privind asistenţa reciprocă şi cooperarea în domeniul vamal

Guvernul Republicii Moldova şi Guvernul Republicii Finlanda, denumite în continuare Părţi Contractante,
Considerând că încălcările legislaţiei vamale prejudiciază interesele lor economice, comerciale, fiscale, sociale, culturale, industriale şi agricole;
Având convingerea că acţiunile împotriva încălcărilor legislaţiei vamale pot fi eficientizate prin cooperarea strânsă între autorităţile lor vamale;
Luând în considerare importanţa evaluării exacte a taxelor vamale şi impozitelor încasate la import sau export şi asigurării aplicării corecte a măsurilor de prohibiţie, restricţie şi control, acestea din urmă incluzând cele privind aplicarea legii şi a reglementărilor referitoare la mărfurile contrafăcute şi mărcile comerciale înregistrate;
Considerând că traficul ilicit de arme, muniţii, materii explozive, substanţe toxice, materiale radioactive, stupefiante şi substanţe psihotrope reprezintă un pericol pentru sănătatea publică şi societate;
Luând în considerare ameninţarea criminalităţii organizate transnaţionale şi a grupurilor teroriste cu resursele lor substanţiale şi necesitatea de a le combate eficient;
Având în vedere Acordul de Asociere între Republica Moldova, pe de o parte, şi Uniunea Europeană şi Comunitatea Europeană a Energiei Atomice şi statele membre ale acestora, pe de altă parte, semnat la Bruxelles la 27 iunie 2014;
Luând în considerare Convenţia Organizaţiei Naţiunilor Unite împotriva criminalităţii transnaţionale organizate, adoptată la New York la 15 noiembrie 2000, care stabileşte un cadru pentru asistenţa reciprocă internaţională în materie penală în vederea prevenirii şi combaterii criminalităţii transnaţionale organizate;
Având în vedere dispoziţiile Convenţiei unice asupra stupefiantelor din 1961, astfel cum a fost modificată, şi ale Convenţiei asupra substanţelor psihotrope din 1971, astfel cum a fost modificată, întocmite sub auspiciile Organizaţiei Naţiunilor Unite, precum şi ale Convenţiei Organizaţiei Naţiunilor Unite contra traficului ilicit de stupefiante şi substanţe psihotrope din 1988 şi anexa la aceasta, astfel cum a fost modificată;
Având în vedere, de asemenea, instrumentele relevante ale Consiliului de cooperare vamală, în special Recomandarea privind asistenţa administrativă reciprocă din 5 decembrie 1953;
au convenit următoarele:
Articolul 1
Definiţii
În scopurile prezentului Acord:
a) "legislaţie vamală" va însemna orice acte legale sau de reglementare aplicabile de către autorităţile vamale ale Părţilor Contractante în legătură cu importul, exportul, tranzitul, depozitarea şi circulaţia mărfurilor, inclusiv a mijloacelor de plată, fie referitoare la taxele vamale, impozitele sau alte plăţi percepute sau controlate de către autorităţile vamale sau la măsurile de prohibiţie, restricţie sau control;
b) "autoritate vamală" va însemna Serviciul Vamal pentru Republica Moldova, şi Vama Finlandeză pentru Republica Finlanda, competentă pentru aplicarea dispoziţiilor menţionate la alineatul a) din prezentul articol;
c) "încălcare a legislaţiei vamale" va însemna orice încălcare sau tentativă de încălcare a legislaţiei vamale;
d) "taxe vamale şi impozite" va însemna taxele vamale şi toate celelalte taxe, impozite şi plăţi încasate la sau în legătură cu importul sau exportul de mărfuri, dar care nu includ taxele şi plăţile limitate la cuantumul costurilor aproximative ale serviciilor prestate, inclusiv pentru Republica Finlanda, taxele şi impozitele stabilite de autorităţile competente ale Uniunii Europene;
e) "persoană" va însemna orice persoană fizică sau juridică, dacă contextul nu presupune altceva;
f) "date cu caracter personal" va însemna orice informaţie referitoare la o persoană identificată sau identificabilă;
g) "stupefiante" va însemna orice substanţă, naturală sau sintetică, din Listele I şi II ale Convenţiei unice asupra stupefiantelor din 1961, astfel cum a fost modificată, precum şi orice substanţă asimilată stupefiantelor în legislaţia naţională;
h) "substanţe psihotrope" va însemna orice substanţă, naturală sau sintetică, sau orice material natural din Listele I, II, III şi IV ale Convenţiei asupra substanţelor psihotrope din 1971, astfel cum a fost modificată, precum şi orice substanţă asimilată substanţelor psihotrope în legislaţia naţională;
i) "precursori" va însemna substanţele chimice enumerate în Anexa la Convenţia Organizaţiei Naţiunilor Unite contra traficului ilicit de stupefiante şi substanţe psihotrope din 1988, astfel cum a fost modificată;
j) "livrare controlată" va însemna metoda de permitere a trecerii loturilor ilicite de mărfuri de pe, prin sau pe teritoriile statelor Părţilor Contractante, cu acordul şi sub supravegherea autorităţilor competente, în vederea detectării şi identificării persoanelor implicate în încălcările legislaţiei vamale;
k) "autoritate vamală solicitantă" va însemna autoritatea vamală a Părţii Contractante care solicită asistenţă în domeniul vamal;
l) "autoritate vamală solicitată" va însemna autoritatea vamală a Părţii Contractante de la care se solicită asistenţă în domeniul vamal.
Articolul 2
Domeniul de aplicare a Acordului
1. Părţile Contractante, prin intermediul autorităţilor lor vamale şi în conformitate cu dispoziţiile prezentului Acord, îşi vor acorda asistenţă reciprocă:
a) pentru a asigura respectarea cuvenită a legislaţiei vamale;
b) pentru prevenirea, investigarea şi combaterea oricărei încălcări a legislaţiei vamale;
c) în cazurile referitoare la livrarea/notificarea documentelor privind aplicarea legislaţiei vamale.
2. Asistenţa în cadrul prezentului Acord va fi acordată în conformitate cu legislaţia în vigoare pe teritoriul statului Părţii Contractante solicitate şi în limitele competenţei şi resurselor disponibile ale autorităţii vamale solicitate. În caz de necesitate, autoritatea vamală solicitată poate organiza ca asistenţa să fie acordată de către o altă autoritate competentă.
3. Prezentul Acord nu prevede recuperarea taxelor vamale, impozitelor şi oricăror alte plăţi.
4. Prezentul Acord nu va afecta aplicarea tratatelor internaţionale privind asistenţa juridică în materie penală sau a tratatelor internaţionale privind cooperarea vamală la care Părţile Contractante sunt părţi.
Articolul 3
Domeniul de aplicare a asistenţei
1. Autorităţile vamale ale Părţilor Contractante, în contextul actelor legale şi de reglementare, vor efectua schimb de orice informaţie - la solicitare şi după o investigaţie prealabilă, dacă este cazul - care să le permită să asigure încasarea corectă a taxelor vamale şi impozitelor, în special informaţie care facilitează:
a) determinarea valorii impozabile, clasificării tarifare şi originii mărfurilor,
b) punerea în aplicare a dispoziţiilor privind prohibiţiile, restricţiile şi controalele.
2. La solicitare, autoritatea vamală solicitată va transmite toată informaţia privind legislaţia vamală şi procedurile aplicabile în statul Părţii Contractante solicitate, care este relevantă pentru investigaţiile referitoare la o încălcare a legislaţiei vamale.
3. Autorităţile vamale îşi vor transmite reciproc, la solicitare sau din propria lor iniţiativă, informaţie şi documente utile pentru asigurarea aplicării corecte a legislaţiei vamale şi prevenirea, investigarea şi combaterea încălcărilor legislaţiei vamale.
4. Orice autoritate vamală, la efectuarea investigaţiilor în numele celeilalte autorităţi vamale, va acţiona ca şi cum ele ar fi fost efectuate în numele său propriu sau la solicitarea altei autorităţi din statul Părţii Contractante solicitate.
5. în cazul în care autoritatea vamală solicitată nu este agenţia potrivită pentru a satisface solicitarea, aceasta o va transmite prompt agenţiei corespunzătoare şi va solicita cooperarea acesteia.
Articolul 4
Situații de asistenta
Autorităţile vamale îşi vor transmite reciproc, din propria lor iniţiativă sau la solicitare, următoarea informaţie:
a) dacă mărfurile importate pe teritoriul statului uneia dintre Părţile Contractante au fost exportate în mod legal de pe teritoriul statului celeilalte Părţi Contractante, precum şi regimul vamal, dacă este cazul, sub care mărfurile au fost plasate;
b) dacă mărfurile exportate de pe teritoriul statului uneia dintre Părţile Contractante au fost importate în mod legal pe teritoriul statului celeilalte Părţi Contractante, precum şi regimul vamal, dacă este cazul, sub care mărfurile au fost plasate;
c) dacă mărfurile cărora li se acordă un tratament favorabil la export de pe teritoriul statului uneia dintre Părţile Contractante au fost importate în mod cuvenit pe teritoriul statului celeilalte Părţi Contractante, înţelegându-se că va fi furnizată de asemenea informaţia cu privire la orice măsuri de control vamal aplicate acestora.
Articolul 5
Supraveghere specială
1. La solicitare, autoritatea vamală solicitată va furniza informaţia şi va menţine supravegherea specială asupra:
a) persoanelor cunoscute autorităţii vamale solicitante că au comis o încălcare a legislaţiei vamale sau suspectate de aceasta, în special asupra celor care se deplasează pe şi de pe teritoriul statului Părţii Contractante solicitate;
b) deplasării mărfurilor notificate de către autoritatea vamală solicitantă că generează trafic ilicit suspect înspre teritoriul statului Părţii Contractante solicitante;
c) mijloacelor de transport suspectate de autoritatea vamală solicitantă ca fiind folosite pentru a comite încălcări ale legislaţiei vamale în vigoare pe teritoriul statului oricărei dintre Părţile Contractante;
d) locurilor utilizate pentru depozitarea mărfurilor suspectate de autoritatea vamală solicitantă ca fiind folosite pentru a comite încălcări ale legislaţiei vamale în vigoare pe teritoriul statului oricărei dintre Părţi Contractante.
2. Autorităţile vamale ale Părţilor Contractante, în limita competenţei lor, vor preveni:
a) exportul de mărfuri cunoscute sau, pe motive întemeiate, suspectate ca fiind exportate pe teritoriul statului celeilalte Părţi Contractante, pentru a fi folosite în alte scopuri decât în comerţul legal între Părţile Contractante;
b) exportul de mărfuri al căror import este interzis pe teritoriul statului celeilalte Părţi Contractante.
Articolul 6
Acţiuni împotriva traficului ilicit de mărfuri de o importanţă deosebită
Autorităţile vamale îşi vor furniza reciproc, din propria lor iniţiativă sau la solicitare şi fără întârziere, toată informaţia relevantă privind activităţile, realizate sau planificate, care constituie sau par să constituie o încălcare a legislaţiei vamale în vigoare pe teritoriul statului uneia dintre Părţile Contractante, în special în domeniul circulaţiei:
a) armelor, muniţiilor şi substanţelor explozive;
b) mărfurilor sensibile şi strategice supuse controlului în conformitate cu tratatele internaţionale corespunzătoare şi acordurile sau regimurile multilaterale relevante şi/sau obligaţiile comune de neproliferare;
c) stupefiantelor, substanţelor psihotrope şi precursorilor;
d) obiectelor de artă şi antichitate care au o valoare istorică, culturală sau arheologică semnificativă;
e) substanţelor toxice, materialelor radioactive, precum şi altor mărfuri şi substanţe periculoase pentru mediul înconjurător şi sănătate;
f) mărfurilor supuse taxelor sau impozitelor înalte, în special băuturilor alcoolice şi produselor din tutun;
g) mărfurilor care încalcă drepturile de proprietate intelectuală.
Articolul 7
Livrare controlată
1. Autorităţile vamale, prin consimţământ reciproc şi fiecare conform competenţelor sale stabilite de legislaţia naţională, vor folosi livrarea controlată pentru a identifica persoanele implicate într-o încălcare. Atunci când o decizie privind utilizarea livrării controlate nu este de competenţa autorităţii vamale, aceasta va iniţia cooperarea cu autorităţile naţionale care deţin o astfel de competenţă sau va transfera cauza autorităţii respective.
2. Loturile ilicite de mărfuri ale căror livrare controlată este convenită pot, cu consimţământul autorităţilor naţionale competente, fi reţinute şi admise pentru deplasare ulterioară, cu mărfurile intacte sau îndepărtate şi confiscate sau înlocuite integral sau parţial.
3. Deciziile privind utilizarea livrării controlate urmează a fi luate în fiecare caz concret şi, dacă este necesar, luând în considerare aranjamentele şi înţelegerile financiare convenite între autorităţile naţionale competente.
4. Livrarea controlată nu trebuie să cauzeze un pericol semnificativ pentru viaţa, sănătatea sau libertatea oricărei persoane sau orice pericol semnificativ de prejudiciere extensivă a mediului, proprietăţii sau a bunurilor.
Articolul 8
Forma şi conţinutul solicitărilor de asistenţă
1. Solicitările, în temeiul prezentului Acord, vor fi perfectate în scris. Acestea vor fi însoţite de documentele necesare pentru a permite satisfacerea solicitării. Atunci când este necesar, din cauza urgenţei situaţiei, solicitările verbale pot fi acceptate, însă trebuie confirmate imediat în scris.
2. Solicitările, conform alineatului 1 din prezentul articol, vor include următoarea informaţie:
a) autoritatea vamală care perfectează solicitarea;
b) măsurile solicitate;
c) obiectul şi motivul cererii;
d) legile, regulile şi alte elemente juridice implicate;
e) date cât mai exacte şi cuprinzătoare cu privire la persoanele care simt ţinta investigaţiilor;
f) un rezumat al faptelor relevante şi al investigaţiilor deja efectuate, cu excepţia cazurilor prevăzute la articolul 9.
3. Solicitările de asistenţă vor fi transmise în limba engleză.
4. în cazul în care o solicitare nu îndeplineşte căinţele formale, poate fi cerută corectarea sau completarea acesteia; măsurile de precauţie privind obiectele solicitării pot fi totuşi dispuse.
Articolul 9
Notificarea documentelor
1. La solicitarea autorităţii vamale a unei Părţi Contractante, autoritatea vamală a celeilalte Părţi Contractante va notifica persoanelor interesate, domiciliate sau stabilite pe teritoriul statului său, documentele referitoare la măsurile şi deciziile luate de către autorităţile administrative în aplicarea legislaţiei vamale.
2. Notificarea documentelor se va face în conformitate cu legislaţia în vigoare pe teritoriul statului Părţii Contractante solicitate. De asemenea, notificarea documentelor poate fi efectuată şi după o formă sau o metodă specială conţinută în solicitare, cu condiţia ca aceasta să nu fie considerată contrară legislaţiei statului Părţii Contractante solicitate.
3. Dovada notificării poate lua forma unei confirmări datate şi semnate privind primirea de către persoana interesată sau a unui certificat al autorităţii competente din statul Părţii Contractante solicitate, indicând metoda şi data notificării.
Articolul 10
Investigaţii
1. În cazul în care o autoritate vamală le solicită, cealaltă autoritate vamală va iniţia investigaţii privind operaţiunile care sunt sau par a fi contrare legislaţiei vamale în vigoare pe teritoriul statului autorităţii vamale solicitante şi va comunica rezultatele acestor investigaţii autorităţii vamale solicitante.
2. Aceste investigaţii se vor desfăşura în conformitate cu legislaţia în vigoare pe teritoriul statului autorităţii vamale solicitate. Autoritatea vamală solicitată va proceda ca şi cum ar acţiona în numele său propriu.
3. La solicitare scrisă, funcţionarii special desemnaţi de către autoritatea vamală solicitantă, cu autorizarea autorităţii vamale solicitate şi în funcţie de condiţiile pe care aceasta din urmă le poate impune, în scopul investigării unei încălcări a legislaţiei vamale, pot:
a) obţine din oficiile autorităţii vamale solicitate informaţia cu privire la această încălcare a legislaţiei vamale;
b) fi prezenţi în timpul unei investigaţii efectuate de autoritatea vamală solicitată pe teritoriul statului Părţii Contractante solicitate şi relevante pentru autoritatea vamală solicitantă.
Articolul 11
Dosare şi documente
1. Autoritatea vamală a unei Părţile Contractante, din propria iniţiativă sau la solicitare, va furniza autorităţii vamale a celeilalte Părţi Contractante rapoarte, înscrisuri sau copii certificate ale documentelor care oferă toată informaţia disponibilă cu privire la tranzacţiile, realizate sau planificate, care constituie sau par a constitui o încălcare a legislaţiei vamale în vigoare pe teritoriul statului acelei Părţi Contractante.
2. Documentele prevăzute în prezentul Acord pot fi înlocuite cu informaţie computerizată prezentată sub orice formă în acelaşi scop. Toate materialele relevante pentru interpretarea sau folosirea informaţiei şi documentelor trebuie furnizate în acelaşi timp.
3. Dosarele şi documentele în original vor fi solicitate doar în cazurile în care copiile certificate vor fi insuficiente.
4. Dosarele şi documentele în original primite în temeiul prezentului Acord vor fi returnate în cel mai scurt timp posibil.
Articolul 12
Experţi şi martori
1. La solicitarea unei Părţi Contractante în legătură cu o încălcare a legislaţiei vamale, autoritatea vamală solicitată poate autoriza funcţionarii săi, când este posibil, să depună mărturii în faţa autorităţilor competente ale Părţii Contractante solicitante în calitate experţi sau martori în ceea ce priveşte faptele stabilite de către aceştia în timpul exercitării atribuţiilor lor oficiale şi să prezinte probe. O astfel de solicitare trebuie să indice în mod clar în ce cauză şi în ce calitate urmează a fi audiat funcţionarul.
2. Acceptând solicitarea, autoritatea vamală specifică exact în autorizaţia eliberată, dacă s-a solicitat, limitele în care oficialii săi pot depune mărturii.
Articolul 13
Aranjamente pentru funcţionarii vizitatori
În cazurile când, în circumstanţele prevăzute de prezentul Acord, funcţionarii autorităţii vamale a unei Părţi Contractante sunt prezenţi pe teritoriul statului celeilalte Părţi Contractante, aceştia în orice moment trebuie să poată confirma statutul lor oficial. Ei nu trebuie să fie în uniformă şi nici să poarte arme.
Articolul 14
Folosirea informaţiei şi documentelor
1. Informaţia, documentele şi alte comunicări obţinute vor fi folosite în scopurile prezentului Acord şi pot fi folosite în alte scopuri doar cu acordul prealabil scris al autorităţii vamale care a furnizat informaţia şi va fi supusă restricţiilor stabilite de către această autoritate. Aceste prevederi nu se aplică informaţiei, documentelor şi altor comunicări privind încălcările referitoare la stupefiante şi substanţe psihotrope. O astfel de informaţie poate fi comunicată altor autorităţi implicate direct în combaterea traficului ilicit de stupefiante şi substanţe psihotrope.
2. Orice informaţie comunicată sub orice formă, în temeiul prezentului Acord, va fi de natură confidenţială. Aceasta va fi protejată prin obligaţia de păstrare a secretului oficial şi va beneficia de protecţia acordată aceluiaşi tip de informaţie şi documente conform legislaţiei în vigoare pe teritoriul statului Părţii Contractante care le-a primit.
3. Alineatul 1 al prezentului Articol nu va împiedica folosirea informaţiei în orice procese judiciare sau administrative intentate ulterior pentru nerespectarea legislaţiei vamale.
Articolul 15
Protecţia şi folosirea datelor cu caracter personal
1. În conformitate cu legislaţia în vigoare pe teritoriile statelor Părţilor Contractante, protecţia datelor cu caracter personal, schimbul căruia se va efectua în temeiul prezentului Acord, va fi supusă cel puţin următoarelor condiţii:
a) fără a aduce atingere dispoziţiilor articolului 3, datele cu caracter personal nu se vor transmite, ori de câte ori există motive întemeiate să se considere că transferul sau folosirea datelor transmise ar fi contrare legislaţiei statului uneia dintre Părţile Contractante şi, în special, legislaţiei privind protecţia datelor. Această cerinţă nu poate fi ignorată şi în cazurile în care transmiterea datelor poate fi considerată că provoacă inconvenienţe persoanei vizate. La solicitare, autoritatea vamală destinatară, va informa autoritatea vamală care furnizează informaţia despre folosirea acesteia şi rezultatele obţinute;
b) datele cu caracter personal pot fi transmise doar autorităţilor vamale şi altor autorităţi de aplicare a legii şi, în caz de necesitate în scopuri de urmărire, autorităţilor de urmărire şi judiciare. Această informaţie nu va fi comunicată altor persoane decât celor care au solicitat s-o folosească în aceste scopuri, cu excepţia cazurilor în care autorităţile care furnizează informaţia sunt de acord în fiecare caz în parte şi legislaţia care reglementează activitatea autorităţilor care primesc informaţia, permite o astfel de comunicare;
c) autoritatea vamală solicitată trebuie să verifice valabilitatea şi corectitudinea datelor cu caracter personal care urmează a fi prezentate. Autoritatea vamală care transmite datele va asigura că acestea sunt corecte şi actualizate. Autoritatea vamală solicitantă va corecta, distruge sau şterge datele cu caracter personal, în cazul în care acest lucru este solicitat;
d) autoritatea vamală solicitată, împreună cu datele cu caracter personal, va furniza informaţia cu privire la termenul limită necesar pentru ştergerea datelor conform legislaţiei sale proprii. Datele cu caracter personal vor fi păstrate pentru o perioadă care nu depăşeşte perioada necesară în scopul pentru care a fost comunicată;
e) autorităţile vamale vor ţine un registru al datelor cu caracter personal prezentate sau primite şi vor proteja eficient orice date cu caracter personal împotriva accesului, modificării, publicării, deteriorării sau distrugerii neautorizate.
2. Părţile Contractante se vor notifica reciproc cu privire la autoritatea naţională competentă căreia i se pot transmite solicitări privind protecţia datelor cu caracter personal.
Articolul 16
Folosirea informaţiei şi documentelor în calitate de probe
1. Autorităţile vamale, în conformitate cu scopurile şi în cadrul domeniului de aplicare al prezentului Acord, pot folosi informaţia şi documente obţinute în conformitate cu prezentul Acord în calitate de probe în înscrisurile, rapoartele şi mărturiile lor, precum şi în cadrul proceselor judiciare.
2. Folosirea acestor informaţii şi documente drept probe în instanţele de judecată şi valoarea probatorie anexată vor fi stabilite în conformitate cu legislaţia naţională a Părţilor Contractante.
Articolul 17
Excepţii de la obligaţia de a acorda asistenţă
1. În cazul în care autoritatea vamală solicitată a unei Părţi Contractante consideră că acordarea asistenţei solicitate ar prejudicia suveranitatea, securitatea, ordinea publică sau alte interese esenţiale ale statului Părţi Contractante solicitate sau ar implica o încălcare a unui secret industrial, comercial sau profesional sau ar fi contrară principiilor de bază ale sistemului său juridic naţional, acesta poate refuza să ofere asistenţă sau o poate acorda parţial sau sub rezerva anumitor condiţii sau cerinţe.
2. În cazul în care autoritatea vamală solicitantă nu ar fi în măsură să satisfacă o solicitare similară dacă ar fi fost făcută de către autoritatea vamală solicitată, aceasta va atrage atenţia asupra acestui fapt în solicitarea sa. Satisfacerea unei astfel de solicitări va fi la discreţia autorităţii vamale solicitate.
3. Asistenţa poate fi amânată de către autoritatea vamală solicitată pe motiv că aceasta va împiedica o investigaţie, urmărire sau dezbatere judiciară demarată. Intr-un astfel de caz, autoritatea vamală solicitată va consulta autoritatea vamală solicitantă pentru a determina dacă asistenţa poate fi acordată sub rezerva unor condiţii pe care autoritatea vamală solicitată le poate cere.
4. Autorităţile vamale se vor notifica reciproc atunci când asistenţa este refuzată sau amânată, precizând motivele refuzului sau amânării.
Articolul 18
Cheltuieli
1. Autorităţile vamale vor renunţa la toate pretenţiile de rambursare a cheltuielilor rezultate din implementarea prezentului Acord, cu excepţia cheltuielilor şi a diurnelor plătite experţilor şi martorilor, precum şi a cheltuielilor pentru translatori şi interpreţi, care nu sunt funcţionari publici, care vor fi suportate de autoritatea vamală solicitantă.
2. În cazul în care cheltuielile de natură substanţială şi extraordinară sunt sau vor fi necesare pentru a executa solicitarea, Părţile Contractante se vor consulta pentru a stabili termenii şi condiţiile în care solicitarea va fi executată, precum şi modul în care vor fi suportate cheltuielile.
Articolul 19
Complementaritate
Fără a aduce atingere articolelor 14 şi 15, prezentul Acord nu va afecta dispoziţiile Uniunii Europene care reglementează comunicarea între serviciile competente ale Comisiei Uniunii Europene şi autorităţile vamale alei Republicii Finlanda a oricărei informaţii obţinute în domeniul vamal, care ar putea să prezinte interes pentru Uniunea Europeană.
Articolul 20
Implementarea Acordului
1. Asistenţa, în temeiul prezentului Acord, va fi acordată direct între autorităţile vamale ale Părţilor Contractante.
2. Autorităţile vamale vor decide asupra aranjamentelor detaliate pentru facilitarea implementării prezentului Acord.
3. Autorităţile vamale pot lua măsuri, astfel încât funcţionarii lor responsabili de investigarea sau contracararea încălcărilor legislaţiei vamale să menţină relaţii personale şi directe, în conformitate cu procedurile administrative interne ale acestora.
4. Toate subiectele discutabile legate de implementarea şi interpretarea prezentului Acord vor fi soluţionate prin negocieri între autorităţile vamale ale Părţilor Contractante. Conflictele pentru care nu se găsesc soluţii amiabile vor fi soluţionate prin canale diplomatice.
5. Informaţia menţionată în prezentul Acord va fi comunicată funcţionarilor special desemnaţi în acest scop de către fiecare autoritate vamală.
Articolul 21
Aplicarea teritorială
Prezentul Acord va fi aplicabil pe teritoriul vamal al Republicii Moldova şi pe teritoriul vamal al Republicii Finlanda.
Articolul 22
Modificări şi completări
Cu acordul reciproc al Părţilor Contractante, în prezentul Acord pot fi introduse orice modificări şi completări perfectate în protocoale separate, care vor fi parte integrantă a prezentului Acord. Aceste protocoale vor intra în vigoare în conformitate cu procedura descrisă la articolul 23 din prezentul Acord.
Articolul 23
Intrarea în vigoare şi denunţarea
1. Părţile Contractante se vor notifica reciproc prin canale diplomatice când vor fi îndeplinite toate procedurile legale naţionale necesare pentru intrarea în vigoare a prezentului Acord. Acordul va intra în vigoare peste şaizeci de zile după primirea ultimei notificări.
2. Prezentul Acord se încheie pentru o perioadă nelimitată. Orice Parte Contractantă poate denunţa Acordul printr-o notificare scrisă prin canale diplomatice.
3. Denunţarea va intra în vigoare la expirarea a şase luni după primirea unei asemenea notificări de către cealaltă Parte Contractantă.
4. Procedurile în derulare în momentul denunţării vor fi finalizate, pe cât posibil, în conformitate cu dispoziţiile prezentului Acord.
Drept confirmare, subsemnaţii, fiind împuterniciţi în modul cuvenit pentru acest scop, au semnat prezentul Acord.
Întocmit la 11 martie 2020 la Helsinki în două exemplare originale, fiecare în limba română, finlandeză şi engleză, toate textele fiind egal autentice. În cazul divergenţelor de interpretare, textul în limba engleză va fi de referinţă.

AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA AND
THE GOVERNMENT OF THE REPUBLIC OF FINLAND ON MUTUAL ASSISTANCE
AND COOPERATION IN CUSTOMS MATTERS
The Government of the Republic of Moldova and the Government of the Republic of Finland hereafter referred to as the Contracting Parties,
Considering that violations of customs laws are prejudicial to their economic, commercial, fiscal, social, cultural, industrial and agricultural interests;
Convinced that actions against violations of customs laws can be rendered more effective by close co-operation between their customs authorities;
Considering the importance of accurate assessment of customs duties and taxes collected at importation or exportation and of ensuring proper enforcement of measures of prohibition, restriction and control, the latter including those on the enforcement of the law and regulations on counterfeit goods and registered trade-marks;
Considering that illicit trafficking in arms, ammunition, explosives, poisonous substances, radioactive materials, narcotic drugs and psychotropic substances represents a danger for public health and society;
Taking into account the threat of transnational organized crime and terrorist groups with their substantial resources and the need to effectively combat them;
Having regard to the Association Agreement between the Republic of Moldova, of the one part, and the European Union and the European Atomic Energy Community and their Member States, of the other part, signed in Brussels on 27 June 2014;
Taking into account the United Nations Convention against Transnational Organized Crime, adopted in New York on 15 November 2000, which lays down a framework for international mutual assistance in criminal matters with a view to preventing and combating transnational organized crime;
Having regard to the provisions of the Single Convention on Narcotic Drugs of 1961, as amended, and the Convention on Psychotropic substances of 1971, as amended, drawn up under the auspices of the United Nations Organisation as well as the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances of 1988 and its Annex, as amended;
Having regard also to the relevant instruments of the Customs Co-operation Council, in particular the Recommendation on mutual administrative assistance of 5 December 1953;
Have agreed as follows:
Article 1
Definitions
For the purposes of this Agreement:
a) "customs laws" shall mean any legal or regulatory provisions applicable by the customs authorities of the Contracting Parties in connection with the importation, exportation, transit, storage and circulation of goods, including means of payment, whether relating to customs duties, taxes or other charges levied or controlled by the customs authorities, or to measures of prohibition, restriction or control;
b) "customs authority" shall mean the Customs Service for the Republic of Moldova, and the Finnish Customs for the Republic of Finland, competent for the enforcement of the provisions referred to in paragraph a) of this Article;
c) "violation of customs laws" shall mean any breach or attempted breach of customs laws;
d) "customs duties and taxes" shall mean customs duties and all other duties, taxes and charges which are collected on or in connection with the importation or exportation of goods but not including fees and charges which are limited in amount to the approximate costs of services rendered, including for the Republic of Finland, the duties and taxes as set forth by the competent bodies of the European Union;
e) "person" shall mean any natural or legal person, unless the context otherwise requires;
f) "personal data" shall mean any information relating to an identified or identifiable individual;
g) "narcotic drugs" shall mean any substance, natural or synthetic, in Schedules I and II of the Single Convention on Narcotic Drugs, 1961, as amended, as well as any substance assimilated to narcotic drugs in national legislation;
h) "psychotropic substances" shall mean any substance, natural or synthetic, or any natural material in Schedules I, II, III and IV of the Convention on Psychotropic Substances, 1971, as amended, as well as any substance assimilated to psychotropic substances in national legislation;
i) "precursors" shall mean chemical substances listed in the Annex to the 1988 United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, as amended.
j) "controlled delivery" shall mean the technique of allowing illicit consignments to pass out of, through or into the territories of the states of the Contracting Parties with the knowledge and under supervision of their competent authorities, with a view to detecting and identifying persons involved in violations of customs laws;
k) "requesting customs authority" shall mean the customs authority of the Contracting Party which requests assistance in customs matters;
l) "requested customs authority" shall mean the customs authority of the Contracting Party from which assistance in customs matters is requested.
Article 2
Scope of the Agreement
1. The Contracting Parties shall, through their customs authorities and in accordance with the provisions set out in this Agreement, afford each other assistance:
a) in order to ensure that customs laws are properly followed;
b) in order to prevent, investigate and prosecute any violation of customs laws;
c) in cases concerning delivery/notification of documents regarding application of customs laws.
2. Assistance within the framework of this Agreement shall be rendered in accordance with the
legislation in force in the territory of the state of the requested Contracting Party and within the competence and available resources of the requested customs authority. If necessary, the requested customs authority can arrange for assistance to be provided by another competent authority.
3. This Agreement does not provide for the recovery of customs duties, taxes and any other charges.
4. This Agreement shall not affect the application of international agreements on legal assistance in criminal matters or international agreements on customs co-operation into which the Contracting Parties have entered.
Article 3
Scope of assistance
1. In the context of the legal and regulatory provisions, the customs authorities of the Contracting Parties will exchange any information - upon request and after prior investigation if needed - enabling them to ensure the correct collection of customs duties and taxes, especially the information that facilitates:
a) the determination of dutiable value, the tariff classification and the origin of goods;
b) the enforcement of the provisions concerning prohibitions, restrictions and controls.
2. On request, the requested customs authority shall provide all information about the customs laws and procedures applicable in the state of die requested Contracting Party, which are relevant to enquiries relating to a violation of customs laws.
3. The customs authorities shall provide each other, either on request or on their own initiative, with information and documents, which help to ensure proper application of customs laws and the prevention, investigation and repression of violations of customs laws.
4. Either customs authority shall, in making inquiries on behalf of the other customs authority, act as if they were being made on its own account or at the request of another authority in the state of the requested Contracting Party.
5. In case the requested customs authority is not the appropriate agency to comply with the request, it shall promptly transmit it to the appropriate agency and seek the co-operation of that , agency.
Article 4
Instances of assistance
The customs authorities shall, on their own initiative or upon request, supply to each other the following information:
a) whether goods imported into the territory of the state of one of the Contracting Parties have been lawfully exported from the territory of the state of the other Contracting Party, and the customs procedure if any, under which the goods have been placed;
b) whether goods exported from the territory of the state of one of the Contracting Parties have been lawfully imported into the territory of the state of the other Contracting Party and the customs procedure, if any, under which the goods have been placed.
c) whether goods which are granted favourable treatment upon exportation from the territory of the state of one Contracting Party have been duly imported into the territory of the state of the other Contracting Party, it being understood that information shall also be provided on any customs control measures to which they have been subjected.
Article 5
Special surveillance
1. On request the requested customs authority shall provide information on, and maintain special surveillance over:
a) persons known to the requesting customs authority to have committed a violation of customs laws or suspected of doing so, particularly those moving into and out of the territory of the state of the requested Contracting Party;
b) movements of goods notified by the requesting customs authority as giving rise to suspected illicit traffic towards the territory of the state of the requesting Contracting Party;
c) means of transport suspected by the requesting customs authority of being used to commit violations of customs laws in force in the territory of the state of either Contracting Party;
d) places used for storing goods which are suspected by the requesting customs authority of being used to commit violations of customs laws in force in the territory of the state of either Contracting Party.
2. Within their competence, the customs authorities of the Contracting Parties shall prevent:
a) the exportation of goods which are known to be or, on reasonable grounds, suspected of being exported into the territory of the state of the other Contracting Party to be used for other purposes than in the legitimate trade between the Contracting Parties;
b) the exportation of goods the importation of which is forbidden into the territory of the state of the other Contracting Party.
Article 6
Action against illicit traffic of goods of special importance
The customs authorities shall, on their own initiative or upon request and without delay, supply to each other all relevant information on activities, completed or planned, which constitute or appear to constitute a violation of the customs laws in force in the territory of the state of one of the Contracting Parties especially in the field of movement of:
a) arms, ammunition and explosives;
b) sensitive and strategic goods subject to control in accordance with the international treaties concerned and the relevant multilateral arrangements or regimes and/or concurring non-proliferation obligations;
c) narcotic drugs, psychotropic substances and precursors;
d) objects of art and antiquity which are of significant historical, cultural or archaeological value;
e) poisonous substances, radioactive materials as well as other goods and substances dangerous to environment or health;
f) goods subject to high duties or taxes, in particular, alcoholic beverages and tobacco products;
g) goods infringing Intellectual Property Rights.
Article 7
Controlled delivery
1. The customs authorities shall, by mutual consent and each within its competence determined by national legislation, use controlled delivery in order to identify persons involved in a crime. When a decision on the use of controlled delivery is not within the competence of the customs authority, it shall initiate co-operation with national authorities having such competence or transfer the case to that authority.
2. Illicit consignments whose controlled delivery is agreed to may, with the consent of the competent national authorities, be intercepted and allowed to continue with the goods intact or removed and seized or replaced in whole or in part
3. Decisions concerning the use of controlled delivery are to be taken on a case-by-case basis, and may if necessary take into account financial arrangements and understandings between the competent national authorities.
4. Controlled delivery must not cause significant danger to the life, health or freedom of any person, or any significant danger of extensive damage to the environment, to property or to assets.
Article 8
Form and substance of requests for assistance
1. Requests pursuant to this Agreement shall be made in writing. They shall be accompanied by the documents necessary to enable compliance with the request. When required, because of the urgency of the situation, oral requests may be accepted, but must be confirmed in writing immediately.
2. Requests pursuant to paragraph 1 of this Article shall include the following information:
a) the customs authority making the request;
b) the measures requested;
c) the object of and the reason for the request;
d) the laws, rules and other legal elements involved;
e) indications as exact and comprehensive as possible on the persons who are the target of the investigations;
f) a summary of the relevant facts and of die inquiries already carried out, except in cases provided for in Article 9.
3. Requests for assistance shall be submitted in the English language.
4. If a request does not meet formal requirements, its correction or completion may be demanded; precautionary measures concerning the objects of the request may, however, be ordered.
Article 9
Notification of documents
1. At the request of the customs authority of one Contracting Party, the customs authority of the other Contracting Party shall notify the persons concerned, residing or established in the territory of its state, of documents relating to measures and decisions taken by the administrative authorities in application of customs laws.
2. Notification of documents shall be made in accordance with the legislation in force in the territory of the state of the requested Contracting Party. Notification of documents may, however, also be made following a particular form or method contained in the request provided that this is not to be considered to be contrary to the laws of the state of the requested Contracting Party.
3. Evidence of notification may take the form of a dated and signed acknowledgement of receipt by the person concerned or of a certificate of the competent authority in the state of the requested Contracting Party, indicating the method and date of the notification.
Article 10
Inquiries
1. If one customs authority so requests, the other customs authority shall initiate inquiries concerning operations which are, or appear to be, contrary to the customs laws in force in the territory of the state of the requesting customs authority, and it shall communicate the results of such inquiries to the requesting customs authority.
2. These inquiries shall be conducted under the laws in force in the territory of the state of the requested customs authority. The requested customs authority shall proceed as if it were acting on its own account.
3. On written request, the officials specially designated by the requesting customs authority may, with the authorization of the requested customs authority and subject to conditions the latter may impose, for the purpose of investigating a violation of customs laws:
a) obtain from the offices of the requested customs authority information in respect of that violation of customs laws;
b) be present during an inquiry conducted by the requested customs authority in the territory of the state of the requested Contracting Party and relevant to the requesting customs authority.
Article 11
Files and documents
1. The customs authority of one Contracting Party shall, on its own initiative or upon request supply to the customs authority of the other Contracting Party reports, records of evidence or certified copies of documents giving all available information on transactions, completed or planned, which constitute or appear to constitute a violation of the customs laws in force in the territory of the state of that Contracting Party.
2. The documents provided for in this Agreement, may be replaced by computerized information produced in any form for the same purpose. All relevant materials for the interpretation or utilization of the information and documents should be supplied at the same time.
3. Original files and documents shall be requested only in cases where certified copies would be insufficient.
4. Original files and documents received under this Agreement shall be returned at the earliest opportunity.
Article 12
Experts and witnesses
1. Upon request of a Contracting Party in connection with a violation of customs laws, the requested customs authority may authorize its officials, whenever possible, to testify before the competent authorities of the requesting Contracting Party as experts or witnesses regarding facts established by them in the course of their official duties and to produce evidence. The request for the appearance must clearly indicate in what case and in what capacity the official is to appear.
2. The customs authority accepting the request states precisely, if required, in the authorization issued, the limits within which its officials may testify.
Article 13
Arrangements for visiting officials
When, in the circumstances provided by this Agreement, officials of the customs authority of one Contracting Party are present in the territory of the state of the other Contracting Party, they must at all times be able to furnish proof of their official capacity. They must not be in uniform nor carry arms.
Article 14
Use of information and documents
1. Information, documents and other communications obtained shall be used for the purposes of this Agreement and may be used for other purposes only with prior written consent of the customs authority which furnished the information and shall be subject to any restrictions laid down by that authority. These provisions are not applicable to information, documents and other communications concerning crimes relating to narcotic drugs and psychotropic substances. Such information may be communicated to other authorities directly involved in combating illicit trafficking in narcotic drugs and psychotropic substances.
2. Any information communicated in whatever form pursuant to this Agreement shall be of confidential nature. It shall be covered by the obligation of official secrecy and shall enjoy the protection extended to the same kind of information and documents under the legislation in force in the territory of the state of the Contracting Party which received it.
3. Paragraph 1 of this Article shall not impede the use of information in any judicial or administrative proceedings subsequently instituted for failure to comply with customs laws.
Article 15
Protection and use of personal data
1. In accordance with the legislation in force in the territories of the states of the Contracting Parties the protection of personal data exchanged under this Agreement shall be subject at least to the following conditions:
a) notwithstanding the provisions of Article 3, personal data shall not be transmitted whenever there are reasonable grounds to believe that the transfer or the use made of the data transmitted would be contrary to the law of one of the Contracting Parties, and legislation on data protection in particular. Nor can this requirement be ignored in cases where the transmission of data cannot be deemed to cause inconvenience to the person concerned. Upon request, the receiving customs authority shall inform the furnishing customs authority of the use made of the information supplied and of the results achieved;
b) personal data may only be transmitted to customs authorities and other law enforcement authorities, and in the case of need for prosecution purposes, to public prosecution and judicial authorities. Such information shall not be communicated to persons other than those required to use it for such purposes unless the authorities supplying the information agree case-by-case and the law governing the activity of the receiving authorities allows such communication;
c) the requested customs authority must ascertain the validity and correctness of the personal data to be submitted. The customs authority which transmits data shall ensure that they are accurate and up-to-date. The requesting customs authority shall correct destroy or delete the personal data, if so required;
d) the requested customs authority shall together with the personal data provide information on the required deadline for data deletion according to its own legislation. Personal data shall be kept for a period not exceeding that necessary for the purpose for which they were communicated;
e) the customs authorities shall keep a register on personal data submitted or received and effectively protect any personal data against unauthorised access, modification, publication, damage or destruction.
2. The Contracting Parties shall notify each other of the competent national authority to which inquiries concerning protection of personal data can be addressed.
Article 16
Use as evidence of information and documents
1. The customs authorities may, in accordance with the purposes and within the scope of this Agreement, in their records of evidence, reports and testimonies, and in proceedings brought before courts, use as evidence information and documents obtained in accordance with this Agreement.
2. The use made of such information and documents as evidence in courts and the weight to be attached thereto shall be determined in accordance with the national legislation of the Contracting Parties.
Article 17
Exceptions to the obligation to provide assistance
1. If the requested customs authority considers that compliance with the assistance requested would be prejudicial to the sovereignty, security, public order or other essential interests of the state of the requested Contracting Party, or would involve a violation of an industrial, commercial or professional secret or would be contrary to the basic principles of its domestic legal system, it may refuse to provide assistance, or provide it partly or provide it subject to certain conditions or requirements.
2. If the requesting customs authority would be unable to comply if a similar request were made by the requested customs authority, it shall draw attention to that fact in its request. Compliance with such a request shall be at the discretion of the requested customs authority.
3. Assistance may be postponed by the requested customs authority on the grounds that it will interfere with an ongoing investigation, prosecution or proceeding. In such a case the requested customs authority shall consult the requesting customs authority to determine if assistance can be given subject to such terms or conditions as the requested customs authority may require.
4. The customs authorities shall notify each other where assistance is denied or postponed, specifying the reasons for the denial or postponement
Article 18
Costs
1. The customs authorities shall waive all claims for reimbursement of costs incurred in the execution of this Agreement except for expenses and allowances paid to experts and to witnesses as well as costs of translators and interpreters other than Government employees, which shall be borne by the requesting customs authority.
2. If expenses of a substantial and extraordinary nature are or will be required to execute the request the Contracting Parties shall consult to determine the terms and conditions under which the request will be executed, as well as the manner in which the costs shall be borne.
Article 19
Complementarity
Without prejudice to Articles 14 and 15, this Agreement shall not prejudice the European Union provisions governing the communication between the competent services of the Commission of the European Union and the customs authorities of the Republic of Finland of any information obtained in customs matters, which could be of the European Union interest.
Article 20
Implementation of the Agreement
1. Assistance under this Agreement shall be exchanged directly between the customs authorities of the Contracting Parties.
2. The customs authorities shall decide on detailed arrangements to facilitate the implementation of this Agreement.
3. The customs authorities may take measures so that their officials responsible for the investigation or repression of violations of customs laws maintain personal and direct relations with each other in accordance with their internal administrative procedures.
4. All disputable issues connected with implementation and interpretation of this Agreement shall i be solved through negotiations between the customs authorities of the Contracting Parties. Conflicts for which no amicable solutions are found shall be settled through diplomatic channels.
5. The information referred to in this Agreement shall be communicated to officials who are specially designated for this purpose by each customs authority.
Article 21
Territorial application
This Agreement shall be applicable to the customs territory of the Republic of Moldova and to the customs territory of the Republic of Finland.
Article 22
Additions and amendments
Upon mutual consent of the Contracting Parties any additions and amendments formalized in separate Protocols, which will be an integral part of this Agreement, may be introduced to this Agreement Such Protocols will enter into force according to the procedure described in Article 23 of this Agreement.
Article 23
Entry into force and termination
1. The Contracting Parties shall notify each other through diplomatic channels when all necessary national legal requirements for the entry into force of this Agreement have been fulfilled. The Agreement shall enter into force sixty days after the last notification has been received.
2. This Agreement is concluded to be of unlimited duration. Either Contracting Party may terminate it by a written notice through diplomatic channels.
3. The termination shall take effect upon expiry of six months after such a notice has been received by the other Contracting Party.
4. Ongoing proceedings at the time of termination shall, as far as possible, be completed in accordance with the provisions of this Agreement.
In witness whereof the undersigned representatives, duly authorised thereto, have signed this Agreement.
Done at Helsinki on 11 marty 2020 in two originals, each in the Romanian, Finnish and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
