentă;
6.2 produse destinate stingerii focului şi lichide chimice;
6.3 obiecte ce contravin principiilor religiei islamice.
7. În afară de obiectele citate la articolul 19, Iran (Republica Islamică) este autorizată să nu accepte colete ce conţin obiectele care contravin principiilor religiei islamice şi îşi rezervă dreptul de a nu accepta colete ordinare sau cu valoarea declarată care conţin monede, bancnote, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase, bijuterii sau alte obiecte de valoare, şi declină orice responsabilitate pentru pierderi sau deteriorare a unor astfel de trimiteri.
8. Filipine este autorizată să nu accepte colete care conţin monede, bancnote sau orice valoare la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase sau alte obiecte preţioase sau ce conţin lichide şi elemente uşor lichefiabile sau obiecte din sticlă sau asimilabile sau fragile.
9. Australia nu acceptă nici o trimitere poştală conţinând lingouri sau bancnote.
10. China (Rep. Pop.) nu acceptă colete ordinare care conţin monede, bancnote sau valori la purtător, cecuri de călătorie, platină, aur sau argint, prelucrate sau nu, pietre preţioase sau alte obiecte preţioase. În plus, mai puţin în ceea ce priveşte Regiunea administrativă specială Hong Kong, coletele cu valoare declarată ce conţin monede, bancnote, valori la purtător sau cecuri de călătorie nu sunt nici ele acceptate.
11. Mongolia îşi rezervă dreptul de a nu accepta, potrivit legislaţiei sale naţionale, colete ce conţin monede, bancnote, titluri la vedere şi cecuri de călătorie.
12. Letonia nu acceptă nici colete ordinar nici colete cu valoare declarată ce conţin monede, bancnote, valori la purtător (cecuri) sau devize străine şi îşi declină orice responsabilitate în caz de pierdere sau de avariere a acestor trimiteri.
13. Moldova, Uzbekistan, Rusia (Federaţia), şi Ucraina nu acceptă colete ordinare şi cele cu valoare declarată care conţin bancnote în circulaţie, titluri de valoare (cecuri) la purtător sau valută străină şi declină orice responsabilitate pentru pierderea sau deteriorare a astfel de trimiteri.
14. Azerbaidjan şi Kazahstan nu acceptă colete ordinare şi cele cu valoare declarată care conţin monede, bancnote sau orice valori la purtător, cecuri, metale preţioase, fabricate sau nu, pietre preţioase, bijuterii şi alte obiecte de valoare, precum şi valută străină şi declină orice responsabilitate pentru pierderea sau deteriorare a astfel de trimiteri.
15. Cuba îşi rezervă dreptul de a nu accepta, prelucra, îndruma sau distribui colete poştale ce conţin monede, bilete de bancă, bancnote sau orice valoare la purtător, cecuri, metale preţioase, fabricate sau nu, pietre preţioase, bijuterii şi alte obiecte preţioase, precum şi orice tip de documente, mărfuri sau obiecte, dacă aceste trimiteri nu sunt conforme cu legislaţia sa naţională, legislaţiei internaţionale sau instrucţiunilor tehnice şi de ambalaj legate de transportul aerian şi declină orice responsabilitate în caz de spoliere, de pierdere sau avariere a acestui tip de trimiteri. Cuba îşi rezervă dreptul de a nu accepta colete poştale pasibile de drepturi vamale ce conţin mărfuri importate în ţară dacă valoarea lor nu este conformă legislaţiei sale naţionale.
Articolul X
Obiecte pasibile de drepturi vamale
1. Cu referire la articolul 19, următoarele Ţări-membre nu acceptă trimiteri cu valoare declarată ce conţin obiecte pasibile de drepturi vamale: Bangladesh şi Salvador.
2. Cu referire la articolul 19, următoarele Ţări-membre nu acceptă scrisori simple şi recomandate ce conţin obiecte pasibile de drepturi vamale: Afganistan, Albania, Azerbaidjan, Belarus, Cambogia, Chile, Columbia, Cuba, El Salvador, Estonia, Kazahstan, Letonia, Moldova, Nepal, Uzbekistan, Peru, Rep. Pop. Dem. Coreeană, Rusia (Federaţia), San Marino, Turkmenistan, Ucraina şi Venezuela (Rep. bolivariană).
3. Cu referire la articolul 19, următoarele Ţări-membre nu acceptă scrisori simple ce conţin obiecte pasibile de drepturi vamale: Benin, Burkina Faso, Coasta de Fildeş (Rep.), Djibouti, Mali şi Mauritania.
4. Contrar dispoziţiilor prevăzute la paragrafele 1-3, trimiterea de seruri, vaccinuri precum şi medicamente de necesitate urgentă care sunt dificil de procurat sunt admise în toate cazurile.
Articolul XI
Taxe de prezentare la vamă
1. Gabon îşi rezervă dreptul de a percepe o taxă de prezentare la vamă de la clienţii săi.
2. Prin derogare de la articolul 20.2, Australia, Brazilia, Canada, Cipru şi Federaţia Rusă îşi rezervă dreptul de a percepe o taxă de prezentare la vamă de la clienţii săi pentru orice trimitere supusă controlului vamal.
3. Prin derogare de la punctul 20.2, Azerbaidjan, Grecia, Pakistan şi Turcia îşi rezervă dreptul de a percepe pentru toate trimiterile prezentate autorităţilor vamale o taxă de prezentare în vamă de la clienţii săi.
4. Congo (Rep.) şi Zambia îşi rezervă dreptul de a percepe o taxă de prezentare la vamă de la clienţi pentru colete.
Articolul XII
Reclamaţii
1. Prin derogare de la articolul 21.2, Arabia Saudită, Capul Verde, Egipt, Gabon, Teritoriile de dincolo de mare dependente de Regatul Unit, Grecia, Iran (Rep. islamică), Kârghâzstan, Mongolia, Myanmar, Uzbekistan, Filipine, Rep. Pop. Dem. Coreeană, Sudan, Siria (Rep. arabă), Ciad, Turkmenistan, Ucraina şi Zambia îşi rezervă dreptul de a percepe o taxă de reclamaţie de la clienţi pentru trimiterile poştei de scrisori.
2. Prin derogare de la articolul 21.2, Argentina, Austria, Azerbaidjan, Ungaria, Lituania, Moldova, Norvegia şi Slovacia îşi rezervă dreptul de a percepe o taxă specială atunci când, cu ocazia unor demersuri întreprinse ca urmare a unei reclamaţii, se dovedeşte că aceasta a fost neîntemeiată.
3. Afganistan, Arabia Saudită, Capul Verde, Congo (Rep.), Egipt, Gabon, Iran (Rep. Islamică), Kârghâzstan, Mongolia, Myanmar, Uzbekistan, Sudan, Surinam, Siria (Rep. arabă), Turkmenistan, Ucraina şi Zambia îşi rezervă dreptul de a percepe o taxă de reclamaţie de la clienţi pentru colete.

Articolul XIV
Tarifele de bază şi dispoziţiile referitoare la costurile de transport aerian
1. Prin derogare de la articolul 33, Australia îşi rezervă dreptul de a aplica tarifele referitoare la transportul aerian pentru furnizarea serviciilor de retur al mărfurilor prin colete, aşa cum este stipulat în Regulament sau în conformitate cu orice alt procedeu, inclusiv cum ar fi acordurile bilaterale.
Articolul XV
Tarife speciale
1. America (Statele Unite), Belgia şi Norvegia au posibilitatea de a percepe pentru coletele par avion cote-părţi teritoriale mai ridicate decât pentru coletele de suprafaţă.
2. Liban este autorizat să perceapă pentru colete până la 1 kilogram taxa aplicabilă coletelor cântărind peste 1 până la 3 kilograme.
3. Panama (Rep.) este autorizată să perceapă 0,20 DST per kilogram pentru colete de suprafaţă transportate pe cale aeriană (S.A.L.) în tranzit.

1. Prin derogare de la dispoziţiile articolului 35.1.6, Australia îşi rezervă dreptul de a aplica cotele-părţi teritoriale de ieşire pentru prestarea serviciului de returnare a mărfurilor prin colete astfel cum este prevăzut în Regulament sau în conformitate cu orice alt procedeu, inclusiv cum ar fi acordurile bilaterale.
Drept pentru care, Plenipotenţiarii de mai jos au redactat prezentul Protocol, care va avea aceeaşi forţă şi aceeaşi valoare ca şi cum dispoziţiile sale ar fi fost incluse în cadrul textului Convenţiei şi l-au semnat într-un exemplar care este depus la Directorul general al Biroului Internaţional. O copie va fi predată fiecărei Părţi de către Biroul Internaţional al Uniunii Poştale Universale.

Universal Postal Convention
The undersigned, plenipotentiaries of the governments of the member countries of the Union, having regard to article 22.3 of the Constitution of the Universal Postal Union concluded at Vienna on 10 July 1964, have by common consent and subject to article 25.4 of the Constitution drawn up in this Convention the rules applicable throughout the international postal service.
Section I
Rules applicable in common throughout
the international postal service
Article 1
Definitions
1 For the purposes of the Universal Postal Convention, the following terms shall have the meanings
defined below:
1.1 letter-post item: item described in and conveyed under the conditions of the Universal Postal Convention and Regulations;
1.2 parcel-post item: item described in and conveyed under the conditions of the Universal Postal Convention and Regulations;
1.3 EMS item: item described in and conveyed under the conditions of the Universal Postal Convention, Regulations and associated EMS instruments;
1.4 documents: a letter-post, parcel-post or EMS item consisting of any piece of written, drawn, printed or digital information, excluding objects of merchandise, whose physical specifications lie within the limits specified in the Regulations;
1.5 goods: a letter-post, parcel-post or EMS item consisting of any tangible and movable object other than money, including objects of merchandise, which does not fall under the definition of "documents" as provided in paragraph 1.4 above and whose physical specifications lie within the limits specified in the Regulations;
1.6 closed mail: labelled receptacle(s) sealed with or without lead, containing postal items;
1.7 misrouted mails: receptacles received at an office of exchange other than the one mentioned on the (receptacle) label;
1.8 personal data: information needed to identify a postal service user;
1.9 mis sent items: items received at an office of exchange meant for an office of exchange in another member country;
1.10 transit charges: remuneration for services rendered by a carrier in the country crossed (designated operator, other service or combination of the two) in respect of the land, sea and/or air transit of letter-post items;
1.11 terminal dues: remuneration owed to the designated operator of the country of destination by the designated operator of the dispatching country in compensation for the costs incurred in the country of destination for letter-post items received;
1.12 designated operator: any governmental or non-governmental entity officially designated by the member country to operate postal services and to fulfil the related obligations arising out of the Acts of the Union on its territory;
1.13 small packet: item conveyed under the conditions of the Convention and the Regulations;
1.14 inward land rate: remuneration owed to the designated operator of the country of destination by the designated operator of the dispatching country in compensation for the costs incurred in the country of destination for parcels received;
1.15 transit land rate: remuneration owed for services rendered by a carrier in the country crossed (designated operator, other service or combination of the two) in respect of the land and/or air transit of parcels through its territory;
1.16 sea rate: remuneration owed for services rendered by a carrier (designated operator, other service or a combination of the two) participating in the sea conveyance of parcels;
1.17 inquiry: a complaint or query relating to the use of a postal service submitted in accordance with the conditions of the Convention and its Regulations;
1.18 universal postal service: the permanent provision of quality basic postal services at all points in a member country's territory, for all customers, at affordable prices;
1.19 transit a decouvert: open transit through an intermediate country, of items whose number or weight does not justify the make-up of closed mails for the destination country.
Article 2
Designation of the entity or entities responsible for fulfilling
the obligations arising from adherence to the Convention
1 Member countries shall notify the International Bureau, within six months of the end of Congress, of the name and address of the governmental body responsible for overseeing postal affairs. Within six months of the end of Congress, member countries shall also provide the International Bureau with the name and address of the operator or operators officially designated to operate postal services and to fulfil the obligations arising from the Acts of the Union on their territory. Between Congresses, member countries shall notify the International Bureau of any changes in the governmental bodies as soon as possible. Any changes with regard to the officially designated operators shall also be notified to the International Bureau as soon as possible, and preferably at least three months prior to the entry into force of the change.
2 When a member country officially designates a new operator, it shall indicate the scope of the postal services that the latter will provide under the Acts of the Union, as well as the operator's geographical coverage on its territory.
Article 3
Universal postal service
1 In order to support the concept of the single postal territory of the Union, member countries shall ensure that all users/customers enjoy the right to a universal postal service involving the permanent provision of quality basic postal services at all points in their territory, at affordable prices.
2 With this aim in view, member countries shall set forth, within the framework of their national postal legislation or by other customary means, the scope of the postal services offered and the requirement for quality and affordable prices, taking into account both the needs of the population and their national conditions.
3 Member countries shall ensure that the offers of postal services and quality standards will be achieved by the operators responsible for providing the universal postal service.
4 Member countries shall ensure that the universal postal service is provided on a viable basis, thus guaranteeing its sustainability.
Article 4
Freedom of transit
1 The principle of the freedom of transit is set forth in article 1 of the Constitution. It shall carry with it the obligation for each member country to ensure that its designated operators forward, always by the quickest routes and the most secure means which they use for their own items, closed mails and a decouvert letter-post items which are passed to them by another designated operator. This principle shall also apply to missent items and misrouted mails.
2 Member countries which do not participate in the exchange of postal items containing infectious substances or radioactive substances shall have the option of not admitting these items in transit a decouvert through their territory. The same shall also apply to printed papers, periodicals, magazines, small packets and M bags the content of which does not satisfy the legal requirements governing the conditions of their publication or circulation in the country crossed.
3 Freedom of transit for parcels shall be guaranteed throughout the territory of the Union.
4 If a member country fails to observe the provisions regarding freedom of transit, other member countries may discontinue their provision of postal services with that member country.
Article 5
Ownership of postal items. Withdrawal from the post. Alteration or correction of address and/or name of the addressee (name of the legal person, or family name, given name or patronymic (if any)). Redirection. Return to sender of undeliverable items
1 A postal item shall remain the property of the sender until it is delivered to the rightful owner, except when the item has been seized in pursuance of the national legislation of the country of origin or destination and, in case of application of article 19.2.1.1 or 19.3, in accordance with the national legislation of the country of transit.
2 The sender of a postal item may have it withdrawn from the post or have its address and/or the name of the addressee (name of the legal person, or family name, given name or patronymic (if any)) altered or corrected. The charges and other conditions are laid down in the Regulations.
3 Member countries shall ensure that their designated operators redirect postal items if an address eehas changed his address, and return undeliverable items to the sender. The charges and other conditions are laid down in the Regulations.
Article 6
Postage stamps
1 The term "postage stamp" shall be protected under the present Convention and shall be reserved exclusively for stamps which comply with the conditions of this article and of the Regulations.
2 Postage stamps:
2.1 shall be issued and put into circulation solely under the authority of the member country or territory, in conformity with the Acts of the Union;
2.2 are a manifestation of sovereignty and constitute proof of prepayment of the postage corresponding to their intrinsic value when affixed to postal items, in conformity with the Acts of the Union;
2.3 must be in circulation, for postal prepayment or for philatelic purposes, in the member country or territory of issue, according to its national legislation;
2.4 must be accessible to all citizens within the member country or territory of issue.
3 Postage stamps comprise:
3.1 the name of the member country or territory of issue, in roman letters, or, if the UPU International Bureau is so requested by the member country or territory of issue, the abbreviation or initials officially representing the member country or territory of issue, in accordance with the conditions laid down in the Regulations;1
3.2 the face value, expressed:
3.2.1 in principle, in the official currency of the country or territory of issue, or as a letter or symbol;
3.2.2 through other identifying characteristics.

1 An exception shall be granted to the United Kingdom of Great Britain and Northern Ireland, the country which invented the postage stamp.
4 Emblems of state, official control marks and logos of intergovernmental organizations featuring on
postage stamps shall be protected within the meaning of the Paris Convention for the Protection of Industrial Property.
5 The subjects and designs of postage stamps shall:
5.1 be in keeping with the spirit of the Preamble to the UPU Constitution and with decisions taken by the Union's bodies;
5.2 be closely linked to the cultural identity of the member country or territory, or contribute to the dissemination of culture or to maintaining peace;
5.3 have, when commemorating leading figures or events not native to the member country or territory, a close bearing on the country or territory in question;
5.4 be devoid of political character or of any topic of an offensive nature in respect of a person or a country;
5.5 be of major significance to the member country or territory.
6 Postal prepayment impressions, franking machine impressions and impressions made by a printingpress or another printing or stamping process in accordance with the Acts of the Union may be used only with the authorization of the member country or territory.
7 Prior to issuing postage stamps using new materials or technologies, member countries shall provide the International Bureau with the necessary information concerning their compatibility with mail processing machines. The International Bureau shall inform the other member countries and their designated operators accordingly.
Article 7
Sustainable development
1 Member countries and/or their designated operators shall adopt and implement a proactive sustainable development strategy focusing on environmental, social and economic action at all levels of postal operations and promote sustainable development awareness.
Article 8
Postal security
1 Member countries and their designated operators shall observe the security requirements define din the UPU security standards and shall adopt and implement a proactive security strategy at all levels of postal operations to maintain and enhance the confidence of the general public in the postal services provided by designated operators, in the interests of all officials involved. This strategy shall include the objectives defined in the Regulations, as well as the principle of complying with requirements for providing electronic advance data on postal items identified in implementing provisions (including the type of, and criteria for, postal items) adopted by the Council of Administration and Postal Operations Council, in accordance with UPU technical messaging standards. The strategy shall also include the exchange of information on maintaining the safe and secure transport and transit of mails between member countries and their designated operators.
2 Any security measures applied in the international postal transport chain must be commensurate with the risks or threats that they seek to address, and must be implemented without hampering world wide mail flows or trade by taking into consideration the specificities of the mail network. Security measures that have a potential global impact on postal operations must be implemented in an internationally coordinated and balanced manner, with the involvement of the relevant stakeholders.
Article 9
Violations
1 Postal items
1.1 Member countries shall undertake to adopt the necessary measures to prevent, prosecute and punish any person found guilty of the following:
1.1.1 the insertion in postal items of narcotics and psychotropic substances, as well as dangerous goods, where their insertion has not been expressly authorized by the Convention and Regulations;
1.1.2 the insertion in postal items of objects of a paedophilic nature or of a pornographic nature using children.
2 Means of postal prepayment and postal payment itself
2.1 Member countries shall undertake to adopt the necessary measures to prevent, prosecute and punish any violations concerning the means of postal prepayment set out in this Convention, such as:
2.1.1 postage stamps, in circulation or withdrawn from circulation;
2.1.2 prepayment impressions;
2.1.3 impressions of franking machines or printing presses;
2.1.4 international reply coupons.
2.2 In this Convention, violations concerning means of postal prepayment refer to any of the acts outlined below committed by any persons with the intention of obtaining illegitimate gain for oneself or for a third party. The following acts shall be punished:
2.2.1 any act of falsifying, imitating or counterfeiting any means of postal prepayment, or any illegal or unlawful act linked to the unauthorized manufacturing of such items;
2.2.2 manufacture, use, release for circulation, commercialization, distribution, dissemination, transportation, exhibition or display (also in the form of catalogues and for advertising purposes) of any means of postal prepayment which has been falsified, imitated or counterfeited;
2.2.3 any act of using or circulating, for postal purposes, any means of postal prepayment which has already been used;
2.2.4 any attempt to commit any of these violations.
3 Reciprocity
3.1 As regards sanctions, no distinction shall be made between the acts outlined in 2, irrespective of whether national or foreign means of postal prepayment are involved; this provision shall not be subject to any legal or conventional condition of reciprocity.
Article 10
Processing of personal data
1 Personal data on users may be employed only for the purposes for which they were gathered in accordance with applicable national legislation.
2 Personal data on users shall be disclosed only to third parties authorized by applicable national legislation to access them.
3 Member countries and their designated operators shall ensure the confidentiality and security of personal data on users, in accordance with their national legislation.
4 Designated operators shall inform their customers of the use that is made of their personal data, and of the purpose for which they have been gathered.
5 Without prejudice to the foregoing, designated operators may transfer electronically personal data to the designated operators of destination or transit countries that need these data in order to fulfil the service.
Article 11
Exchange of closed mails with military units
1 Closed letter-post mails may be exchanged through the intermediary of the land, sea or air services of other countries:
1.1 between the post offices of any member country and the commanding officers of military units placed at the disposal of the United Nations;
1.2 between the commanding officers of such military units;
1.3 between the post offices of any member country and the commanding officers of naval, air or army units, warships or military aircraft of the same country stationed abroad;
1.4 between the commanding officers of naval, air or army units, warships or military aircraft of the same country.
2 Letter-post items enclosed in the mails referred to under 1 shall be confined to items addressed to or sent by members of military units or the officers and crews of the ships or aircraft to or from which the mails are forwarded. The rates and conditions of dispatch applicable to them shall be fixed, according to its regulations, by the designated operator of the member country which has made the military unit available or to which the ships or aircraft belong.
3 In the absence of special agreement, the designated operator of the member country which has made the military unit available or to which the warships or military aircraft belong shall be liable to the designated operators concerned for the transit charges for the mails, the terminal dues and the air conveyance dues.
Article 12
Posting abroad of letter-post items
1 A designated operator shall not be bound to forward or deliver to the addressee letter-post items which senders residing in the territory of its member country post or cause to be posted in a foreign country with the object of profiting by the more favourable rate conditions there.
2 The provisions set out under 1 shall be applied without distinction both to letter-post items made up in the sender's country of residence and then carried across the frontier and to letter-post items made up in a foreign country.
3 The designated operator of destination may claim from the designated operator of posting, payment of the internal rates. If the designated operator of posting does not agree to pay these rates within a time limit set by the designated operator of destination, the latter may either return the items to the designated operator of posting and shall be entitled to claim reimbursement of the redirection costs, or handle the min accordance with its national legislation.
4 A designated operator shall not be bound to forward or deliver to the addressees letter-post items which senders post or cause to be posted in large quantities in a country other than the country where they reside if the amount of terminal dues to be received is lower than the sum that would have been received if the mail had been posted in the country where the senders reside. The designated operator of destination may claim from the designated operator of posting payment commensurate with the costs incurred and which may not exceed the higher of the following two amounts: either 80% of the domestic tariff for equivalent items, or the rates applicable pursuant to articles 29.5 to 29.11, 29.12 to 29.15, or 30.9, as appropriate. If the designated operator of posting does not agree to pay the amount claimed within a time limit set by the designated operator of destination, the designated operator of destination may either return the items to the designated operator of posting and shall be entitled to claim reimbursement of the redirection costs, or handle them in accordance with its national legislation.
Article 13
Use of UPU forms
1 Unless otherwise provided by the Acts of the Union, only designated operators shall use UPU forms and documentation for the operation of postal services and exchange of postal items in accordance with the Acts of the Union.
2 Designated operators may use UPU forms and documentation for the operation of extraterritorial offices of exchange (ETOEs), as well as international mail processing centers (IMPCs) established by designated operators outside their respective national territory, as further defined in paragraph 6, in order to facilitate the operation of the aforementioned postal services and exchange of postal items.
3 The exercise of the possibility outlined in paragraph 2 shall be subject to the national legislation or policy of the member country or territory in which the ETOE or IMPC is established. In this regard, and without prejudice to the designation obligations contained in article 2, designated operators shall guarantee the continued fulfilment of their obligations under the Convention and be fully responsible for all their relations with other designated operators and with the International Bureau.
4 The requirement set forth in paragraph 3 shall equally apply to the destination member country for the acceptance of postal items from such ETOEs and IMPCs.
5 Member countries shall inform the International Bureau on their policies with regard to postal items transmitted and/or received from ETOEs or IMPCs. Such information shall be ma de available on the Union's website.
6 Strictly for the purposes of this article, ETOEs shall be defined as offices or facilities established for commercial purposes and operated by designated operators or under the responsibility of designated operators on the territory of a member country or territory other than their own, with the objective of drawing business in markets outside their respective national territory. IMPCs shall be defined as international mail processing facilities for the processing of international mail exchange deither in order to generate or receive mail dispatches, or to act as transit centres for international mail exchanged between other designated operators.
7 Nothing in this article shall be construed to imply that ETOEs or IMPCs (including the designated operators responsible for their establishment and operation outside their respective national territory) are in the same situation under the Acts of the Union as designated operators of the host country, nor impose a legal obligation on other member countries to recognize such ETOEs or IMPCs as designated operators on the territory where they are established and operated.
Section II
Quality of service standards and targets
Article 14
Quality of service standards and targets
1 Member countries or their designated operators shall establish and publish delivery standards and targets for their inward letter-post items and parcels.
2 These standards and targets, increased by the time normally required for customs clearance, shall be no less favourable than those applied to comparable items in their domestic service.
3 Member countries or their designated operators of origin shall also establish and publish end-to-end standards for priority and airmail letter-post items as well as for parcels and economy/surface parcels.
4 Member countries or their designated operators shall measure the application of quality of service standards.
Section III
Charges, surcharges and exemption from postal charges
Article 15
Charges
1 The charges for the various postal services defined in the Convention shall be set by the member countries or their designated operators, depending on national legislation, in accordance with the principles set out in the Convention and its Regulations. They shall in principle be related to the costs of providing these services.
2 The member country of origin or its designated operator, depending on national legislation, shall fix the postage charges for the conveyance of letter- and parcel-post items. The postage charges shall cover delivery of the items to the place of address provided that this delivery service is operated in the country of destination for the items in question.
3 The charges collected, including those laid down for guideline purposes in the Acts, shall be at least equal to those collected on internal service items presenting the same characteristics (category, quantity, handling time, etc.).
4 Member countries or their designated operators, depending on national legislation, shall be authorized to exceed any guideline charges appearing in the Acts.
5 Above the minimum level of charges laid down in 3, member countries or their designated operators may allow reduced charges based on their national legislation for letter-post items and parcels posted in the territory of the member country. They may, for instance, give preferential rates to major users of the Post.
6 No postal charge of any kind may be collected from customers other than those provided for in the Acts.
7 Except where otherwise provided in the Acts, each designated operator shall retain the charges which it has collected.
Article 16
Exemption from postal charges
1 Principle
1.1 Cases of exemption from postal charges, as meaning exemption from postal prepayment, shall be expressly laid down by the Convention. Nonetheless, the Regulations may provide for exemption from postal prepayment, transit charges, terminal dues and inward rates for letter-post items and postal parcels sent by member countries, designated operators and Restricted Unions and relating to the postal services. Furthermore, letter-post items and postal parcels sent by the UPU International Bureau to Restricted Unions, member countries and designated operators shall be exempted from all postal charges. However, the member country of origin or its designated operators hall have the option of collecting air surcharges on the latter items.
2 Prisoners of war and civilian internees
2.1 Letter-post items, postal parcels and postal payment services items addressed to or sent by prisoners of war, either direct or through the offices mentioned in the Regulations of the Convention and of the Postal Payment Services Agreement, shall be exempt from all postal charges, with the exception of air surcharges. Belligerents apprehended and interned in a neutral country shall be classed with prisoners of war proper so far as the application of the foregoing provisions is concerned.
2.2 The provisions set out under 2.1 shall also apply to letter-post items, postal parcels and postal payment services items originating in other countries and addressed to or sent by civilian internees as defined by the Geneva Convention of 12 August 1949 relative to the protection of civilian persons in time of war, either direct or through the offices mentioned in the Regulations of the Convention and of the Postal Payment Services Agreement.
2.3 The offices mentioned in the Regulations of the Convention and of the Postal Payment Services Agreement shall also enjoy exemption from postal charges in respect of letter-post items, postal parcels and postal payment services items which concern the persons referred to under 2.1 and 2.2, which they send or receive, either direct or as intermediaries.
2.4 Parcels shall be admitted free of postage up to a weight of 5 kilogrammes. The weight limit shall be increased to 10 kilogrammes in the case of parcels the contents of which cannot be split up and of parcels addressed to a camp or the prisoners' representatives there ("hommes de confiance") for distribution to the prisoners.
2.5 In the accounting between designated operators, rates shall not be allocated for service parcelsand for prisoner-of-war and civilian internee parcels, apart from the air conveyance dues applicable to air parcels.
3 Items for the blind
3.1 Any item for the blind sent to or by an organization for the blind or sent to or by a blind person shall be exempt from all postal charges, with the exception of air surcharges, to the extent that the so items are admissible as such in the internal service of the sending designated operator.
3.2 In this article:
3.2.1 a blind person means a person who is registered as blind or partially sighted in his or her country or who meets the World Health Organization's definition of a blind person or a person with low vision;
3.2.2 an organization for the blind means an institution or association serving or officially representing blind persons;
3.2.3 items for the blind shall include correspondence, literature in whatever format including sound recordings, and equipment or materials of any kind made or adapted to assist blind persons in overcoming the problems of blindness, as specified in the Regulations.
Section IV
Basic and supplementary services
Article 17
Basic services
1 Member countries shall ensure that their designated operators accept, handle, convey and deliver letter-post items.
2 Letter-post items containing only documents are:
2.1 priority items and non-priority items, up to 2 kilogrammes;
2.2 letters, postcards and printed papers, up to 2 kilogrammes;
2.3 items for the blind, up to 7 kilogrammes;
2.4 special bags containing newspapers, periodicals, books and similar printed documentation for the same addressee at the same address called "M bags", up to 30 kilogrammes.
3 Letter-post items containing goods are:
3.1 priority and non-priority small packets, up to 2 kilogrammes.
4 Letter-post items shall be classified on the basis of both the speed of treatment of the items and the contents of the items in accordance with the Regulations.
5 Within the classification systems referred to in 4, letter-post items may also be classified on the basis of their format as small letters (P), large letters (G), bulky letters (E) or small packets (E). The size and weight limits are specified in the Regulations.
6 Higher weight limits than those indicated in paragraph 2 apply optionally for certain letter-post item categories under the conditions specified in the Regulations.
7 Member countries shall also ensure that their designated operators accept, handle, convey and deliver parcel-post items up to 20 kilogrammes.
8 Weight limits higher than 20 kilogrammes apply optionally for certain parcel-post items under the conditions specified in the Regulations.
Article 18
Supplementary services
1 Member countries shall ensure the provision of the following mandatory supplementary services:
1.1 registration service for outbound priority and airmail letter-post items;
1.2 registration service for all inbound registered letter-post items.
2 Member countries or their designated operators may provide the following optional supplementary services in relations between those designated operators which agreed to provide the service:
2.1 insurance for letter-post items and parcels;
2.2 cash-on-delivery service for letter-post items and parcels;
2.3 tracked delivery service for letter-post items;
2.4 delivery to the addressee in person of registered or insured letter-post items;
2.5 free of charges and fees delivery service for letter-post items and parcels;
2.6 fragile and cumbersome parcels services;
2.7 consignment service for collective items from one consignor sent abroad;
2.8 merchandise return service, which involves the return of merchandise by the addressee to the original seller, with the latter's authorization.
3 The following three supplementary services have both mandatory and optional parts:
3.1 international business reply service (IBRS), which is basically optional. All member countries or their designated operators shall, however, be obliged to operate the IBRS "return" service;
3.2 international reply coupons, which shall be exchangeable in any member country. The sale of international reply coupons is, however, optional;
3.3 advice of delivery for registered letter-post items, parcels and insured items. All member countries or their designated operators shall admit incoming advices of delivery. The provision of an out ward advice of delivery service is, however, optional.
4 The description of these services and their charges are set out in the Regulations.
5 Where the service features below are subject to special charges in the domestic service, designated operators shall be authorized to collect the same charges for international items, under the conditions described in the Regulations:
5.1 delivery for small packets weighing over 500 grammes;
5.2 letter-post items posted after the latest time of posting;
5.3 items posted outside normal counter opening hours;
5.4 collection at sender's address;
5.5 withdrawal of a letter-post item outside normal counter opening hours;
5.6 poste restante;
5.7 storage for letter-post items weighing over 500 grammes (with the exception of items for the blind), and for parcels;
5.8 delivery of parcels, in response to the advice of arrival;
5.9 cover against risks of force majeure;
5.10 delivery of letter-post items outside normal counter opening hours.
Section V
Prohibitions and customs matters
Article 19
Items not admitted. Prohibitions
1 General
1.1 Items not fulfilling the conditions laid down in the Convention and the Regulations shall not be admitted. Items sent in furtherance of a fraudulent act or with the intention of avoiding full payment of the appropriate charges shall not be admitted.
1.2 Exceptions to the prohibitions contained in this article are set out in the Regulations.
1.3 All member countries or their designated operators shall have the option of extending the prohibitions contained in this article, which may be applied immediately upon their inclusion in the relevant compendium.
2 Prohibitions in all categories of items
2.1 The insertion of the articles referred to below shall be prohibited in all categories of items:
2.1.1 narcotics and psychotropic substances, as defined by the International Narcotics Control Board, or other illicit drugs which are prohibited in the country of destination;
2.1.2 obscene or immoral articles;
2.1.3 counterfeit and pirated articles;
2.1.4 other articles the importation or circulation of which is prohibited in the country of destination;
2.1.5 articles which, by their nature or their packing, may expose officials or the general public to danger, or soil or damage other items, postal equipment or third-party property;
2.1.6 documents having the character of current and personal correspondence exchanged between persons other than the sender and the addressee or persons living with them;
3 Dangerous goods
3.1 The insertion of dangerous goods as described in the Convention and Regulations shall be prohibited in all categories of items.
3.2 The insertion of replica and inert explosive devices and military ordnance, including replica and inert grenades, inert shells and the like, shall be prohibited in all categories of items.
3.3 Exceptionally, dangerous goods may be admitted in relations between member countries that have declared their willingness to admit them either reciprocally or in one direction, provided that they are in compliance with national and international transport rules and regulations.
4 Live animals
4.1 Live animals shall be prohibited in all categories of items.
4.2 Exceptionally, the following shall be admitted in letter-post items other than insured items:
4.2.1 bees, leeches and silk-worms;
4.2.2 parasites and destroyers of noxious insects intended for the control of those insects and exchanged between officially recognized institutions;
4.2.3 flies of the family Drosophilidae for biomedical research exchanged between officially recognized institutions.
4.3 Exceptionally, the following shall be admitted in parcels:
4.3.1 live animals whose conveyance by post is authorized by the postal regulations and/or national legislation of the countries concerned.
5 Insertion of correspondence in parcels
5.1 The insertion of the articles mentioned below shall be prohibited in postal parcels:
5.1.1 correspondence, with the exception of archived materials, exchanged between persons other than the sender and the addressee or persons living with them.
6 Coins, bank notes and other valuable articles
6.1 It shall be prohibited to insert coins, bank notes, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones, jewels or other valuable articles:
6.1.1 in uninsured letter-post items;
6.1.1.1 however, if the national legislation of the countries of origin and destination permits this, such articles may be sent in a closed envelope as registered items;
6.1.2 in uninsured parcels; except where permitted by the national legislation of the countries of origin and destination;
6.1.3 in uninsured parcels exchanged between two countries which admit insured parcels;
6.1.3.1 in addition, any member country or designated operator may prohibit the enclosure of gold bullion in insured or uninsured parcels originating from or addressed to its territory or sent in transit a de couvert across its territory; it may limit the actual value of these items.
7 Printed papers and items for the blind:
7.1 shall not bear any inscription or contain any item of correspondence;
7.2 shall not contain any postage stamp or form of prepayment, whether cancelled or not, or any paperrepresenting a monetary value, except in cases where the item contains as an enclosure a card, envelope or wrapper bearing the printed address of the sender of the item or his agent in the country of posting or destination of the original item, which is prepaid for return.
8 Treatment of items wrongly admitted
8.1 The treatment of items wrongly admitted is set out in the Regulations. However, items containing articles mentioned in 2.1.1,2.1.2, 3.1 and 3.2 shall in no circumstances be forwarded to their destination, delivered to the addressees or returned to origin. In the case of articles mentioned in 2.1.1discovered while in transit, such items shall be handled in accordance with the national legislation of the country of transit. In the case of articles mentioned in 3.1 and 3.2 discovered during transport, the relevant designated operator shall be entitled to remove the article from the item and dispose of it. The designated operator may then forward the remainder of the item to its destination, together with information about the disposal of the inadmissible article.
Article 20
Customs control. Customs duty and other fees
1 The designated operators of the countries of origin and destination shall be authorized to submititems to customs control, according to the legislation of those countries.
2 Items submitted to customs control may be subjected to a presentation-to-Customs charge, the guideline amount of which is set in the Regulations. This charge shall only be collected for the submission to Customs and customs clearance of items which have attracted customs charges or any other similar charge.
3 Designated operators which are authorized to clear items through the Customs on behalf of customers, whether in the name of the customer or of the designated operator of the destination country, may charge customers a customs clearance fee based on the actual costs. This fee may be charged for all items declared at Customs according to national legislation, including those exempt from customs duty. Customers shall be clearly informed in advance about the required fee.
4 Designated operators shall be authorized to collect from the senders or addressees of items, as the case may be, the customs duty and all other fees which may be due.
Section VI
Liability
Article 21
Inquiries
1 Each designated operator shall be bound to accept inquiries relating to parcels or registered or insured items posted in its own service or that of any other designated operator, provided that the in quiriesare presented by customers within a period of six months from the day after that on which the item was posted. The transmission and processing of inquiries between designated operators shall be made under the conditions laid down in the Regulations. The period of six months shall concern relations between claimants and designated operators and shall not include the transmission of inquiries between designated operators.
2 Inquiries shall be free of charge. However, additional costs caused by a request for transmission by EMS shall, in principle, be borne by the person making the request.
Article 22
Liability of designated operators. Indemnities
1 General
1.1 Except for the cases provided for in article 23, designated operators shall be liable for:
1.1.1 the loss of, theft from or damage to registered items, ordinary parcels (with the exception of parcels in the e-commerce delivery category ("ECOMPRO parcels"), whose specifications are further defined in the Regulations) and insured items;
1.1.2 the return of registered items, insured items and ordinary parcels on which the reason for non delivery is not given.
1.2 Designated operators shall not be liable for items other than those mentioned in 1.1.1 and 1.1.2,nor for ECOMPRO parcels.
1.3 In any other case not provided for in this Convention, designated operators shall not be liable.
1.4 When the loss of or total damage to registered items, ordinary parcels and insured items is due to a case of force majeure for which indemnity is not payable, the sender shall be entitled to repayment of the charges paid for posting the item, with the exception of the insurance charge.
1.5 The amounts of indemnity to be paid shall not exceed the amounts mentioned in the Regulations.
1.6 In cases of liability, consequential losses, loss of profits or moral damage shall not be taken into account in the indemnity to be paid.
1.7 All provisions regarding liability of designated operators shall be strict, binding and complete. Designated operators shall in no case, even in case of severe fault, be liable above the limits provided for in the Convention and the Regulations.
2 Registered items
2.1 If a registered item is lost, totally rifled or totally damaged, the sender shall be entitled to an indemnity set in the Regulations. If the sender has claimed an amount less than the amount set in the Regulations, designated operators may pay that lower amount and shall receive reimbursement on this basis from any other designated operators involved.
2.2 If a registered item is partially rifled or partially damaged, the sender is entitled to an indemnity corresponding, in principle, to the actual value of the theft or damage.
3 Ordinary parcels
3.1 If a parcel is lost, totally rifled or totally damaged, the sender shall be entitled to an indemnity of an amount set in the Regulations. If the sender has claimed an amount less than the amount set in the Regulations, designated operators may pay that lower amount and shall receive reimbursement on this basis from any other designated operators involved.
3.2 If a parcel is partially rifled or partially damaged, the sender shall be entitled to an indemnity corresponding, in principle, to the actual value of the theft or damage.
3.3 Designated operators may agree to apply, in their reciprocal relations, the amount per parcel set in the Regulations, regardless of the weight.
4 Insured items
4.1 If an insured item is lost, totally rifled or totally damaged, the sender shall be entitled to an indemnity corresponding, in principle, to the insured value in SDRs.
4.2 If an insured item is partially rifled or partially damaged, the sender shall be entitled to an indemnity corresponding, in principle, to the actual value of the theft or damage. It may, however, in no case exceed the amount of the insured value in SDRs.
5 If a registered or insured letter-post item is returned and the reason for non-delivery is not given, the sender shall be entitled to a refund of the charges paid for posting the item only.
6 If a parcel is returned and the reason for non-delivery is not given, the sender shall be entitled to are fund of the charges paid by the sender for posting the parcel in the country of origin and the expenses occasioned by the return of the parcel from the country of destination.
7 In the cases mentioned in 2, 3 and 4, the indemnity shall be calculated according to the current price, converted into SDRs, of articles or goods of the same kind at the place and time at which the item was accepted for conveyance. Failing a current price, the indemnity shall be calculated according to the ordinary value of articles or goods whose value is assessed on the same basis.
8 When an indemnity is due for the loss of, total theft from or total damage to a registered item, ordinary parcel or insured item, the sender, or the addressee, as the case may be, shall also be entitled to repayment of the charges and fees paid for posting the item with the exception of the registration or insurance charge. The same shall apply to registered items, ordinary parcels or insured items refused by the addressee because of their bad condition if that is attributable to the designated operator and involves its liability.
9 Notwithstanding the provisions set out under 2, 3 and 4, the addressee shall be entitled to the indemnity for a rifled, damaged or lost registered item, ordinary parcel or insured item if the sender waives his rights in writing in favour of the addressee. This waiver shall not be necessary in cases where the sender and the addressee are the same.
10 The designated operator of origin shall have the option of paying senders in its country the indemnities prescribed by its national legislation for registered items and uninsured parcels, provided that they are not lower than those laid down in 2.1 and 3.1. The same shall apply to the designated operator of destination when the indemnity is paid to the addressee. However, the amounts laid down in 2.1 and 3.1 shall remain applicable:
10.1 in the event of recourse against the designated operator liable; or
10.2 if the sender waives his rights in favour of the addressee.
11 Reservations concerning the exceeding of deadlines for inquiries and payment of indemnity to designated operators, including the periods and conditions fixed in the Regulations, shall not be made, except in the event of bilateral agreement.
Article 23
Non-liability of member countries and designated operators
1 Designated operators shall cease to be liable for registered items, parcels and insured items which they have delivered according to the conditions laid down in their regulations for items of the same kind. Liability shall, however, be maintained:
1.1 when theft or damage is discovered either prior to or at the time of delivery of the item;
1.2 when, national regulations permitting, the addressee, or the sender if it is returned to origin, makes reservations on taking delivery of a rifled or damaged item;
1.3 when, national regulations permitting, the registered item was delivered to a private mail-box and the addressee declares that he did not receive the item;
1.4 when the addressee or, in the case of return to origin, the sender of a parcel or of an insured item, although having given a proper discharge, notifies the designated operator that delivered the item without delay that he has found theft or damage. He shall furnish proof that such theft or dam agedid not occur after delivery. The term "without delay" shall be interpreted according to national law.
2 Member countries and designated operators shall not be liable:
2.1 in cases of force majeure, subject to article 18.5.9;
2.2 when they cannot account for items owing to the destruction of official records by force majeure, provided that proof of their liability has not been otherwise produced;
2.3 when such loss or damage has been caused by the fault or negligence of the sender or arises from the nature of the contents;
2.4 in the case of items that fall within the prohibitions specified in article 19;
2.5 when the items have been seized under the national legislation of the country of destination, as notified by the member country or designated operator of that country;
2.6 in the case of insured items which have been fraudulently insured for a sum greater than the actual value of the contents;
2.7 when the sender has made no inquiry within six months from the day after that on which the item was posted;
2.8 in the case of prisoner-of-war or civilian internee parcels;
2.9 when the sender's actions may be suspected of fraudulent intent, aimed at receiving compensation.
3 Member countries and designated operators shall accept no liability for customs declarations in whatever form these are made or for decisions taken by the Customs on examination of items submitted to customs control.
Article 24
Sender's liability
1 The sender of an item shall be liable for injuries caused to postal officials and for any damage
caused to other postal items and postal equipment, as a result of the dispatch of articles not acceptable for conveyance or the non-observance of the conditions of acceptance.
2 In the case of damage to other postal items, the sender shall be liable for each item damaged within the same limits as designated operators.
3 The sender shall remain liable even if the office of posting accepts such an item.
4 However, where the conditions of acceptance have been observed by the sender, the sender shall not be liable, in so far as there has been fault or negligence in handling the item on the part of designated operators or carriers, after acceptance.
Article 25
Payment of indemnity
1 Subject to the right of recourse against the designated operator which is liable, the obligation to pay the indemnity and to refund the charges and fees shall rest either with the designated operator of origin or with the designated operator of destination.
2 The sender may waive his rights to the indemnity in favour of the addressee. The sender, or the addressee in the case of a waiver, may authorize a third party to receive the indemnity if national legislation allows this.
Article 26
Possible recovery of the indemnity from the sender or the addressee
1 If, after payment of the indemnity, a registered item, a parcel or an insured item or part of the contents previously considered as lost is found, the sender or the addressee, as the case may be, shall be advised that the item is being held at his disposal for a period of three months on repayment of the amount of the indemnity paid. At the same time he shall be asked to whom the item is to be delivered. In the event of refusal or failure to reply within the prescribed period, the same approach shall be made to the addressee or the sender as the case may be, granting that person the same period to reply.
2 If the sender and the addressee refuse to take delivery of the item or do not reply within the period provided for in paragraph 1, it shall become the property of the designated operator or, where appropriate, designated operators which bore the loss.
3 In the case of subsequent discovery of an insured item the contents of which are found to be of less value than the amount of the indemnity paid, the sender or the addressee, as the case may be, shall repay the amount of this indemnity against return of the item, without prejudice to the consequences off raudulent insurance.
Section VII
Remuneration
A. Transit charges
Article 27
Transit charges
1 Closed mails and a decouvert transit items exchanged between two designated operators or between two offices of the same member country by means of the services of one or more other designated operators (third party services) shall be subject to the payment of transit charges. The latter shall constitute remuneration for the services rendered in respect of land transit, sea transit and air transit. This principle shall also apply to missent items and misrouted mails.
B. Terminal dues
Article 28
Terminal dues. General provisions
1 Subject to exemptions provided in the Regulations, each designated operator which receives letter-post items from another designated operator shall have the right to collect from the dispatching designated operator a payment for the costs incurred for the international mail received.
2 For the application of the provisions concerning the payment of terminal dues by their designated operators, countries and territories shall be classified in accordance with the lists drawn up for this purpose by Congress in its resolution C 7/2016, as follows:
2.1 countries and territories in the target system prior to 2010 (group I);
2.2 countries and territories in the target system as of 2010 and 2012 (group II);
2.3 countries and territories in the target system as from 2016 (group III);
2.4 countries and territories in the transitional system (group IV).
3 The provisions of the present Convention concerning the payment of terminal dues are transitional arrangements, moving towards a country-specific payment system at the end of the transition period.
4 Access to domestic services. Direct access
4.1 In principle, each designated operator of a country that was in the target system prior to 2010 shall make available to the other designated operators all the rates, terms and conditions offered in its domestic service on conditions identical to those proposed to its national customers. It shall be up to the designated operator of destination to decide whether the terms and conditions of direct access have been met by the designated operator of origin.
4.2 Designated operators of countries in the target system prior to 2010 shall make available to other designated operators of countries that were in the target system prior to 2010 the rates, terms and conditions offered in their domestic service, on conditions identical to those proposed to their national customers.
4.3 Designated operators of countries that joined the target system from 2010 may opt to make available to a limited number of designated operators the application of domestic conditions, on a reciprocal basis, for a trial period of two years. After that period, they must choose either to cease making available the application of domestic conditions or to continue to make their own domestic conditions available to all designated operators. However, if designated operators of countries that joined the target system from 2010 ask designated operators of countries that were in the target system prior to 2010 for the application of domestic conditions, they must make available to all designated operators the rates, terms and conditions offered in their domestic service on conditions identical to those proposed to their national customers.
4.4 Designated operators of countries in the transitional system may opt not to make available to other designated operators the application of domestic conditions. They may, however, opt to make available to a limited number of designated operators the application of domestic conditions, on are ciprocal basis, for a trial period of two years. After that period, they must choose either to cease making available the application of domestic conditions or to continue to make their own domestic conditions available to all designated operators.
5 Terminal dues remuneration shall be based on quality of service performance in the country of destination. The Postal Operations Council shall therefore be authorized to supplement the remuneration in articles 29 and 30 to encourage participation in monitoring systems and to reward designated operators for reaching their quality targets. The Postal Operations Council may also fix penalties in case of insufficient quality, but the remuneration shall not be less than the minimum remuneration according to articles 29and 30.
6 Any designated operator may waive wholly or in part the payment provided for under 1.
7 M bags weighing less than 5 kilogrammes shall be considered as weighing 5 kilogrammes for terminal dues payment purposes. The terminal dues rates to be applied for M bags shall be:
7.1 for the year 2018, 0.909 SDR per kilogramme;
7.2 for the year 2019, 0.935 SDR per kilogramme;
7.3 for the year 2020, 0.961 SDR per kilogramme;
7.4 for the year 2021, 0.988 SDR per kilogramme.
8 For registered items there shall be an additional payment of 1.100 SDR per item for 2018, 1.200SDR per item for 2019, 1.300 SDR per item for 2020 and 1.400 SDR for 2021. For insured items, there shall be an additional payment of 1.400 SDR per item for 2018, 1.500 SDR per item for 2019, 1.600 SDR per item for 2020 and 1.700 SDR for 2021. The Postal Operations Council shall be authorized to supplement remuneration for these and other supplementary services where the services provided contain additional features to be specified in the Regulations.
9 For registered and insured items not carrying a bar coded identifier or carrying a bar coded identifier that is not compliant with UPU Technical Standard S10, there shall be a further additional payment of 0.5 SDR per item unless otherwise bilaterally agreed.
10 For terminal dues payment purposes, letter-post items posted in bulk by the same sender and received in the same dispatch or in separate dispatches in accordance with the conditions specified in the Regulations shall be referred to as "bulk mail". The payment for bulk mail shall be established as provided for in articles 29 and 30.
11 Any designated operator may, by bilateral or multilateral agreement, apply other payment systems for the settlement of terminal dues accounts.
12 Designated operators may exchange non-priority mail on an optional basis by applying a 10% discount to the priority terminal dues rate.
13 The provisions applicable between designated operators of countries in the target system shall apply to any designated operator of a country in the transitional system which declares that it wishes to jointhe target system. The Postal Operations Council may set transitional measures in the Regulations. The full provisions of the target system may apply to any new target designated operator that declares that it wishes to apply such full provisions without transitional measures.
Article 29
Terminal dues. Provisions applicable to mail flows between
designated operators of countries in the target system
1 Payment for letter-post items, including bulk mail but excluding M bags and IBRS items, shall be established on the basis of the application of the rates per item and per kilogramme reflecting the handling costs in the country of destination. Charges corresponding to priority items in the domestic service which are part of the universal service provision will be used as a basis for the calculation of terminal dues rates.
2 The terminal dues rates in the target system shall be calculated taking into account, where applicable in the domestic service, the classification of items based on their format, as provided for in article 17.5 ofthe Convention.
3 Designated operators in the target system shall exchange format-separated mails in accordance with the conditions specified in the Regulations.
4 Payment for IBRS items shall be as described in the Regulations.
5 The rates per item and per kilogramme are separated for small (P) and large (G) letter-post items and bulky (E) and small packet (E) letter-post items. They shall be calculated on the basis of 70%of the charges for a 20-gramme small (P) letter-post item and for a 175-gramme large (G) letter-post item, exclusive of VAT or other taxes. For bulky (E) and small packet (E) letter-post items, they shall be calculated from the P/G format line at 375 grammes, exclusive of VAT or other taxes.
6 The Postal Operations Council shall define the conditions for the calculation of the rates as well as the necessary operational, statistical and accounting procedures for the exchange of format-separated mails.
7 The rates applied for flows between countries in the target system in a given year shall not lead toan increase of more than 13% in the terminal dues revenue for a letter-post item in the P/G format of 37.6grammes and in the E format of 375 grammes, compared to the previous year.
8 The rates applied for flows between countries in the target system prior to 2010 for small (P) andfor large (G) letter-post items may not be higher than:
8.1 for the year 2018, 0.331 SDR per item and 2.585 SDR per kilogramme;
8.2 for the year 2019, 0.341 SDR per item and 2.663 SDR per kilogramme;
8.3 for the year 2020, 0.351 SDR per item and 2.743 SDR per kilogramme;
8.4 for the year 2021, 0.362 SDR per item and 2.825 SDR per kilogramme.
9 The rates applied for flows between countries in the target system prior to 2010 for bulky (E) and small packet (E) letter-post items may not be higher than:
9.1 for the year 2018, 0.705 SDR per item and 1.584 SDR per kilogramme;
9.2 for the year 2019, 0.726 SDR per item and 1.632 SDR per kilogramme;
9.3 for the year 2020, 0.748 SDR per item and 1.681 SDR per kilogramme;
9.4 for the year 2021, 0.770 SDR per item and 1.731 SDR per kilogramme.
10 The rates applied for flows between countries in the target system prior to 2010 or from 2010,2012 and 2016 for small (P) and for large (G) letter-post items may not be lower than:
10.1 for the year 2018, 0.227 SDR per item and 1.774 SDR per kilogramme;
10.2 for the year 2019, 0.233 SDR per item and 1.824 SDR per kilogramme;
10.3 for the year 2020, 0.240 SDR per item and 1.875 SDR per kilogramme;
10.4 for the year 2021, 0.247 SDR per item and 1.928 SDR per kilogramme.
11 The rates applied for flows between countries in the target system prior to 2010 or from2010, 2012 and 2016 for bulky (E) and small packet (E) letter-post items may not be lower than:
11.1 for the year 2018, 0.485 SDR per item and 1.089 SDR per kilogramme;
11.2 for the year 2019, 0.498 SDR per item and 1.120 SDR per kilogramme;
11.3 for the year 2020, 0.512 SDR per item and 1.151 SDR per kilogramme;
11.4 for the year 2021,0.526 SDR per item and 1.183 SDR per kilogramme.
12 The rates applied for flows between countries in the target system as from 2010 and 2012 as well as between these countries and countries in the target system prior to 2010 for small (P) and for large (G) letter-post items may not be higher than:
12.1 for the year 2018, 0.264 SDR per item and 2.064 SDR per kilogramme;
12.2 for the year 2019, 0.280 SDR per item and 2.188 SDR per kilogramme;
12.3 for the year 2020, 0.297 SDR per item and 2.319 SDR per kilogramme;
12.4 for the year 2021, 0.315 SDR per item and 2.458 SDR per kilogramme.
13 The rates applied for flows between countries in the target system as from 2010 and 2012 as well as between these countries and countries in the target system prior to 2010 for bulky (E) and small packet (E) letter-post items may not be higher than:
13.1 for the year 2018, 0.584 SDR per item and 1.313 SDR per kilogramme;
13.2 for the year 2019, 0.640 SDR per item and 1.439 SDR per kilogramme;
13.3 for the year 2020, 0.701 SDR per item and 1.577 SDR per kilogramme;
13.4 for the year 2021, 0.770 SDR per item and 1.731 SDR per kilogramme.
14 The rates applied for flows between countries in the target system as from 2016 as well as between these countries and countries in the target system prior to 2010 or as from 2010 and 2012for small (P) and for large (G) letter-post items may not be higher than:
14.1 for the year 2018, 0.234 SDR per item and 1.831 SDR per kilogramme;
14.2 for the year 2019, 0.248 SDR per item and 1.941 SDR per kilogramme;
14.3 for the year 2020, 0.263 SDR per item and 2.057 SDR per kilogramme;
14.4 for the year 2021, 0.279 SDR per item and 2.180 SDR per kilogramme.
15 The rates applied for flows between countries in the target system as from 2016 as well as between these countries and countries in the target system prior to 2010 or as from 2010 and 2012for bulky (E) and small packet (E) letter-post items may not be higher than:
15.1 for the year 2018, 0.533 SDR per item and 1.198 SDR per kilogramme;
15.2 for the year 2019, 0.602 SDR per item and 1.354 SDR per kilogramme;
15.3 for the year 2020, 0.680 SDR per item and 1.530 SDR per kilogramme;
15.4 for the year 2021, 0.770 SDR per item and 1.731 SDR per kilogramme.
16 For flows below 50 tonnes a year between countries that joined the target system in 2010 and2012, as well as between these countries and countries that were in the target system prior to 2010, the per-kilogramme and per-item components shall be converted into a total rate per kilogramme on the basis of a world wide average composition of one kilogramme of mail in which P and G format items account for 8.16 items weighing 0.31 kilogrammes and E format items account for 2.72 items weighing 0.69 kilogrammes.
17 For flows below 75 tonnes a year in 2018, 2019 and 2020, and below 50 tonnes in 2021, between countries that joined the target system in 2016 or after that date, as well as between the secountries and countries in the target system prior to 2010 or as from 2010 and 2012, the per-kilogramme and per-item components shall be converted into a total rate per kilogramme on the basis of a worldwide average composition of one kilogramme of mail, as referred to in paragraph 16.
18 The payment for bulk mail sent to countries in the target system prior to 2010 shall be established by applying the rates per item and per kilogramme provided for in paragraphs 5 to 11.
19 The payment for bulk mail sent to countries in the target system as from 2010, 2012 and 2016 shallbe established by applying the rates per item and per kilogramme provided for in paragraphs 5 and 10 to 15.
20 No reservations may be made to this article, except within the framework of a bilateral agreement.
Article 30
Terminal dues. Provisions applicable to mail flows to, from and
between designated operators of countries in the transitional system
1 In preparation for the entry into the target system of the designated operators of countries in the terminal dues transitional system, payment for letter-post items, including bulk mail but excluding M bag sand IBRS items, shall be established on the basis of a rate per item and a rate per kilogramme.
2 Payment for IBRS items shall be as described in the Regulations.
3 The rates applied for flows to, from and between countries in the transitional system for small (P) and for large (G) letter-post items shall be:
3.1 for the year 2018, 0.227 SDR per item and 1.774 SDR per kilogramme;
3.2 for the year 2019, 0.233 SDR per item and 1.824 SDR per kilogramme;
3.3 for the year 2020, 0.240 SDR per item and 1.875 SDR per kilogramme;
3.4 for the year 2021, 0.247 SDR per item and 1.928 SDR per kilogramme.
4 The rates applied for flows to, from and between countries in the transitional system for bulky (E) and small packet (E) letter-post items shall be:
4.1 for the year 2018, 0.485 SDR per item and 1.089 SDR per kilogramme;
4.2 for the year 2019, 0.498 SDR per item and 1.120 SDR per kilogramme;
4.3 for the year 2020, 0.512 SDR per item and 1.151 SDR per kilogramme;
4.4 for the year 2021, 0.526 SDR per item and 1.183 SDR per kilogramme.
5 For flows below the flow threshold specified in article 29.16 or 29.17, the per-kilogramme andper-item components shall be converted into a total rate per kilogramme on the basis of a worldwide average composition of one kilogramme of mail. The following rates shall apply:
5.1 for the year 2018, 4.472 SDR per kilogramme;
5.2 for the year 2019, 4.592 SDR per kilogramme;
5.3 for the year 2020, 4.724 SDR per kilogramme;
5.4 for the year 2021, 4.858 SDR per kilogramme.
6 For mail flows over the flow threshold specified in article 29.17, the flat rate per kilogramme listed above shall be applied if neither the origin designated operator nor the destination designated operator requests the revision mechanism in order to revise the rate on the basis of the actual number of items perkilogramme, rather than the worldwide average. The sampling for the revision mechanism shall be applied in accordance with the conditions specified in the Regulations.
7 The downward revision of the total rate in paragraph 5 may not be invoked by a country in the target system against a country in the transitional system unless the latter asks for a revision in the opposite direction.
8 Designated operators of countries in the terminal dues transitional system may send and receive format-separated mail on an optional basis, in accordance with the conditions specified in the Regulations. In the case of format-separated exchanges the rates in paragraphs 3 and 4 above shall apply.
9 The payment for bulk mail to designated operators of countries in the target system shall be established by applying the rates per item and per kilogramme provided for in article 29. For bulk mail received, designated operators in the transitional system may request payment according to paragraphs 3 and 4.
10 No reservations may be made to this article, except within the framework of a bilateral agreement.
Article 31
Quality of Service Fund
1 Terminal dues payable by all countries and territories to the countries classified as least developed countries and included in group IV for terminal dues and Quality of Service Fund (QSF) purposes, except for M bags, IBRS items and bulk mail items, shall be increased by 20% of the rates given in article 30for payment into the QSF for improving the quality of service in those countries. There shall be no such payment from one group IV country to another group IV country.
2 Terminal dues, except for M bags, IBRS items and bulk mail items, payable by countries and territories classified as group I countries to the countries classified as group IV countries, other than the least developed countries referred to in paragraph 1 of this article, shall be increased by 10% of the rates given in article 30, for payment into the QSF for improving the quality of service in those countries.
3 Terminal dues, except for M bags, IBRS items and bulk mail items, payable by countries and territories classified as group II countries to the countries classified as group IV countries, other than the least developed countries referred to in paragraph 1 of this article, shall be increased by 10% of the rates given in article 30, for payment into the QSF for improving the quality of service in those countries.
4 Terminal dues, except in respect of M bags, IBRS items and bulk mail items, payable by countries and territories classified as group III countries to the countries classified as group IV countries, other than the least developed countries referred to in paragraph 1 of this article, shall be in creasedby 5% of the rates given in article 30, for payment into the QSF for improving the quality of service in those countries.
5 An increase of 1%, calculated on the basis of terminal dues payable by countries and territories classified as group I, II and III countries to the countries classified as group III countries, except in respect of M bags, IBRS items and bulk mail items, shall be paid into a common fund to be established for improving the quality of service in countries classified in groups II, III and IV and managed in accordance with the relevant procedures set by the Postal Operations Council.
6 Subject to the relevant procedures set by the Postal Operations Council, any unused amounts contributed under paragraphs 1, 2, 3 and 4 of this article and accumulated over the four preceding QSF reference years (with 2018 as the earliest reference year) shall also be transferred tothe common fund referred to in paragraph 5 of this article. For the purposes of this paragraph, only funds that have not been used in QSF-approved quality of service projects within two years following receipt of the last payment of contributed amounts for any given four-year period as defined above shall be transferred to the aforementioned common fund.
7 The combined terminal dues payable into the QSF for improving the quality of service of countries in group IV shall be subject to a minimum of 20,000 SDR per annum for each beneficiary country. The additional funds needed for reaching this minimum amount shall be invoiced, in proportion to the volumes exchanged, to the countries in groups I, II and III.
8 The Postal Operations Council shall adopt or update, in 2018 at the latest, procedures for financing QSF projects.
C. Rates for parcel post
Article 32
Parcel post land and sea rates
1 With the exception of ECOMPRO parcels, parcels exchanged between two designated operators shall be subject to inward land rates calculated by combining the base rate per parcel and base rate per kilogramme laid down in the Regulations.
1.1 Bearing in mind the above base rates, designated operators may, in addition, be authorized toclaim supplementary rates per parcel and per kilogramme in accordance with provisions laid downin the Regulations.
1.2 The rates mentioned in 1 and 1.1 shall be payable by the designated operator of the country of origin, unless the Regulations provide for exceptions to this principle.
1.3 The inward land rates shall be uniform for the whole of the territory of each country.
2 Parcels exchanged between two designated operators or between two offices of the same country by means of the land services of one or more other designated operators shall be subject to the transit land rates, payable to the designated operators which take part in the routeing on land, laid down in the Regulations, according to the distance step applicable.
2.1 For parcels in transit a decouvert, intermediate designated operators shall be authorized to claim the single rate per item laid down in the Regulations.
2.2 Transit land rates shall be payable by the designated operator of the country of origin unless the Regulations provide for exceptions to this principle.
3 Any designated operator which participates in the sea conveyance of parcels shall be authorized to
claim sea rates. These rates shall be payable by the designated operator of the country of origin, unless the Regulations provide for exceptions to this principle.
3.1 For each sea conveyance used, the sea rate shall be laid down in the Regulations according to the distance step applicable.
3.2 Designated operators may increase by 50% at most the sea rate calculated in accordance with 3.1.On the other hand, they may reduce it as they wish.
D. Air conveyance dues
Article 33
Basic rates and provisions concerning air conveyance dues
1 The basic rate applicable to the settlement of accounts between designated operators in respect of air conveyance shall be approved by the Postal Operations Council and shall be calculated by the International Bureau according to the formula specified in the Regulations. The rates applying to the air conveyance of parcels sent via the merchandise return service shall be calculated according to the provisions defined in the Regulations.
2 The calculation of air conveyance dues on closed dispatches, priority items, airmail items and air parcels sent in transit a decouvert, missent items and misrouted mails, as well as the relevant methods of accounting, are described in the Regulations.
3 The air conveyance dues for the whole distance flown shall be borne:
3.1 in the case of closed mails, by the designated operator of the country of origin of the mails, including when these mails transit via one or more intermediate designated operators;
3.2 in the case of priority items and airmail items in transit a decouvert, including missent items, by the designated operator which forwards the items to another designated operator.
4 These same regulations shall be applicable to items exempted from land and sea transit charges if they are conveyed by air.
5 Each designated operator of destination which provides air conveyance of international mail within its country shall be entitled to reimbursement of the additional costs incurred for such conveyance provided that the weighted average distance of the sectors flown exceeds 300 kilometres. The Postal Operations Council may replace the weighted average distance by other relevant criteria. Unless agreement has be enreached that no charge should be made, the dues shall be uniform for all priority mails and airmails originating abroad whether or not this mail is reforwarded by air.
6 However, where the terminal dues levied by the designated operator of destination are based specifically on costs or on domestic rates, no additional reimbursement for internal air conveyance shall be made.
7 The designated operator of destination shall exclude, for the purpose of calculating the weighted average distance, the weight of all mails for which the terminal dues calculation has been based specifically on costs or on the domestic rates of the designated operator of destination.
E. Settlement of accounts
Article 34
Provisions specific to the settlement of accounts
and payments for international postal exchanges
1 Settlements in respect of operations carried out in accordance with the present Convention (including settlements for the transport (forwarding) of postal items, settlements for the treatment of postal items in the country of destination and settlements in compensation for any loss, theft or damage relating to postal items) shall be based on and made in accordance with the provisions of the Convention and other Acts of the Union, and shall not require the preparation of any documents by a designated operator except in cases provided for in the Acts of the Union.
F. Fixing of charges and rates
Article 35
Authority of the Postal Operations Council to fix charges and rates
1 The Postal Operations Council shall have the authority to fix the following rates and charges, whi chare payable by designated operators in accordance with the conditions shown in the Regulations:
1.1 transit charges for the handling and conveyance of letter mails through one or more intermediary countries;
1.2 basic rates and air conveyance dues for the carriage of mail by air;
1.3 inward land rates for the handling of all inward parcels except ECOMPRO parcels;
1.4 transit land rates for the handling and conveyance of parcels through an intermediary country;
1.5 sea rates for the conveyance of parcels by sea.
1.6 outward land rates for the provision of the merchandise return service for parcels.
2 Any revision made, in accordance with a methodology that ensures equitable remuneration for designated operators performing the services, must be based on reliable and representative economic and financial data. Any change decided upon shall enter into force at a date set by the Postal Operations Coucil.
Section VIII
Optional services
Article 36
EMS and integrated logistics
1 Member countries or designated operators may agree with each other to participate in the following services, which are described in the Regulations:
1.1 EMS, which is a postal express service for documents and merchandise, and shall whenever possible be the quickest postal service by physical means. This service may be provided on the basisof the EMS Standard Multilateral Agreement or by bilateral agreement;
1.2 integrated logistics, which is a service that responds fully to customers' logistical requirements and includes the phases before and after the physical transmission of goods and documents.
Article 37
Electronic postal services
1 Member countries or designated operators may agree with each other to participate in the following electronic postal services, which are described in the Regulations:
1.1 electronic postal mail, which is an electronic postal service involving the transmission of electronic messages and information by designated operators;
1.2 electronic postal registered mail, which is a secure electronic postal service that provides proof of sending and proof of delivery of an electronic message and a secure communication channel to the authenticated users;
1.3 electronic postal certification mark, which provides evidentiary proof of an electronic event, in agiven form, at a given time, and involving one or more parties;
1.4 electronic postal mailbox, which enables the sending of electronic messages by an authenticated mailer and the delivery and storage of electronic messages and information for the authenticated addressee.
Section IX
Final provisions
Article 38
Conditions for approval of proposals concerning
the Convention and the Regulations
1 To become effective, proposals submitted to Congress relating to this Convention must be approved by a majority of the member countries present and voting which have the right to vote. At least half of the member countries represented at Congress and having the right to vote shall be present at the time of voting.
2 To become effective, proposals relating to the Regulations must be approved by a majority of the members of the Postal Operations Council having the right to vote.
3 To become effective, proposals introduced between Congresses relating to this Convention and toits Final Protocol must obtain:
3.1 two thirds of the votes, at least one half of the member countries of the Union which have the right to vote having taken part in the vote, if they involve amendments;
3.2 a majority of the votes if they involve interpretation of the provisions.
4 Notwithstanding the provisions under 3.1, any member country whose national legislation is as yet in compatible with the proposed amendment may, within ninety days from the date of notification of the latter, make a written declaration to the Director General of the International Bureau stating that it is unable to accept the amendment.
Article 39
Reservations at Congress
1 Any reservation which is incompatible with the object and purpose of the Union shall not be permitted.
2 As a general rule, any member country whose views are not shared by other member countries shall endeavour, as far as possible, to conform to the opinion of the majority. Reservations should be made only in cases of absolute necessity, and proper reasons given.
3 Reservations to any article of the present Convention shall be submitted to Congress as a Congress proposal written in one of the working languages of the International Bureau and in accordance with the relevant provisions of the Rules of Procedure of Congresses.
4 To become effective, proposals concerning reservations must be approved by whatever majority is required for amendment of the article to which the reservation relates.
5 In principle, reservations shall be applied on a reciprocal basis between the reserving member country and the other member countries.
6 Reservations to the present Convention shall be inserted in the Final Protocol to the present Convention, on the basis of proposals approved by Congress.
Article 40
Entry into force and duration of the Convention
1 This Convention shall come into force on 1 January 2018 and shall remain in operation until the entry into force of the Acts of the next Congress.
In witness whereof the plenipotentiaries of the Governments of the member countries have signed this Convention in a single original which shall be deposited with the Director General of the International Bureau. A copy thereof shall be delivered to each party by the International Bureau of the Universal Postal Union.

Final Protocol
to the Universal Postal Convention
At the moment of proceeding to signature of the Universal Postal Convention concluded this day, the undersigned plenipotentiaries have agreed the following:
Article I
Ownership of postal items. Withdrawal from the post.
Alteration or correction of address
1 The provisions in article 5.1 and 2 shall not apply to Antigua and Barbuda, Bahrain (Kingdom), Barbados, Belize, Botswana, Brunei Darussalam, Canada, Hong Kong, China, Dominica, Egypt, Fiji, Gambia, United Kingdom of Great Britain and Northern Ireland, Overseas Dependent Territories of the United Kingdom, Grenada, Guyana, Ireland, Jamaica, Kenya, Kiribati, Kuwait, Lesotho, Malawi, Malaysia, Mauritius, Nauru, New Zealand, Nigeria, Papua New Guinea, Saint Christopher and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Samoa, Seychelles, Sierra Leone, Singapore, Solomon Islands, Swaziland, Tanzania (United Rep.), Trinidad and Tobago, Tuvalu, Uganda, Vanuatu and Zambia.
2 Nor shall article 5.1 and 2 apply to Austria, Denmark and Iran (Islamic Rep.), whose internal legislation does not allow withdrawal from the Post or alteration of the address of correspondence, at the request of the sender, from the time when the addressee has been informed of the arrival of an item addressed tohim.
3 Article 5.1 shall not apply to Australia, Ghana and Zimbabwe.
4 Article 5.2 shall not apply to Bahamas, Belgium, the Dem. People's Rep. of Korea, Iraq and Myanmar, whose legislation does not permit withdrawal from the post or alteration of address of letter-post items at the sender's request.
5 Article 5.2 shall not apply to the United States of America.
6 Article 5.2 shall apply to Australia only in so far as that article is consistent with its domestic legislation.
7 Notwithstanding article 5.2, Dem. Rep. of the Congo, El Salvador, Panama (Rep.), Philippines and Venezuela (Bolivarian Rep.) shall be authorized not to return postal parcels after the addressee has requested their clearance by Customs, since this is incompatible with those countries' customs legislation.
Article II
Postage stamps
1 Notwithstanding article 6.7, Australia, the United Kingdom of Great Britain and Northern I rel and, Malaysia and New Zealand will process letter-post items and postal parcels bearing postage stamp susing new materials or technologies that are not compatible with their respective mail processing machine sonly upon prior agreement with the designated operator of origin concerned.
Article III
Posting abroad of letter-post items
1 Australia, Austria, United Kingdom of Great Britain and Northern Ireland, Greece, New Zealand and United States of America reserve the right to impose a charge, equivalent to the cost of the work it incurs, on any designated operator which, under the provisions of article 12.4, sends to it items for disposal which were not originally dispatched as postal items by their services.
2 Notwithstanding article 12.4, Canada reserves the right to collect from the designated operator of origin such amount as will ensure recovery of not less than the costs incurred by it in the handling of such items.
3 Article 12.4 allows the designated operator of destination to claim, from the designated operator of posting, appropriate remuneration for delivering letter-post items posted abroad in large quantities. Australia and the United Kingdom of Great Britain and Northern Ireland reserve the right to limit any such payment to the appropriate domestic tariff for equivalent items in the country of destination.
4 Article 12.4 allows the designated operator of destination to claim, from the designated operator of posting, appropriate remuneration for delivering letter-post items posted abroad in large quantities. The following member countries reserve the right to limit any such payment to the limits authorized in the Regulations for bulk mail: Bahamas, Barbados, Brunei Darussalam, China (People's Rep.), United Kingdom of Great Britain and Northern Ireland, Overseas Dependent Territories of the United Kingdom, Grenada, Guyana, India, Malaysia, Nepal, Netherlands, Netherlands Antilles and Aruba, New Zealand, Saint Lucia, Saint Vincent and the Grenadines, Singapore, Sri Lanka, Suriname, Thailand and United States of America.
5 Notwithstanding the reservations under 4, the following member countries reserve the right to apply in full the provisions of article 12 of the Convention to mail received from Union member countries: Argentina, Australia, Austria, Azerbaijan, Benin, Brazil, Burkina Faso, Cameroon, Canada, Cote d'Ivoire (Rep.), Cyprus, Denmark, Egypt, France, Germany, Greece, Guinea, Iran (Islamic Rep.), Israel, Italy, Japan, Jordan, Lebanon, Luxembourg, Mali, Mauritania, Monaco, Morocco, Norway, Pakistan, Portugal, Russian Federation, Saudi Arabia, Senegal, Switzerland, Syrian Arab Rep., Togo and Turkey.
6 In application of article 12.4, Germany reserves the right to request the mailing country to grant compensation of the amount it would receive from the country of which the sender is resident.
7 Notwithstanding the reservations made under article III, China (People's Rep.) reserves the right to limit any payment for delivering letter-post items posted abroad in large quantities to the limits authorized in the UPU Convention and its Regulations for bulk mail.
8 Notwithstanding article 12.3, Austria, Germany, the United Kingdom of Great Britain and Northern Ireland, Liechtenstein and Switzerland reserve the right to claim from the sender or, failing that, from the designated operator of posting, the payment of the internal rates.
Article IV
Charges
1 Notwithstanding article 15, Australia, Belarus, Canada and New Zealand shall be authorized to collect postal charges other than those provided for in the Regulations, when such charges are consistent with the legislation of their countries.
2 Notwithstanding article 15, Brazil shall be authorized to collect an additional fee from the addressees of ordinary items containing merchandise that had to be converted to tracked items as are sult of customs and security requirements.
Article V
Exception to the exemption of items for the blind from postal charges
1 Notwithstanding article 16, Indonesia, Saint Vincent and the Grenadines and Turkey, which do not concede exemption from postal charges to items for the blind in their internal service, may collect the postage and charges for special services which may not, however, exceed those in their internal service.
2 France shall apply the provisions of article 16 concerning items for the blind subject to its national regulations.
3 Notwithstanding article 16.3, and in accordance with its national legislation, Brazil reserves the right to consider as items for the blind only those items which are sent by or addressed to blind persons or organizations for the blind. Items not satisfying these conditions shall be subject to payment of postage.
4 Notwithstanding article 16, New Zealand will accept as items for the blind for delivery in New Zealand only those items that are exempted from postal charges in its domestic service.
5 Notwithstanding article 16, Finland, which does not provide exemption from postal charges for items for the blind in its domestic service according to the definitions in article 7 adopted by Congress, may collect the domestic charges for items for the blind destined for other countries.
6 Notwithstanding article 16, Canada, Denmark and Sweden allow exemption from postal charges for the blind only to the extent provided for in their internal legislation.
7 Notwithstanding article 16, Iceland accepts exemption from postal charges for the blind only to the extent provided for in its internal legislation.
8 Notwithstanding article 16, Australia will accept as items for the blind for delivery in Australia only those items that are exempted from postal charges in its domestic service.
9 Notwithstanding article 16, Australia, Austria, Azerbaijan, Canada, Germany, United Kingdom of Great Britain and Northern Ireland, Japan, Switzerland and United States of America may collect the charges for special services which are applied items for the blind in their internal service.
Article VI
Basic services
1 Notwithstanding the provisions of article 17, Australia does not agree to the extension of basic services to include postal parcels.
2 The provisions of article 17.2.4 shall not apply to the United Kingdom of Great Britain and Northern Ireland, whose national legislation requires a lower weight limit. Health and safety legislation in the United Kingdom of Great Britain and Northern Ireland limits the weight of mail bags to 20 kilogrammes.
3 Notwithstanding article 17.2.4, Azerbaijan, Kazakhstan, Kyrgyzstan and Uzbekistan shall be authorized to limit to 20 kilogrammes the maximum weight of inward and outward M bags.
Article VII
Advice of delivery
1 Canada and Sweden shall be authorized not to apply article 18.3.3, as regards parcels, given that
they do not offer the advice of delivery service for parcels in their internal service.
2 Notwithstanding article 18.3.3, Denmark and the United Kingdom of Great Britain and Northern Ireland reserve the right not to admit inward advices of delivery, given that they do not offer advice of delivery in their internal service.
3 Notwithstanding article 18.3.3, Brazil shall be authorized to admit inward advices of deliveryonly when they can be returned electronically.
Article VIII
Prohibitions (letter post)
1 Exceptionally, Dem. People's Rep. of Korea and Lebanon shall not accept registered items containing coins, bank notes, securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver whether manufactured or not, precious stones, jewels or other valuable articles. They shall not be strictly bound by the provisions of the Regulations with regard to their liability in cases of theft or damage, or where items containing articles made of glass or fragile articles are concerned.
2 Exceptionally, Bolivia, China (People's Rep.), excluding Hong Kong Special Administrative Region, Iraq, Nepal, Pakistan, Saudi Arabia, Sudan and Viet Nam shall not accept registered items containing coins, bank notes, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver whether manufactured or not, precious stones, jewels or other valuable articles.
3 Myanmar reserves the right not to accept insured items containing the valuable articles listed in article 19.6, as this is contrary to its internal regulations.
4 Nepal does not accept registered items or insured items containing currency notes or coins, except by special agreement to that effect.
5 Uzbekistan does not accept registered or insured items containing coins, bank notes, cheques, postage stamps or foreign currency and shall accept no liability in cases of loss of or damage to such items.
6 Iran (Islamic Rep.) does not accept items containing articles contrary to the principles of the Islamic religion, and reserves the right not to accept letter-post items (ordinary, registered or insured) containing coins, bank notes, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones, jewels or other valuable articles, and shall accept no liability in cases of loss or damage to such items.
7 The Philippines reserves the right not to accept any kind of letter post (ordinary, registered or insured) containing coins, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones or other valuable articles.
8 Australia does not accept postal items of any kind containing bullion or bank notes. In addition, itdoes not accept registered items for delivery in Australia, or items in transit a decouvert, containing valuables such as je wellery, precious metals, precious or semi-precious stones, securities, coins or any form of negotiable financial instrument. It declines all liability for items posted which are not in compliance with this reservation.
9 China (People's Rep.), excluding Hong Kong Special Administrative Region, shall not accept insured items containing coins, bank notes, currency notes or securities of any kind payable to bearer and travellers' cheques in accordance with its internal regulations.
10 Latvia and Mongolia reserve the right not to accept, in accordance with their national legislation, ordinary, registered or insured mail containing coins, bank notes, securities payable to bearer and travellers' cheques.
11 Brazil reserves the right not to accept ordinary, registered or insured mail containing coins, banknotes in circulation or securities of any kind payable to bearer.
12 Viet Nam reserves the right not to accept letters containing articles or goods.
13 Indonesia does not accept registered or insured items containing coins, bank notes, cheques, postage stamps, foreign currency, or any kind of securities payable to bearer for delivery in Indonesia, andshall accept no liability in cases of loss of or damage to such items.
14 Kyrgyzstan reserves the right not to accept letter-post items (ordinary, registered, insured, small packets) containing coins, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones, jewels or other valuable articles, and shall accept no liability in cases of loss of or damage to such items.
15 Azerbaijan and Kazakhstan shall not accept registered or insured items containing coins, banknotes, credit notes or any securities payable to bearer, cheques, precious metals, whether manufactured or not, precious stones, jewels and other valuable articles or foreign currency, and shall accept no liability incases of loss of or damage to such items.
16 Moldova and the Russian Federation do not accept registered or insured items containing banknotes in circulation, securities (cheques) of any kind payable to bearer or foreign currency, and shall accept no liability in cases of loss of or damage to such items.
17 Notwithstanding article 19.3, France reserves the right not to accept items containing goods in cases where these items do not comply with its national regulations, or international regulations, or technical and packing instructions for air transport.
18 Cuba reserves the right not to accept, handle, convey or deliver letter-post items containing coins, banknotes, currency notes or securities of any kind payable to bearer, cheques, precious metals and stones, jewels or other valuable articles, or any kind of document, goods or object in cases where these items do not comply with its national regulations, or international regulations, or technical and packing instructions for air transport, and shall accept no liability in cases of theft, loss or damage to such items. Cuba reserves the right not to accept letter-post items subject to customs duty containing goods that are imported to the country if their value does not comply with its national regulations.
Article IX
Prohibitions (postal parcels)
1 Myanmar and Zambia shall be authorized not to accept insured parcels containing the valuable articles covered in article 19.6.1.3.1, since this is contrary to their internal regulations.
2 Exceptionally, Lebanon and Sudan shall not accept parcels containing coins, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones or other valuable articles, or containing liquids or easily liquefiable elements or articles made of glass or similar or fragile articles. They shall not be bound by the relevant provisions of the Regulations.
3 Brazil shall be authorized not to accept insured parcels containing coins and currency notes in circulation, as well as any securities payable to bearer, since this is contrary to its internal regulations.
4 Ghana shall be authorized not to accept insured parcels containing coins and currency notes incirculation, since this is contrary to its internal regulations.
5 In addition to the articles listed in article 19, Saudi Arabia shall be authorized not to accept parcels containing coins, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones or other valuable articles. Nor does it accept parcels containing medicines of any kind unless they are accompanied by a medical prescription issued by a competent official authority, products designed for extinguishing fires, chemical liquids or articles contrary to the principles of the Islamic religion.
6 In addition to the articles referred to in article 19, Oman does not accept items containing:
6.1 medicines of any sort unless they are accompanied by a medical prescription issued by a competent official authority;
6.2 fire-extinguishing products or chemical liquids;
6.3 articles contrary to the principles of the Islamic religion.
7 In addition to the articles listed in article 19, Iran (Islamic Rep.) shall be authorized not to accept parcels containing articles contrary to the principles of the Islamic religion, and reserves the right not to accept ordinary or insured parcels containing coins, bank notes, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones, jewels or other valuable articles; it shall accept no liability incases of loss or damage to such items.
8 The Philippines shall be authorized not to accept any kind of parcel containing coins, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones or other valuable articles, or containing liquids or easily liquefiable elements or articles made of glass or similar or fragile articles.
9 Australia does not accept postal items of any kind containing bullion or bank notes.
10 China (People's Rep.) shall not accept ordinary parcels containing coins, currency notes or securities of any kind payable to bearer, travellers' cheques, platinum, gold or silver, whether manufactured or not, precious stones or other valuable articles. Furthermore, with the exception of the Hong Kong Special Administrative Region, insured parcels containing coins, currency notes or securities of any kind payable to bearer and travellers' cheques shall not be accepted.
11 Mongolia reserves the right not to accept, in accordance with its national legislation, parcels containing coins, bank notes, securities payable to bearer and travellers' cheques.
12 Latvia does not accept ordinary and insured parcels containing coins, bank notes, securities (cheques) of any kind payable to bearer or foreign currency, and shall accept no liability in cases of loss of or damage to such items.
13 Moldova, the Russian Federation, Ukraine and Uzbekistan do not accept ordinary or insured parcels containing bank notes in circulation, securities (cheques) of any kind payable to bearer or foreign currency, and shall accept no liability in cases of loss of or damage to such items.
14 Azerbaijan and Kazakhstan do not accept ordinary or insured parcels containing coins, bank notes, credit notes or any securities payable to bearer, cheques, precious metals, whether manufactured or not, precious stones, jewels and other valuable articles or foreign currency, and shall accept no liability in cases of loss of or damage to such items.
15 Cuba reserves the right not to accept, handle, convey or deliver postal parcels containing coins, banknotes, currency notes or securities of any kind payable to bearer, cheques, precious metals and stones, jewels or other valuable articles, or any kind of document, goods or object in cases where these items do not comply with its national regulations, or international regulations, or technical and packing instructions for air transport, and shall accept no liability in cases of theft, loss or damage to such items. Cuba reserves the right not to accept postal parcels subject to customs duty containing goods that are imported to the country if their value does not comply with its national regulations.
Article X
Articles subject to customs duty
1 With reference to article 19, Bangladesh and El Salvador do not accept insured items containing articles subject to customs duty.
2 With reference to article 19, Afghanistan, Albania, Azerbaijan, Belarus, Cambodia, Chile, Colombia, Cuba, Dem. People's Rep. of Korea, El Salvador, Estonia, Kazakhstan, Latvia, Moldova, Nepal, Peru, Russian Federation, San Marino, Turkmenistan, Ukraine, Uzbekistan and Venezuela (Bolivarian Rep.) do not accept ordinary and registered letters containing articles subject to customs duty.
3 With reference to article 19, Benin, Burkina Faso, Cote d'Ivoire (Rep.), Djibouti, Mali and Mauritania do not accept ordinary letters containing articles subject to customs duty.
4 Notwithstanding the provisions set out under 1 to 3, the sending of serums, vaccines and urgently required medicaments which are difficult to procure shall be permitted in all cases.
Article XI
Presentation-to-Customs charge
1 Gabon reserves the right to collect a presentation-to-Customs charge from customers.
2 Notwithstanding article 20.2, Australia, Brazil, Canada, Cyprus and the Russian Federation reserve the right to collect a presentation-to-Customs charge from customers for any item submitted to customs control.
3 Notwithstanding article 20.2, Azerbaijan, Greece, Pakistan and Turkey reserve the right to collect from customers a presentation-to-Customs charge for all items presented to customs authorities.
4 Congo (Rep.) and Zambia reserve the right to collect a presentation-to-Customs charge from customers in respect of parcels.
Article XII
Inquiries
1 Notwithstanding article 21.2, Cape Verde, Chad, Dem. People's Rep. of Korea, Egypt, Gabon, Overseas Dependent Territories of the United Kingdom, Greece, Iran (Islamic Rep.), Kyrgyzstan, Mongolia, Myanmar, Philippines, Saudi Arabia, Sudan, Syrian Arab Rep., Turkmenistan, Ukraine, Uzbekistan and Zambia reserve the right to collect from customers charges on inquiries lodged in respect of letter-post items.
2 Notwithstanding article 21.2, Argentina, Austria, Azerbaijan, Hungary, Lithuania, Moldova, Norway and Slovakia reserve the right to collect a special charge when, on completion of the investigation conducted in response to the inquiry, it emerges that the latter was unjustified.
3 Afghanistan, Cape Verde, Congo (Rep.), Egypt, Gabon, Iran (Islamic Rep.), Kyrgyzstan, Mongolia, Myanmar, Saudi Arabia, Sudan, Suriname, Syrian Arab Rep., Turkmenistan, Ukraine, Uzbekistan and Zambia reserve the right to collect an inquiry charge from customers in respect of parcels.
4 Notwithstanding article 21.2, Brazil, Panama (Rep.) and the United States of America reserve theright to collect a charge from customers for inquiries lodged in respect of letter-post items and parcels posted in countries which apply that type of charge in accordance with paragraphs 1 to 3 of this article.
Article XIII
Exceptional inward land rates
1 Notwithstanding article 32, Afghanistan reserves the right to collect an additional exceptional inward land rate of 7.50 SDR per parcel.
Article XIV
Basic rates and provisions concerning air conveyance dues
1 Notwithstanding the provisions of article 33, Australia reserves the right to apply air conveyance rates for outward parcels sent via the merchandise return service, either as laid down in the Regulations or by any other means, including bilateral agreements.
Article XV
Special tariffs
1 Belgium, Norway and United States of America may collect higher land rates for air parcels than for surface parcels.
2 Lebanon shall be authorized to collect for parcels up to 1 kilogramme the charge applicable to parcels over 1 and up to 3 kilogrammes.
3 Panama (Rep.) shall be authorized to collect 0.20 SDR per kilogramme for surface airlifted (S.A.L.) parcels in transit.
Article XVI
Authority of the Postal Operations Council to fix charges and rates
1 Notwithstanding article 35.1.6, Australia reserves the right to apply outward land rates for the provision of the merchandise return service for parcels, either as laid down in the Regulations or by any other means, including bilateral agreements.
In witness whereof, the plenipotentiaries below have drawn up this Protocol which shall have the same force and the same validity as if its provisions were inserted in the text of the Convention itself, and they have signed it in a single original which shall be deposited with the Director General of the International Bureau. A copy thereof shall be delivered to each party by the International Bureau of the Universal Postal Union.
